After a Divorce, Shared Parenting is Wanted

A Powerful demand from Men's Organisations

The men's organisations have tightened the belts in order to bring in and implement the "Shared Parenting" system in India which has already been successful in Western countries.

They have appealed to Women and Child Department (WCD) to obtain its help is remedying the situations where Even though the father may be of sound Financial and Mental health, in many divorce proceedings, the Indian rule of awarding custody of children to their father is being ignored and is showing lethargic attitude.

In Divorce Proceedings, while father and mother fight with each other, children are routinely ignored. Child knows that father and mother both love him or her equally, but court proceedings are so antagonistic against each other that both parents tend to overlook the needs of the child.

"In Indian Family Laws, During Separation, Mother is considered more important" says P.R.Gokul, a member from a voluntary organisation Called "Children Rights Initiative for Shared Parenting". Because of this only, even after a father is proved innocent, he only gets rights of visitation.

If for some reason, a father is not able to meet his children, the opposite party pollutes the mind of the child and changes outlook of the children towards their father. Because of this, the children are constantly trying to evaluate whether their father loves for them.

Besides this, problems faced by such father is not heard or considered properly.

Hence for those kids, whose parents are living in same city, let one of them take him from Monday to Friday and let another parent take him on Saturday and Sunday. In this manner, the child will not feel deprived from the father as well as the mother.

Options for such a Shared Parenting Arrangements must be considered.

A plea is made to Women and Child Department (WCD) to make Justice system of India to consider that during durations of holidays, guardians must spend equal portions of time with children And Instead of the current law where children less than five years of age live with mother, the child must be allowed to spend some with the father.

For further information on this, Kumar Jahagirdar from CRISP told Saamna that Women and Child Department has assured him that Shared Parenting Options is being considered.

It has been proven time and again that the children who only live with one of their natural parent as a result of divorce grow up to face many mental and social problems which affect their personality.

For this reason, "Shared Parenting" system currently being practised in western countries must be implemented for benefit of children from divorced parents must be able to obtain love from both parents.

"The fun really begins at the Immunity Task when the boys put their future generations at stake during the Ball Bursting quiz ;). Here, the girls get tested on their Hindi vocabulary - one mistake and the guys get it between their legs. " ........................

Thus goes the description for the latest Roadies episode in which young boys get whacked on their scrotum with a pole!, as girls answer a quiz which supposedly tests Hindi - our National language... television has touched a new low, an abysmal low just in the pursuit of TRPs, advocating mis-andry in the process.'

We should complain to ministry of Broadcasting and other watchdog bodies about this inhuman
and negatively influencing trend........ in general roadies inculcates hatred as a desired attitude and makes the format of their show a very 'dog eat dog' one... which is not at all a responsible thing to do.

Roadies is just riding by pandering to young peoples baser instincts of hatred, bitchiness, scheming and rudeness and such undesirable traits, we need to stop this immediately.

We may see people emulating these things on campus/ragging soon and god forbid we lose lives, even otherwise spreading a message that humiliating and paining others are "fun-stuff" is worse enough.

My comment to the "Roadies" production unit:

Hi raghu and other makers of roadies,

How did u all think that the "ball busting" task was an amusing thingto
do to enrich roadies?. It was the most barbaric thing i had seen on tv.
Had you guys assessed the physical risks and the negative effects the
"ball busting" task would have over the impresisonable target audience
Roadies commands?.

We at protect indian family demand a explanation and a public apology
from the production team of roadies, and would urge you to cease and
desist from incorporating such negative footage in future roadies
editions.

Is this Scrotum-Pole experience the meaning of "Roadies - hell down under? ", it better not be!, since we will react against such anti-social 'feeds' in the name of FUN.

Hi Raghu and others,It is very unfortunate that in the name of fun, all kinds of bodily harm is inflicted on the guys participating in it. Just because there is a lot of competition in the media, it doesn't mean that anything and everything can be performed or shown. Inflicting bodily harm or any kind of violence is a violation of Press Council of India norms and broadcasters norms. This is allowed to happen just because men are considered disposable creatures. Ball Bursting and Bobbitising (cutting the penis by women) are comicstuff for society. These were social norms even before 498a or DV came.Men are considered disposable and are emotionally castrated at age of7. If they become criminals and rapists, then they raise a hue and cry.Who gave the society the right to make men disposable?We did.Unless, we change the attitudes ourselves, and kick the society, thejudges and politicians will not change.]We have not change attitude of a million men in next 6 months throughmedia and bombardment in Internet.

Misandry, is a abuse of males based on gender. We have too many 'socially accepted' forms of misandry, that males need to be AWARE of. Males, unfortunately, do not speak up for themselves when they are abused. Here are a few examples of 'socially accepted' misandry :1. Circumcision in males2. Conscription of males without compensation for the years lost ( unlike in 'maternal leave' for females )3. Much more funding for breast cancer, as opposed to prostate cancer4. Ragging, etc.etc.This is also due to TV advertisements . - from domestic cleaning agents, to car insurance, to food, which all portray the male as the stupid moron, and the female as the one who provides a solution to his stupidity by using the product being advertised. This creates gender roles where women are the smart, cool, sophisticated and innocent gender, and men are the complacent, retarded, pathetic gender.Insentising people to the pain felt by males is deplorable. Such inhuman and negatively influencing trend has to be nipped in the bud........ in general "Roadies" inculcates hatred as a desired attitude and makes their format akin to 'dog eat dog'... which is not at all a responsible thing to do. Hi All,
Parental interference(it could be either side or even both sides, owing to the lack of understanding with respect to the actual intensity or manner of the conflict between the couple concerned!) either catalyses impending splits and obnoxious behaviour which follows(after the war is announced!) and even legal terrorism once they come to know that there is 'some' trouble between the couple.

Such 'some' trouble kind of situations existed even in earlier times, but they did not definitely crystalise into 'stymie' situations or even evoked extreme actions for either side, since earlier generations had the skill and diplomacy(or command of a head of the joint/united family, which in turn came from the respect this head earned vide the services and dedication rendered to ones family- respect has that way of manifesting, it can never bought or forced, its self-evoking/eliciting... and this is a oft-forgotten truth by modernists, the so called modern men and women), the other members of a joint family would act as vents, counselors, confidantes, sounding boards or whatever the situation of conflict might warrant, and the couple at conflict themselves had some strong value base which seldom let them disrupt the peace of the family.

This kind of "concern for the family" or 'WE" is slowly becoming non existent and its this factor which pushes the so called 'modern' couple who do not have anytime other than thinking about 'I' and 'My'... the value base too have eroded so much that their shell-like self is so brittle that such persons can only think of self-destructive ways to handle a situation of conflict.

Lack of values coupled with self-centeredness does them in... and they do not usually mend their ways even after hard times like a violent divorce which extends to years of negativity and trauma(resulting in profuse loss of peace, spirit, resources, etc., on one side)... these persons run into disruptive situations after disruptive and eroding situations.. finally they are totally 'spent' on their intrinsic goodness, and turn totally negative and starts acting against whoever comes in contact with them and thence the society at large.

Their negative vibes and examples of wrong doing sets off an unfortunate trend in conflict management, and a snowball effect in a definite perimeter around them, especially on the impressionable youngsters who grow up to believe that these are the only ways to handle conflicts.

Unless we try to address and rectify these undercurrents which finally leads to legal terrorism , we would only be getting at the surface of the 'rust' or 'rot', just painting the rusted surface will not ensure that the 'spread' can be stopped, it will surface from time to time, until we address these problem of moral degradation in a macro scale.

Back to basics is one word to describe the cure, while we do what we are currently doing, the touch-up or fire-fighting jobs(by way of fighting legal terrorists on the same token or on a different, but addressing legal terrorism as a piece-meal problem).

Think about this, may you be able to action some solutions around you, starting NOW.
Spread the message too.... Values, Values, and Values. values of honesty, of mutual respect, of Love, or Patience, of sharing, of caring, of courage, of physical endurance and mental serenity, of planting tress and rearing children, of Vasudeva Kudumbakam......

Parents contribute a lot to 498a female's behaviour and attitude.

Now, a Florida based counsellor has written about it and Deccan
Chronicle has reported it.

Till now, we never highlighted this as "No one will digest that
parents can contribute to Marriage break up." My guess shows that in
90% of cases the mother-in-law and father-in-law make the female file
498a.

SIF, the adverse and destructive advice by parents has led to breaking
of marriage and 498a.

Let us build momentum on this Thread.

We had done a press conference in Bangalore just yesterday. So, it may

But, activists in other cities can use this opportunity to show the
real side of "Girl's Parents".

Hi All,

The Black March went on better than expected, considering that it was held on the day of Danteras festival. Many of members chose to celebrate danteras and perfrom poojas at home in connection with the same, but my only argument in favour of their attending our events(even if they had to be conducted on the same day as festivals as this) is that "Seva is the best form of prayer". If u do not help others or even help yourselves by strengthening our movement, how can we hope to achieve anything any soon?

We had 30 plus members participating displaying the banners to the oncoming traffic , distributing pamphlets and engaging the media, etc. The highlight for media was the video clips of one of our members , which showed the wife beating him for more than 1 hour etc.

Let me keep a proposal to all of you. November 19th we are going to conduct a massive Bike AND Car Rally from Fort area(from Fountain area if we get premission, or any other visible area, Family court Bandra). The detailed program will be designed and informed to all of you within this week.

Please mark this date(NOVEMBER 19TH) on your calenders right away and apply for necessary leaves or make suitable arrangements(no exuces please), since we need atleast 50 bikes and 10 cars to make an impact in the dense mumbai traffic. First weekly meeting in western-suburbs of Mumbai- resolutions and action points, event calender ahead

I am glad(I am actually holding back my sheer elation) to announce the newly formed email distribution list of mumbai, now onwards u can reach the core-group of Mumbai(PIF, NGO) by mailing to a single maild, ie. mumbai (at) protectindianfamily (dot) org

This is the start of a quantum jump in Mumbai's activity levels. Yesterday in the first weekly meeting of the western line(Venue: Goregaon)We were discussing Mumbai's evolution in SIF history, although we were among the first movers to start SIF group activities(back in 2005 Sept 11th we had our first group meeting at Powai, blogged at http://indianhusbands.blogspot.com/2005/09/mumbai-meeting-no1.html ), mumbai was the first among the SIF brigades to conduct a seminar: http://at498a.blogspot.com/2006/08/legal-awareness-seminar-coping-with_18.html ), the first among innovative awareness programs : http://at498a.blogspot.com/2008/03/sif-presentation-at-15th-annual.html and http://at498a.blogspot.com/2007/09/peace-ride-on-bikes-around-bombay30th.html , etc. etc.

Even with these commendable firsts, the fact remained that these pockets of excellence were only possible due to a very few dedicated members, and given that their whole-hearted efforts coming out of the firm conviction that piece-meal solutions will not solve the critical problems of the opulation at large, nor will solving personal cases bring immunity to oneself in future(misuse of family laws are, by nature, multi-directional, counter-intuitive and even beyond regular estimation or risk-assesments). But like a chinese bamboo shoot we had been systematically growing our roots in mumbai without much fuss or notice by even close associates, now this chinese bamboo is ready to achieve phenomenal growth which is well within the capabilities of the well motivated group we have now in Mumbai(bamboos grow their roots first, and then after couple of years, grows leaps and bounds after it has spread its roots enough to ensure food-security and sustainability in growth and existence!).

With these thoughts I would like to invite your attention to watch Mumbai group(Protect Indian Family, NGO- For family harmony, against legal terrorism) and to prepare yourselves to get ready to be inspired.

Today we had the first meeting(weekly') in Goregaon(western line) and we have decided upon innvoative events, as well as the tested options like Dharna,Seminars, pls see the events as below

1) October 26th, 2008, 2nd Anniverssary of DV Act(Domestic Violence act)Black march: to mark this "Black Day for Indian families"
2) November 19th- Men's day, Bike/Car rally: 40 bikes and cars with PIF, Mumbai members and out station members
Optional-> Black(prominently) rangoli competitions , 2) Pamphlet distribution booths in V.T & Churchgate + family court(other courts worth which are worth it), other offices of state government,and 3) Candle march
3) 13th December - Dharna and memorandum/stats compiled as a folders andpresent to Home ministry. As a run-up to these events we can start distributing pamphlets as paper inserts, get news paper articles, etc, so that we can get maximum mileage out of every expense we incur.

My name is Ajay. I am based in Gwalior (Madhya Pradesh).I am a member of SIF family. Two years ago my wife left home in criminal conspiracy with her parents, and lodged false police complaint against me, my parents, sister and Brother-in-law at Mahila police Station.

In counselling at Police station nothing happened except that it was clearly established that she had lodged false complaint.Thereafter, she filed a number of cases against me including maintainance and custody of my two children. My children (daughter 11 years and son 5 years) appeared in court and clearly told Hon'ble Judge that they are living with their father and in future too would live with their father. The court granted interim custody in my favour.She filed appeal against family court interim order before Gwalior bench of M P High Court where after final hearing we are waiting for the judgement.

I will intimate as soon as it is delivered.The reason I am writing this blog is I have seen that most of the cases of D.V. are false, where men are being blackmailed by wives and theirparents. In my case too, my wife's brother is mentally upset and needs constant looking after and after her parents there is no one to take his care. To solve this problem my in wife presurrised me to live with her parents. When I refused she did the dirty work. There is one moretwist in the story, my wife also is a patient of epilepsy and vertigo. I have filed her medical record before the court. Plus she has studied only upto 12th standard. I am the only son of my parents who are both about 70 years old. In this age too when most people take to bed, they are looking after both my children.

To help my brothers I will search, load and provide links to judgements which will help us in getting justice. The readers too are requested to link their blogs and also submit links of the judgements delivered in our favour.

About the presentation/argumenting
tones and persona of our activists: We need to play the "Good Cop
& Bad Cop" routine in any public debate to achieve maximum
information absorption!. The bad cop will ridicule, use dark sarcasm, humour,
down right censure, etc., while the Good Cop(like Rajesh projected his
arguments) tells his mind with a cool, compassionate tone. The good cop will not
be able to cut the other parties arguments since his projected persona will not
allow being rude, but that’s where the bad cop comes in!, he can be rude,
point blank and on the face with his arguments and criticism. The good cops role
is to provide a shoulder for the tired opposition to rest their heads!(fighting
with the bad cop!) and while the opposition takes a breather the good cop
manipulates the oppositions’ opinions in his own way and set stage for the
opponent to finally yield!

Haven’t you guys met
these characters in real life?: like one traffic police acting tough and
being abusive, and then comes the good cop lovingly listening to ur view, and
slowly preparing you to part with your bribe money!(the yield in this example),
and the final push comes when the bad cop pounces from behind and rolls his
eyes- you part with a crisp 100 rupee(or even 500 if the couple performs their
routine well!). Its the same thing what we can emulate, like the generations
successfully have!.

This is the way police in
advanced countries break up a tough criminal too, without force, without even
touching the criminal/terrorist- this is the model which is ever green. So we
just have to assume the part we are comfi with. Swarup will always, better, be
the bad cop(since the other part doesn't suit him much), Virag is also naturally
inclined that way. For me any role which is vacant is ok(like a joker of
cards!).

If we understand this
analogy well, theres no chance in hell that we don't win debates, so internalise
this, consciously generate rage(but let not control you, you control it),
posture yourselves according to the strengths and weakness of the opposition -
go for the Jugular all the time, we have no time to waste!, too many opponents
to obliterate!.

What Rajesh is thinking is
already done, all the deans and colleagues of Huma have received what Virag and
me wrote in Huma's criticism(I hope she hasn't applied for long leave or even

Does this mean that the incidence of women
criminals are 4 times more inside Indian families than in the general
population!?

Or does this anomaly mean, RIGHTLY so,
that women protection laws like IPC 498a is grossly
misused, especially against women themselves. Indeed these laws are
misused by women criminals(who were termed as ‘Legal
Terrorists’ by supreme court(India) itself), the so called Wives,
who are just feigning victims, and are an insult to every woman.

498a& Dowry Act(3,4):more than 22%
arrested are women themselves - see the statistics(as available in the
NCRB sire, see links below) for women affected by IPC 498a and Dowry Death(IPC
304B).

3,90,397 persons(of which 87,830(22.5%) were women themselves!!!) were
arrested under Section 498A in 2004, 2005 & 2006 as per the data published
by the National Crime Research Bureau(NCRB).

So over 87,000 women also have been arrested without evidence or
investigation in case of IPC 498a cases, in three years(2004 to 2006) so its not
just a matter of Harrassed Men, its a clear case of Families in distress due to legal
terrorism.

Another point to note is that in IPC 498a and Dowry Deaths(304B) the
percentage of women arrested are more than 22% of the total number of people
arrested(compared to around 5.8% women in the total arrested in other crimes)

succumb to fear of false cases and end up loosing all their wealth in settling
this false case in addition to bearing the social stigma, ostracization and
trauma of false allegations.

Many Indian married men succumb to this ongoing Legal Terrorism in the name of
Women Empowerment as reflected in the suicide statistics prepared by National
Crime Records Bureau,

In 2005, 52, 483 and in 2006, 55, 452 married men committed suicide in India
as opposed to 28, 188 and 29, 869 married women for the same years
respectively.

Has this thought ever occurred to you as to why so many men are forced to

In our search for truth we have found enough evidences to state that the girl suicided on her own, and Demand of dowry was not its cause(inferring from the local Police(Sierra Leone police had closed this by confirming that it was a clear case if suicide not arising due to demand of dowry) reports and Witness statements).

The girl's(Preeti Raisighani) body is still in the mortuary(in Africa) even after 60 days of her death by suicide, since her relatives still want to investigate the truth(not accepting the local police's investigation report and conclusion of Suicide by self will).

The boy's family has now run out of money after paying heavily for the mortuary(refrigerated) expenses and lawyer/bail fees(the parents of the husband where in custody for around a month and had to approach HC, Mumbai, after their bail applications were rejected in District court and Sessions court), other incidental expenses(phone, courier, local expenses), etc.

The husband is now not in a position(financially in heavy debt, due to this false allegation on him , his brothers family and his senior citizen-parents!) to transport the body at his expense, and this was projected as "the husband demanded 15 lakhs from the deceased girl's parents, for release of the dead body!!!", whereas the husband in his telecon with the girl's parents just mentioned that it takes 15,000 local currency(Sierra Leone) to transport the body to India and that he is not in position to pay that much now that his financial position is negative(on loans now)).

If a woman commits suicide within seven years of her marriage, it cannot automatically be inferred that the incident was abetted by her husband and in-laws who had ill-treated her earlier, the Supreme Court has held.

"One of the circumstances which has to be considered by the court is whether the alleged cruelty was of such nature as was likely to drive the woman to commit suicide or cause grave injury or danger to life, limb or health of the woman," the bench said.
In the instant case, the deceased Shanti Bai had committed suicide by setting herself ablaze. The prosecution claimed that Shanti Bai had resorted to the extreme step as she was unable to bear the harassment by her in-laws.
On the basis of the evidence the trial court in Madhya Pradesh convicted the deceased's mother-in-law Munni Bai for abetting the suicide and sentenced her to three years RI, which was affirmed by the High Court, upon which she appealed in the apex court.
The apex court after perusal of various evidence and records noted that there was nothing on record to prove the prosecution's claim that the mother-in-law abetted the suicide of her daughter-in-law. Accordingly, it ordered her acquittal. — PTI

· NCW's recommendations to address "unnatural deaths" of married women are Unreasonable
In the interest of justice, fairness and equality to both genders, we, the members of Save family Foundation, Delhi, make the following recommendations:
• Section 304(B) should not be retained in the law; IPC Section 302 already covers murder andIPC Section 306 covers abetment of suicide, and therefore Section 304(B) is only a duplicationof law, which is gender-biased.
• All cases of murder, including murder for dowry should be dealt with under IPC Section 302.
• All cases of abetment of suicide, including those allegedly done for dowry, should be dealt withunder IPC Section 306.
• If IPC Section 304(B) is not removed from Indian law, then it should be amended and madeapplicable to men and women equally. Specifically, the word "husband/wife" should bereplaced by the word spouse.
• Section 304(B) treats the accused as guilty until proven innocent, thus, violating the UniversalDeclaration of Human Rights which proclaims that "everyone charged with a penal offence hasthe right to be presumed innocent until proved guilty". The law needs to be amended so that noarrests of any of the accused (man, woman or child) are made without proper investigation and Written approval of police officials of the rank of DCP or above.
• Those who misuse the section for settling personal scores should be heavily penalizedbecause false allegations and prosecution can cause irreparable damage to the accusedParties even if they are later declared not guilty.
Unnatural death "is a category used by coroners and vital statistics specialists for classifying all human deaths not properly describable as death by natural causes. Hence it would include events such as accident, execution, homicide, misadventure (being attacked by insects, reptiles, fishes, lions, tigers, bears, stingrays, or other wild animals), adverse outcome of surgery, suicide, terrorism, war."
Any person, male or female, married or unmarried, may die an unnatural death due to any of the above causes. Among these, homicide (murder) is the only cause which unambiguously qualifies as crime that can be committed by one person on another, and is already covered under IPC Section 302. It is, therefore, obvious that having a section specifically to deal with dowry murder is redundant, and only reflects gender bias. In addition to murder, abetment of suicide is also a crime and punishable under IPC Section 306 which addresses both male and female victims.
Therefore, once again, it is unnecessary to have duplications and special provisions in law like Section 304(B) and Section 498(A) to address suicides of women. Most cases recorded as "dowry death" involve women who died by accident or by committing suicide. Data from the National Crime Records Bureau indicates that there is no difference between the rate of suicide of married women and never married women. However, radical organizations like NCW would have us believe that every death of a married woman is a dowry death, without providing any justification for such presumption.
Recent data from the National Crime Records Bureau indicate that nearly twice as many married men, compared to married women, commit suicide every year, unable to withstand verbal, emotional, economic and physical abuse and legal harassment by their wives. While every death of a young married woman is converted into a case of dowry death leading to immediate arrest of the husband and in-laws, followed by a prompt media trial, large-scale suicides of men do not cause any outrage.
Gender obsessed women's activists also refuse to admit the fact that accidental deaths are also equally likely among men and women. Therefore, it has become routine for police to arrest the husband and his relatives and book them under several sections including, IPC 498A, 304B, and Dowry Prohibition Act, every time a woman's relatives claim that the deceased woman had been killed or driven to death/suicide for dowry.
This is the case even when there are suicide notes or dying declarations absolving everyone including the husband of any responsibility for the woman's suicide or death. There have even been instances where fake dowry death cases were registered and the "deceased" wife was found to be alive after the accused husband and in-laws were refused bail and imprisoned. While husbands and their relatives are under constant suspicion leading to frequent violation of their basic human rights, wives are rarely ever questioned leave alone prosecuted if a husband dies or ends his life under similar circumstances.

A journalist and a reputed tabloid like TOI is believed by everyone
and such news by you, overtly hyped, heavily biased, and unnecessarily
sensationalized are creating panic in the society that women are a
liability and people are rushing to abortion clinics to abort the girl
child either as an infant or a foetus. Such news from sexist people
like you are increasing female feoticide in India. You are the one
responsible for such hoaxes.

Why have you not printed the husband's side of the story? Why has the
news made it to print when he is behind bars and not in a position to
give a statement? Why did you not raise the contention that this
matter is subjudice and you cannot print it without taking the views
of both the parties?

You call yourself the champion of women's causes with such article,
are the mothers and sisters of husbands not women? This yellow
journalism by TOI is spreading poison in the society and creating a
gender divide which will ultimately lead to a social catastrophe. My
job is to create awareness and warn you before hand about it. Choice
is yours whether you want to ignore it or heed to it.

Nagpur Dharna was conducted on 27th July, 2008(11AM to 3 PM), at variety Square, Seetabuldi, Nagpur.

Dharna news reported on Tv, interspersed with Statistics, bitter realities, Opinions and some Music for inspiring the next revolution- Gender-Mafia.... Quit India!

This DHARNA was conducted for the demand of formation of "A MEN WELFARE MINISTRY " & to stop misuse of IPC 498(A), Domestic Violence Act (2006) and other misuse-prone women-protection laws(Dowry Prohibition Act, Sexual Harassment at Work place Act, etc ) by suitably amending them and by rectifying the flaws in their execution by the Police and Judiciary.

Dharna Report

We distributed around 10,000 pamphlets right at the venue(another 10,000 were distributed in the previous days). Since the venue was a junction of 5 roads(heart of the city) easily around 10,000 people were crossing the venue every hour noticing the banners and even reaching out for the banners from buses, rickshaws, pillions on bikes etc.

With 8 news papers publishing the news in quarter page size(on an average), and local TV channel airing a detailed report, the reach this first time Dharna at Nagpur attained was phenomenal.

While distributing pamphlets at the junction we interacted with a lot of passerby’s who seem to readily acknowledge that dowry based laws are misused a lot.

The only group of pamphlet recipients I had to really brief was a group of 12 year olds, to whom I had to say that they could ask their fathers to know what the pamphlet is about. But they also seemed to know the crux of the matter. Alas I had to leave them at that moment, letting them figure it out for themselves.

As usual in other parts of India, none of the Newspapers seems to have carried the help-line numbers. This is exactly why it becomes very important to print help-line numbers on each and every placard, banner, etc., in big fonts, so that the readers can make out these numbers from the photographs published(I remember Delhi has made this a regular practice, but it somehow skipped my mind at the planning stage).

Nagpur team will be following up the event with mailing the memorandum to authorities of State/Central legislature, Police, Judiciary etc. , these post dharna follow-up activities are very important since these will help in sensitising the system very effectively. Main authorities will be met in person both in Nagpur and Mumbai.

Yet another false dowry death accusation!

If you had followed how this news unfolded, you would have realised how the deceased girl's parents changed their statement(which they gave on national TV!) each day as more efidence against their accusations against the deceased girl's husband(alleging that his torture and divorce proceedings caused the suicide!, and hence he should be booked for dowry death and abbetting suicide, etc.- all these accusations for extorting money from the husband thus trapped under legal terrorism)

Whereas later it was evident, after due investigations , that the suicide was mainly due to some issues between her and her paramour and colleague(a pilot with the same airline where she was an air-hostess!)

This is a typical-false dowry death allegation.

The recent police circulars by Delhi Police, which are a relief from rampant misuse and shoddy implementation of law by police, also is being objected by Ms.Girija Vyas, while these circulars are following the various supreme court and state high court judgements and directions therein, as mentioned below

There are now 4 police circulars(3 in delhi and 1 in hyderabad) and one High court(Chennai) order which is on similar lines, and which insists that the Police do not arrest innocent husbands and their relatives on mere false complaints(alleging cruelty and harassment) by their vexatious wives, for oblique motives(money, control, vengeance, etc). These directives insist on an investigation before any arrests(this would be sounding ridiculous to many readers of non-Indian origin, but this is a fact of life for many Indians living in India and also abroad!)

This is apart from the 1994 SC judgement(Joginder Vs State of UP) and the allahadbad HC judgement giving more guidelines for arrest and investigation.

Further we witness the cases, even when the wife is alive, still the Husbands/husbands mother/sisters send behind the bar years together and after 2 or 3 years we witness the wife is alive and staying with other men. This clearly evident and expose beyond reasonable dought the loop hole of the law , which can be abused even when the wife is alive, then you can understand what can be happen when a women die in accident/suicide/Murder or any other illness.

Mansi, a little 4 years old girl was sitting on laps of her mother, confused but aware that her grandmother had died last night. Her grandmother Mrs. Sahay died after prolonged illness. Besides her husband Mr. Sahay, she left behind a joint family consisting of her three sons, three daughter-in-laws and half a dozen grandchildren. Mr. Sahay is a senior citizen retired from a white color top govt. post.

Suddenly mansi saw 3-4 persons in khaki, talking aggressively to her father and grandfather.
Mansi innocently asked her mother
"Mamma, are they Yamadutas?
If they are, aren't they making a mistake?
Why they are taking away grandpa, its the grandma who actually have died."

Her mother immidiately put a finger on mansi's mouth and whispered in her ear, "They are not Yamadutas my angle, they are policemen."

Police officer: Mr. sahay, you are under arrest on charges of section 304-B.

Mr. Sahay: But we have been married long back and there was not a single dispute in our whole married life. I have a big joint family and we are living happily.

Police officer: You all have to be arrested and the body of the deceased need to be sent for post mortem.

Mr. Sahay: What do you mean by all? She died a natural death.

Police officer: All means, all your sons and daughter-in-laws also.

Then he changed his tone to bollywood style policeman, "Main farz se majboor hun" (i am duty bound, i cant do anything). You all have to come with me, as by law, husband and all her relatives have to be presumed guilty for an offence of dowry death. Are they not your relatives?

Mr. Sahay: But officer, its more than 35 years since our marriage. Arrest, Why?

Police officer: "Kyonki Saas Bhee Kabhi To Bahu Thi", the officer promptly replied.

Thanks to _NCW_ for their proposal to remove the limit of 7 years on the presumptions in case of dowry death under section 304-B IPC and making it for complete lifetime of a woman.

anti-dowry legislation and the Domestic Violence Act are violative of
their fundamental rights. Their plea to scrap the legislation
prompted the ministry to review the Act.

While demanding dowry is a crime, even those agreeing to it from now
on may face a strict punishment. The law should be the same for both
the parties. There should be punishment for all those accepting and
giving dowry. Why should all those giving dowry be

considered innocent?, an official in the ministry told The Indian
Express.

The NCW, in its radical suggestions, has also asked for enhancing the
minimum punishment for the dowry-related cases. The ministry is also
likely to consider this.

The NCW has also suggested that a professional counselor talk to both
the parties rather than the police, which is not a competent
authority to deal with matrimonial discords.

Delhi, the capital of dowry deaths

According to the recent NCRB 2006 figures, dowry death figures in
Delhi reveal the dismal state of women in the city. According to the
figures there were 120 reported dowry deaths which occurred in 2006,
higher than other mega cities.

A 1997 report claimed that at least 5,000 women die each year because
of dowry deaths, and at least a dozen die each day in `kitchen
fires', thought to be intentional.

According to surveys, the epicentre of the problem of bride-burning
and other forms of dowry-related violence on women is Delhi, western
and central Uttar Pradesh (cities such as Kanpur, Lucknow, and Agra
have witnessed the highest number of deaths), and places adjoining
Delhi (Haryana, Rajasthan, Madhya Pradesh, and Punjab).

The other side of the picture

According to the National Crime Records Bureau (NCRB), more than
6,000 dowry related cases are registered on an average annually. Of
these cases, according to Save Family Foundation, an NGO, 65 per cent
of cases are reportedly false. The amendments in the Act are much
needed. During the suicide cases by wife the whole family is
immediately arrested. Though it is a different matter that every year
more men commit suicide then women. There is a dire need to balance
the law, says Swarup Sarkar, one of the founder members of Save
Family Foundation.

A FAIR TRIAL: This is being done to avoid increasing misuse of the anti-dowry law.

New Delhi: The Delhi government is following in Hyderabad’s footsteps with regard to arrests and probe in dowry cases.

This essentially means those accused of dowry harassment will be arrested only after a thorough probe.

The Delhi police chief says it has been done so as to avoid increasing misuse of the anti-dowry law, a trend acknowledged even by the apex court.

According to data available with support organisations, of the five lakh people arrested from 2003- 2006 in dowry-related offences, 80 per cent were acquitted by courts.

A computer professional – who spoke with CNN-IBN on conditions of anonymity – said he and his family were victimised by his wife in a fake dowry harassment case. While he spent three days in jail, he was lucky the police didn't arrest his family members, all of who had been named in the FIR.

Support groups like Rakshak were formed especially to help those men who have been wrongfully implicated under laws for the protection of women.

According to information received by them through various RTIs:
Till 2006, more than six lakh people were still facing trial for past cases.
More than five lakh were awaiting a trial in court.
The expected length of trial in dowry cases was almost eight years in the same year.

A dowry (also known as trousseau) is the money, goods, or estate that a woman brings to her husband in marriage.

The opposite direction, property given to the bride by the groom, is called dower or mahr. Normally the bride would be entitled to her dowry in event of her widowhood, prior to the evolution of her dower rights; so common was this that the terms "dowry" and "dower" are sometimes confused.

The dowry should not be confused with a bride price, money or goods paid by the prospective groom to the bride's parents in exchange for her hand in marriage.

In Homeric times, the usual Greek practice was to give a brideprice, and dowries were also exchanged in the later classical time (5th century BC). Ancient Romans also practiced dowry, though Tacitus notes that the Germanic tribes practiced the reverse custom of the dower.

Dowry was widely practiced in Europe at all times. In Victorian England, it was seen as an early payment of her inheritance, such that only daughters who had not received their dowry were entitled to part of the estate when their parents died, and if the couple died without children, the dowry was returned to the bride's family.

Failure to provide a customary, or agreed-upon, dowry could call off a marriage. William Shakespeare made use of this in King Lear: one of Cordelia's wooers ceases to woo her on hearing that King Lear will give her no dowry. And in Measure for Measure, Claudio and Juliet's premarital sex was brought about by their families' wrangling over dowry after the betrothal, and Angelo's motive for forswearing his betrothal with Mariana is the loss of her dowry at sea. Folklorists often interpret the fairy tale Cinderella as the competition between the stepmother and the stepdaughter for resources, which may include the need to provide a dowry. Gioacchino Rossinis opera La Cenerentola makes this economic basis explicit: Don Magnifico wishes to make his own daughters' dowry larger, to attract a grander match, which is impossible if he must provide a third dowry.

One common penalty for the kidnapping and rape of unmarried women was that the abductor or rapist had to provide the woman's dowry, which was until the late 20th century the wreath money, or the breach of promise.

Providing dowries for poor women was regarded as a form of charity. The custom of Christmas stockings springs from a legend of St. Nicholas, in which he threw gold in the stockings of three poor sisters, thus providing for their dowries. St. Elizabeth of Portugal and St. Martin de Porres were particularly noted for providing such dowries, and the Archconfraternity of the Annunciation, a Roman charity dedicated to providing dowries, received the entire estate of Pope Urban VII.

In some parts of Europe, land dowries were common. The Indian city of Mumbai(Bombay), which is one of the biggest cities in the world, was given as a dowry by the Portuguese crown to the British when H.M. Charles II King of England, Scotland and Ireland married Catherine of Braganza, a princess of Portugal in 1661.

In some cases, nuns would be required to bring a dowry when joining a convent.

In Europe and Western culture in general it is still common for the bride's family to pay for the majority of the wedding costs.

Report of Awareness program in front of Family court

On 7th June 2008 Protect Indian Family Foundation, NGO, Mumbai (Member of the Save Indian Family(SIF) Network), conducted an awareness program- ‘Effects of 498a, Dowry Act & Domestic Violence Act on Indian Families’.

This program was at the family court, bandra. 50 members in PIF T-shirts gathered and educated the people around family about the ill effects of misusing laws concerning families and also distributed pamphlets outlining these ill effects. The program details were communicated beforehand to the family court officials including the judges and the counsellors. Protect Indian family intends to continue such awareness programs in future too, especially since the high court of mumbai itself has been promoting such programs which could reduce disintegration of families and avoid wasteful litigation for all. Crores of rupees are wasted in the conduct of such litigations both in terms of juidical resources and public resources, apart from the weakening of the foundation of nation itself- The Family.

The present trend of wives filing false criminal cases, against their husbands and his family, at the drop of the hat(for reasons other than harassment and cruelty) is a very disturbing trend and is sure to affect India's progress itself in the long run. Progress of a country depends upon the level of wellness of its citizens, and if most of the citizens are entangled in trivial marital issues which are nevertheless catapulted into false but serious criminal cases, only god can save that nation!. The future of the nation, the children, are actually the prime affected in these unnecessary and ill-intentioned litigations there by sealing the fate of progress deep down the drains.

Misuse proportions are so overwhelming and flagrant that the Supreme court itself has termed this trend of misuse of women protection laws as 'Legal Terrorism', whereas this trend is actually fuelled by the breed of corrupt Police, indifferent Judiciary apart from the conniving and fire-starting advocates which prompts us to call it 'Sate Terrorism'!. Of course these laws are misused by the misusers themselves, but they find it easy to misuse since there is no fear of punishment even if the misuse is proved – They misuse the laws, because THEY CAN!.

The irony of all this is that women themselves are the targets of these misused women protection laws!(22% of all arrested in 498a IPC are women, compared to 5.8% average number of women arrested among the total in case of all other IPC sections. Source: National Crime Research Bureau)

Did you know that every year over 5 lakh persons are
harassed by the misuse of women-protection laws (IPC 498a, Domestic Violence
Act, Dowry Prohibition Act) – Please note that more than 22% of total arrested
are women themselves, and that more than 1.2 lakh women (over 5.3 lakh persons
in total) have been arrested since 2004 under IPC Section 498a (Source: National
Crime Research Bureau (NCRB). WOMEN THEMSELVES ARE VICTIMISED BY THE MISUSE
OF WOMEN-PROTECTION LAWS.

Are you being advised to misuse these laws just to make
the opposite party (husband and his family) submit to your terms and demands – Please note that
these laws are known as ‘Family Breaker laws’ and the persons who misuses
are termed as ‘Legal Terrorists’ by Supreme Court itself. There is no chance of
reuniting and leading a meaningful family life after anyone misuses these laws,
since trust, which is the basis and foundation block of a family, is lost. DO
NOT MISUSE LAWS CONCERNING FAMILY.

Whether you are a man or woman please realise that
fighting against misuse of laws concerning family is your duty, since these laws
only break families, puts individuals in distress for years together, and
promotes a fatherless society. We only need to look towards western societies,
where no one has benefited from laws like these, whereas violence has replaced
security and values inside their fatherless families, to know the worst effects
of destructive family laws like these.

If you have problems in your families, communicate with
each other or take assistance of counseling or elderly members of the family, do
not run to courts/police to settle scores. Making criminal offences out of
trivial family issues need to be resisted by all of us. We also urge the
legislation and government to curb the tendency of criminalization of trivial
family issues without even investigating
complaints.
