The debate rested largely on whether or not legislation was necessary or if Council President Bruce Hawkins should simply put the practice back on the agenda.

One News Now: He believes these incidents keep occurring throughout the country because school officials are afraid some parents will complain about their children receiving literature with religious content. Meanwhile, birthday party invitations are allowed. "That is not a constitutionally sound reason to say 'no' to religious speech," the attorney asserts. "It's called a heckler's veto. You can't restrict speech because somebody else doesn't like that speech." [more quote by Jeremy Tedesco]

U. of Virginia Law School: Though many critics have pegged the U.S. Supreme Court's First Amendment doctrine as incoherent, the court's opinions have long shown a definable pattern, argues University of Virginia law professor Leslie Kendrick in her latest article.
In "Content Discrimination Revisited," published in the April 2012 issue of the Virginia Law Review, Kendrick explains that the court's system for evaluating whether speech is legal under the First Amendment resembles its test for whether a law is discriminatory under the 14th Amendment's equal protection clause.

Christian Post: The U.S. Catholic Church will hold an event this summer called "Fortnight for Freedom" to bring attention to religious freedom issues. The Christian Post has learned that discussions are underway to include evangelical organizations with these events. Evangelical organizations have expressed solidarity with Catholic leaders who oppose the Obama administration's birth control mandate, which, they argue, is a religious freedom issue.

Baptist Press: Erik Stanley, senior legal counsel of the Alliance Defense Fund, said pastors in particular should not be afraid to speak biblically from the pulpit without fear of reprisal, even when their opinion is contrary to that of President Obama. "The fact that the pastor may be responding to a comment from the president doesn't make the biblical comments off-limits," Stanley said. The ADF campaigns against U.S. law that prohibits pastors from using the pulpit to oppose political candidates. "At ADF, we believe that restriction is unconstitutional," Stanley said. "Our point is that we should let the pastors and the churches of America debate what is wrong or right."
