SAACPP AGM – 31 May 2011

SAACPP, South’s AGM will be held on the 31st May 2011. The venue is still to be confirmed.
Nomination forms have been e-mailed, but if you haven’t received these, please contact Louis. The Committee is to consist of a chairman, a vice-charman, the retiring chairman, 4 committee members and additional members may be co-opted. “Member” in terms of the constitution is a firm and a firm (or a specific representative) may be nominated.
The Constitution indicates that prior to the date on which nominations for the election of committee members are sent to the members of a Region, the existing Committee shall designate from amongst its members persons who will, after the next annual general meeting, hold the offices of chairman, vice-chairman and secretary (and treasurer) for the succeeding session. Unfortunately the previous committee meeting was only attended by 4 firms and therefore not all positions have been filled. Thank you to Quintus Thom who will be our secretary and Mauritz van deer Heever who will be our treasure

DRAFT SPATIAL PLANNING AND LAND USE MANAGEMENT BILL, 2011

The Department of Rural Development and Land Reform has published the DRAFT SPATIAL PLANNING AND LAND USE MANAGEMENT BILL, 2011 (Government Gazette, 6 May 2011, No.34270, NOTICE 280 OF 2011.
Attached hereto please find a copy of the said publication. A copy will also be placed on the SACPLAN as well as the SAACPP Websites.
The Department of Rural Development and Land Reform invites any interested person or body to provide comments on the Draft Spatial Planning and Land Use Management Bill, 2011.
The Bill will replace the Development Facilitation Act, No 67 of 1995, Removal of Restrictions Act, No 84 of 1967, the Physical Planning Act, No 88 of 1967 and other laws. The Bill will impact on all national, provincial and pre-1994 pieces of legislation on land use management and land development.
The objects of the Bill are to-
a) provide for a uniform, effective, efficient and integrated regulatory framework for spatial planning, land use and land use management in a manner that promotes the principles of co-operative government and public interest;
b) provide for and determine development principles, compulsory norms and standards for land use management;
c) maintain essential standards for land use management, spatial development and land use;
d) promote co-operative governance; socio-economic benefits; sustainable and efficient use of land; establish planning tribunals; and redress the imbalances of the past and ensure that there is equity in land use and land use management.

REVIEW OF THE PROVINCIAL SPATIAL DEVELOPMENT FRAMEWORK, 2009

Subsequent to the approval of the Western Cape Provincial Spatial Development Framework (PSDF) as a Structure Plan in terms of Section 4(6) of the Land Use Planning Ordinance, 1985 (Ordinance 15 of 1985) on 24 June 2009, the Department of Environmental Affairs and Development Planning (DEA&DP) committed to initiate the review and update the PSDF in 2011.
In view of the importance of the PSDF and to ensure that it stays a relevant spatial planning policy document, it needs to be reviewed and updated at least every five years.
As important administrators of the PSDF, your Municipality/Institution is requested to respond to the request of the Department for comments and inputs on the content of the document.
The aim of the Department is to improve the existing document. Previous comments and internal discussions revealed that uncertainty exist regarding some aspects discussed in the PSDF. Some uncertainties existed in the interpretation of certain sections and criticism was received on the content thereof. In addition, more constitutional information has come to light concerning the distinction between Provincial and Municipal planning and it

is clear that the PSDF addresses some issues of Municipal planning. The latter will have to be excised.
A clear motivation for the suggested amendment must be provided including the recommended phrasing.
The period for comment will end on Thursday, 30 June 2011. All comments must be forwarded to dalene.groenewald@pgwc.gov.za. Repeal of obsolete planning policies – City of Cape Town

To update its Land Use Management System and streamline its decision making process, the City of Cape Town has undertaken a planning policy rationalisation exercise and intends to repeal obsolete policies. Such policies mostly deal with local area issues and have been superseded by newer policies or are no longer relevant.
