Divorce is likely the most legally difficult and emotionally wrenching experiences a couple can go through, but it doesn't have to be that way. A recent survey of the American Academy of Matrimonial Lawyers indicates that 58% of the lawyers responding said they are seeing more cases resolved without going to trial. Another recent study by the Institute for Marriage and Public Policy notes that a number of states have engaged in various legislative efforts to "reform" no-fault laws. This program is a practice-oriented roundup on the state of divorce law today, and relies on expert practitioners to talk about what approaches are making the process easier and mistakes lawyers make in this difficult area of practice.<img src="http://feeds.feedburner.com/~r/abacle2/~4/316393413" height="1" width="1"/>

Our faculty will highlight some of the rapidly evolving issues in business litigation that were practically nonexistent when the first edition was published in 1998 such as e-discovery, litigation technology, techniques for streamlining and expediting litigation, case evaluation, and civility. Five of the 199 leading litigators and federal judges who wrote chapters will discuss key developments in their areas of practice: Barry Barnett, Michael Keating, Hon. Shira Scheindlin, Louis Solomon and David Boies The program will focus on the increasing importance of technology in commercial litigation, along with the efforts of courts and business clients to manage litigation more efficiently and proactively. Like the treatise, the program will provide litigation strategies and practical guidance.<img src="http://feeds.feedburner.com/~r/abacle2/~4/305393913" height="1" width="1"/>

Outer Space Law Blasts Off (Audio Download)

<itunes:author>American Bar Association</itunes:author>
<itunes:summary>Outer space is a frontier of the law along with science and exploration. But as the commercial use of space grows and as governments rely increasingly on satellite technology for surveillance and other purposes, the issues facing lawyers in the private and public sectors are increasing—and increasingly complex. Some of those issues relate to privacy concerns, treaty and jurisdictional regimes, contracts and regulations, and electronic communications. Sooner rather than later, these issues will affect a growing number of earth-bound lawyers and their clients. This audio program will give attorneys an early heads-up on issues that may soon be landing right in their laps.

The Counter Revolution in Patent Law (Audio Download)

<itunes:author>American Bar Association</itunes:author>
<itunes:summary>For the past 25 years, Congress and the courts have strengthened the rights of patent holders. But now there are widespread concerns that the law has gone too far in protecting those rights to the detriment of economic growth and innovation in the United States. As a result, the pendulum is starting to swing back. In its last three terms, the U.S. Supreme Court has issued rulings that cut back on the rights of patent holders and even the Court of Appeals for the Federal Circuit—once the champion of patent rights—has begun changing direction. Congress is working on legislation that would bring profound changes to patent law. This audio program will look at how patent law got to where it is today, how that pendulum is swinging back and what the ramifications will be for lawyers who concentrate on patent law as well as lawyers who advise businesses generally.

Employment Law Goes Overtime

<itunes:author>American Bar Association</itunes:author>
<itunes:summary>Businesses are looking for ways to control the activities of their employees when they're away from the workplace. Businesses say they're just trying to hold down medical costs by regulating the personal habits of employees on such things as smoking, drinking, and eating. Other developments include efforts to control employee blogging and other electronic communications, romantic behavior, and even activities like volunteer work and serving on boards. In recent cases, a good number of these regulations have been upheld. The line is out there someplace, and both sides are trying to push it as far as possible in the direction that most serves their interests. What rules should be followed in this evolving environment and what advice can lawyers give to both employers and employees? This downloadable audio program looks at what employers are trying to do, how workers have been resisting, and who seems to be winning the legal battle.
