<p><em>If you started law school in fall 2023 or later, get ready for something completely different: the NextGen bar exam 2026. This isn&#8217;t just a small update to the current test—it&#8217;s a complete reimagining of how we assess whether new lawyers are ready to practice.</em></p>
<p><em>The National Conference of Bar Examiners has spent years developing this new exam through task forces, focus groups, and extensive evaluation. The goal? Create a more valid measure of the knowledge and skills new lawyers actually need. And we think that&#8217;s a really positive change.</em></p>
<p><span id="more-21676"></span></p>
<h2><strong>What Is the NextGen Bar Exam Replacing?</strong></h2>
<p>The NextGen bar exam will replace the Uniform Bar Exam (UBE), which has been around since 2011. The current UBE has three components: the Multistate Bar Exam (MBE) with 200 multiple-choice questions over two three-hour sessions, the Multistate Essay Exam (MEE) with six 30-minute essays, and the Multistate Performance Test (MPT) with two 90-minute tasks. That adds up to 12 hours of testing spread over two days.</p>
<p>Because almost all U.S. jurisdictions use at least some UBE components—39 states plus D.C. and the Virgin Islands use the full UBE—this change will affect bar exam preparation virtually everywhere except Louisiana and Puerto Rico.</p>
<h2><strong>Why Create a New Bar Exam?</strong></h2>
<p>The driving force behind NextGen is reducing the overwhelming amount of material tested while putting more emphasis on practical lawyering skills. Let&#8217;s be honest: memorization is the biggest hurdle to bar success for a lot of people. The current exam requires you to memorize massive amounts of picky details that, in practice, any competent lawyer would look up rather than rely on memory.</p>
<p>With NextGen, some legal information will actually be provided as part of the exam materials. You&#8217;ll still need to know the law, but you won&#8217;t have to memorize every single detail about, say, the number of days for responding to a pleading. Instead, the exam will focus on bigger core concepts and your ability to apply them.</p>
<h2><strong>What Subjects Made the Cut?</strong></h2>
<p>Here&#8217;s where things get interesting. The current UBE tests Civil Procedure, Constitutional Law, Contracts, Criminal Law and Procedure, Evidence, Real Property, and Torts in both multiple-choice and essay form. Then there are additional essay-only topics: Agency, Conflict of Laws, Corporations, Family Law, Partnerships, Secured Transactions, Trusts, and Wills.</p>
<p>The NextGen bar exam is slimming this down. The surviving subjects are basically the current MBE subjects plus Business Associations. So it’s Business Associations (Agency, Corporations, and Partnerships), Civil Procedure, Contracts, Constitutional Law, Criminal Law and Procedure, Evidence, Real Property, and Torts.</p>
<p><strong>What&#8217;s gone?</strong> Conflicts, Family Law, Secured Transactions, Trusts, and Wills won&#8217;t be tested anymore. There will also be reduced coverage within each surviving topic. <a href="https://www.ncbex.org/exams/nextgen">You should check the NCBE website for more detailed information on the Content Scope and Sourcebooks for the NextGen exam</a>.</p>
<p>The NCBE prioritized subjects based on how frequently they arise in entry-level practice, whether they&#8217;re relevant across multiple practice areas, and whether not knowing the topic would pose a significant risk of malpractice or poor client outcomes.</p>
<h2><strong>New Question Formats: &#8220;Integrated Question Sets&#8221;</strong></h2>
<p>This might be the most dramatic shift. The current exam separates question types—MBE is all multiple choice, MEE is all essays, MPT is legal writing tasks. NextGen introduces something called &#8220;<a href="https://barexamtoolbox.com/podcast-episode-327-facts-and-fears-around-the-integrated-question-sets-iqss-on-the-nextgen-bar-exam/">integrated question sets</a>.&#8221;</p>
<p>Here&#8217;s <a href="https://barexamtoolbox.com/podcast-episode-330-nextgen-ube-lets-walk-through-an-integrated-question-set-iqs-together/">how it works</a>: you&#8217;ll get a case file that raises legal questions and requires you to use foundational lawyering skills. For example, you might receive a file that includes a police report, a statute for assault and battery, and an excerpt from a case interpreting that statute. Then you&#8217;ll answer a series of questions about this scenario.</p>
<p>Some questions will be short written answers, like identifying a fact in the police report that would prove the &#8220;knowingly&#8221; element of the statute. Others might ask you to list ways to gather more evidence on a particular issue. And yes, there will still be some multiple-choice questions tied to the case file.</p>
<p>The scenario might even develop as you go. After answering the first set of questions, you could receive additional information—like a transcript of a witness interview—and then answer new questions based on this expanded file. The questions won&#8217;t be cumulative (so one wrong answer won&#8217;t cascade into more errors), but you&#8217;ll need to work through increasingly complex scenarios.</p>
<p>It&#8217;s essentially <a href="https://barexamtoolbox.com/podcast-episode-9-mastering-the-performance-test-w-doretta-mcginnis/">like the MPT</a> plus substantive knowledge. The MPT never required you to know the law beforehand because everything was in the materials. These new integrated question sets combine that practical, file-based approach with the need to know and apply legal rules.</p>
<h2><strong>Skills Beyond Memorization</strong></h2>
<p>The MPT already tests legal writing, issue-spotting, analysis, and some client counseling. NextGen keeps all of that but adds more practical skills: research, investigation and evaluation, negotiation and dispute resolution, and client relationship management.</p>
<p>If you&#8217;ve made it through law school, you&#8217;ve been developing these skills for three years. The bar prep period becomes about polishing and focusing them rather than learning entirely new capabilities.</p>
<h2><strong>When Does This Start?</strong></h2>
<p>Some jurisdictions will begin administering the NextGen bar exam in July 2026. First-year law students starting in fall 2023 will be the first cohort taking this new exam upon graduation (assuming they graduate in May 2026 and sit in July).</p>
<p>Here&#8217;s the tricky part: not all jurisdictions will switch at the same time. You can <a href="https://www.ncbex.org/exams/nextgen">check the NCBE website to see whether and when your target jurisdiction will be changing</a>.</p>
<p>One positive note: NextGen will maintain score portability, just like the UBE. However, questions remain about how UBE scores will transfer to NextGen jurisdictions during the transition, and vice versa.</p>
<h2><strong>How Will Bar Prep Change?</strong></h2>
<p>Some existing test prep materials will remain useful for reviewing substantive law, since the tested subjects are mostly the current MBE subjects plus Business Associations. There will just be less depth of coverage.</p>
<p>But the bar prep industry will need to generate completely new materials reflecting the integrated assessment format and the emphasis on skills. What those materials look like is anyone&#8217;s guess right now. Bar prep companies will need guidance from the NCBE—hopefully including released subject matter outlines and sample questions—before they can fully respond to this transition.</p>
<p>The good news? Materials generated for the MPT will retain some relevance. The whole idea of reading a case file and extracting information is very similar to these new integrated assessments. The difference is what you do with that information—instead of writing a memo or brief, you&#8217;ll answer specific questions about the file.</p>
<h2><strong>Is This Actually Better?</strong></h2>
<p>Yes, we think it&#8217;s a very positive change, though there will be challenges. The reduced memorization burden should make bar prep much less stressful and overwhelming (though, of course, you’ll still need <a href="https://barexamtoolbox.com/podcast-episode-13-handling-bar-exam-stress-w-megan-canty/">strategies for managing bar stress</a>!). The skills being tested are things you&#8217;ve been practicing throughout law school—issue spotting, analysis, applying law to facts. These don&#8217;t require brand-new learning, just focused practice.</p>
<p>The exam will only be 9 hours, compared to the current 12-hour marathon, which is better for everyone, but especially helpful for <a href="https://barexamtoolbox.com/podcast-episode-261-quick-tips-bar-exam-accommodations-basics/">students who need accommodations</a>.</p>
<p>On the flip side, these integrated question sets have the potential to be dense and reading-heavy. Time pressure could remain an issue for many test-takers, even though the NCBE says they&#8217;re specifically looking at timing during pilot testing.</p>
<p>The transition period will create some unfortunate scenarios. Someone who fails the final UBE administration in their jurisdiction will face a completely different exam format when retaking. And there will be uncertainty about how materials and preparation strategies translate from the old exam to the new one.</p>
<h2><strong>What Should You Do Now?</strong></h2>
<p>If you started law school in fall 2023 or later, embrace this change. You&#8217;re getting a better exam than your predecessors had to take. You&#8217;ll have more flexibility in choosing coursework without worrying about whether every single class appears on the bar exam.</p>
<p>Focus on developing practical skills throughout law school. Even if you don&#8217;t think you have these skills yet, you&#8217;re building them every time you analyze a case, write a memo, or work through a fact pattern. By the time you graduate, you&#8217;ll have the foundation you need.</p>
<p>For students and bar examinees closer to test day, realize that you&#8217;ve already developed many of these necessary skills through your work experience and law school education. The practical, skill-based aspect of NextGen has the potential to be an asset rather than an obstacle. And, of course, as you prepare, watch out for <a href="https://barexamtoolbox.com/podcast-episode-11-self-sabotaging-behavior-during-bar-prep-w-ariel-salzer/">common self-sabotaging behavior</a> that can undermine even the best study plans.</p>
<h2><strong>The Bottom Line</strong></h2>
<p>The NextGen bar exam 2026 represents a significant shift toward testing what new lawyers actually need to know and do. Less memorization, more practical application. Fewer obscure details, more realistic lawyering tasks. It&#8217;s not perfect—no licensing exam can truly capture the diversity of legal practice—but it&#8217;s an improvement.</p>
<p>We&#8217;re all going to have to sit back and see what happens as more details emerge about which jurisdictions go first, what the subject matter outlines look like, and how sample questions actually work. But if you&#8217;re facing this new exam, you&#8217;re fortunate to be taking a test that better reflects the skills you&#8217;ll use in practice.</p>

<p><em>The final weekend before the bar exam can feel overwhelming. You&#8217;ve spent weeks (or months) preparing, and now you&#8217;re staring down the last few days before test day. But here&#8217;s the thing: studying for the bar exam is like <a href="https://barexamtoolbox.com/train-like-athlete-bar-exam/">training for a marathon</a>. You need to taper off your training in those final days so you can rest and restore your energy.</em></p>
<p><em>Nobody training for a marathon runs 20 miles two days before race day, right? The same principle applies to bar prep. If you&#8217;re studying until the very last second, you&#8217;re probably setting yourself up for failure. Let&#8217;s walk through <a href="https://barexamtoolbox.com/bar-exam-approaching-fast-heres-manage-final-3-days-bar-prep/">what you should actually be doing this final weekend</a> to show up on exam day <a href="https://barexamtoolbox.com/its-almost-the-week-of-the-bar-exam-but-you-can-stay-sane/">well-rested and ready to perform</a>.</em></p>
<p><span id="more-21644"></span></p>
<h2><strong>SATURDAY: START GETTING INTO EXAM MODE</strong></h2>
<h3><strong>Wake Up at Exam Time</strong></h3>
<p>If you haven&#8217;t started already, Saturday is when you need to begin waking up at the time you&#8217;ll need to get up on exam day. This is especially important if you&#8217;re not a morning person. You usually have to be at the exam center by 8:00 or so at the latest, and if you&#8217;re driving yourself there, it could be even earlier.</p>
<p>Think of this like adjusting to jet lag. If you&#8217;re someone who doesn&#8217;t respond well to jet lag and isn&#8217;t naturally a morning person, start getting up early. Give yourself a few days to shift your schedule. Some people are <a href="https://barexamtoolbox.com/considerations-for-out-of-state-bar-exams/">even traveling across the country</a> and dealing with actual jet lag—if that&#8217;s you, start adjusting your sleep schedule even earlier.</p>
<h3><strong>Practice in Three-Hour Blocks</strong></h3>
<p>You need to get comfortable sitting and focusing for a solid three hours without taking a bunch of breaks. California test-takers need to practice three-and-a-half hour blocks. You want to mimic the actual testing conditions as closely as possible.</p>
<p>This means timed, closed-book practice for multiple choice and essays. No water bottle on your desk if that&#8217;s not allowed during the actual exam. Limit bathroom breaks. Think about what you&#8217;ve been eating and how it affects your ability to sit still and concentrate.</p>
<p>Here&#8217;s the reality: sitting in one spot for three hours and just using your brain is physically difficult. People underestimate this. Many unsuccessful test-takers blame day-of fatigue, especially during that second day afternoon session.</p>
<h3><strong>Get Comfortable Switching Topics</strong></h3>
<p>If you&#8217;re doing the MEE, you&#8217;ll have three hours and they&#8217;re going to hand you six essays. That&#8217;s very different from sitting down and thinking, &#8220;Today I&#8217;m going to do a civ pro essay.&#8221; Nobody&#8217;s going to tell you what the essays are about on exam day.</p>
<p>With our tutoring students, we call it the &#8220;surprise package&#8221;—it just gets put into a schedule and they have to sit down and do it. If you&#8217;ve never done back-to-back essays like that, you need to do them this weekend. Your bar review provider should have supplied these, but if not, grab a bar prep friend and put together surprise packets for each other. Or download a full exam from a few years ago.</p>
<h3><strong>Figure Out Your Lunch Schedule</strong></h3>
<p>You probably want to eat lunch around the same time you&#8217;ll be eating during the test. Make sure you&#8217;re eating enough. This can be a problem if you&#8217;re a big snacker—the bar doesn&#8217;t really let you take snack breaks. You don&#8217;t get your 2:00 latte. You need to adjust to the examiners&#8217; schedule.</p>
<p>If you don&#8217;t usually eat lunch at noon and you&#8217;ve got to eat at noon on exam day, figure out what you need to eat to make it all the way until 4:30 or 5:00. That&#8217;s a very long time. You also need to think about calibrating your caffeine and sugar intake. If you eat too much, you get drowsy. Too much sugar and you crash. Try some things out this weekend and see how they make you feel.</p>
<h3><strong>Do a Test Run to the Exam Site</strong></h3>
<p>Decide how long it&#8217;s going to take you to get there and where you&#8217;re going to park. You want to make sure the day you&#8217;re planning to park isn&#8217;t street cleaning day. Seriously—these details matter.</p>
<p>If you&#8217;re taking public transit, make sure you know exactly what you can take and have a backup plan. Public transit can be incredibly unreliable. In California, the bar is typically given in Oakland, and if you&#8217;re thinking &#8220;I&#8217;ll just jump on BART from San Francisco,&#8221; you better have a plan B. If BART stops running in the tunnel, you&#8217;re stuck. What&#8217;s your backup? Can you walk? Who can you call?</p>
<h3><strong>Get Your Registration Materials Organized</strong></h3>
<p>Print or download anything you need. If they mailed you anything you’ll need, make sure you have that too. Put it all in a gallon-sized clear Ziploc bag (check your jurisdiction&#8217;s specific requirements). Know exactly what you can bring into the room and have everything organized so you can grab and go.</p>
<p>Check that your ID is valid and not expired. Driver&#8217;s license expiration dates can sneak up on people. If you&#8217;re international, do you need your passport? Make sure you&#8217;ve checked all the boxes so you can just show up, show them your documents and your plastic bag, and sit down without any issues.</p>
<h3><strong>Confirm Your Computer is Ready</strong></h3>
<p>Turn off automatic updates. Make sure you&#8217;ve done all the testing and downloaded or uploaded everything you need. Check that your power cord works. You really don&#8217;t want last-minute computer surprises. If there&#8217;s testing software, make sure you know how to use it. Are you allowed to use spell check? What formatting options do you have? You shouldn&#8217;t be spending time on exam day looking for the bold button.</p>
<h3><strong>Study Smart: Focus on Heavily Tested Law</strong></h3>
<p>From a study perspective, spend your time (six to eight hours max) focusing on weak areas of heavily tested law. You need to know everything that&#8217;s likely to show up on the test. If it&#8217;s heavily tested, know it. If you don&#8217;t know it, create a list and start drilling that material this weekend.</p>
<p>Don&#8217;t get caught up in predictions. We&#8217;ve talked to many people who gambled on predictions and were wrong. Yes, Professional Responsibility will be on the California bar—that&#8217;s about as close to a guarantee as you get (it&#8217;s on something like 95% of exams). But beyond obvious things like that, you can&#8217;t game this test.</p>
<p>The reality is that they&#8217;re going to throw in some curveballs that maybe aren&#8217;t even in your study materials. This happens every year. Learn everything that has a high likelihood of being on the test based on frequency data, not random website predictions. Then you&#8217;ll know enough to deal with questions you don&#8217;t have any idea about.</p>
<p>Spend about 30-40% of your time memorizing, and the rest needs to be practice. Focus on heavily tested essays and topics. And don&#8217;t study super late—you need to shut it down in the evening so you can get to bed at a good time.</p>
<h2><strong>SUNDAY: LOGISTICS AND LIGHTER STUDYING</strong></h2>
<h3><strong>Start Packing</strong></h3>
<p>If you&#8217;re staying at a hotel, make sure you have what you need. Call the hotel and confirm your reservation. We&#8217;ve had students call only to discover the hotel doesn&#8217;t have their reservation. Oops.</p>
<p>You can also request a low-floor room (less elevator wait time) and see if it&#8217;s possible to get a mini fridge to keep food in your room. Consider whether you want late checkout on the second day so you don&#8217;t have to pack up and check out on Wednesday. It may cost a small fee, but having a place to go eat lunch on Wednesday is very nice.</p>
<p>Even paying for an extra night might be worth it. These hotels near exam centers can be pretty crowded with hundreds or even thousands of test-takers. Anything you can do to avoid showing up stressed out, running late, or wondering if your luggage is okay is worth the extra money.</p>
<h3><strong>Prep Your Food</strong></h3>
<p>If you&#8217;re staying at home, make sure you&#8217;ve done all your laundry and grocery shopping. Consider doing some food prep to make your life easier. Never cut up just one carrot—cut up a whole bag, put them in a jar with water, and just grab them when you need them. Same with celery, peppers, watermelon. You want to make everything outside the test very easy because you&#8217;re going to be very fatigued at the end of each day.</p>
<p>Think ahead about what you&#8217;re going to eat when you come back after the first day. Have your fridge stocked with a few great meals. Your future self will thank you for planning ahead so you can just roll in exhausted and heat something up instead of ordering pizza and feeling terrible.</p>
<h3><strong>Organize What Goes Into the Exam Room</strong></h3>
<p>They&#8217;ll have a list of things you can bring. Don&#8217;t bring everything on the list—just bring what you need. Ear plugs, pencil, pen, highlighter. Sometimes you&#8217;re allowed to bring Advil or Tylenol. If you&#8217;re planning to <a href="http://barexamtoolbox.com/planning-to-handwrite-the-bar-exam-ask-these-questions-first/">hand write</a> (or even if you&#8217;re not), have a couple of reasonable pens that you could write for hours with if you had to.</p>
<h3><strong>Keep Studying Light</strong></h3>
<p>Again, six hours or so max. Continue to chip away at heavily tested law you&#8217;re still struggling with. Stick to the statistics—don&#8217;t get caught up in predictions. Be kind to yourself. If you&#8217;re feeling anxious, maybe it&#8217;s not a great time to quiz yourself on MBE questions. It&#8217;s better to just do some studying or write some heavily tested rule statements.</p>
<p>This is a good point to sit down and rewrite attack plans or rule statements you feel fairly confident about. If you can&#8217;t do that at this point, you might have cause for concern. Focus on memorizing and being able to write down attack plans by element.</p>
<h2><strong>MONDAY: THE DAY BEFORE EXAM DAY</strong></h2>
<h3><strong>Stop Studying by 3:00 PM</strong></h3>
<p>Have a pre-set time when you&#8217;re going to stop studying—noon, 1:00, 2:00, no later than 3:00. Just pick it. It doesn&#8217;t matter how you feel when that time comes. Put the books down and walk away. Very important.</p>
<p>Spend that morning continuing to check off your list of law you&#8217;re still struggling with. Be careful about doing lots of essay questions or MBE sets. You can easily get into a head space where you feel like you don&#8217;t know what&#8217;s going on. This is not the time to demoralize yourself. Just drill the law.</p>
<h3><strong>Travel and Get Settled</strong></h3>
<p>If you&#8217;re traveling to your location, do that Monday. Go to the grocery store and get the food you need to stock your hotel room. If you can&#8217;t get a mini fridge, ice chests work great. Here&#8217;s a pro tip: don&#8217;t dump ice directly into your cooler. Put ice in big Ziploc bags. When it melts, you just have a bag of water to pour into the sink instead of a pool of water in your cooler.</p>
<h3><strong>Find a Distraction</strong></h3>
<p>Have a plan to distract yourself. Go to a movie or dinner with a friend—preferably someone who&#8217;s <em>not</em> sitting for the test so they can&#8217;t talk to you about it. You&#8217;re basically just burning hours until it&#8217;s time to go to bed. Download some favorite reality TV shows or light entertainment. Don&#8217;t read anything stressful—if a book is about to take a dark turn, put it down.</p>
<h3><strong>Stick to Your Schedule</strong></h3>
<p>Don&#8217;t sleep in. Get up early because you&#8217;re going to have to get up early on Tuesday, and you don&#8217;t want to make it so you can&#8217;t go to bed Monday night. Have a similar breakfast as you will on exam day to make sure you have your food routine down.</p>
<p>Eat dinner a little earlier—if you&#8217;re trying to go to bed by 10:00, go to a 6:00 dinner instead of an 8:00 dinner. A super full stomach makes it harder to fall asleep.</p>
<h3><strong>Don&#8217;t Experiment</strong></h3>
<p>This is not the time to start experimenting with sleeping pills. If you need them and you&#8217;ve taken them before, fine. But if you&#8217;ve never taken Ambien before, Monday night before the bar exam is not the time to try it.</p>
<h2><strong>SPECIAL CONSIDERATIONS FOR ACCOMMODATIONS</strong></h2>
<p>If you&#8217;re <a href="https://barexamtoolbox.com/seeking-accommodations-on-the-bar-exam/">getting accommodations</a> and taking the exam at a hotel or in a specific room, there are often rules that you have to check in the day before. Some people don&#8217;t show up to the test (a surprisingly high number), so they want to confirm you&#8217;re coming. Sometimes you have to develop the schedule for when you&#8217;re taking lunch breaks if you&#8217;re sharing a room.</p>
<p>Make sure you&#8217;ve read all the materials the bar has given you. And bring that documentation with you in case there are any issues about what you should be getting. Don&#8217;t be in a position where you&#8217;re arguing about what you remember—just have everything printed out and ready to go.</p>
<h2><strong>THE BOTTOM LINE</strong></h2>
<p>The final weekend isn&#8217;t about cramming in more information. It&#8217;s about getting your logistics sorted, getting your body and mind into the right rhythm, and <a href="https://barexamtoolbox.com/the-last-7-days-of-bar-prep-and-how-to-make-the-most-of-them/">setting yourself up to perform well on exam day</a>. You&#8217;ve spent weeks or months preparing. These last few days are about tapering off, organizing, and resting.</p>
<p>You want to show up to that exam well-rested, with all your materials organized, knowing exactly where you&#8217;re going and what to expect. The bar exam is hard, but you don&#8217;t need to make it harder by being sleep-deprived, disorganized, or stressed about logistics.</p>
<p>Remember: This will be over in a few days. Head in the game. Keep going. You&#8217;ve got this.</p>

<h3><strong>What Makes IQS Questions Different?</strong></h3>
<p>Integrated question sets aren&#8217;t just harder versions of traditional bar questions. They test you in completely new ways that demand different skills.</p>
<p>First, you&#8217;re dealing with a shared fact pattern that applies to multiple questions. You&#8217;ll read through a client interview, review statutory language, and then answer a mix of question types—all while the clock is ticking. Unlike traditional essay questions where you write one answer and move on, IQS problems require you to hold a lot of information in working memory while switching between different task types.</p>
<p>Second, you&#8217;ll be scrolling constantly. The facts are here, the statute is there, and the questions are somewhere else entirely. You can&#8217;t spread everything out on a desk or flip between pages in a blue book. Everything happens on a screen, and you need to remember what you read two pages ago while answering the current question.</p>
<h3><strong>Hunt for Legally Significant Facts</strong></h3>
<p>When you&#8217;re working through an IQS, your first job is identifying which facts actually matter. In our sample question, the fact that &#8220;Marcus ate the grapes, not Peter&#8221; isn&#8217;t just background color—it&#8217;s the entire legal problem. The security guard detained the wrong person, and he knew it.</p>
<p>These details are planted in the fact pattern for a reason. If the question tells you someone was held in a &#8220;windowless storage room with a door locked from the outside,&#8221; that&#8217;s not atmospheric writing. That&#8217;s a fact you&#8217;ll need when analyzing whether the detention was conducted in a reasonable manner.</p>
<p>Pay attention to what people say and when they say it. When the security guard states &#8220;Right, it was your buddy here&#8221; before detaining Peter anyway, that&#8217;s your smoking gun. The store detained someone they knew didn&#8217;t commit the shoplifting—that&#8217;s going to be a problem for their legal defense.</p>
<h3><strong>Read the Call of the Question Carefully</strong></h3>
<p>IQS questions are incredibly specific about what they&#8217;re asking. You might see a question about &#8220;reasonable manner&#8221; of detention, not &#8220;reasonable cause&#8221; for detention. Those sound similar, but they&#8217;re asking about completely different legal elements.</p>
<p>In our walkthrough, one question asked which factors would be &#8220;most relevant to determining whether the detention was conducted in a reasonable manner.&#8221; The key phrase is &#8220;conducted in a reasonable manner&#8221;—not whether they had the right guy, not whether they should have called the police, but specifically about how they conducted the detention itself.</p>
<p>If you start analyzing whether they had reasonable cause to detain him, you&#8217;re answering a different question. The graders won&#8217;t give you credit for analyzing something they didn&#8217;t ask about, even if your analysis is brilliant.</p>
<h3><strong>You&#8217;ll Need Both Legal Knowledge and Practical Judgment</strong></h3>
<p>Some IQS questions test pure legal knowledge—you either know the rule or you don&#8217;t. But other questions test practical lawyering skills like spotting missing facts or identifying what needs investigation.</p>
<p>One of our sample questions asked test-takers to &#8220;identify three specific factual issues that would need to be investigated to determine whether the detention was conducted in a reasonable manner.&#8221; This isn&#8217;t asking you to define &#8220;reasonable manner&#8221; or recite a legal standard. It&#8217;s asking what additional facts you&#8217;d need to know.</p>
<p>Maybe you&#8217;d want to know more about the physical conditions of the storage room. Was it dark? Did it smell? How big was it? Or maybe you&#8217;d investigate the use of force—were there bruises on Peter&#8217;s arm? Did anyone witness the security guard grabbing him?</p>
<p>The question isn&#8217;t looking for one &#8220;right&#8221; answer. It&#8217;s testing whether you can think like a lawyer who needs more information before advising a client.</p>
<h3><strong>Your Working Memory Will Be Challenged</strong></h3>
<p>Here&#8217;s an uncomfortable truth: you&#8217;re going to forget things while working through an IQS. You&#8217;ll answer question three and suddenly can&#8217;t remember whether the detention lasted an hour or thirty minutes. You&#8217;ll need to scroll back up to check if the security guard actually worked for the store or was just &#8220;some intimidating guy in a security uniform.&#8221;</p>
<p>This is by design. IQS questions test your ability to manage information overload under time pressure. You have roughly 24 minutes for an entire problem set, which means you need to make smart decisions about when to double-check facts versus when to trust your memory.</p>
<p>Practice holding key details in your head. When you read the fact pattern, make mental notes about the big picture: Who did what? What&#8217;s the main legal problem? Which facts seem unusual or legally significant? You won&#8217;t remember every detail, but you should remember enough to answer questions without re-reading the entire fact pattern for each one.</p>
<h3><strong>Different Question Types Require Different Strategies</strong></h3>
<p>Our sample IQS included traditional multiple-choice questions, six-option &#8220;pick two&#8221; questions, and short-answer questions. Each type demands a different approach.</p>
<p>For multiple-choice questions with one correct answer, use your standard MBE strategies. Identify legally significant facts, have an answer in mind before looking at the options, and eliminate clearly wrong choices.</p>
<p>For &#8220;pick two&#8221; questions with six options, the difficulty level jumps significantly. Multiple answers could be plausibly correct, and you&#8217;re looking for the most relevant or most significant factors. These questions often hinge on careful reading of what&#8217;s actually being asked.</p>
<p>For short-answer questions, you&#8217;re not writing a full IRAC analysis. Keep your responses focused and concise. If the question asks for three factual issues that need investigation, give three factual issues—not legal arguments or policy considerations.</p>
<h3><strong>The Statute Isn&#8217;t Always Your Friend</strong></h3>
<p>In our sample problem, we provided a shoplifting statute that defined reasonable cause, reasonable manner, and reasonable time for detention. Sounds helpful, right? Except the statute didn&#8217;t actually define what &#8220;reasonable manner&#8221; means in practice.</p>
<p>This is frustrating but realistic. Real statutes often use vague language like &#8220;reasonable&#8221; without spelling out exactly what that means. You&#8217;ll need to apply your general legal knowledge and common sense to figure out what the statute requires.</p>
<p>Don&#8217;t waste time looking for answers that aren&#8217;t in the statute. If the law doesn&#8217;t define something precisely, acknowledge the ambiguity and make your best argument based on the facts and your understanding of related legal concepts.</p>
<h3><strong>Start Practicing Now</strong></h3>
<p>The only way to get comfortable with IQS questions is to <a href="https://barexamtoolbox.com/bar-exam-study-strategies/">practice them</a>. Work through the official NCBE sample questions multiple times. Time yourself strictly—24 minutes goes by faster than you think. And remember: you’re not alone! The IQS is new for everyone.</p>
<p>Pay attention to your process. Are you scrolling back to re-read things constantly? Are you getting tripped up by the call of the question? Do you struggle to remember key facts? Each of these problems can be addressed with deliberate practice.</p>
<p>And here&#8217;s the most important thing: don&#8217;t panic when these questions feel hard. They&#8217;re supposed to feel hard. They&#8217;re supposed to be different from what you&#8217;ve practiced in law school. That&#8217;s why practicing them beforehand is so crucial.</p>
<p>The NextGen bar exam is coming whether you&#8217;re ready or not. The students who will succeed are the ones who start preparing now—not by memorizing more law, but by practicing the specific skills these questions demand.</p>
