A few basic points...

3-day Rule
Lenders now must provide borrowers with a GFE within three days of receiving a loan application. 
HUD does allow lenders to provide general information worksheets in lieu of the GFE during the 
pre-approval process as long as no specific property is identified. 
If consumers ask for a GFE, however, one must be provided whether the borrow is ready to buy or not. 

Fee Categories
The new GFE includes three categories of closing fees that your clients need to understand. 
(1) fees that cannot change at closing, such as origination fees 
(2) a group of charges that collectively can increase up to 10% only, such as government recording fees, and 
(3) costs that are permitted to change if a buyer chooses to shop around for services, such as homeowner’s insurance. 

Checks and Balances
Consumers should confirm their lender’s compliance with the new RESPA rules by carefully 
reading and reviewing the GFE and HUD-1 forms.

rate of 5.77 million units from 5.36 million units in March. 
The inventory of unsold homes on the market rose 11.5% to 4.04 million, 
an 8.4-month supply at the current sales pace, up from an 8.1-month supply in March.

The Standard &amp; Poor’s/Case-Shiller 20-city housing price index — on a seasonally 
adjusted basis — was unchanged in March after a 0.1% decline in February.

The consumer confidence index rose to 63.3 in May from a slightly revised 
57.7 in April. Economists had anticipated a reading of 59. 
The index was benchmarked at 100 in 1985, a year chosen because it was neither 
a peak nor a trough in consumer confidence.

The Mortgage Bankers Association said its seasonally adjusted index of mortgage 
applications for the week ending May 21 rose 11.3%. Refinancing applications jumped 17%. 
Purchase volume decreased 3.3%.

Orders for durable goods — items expected to last three or more years — rose 2.9% in 
April after falling a slightly revised 1.2% in March. The increase was largely due to a 
jump in demand for commercial aircraft. Excluding volatile transportation-related goods, 
orders posted a monthly decrease of 1%.

New home sales rose 14.8% in April to a seasonally adjusted annual rate of 504,000 units 
from an upwardly revised rate of 439,000 units in March. Economists had expected a pace 
of 425,000 units. The April reading was the highest level since May 2008.

Initial claims for unemployment benefits fell by 14,000 to 460,000 for the week ending 
May 22. May 4, 2010  &lt;em&gt;Governor Signs Real Estate Legislation into Law&lt;/em&gt;
The Governor signed the following real estate bills into law.  A complete summary of real estate bills considered by the Maryland General Assembly can be found on the 2010 Bill Summary under Government Affairs.
&lt;strong&gt;HB 1298/SB 666 – Prohibition of Private Transfer Fees&lt;/strong&gt;
STATUS: PASSED – Effective May 4, 2010
Prohibits developers and sellers of residential property from imposing a private transfer fee on the sale of residential property. Similar to a ground rent, private transfer fees are typically created as a 99 year deed restriction that require a buyer to pay a fee to the original seller of the property every time the property sells. The fees can be as high as 1% of the purchase price. 
&lt;strong&gt;SB 683 – Property Taxes – Bicounty Commissions&lt;/strong&gt;
STATUS: PASSED – Effective June 1, 2010 for tax years beginning after June 30, 2010.
Applies the homestead tax credit to property taxes imposed by bicounty commissions like the Parks and Planning Commission in Prince George’s and Montgomery Counties. While principal homeowners are generally protected from large increases in property taxes, principal homeowners subject to property taxes levied by bicounty commissions were not protected from increases in the commission property taxes until this bill passed.
&lt;strong&gt;HB 6 – Property Tax – Notice – 60 Day Appeal&lt;/strong&gt;
STATUS: PASSED – Effective October 1, 2010
Requires all residential contracts of sale to contain a notice informing the buyer of his/her right to challenge the tax assessment of the property within 60 days of purchase. The contract must contain a statement in substantially the same form as the following: “If any real property is transferred after January 1 and before the beginning of the next taxable year to a new owner, the new owner may submit a written appeal as to a value or classification on or before 60 days after the date of the transfer.” 
&lt;strong&gt;HB 62 – Septic Systems – Nitrogen Removal Technology&lt;/strong&gt;
STATUS: PASSED – Effective October 1, 2010
Requires that MDE provide grants for 100% of the cost differential between a conventional septic system and one utilizing nitrogen reduction technology when a homeowner is required to replace a septic system in Maryland’s Critical Areas. This legislation clarifies the law that was passed last year but which did not provide a statutory guarantee for the cost-differential grants. The grants must be paid until 2012 when the program will be reevaluated.
&lt;strong&gt;HB 1382/SB 554 – Rental Housing – Lease Termination for Domestic Violence Victims&lt;/strong&gt;
STATUS: PASSED – Effective October 1, 2010
Allows a victim of domestic violence or sexual assault to terminate a lease if granted a final protective or peace order by a court. As introduced the legislation would have created a new protected class for domestic abuse and sexual assault victims for all housing. &lt;div&gt;&lt;strong&gt;Maryland Association of Realtors &lt;/strong&gt;Priorities-

&lt;a href="http://mlis.state.md.us/2010rs/billfile/hb0590.htm"&gt;HB 590/SB 657&lt;/a&gt; -- &lt;strong&gt;Prohibit the Taxation of Forgiven Debt in Short Sales – SUPPORT&lt;/strong&gt;
Last fall, three counties (Anne Arundel, Prince George’s and Montgomery) implemented a policy that imposed recordation and/or transfer taxes on the forgiven debt in short sales transactions. HB 590/SB 657 make clear that recordation and transfer taxes may not be imposed on the forgiven debt in short sale transactions. Short sales, like other real estate transactions, may only be taxed on the consideration. The passage of this legislation follows an Attorney General Opinion issued at MAR’s Legislative Day that also deemed the Counties’ practices unlawful.
STATUS: Passed – Effective on the date the Governor signs the bill into law.
&lt;a href="http://mlis.state.md.us/2010rs/billfile/hb1298.htm"&gt;HB 1298/SB 666&lt;/a&gt; -- &lt;strong&gt;Prohibit Private Transfer Fees – SUPPORT&lt;/strong&gt;
Several states have passed legislation prohibiting the imposition of private transfer fees on property. Those fees can be as high as 1% of the purchase price. Developers and some individual sellers often share the revenue with the commercial entity that creates it. MAR believes PTFs reduce transparency in real estate transactions, impose complexity on transactions which will increase with time, and cost buyers money in higher closing costs and lost equity. HB 1298/SB 666 prohibits the imposition of PTFs on property in Maryland.
STATUS: Passed – Effective on the date the Governor signs the bill into law.
&lt;a href="http://mlis.state.md.us/2010rs/billfile/hb0062.htm"&gt;HB 62&lt;/a&gt; --&lt;strong&gt; Septic Legislation Correction - SUPPORT&lt;/strong&gt;
The Maryland General Assembly passed legislation in 2009 which required homeowners living in Maryland’s Critical Areas to install nitrogen reduction technology when replacing a failing septic system. Although the legislation was passed with the understanding that grants would cover the cost difference of the new technology, the Maryland Department of the Environment changed the loan terms forcing most families to incur thousands of dollars in extra costs. In response to the introduction of HB 62, MDE reversed course and is now providing full grants for the cost differential to those homeowners living in Maryland’s Critical Areas. HB 62 clarifies in statute that MDE must continue to provide full grants through 2012, at which time the grants and program funding will be reevaluated.
STATUS: Passed – Effective October 1, 2010
&lt;a href="http://mlis.state.md.us/2010rs/billfile/hb0999.htm"&gt;HB 999/SB 686&lt;/a&gt; -- &lt;strong&gt;Storm Water Management Fees - OPPOSE&lt;/strong&gt;
MAR opposed similar legislation last year. These bills would have required all residential and commercial properties to pay a stormwater “fee” even if those properties already manage all of their stormwater on-site. There are already multiple layers of tax on real property and MAR opposed these bills again this year.
STATUS: Not Passed.
&lt;a href="http://mlis.state.md.us/2010rs/billfile/hb1209.htm"&gt;HB 1209/SB 1083&lt;/a&gt; -- &lt;strong&gt;Semi-Annual Taxation for Non Owner-Occupied Properties - SUPPORT&lt;/strong&gt;
All owner-occupied residential properties in Maryland pay their property taxes semi-annually or may choose to pay the full payment in advance. Non owner-occupied properties in Maryland, however, do not have the option of paying their property taxes semi-annually. Given the state of the economy, many businesses and investors would benefit from semi-annual payments. Although the Legislature was unwilling to pass HB 1209/SB 1083 as introduced, it passed a more limited semiannual bill which MAR also strongly supported. &lt;a href="http://mlis.state.md.us/2010rs/billfile/hb0484.htm"&gt;HB 484&lt;/a&gt; requires counties to convert small business property to a semiannual tax payment schedule. A small business is a commercial property with a property tax bill of no more than $50,000 a year.
STATUS: HB 484 Passed. Effective October 1, 2010.
&lt;a href="http://mlis.state.md.us/2010rs/billfile/hb1291.htm"&gt;HB 1291/SB 952&lt;/a&gt; -- &lt;strong&gt;Energy Disclosure for Maryland Properties - OPPOSE
&lt;/strong&gt;The Maryland Energy Administration introduced legislation to require the disclosure of utility bills to all homebuyers in Maryland. Although MAR was initially opposed to the specific approach taken by these bills, MAR worked with the Energy Administration on an alternative approach. However, those amendments were not ultimately accepted by the Committees and the legislation died.
STATUS: Not Passed.&lt;/div&gt;

&lt;/div&gt;&lt;div&gt;Anne Arundel County recently made the decision to collect taxes on “Short Sale” sales based not on the contract price, but on what the sellers owe on their mortgages at the time the purchase offer was accepted.
&lt;/div&gt;&lt;div&gt;“Short sales” are homes that sell for less than the balance due on the loans.
Buyers and sellers are already being squeezed, and this is just an extra tax nobody saw coming or prepared to pay.
Anne Arundel County said it is charging recordation tax of $3.50 for every $500 on the sales price plus any forgiven debt.
If the lender has indicated that it will go after the seller for the remainder owed, then the county will tax just the contract price. The Anne Arundel County officials, say it’s not a new policy and the county is simply following state law.
However, the Maryland Association of Realtors said the county began requiring the extra money last week without warning.
Some deals are still in limbo as title companies and agents scrambled to figure out how much was owed and who would be paying those extra charges.
Taxes collected on home sales are typically split between buyers and sellers.
An example of the recordation and transfer taxes add up to $1,100 on $50,000 of forgiven debt.
Other counties aren't collecting transfer and recordation taxes on forgiven debt. Montgomery County was considering it recently but decided to wait on legal advice and "further clarification.
The Maryland attorney general's office said it is researching the issue and expects to weigh in shortly.&lt;/div&gt;

&lt;/strong&gt;Property tax bills usually come due once or twice a year. Your local government needs every dime it can collect to pay for all of the services you expect as a resident: schools, libraries, hospitals, and so on. A healthy chunk of that revenue is raised from homeowner’s property taxes. In a healthy market real estate values climb steadily, allowing local governments to take in a little more every year to keep up with inflation.
When real estate values are in decline local governments generate less revenue from property taxes, meaning the tax rate needs to go up, the money needs to come from somewhere else, or spending on services needs to go down. According to a 2009 survey conducted by the National Association of Counties, 62% of counties polled say declining property taxes are a major source of revenue shortfalls. Forty-two percent of counties have cut services, and 11% have raised property taxes.
Assessment
No matter if property values are rising, falling, or stagnant, you need to understand how you’re being taxed. Everything starts with your real estate assessment. Depending on where you live, it will have a legal description of your house and separate values for the land and structure. Add those two numbers together to get your home’s assessed value. Top 10 Frequently asked Short Sale Questions:
1. &lt;span style="color:#990000;"&gt;What is a real estate short sale?&lt;/span&gt; A real estate short sale is a form of agreement between the seller of a home in the beginning stages of foreclosure and their lender, allowing the home to be sold for less than the existing loan balance outstanding. The mortgagee would accept less than the loan amount in order to avoid a foreclosure proceeding. This short sale would result in a substantially discounted purchase price for the buyer of the home. The buyer would then proceed with the purchase of the home much the same as in any conventional realty transaction.
2. &lt;span style="color:#cc0000;"&gt;How late in the pre-foreclosure process can you start a short sale? &lt;/span&gt;Depending on individual state law and regulations, a foreclosure can proceed as quickly as 35 days from the date the notice to the borrower is filed. For that reason, time is of the essence and you should allow a window of no more than 60 days to effectuate a lender approved short sale.
&lt;span style="color:#990000;"&gt;&lt;span style="color:#000000;"&gt;3&lt;/span&gt;. Will a lender allow a real estate short sale when the seller has some a good amount of equity?&lt;/span&gt;If the home has some considerable amount of equity, the lender may choose to continue with a traditional foreclosure proceeding to regain title to the property and dispose of it at a market price. Given the current state of affairs with the real estate market, the home will most likely be over encumbered, hence the reason for the short sale in the first place. A glut of homes for sale in the market area of the home may make the lender think twice about taking title to the property.
&lt;span style="color:#cc0000;"&gt;&lt;span style="color:#000000;"&gt;4.&lt;/span&gt; What documents are necessary to proceed with a short sale?&lt;/span&gt; The individual documents necessary to proceed with the short sale will depend on the lender. Typically the lender will require hardship letter detailing the circumstances behind the short sale. A signed, valid purchase and sales contract, preliminary HUD-1 settlement statement and a preliminary estimate of proceeds to the lender. There may be additional requests for more detailed information on the financial condition of the seller, ie; pay check stubs, bank statements, a personal financial statement and monthly budget assessment, amongst other things.
5. &lt;span style="color:#990000;"&gt;Will the seller’s credit rating be affected if they allow a short sale on their property to occur?&lt;/span&gt;While it is up to the individual lender to decide what to report, what often happens is the loan will report as "paid" on their credit report. While that good news the bad news is that there will likely be a reference that says "settled for less than originally owed" or something similar. It is certainly more advantageous to have the short sale referenced than to have a foreclosure on their credit report.
6. &lt;span style="color:#cc0000;"&gt;Will a lender allow the seller to make a profit on a short sale?&lt;/span&gt; By the nature of the transaction, the seller is not going to make a profit on the short sale. They may have extracted equity from a previous refinance of the home, but their current loan balance will be higher than the selling price of the home.
7. &lt;span style="color:#990000;"&gt;If a seller is in bankruptcy, will that affect the short sale of the property?&lt;/span&gt; Absolutely, as most lender would not consider a short sale if the homeowner is in the middle of a bankruptcy proceeding. Negotiating a short sale between the parties is considered a collection activity and such a negotiation is prohibited in bankruptcy.
8. &lt;span style="color:#cc0000;"&gt;Will the bank or lender require an appraisal on the home in a short sale?&lt;/span&gt; Most lenders will require that a full appraisal be submitted in the short sale package. Some may only require a BPO or brokers price opinion. The lender will need some formal assessment of the value of the home in order to make a decision as to accept or reject the short sale offer.
9. &lt;span style="color:#cc0000;"&gt;Are there tax implications in the short of real estate?&lt;/span&gt; Much like the issue of credit reporting, the circumstances are individual to the lender. As a short sale represents a loss for the lender, they can report the amount lost a debt forgiveness to the seller. If a formal tax form 1099 is filed, the seller may be responsible for paying taxes on the amount of debt forgiveness.
10.&lt;span style="color:#cc0000;"&gt;Why would a lender allow a short sale to occur?&lt;/span&gt; Quite simply, it may benefit all the parties involved in the transaction. The seller is relieved of the home they cannot afford. A costly foreclosure proceeding by the lender is avoided and the buyer purchases the home at an attractive price.
