The Hearing on Thursday starts at 8:00AM and is expected to last three hours.  Defendants Bonnie Stern and Lyndal Harrington or their respective representatives are each expected to face the judge to present an argument as to the reason the defendant should not be held in contempt for not turning in hard drives to Special Master Craig Ball when the Court first issued the order.  At the conclusion of the previous hearing in Houston’s 280th District Court, McCabe handed two documents to Judge Lindsay for her signature.  These were the motions to compel Misses Stern and Harrington to appear on Thursday, May 21.

Lyndal Harrington had first claimed her PC was destroyed when Hurricane Ike flooded her residence, but later discovered it was still operational.  Shortly thereafter, she claimed her PC was stolen during a break-in.  Mr. McCabe intends to prove the falsity of Miss Harrington’s claim by presenting in court a statement authored by the responding policeman which purports that the break-in appeared to the officer as having been staged to look like a burglary.

Bonnie Stern filed bankruptcy in California just prior to the deadline by which she was supposed to turn in her computer.  Because of the way the laws are written, the bankruptcy filing brought Virgie’s entire Texas State case to a halt.  In legal terms, Miss Stern’s bankruptcy filing placed a “stay” on Virgie’s case.  Because of the stay, Mr. McCabe’s legal pursuit to compel the defendants to abide by Court’s ruling with respect to producing their hard drives immediately drew to a halt.  However, McCabe went to California and filed a motion to Lift the Stay that Miss Stern caused.  His motion was heard and he won.  Stern appealed the Lifting of the Stay and the court struck her down without benefit of an argument from Mr. McCabe.

Bonnie Stern will still have to answer the Court when Judge Lindsay asks her why she shouldn’t be held in contempt for disobeying the court’s previous order demanding she turn in her PC.  McCabe may argue the surreptitious nature of the bankruptcy action by claiming it was nothing more than a delay tactic.

Most notably, Thursday’s appearance of Bonnie Stern and Lyndal Harrington appears to be the “one last chance” that Judge Lyndsay mentioned in last Friday’s hearing.  What lay ahead for Miss Stern and Miss Harrington will most assuredly depend on how convincing their arguments are to Judge Lindsay’s ears.  The hearing should be very interesting.

According tp the latest documents filed by Ms. Stern,  she will not apppear at the hearing. Also, the police officer in Lyndal Harrington’s part of the lawsuit will attend and testify at the May 21st hearing about the burglary Harrington alleges happened.

The Associated Press in Los Angeles reports that Howard K. Stern and Drs. Khristine Eroshevich and Sandeep Kapoor appeared this morning before Los Angeles Superior Court Commissioner Kristi Lousteau to enter pleas to felony charges that they conspired to provide prescription drugs to Anna Nicole Smith before her overdose death two years ago.  Stern and the two doctors stand accused of six felony counts, including prescribing, administering, and dispensing a controlled substance to an addict.

The commissioner did not give the defendants the opportunity to proclaim their pleas aloud—preferring rather to elicit the defendants’ pleas by asking if they would be pleading not guilty.  The defendants answered, “Yes.”

Prosecutors allege Stern was the principal enabler in a conspiracy to provide Smith thousands of prescription pills.  City Prosecutor Renee Rose entered a motion that required each defendant to provide a handwriting sample to compare with signatures written on alleged fraudulent prescription slips seized by authorities during a massive two-year investigation. The commissioner granted the motion, without objection, that each defendant is to provide law enforcement handwriting samples.

To curb the predicted media onrush to cover the case, Commissioner Lousteau signed a protective order to ensure that at least some information pertaining to the case remain private.  She ordered that a 1,400-page brief relating to the case not be available to the public because it contains information related to ongoing Smith-related cases in New York and Texas.

After the arraignment, Stern’s defense attorney, Steve Sidow, made another showing before the press.  He said he will not object to having Stern turn in handwriting samples because it will exonerate his client of the charge of writing fraudulent prescriptions.  “He isn’t a doctor,” Sadow said. “He isn’t signing prescriptions. He isn’t issuing prescriptions. Howard K. Stern didn’t commit a criminal act.”

During the Sidow’s previous press conference on March 12, the day Stern and Kapoor were formally charged, the defense attorney stated his belief that the charges against his client were “sensational lies, speculation, rumor and gossip.”  This morning, he reiterated his stance, adding that California Attorney General Jerry Brown’s purpose for bringing charges against Stern stemmed from Brown’s political aspirations. “He wants to be governor again,” Sidow said.

Commissioner Lousteau adjourned the arraignment after scheduling a June 8 court date to determine when a preliminary hearing in the case will begin.

The three defendants were each charged with six felony counts on March 12, after a lengthy investigation carried out by the District Attorney’s Office, the state Attorney General’s Office, the Drug Enforcement Administration, the California Medical Board and the state’s Department of Insurance.

If convicted, each faces a maximum of five years and eight months in state prison.

Howard K. Stern and Teresa Stephens must give their computers to Forensic Examiner  Craig Ball by 10 days after today’s order is signed. The order is expected to be signed by Monday.

Art Harris must give his hard drive to  Craig Ball by May 19. There are contempt and other sanctions possible if he does not comply or if he deleted anything from his computer.

Nelda Turner is given until May 22nd to produce what she has withheld.

Lyndal Harrington and Bonnie Stern are to appear in court on May 21 to show cause why they should not be held in contempt.  They were not present at today’s hearing and neither was Teresa Stephens.

Next court date is Monday at 3:00 pm on the proposed orders.

Judge Lindsay held a telephone conference today as a result of the emergency hearing filed by Howard K. Stern’s counsel Lin Wood.

Judge Lindsay will not hear the motion for sanctions. She said since it involves the recusal which was denied, the issue should be brought before Judge Underwood.

Tomorrow Judge Lindsay said she will hear the motion of Art Harris to “clarify” the order to turn over his computer. Also she will decide whether and when to hear the motions for contempt on Bonnie Stern, Art Harris, and Lyndal Harrington.

Judge Lindsay will also hear the motions to compel Howard K. Stern and Teresa Stephens and Nelda Turner to turn over their computers.

The Judge said she will not hear Teresa’s motions (injunction, whatever), because it has not been properly served to the required parties.

One more note;

Bonnie Stern’s motion for reconsideration has been DENIED by the California bankruptcy judge and this was done before McCabe could file any opposition.
