Q & A: What Does "HARD" Proof of Funds mean ?

Many Buyers are looking to purchase distressed property as the Spring market brings out NEW inventory of REO's and Short Sales. Many are trying to secure the winning bid with an ALL CASH purchase or with a LARGE down payment using an Investor or Conventional Loan.

Many of these clients must wait 15 (fifteen) days before they can even submit an offer as many banks are trying to give First Time Homebuyers and/or Returning Homeowners the first opportunity to secure a contract on these houses.

I know that many of my Investor client ask me to package an offer together on the off chance that there won;t be any bids from owner occupants. Then once the 15 (fifteen) days have passed , they have me submit the offer according to the Listing agents instructions.

When preparing an offer that is all "CASH" or has a "LARGE" down payment the mortgage company will request the agent to verify the funds that the buyer is using to purchase the property. These funds are called HARD PROOF OF FUNDS and they can come in several accepted formats as noted below.

Current Bank Statement - Checking or Savings
Money Market Fund , Self Directed IRA
A dated statement from the Purchaser's bank on letterhead signed by the Branch Manager with the financial information noted.

All of these "HARD PROOF OF FUNDS" must of course have the same name on them as the name of the purchaser on the contract offer. The other rule of thumb that a buyer agent should be aware of and inform their client of is that the statements can not be more than 30 (Thirty) days old , and is some cases no more than 14 (Fourteen) days old.

Due to these restrictions you would want to inform the buyer to send you another set of updated financial statements as the mortgage company may not always respond and.or accept the contract before the HARD PROOF OF FUNDS are older than 30(Thirty) days old

Q & A: How can I have PMI removed from my current mortgage ?

Know your rights for canceling PMI on your original mortgage or refi

Under certain circumstances, having sufficient home equity isn't enough.

Traditionally, lenders take the position that if you have at least 20 percent equity in your home, that is sufficient security. But what if you get a loan of 90 or even 95 percent of the purchase price? Then, lenders want insurance to pay them for any loss if there is a foreclosure. If you obtain an FHA or a VA loan, you pay the government for this insurance; otherwise, your lender arranges for private mortgage insurance, and you have to pay for this, usually on a monthly basis.

Over the years, this insurance was abused. Homeowners were unable to get this PMI canceled, despite having more than adequate equity. Accordingly, in 1999, Congress enacted the Homeowners Protection Act, also known as the PMI Cancellation Act.

The act applies primarily to residential mortgage loans, and includes single-family homes, condominiums and cooperatives. The requirements of the law vary depending on whether your loan is a high risk (as defined by your lender in the case of a nonconforming loan) or a conforming loan by Fannie Mae or Freddie Mac.

If your loan balance hits 80 percent of the original value when you first obtained the loan and you ask your lender to terminate the insurance, the lender must comply. And in your case that relates back to your refinance loan, not your original loan.

And when your loan to value drops down to 78 percent, cancellation of the insurance is automatic.

However, the lender is not obligated to accept your request for termination if you have a second mortgage or you have had late payments for 30 days or more during the year before you request the cancellation.

If your loan was under Fannie or Freddie, you have the right to terminate after two years if the loan balance is no more than 75 percent of the current appraised value, and after five years if it is no more than 80 percent. Note that I used the words "current appraised value." This is different and generally more favorable to homeowners because where homes do appreciate, you will be able to reach the termination percentages faster.

You may have to obtain and pay for an appraisal or your lender may have a local Realtor contact you to condust a BPO (Broker Price Opinion) to provide a less formal valuation of the property. Make sure your lender approves of the appraiser you plan to use; otherwise, you will have to pay another appraiser for the same task.

To Buy or Not To Buy......... That is the question !

In today's tumultuous housing market many prospective homebuyers are forced to make some hard decisions in regards to their living space. There is no doubt that the downward spiral of house values since 2008 have made many choose to wait out this market until house values improve. The funny thing about that is there is never a "Warning" sign that the market has "Hit the Bottom" or "Gone through the Roof". It appears to just happen , similar to something "Hitting a Brick Wall".

Many buyers I have met lately are looking to enter the housing market due to several factors such as: relocation, lease term ending, downsizing, move-up as well as financial recovery. But , they all have one thing in common...... they question if prices are going to keep dropping. They don't want to make an offer on a home and then by the time they settle have the value drop right after they move in. This may have been the case if they purchased a regular resale from 2008 to 2010.

The following market trends as of May 2012 are showing an increase in prices, but these are still fairly restricted to various neighborhoods within the region. If you add the increase of homes prices, be they resale, foreclosures or short sales with the fact that more permits for new construction have been issued since 2008 ,the answer is prices are trending upwards.

Factor in the lowest mortgage interest rates that I have ever seen in twenty years , it appears to be the perfect storm for those that are looking to purchase. If the consumer confidence continues to grow even marginally , this may be enough to “Bump up” those interest rates. Buyers will loose their purchase power if this happens and add that a neighborhood and/or community that sees a marginal increase in price and the Buyer has just lost out on the opportunity to move in to their “Dream” house.

Continuing to rent by extending their lease another year , or waiting to take advantage of their companies Relocation package until the last minute may cost them thousands of dollars up front or in monthly payments.

Based on the information that has been available this month , what are today’s buyers looking for ? They should put on their raincoats , grab their umbrella’s and start looking at houses now while before the storm passes.
