SUMMER OF EU REFORM

The European Parliament is on recess and most of the Commission civil servants are somewhere in their native countries. The summer is a great moment to lay on the beach and think about the next Treaty change, and what should be in it. The whole of summer I will blog about reform options of the EU. Some of the ideas will be radical, others will be more incremental. To kick it off I will grab the bull by its horns

How to make the EU more transparent.

Roll call voting in the Parliament Committee’s

At this moment roll call votes or electronic voting is not possible in the European Parliament committee's. Meaning that after voting has taken place there isn't a registration showing who exactly voted in which way. In this way we cannot hold individual MEP's accountable for their voting paterns in the EP Committee's. Because committee's have such a great influence on the decisive vote in the plenary, transparency would benefit a great deal if we knew the individual positions of members of parliament in the individual committee's. An effort by the British MEP Andrew Duff to change this was rejected by the EP constitutional affairs committee. Some MEP's argued that it would be technically difficult to implement, which of course is baloney.

Limit trialogues

Before Lissabon, trialogues were something reserved for the final stages of the co-decision process. If the first reading and second reading failed, council, commission and parliament would enter into trialogues in the last stage to make ammends.Nowadays, 58% of all legislation is finished by first reading, meaning that a lot of decision making is made during trialogue meetings before the piece of legislation even gets to the first reading vote. While it is understandable that for complex issues or controversiel issues it is easier to reach a compromise behind close doors, trialogues kill public debate and make it very difficult to scrutinize individuals MEP's.

Dualism; True seperation of the exective and the legislative

While limiting trialogues will surely improve transperency, it would only be treating the symptoms of a much larger problem; the fact that in Brussels, informal processes grreatly hamper the seperation of powers. Because MEP's, political advisors are in constant contact with the Commission or Council services, public debates are rendered useless. In fact public debates in committee meetings are used to sum up what is agreed behind closed doors, not to have a hounest debate. If Brussels is serious about transperency it should take the Dutch example, where civil servants are forbidden to talk to Members of Parliament and vice versa.

Bring back the e-mails!

While I still can use the WHO is WHO in the EU directory, I think it is a serious setback to democracy that the European Parliament deleted the email adresses of the MEP's from their profile page. While serious lobbyists and interest representatives will already have all the MEP' emails (and of their assistants) , ordinary citizens will have a more difficult time to contact "their" member of parliament.

Alternative guide for when friends visit you in the EU Bubble

When working in the EU bubble, you are bound to have friends over from your hometown or from your Erasmus year ;-). After a while you get weary from visiting the Grande Place and the Atomium for the hundredth time. This guide is designed to provide an alternative. Visit some of the beautiful parks

Brussels has a couple of beautiful green strips, Park Cincquantenaire obviously being the most impressive. In summer there are a lot of events going on, so be sure to be on the lookout for the occasion’s environment party or the annual summer party. Another cool feature of Park Cinquantenaire is its landmark Arch, which gives a spectacular view on top (entrance for free through the museum). The Ambiorix Square is also marvelous and might be on route when walking from Cinquantenaire to the City center. Another gem is the Elisabeth Park.

Visit other landmarks

Basiliquee National Basilica of the Sacred Heart in Koekelberg is one of the great landmarks of

Brussels. It is the fifth longest Church in the world, and you’ll be surprised by the interior architecture which is made entirely in art-deco style.

Legendary cafes and restaurants

To experience Brussels, one really needs to visit some of the legendary cafes and brasserie. Brussels is full of places which have been around for more than a century. The Hotel Metropol for example is one of those great institutions of Brussels. Big Lebowski's favorite cocktail -The white Russian- was actually invented in Hotel Metropol. Don’t sit in the brasserie, opt for the inside lounge instead. Mort Subite is also a diner with a long tradition, and a story. Het Goudblommeke van Papier is not far from the center, and is the place where the surrealistic movement of Brussels has its roots. Finally, in the evening go to L'Árchiduc which is my second favorite bar in the world.

Explore Brussels by public transport

Yes the hops on hop off bus provides for an instant tourist fix, but why not buy a day pass for the general public transport and design your own route? Brussels bus lines go from one end of the city to the other, and armed with a map you can go urban exploring. At the same time you can design your own hop off moments and explore the communes. My favorite public transport rides are;

Markets

Brussels doesn’t have a shopping center which is worth the bother, and the main shopping street - ------Nieuwstraat- is a nightmare on a Saturday. Why not visit a market instead? The markets of Brussels provide for a couple of hours of fun and food and are a refreshing alternative to cramped shopping. The antiques market of the Vosseplein is filled with curious object, and even you don't buy anything you'll be digging for treasures for a couple of ours. The Abbatoirs, or the Anderlecht Market is a market in the more traditional sense of the word. Open on Saturday and Sunday, it is the ideal place to show your friends how well, integrated you are buy buying fresh veggies in Anderlecht.

De Unie in Week 29: Laatste week voor het reces

Dit is het laatste week voor het reces. Het is tevens een "groene week", oftewel een week waarin Europarlementariërs de gelegenheid krijgen om hun achterban de ontmoeten of een werkbezoek af te leggen. Marije Cornelissen is bijvoorbeeld in Barcelona om voedselbanken te bezoeken, Gerben Jan Gebrandy van D66 is in Vilnius vanwege de Informele Milieuraad en Esther de Lange bezoekt Europol voor gesprekken over voedselfraude. De lobbyisten in Brussel gaan op vakantie op doen achterstallig archiveringswerk.

In Vilnius vinden er nog twee informele raden plaats; de eerder genoemde Informele Milieuraad, en een Informele Raad Justitie en Binnenlandse Zaken.

September.

September zal een drukke maand worden. In november moet het MFK afgetikt worden in de plenaire. Dat betekent dat in oktober alle Commissies hun individuele verordeningen in de plenaire van oktober gebracht moeten hebben. Om dit mogelijk te maken moet alles eerst afgestemd zijn in de individuele Parlementaire Commissies van september. Iedereen die in de REGI, AGRI, ITRE zit zal het dus vreselijk druk hebben in september.

Tijd: Vriend en Vijand van de EU Lobbyist

Iedereen in Brussel is lobbyist. De Europese Commissie, Europarlementariërs lobbyen, de Raad, de en uiteraard de lobbyisten lobbyen zelf. Alleen Ruwi de bloemenverkoper op Schuman is geen lobbyist. Een van de meest krachtige instrumenten in de Europese Arena is tijd en timing. Gek genoeg vinden wij weinig in de vakliteratuur over het bewust gebruiken van tijd en timing bij het lobbyen in Brussel. Misschien omdat het juist de instellingen en niet de lobbyist is die dit instrument aanwenden. Maar misschien is het daarom juist belangrijk om te weten hoe tijd en timing aangewend wordt om beleid te beïnvloeden.

Wie bepaald het tempo?

De Commissie?

De Europese Commissie heeft het alleenrecht om beleid- en wetsvoorstellen te doen. Vaak zijn zij verplicht om eerst belanghebbende te consulteren. In het verleden is het vaak gebeurt dat op bepaalde wetsvoorstellen de Europese Commissie raadplegingen lanceert op uiterst ongelukkige momenten. Net voor kerstmis of voor de zomervakantie. Als het wetsvoorstel eenmaal gepubliceerd is bepalen Raad Parlement hun eigen tempo.

De Raad?

Bij de Raad is het Voorzitterschap cruciaal bij het vaststellen van de agenda. Voelt een voorzitterschap weinig voor een wetsvoorstel dan kunnen zij besluiten dat er geen beslissing genomen wordt tijdens het voorzitterschap maar dat slechts de voortgang besproken wordt. In sommige extreme gevallen, als er veel oppositie is in de Raad, dan zal het voorzitterschap überhaupt niet geneigd zijn om een wetsvoorstel op de agenda te zetten. Deze mogelijkheid bestaat omdat in de eerste lezing geen deadline bestaat voor het behandelen van een wetsvoorstel.

Het Europees Parlement?

Bij het Europees Parlement is de rapporteur de sleutelfiguur die beslist met welke snelheid een wetsvoorstel door het Parlement geloodst wordt. Hij zal dit doen in samenspraak met de admin die aan hem is toegewezen door de EP commissie secretariaat. De admin zal de wensen van de rapporteur vertalen in een tijdspad waarop de volgende zaken moeten gebeuren; rapport naar de vertaling sturen, begindatum voor amendementen, deadline voor amendementen, behandeling in de parlementaire commissie, stemmen in de commissie en stemmen tijdens de Plenaire. Omdat het proces in Brussel per definitie lagentermijn is, moet de admin dit allemaal al maanden van tevoren regelen. Een bekende tactiek van rapporteurs die geen bemoeienis willen is de periode voor het indienen van amendementen zo on-practisch mogelijk maken. Zo heb ik op dit moment te maken met een dossier, waarbij de rapporteur zijn rapporteur openbaar maakt 1 week voor het reces, waarna geamendeerd kan worden in de eerste twee weken na de zomervakantie, waarvan de tweede week een Straatsburgweek is. De lat licht dus hoger als het gaat om persoonlijke afspraken met Europarlementariërs maken, tenzij je bereidt bent om naar Straatsburg af te reizen.

Aan de andere kant bestaan er binnen het Europees Parlement ook vertragingstechnieken. Om tijd te besparen wacht men niet op de vertalingen in alle 27 landen bij elke behandeling. Echter volgende EP rules of procedure kan uitstel van behandeling afgedwongen worden als een Europarlementariër verzoekt om niet verder te gaan zolang er geen versie in zijn taal bestaat.

Vertragen en versnellen

Daarnaast zijn er een aantal ingebouwde tijds-mechanismen in de EU. Het jaarlijkse budget van de EU wordt via een stramien vastgesteld met een aantal wettelijk bepaalde deadlines. Dit is om druk op de onderhandelaars te zetten zodat zij eruit komen. Verkiezingen brengen ook een bepaalde tijdsdruk met zich mee. Voorzitterschappen willen alles wat ze in hun brochures hebben beloofd nakomen voordat ze voorzitter-af zijn. En zo zijn er nog meer momenten in het Europese beleidsproces waar tijd en timing een cruciale rol speelt. De rol van de lobbyist daarin? Vooral zorgen dat je geen slachtoffer wordt.

De Unie in Week 28

Deze week kunnen exotische Nederlanders gespot worden in het Europees Parlement; Anouscka van Miltenburg praat op maandag met voorzitter Martin Schulz, terwijl op dinsdagochtend Minister Dijsselbloem -in de vroege ochtend- een bakje koffie drinkt met de voorzitter van het EP.

Het is overigens de laatste Commissieweek in het Europees Parlement. Dat betekent dat er nog een aantal zaken afgetikt moeten worden. De REGI Commissie zal stemmen over de verschillende structuurfondsenverordeningen. In principe wordt er verwacht dat dit een formaliteit is, sinds alle onderhandelingen en discussies reeds in de trielogen met de Raad hebben plaatsgevonden. De visserijcommissie zal een marathonsessie houden over het Europees Maritiem en Visserij Fonds. Er zijn namelijk 2475 amendementen voorgesteld

De Europese Commissie heeft deze week ook een consultatie gelanceerd over het stimuleren van duurzame phosphaat in Europa. De consultatie is te vinden op;

Week 29 is een achterbanweek, hetgeen betekent dat Europarlementariers evenementen bezoeken in Nederland, of ze zijn op fact-finding-missions ergens in de wereld.

Prioriteiten van het EU Voorzitterschap van Litouwen

Op 1 juli is Litouwen voorzitter geworden van de Europese Raad. Ondanks de hervormingen van het verdrag van Lissabon blijft een voorzitterschap belangrijk. Tijdens zo een voorzitterschap mag en kan een land de agenda en tempo van de Europese Raad bepalen. In goed overleg met eerdere voorzitterschappen en de andere Europese instellingen wordt een prioriteitenlijst opgesteld. In een notendop; de Litouwers lijken voornamelijk van plan om lopende zaken af te handelen zoals het meerjarig EU Budget en de verordeningen die daarbij gemoeid zijn (cohesiebeleid, landbouw, visserij). Daarnaast staat energie hoog op de agenda van de Litouwers.

Het Litouws voorzitterschap organiseert haar voorzitterschap rondom drie pilaren;

Een geloofwaardig Europa
Een Groeiend Europa
Een Open Europa

Een geloofwaardig Europa

Litouwen heeft e ambitie om tijdens haar voorzitterschap verder te gaan met het in orde maken van de Europese financiën. Het vervolmaken van de Europese Economische en Monetaire Unie is daarin een speerpunt. Litouwen zal proberen verder te komen bij het opzetten van een Europese Bankenunie. Betere economisch bestuur is daarbij onmisbaar. Het implementeren van gemaakte afspraken rondom het Europese semester, het monitoren van de eurolanden en de uitvoering van specifieke landenaanbevelingen zijn een aantal thema's die behandelt zullen worden tijdens het Litouws voorzitterschap. Ook hoog op de agenda staat het bestrijden van belastingfraude. Litouwen zal de discussie rondom het automatisch delen van belastinggegevens tijdens haar voorzitterschap aanzwengelen.

Een groeiend Europa

De Litouwers willen de onderhandelingen rondom het Meerjarig Financieel Kader afronden. Het Iers voorzitterschap sloot een deal met het EP wat betreft de algemene kaders van het MFK, maar er moeten nog zo een 70 verschillende wetteksten afgehandeld worden die direct met het MFK te maken hebben. De verordeningen rondom de structuurfondsen bijvoorbeeld. Het Litouws voorzitterschap zal ook het budget voor 2014 moeten vaststellen, het eerste jaar van de nieuwe budgetaire periode.

Een ander belangrijk onderwerp van deze pijler is de digitale agenda en het stimuleren van onderzoek en innovatie. De Litouwers willen bijdragen aan het creëren van een interne digitale markt. Zij hopen de komende zes maanden te overeenstemming te bereike over afspraken rondom elektronische identificatie en diensten die vertrouwen op het internet moeten stimuleren. Op 6 en 8 november 2013 zal er in Litouwen een internationale ICT conferentie plaatsvinden. In datzelfde kader zullen de Litouwers ijveren om de interne markt te vervolmaken. Elektronisch aanbesteden is bijvoorbeeld een thema wat op de agenda zal staan de komende half jaar.

Energy is wellicht het meest belangrijke thema van het Litouws voorzitterschap. Dat is ook niet vreemd, want zij proberen al jaar en dag onafhankelijker te worden van Rusland. Litouwen is voor 90% afhankelijk van Russisch gas. Daarom zal het energy vraagstuk een aantal keer terugkomen tijdens het voorzitterschap. Litouwen is voornemens de eerste lijst van prioritaire Europese energyprojecten tijdens hun voorzitterschap te behandelen. Andere onderdelen van deze pijler zijn het bestrijden van Jeugdwerkeloosheid, en de rechen van migrante arbeiders. Speciale aandacht gaat uit naar macro-regio's. Een grote conferentie speciaal geweid aan dit concept zal op 11 november georganiseerd worden in Vilnius. Als laatst willen de Litouwers onder deze pijler ook wat aandacht schenken aan landbouw en visserij.

Open Europa

De Litouwers willen aandacht voor het Europees Oostelijk Partnerschap. Dit is een instrument om de betrekkingen met Europa's oostelijke buurlanden collectief te smeden. Niet gek, want Litouwen heeft historisch en geografisch gezien veel van doen met landen zoals Rusland, Ukraine en Wit-Rusland. Speciale aandacht gaat uit naar kandidaat-landen Montenegro en Turkije. Naast nabuurschap en uitbreiding staat ook handel hoog op de agenda. Litouwen zal tijdens haar voorzitterschap verder gaan met de onderhandelingen met Japan en de V.S over een vrijhandelsakkoord.

Europese Verkiezingen 2014: Groenlinks Europa Pamflet

Op 22 Mei gaan wij weer naar de stembus om onze Europese volksvertegenwoordigers te kiezen. Inmiddels broeit het bij de verschillende partijen. Kandidaatlijsten moeten worden opgesteld, lijsttrekkers moeten worden gekozen en verkiezingsprogramma's zullen worden geschreven. Groenlinks is voortvarend van start gegaan met een Europa Pamflet; Macht pakken met Europa

Met het pamflet wil Groenlinks een Europese toekomstvisie schetsen. Het pamflet gaat daarom niet teveel in op specifieke beleidsvelden, maar is meer een stip op de horizon. In het pamflet hekelt Groenlinks de subsidiariteitslijstjes van Sybrand Buma, en wordt premier Rutte bekritiseert om zijn uitspraak dat het nu geen tijd is voor vergezichten als het om Europa gaat. Het pamflet komt hier een aantal maal op terug.

De titel van het Pamflet (Macht pakken met Europa) is de rode draad van het document. Europa zou geëquipeerd moeten worden om een aantal macro-uitdagingen aan te kunnen; De Economische Crisis, klimaatverandering, maar ook het verdedigen van de mensenrechten en de European way of life. Veel aandacht gaat in het pamflet uit naar het oplossen van de crisis. De keuzes van Groenlinks zijn daarin helder; Er moeten Euro-obligaties komen, belastingontduiking moet samen worden opgepakt en de bankenunie moet worden vervolmaakt. Daarnaast moet er een Europese stroppenpot komen om banken in nood te helpen. Groenlinks windt er geen doekjes om; Dit gaan leiden tot meer Europa.

Uiteraard krijgt groene innovatie ook prominente plek in het pamflet, met een verwijzing naar een wel heel actueel onderwerp; Het repareren van het Europees Handelssysteem voor Emmissierechten. En passant; Hier wordt deze weekover gestemd .

Gekozen voorzitter van de Europese Commissie

Het pamflet doet ook een aantal concrete suggesties om de democratische controle in Europa te versterken. Het Europees Parlement zou de Supercommissaris voor Economie en Monetaire Zaken weg moeten kunnen sturen. Bovendien is Groenlinks een voorstander van een gekozen voorzitter van de Europese Commissie. Alle Europese partijen zouden een kandidaat naar voren moeten schuiven, waarna deze door heel Europa met elkaar het debat aan zouden moeten gaan.

Op 14 december zal Groenlinks haar programma voor de Europese verkiezingen publiceren. Met dit pamflet is in ieder geval een schot voor de boeg genomen.

De Unie in WEEK 27

Week 26 is een spannende week. Croatie wordt, lid, Litouwen wordt voorzitter en het Europees Parlement stemt over een aantal belangrijke zaken.

In Straatsburg zal het Europees Parlement stemmen over een aantal belangrijke zaken zoals;

Backloading ETS: Een amendement om CO2 rechten te onthouden om de prijs van emmissierechten te doen stijgen.
MFK: het Europees Parlement stemt over het gesloten akkoord tussen raad en parlement op het meerjarig financieel kader.
Vorige week sloten onderhandelaars van het Parlement en de Raad een akkoord over het MFK. Hierover zal op dinsdag in Straatsburg gestemd worden. Echter op vrijdag was de definitieve tekst van het akkoord nog niet beschikbaar. Er staan uiteraard nog een aantal andere zaken op de agenda.Het Parlement ook stemmen wie de nieuwe Europese Ombudsman wordt. In de running zijn twee Nederlanders; Ria Oomen en de huidige Nederlandse Ombudsman Alex Brenninkmeijer.

Naast de bovenstaande stemmingen zal er gedebatteerd worden over rapporten aangaande de registratie van voertuigen geimporteerd uit andere lidstaten, het rapport over Havendiensten en het rapport van Bartolozzi over de Bioeconomie.

Ook niet geheel onbelangrijk is een verslag over hoe Europa moet reageren op de verhoging van import-accijnsen die Noorwegen onlangs heeft ingevoerd.

Vooruitblik op week 28

Week 10 is een Commissie week in het Europees Parlement.De meeste Commissies komen bijeen omdat het de laatste Commissie bijeenkomsten zijn voor het reces.

De Unie in WEEK 26

Deze week is een fractieweek in Brussel. Dit betekent dat in het Europees Parlement de fracties de kans krijgen om hun Straatsburgweek voor te bereiden. Daarnaast zijn er een beperkt aantal Commissies in het Europees Parlement die bijeenkomen.

Johannes Hahn, Eurocommissaris voor regionaal beleid is in Amsterdam, om burgemeester Eberhard van de Laan te ontmoeten en om een Europees gefinancierd project te bezoeken.

Het nieuws in Brussel wordt nu beheerst door het akkoord (of het ontbreken van het akkoord op het meerjarig financieel kader). Vorige week riep het Iers voorzitterschap uit dat er een akkoord was bereikt, terwijl leden van het EP onderhandelignsteam het hier niet mee eens waren. Een van de onderhandelaars Reimer Boege legde zijn functie als onderhandelaar neer uit protest tegen het "akkoord". Deze week zal het akkoord in de verschillende fracties besproken worden.

Op 24 juni zullen onderhandelingen over het Gemeenschappelijk Landbouw Beleid zich voorzetten, deze keer in Luxemburg. De onderhandelingen zijn in hun laatste fase gekomen. Verwacht wordt dat er nog over de laatste open eindjes onderhandeld zal worden. Raad en Parlement konden het voorheen niet eens worden over de volgende zaken;

-Het totale budget voor het Gemeenschappelijk Landbouwbeleid

-Maximum aan subsidies wat een landbouwer kan krijgen; Commissie stelde 100.000 Euro voor, maar de Raad is tegen elke vorm van begrenzing. Een nieuw idee is om de een grens te stellen aan 150.000 Euro. Alles wat daar overheen gaat, zal overgeheveld worden naar projecten binnen het Europees Landbouwfonds voor Plattelandsontwikkeling.
-Hoewel zowel Raad als Parlement sympathiek tegenover jonge en kleine landbouwers staan, zijn zij er niet over eens of hulp aan eerdergenoemde verplicht of vrijwillig zou moeten zijn.
-De vergroening blijft een twistpunt. De lidstaten willen meer flexibiliteit om op hun eigen manier dit in te vullen. De vraag is of het voorgestelde certificereingssysteem aangenomen zal worden.

Deze week staat Brussel op zijn kop vanwege de European Sustainable Energy Week. Er zullen heel veel bijeenkomsten georganiseerd worden om duurzame energie te promoten. De Provincie Zeeland organiseert samen met het FREE netwerk een bijeenkomst over het financieren van energieprojecten op het platteland met behulp van Europese middelen. Informatie en aanmelden:

Down the road

Week 27 is een Straatsburg week. Op de agenda staan onder andere stemmingen over rapporten op het gebied van de bio-economy, kust-toerisme, registratie van buitenlandse auto's en bovendien zal het Iers voorzitterschap ge-evalueerd worden en zal er een blik geworpen worden op het Litouws voorzitterschap. Op 10 juli za er gestemd worden in de REGI Commissie over de verordeningen die alle structuurfondsen beheerse. Ook het rapport van Lambert van Nistelrooij zal behandeld worden.

Hoe stop je een Europees wetsvoorstel

Soms is een Europees wetsvoorstel zo problematisch dat bijsturen via amandementen niet toereikend is. In dat geval: "The proposal needs to go". Er zijn een aantal manieren om een Europees wetsvoorstel te stoppen. In tegenstelling tot het Amerikaans congres hebben we in EU-ropa geen fillibuster. Er zijn echter wel degelijk mogelijkheden. Hieronder een aantal suggesties. Er zijn ook manieren om een wetsvoorstel te vertragen, maar daar zal ik een aparte EU KNOW HOW voor schrijven.

Gele en Oranje kaart Procedure

Het subsidiariteitsbeginsel moet garanderen dat besluiten op een zo laag mogelijk niveau (zo dicht mogelijk bij de burger) worden genomen. Een besluit mag alleen op Europees niveau genomen worden, als dat niet net zo goed op landelijk, provinciaal of gemeentelijk niveau kan gebeuren. Om te beslissen of een voorstel van de Commissie wel of niet op Europees niveau behandeld mag worden, kan een subsidiariteitstoets uitgevoerd worden.

Nationale parlementen mogen via een brief bezwaar aantekenen als zij vinden dat een Europees wetsvoorstel het beginsel van subsidiariteit schendt. Wanneer meer dan één derde van de nationale parlementen de subsidiariteitstoets negatief beoordeeld, moet de Commissie het voorstel herformuleren. Dit wordt ook wel de zogenaamde gele kaart-procedure genoemd. Bij voorstellen op het terrein van justitie en politie is overigens een kwart van de stemmen genoeg.

Deze procedure bestaat sinds het Verdrag van Lissabon, maar is pas een keer tot een succesvol einde gebracht: in september 2012 werd het voorstel van de Europese Commissie om werknemersrechten op gelijke voet te stellen met de vrijheid van bedrijven om zich overal te vestigen, is teruggetrokken dankzij verzet van nationale parlementen en het Europees Parlement.

Het subsidiariteitsbeginsel biedt vooral de mogelijkheid de invloed van de Commissie en andere instellingen af te bakenen op terreinen waar de bevoegdheden van de Unie en de nationale lidstaten elkaar raken of overlappen. Dit ligt vaak politiek gevoelig. Als meer dan de helft van de nationale parlementen plus ofwel de Raad of het Europees Parlement een negatieve subsidiariteitsbeoordeling geeft, wordt het voorstel teniet gedaan. Dit is de oranje kaart-procedure. Tot op heden is dit echter nog niet voorgekomen.

Een verzoek tot een subsidiariteitstoets kan al direct na het publiceren van het werkplan van de Commissie ingediend worden door de Tweede Kamer. Een tweede mogelijkheid is om het verzoek in te dienen nadat het voorstel is gepubliceerd door de Commissie. In het verleden is gebleken dat met name dossiers op het vlak van Ruimtelijke Ontwikkeling en Sociale Zaken in aanmerking komen voor een subsidiariteitstoets.

Blokkerende Minderheid

Sinds het Verdrag van Lissabon is de gekwalificeerde meerderheid (in combinatie met medebeslissingsrecht voor het Europees Parlement) de standaardprocedure voor de aanname van wetten. Onder gekwalificeerde meerderheid van stemmen wordt verstaan ten minste 55% van de leden van de (Europese) Raad. Daarnaast moeten deze meerderheid bestaan uit minimaal vijftien lidstaten; en moeten deze lidstaten samen ten minste 65% van de bevolking van de Unie vertegenwoordigen.

Binnen de Raad van de Europese Unie (de 'Raad van ministers') heeft elke land een bepaald aantal stemmen. Sommige landen hebben echter een zwaardere stem dan andere. Dit is gebaseerd op het aantal inwoners en gecorrigeerd in het voordeel van de landen met minder inwoners. Het totaal is 345 stemmen. Wanneer de Europese Raad besluit met gekwalificeerde meerderheid van stemmen, maakt zij gebruik van dezelfde stemverdeling als de Raad van Ministers.

Een besluit van de Raad bij gekwalificeerde meerderheid kan worden tegengehouden door een zogenaamde blokkerende minderheid. Deze moet bestaan uit minsten vier leden van de Raad. Voor deze blokkerende minderheid moeten de blokkerende landen daarnaast minstens 91 van de 345 stemmen hebben (in een Unie van 27 lidstaten) of 38 procent van de EU-bevolking vertegenwoordigen. In 2014 zullen de regels de regels voor de stemmenweging veranderen.

Niet op de agenda van de Raad zetten

Doordat er in de eerste lezing van de normale legislatieve procedure geen deadline is voor de Raad om tot een positie ten aanzien van een Commissievoorstel te komen, bestaat de merkwaardige mogelijkheid om Commissievoorstellen simpelweg niet te agenderen. Dit gebeurt wel eens als het voorzitterschap het gevoel heeft dat er geen gekwalificeerde meerheid voor een wetsvoorstel bestaat. De Europese bodemrichtlijn is een voorbeeld van een wetsvoorstel dat al jaren in de koelkast staat omdat het maar niet geagendeerd wordt. Het land wat voorzitter van de Raad is speelt een hele belangrijke rol bij het bepalen van de rol en het tempo van de Raad. Het is daarom van groot belang om de werkprogramma’s van het voorzitterschap in de gaten te houden.

Blokkerende kracht van het Europees Parlement

Dankzij het verdrag van Lissabon heeft het Europees Parlement nog meer krachten gekregen om wetsvoorstellen te blokkeren of verwerpen. De meest gangbare is simpelweg door een voorstel in een plenaire te verwerpen of door alle amendementen van de Raad niet te accepteren, zelfs niet tijdens conciliatie. Een andere mogelijkheid is om het wetsvoorstel terug te sturen naar de Commissie omdat het voorstel niet van goede kwaliteit is. Dit gebeurde bijvoorbeeld bij de Humane Vallen richtlijn. In sommige gevallen (zoals handelsverdragen en als het om het meerjarenbegroting gaat) kan het Europees Parlement niet amenderen, maar wel het hele voorstel an sich verwerpen. Dit gebeurde bijvoorbeeld bij het ACTA handelsverdrag, maar ook bij het voorstel om passagiersgegevens tussen Amerika en Europa uit te wisselen.

EU Know How Klassieker: Interview met Frans Timmermans in 2007

In 2007 interviewde ik Frans Timmermans, toen staatssecretaris Europese Zaken over zijn ideeën over Europa. Zes jaar en twee kabinetten later publiceert het kabinet de Staat van de Unie. Het is opvallend hoe het discours over Europa weinig verandert is. Veel leesplezier.

U bent nu nog geen jaar staatssecretaris. In wat voor klimaat kwam u terecht?

“Ik trof een Nederland dat zoekend naar zichzelf was. Een Nederland dat op zoek was naar een eigen rol binnen Europa. Europa was inmiddels geen populair onderwerp; men vroeg zich af of het wel zó moet.”

U had zich een betere situatie kunnen wensen om in te belanden. Was dat moeilijk voor u?

“Nee, ik wist wat de situatie was, en ik wist wat er van mij verwacht werd. Mijn belangrijkste taak was Nederland uit de grondwettelijke impasse leiden. Europa heeft nieuwe spelregels nodig, maar er moet ook rekening gehouden worden met de eisen van de Nederlandse burgers.”

Heeft u in het buitenland zich vaak moeten verontschuldigen voor het Nederlandse “Nee”, of de positie van Nederland ? Ervaren ze ons in Europa als "moeilijk?"

“Nee, ik heb me nog nooit verontschuldigd. Waarom zou ik? Als democraat, vind ik dat niet nodig. Ik moet er juist naar handelen. In Europa vinden ze ons soms lastig, maar ook heel constructief. Wat wel speelt is dat ze ons niet begrijpen. Zo van; "wat willen jullie nou?”

Toen u vier maanden staatssecretaris was, organiseerde ik de EuroNederlander Awards. U was toen door mensen in het veld voorgedragen voor zowel EuroNederlander als Eurofoob van het jaar. Uiteindelijk heeft de redactie besloten u in de categorie EuroNederlander te plaatsen. Waarom denkt u dat u voorgegdragen was voor Eurofoob en waarom voor Euronederlander?

“Ik denk dat ik genomineerd was voor EuroNederlander van het jaar, omdat mensen mij identificeren met Europa. Ik heb natuurlijk in de Tweede Kamer veel gedaan omtrent Europese zaken. En nu als staatssecretaris word ik natuurlijk ook geassocieerd met Europa. Maar ook op persoonlijk vlak; ik heb in verschillende Europese landen gereisd, gewoond en gestudeerd.”
“Ik denk dat ik voornamelijk door Eurofielen ben voorgedragen voor Eurofoob van het Jaar. Ik heb het afgelopen jaar een aantal heilige huisjes omver geschopt. Ik geloof niet in oplossingen uit de jaren zestig en zeventig, waarin we allemaal zouden moeten opgaan in één Europa. Dit zal voornamelijk de Eurofielen niet bevallen.”

Wanneer u praat over oplossingen uit de jaren zestig en zeventig, bedoelt u dan het Federalisme?

“Ja.”

Tijdens een bezoek aan Sophie in het Veld, hadden we het over de nieuwe staatssecretaris. Zij noemde u een Europeaan in hart en nieren. Hoe ver was zij van de waarheid?

“Geen millimeter!. Dit klopt inderdaad. Maar tegelijkertijd ben ik géén Eurofiel. Ik probeer altijd kritisch te zijn tegenover Europa.”

U bezoekt met enige regelmaat publieke debatten. Men zou zelfs kunnen spreken over de Timmermans Tour door het Land. Is er een moment wat u in het bijzonder is bijgebleven? In zowel positieve als negatieve zin.

“In positieve zin is mij een debat met scholieren in Breda het meest bijgebleven. Dat was een enorm levendig debat, waar de vragen over en weer gingen. Het was net pingpongen met de zaal. Ik heb niet echt negatieve ervaringen meegemaakt, behalve dan dat ik soms ergens kom en lege zalen aantref. Maar goed, dat is het risico van het vak.”

U heeft het hele jaar door kritische vragen van burgers gekregen. Met welke vragen heeft u het meest moeite ?

“Ik heb de meeste moeite met vragen waar men mijn integriteit in twijfel trekt.

Hoe vaak zegt u het woord Europa op een dag ? En heeft u wel eens last van Europa overdosis ?

“Ja ik heb soms last van Europa overdosis. Hoe vaak ik het woord Europa zeg ? Géén idee, misschien tien keer op een dag. Het gebeurt mij een enkele keer in het weekeinde dat ik het woord niet zeg.”

Ikzelf was coördinator Europese Zaken van de Jeugdraad, voorzitter van de Jonge Europese Federalisten, en heb een Master gedaan in Europese studies. Ik denk erover na om binnenkort niks meer te doen met Europa. Wellicht dat ik ga bloemschikken. Zal ik u meteen ook inschrijven?

“Bloemschikken ? Nou nee, ik hou van theater, lezen, fietsen. Bloemschikken lijkt me nou niks.”

Vorige week was er een item op Europa in Nederland over de mogelijkheid een Europa-wijde referendum te houden over het Lissabon-verdrag. Het ziet ernaar uit dat de maatschappelijke organisaties hier voor zijn (met enig voorbehoud). Wat is uw positie ten opzichte van een Europa-wijd referendum ?

“Het Europa-wijd referendum is een mooie manier om de burgers te betrekken bij Europese Zaken. Maar..... Het houden van een Europa-wijde referendum zou bij verschillende Europese landen stuiten tegen grondwettelijke bezwaren. Dus in die zin is het de mensen blij maken met een dooie mus.”

Hoe belangrijk zijn maatschappelijke organisaties voor het Europees integratieproces in Nederland, en op welke manier betrekt u hen bij het proces?

“De maatschappelijke organisaties zijn héél belangrijk, in ieder geval veel belangrijker dan ze zich zelf realiseren. Zij staan tussen de burgers en de overheid en daarmee genieten ze een groot vertrouwen. Wat ik graag zou willen zien is dat de maatschappelijke organisaties een standpunt innemen ten opzichte van Europese integratie. Op dit moment nemen ze nog teveel een neutrale positie in.”

Eerder dit jaar, heb ik u tijdens een debat gevraagd waar we u op mogen afrekenen. U antwoordde toen; "op een helder en realistisch Europa beleid". Laat ik het nu anders vragen. Waar hoopt u aan het eind van uw termijn het meest trots op te zijn ?

“Misschien, dat ik erin geslaagd ben om Europa een betere plaats in Nederland te geven.”

Dat de mensen iets meer van Europa houden ?

“Dat mensen in Nederland, Europa op haar waarde kunnen schatten.”

U heeft wel eens gezegd dat het goed is dat het debat omtrent Europa van haar ideologie ontdaan wordt. Sommige zouden zeggen dat dit juist het probleem is.

“Ik geloof dat mensen het praktische nut van Europa moeten inzien. In de jaren zeventig was Europa nog een ideologie. Ik geloof dat mensen eerst moeten begrijpen op welke manier zij praktisch profijt hebben van Europa, eer zij in Europa kunnen geloven. Om te proberen mensen te overtuigen uit ideologische redenen vóór Europa te zijn, voordat zij het praktische nut ervan inzien is het paard achter de wagen spannen.”

En dan komen we nu bij de laatste vraag.

“En dan ? Ga ik door voor de koelkast?”

Nee, maar wellicht dat de redactie u weer voor EuroNederlander van het Jaar nomineert.

“Haha”

Waar zou Europa in Nederland een item aan moeten wijden of wie zouden wij moeten interviewen?

“Ik denk dat het interessant zou zijn om Jan Marijnissen te interviewen, hij heeft hele interessante opvattingen over Europa. Rita Verdonk zou ook een interessante zijn, Of anders misschien iemand die niet in de politiek zit. Zoals wellicht mensen die in de grensgebieden wonen, of een vrachtwagenchauffeur.”

Decentrale overheden en Industrie: Samen Lobbyen richting Europa?

Bijna 300 lokale en regionale overheden hebben een vertegenwoordiging in Brussel. Het betreft hier regio’s, Provincies, Bundesländer, steden, maar ook Waterschappen. Allemaal zijn ze vertegenwoordigd. Maar waarom? Het idee dat de je als decentrale overheid een belang hebt in Brussel is niet nieuw. Van oudsher gaat het om financiële belangen, het monitoren en beïnvloeden van wetgeving en profilering. Sinds kort zien we in Brussel steeds meer dat regio’s samenwerken met de industrieën om meerwaarde te genereren.

Klassieke belangen

Het meest duidelijke belang van een regio in Brussel zijn de fondsen die Europa beschikbaar stelt aan regio’s. Door mee te praten als de fondsen en de bijbehorende regelingen vastgesteld worden kan een gemeente of Provincie ervoor zorgen ze meer geld krijgen. Ook zijn er financiële middelen door het jaar heen, in de vorm van call’s for proposals. De tweede meest gangbare reden om als decentrale overheid in Brussel een vertegenwoordiging te hebben is Europese wetgeving die van belang is voor decentrale overheden. Enkele voorbeelden; Het Noorden van het land volgt heel nauwlettend of er wetgeving op het gebied van nucleaire opslag in de aarde komt, en de Randstad die kijkt met argusogen naar alles wat te maken heeft met Luchtkwaliteit. Van meer generieke aard is de wetgeving op het gebied van staatssteun en aanbesteding, waar alle lokale overheden mee te krijgen krijgen.

Industrie en Stad/Povincie/Regio

Minder belicht is echter de samenwerking die decentrale overheden kunnen aangaan met de industriën uit hun regio’s. Immers, de industrie die zich bevinden op hun gebied leveren groei en banen op, en zijn dus van groot belang voor de desbetreffende regio. Ik heb zelf een aantal keer de situatie meegemaakt dat een bedrijf een verzoek doet om mee te denken over een lobby richting de Europese instellingen. Zo vroeg de agrarische sector om hulp bij de hervormingen van het Europees landbouwbeleid en een ander bedrijf vroeg om advies inzake milieuwetgeving. Door in te gaan op verzoeken uit het veld wordt het portfolio van de regionale lobbyist breder en genereert hij waarde voor de stakeholders die hij vertegenwoordigd bij de EU. De samenwerking versterkt ook beide partners in hun lobby omdat decentrale overheden vaak toegang hebben tot delen van het proces waar private firma’s voor zijn uitgesloten. Aan de andere kant hebben industrieën vaak de middelen en de flexibiliteit om acties uit te voeren die taboe zijn voor decentrale overheden. (denk aan een pittig persbericht of ludieke actie).

Unholy Alliance?

Uiteraard zijn er grenzen aan het samen optrekken van lokale overheden en industrieën De keuze om samen op te trekken moet altijd een bestuurlijke zijn, en bovendien moet het passen in het collegeprogramma. Persoonlijk vond ik de samenwerking tussen Poolse regio's en de Tabaksindustrie een beetje kantje boord. Er zullen altijd legitieme vragen zijn waarom een decentrale overheid zich inzet voor een bedrijf. Deze vraag wordt echter nooit gesteld als een groot bedrijf failliet dreigt te gaan.

Lobbying: A constitutional but fragile right

Lobbying, whether in the EU or any powercenter is always at the center of ethical debates. Sometimes, it is equated with corruption and anti-democratic practices. Nothing can be further from the truth. Lobbying is in fact an in-alienable constitutional right, safeguarded both in national constitutions (Dutch constitution, article 5, Right to petition) as well as in the European Lissabon Treaty (article 11, Treaty on the European Union).

Cash for Laws Scandal: Whats lobbying got to do with it?

In march 2011, a small number of MEP's accepted cash from journalist pretending to be lobbyist in return for putting forth amendments. The scandal, now known as the Cash for Law Scandal involved four MEP's, of which one is now being prosecuted. In the aftermath of the scandal, new stricter laws for acces to the EU were being drafted for lobbyist. I personally find this ludicrous; how can you pin the blame for a scandal where MEP's and journalists were involved on lobbyists? Lobbying involves monitoring the policy proces in all its fases, and providing both rational and political arguments in order to influence the outcome. Corruption is the abuse of entrusted power for private gain. The two practices are a world apart. The misconception arises because lobbyists also operate behind closed doors, and will never lay public claims on policy outcomes. This "operating from the background" sometimes raises concern about the power of lobbyists to influence outcomes, but not be held accountable for them.

Let the people lobby

In a proposal by Dutch MP Lea Bouwmeester, Ministers would be obliged to rapport with which lobbyist they talked before proposing a law. There are three problems with the proposal. Firstly, its feasability.Will the Minister have to rapport to whome he spoke personally or does the obligation extend to the civil servants from his ministry. What if lobbyist talk to civil servants from other ministeries and they talk to the civil servants from the responsible ministry? Does the proposal only aim at private sector lobbyist or also lobbyist from local authorities? Besides, why hold the Minister to such high standards when most of the lobbying is being done in Parliament? Will Ms Bouwmeester also rapport with whome she speaks in Parliament? The second problem with the proposal is that in a democracy, parliament scrutinizes the government. Regardless if the Minister talked to lobbyist, any decision made is ultimately his responsibility. Blaming lobbyists for policy outcomes is downright childish and irresponsible. The third and most important reason is that while I am all for transperancy and honesty, we should be cautious about any attempt to restrict the constitutional, but fragile right to petition government. Because in the end, people, ngo's and businesses should be able to influence the laws that shape their everyday reality.

Reactie op AIV Advies: Nederland en het Europees Parlement

In het rapport “Nederland en het Europees Parlement” brengt het AIV een advies uit aan de Nederlandse regering over een aantal vraagstukken gerelateerd aan het Europees Parlement. De vraagstukken kunnen op de volgende manier worden samengevat; (1) Hoe kan Nederland meer invloed uitoefenen op het Europees Parlement en (2) Hoe kunnen burgers zich meer betrokken voelen bij het Europees Parlement. Het is merkwaardig dat deze twee vraagstukken zich in hetzelfde advies gevonden hebben, want het zijn twee totaal verschillende vraagstukken, die elk op zich een AIV advies waard zijn. Ik zal mij dan ook in mijn reactie beperken op de onderdelen van het AIV advies die over belangenbehartiging gaan.

Gebruik Nederlandse Europarlementariërs op een slimmere manier
Het AIV wijst erop dat bij de verdeling van posities in het Europees Parlement er teveel aan “kluitjesvoetbal” is gedaan, waardoor er veel Nederlandse Europarlementariërs in dezelfde commissies zitten en bovendien zitten er in sommige belangrijke commissies géén enkele Nederlandse Europarlementariër. Het AIV adviseert dat Nederlandse regeringsvertegenwoordigers zich moeten richten op buitenlandse Europarlementariërs. Ik denk echter dat het AIV zich blindstaart op de vaste leden van de commissies. Ter voorbeeld; Esther de Lange is vervangend lid in de landbouw Commissie maar draait daarin volop mee, en heeft zelfs gewicht binnen de EVP als het om landbouwaangelegenheden gaat. Corien Wortman spreekt zich vaak uit over Haven-gerelateerde zaken (competenties van TREN Commissies) en Peter van Dalen heeft in het verleden dingen gedaan voor de uiensector(comepetenties van AGRI Commissie). Lambert van Nistelrooij heeft wel eens geamendeert op zaken die afspeelde in de Visserijcommissie hoewel hij zelf geen lid van de PECH Commissie is. De heer van Nistelrooij heeft zelfs een persoonlijk medewerker die die Commissie volgt. Deze voorbeelden laten zien dat Nederlandse Europarlementariërs wel degelijk iets kunnen betekenen ook zal zitten ze niet in de verantwoordelijke commissie. Bovendien worden meestal meerdere Commissies om een opinie gevraagd, wat weer mogelijkheden geeft voor Nederlandse Europarlementariërs.

Versterk de band tussen ambtenaren en assistenten van Europarlementariërs

Terecht wijst het AIV op een duivels dilemma; daadkrachtig beïnvloeden is nagenoeg onmogelijk als men vooraf altijd toestemming moet vragen aan de Minister om contact te leggen met Europarlementariërs. Het AIV beveelt aan dat directe contacten tussen daartoe aangewezen Haagse ambtenaren en Europarlementariërs, ook zonder voorafgaande toestemming van de minister, expliciet toegestaan moeten zijn. Ik denk dat men hiermee het probleem slechts deels oplost en dat de slagvaardigheid maar weinig verbetert. De echte oplossing ligt in de relaties die ambtenaren kunnen opbouwen met de assistenten van Europarlementariërs. Het belang van de assistenten van Europarlementariërs wordt veelal onderschat. Door ambtenaren van alle niveau’s carte-blanche te geven om contact te zoeken met de assistenten van Europarlementariërs worden de kaders geschept voor snelle informatie-uitwisseling tussen experts en worden formele, veelal hinderlijke regels omzeilt. Als het moment komt om formele input te leveren dan kunnen de assistenten en de betrokken ambtenaren een bijeenkomst organiseren tussen hogere ambtenaren (of zelfs Ministers) en de Europarlementariërs

3) Versterk partijlijnen tussen Brussel en Den Haag
Het AIV adviseert om in het Reglement van Orde op te nemen dat Kamerleden minstens 1 maal per maand een bezoek aan Brussel brengen. Het lijkt mij zeer onwaarschijnlijk dat Kamerleden open zouden staan voor zo een regel. Bovendien zouden bezoeken aan Brussel afgelegd moeten worden omdat er een directe aanleiding is, en niet omdat het reglement het voorschrijft. Het groter onderliggend probleem is dat de agenda van het Europees Parlement slechts deels aansluit met de activiteiten van de Tweede Kamer. De Tweede Kamer heeft fantastische sprongen gemaakt als het gaat om op tijd input leveren aan de minister voor een Raad in Brussel, maar nog steeds zijn de mogelijkheden beperkt om in te spelen op momenten van invloed als die zich voordienen in het Europees Parlement. Bovendien, iedereen die werkzaam is in Brussel weet dat officiële momenten van invloed zoals Commissievergaderingen in het Europees Parlement niet het moment zijn waar men debatten voert en tot overeenstemming komt. Dit gebeurt namelijk informeel tussen Commissievergaderingen in. Dus als kamerleden zich verplichten eenmaal per maand naar Brussel te gaan, wanneer zou dit dan moeten zijn? Het is daarom ook jammer dat het AIV de mogelijkheden die partijlijnen bieden aan zich voorbij laat gaan. Het CDA en het PvdA hebben al coördinerende mechanismen tussen Brussel en Den Haag aangebracht die veelbelovend zijn. Hierdoor vindt er overleg plaats op het moment wanneer het echt telt. Het is alleen natuurlijk aan de politieke fracties zelf om hun Europa-coördinatie te organiseren.

4) Gebruik belangenorganisaties én de decentrale overheden
BNC Fiches blijven hun prominente rol blijven spelen, maar ze zijn ze zeker niet het eerste moment om invloed uit te oefenen op Nederlands beleid. Dit gebeurt meestal maanden eerder in de vorm van een kabinetsreactie op een groenboeken of een consultatie. Zo was een deel van het Nederlands beleid inzake het cohesiebeleid reeds opgesteld in de kabinetsreactie op het Vijfde Cohesieverslag, tien maanden voordat een BNC Fiche opgesteld werd als reactie op de verordeningen van het cohesiebeleid. Ik ben het bovendien niet eens met het AIV dat relatief weinig belangenorganisaties weten wanneer ze bij de Tweede Kamer moeten aankloppen om Brussels beleid te beïnvloeden. Als er een Algemeen Overleg is waar een Europees thema van belang speelt, dan weten de LTO’s, IPO en Bit’s of Freedoms van Nederland allemaal de Tweede Kamer te vinden. Meestal gaat dit echter niet via een brief maar in direct contact met Kamerleden of beleidsassistenten, waardoor deze samenwerking minder zichtbaar is. Andersom is er nog een wereld te winnen als het Rijk en Parlement meer samenwerken met de decentrale overheden. De twaalf Provincies, steden, gemeentes en regio's zijn vertegenwoordigd in Brussel. Óók zij vertegenwoordigen de belangen van Nederland. Zij opereren vaak als vrijgevochten lobbyisten in plaats van ambtenaren, en hebben daardoor vaak makkelijk toegang tot Europarlementariërs of leden van de Europese Commissie. Bovendien zitten zij vertakt in verschillende netwerken en hebben daardoor snel toegang tot (uitgelekte) documenten. Nog meer samenwerking door de decentrale overheden te betrekken in Raadstrajecten zorgt ervoor dat het Nederlands belang nog breder vertegenwoordigt wordt.

Al en al is het AIV advies Rijk aan relevante informatie en bronnen. Het bovenstaande commentaar moet daarom vooral als aanvulling gezien worden. Het zou echter beter zijn dat als er een volgende keer een advies over belangenbehartiging in Brussel geschreven wordt, er ook een Brusselse lobbyist geraadpleegd wordt

Specifics of EU Lobbying

Lobbying (or Public Affairs if you will) in Brussels is in many respects very similar to lobbying in national or even regional power-centers. There is always the tension between the legislative and the executive, and the structures of power are disappointingly identical. Civil servants, parliamentarians, assistants, and of course... lobbyists make up the blood-types of any centre of power, whether in Brussels, Madrid or Dusseldorf. However there are a couple of characteristics which are unique to the European capital. While this list certainly isn't exhaustive, it gives an idea of the particularities of Brussels

In Brussels- everybody is nice to each other

Since the Commission is not elected by the Parliament, (but by the Council) there is nothing which could be called opposition in the European Parliament. While in most capitals, the chief aim of the opposition is to overthrow the government, in the European Parliament the aim is to cooperate together with the European Commission in order to exert as much influence. What's more, because there is neither a dominant force in Parliament, or in the other institutions anyone wanting to influence the policy process is forced to build alliances and work together. Hence, the reason that everyone is nice to each other.

In Brussels- learn how to be informal

If you would follow the formal policy process, you are missing out a lot. In some countries like the Netherlands it is forbidden for members of Parliament to talk to government civil servants. In Brussels however, everyone is talking to everyone; Literally. Commission civil servants talk to Members of Parliament, Lobbyists talk to Political Advisors and before you know it a document is leaked. Because of this open nature of policy making, key decisions are often made during lunch hours, instead during Committee debates. The plenary and committee debates often serve as a official round-up of all informal debates that have happened beforehand.

In Brussels- Media does not have the same role

The debate in Brussels is less politicized then in the capitals of Europe. The first reason was the aforementioned lack of opposition. There is no government to be overthrown so members of Parliament are not constantly appalled like in .... Lets say..... Westminster. Secondly, most of European legislation or policy is of a fairly technical or abstract nature. When the European Union voted to ban phosphor in household detergents, this had far reaching consequences for both the environment as well as producers. However it will be very difficult to make the evening news with this item. So the media in Brussels does not have the same vigilantly, scrutinizing, criticizing role as they have back home. Instead they are more something like translators, trying to translate what is going on in Brussels, to the relevance of their respective countries.

In Brussels-Policymaking takes years

Because of the far-reaching consequences of European policies, the European Commission is very careful when it proposes new legislation. First a great deal of effort and time is invested to consult stakeholders through greenbooks and other ways of consulting. A legislative procedure can take around 3 to 5 years. To be effective you need to have a strategic mind-set. Moreover you should have early warning mechanisms to "read the signs". Namely, a lot of policies start with some kind of abstract-European-Union-mumbo-jumbo (energy efficiency discussions), and end up with concrete proposals (ban the light-bulb from Europe). This multi-annual policymaking has big effects on the choices and decisions of us Public Affairs professionals. In the national capitals, the pace of policy is much faster, which sometimes obscures the bigger picture of politics.

Lobbying through European Associations and Umbrella organizations

An unbelievable amount of lobbying in Brussels is done through associations and umbrella organisations. These vary from your typical industry associations to the European Youth Council. But how effective are they and is it worth spending money (in the form of membership fee) and energy (you have to attend meetings and give input) or should you simply “ do it yourself”.

Strength through numbers

In my opinion there are certainly some excellent associations and umbrella organisations operating in Brussels. Amongst them I would name COPA-COGECA (representing the European farmers) and BusinessEurope. The European Commission isn’t able to talk with each and every stakeholder when drawing up legislation or policy, so it is better to talk to the representatives from the field, which in turn represent thousands, sometimes millions of persons. Moreover, the aforementioned organizations also have a lot of in-house expertise and organizational capacity so the European institutions can rely on them for input and to create legitimacy Europe wide for policy. Paying for membership of these kind of organizations is worth every penny, and moreover it is also wise to monitor internal developments so you can steer the positions and activities of such “ giants”.

The draw-backs

There are however a couple of draw-backs of having your interest represented by umbrella organizations. You should be aware that such umbrella organizations sometimes represent very diverse interest. Consumer umbrella organizations for example have to juggle between the interests of consumers wanting more ease when buying online versus consumers which value privacy more, and thus would like to see barriers to information gathering on the internet. Sometimes these internal conflicts of interest are unbridgeable. What then often happens is that there is a consensus to “agree to disagree” or even worse, the biggest interest within the umbrella organization wins it from the smaller factions. This sometimes has as a perverted result that the umbrella organization to whome you pay a fee to represent your interest becomes a way to block your lobby. You should be aware that this happens in Brussels with some frequency and that from the moment you realize this is happening, you should abort any plans of lobbying through the umbrella association.

The second draw-backs of lobbying though umbrella organizations is that they tend to be a bit slow and sluggish when it comes to reacting to new policy developments. This is because construing official positions requires both internal administrative as well as political agreement. It has happened that umbrella organization were not able to react on time to fast developing policies.

Concluding remarks

Yes, associations and umbrella organisations DO matter in Brussels. They are often the official spokesperson for industry and civil society towards the institutions. Some Members of Parliaments refuse to talk to smaller actors, opting to talk only to the big organisations that represent them. However, bear in mind that umbrella organisations and associations can sometimes be very slow to react to policy developments, and are sometimes even a blocking power because of internal bickering. if you have the feeling this is the case, dont ever hesitate to start your own lobby.

Open Days 2012 Special: Why have a regional representation in Brussel

There are over 200 regional representations in Brussel. Every year during the EU Open Days we celebrate the partnership between the EU and regions. As part of this the coming weeks, EU KNOW HOW blogs will focus especially on EU regional interest representation; Our first blog answers the question on why have a regional representation in the first place?

Lobbying requires a lot of resources. Budget does help, but it is third in importance compared to manpower and political will. A certain cost benefit analysis should be at the basis of any rational behind deciding to have a regional representation in Brussels. Still, when making a cost-benefit analysis you should also take into account the so called “opportunity costs”. While a lot of representations have a hard time measuring how much did their lobby benefit from being based in Brussels or the national capital, it is quite easy calculating how much it costs when you are not involved in European Affairs. There are numerous examples of regions facing problems with legislations or being the last to get funded. Often -if not always- these laggards have been “sleeping” while legislations was passed. And while no regional representation is alike, I think there are basicly tree main reasons regional lobby’s should lobby in Brussels.

Monitoring and influencing Legislation

More then 50% of national legislation originates in Brussels. This figure rises to almost 80% if you only take environmental legislation into account. Bearing in mind that local governments are often responsible for carrying out, monitoring and upholding this legislation, it becomes all the more apparent that it is important to be aware of upcoming legislation in an early stage. This is no trivial matter, as the wrong application of EU legislation can lead to claims in court, complaints at the European Commission , decision to be annulled, fines and/or repayment of unintentional damages. But more important is the damage to the reputation of a local government. Citizens of local governments have the right to depend on sound governance, and you can imagine how a European court-case undermines the respectability of a municipality or region.

Monitoring and seizing financial opportunities

The EU has an agreed budget of €120.7 billion for the year 2011 and €864.3 billion for the period 2007–2013. About 30% of this budget are reserved for structural action, which target the regional and municipal level. In times of crisis and budgetcuts the EU budget can make a real and sustainable impact to regional development. Regions often joke that the EU is a bigger friend to local governments then their own national ministries. By being in Brussel it is easier to monitor and seize the financial opportunities that the EU provides. By maintaining contacts, you will be able to hear about call for proposals before they come out and find partners to tea up with for the development of your EU project.

Building the profile of your municipality or region

Building a European profile of your municipality or region is a must if you want to have success influencing the EU legislative process or seizing the financial opportunities the EU has to offer. How many times have I seen local governments go to Brussels as part of a annual trip, in the hope to make a statement. This is a utter waste of time and resources. Brussels is a constant flux of people, and just visiting once a year will have no impact. “Being there” is an advantage you have over thousands of competitors EU-wide. However, just being there is not enough. While no region is alike, you should at least be seen as a reliable partner that not only “takes” but also “gives”. As a former MEP told me at the start of my career; “If a problem arises in the EU, the whole of Europe wil start calling 1 or 2 members of European Parliament. Make sure they know you and appreciate you before you have a problem!”. And indeed, as a legislative proces reaches its decisive stage policymakers are inundated with e-mails and phone-calls. The policymaker will decide to answer only those that have a track-record in contributing with sound advise.

All the wrong reasons to have a regional representation in Brussels.

While I think it is important that every region is present in the national capital, at the same time regions should think twice before opening shop in Brussels. Some say; Europe is becoming increasingly more important! But is it really? Does the region have a good overview of it’s “European interests”. Here are at least tree wrong reasons why regions enter the world of EU lobbying.

Goldrush
This is a bit of a contradiction of the beforementioned reason to actually be present in Brussel. A lot of regional representations are in Brussels because of the EU Budget. And while the EU Budget is an attractive reason to be based in Brussels, one should always be cautioned not to be struck by gold-fever. In reality, EU funds are very difficult to come by. Cohesion funds are allocated by a National Envelop, and so are funds from the CAP. To get money from yearly calls for proposals depend as much on having a good project proposal as on lobbying. Lobbying does help, but only if the project proposal is already excellent, and it needs that extra push in the midst of competing excellent projects.

Not a local or regional issue
The European Union spans a wide range of policy issues, from enlargement to transport. Does your local government really have the competencies to deal with all EU issues? Does your Province really have to have an opinion on the European Union wind-energy policy? Or the European Union pension system for that matter? With the right stretch of imagination, you could make a case that everything has a local or regional dimension to it, and before you know it you will be involved in countless meetings spending numerous hours discussing things that only have a marginal relevance for your region. Sometimes it is difficult to judge if something is important for your local government. In case of doubt it is even better not to take action then to take action. In Brussels there are numerous professionails with their own pet projects, and they will do anything to convince you that this policy issue is pressing. Avoid getting tangled in their web. The golden rule is; a policy issue is only important if a lot of people are working on it, and if there is substantial budget involved.

Not an European issue
As a lobbyist at the European Union for the Dutch Province of Zeeland, a lot of local stakeholders came to me with issues which they hoped to solve on EU level. However not every problem or issue can be resolved on the EU level. Paving a local road with little importance for the EU, or building a local yacht harbour are just some things that come to mind. And while it certainly is not impossible, it is not always easy to interest the EU for a local issue unless you can prove that more European regions face the same problem.

How to lobby for EU funding

The EU bolst a budget of billions of Euro’s. Getting to those billions is however an arduous and complex undertaking that will will require both time and energy. There are roughly said, three moments when lobbying for funds can take place; When regulations are drawn up, when the annual or operation programme is drawn up and at project level.

The Regulation; The root of all funds

Every EU fund has its root in a regulation. There are thee reasons why influencing a regulation might be beneficial; First, because you can try to have your distinctive theme or issue mentioned in the regulation (such as climate change, or SME’s). For this reason regional representations always try to add a territorial or regiona aspect to regulations that govern a certain fund. Secondly, some regulations bear an allocation formula. Such is the case for most structural funds. Tweaking this formula will have an impact on the amount of money that your member state, region or what-not will receive. Finally, lobbying a fund regulation also gives you the opportunity to make a fund more workable. Most funds will need some amount of co-financing. Both the amount as the natura of co-financing (private or public money) is always a matter of debate. Another example would be lump-sums or variable rates for overhead costs of project. Working on a regulation while it is still a proposal will make it will be easier to acces and work with later on. Please mind, that while lobbying at this stage is both sensible and necessary, it is quite difficult. Moreover the opportunity comes along only once every 7 years, when the EU multi-annual budget and it subsequent funding schemes are developed.

Annual or operational programs.

Every regulation will be worked out in a more detailed annual plan or an operational program (in case of the structural funds). These programs highlight the goals, objectives and measures of each and every fund. For the centrally managed project it is the European Commission that draws the programs, for the structural funds it is either the member state or the regions, in both cases in good partnership with stakeholders. There is no uniform way how programmes are drawn up. This differes from fund to fund. What is uniform however, is that all funds will allow for some degree of inpunt by stakeholders. Most of the time the people drawing up the program will appreciate timely and accurate input. So it it very important to identify at an early stage who will draw the annual or operation program and when there are opportunities to provide input. Why are these programmes important. Regulations provide for goals and objectives at a very abstract level. The regulation might for example say that climate change is an objective of a fund, the program makes the regulation more tangible (promotion of electric cars). Secondly, operational programmes sometime provide for gouverning rules which enable or unable you to make use of funds. (the programme area of Interreg is determined in the programmes, so if your region is outside a certain programme area, your tough out of luck).

Project level

We have arrived at the most concrete level, that of the project. Most if not all EU funding will in the end need some kind of projectdesign to approve funding. In other words you will need to design a project. While it goes beyond the scope of this blog to write how to write a EU projectproposal I will limit myself to saying that your project needs to be well written. All the lobbying in the world wont help if your project is poorly written and/or designed. A good project can take over a year to develop. When you are the proud owner of a well written project, turn to lobbying. A project is always evaluated either by European Commission evaluators or by steering committees. In both cases try to find out who they are. Try to find out if the person(s) in question are receptive to input. Some project evaluators like to see concept projects in order to give advice and feedback. Some however are absolutely allergic to lobbying and don’t like to be approached under no circumstances. Then its “mission abort”. Secondly, always find political backing for your project. This doesn’t need to be someone with direct decision making power in the project selection process. You can find for example a local deputy or an Member of European Parliament to endorse your project. Finally try to push the theme, goal or objective of your project. If your project is about energy efficiency in your local port, don’t promote your specific port, try to promote energy efficiency in ports in general. By lifting your project to a EU level you can lobby and promote your cause without being accused of promoting just one particular pet-project.

Shadier parts of European Union policy making

Counter to what a lot of academics, media, politicians and conspiracy theorists would have us believe, I would argue that European Union politics is very open, accessible and transparent. True, the sheer complexity of the process makes it very difficult to follow, but at the end of the day, if you have the time, resources and energy you can monitor and influence EU policy.

Having said this, there are parts of European lawmaking which are murkier, shadier and less easy to follow. They are what I call the shadier parts of the EU process; moments where there are no camera's, meeting-minutes, rapports or public access. They are not only troublesome because there is no possibility for public scrutiny, but also because of the limited access for Public Affairs professionals .

Roll-call votes at committees

Parliamentary Committees are a crucial part of the EU decision process. They compose experts and coordinators of the various political families and their votes are used for group whipping. It is all the more strange that votes in Parliamentary committees are not subject to roll-call. Meaning that after the voting has taken place there isn't a registration showing who exactly voted in which way. An effort by the British MEP Andrew Duff to change this was rejected by the EP constitutional affairs committee. Some MEP's argued that it would be technically difficult to implement, which of course is baloney.

First Reading Trialogues

Rules 70 of the European Parliament allows Committees and Committee members to negotiate with Council before a proposal goes to vote (either in committee or plenary). The members negotiating with Council have to -in principle- take a decision by a majority of its members and adopt a mandate on the poltical orientations and priorities. However in practice negotiations take place in various forms, both formally and informally. In Brussels, everybody talks to everybody. As a consequence more and more proposals are being adopted in first reading. This avoids lengthy legislative processes, however it makes it much more difficult to monitor and scrutinize whats going on.

Delegated acts

When a law is adopted there will still be a need for some decision making in the implementation phase. For example when a law on prohibited substances is made there still the necessity to draw up a list of substances or products. Because it would be silly to open up legislation and go through the whole co-decision process again, decision-makings-powers can be delegated to the European Commission. This used to be called Comitology, but after the adoption of the Lisbon Treaty it is now called "Delegated Acts". Whatever the name, it boils down to the Commission making decisions without consulting Parliament or Council. It has been criticized for opening up the back-door for ambiguous decisions. Lisbon has made it a bit more transparent because Council and Parliament have to agree upfront till wha extent they will allow Commission to decide, and moreover they can actually block decisions made under "Delegated Acts."

In Camera meetings

The Rules of Procedure state that hearings and testimony in the European Parliament shall take place in public. However, proceedings can take place in camera if this is requested by one quarter of the members of the committee of inquiry, or by the Community or national authorities, or where the temporary committee of inquiry is considering secret information. In practice In Camera meetings have been called on different occasions while the reason for doing so wasn't always clear. Moreover, the European Parliament never disclosed which members actually called for the meeting to be behind closed doors.

12 SEPTEMBER EN EUROPA DEEL 1: PVDA

Disclaimer to English readers: Blog in Dutch because of 2012 Dutch elections.

Europa zal als nooit tevoren een belangrijk onderdeel zijn van de Tweede Kamerverkiezingen. Maar hoe is het eigenlijk gesteld met Europa in de verkiezingsprogramma’s. Hoe Europaproof zijn de partijen eigenlijk? Met deze reeks analses nemen we de verkiezingsprogramma’s onder de loep en kijken we of de partijen een realistisch, eerlijk en duidelijk verhaal hebben als het om Europa gaat. We trappen af met het verkiezingsprogramma van de PVDA.

Algemene indruk

Het verkiezingsprogramma van de PVDA is opvallend Europa-gezind. Met name als men het vergelijkt met voorgaande verkiezingsprogrammas zoals bijvoobeeld voor de Europese verkiezingen. De partij kiest voor een toekomst in Europa. Van “uit de euro stappen” is géén sprake. In hun eigen woorden; “Een Europa dat groeit, laat Nederland groeien” . Wel menen ze dat het tijd is voor een nieuw Europa; van strenge bezuinigingen naar groei en banen. Daarmee volgen ze in weze de lijn van hun partijgenoten in Frankrijk. Heel veel elementen van het programma pleiten voor verdere Europese integratie. Het gaat dan om practische zaken; het PVDA is voorstander van een Europees bankentoezicht en de invoering van de omstreden Eurobonds. Kenmerkend is dat ook meer federalistische elementen voorgesteld worden. Zo wil het PVDA dat het Europees Parlement de voorzitter van de Commissie levert en het bovendien is het PVDA vóór invoering van Europese kieslijsten. Al en al een verkiezingsprogramma dat de PVDA weer terug in het hart van de Europese discussie plaatst

Realistisch

Behalve duidelijk is het programma bovendien in veel opzichten opvallend realistisch. Menig partij heeft zich de afgelopen jaren schuldig gemaakt aan het beloven van zaken die in een Europees verband niet uitgevoerd konden worden vanwege EU regels of vanwege het ontberen van een meerderheid in Europa. De PVDA wil onder andere immigratieproblemen en belastingfraude via Europa aanpakken. Ook weten ze dat aanpassingen van regels inzake sociale huurwoningen en kerosinesubsidies ze niet in Den Haag, maar in Brussel moeten gaan lobbyen. Ook de uitspraken over uitbreiding laten zien dat het PVDA niet bang is om realistische, duidelijke keuzes te maken.

Kritische Noten

Is het verkiezingsprogramma dan in zijn geheel Europaproof? Bijna. Er staan nog steeds elementen in die onrealistisch zijn of maar deels kloppen. Zo meent het PVDA dat er nog te weinig structuurfondsen naar het MKB gaat, terwijl in deze programmaperiode er drie keer zoveel naar het MKB is gegaan dan oorspronkelijk de bedoeling was (100 miljoen ipv 30 mln). Ook wil het PVDA de voedseloverschotten gebruiken voor voedselbanken. Dit is de afgelopen jaren ook gebeurd middels het food for the deprived programma. De realiteit van vandaag is echter dat door de voedselprijzen er geen voedseloverschotten meer te vinden. Ook de houding ten aanzien van gemeenschappelijk landbouwbeleid kan iets genuanceerder. In Nederland is er namelijk al radicaal ontkoppeld en is er bijna geen sprake meer van exportsubsidies of productiesteun. Ook vraag ik mij af hoe het PVDA geld van het ESF wil gebruiken om jeugdwerkeloosheid te bestrijden als ze ook pleitten voor een miljard korting. Als je kort op de begroting is er ook minder geld voor bestrijding van jeugdwerkeloosheid of het stimuleren van energieprojecten. Het PVDA wil nog meer betrokkenheid van de Tweede Kamer, terwijl juist hier de laatste jaren heel veel slagen zijn gemaakt en Nederland in Europa inmiddels een voorbeeldfunctie heeft. Ook het idee dat lobbyisten bij de Raad zich moeten registreren in het lobbyregister is een beetje merkwaardig omdat de Raad een verlengstuk is van de hoofdsteden en lobbyisten ‘ van de Raad’ dus niet in Brussel maar in de hoofdsteden zitten. Ook zet ik vraagtekens bij het idee om de staatssecretaris van Europese Zaken te plaatsen bij het ministerie van Algemene Zaken. Hij zal dan misschien beter verankert zijn in de Nederlandse politiek, maar ontbeert dan de externe voelsprieten die het ministerie van Buitenlandse Zaken hem kan bieden. Ik was benieuwd naar de mening van voormalig staatssecretaris Frans Timmermans hierover. Via Facebook liet hij mij weten dat het zijn idee was omdat de toon van het Europees beleid en bovendien de coordinatie gedicteerd zou worden door de premier.

Eindoordeel

Al en al is het het verkiezingsprogramma van het PVDA verbazingswekkend Europaproof. Het geeft heldere antwoorden op de meest prangende vragen en doet dat op een realistische manier. Her en der is het nog niet ontdaan van achterhaalde kreten , maar dat neemt niet weg dat het een bijzonder realistisch verkiezingsprogramma is.

Milos Labovic houdt zich tot in de treurnis bezig met Europese zaken. Hij was voorzitter van de Jong Europees Federalisten van 2005 tot 2007 en richtte de werkgroep Europa op bij de Nationale Jeugdraad. Daarnaast was hij van 2007 tot 2009 adviseur van de Servische regering op het gebied van Europese integratie en is hij nu inmiddels drie jaar lobbyist in Brussel. Hij heeft een Master in European Studies van de Universiteit van Maastricht en een Magister in Europawissenschaften van de RWTH Aachen.

European Parliament Assistents

Apart from political assistants and the secretariats MEP's are also helped by their own personal assistants.

It is difficult to overstate the importance of the assistents of members of the European Parliament. While it is ofcourse the members of the European Parliament who in the end are the decision makers, it is safe to say that without parliamentary assistant the whole legislative process in the EU would come to a screaching halt. Parliamentary assistants are the oil that makes the engine run smoothly. It is all the more strange that there is hardly any scholarly research done on the influence of MEP assistants on the legislative process.

So who are they?

MEP assistants tend to be relative young persons, sometimes taking up the assistantship as their first or second job after graduating from University. A lot of the times they have some affinity with Brussels as they have either a European Studies or political studies background. the University of Maastricht and the College of Europe seem to be the chief suppliers of assistants, even though no formal study can back this claim. A majority of them are members of the same party as their MEP, even though a significant number does not have a party membership but is picked for their merit, expertise and/or experience. In certain cases assistants have gone on to become MEP's as was the case with Sophia in t Veld and Emma McClarckin. Assistants are as a rule cheerfull, open personalities and very dedicated to their work. They do however seem in a constant stress because of the workload thrown at them by their MEP's. So don't be surprised if a assistant doesn't have time to chat when you meet them in Parliament, it is rarely something personal, rather their to bussy.

What do they do?

The role of Parliamentary assistants varies from MEP to MEP. Sometime there is a internal division between assistants; some act as policy advisors, while others do more logistics stuff like answering email, managing the MEP's agenda and welcoming groups. More often though assistants will do both. The extent to which a assistant is a policy advisor -or in extreme situation atually drafts policy- depends on various factors. The most important one is the MEP and to what extent to he entrusts the assistant with policy advice or even formulation. Besides that, there is some degree of competition with both the group political advisor and the committee secretariats when in comes to to assisting the MEP. Also, the role of the assistant will depend on his expertise, engagement and bond with the MEP. They are rarely given the task of drafting a whole rapport, as opposed to drafting amendments which they are often entrusted to do. In the end the work of a MEP assistants boils down to knowing what his MEP wants and making sure all initiatives are coherent with this.

How can assistants help you further your cause?

In the case of the MEP assistant, this question is formulated the wrong way. It should be the other way around; How can you help the assistant? Understanding this is vital to building a longstanding relationship with assistants. By assisting him with anything from information to thinking how certain press releasing can be distributed you can really help the assistant and save him/her time. As the guardian of his MEP, an assistant will never do you a favor which is opposed to positions taken by his MEP. However you can remind assistants of similiar positions or actions taken in the past which become pressing or require new action. Helping the assistant to save time and consolidating the position of his MEP is the key to a meaningfull working relationship with MEP assistants. At any rate, always make sure you dont waste their time or do anything that jeopardises your working relationship with assistants, because most of the times you can forget about accessing the MEP as well. The Strasbourg week are excellent weeks to meet up with assistants that stay in Brussels. Normally, they are a bit less buissy and have time for a lunch (even though you wont be able to meet in Parliament premisses as brown badges are not allowed entrance during this week).

Organizing an awesome event in Brussels

When I started as an interest representative in Brussels, I had no idea that organizing events and meetings would be such a big part of the job. Indeed, organizing an event is one of the great ways of reaching out to policymakers, introducing your ideas or connecting to the right people. However, organizing an event in Brussels can be stressful to a point that it becomes a nightmare. I have organized numerous meetings and events in Brussels and decided to write this manual so that everyone can now make an awesome event!

Chronology of Actions

Here is a very brief overview of actions you will need to do to organize your event. At the minimum you will need six weeks to organize an event. I have organized succesfull meetings and events within a matter of weeks (my personal record is 7 days), but those were exceptions. If you want to be sure that you have enough time, six weeks is an absolute minimum. First you need to pick a date. Without a date, you can’t arrange anything. After you set the date find a location. Third, work out the concept; will you have a panel discussion or a network event. This concept doesn’t need to be clear from the start. You can fine tune it as you go. After you have the location and date, try to work out most logistics like catering and arranging a moderator. It is usually these things that are left to the end because they seem easy to arrange. This is true, but because they are relatively simple to arrange, deal with them in the beginning so that you don’t have to deal with them in the last minute when you need all your time for crisis-management. Arrange the speakers as soon as possible. Agenda’s fill up quite fast so as soon as you know what your concept is start with approaching speakers. Then deal with invitations. Send a “save the date” as soon as you know the location and time. Send the official invitations, at the minimum three weeks before your event. I personally don’t like to send reminders because they look desperate. When organizing an event in Brussels, I never sent printed invitations. Instead I always used email. Not only is it more cost-efficient, but respondents only had to reply to the email to sign up. Lastly, promote your event.

Setting the date for your event

Picking the date is without doubt the most crucial steps when organizing an event in Brussels. While you will never able to tell with certainty that you have chosen a good date (I think there is no such thing as the perfect date), there are a couple of rules and principles that you need to keep in mind. The European Parliament resided more or less once a month in Strasbourg, so needless to say that you should avoid this week. Another bad week is the so called “constituency weeks”, where Members of the European Parliament go back to their countries to speak to their constituencies. These weeks occur around 6 times a year. In general, forget about organizing something on Fridays. I always avoid organizing things on Friday because most Parliamentarians are gone, and a lot of people in the Brussels bubble leave town. Some say that for the same reason Thursday-evening is a bad day, but my experience is that Thursday evening is perfectly viable. Another thing to take into consideration is that the College of European Commissioners usually gets together on Wednesday. So if you would like to involve a European Commissioner this might be a good day. Ironically this is also the plenary day of the Flemish Parliament, so forget about inviting members of the Flemish Parliament.

Taking all the above into account, it is easy to imagine that there aren’t actually many good dates throughout the year. Maybe only a handful. To make things worse you will not be the only one that is searching for a suitable date. That is why there are some days throughout the year where 10 or 20 different events are organized in one day. Therefore it is very important to know what other events are going on, so that you don’t compete with similar or more pressing events. In October for example there is the regional Open Days where all the European regions organize events. Unless you are a region, this is a terrible week to organize something. Sometimes it is good to organize on a day that everyone else avoids. I organized an event on the day the Commission was presenting its proposal for a multi-annual budget. Since no-one thought this to be a good idea, it was almost the only event of the day.

Location, location, location

Together with the date, having the right location is one of the most important, if not thé most important thing to consider when organizing an event. What location you should have really depends on what kind of event you are organizing. I will start explaining where and why to organize smaller events (10-50 persons), and afterwards will share some insights about bigger events (+100 persons) A breakfast or a lunch meeting are ideal to speak to policymakers while respecting their time. Everyone has to eat at some point in the day, why not mix business and pleasure. One absolute requirement is that it isshort and relevant. If a lunchevent lasts longer that promised you mess up the agendas of the guests, making them regret they signed up for the lunchevent. Breakfast meetings are tricky. In theory they should start before work starts, but actually rarely do. One drawback is that I noticed that stakeholders send their interns and stagairs to attend them. Organizations like the European Policy Center have successful meetings in the early morning, but they have the clout and reputation to pull it off. Here are a couple of places which are ideal to organize lunch or breakfast meetings. The Stanhope hotel is a lovely, posh boutique hotel with a couple of meeting rooms. Rooms like the Wellington serve perfectly for smaller, intimate lunch meeting. If you prefer to have a meeting more closely to the Berlaymont instead of the Parliament. Martin’s Central Park also offers a couple of meeting rooms, and moreover they are also sometimes willing to close certain parts of the Icones Restaurant for groups. Moreover they have a great garden, which can also be used for lunch meetings. Hotel Rennaisance also offers good value for money, moreover it is very nearby the European Parliament. Then there are a couple of options which are not so accessible because you need someone to “get you in”. The European Parliament has a couple of member saloons which are ideal for organizing smaller meetings. However you will need to persuade a MEP to support your event because only MEP’s can reserve space in the European Parliament. The same goes for the Warande. The Warande is a true gem, a lovely space in the heart of Brussels. However since the Warande belongs to the society of Flemish people in Brussels, you need to know someone who is Flemish, and is a member of the society to help you book a room. In my opinion the Warande is a little bit on the expensive side.
When it comes to bigger events, Brussels houses some top notch locations. One of my favorite is Bibliotheque Solvay. It is located very near the Parliament, and in general you don’t need to worry about giving directions as most of the Brussels crowd knows where it is. Bibliotheque Solvay has a rich decor of precious wood, mosaics and stained glass windows, all covered by a large glass roof, which gives it a feel of prestige and luxury. On a similar note is Concert Noble, charm of a location located in the heart of the European quarter, it boasts a beautiful ballroom, giving it a feel of splendor. A bit out of the way is the Claridge. The Claridge is located near Madau and would certainly not be mentioned were it not for their unique Digital Wallpaper, giving you the opportunity to give your presentation on all walls of the venue. Some people like the Museum of Natural Sciences, because it is located near the Parliament, and sitting alongside dinosaurs is something special. However, mind that they oblige you to work with their caterers and moreover charge you also for the chairs people sit on. I personally prefer when venues give me a total price upfront instead that I have to pay for each single service individually. Also a bit out of the way of the European quarter is the Munt, the old Opera House of Brussels. I like the Munt because the location is relatively cheap and moreover quite flexible concerning what you can do with decorations and stuff. If you are organizing something for a young crowd Area 42 is an interesting alternative. It isn’t in the European quarter but the location is very modern and funky and you can really let your creativity run wild. Then there are a couple of public buildings which are also for rent. The Flemish Parliament has some meeting rooms for rent, but also a space for events like the Schelp. And then there is of course the European Parliament. The Yehudi MENUHIN room is usually used when you also have a concert or music during your event. Again, you will need an MEP to get this space. Moreover, because of its popularity and technical requirements, you will need to plan something at least six months up front if you want to organize something in the Yehudi MENUHIN hall.

Logistics-stuff

When organizing an event, you have to think of a lot more than just the location and the date. Re-run in your head all the things that are going to be needed for the event, and what can go wrong. Will people arrive by car or on foot? Will you have to direct them to a parking? Is all the physical infrastructure like chairs and lighting present at the location or will you need to rent something? Personally I have worked with Design4Rent and I am satisfied with their services. For more practical stuff like stages I worked with Festi. For flowers, I like to work with Schuman Flowers. A lot of people no’t know, but apart from their flower-stand they also deliver for events.

Catering

Whether for the welcome-drink or the network cocktail, when organizing an event, you will have to have some kind of catering. Because there is no catering with which I am 100% satisfied, I decided not to give any suggestion for the time being. But please email me if you have any great suggestions!

Moderator

If you are organizing a bigger event, you might want to hire a moderator or someone who hosts the event. Be aware that this person can make or break your event. I wished I had a list here with good moderators, but it really depends on the event and more importantly on the audience. If you have the budget go for moderators that are famous persons, as this attracts crowd by itself. Another no-brainer is that the person actually knows something about the topic. If the person is passionate about the interest you convey, it will make the event all the much better. In the other extreme if the moderator has no knowledge of the matter at hand, he will make silly mistakes and it will suck out the life of the party.

Arranging speakers

When organizing a public affairs event in Brussels, you will probably arrange some speakers. Some speakers will not have to be arranged because they are either part of your public affairs network or your internal organizations. But if you are asking MEP’s, European Commission officials or other to speak here is some advice, in order to make sure they agree to come, and actually show up. Members of the European Parliament or notorious for cancelling, arriving late and leaving early. To be sure that a MEP agree to come to your event there are a couple of things to keep in mind. First, instead if it is an electorate week (green week) MEP’s don’t like to travel. So your event will need to be near the Parliament if not in the Parliament. Secondly, MEP’s don’t like to share the spotlight. Asking more MEP can raise the profile of your event, but it can also be the reason for the cancellation of some MEP’s. So while it is certainly not forbidden, you will have to know how a MEP will react to other MEP’s being present. Time is of course important; don’t organize anything during the actual committee meetings of MEP’s or during voting time. In order to create commitment request for a meeting with the MEP to brief him/her about the event and his or her role in it. Finally, put the MEP in the spotlight. Arrange an interview before or after the event, and make sure that the MEP has his 5 minutes of fame to convey his political message.

Arranging a European Commissionaire is quite tricky. They have little time, and are very picky about what event to go to. In all honesty I have arranged (and failed to arrange) a couple of European Commissionaires, but still I can’t say exactly what was the main reason for my success or failure. Here are some humble tips anyway. Announce to the secretary by telephone that an invitation is coming s coming. This will create a mental note for the secretary or personal assistant. I have had a few instances that I never got a reply. The assistants receive hundreds of emails every day and they will probably forget to respond to one or two. Therefore it is important to make this mental-post it. Make sure that the invitation is relevant to the Commissionaires portfolio. After you have sent the invitation, don’t hesitate to call the secretary again to see if she has received it and to ask when you can expect a reply. Concept

Not to be under-estimated is the concept of your event. 90 % of all the events in Brussels are panel-debates. If you do not invest time, creativity and effort your event run the danger of being remembered as boring. Because in Brussels you operate in a administrative-political environment, there are limitations on what you can do. The Brussels crowd likes to be entertained but not to be humiliated or made fun of. So a moderator can be challenging, but can’t go over the edge. One way it to re-shape your panel debates into something more fun. You can make it look like a TV-show. I heard of a debate inside a boxing-ring. One consultancy sent out invitations in the form of airplaine-boarding tickets. During one event I visited, there was a fashion-show. For this reason, organizers often also give gifts to guest when they leave. At the yearly KPN event guests were given Moleskine notebooks. I operated once on a low budget, but I still wanted to give something as a parting-gift. So we came up with the idea to give Sunflowers to all guests. They absolutely loved it! You need to have this twist to your event to separate it from competing events, and more importantly to be remembered. One of the reasons you are organizing this event is to convey a political message that “sticks”. So you don’t want to organize something that is easily forgotten, or worse; remembered as a failure.

Promoting your event

Finaly, you will also have to do some promotion of your event. This is not only so you draw more crowd to your event. This is only part of why you prmote your event. By promoting your event, you are also promoting the political message that is enshrined in your event. So no opportunity should be missed to promote both your event as well as your message. I always post my event on the European Agenda. Moreover I use various groups on linkedin. Apart from promotion before the event happens, make sure you also do some after-promotion. This ranges from making a press release to summing up the conclusions of the event. Also you can have a dedicated website with all the fotographs of the event. You can even mention the event months later, in publications or speaches, in order to give it the air of a "landmark" event. You can prmote your event for free in the European Agenda. For me the site is a proven way of reaching the Brussels crowd. If you are Dutch you might also want to put your website on the Agenda of Europa-NU.

Why is lunch so important in European policy making?

Having lunch with policymakers is an everyday routine in Brussels. It is so important I would almost claim it is a part of the ordinary legislative process ;-). Lunch creates an arena where thoughts and information are freely exchanged. This makes sure that there are no bumps in the road or hick-ups during the policy making process. It is simply the oil that makes the engine run more smoothly.

Table manners

Make sure you are the one that chooses the restaurant. The restaurant needs to be nearby the office of the policy maker in question. And with nearby, I mean walking distance. One metrostation away is already too far. Make sure you show taste, without being too exurbitant. Having lunch in a restaurant with three michelin stars may hint at corruption. In any case there is no lack of good restaurants in Brussels. Never start with your problem or issue right away. Use the starter to ask your tableguest about what occupies his mind these days and other chitchat. Save your main issue for the main course. While waiting for your main course start politely with the topic you want to talk about. Make sure you don’t bring forth your most controversial question right away. If the policymaker (like a Commission Official) feels he is pressed for a binding statement he will shut down, and you are in for a long lunch. Smooth him into the conversation by explaining your worries, and how this relates to his work. Never speak in terms of your own narrow interest, always try to show how this is a problem for many actors in the EU. Make it interactive. I have once seen a Turkish lobbyist discussing enlargement. The poor Commission Official had to sit through a monologue of more then one hour. When voicing your concerns, you could do so in form of a question; How can we make sure that the voice of our stakeholders are heard?” How can we make sure that there is enough time for companies to adjust to the new legislation?”. In this way you do not press too much upon the official, while at the same time invite him to think along with your problem. This interactive part is very important. Make sure that there is enough time for chitchat during desert. Always briefly summarize what is discussed, including any action points / obligations stemming from the lunch. This is to make sure that future agreements are binding while making sure that you and your lunchpartner understood each other well. Finally, there are two rules to adhere to to make sure your lunch was a succes. First, respect the other persons time. Always ask up front when he has to be back, and guard his agenda more vigilantly then you would your own. Secondly, always pick up the check!

Some might say that I lack style because the Grapewine ended up on my list. I would retort by saying that this place is really under-rated. The meals are great, the price is low and it is next to the Parliament. The service is very fast and the Indian buffet is a crowd-pleaser. The Grapewine is not a place to organise high-level meetings, rather it is a restaurant to bring assistants of MEP's, journalists or other policy-actors with whome you are already quite familiar.

Karsmakers en Tout Bon

Ok, I know that the title says LUNCH, but these two places are actually great for lobby-breakfast! Both Karsmakers en Tout Bon have similair concepts; great coffee and pastry, and both are actually louzy places for lunch as they are too crowded. However, both are great for a informal breakfast with the assistants of MEP's. Because assistants don't have much time, even for lunch hours, breakfast sometimes is a viable alternative. Both places are very nearby and both open very early so your assistant will be on time for morning briefings, after they had a morning-croissant and capuchino with you!

For whome: MEP's, Head of Units and Directors of the European Commission

Maison de Lyxembourg is a upper class restaurant which serves delicious, albeit a bit expensive meals. It is very close to the European Parliament, and Place Lux. It is not a place I would take assistants for a quick lunch. It is an ideal place to introduce your director or local deputy to an MEP. The business lunches cost around 40 euro's.

WET 89

For whome: Assistants of MEP's, younger civil ervants from the European Commission

WET89 is a worldy lunch café situated at, how could it be else; LOI 89 / Wet 89. The ofice space directly above the diner is occupied by the Christian Democrats of Belgium. Wet89 is very trendy, without being pretentious. I would go here with assistants of MEP's during a Strassbourg week when they have more time, or other stakeholders with time to spare. I have also had lunch here with younger European Commission officials, because they can apprecaite the cool, but cramped atmosphere. I would reserve ahead, as it's popularity has outgrown its physicle space.

Restaurant Icones is part of the Martin's Central Park Hotel. Their business lunches are great value for money, and the atmosphere is formal but pleasant. The waiters are very experienced and it shows. Moreover, what makes this a top destination for lunches with stakeholders is that both waiters and management go through great length to make your event or lunch a succes. I have had different meetings here and sometimes I had special needs which were always taken care of. Moreover, they have a great garden which is a lovely place to have a meeting if the Belgian wather allows it.

Why aren't MEP's reading your letters?

Lobbying the EU seems inviting af first. Indeed all the MEP's have their contact-details posted on their website, and getting in touch with a policymaker seems like just an email away. So you start writing letters to MEP's and to your surprise they aren't getting back to you. After a while you are starte to wonder what you are doing wrong. Here is a small but not exhaustive list of why MEP's aren't responding to your letters/e-mails.

They simply haven't yet read your email.

MEP's sometimes receive hundreds of emails a day. These emails are filtered by their assistants, but even these busy bees can't handle the workload to cover everything. What you could do is call the assistents of the MEP and ask them if they have received the mail. This will make sure you at least know they have received it and bump it up in their unconscious list of letters to watch out for. If it something rather important (but I am mean really important, because in principle everything is important) what you could do is announce that you are going to write a letter. Call the assistant, ask them if they would rather receive the letter on their own email instead of the MEP's and explain in two sentences what the letter is about.

Wrong time, wrong place, wrong MEP: Your letter is irrelevant

Most of the letters and emails that MEP's receive are to inform them about a certain stake, project or region without asking them for direct and concrete action. All these letters end up in the trash bin. The same goes when you write them a letter asking them for their support but the MEP is not in the position (the right committee, or the right moment in the policy process) to help you. Don't expect an MEP to write you back if youre issue is already a lost battle. So ideally, you write to the MEP who is in the right committee to help you, at a moment when it actually matters.

Barking up the wrong tree: the MEP has opposing views of what you are asking from him

Are you sure the MEP is actually in favor of what you are asking from him? A little background check wouldnt hurt. An extreme example would be asking for support for nuclear power from a Green MEP. But every single case will have to be politically in line with the political values of the MEP, and to some extent of his political family. One way to check is by looking at votewatch,eu to see how the MEP or his political party voted on the issue in the past. Or simply do a background check by looking at his website or other resources.

You don't have the (political) clout

When a issue becomes "hot", the whole of Europe wil start contacting a handfull of MEP's. The MEP will then have to decide who to listen to to. He certainly won't be able to listen to each and every lobbyist or interest group calling him. What ussually hapens is that he makes a selection of "opinion leaders" on the issue. These opinion leaders range grom experts to political heavyweights. On the Common Agriculture Policy these could involve world class Universities like Wageningen but also interest groups like COPA-COGECA. All the small players will be disregarded (I am exagerating a bit). So if you want your voice to be heard in the midst of the battle, you should make sure you "bring a friend"which has the attention of the MEP. In case that you do not have the political weight to throw around, you should at least be an expert int he field.

General recommendations

There is nothing worst then having problems to acces a policymaker when you have a immediate and pressing issue. One thing you did wrong from the start is that the MEP apparently doesn't know you well enough to give you 5 minutes of his time. Therefore you should invest in buidling a relationship with an MEP (and just as important with his assistants) even before you have an issue. Seconly, pay great attention to detail. Is the letter you wrote personalized in order to make it relevant for the MEP you are adressing. You can forget about mass-mailings, they are only effective in hurting your reputation. Thirdly, make someone with political clout contacts the MEP. Lobbyists are the weakest pieces on the EU chessboard, its far more better when an CEO, a local politician or a ambssador contacts an MEP.
