A Turn of the Century Lynching that Launched 100 Years of Federalism (Audio Download)

This is the story of Noah Parden's historic and heroic appellate representation of a young black man wrongly convicted of murder in Chattanooga, TN in 1906. The case had the first federal habeas petition from a state criminal case to the U.S. Supreme Court after the state court refused to intervene. When local officials and a mob took the law into their own hands in opposition to the Supreme Court’s stay of execution, the U.S. Attorney General, at the instruction of the Supreme Court, arrested the local sheriff, six deputies, and the leaders of the mob. This led to the only criminal trial ever held in the history of the US Supreme Court. This story is a reminder of what it means to be a lawyer. Famed trial lawyer Michael Tigar claims that Parden is the father of the modern day federal habeas practice. The story is also a reminder of the importance for the rule of law, which was significantly in jeopardy throughout the South in 1906. It shines a light on a politically motivated judge who was up for re-election, and who issued rulings to appease local citizens. This exemplifies the need for zealous advocacy, even when the client is unpopular. Finally, and most importantly, this is a story that shows how two unknown lawyers can make a difference.

More than 3.3 million homes went into foreclosure in 2007 and 2008—about 5 percent of the mortgage loans in the U.S. Many experts expect 3 million more homes to go into foreclosure in 2009 alone. Additionally, some banks have estimated that it is possible that up to 16 percent of all residential mortgages will go through foreclosure during the next four years. This crisis situation has led to a number of private and government-sponsored loan modification initiatives. But the early programs have had little success in reducing homeowners’ monthly payments and keeping people in their homes. Recently the Obama administration has instituted a new program for beleaguered homeowners facing foreclosure that tries to rectify some of the issues of previous initiatives, but the jury is still out on whether or not the program will be more effective than earlier ones.

The real estate market continues to crash. But, since few experts think it has yet to hit bottom, there appears to be more bad news in store for both sellers and buyers of real estate. But, while much of the debate over the issue has concerned broad policy, the impact at ground level also has been significant. This program will assess the legal aspects of the real estate crisis, especially the litigation it has spawned and the legal matters lawyers are handling for clients who are buying, selling, or just trying to hang on to property. Topics will include the spike in foreclosure work (something many people thought was a relic of the Great Depression) and how lawyers are adapting provisions of the recent federal legislation revising bankruptcy law to the current situation. The program also will assess what role, if any, lawyers should have in advising clients on mortgage financing issues and will examine continuing concerns over fraud in the mortgage area.

Divorce is likely the most legally difficult and emotionally wrenching experiences a couple can go through, but it doesn't have to be that way. A recent survey of the American Academy of Matrimonial Lawyers indicates that 58% of the lawyers responding said they are seeing more cases resolved without going to trial. Another recent study by the Institute for Marriage and Public Policy notes that a number of states have engaged in various legislative efforts to "reform" no-fault laws. This program is a practice-oriented roundup on the state of divorce law today, and relies on expert practitioners to talk about what approaches are making the process easier and mistakes lawyers make in this difficult area of practice.

Our faculty will highlight some of the rapidly evolving issues in business litigation that were practically nonexistent when the first edition was published in 1998 such as e-discovery, litigation technology, techniques for streamlining and expediting litigation, case evaluation, and civility. Five of the 199 leading litigators and federal judges who wrote chapters will discuss key developments in their areas of practice: Barry Barnett, Michael Keating, Hon. Shira Scheindlin, Louis Solomon and David Boies The program will focus on the increasing importance of technology in commercial litigation, along with the efforts of courts and business clients to manage litigation more efficiently and proactively.
