This article will provide the reader with the timely and priceless knowledge to save the reader money at tax time.&lt;br /&gt;
&lt;br /&gt;
One of the key's to understanding the differences between what is capital improvement versus what is an operating expenses, is to review the IRS definition of capital improvement. The IRS defines capital improvement&lt;br /&gt;
 as a capital expense of a property improvement that will add value to your property, prolong its' useful life,or adapt the property to new &lt;br /&gt;
uses.&lt;br /&gt;
&lt;br /&gt;
The cost of the improvement must be capitalized, and that capitalize cost will be depreciated. Residential real estate property can be depreciated for a period of 27.5 years from the date that the property was put in service i.e. purchased.  The land that the building sits upon however,can not be depreciated.&lt;br /&gt;
&lt;br /&gt;
When your purchase property to be put in use for your residential rental property, the IRS will consider the following depreciation schedule.The properties purchased are either a 5 year,6 year,7 year,9 year,or a 15 year depreciation schedule.&lt;br /&gt;
&lt;br /&gt;
• Computers, copiers, calculators, typewriters and their peripheral equipment can be depreciated for 5 year schedule&lt;br /&gt;
&lt;br /&gt;
• Appliances such as washer and dryer machines, stoves, refrigerators can be depreciated for a 5 year schedule&lt;br /&gt;
&lt;br /&gt;
• Replacing carpeting, purchasing furniture, TV's stereo's to be used in a residential income producing property can be depreciated on a &lt;br /&gt;
7 year schedule&lt;br /&gt;
&lt;br /&gt;
• Purchasing automobiles and light trucks for business use has a &lt;br /&gt;
5 year depreciation schedule&lt;br /&gt;
&lt;br /&gt;
• Purchasing new furnaces, water pipes, venting can have a &lt;br /&gt;
27.5 year depreciation schedule&lt;br /&gt;
&lt;br /&gt;
• Property improvement such as driveway and road improvements, some landscaping such as planting shrubbery, trees, building fences has a &lt;br /&gt;
15 year depreciation schedule.&lt;br /&gt;
&lt;br /&gt;
The IRS will provide the residential rental property owner with the opportunity to take advantage of many legitimate deductions and also the crème of the crème depreciation schedules. It is always advisable to seek the advice and guidance of a qualified tax advisor in your area.&lt;br /&gt;
&lt;br /&gt;
The difference between an operating expense and repairs versus a capital improvement is that an operating expense and repair will be able to be deducted during the year that the expense and repair occurred.That expense and repair cannot be depreciated nor does the expense and repair add value to the property.&lt;br /&gt;
&lt;br /&gt;
Some examples of operating expenses and repairs include the following:&lt;br /&gt;
&lt;br /&gt;
• Fixing a small section of the roof of your rental property building&lt;br /&gt;
&lt;br /&gt;
• Having your rental unit carpets cleaned after the tenant moves out&lt;br /&gt;
&lt;br /&gt;
• Cleaning your apartment kitchen, and bathrooms and the entire   apartment unit&lt;br /&gt;
• Paying for snow plowing, landscaping, and garden maintenance&lt;br /&gt;
&lt;br /&gt;
• Changing the locks of apartment doors, Fixing apartment faucet leaks&lt;br /&gt;
• Cleaning the common area's of your apartment building&lt;br /&gt;
&lt;br /&gt;
•  Paying common area electric bills, building water and sewer bills&lt;br /&gt;
&lt;br /&gt;
• Property tax for a residential rental property,  Property&lt;br /&gt;
&lt;br /&gt;
 Insurance bills&lt;br /&gt;
• Mortgage interest that you paid during the year on your Mortgage loan&lt;br /&gt;
&lt;br /&gt;
• Condo Fees for condo units&lt;br /&gt;
&lt;br /&gt;
• Advertising cost for filling apartment vacancies&lt;br /&gt;
&lt;br /&gt;
As a property owner you can also  receive a $0.50 per mile mileage deduction.  You need to write down the automobiles miles in December of the prior year, in this case 2010. You then need to write down the mileage on January 1 of 2011.&lt;br /&gt;
&lt;br /&gt;
For example if you are driving to your apartment building for routine maintenance you can deduct the amount of miles that you have driven.  &lt;br /&gt;
If you pick up rent deduct those miles. If you are picking up supplies &lt;br /&gt;
for your rental property deduct those miles as well.  If you are&lt;br /&gt;
searching for a new investment property to purchase you can deduct the miles when you do your property drive-by's.  Print out a www.yahoo.com map quest for each trip that you take for business use.&lt;br /&gt;
&lt;br /&gt;

You must also diversify your sources of income and ownership of residential investment real estate properties is a great way to do just that.&lt;br /&gt;

There are three differant ways to classify income. First there is earned income. Second there is passive income and the third there is portfolio income.  &lt;br /&gt;
&lt;br /&gt;
Our most recent December 2010 unemployment report showed a 9.4% unemployment rate. During 2010 around 14,825,000 fellow American are presently unemployed at the time of this publication.&lt;br /&gt;
&lt;br /&gt;
The unemployment numbers that are a driving force in our country. People are feeling anger, frustration and pain nationwide. The current weekly unemployment check averages around $350. $350 which does not pay a lot of bills, groceries, mortgage or rent payments.&lt;br /&gt;
&lt;br /&gt;
Financial literacy, and income diversification are part of the solution to our national crisis. If you have three sources of income rather than just earned income coming in, then you will not be feeling as much frustration and pain.&lt;br /&gt;
&lt;br /&gt;
Let's use as an example of two person household who has earned income of $40,000 per person.  If one of those people lost their job instead of showing $80,000 annual income, your income would be cut in half.  This income is called earned income.&lt;br /&gt;
&lt;br /&gt;
Now let's say that couple also owned residential investment property that produced an income  stream of $3,800 per month.  That would be called passive income.&lt;br /&gt;
&lt;br /&gt;
Let's also say that our couple had a bond, mutual fund, and stock portfolio of say $250,000, that they could withdraw income from. That income would include dividends,interest,and capital gains. The income we are talking about is portfolio income.&lt;br /&gt;
&lt;br /&gt;
Most financial planners believe that as a rule of thumb that your could safely withdraw on average up to 4% of your portfolio balance per year.  In our example, that would translate into $10,000 of portfolio income withdraw. That would be a monthly withdraw amount of $833.&lt;br /&gt;
&lt;br /&gt;
Our diversified income would look like this;earned income of $40,000 or $3,333 per month. Passive income of $3,800 per month.  A Portfolio income of $833 per month. Your monthly total income would be $7,966 per month.&lt;br /&gt;
&lt;br /&gt;
Let's say that your bills and debt payments total about $3,800 per month.  Your passive and portfolio income comes out to $4,633 per month.If one or both of you lost your earned income your passive and portfolio income can cover the bills and debt payment.&lt;br /&gt;
&lt;br /&gt;
Sound advice for your passive income would include setting aside about 0.10% of your monthly income to cover your property maintenance expenses and utility costs. Keep your passive income located in a high yield money market fund.&lt;br /&gt;
&lt;br /&gt;
Also take another 10% of your passive income and use that to purchase other assets and equipment that will produce additional income. For example, use your income to purchase utility income producing stocks or mutual funds. Take advantage of dollar cost averaging to build up a portfolio.&lt;br /&gt;
&lt;br /&gt;
Strive to put the money that you are making now to it's highest and most productive uses. Always' looking towards purchasing assets and equipment that will produce income for you. The eviction process is an adversary  process where there are no real winners. Typically the landlord is out of at least 2 or more months of rental payments. The landlord could also face damages to their rental property.&lt;br /&gt;
&lt;br /&gt;
    The renters will have to find a new apartment and pay first, last month's rent and security deposit. Renters who are on section 8 housing could also loose that benefit if the tenant is formally evicted. The tenant could also be homeless or be forced to live with family and friends.&lt;br /&gt;
&lt;br /&gt;
     The processing of an eviction will depend upon the tenancy relationship that a landlord and tenant have with their apartment lease.  There are two types of tenancy leases.  &lt;br /&gt;
    &lt;br /&gt;
    The first type of lease is the tenant at will lease.  With this type of lease either the landlord or the tenant can give a formal 30 day written notice to quit to each other. The written notices needs to be received before the next 30 day rental period.A tenant at will provides the most flexibility for both the landlord and the tenant. It does not lock in the parties for a 1 or 2 year lease period.&lt;br /&gt;
&lt;br /&gt;
    The other main type of tenancy is the leased tenancy. A leased tenancy will lock in both parties to either a 1 or 2 year type of lease. This article will be focusing primarily upon the residential apartment properties. Commercial leases are different than the residential.&lt;br /&gt;
&lt;br /&gt;
   If eviction process is elected by the landlord, then the Massachusetts housing court will have jurisdiction over all areas that relate to residential housing.  This includes all contracts, equity matters, apartment evictions, and torts. It is in the Massachusetts housing court that will hear and decide all cases that require a summary process eviction case.&lt;br /&gt;
&lt;br /&gt;
     The first step in the process of a summary process eviction case is;  a landlord needs to fill out a 14 day Notice to Quit form. The type of apartment lease or a tenant at will lease will determine which 14 day Notice to Quit form.&lt;br /&gt;
&lt;br /&gt;
     It is always advisable to seek qualified legal guidance from an attorney who specializes in Landlord/tenant disputes.  This advice is for both the landlord and the tenant.&lt;br /&gt;
&lt;br /&gt;
    A 14 day notice to quit form is available to purchase from the local legal stationary stores in your area. You can also purchase the form from your local constable office and sheriff offices. In Massachusetts the cost of  serving the 14 day notice to quit form from a constable office is&lt;br /&gt;
between $30 to $50 per serving.  You should contact the local sheriff office to verify their cost and fees to serve a tenant.&lt;br /&gt;
&lt;br /&gt;
    Once the tenant has been served that tenant must respond and pay the landlord the full amount of the owed rent within 10 days from being served. If the tenant pays the owed rental amount then this can avoid the eviction process.&lt;br /&gt;
&lt;br /&gt;
    If the tenant refuses to pay the owed rent or refuses to respond to the 14 day notice to quit the next step for the landlord will be to have either the constable or sheriff serve a Summon and complaint form to the tenant.&lt;br /&gt;
&lt;br /&gt;
     The summons and complaint form will require the tenant to appear in the local housing court to face a formal eviction hearing before the housing court judge.&lt;br /&gt;
&lt;br /&gt;
     The housing courts will have available a team of housing court specialist.  The housing court specialist will provide many services.  They can provide you with procedural advice, along with details regarding landlord/tenant law and issues.&lt;br /&gt;
&lt;br /&gt;
     The housing court specialist will also act as mediator between the landlord and the tenant who can offer a binding resolution prior to facing the formal eviction process. The final decision making process is voluntary between the landlord and the tenant.&lt;br /&gt;
&lt;br /&gt;
      Once the settlement is agreed to between both parties the housing court judge will formally approve that settlement decision. Once the settlement decision is approved that decision is binding and final.&lt;br /&gt;
There is no appealing the mediating settlement that was approved by the housing court judge.&lt;br /&gt;
&lt;br /&gt;
      The benefit for both the landlord and the tenant is that you can avoid the arbitrary decision imposed by the housing court judge on both parties. For the tenant there will be no record of an eviction place&lt;br /&gt;
on their credit profile. They will have to lose their Section 8 housing voucher.&lt;br /&gt;
&lt;br /&gt;
       For the landlord that means less lost money and vacancy time in the apartment. The decisions are binding and there is no appealing the mediated decision.&lt;br /&gt;
&lt;br /&gt;
      If you fail to agree to the mediating efforts of the housing court specialist then both parties will have to appear before the housing court judge. Once the housing court judge has reached a formal decision on the eviction there are additional steps that the landlord will have to take.&lt;br /&gt;
&lt;br /&gt;
      If the housing court judge rules in favor of the landlord, and the judge grants not stays of execution, then the tenant will have the right to appeal the decision in 10 days. Upon the 11th day the landlord&lt;br /&gt;
can request that an execution be served to the tenant.&lt;br /&gt;
&lt;br /&gt;
     The local constable/sheriff will execute and serve a 48 hour notice form to the tenant. The constable/Sheriff after the 48 hour period is over will execute the conviction. If,the tenant does not remove their&lt;br /&gt;
personable belongings from the apartment and the property building on the day of the execution,then the tenants' possession will have to be stored.&lt;br /&gt;
&lt;br /&gt;
    The local constable/sheriff will move the tenants belongings to a licensed storage facility. The landlord will have to pay in advance for the first 3 months of the rental storage unit. The landlord can sue the tenant to recover the cost of storage, lost money for rent. The landlord can also sue the tenant for any damages to the apartment,court cost,legal fees.&lt;br /&gt;
&lt;br /&gt;
   To avoid an eviction the tenants should pay their rent on time. The should be respectful of their neighbors rights of the quite enjoyment of their apartment. &lt;br /&gt;
&lt;br /&gt;
   Landlord need to ensure that the apartment meets local housing standards. Treat the tenants with professionalism and respect. Ensure that the property is a clean,safe and,quiet building.&lt;br /&gt;
&lt;br /&gt;
   Both parties should use the services of the housing court specialist.  The mediation process is beneficial to all parties involved. Compromise between the landlord and tenants is always a good result.&lt;br /&gt;

We have owned a 4family, a 5 family multi family unit as well as a rental condo unit in Florida. The following phenomenal and valuable tips will save you headaches, money, and wasted time with vacant units.&lt;br /&gt;
&lt;br /&gt;
Proper tenant screening strategies are critical to your ability to show a positive property cash flow. We utilize a creative and excellent tenant screening strategy. This strategy is compliant with state and federal fair housing guidelines.&lt;br /&gt;
&lt;br /&gt;
The result of this strategy means that you will enjoy a low vacancy rate while spending less time in the eviction housing court system.  When we do receive a phone call from a prospective tenant requesting to show the vacant apartment, we ask the tenant the following questions; Why are you moving? How many people will be living with you?  Do you have pets?  Are you smokers?&lt;br /&gt;
&lt;br /&gt;
Prior to providing the prospective tenant our property address to set up a showing of the vacant unit,we will inform the tenant of the following statement; "We do strive to provide for our tenants a clean,quiet, safe. family friendly property. Does that sound good to you?" With that in mind we do require from all potential applicants that they  go thru a thorough credit history review, criminal background check. We will also require a complete reference check of current and prior employers and landlords. IS THERE ANYTHING THAT WE NEED TO BE AWARE OF?&lt;br /&gt;
&lt;br /&gt;
At this point we do get a lot of prospective tenants that will hang up on us. But in the long run that will save us the headache of potential evections and apartment vacancies'. It is better to have a vacant&lt;br /&gt;
unit now than to face an non paying tenant who will be evicted later.&lt;br /&gt;
&lt;br /&gt;
One vital piece of advice is to NEVER EVER rent to family, friends or relatives. That will be a disaster waiting to happen.&lt;br /&gt;
&lt;br /&gt;
When it comes to showing an vacant apartment we have learned a thing or two. We have figured out that if you have 10 prospective tenants who request a showing, you will be lucky to have 4 show up at all.&lt;br /&gt;
How do you save your effort and wasted time? Schedule multiple showings at the same time period. If you have an afternoon showing around 1pm schedule as many appointments as possible during that window of time. You can also provide a rental open house on the weekends from say 1-3pm.&lt;br /&gt;
&lt;br /&gt;
When your prospective tenant does show up notice the vehicle that they are driving in. Is the vehicle inspection sticker current? Is the vehicle registered and insured? How clean is the exterior and interior of the vehicle? Is the vehicle properly maintained? These are signs of how responsible your prospective tenant will be. You don't want to have  unregistered and uninsured vehicles sitting in your limited parking&lt;br /&gt;
space.&lt;br /&gt;
&lt;br /&gt;
If your prospective tenant shows an interest in your property, have that tenant fill out a rental application form while you are with him. Make sure that all prior contact information for employers and landlords&lt;br /&gt;
are filled out. Ensure that you have their social security number and DOB.&lt;br /&gt;
Request to their drivers license. On your application form include a section that will ask the applicant if they have had a prior rental evection, prior mortgage foreclosure, bankruptcy, criminal/felony convictions. Compare their answers on the application with the results of the credit report and criminal background check.&lt;br /&gt;
&lt;br /&gt;
It would be a good idea to schedule a time with the final prospective tenants to go to their current apartment to see what condition that apartment is in.  If possible discreetly talk to their tenant neighbors to see how well they get along.&lt;br /&gt;
&lt;br /&gt;
As a landlord your wear many hats. You need to show excellent people skills in managing your tenants and their expectations. You need to impress upon your tenants that payment of their rental checks on&lt;br /&gt;
time should be their first priority.You also need to have a solid understanding of local city, state and federal government regulations.  You need to have excellent problem solving skills as well as be a&lt;br /&gt;

Habitual can be defined as a established, customary, routine, that can be everyday routine that falls within your comfort level. A habitual habit is a persistent, ingrained harmful activity that many of us pursue in our daily lives.&lt;br /&gt;
&lt;br /&gt;
What is one of the top hardest habits to break?  Of course it is smoking.  A smoker who has developed a habit of smoking 2 pack's a day will be facing the following economic impact;In a recent phone call to the&lt;br /&gt;
local Cumberland Farms store a pack of cigarettes is around $6.88 per pack.&lt;br /&gt;
&lt;br /&gt;
The annual cost of this bad habit will be the following $5,022.40.  That cost does not factor in the health care cost from the effects of smoking, or the rise of the insurance premiums from tobacco's related diseases.&lt;br /&gt;
&lt;br /&gt;
Another bad habit can be daily, or weekly binge drinking. If you bought a 30 pack of Budweiser once a week that annual cost for you would be around $987.48 based on a pack of Budweiser that was sold for $18.99.&lt;br /&gt;

So the minimum daily cost for purchasing lottery tickets  are for $1 the annual figure would be $365. For a $2 ticket the annual cost is $730, a $5 daily scratch ticket annual figure is $1,825, a daily $10 annual&lt;br /&gt;
figure is $3,650, and a daily scratch ticket at $20 is $7,300. Many customer will purchase any combination of these tickets.&lt;br /&gt;

In another observation of a bad habit to break is the habit of being the most generous tipper in the area. What I mean be that is I have seen some people who insist on leaving the largest tip possible just to satisfy&lt;br /&gt;
their desire to feel important.&lt;br /&gt;
&lt;br /&gt;
For a middle of the road family friendly restaurant chains, like Appleby,TGIF Fridays,Chilli's a popular trend is the 2 meals for $20 or some variation of that idea. Most meals are around $14.99 or so.&lt;br /&gt;
&lt;br /&gt;
Let's review what a typically family of 2 adults with 2 kids would be paying.  The bill for the meals alone will be around $49.99,figure in 4 drinks, with no deserts, and maybe an appetizer as well.&lt;br /&gt;
&lt;br /&gt;
The drinks would come to about $14 for the meal and the appetizer's are around $9. So your total bill would be around $72.99 without including tax and tip.&lt;br /&gt;
&lt;br /&gt;
Going out to dinner with the family once a week the annual cost to your family will be around $3,795.48  Let see what the annual cost of tipping will be.&lt;br /&gt;
&lt;br /&gt;
A 10% tip on a $72.99 meal will be $7.29. A 15% tip on that same $72,99 meal would be$10.94 a 20% tip on $72.99 meal will be $14.59&lt;br /&gt;
&lt;br /&gt;
So here are your annual cost for tipping:  10% =$379.08,15%=$568.88,  20%=$758.68&lt;br /&gt;

Another habit that is easy to get into and hard to get out of is the fast food diet.Do you remember a video spoof of Burger King a few years ago?  The question was "Do you want some Fries with that meal?"&lt;br /&gt;

The correct answer to that quest should be NO.  Eating one value meal per day is a cost of $6.99 per meal or higher if you are spending for your children, or spouses. The annual cost for the fast food junkie&lt;br /&gt;

It is America's national savings week from February 21 to February 28. The purpose of this articles is to empower the reader with common sense tips on how to effectively save your money.&lt;br /&gt;

 Money is nothing more than a tool that you the reader must educate your self about. Money is not emotional.Money is not good or evil. It is people who are emotional about their attitudes,feelings, and spending habits.&lt;br /&gt;
&lt;br /&gt;
 It is not how much money that you make. It is about your ability to make wise saving and spending decisions about your money. The key to building financial security in a financially insecure world is your ability to control your capability or lack of capability to make wise saving and spending decisions.&lt;br /&gt;
&lt;br /&gt;
 The following are effective, yet simple strategies to improve your saving and spending decision process;&lt;br /&gt;
&lt;br /&gt;
1) Monitor and track your bank and credit card monthly statements.&lt;br /&gt;
&lt;br /&gt;
2) Utilize soft wear such as Quicken to categorize your spending habits. Know your fixed costs  and variable cost.&lt;br /&gt;
3) When you make a purchase with either your check book, debit card from you banks checking account, round the purchase to the next dollar amount. For an example let's say that you filled up your car with gas at an amount of $35.50. In your check book register round that up to $36 and&lt;br /&gt;
then transfer that amount of $0.50 into your savings account. Banks such as Bank of Americawill do this for you automatically. Your savings account balance will add up quickly&lt;br /&gt;
&lt;br /&gt;
4)  When you are purchasing your weekly groceries, or any items with your debit card, avoid getting cash back.  Limit your ATM cash withdraws to once a week and learn to live on that budget.&lt;br /&gt;
&lt;br /&gt;
5) At work pay your self first.If your employer offers a retirement savings account make sure that you contribute to that savings account. If your employer matches your own contributions,make sure that you match up to that % amount.You are receiving free money into your retirement&lt;br /&gt;
savings plan.&lt;br /&gt;
&lt;br /&gt;
6) After you have funded your retirement savings plan, strive to pay yourself with an automatic deduction of your after tax money into a money market savings account. Aim for a goal of 10% to 15%  to build up your savings.&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
7) Utilize the income you make now to purchase income producing assets,such as a part time business, bonds,dividend income producing stocks, Treasury inflation protection bonds,gold,silver coins&lt;br /&gt;
&lt;br /&gt;
8) Make your breakfast at home and brown bag your lunch at work. If you eat at McDonalds,or Dunkin doughnuts, your typical breakfast will either be at a minimum $3.05 to $4.99 per meal.If you take $4.99 times 7 days a week that equals $34.93.  If you multiple 52 weeks per year&lt;br /&gt;
by $34.93 that will equal $1,816.36 per year.&lt;br /&gt;
&lt;br /&gt;
9)  On a daily basis take your spare change that you have in your pocket and deposit that change into a coin jar. At the end of the year you can count the coins in that jar and deposit that spare change into a money market savings account. Some people will use that spare change to vacation&lt;br /&gt;
spending money, buying Christmas gifts for the family, or purchase an income producing asset. It is wise to look at your coins to see if they are collectable coins for Numismatic coin collectors. For example a Jefferson nickel from 1943P (3over2) at a VF rating is worth $75 while a rating of MS-60 is worth $250.&lt;br /&gt;
