ARDA & ARDA-ROC Government Affairs Insider 3rd Edition

As our ongoing commitment to keeping timeshare owners up to date on legislation and news affecting the timeshare vacation industry, following you will find a copy of the 3rd edition of ARDA and ARDA-ROC’s digital publication – Goverment Affairs Insider.

Arizona
ARDA-Arizona will hold its 12th Annual Legislative Breakfast for members of the Arizona House and Senate as well as their staff on Thursday, March 1, 2012 in the Parlor of the Arizona Capitol Museum in Phoenix.

On February 9, ARDA-Arizona supported expedited filing bill, HB 2195, unanimously passed the Arizona House and moved to the Senate. HB 2195 was amended in the House Commerce Committee on February 1, and the bill’s sponsor, Representative Weiers, submitted a small clean-up amendment on the House floor to clarify some confusing language. Under the bill, developers could choose to have most timeshare amendments processed within 15 business days—or 30 calendar days if six or more component sites were added to a registration.

Florida
CS/CS/HB 1001, also known as Florida’s Timeshare Resale Accountability Act, passed the House Judiciary Committee by a unanimous vote on February 8, and will now head to its final committee (House Economic Affairs) before being heard on the House floor. Its Senate companion CS/SB 1408 is still waiting to be heard in the Senate Budget Committee. Both bills have been amended to include ARDA-supported provisions.

Utah
HB 191, legislation that includes revisions to the Utah Timeshare and Camp Resort Act, was heard and approved in the House Business and Labor Committee on February 8. The timeshare provisions address a number of issues of interest to both ARDA and ARDA-ROC, including protections for personal information of owners and updates to general timeshare definitions in the Act. Agreement has been reached on additional issues, which should be amended when the bill reaches the House floor. The bill is expected to be heard this week.

Colorado
HB 1116, resale legislation sought by ARDA and ARDA-ROC, was heard in the House Economic and Business Development Committee. HB 1116 would require disclosures for all resale services and prohibit advance fees for resale transfer services. The Committee took testimony from the industry, timeshare consumers, and timeshare association management professionals. The Committee’s response was favorable, though a vote has been postponed until the completion of the amendment process. The bill is expected to be taken up again this week.

Virginia
ARDA-ROC is actively lobbying on behalf of two bills supported by the Virginia Resort Development Association (VRDA). HB 233 contains consumer-friendly timeshare resale provisions. It passed the Housing Subcommittee and the General Laws Committee late last week. HB 234 contains provisions that would make it easier for an HOA to advertise the availability of timeshare interests at foreclosure sale. It passed both the Housing Subcommittee and the General Laws Committee late last week.
