This past fashion week I had the opportunity to view one of the most dynamic, unique and well tailored collection from Marlene Haute Couture. The Garment were so devine and breath taking, Marlene is surely becoming the next power house brand, a collection such as this should be available in New York top department stores.

Since October 2011 , Marlene Haute Couture ( MhC ) has been successfully branding her Name and Label through participation in multiple Fashion Events including: Midwest Fashion Week (Indianapolis) October 2011- Gypsies of the Nile an Avante Garde Collection featuring Peacock Feathers, Plitz's New York City Fashion Week February 10, 11, 2012 with two Collections, an expanded Avante Garde Bridal Collectionon the first night and a new elegant Black and Red Brocade themed Collection the second night. Both received many accolades including from the producers themselves in the media interviews with MhC after the shows. The Plitz's Producers stated that both Collections were the Best they have seen at their Events.

Marlene’s designs are of very high quality, one of a kind, unique but yet very feminine. Aaron Camper @ The Grammy's performing with Justin Timberlake!

The 55th Annual Grammy's was a night to remember, with stellar performance from Justin Timberlake that stole the show with his extravagant performance. Justin Timberlake with his 15 plus member band rocked the stage with background singer such as Aaron Camper and a full orchestra in full black Suit & Tie" and another new track from his upcoming third solo album, "Pusher Love Girl." Whether in black and white or color, JT and his backup singer Aaron Camper and his band brought down the house.

Aaron Camper hailing from Salisbury, MD this Grammy Nominated singer/songwriter has always had a hunger and a drive to learn music in its purest and simplest form without compromising the art. At a young age this son of a preacher was given an array of songs and records from his father that would change his life forever. “Experts Views on the Value of Business Plans”

Business Plan writing is very important to my company in order for us to secure funding. What I have learned from this program is that you can never be too sure about the market you are targeting, what should investors expect from your venture and will this product or service you offer be beneficial to your consumers. In order to be successful one have to make sure they know their products and service and is this service lacking in the market we are targeting. Many times you will find entrepreneurs who have great ideas and really do not have a grasp on what their product or service will give to his or her consumers. What I have learned is you have to know your market, what are my consumers lacking? And how can I change that void to an investment. Taking these things in mind I have decided to make a few changes to my Business Plan, to focus more on my market and how I can convert more consumers and business to partner with my service. We have so much to offer or clients as a business so we want to make sure that every client experience that luxury service we offer and become promoters and referrals for our company. Making these changes and setting up a plan will show and instill confidence in our potential investors that our products and service is worth investing in. After reading an article from Andrea Cockerton we can find a trend. Andrea mentions that networking event is a great way to target contact to large companies that can eventually turn around into long-term partnership and funding. I agree you find networking events to be very informative and beneficial, for you get the opportunity to talk to different people in different areas of the industry that can be lead to one of the real big dogs in investments or work for one of the big banks that are seeking ventures such as yours. Kevin Gieger spoke on production companies taking that step in the industry by producing their own show from in house. I agree I find it more cost effective when you source in house than from other companies. However when doing business with outside companies you build relationships but when you use your own house equipment and staff you have all right to the ideas, venture or product you produce. This is one of the key things I am looking to incorporate in my company. I intend to purchase our own equipment and supply and hire an in house staff to run that department. I believe our investors would find that smart and resourceful. Investors are more concern with the marketing and business operations and how will product or service give them a return on their investment. So in all honesty they are more interested in looking at the projected business growth for the first three years.

Key Component of a Business Plan:

Berry talks about the important of a business plan and what investors look for when looking for potential investment opportunities. The key components of a business plan are your Executive Summary. The Executive summary is a brief summary of everything that is explains in the body of your proposal. It gives an investor the opportunity to see if this venture is worth investing or meets their needs prior to reading the entire plan. We then move on to the second key component, the Marketing Plan. The marketing plan relates to your product and service and should be outlined in your business plan. This shows an investor how the product and service will fulfill the demand within your marketplace. However the company would also need to show that it has advertising, marketing and sales force to effectively get the product and service distributed and build its brand awareness.

The third key component is your competition analysis. This shows who the competition is and how the competition is effectively penetrating the market. If there is not a lot of competition then this proves that there is a need for this service in its market and an open field for business. If the competition is high then the investor would need to see what you do better and why the market purchase your goods and service over the other competitors.

The fourth component is Management. Investor likes to learn about the key personnel and any strategic alliances the company has. Management is very important to any company because they are the ones who see to the success of the business. Without the right people who have a track record that proves they are capable of running the business investors will walk away from the venture.

Finally the last key component that set the tone for the plan is the Financials. Financials are essential for any investor to feel confident that the team understands the market, real costs of business where profits will be earned. For many start-up companies, the financials are done in a pro forma fashion. This means that figures are placed as hypothetical numbers based on data known to the company. For instance, a company may know how much it will cost to make a widget and what it will cost to market it, but may place a constant in for total sales within the year to demonstrate what revenues for the company might be.

These components are key to any business plan and key to your investors. Focus on what makes your company unique, look for employees that are creditable that have a track record that will be beneficial to your company success. Listening to this podcast regarding UMG v. Veoh case Gordon Firemark explains the issues relating to ISP infringement materials. In this case he point out that the very fact that UMG as actual knowledge of infringing on Veoh ISP without notifying the copyright holder of the ISP to infringe material. It all boils down to did YouTube know or did they know of the infringement material and what material should the copyright holder have to present to prove their case and what actual rights do they have to block access. However it all comes down to the 9^th circuits, will the 9^th circuit follow the 2^nd circuit ruling and in the end will the following case revile what ISPs should do if they discover copyright infringement.

The podcast also talked about Royalties dispute with the Universal and Eminem case. Now we all know that a lot of cases have been presented regarding digital downloads and actual sales when it comes to music. Artists have been fighting for a percentage of sales on digital download for years and feel that they have been ripped off from gaining their percentage from their album sales. This case brings light on said situation, the judge in the case blast UMG that they are knowingly bamboozling these artists by rewording document and using them against these artists in court. The Judge ruled that this court would not allow them to get away with it. So the court ruled that they will allow the defendant right to bring their complaint in the new amended case.

This case is all about license vs. Sales and we all know that as Artist we can get wrapped up in the glitz and glimmer and not really aware of what is really going on. It is always wise to have contract and sales agreement reviewed by a legal advisor before signing. The music industry is an industry that we always seem to find the most lawsuits when it comes to royalties and percentage of sales. Recording labels, have always piggyback off artist. As artist we have to educate ourselves of what is right from what is wrong, we have to know our industry, our rights and what resources are at our disposal before we engage in any new business. I have learned a lot over the past few years that you always need to have something in writing; you need legal advisors and never sign anything because it sounds good.

While fall temperatures are dropping outside, it didn't stop the spring colors of aqua, yellow, and grey from brightening up the room in the Empire Room within the Empire State Building this week. Model/Actress Denise Dietrichs, of the Top 20 Victoria Secret Angel Tour and Miss Russia New York, Angelina Shipilina help convert the lounge into a catwalk of the latest fall trends and concepts of the season. Designers Lizzi London, Sharon E. Clarke, and Dexter John gave a glimpse into their current fall collections for the Celebrity Annual Platinum Red Carpet Networking Event. Ruffles, fringe, and chiffon flowed seamlessly through the crowd in high fashion. Within the men’s wear category, embellished jackets were the focal point and rave. Fashion week maybe officially over however that doesn’t stop designers from putting on a show stopping event. Reviewing this case on copyrights Luluemon’s is suing Calvin Klein for copycatting its active wear “Astro” Yoga Pants collection. As we are aware, in today’s fashion industry it is hard to sue a company for patent or copyrights infringement. However today we have seen that numerous companies have taken the step to make this issue know that if done they are taken action. I find that these cases are creating an evolving trend block. Think about it, if more companies start suing other fashion companies and designers then every season new and advance market trends will start to decline. The Fashion industry is one of the leading industry and with new ideas and creativity our market grows. If companies can’t keep up with change then all the wars and lawsuits over whom copycatting their lines will be unnecessary. However I can relate to Lululemon’s wanting to set a standard on what is right but this lawsuit will result in nothing, unless we as consumers have the government dictates what we wear.

“Navajo Nation Vs. Urban Outfitters clothing line”

“The Navajo Nation filed lawsuit against Urban Outfitters of the use of the Navajo name on clothing. This as we know is called trademark infringement in the use of the Navajo name and trademark of its popular clothing and fashion items. Some of the controversial items in the Navajo line included panties and a liquor flask”. After reviewing this case I can understand the Navajo concerns regarding Urban Outfitters line and how it has infringe on its name and culture. However I give urban outfitter credit for coming up which such great collection and its creativity and feel that both parties can come to some form of agreement. Yes, They did trademark infringe upon the name, but in this case it seem to me that its more about the culture and it concerns for usage of the Tribes name without permission. If Urban Outfitters gave the tribe some form of recognition with the collection I believe the lawsuit would be avoided. However there is a lot of money to be made from this collection and maybe wise for Urban Outfitter to put together a contract giving the tribe recognition and a percentage of it sales to one of its foundation. This is just my opinion.

“Will. I. Am Gets Sued for 2Million For Fashion Fall Out”

Black Eyed Peas star Will. I. AM, allegedly broke a contract with I. AM. Clothing. They are suing him for 2 million dollars. The company claims that the performer had a contract with them until 2016; well the performer claims that the contract was over and done with. Well if the contract was signed in 2010 and expires in 2016 then the artist is liable and this is considered a breach of contract. I.AM.Clothing stated that the artist agreed to loan is name for Marketing and design purposes. Companies investing millions of dollars in endorsement deals with artists, found that many performers tend to back out of contracts that ultimately put the company in financial risks and hardship. I feel that Will. I. AM is responsible for backing out of this contract and should pay the 2 million if he signed on to the terms and agreements listed in the contract.

“What does it take to be a Boss in the Entertainment Industry”?

“I’m a Boss, You’re a Boss, and we are all Bosses”

In today's entertainment industry we are provided with book, podcast and more letting us know what we need to accomplish to become a Boss. Well we can read all the books and listen to all the podcast in the world at the end of the day if you work for a company where someone else hold the Boss title then he is the one who decides who becomes the next Boss.

Now the questions is how long will we stay in the background before we take that initiative to be the next Boss. In today economy you find that the numbers for new entrepreneurs are growing, everyone wants to be the Boss of their own company, Label, or clothing line. But do you have what it takes to be a Boss. To be a Boss requires great leadership skills, organization, communication and last but not least patients. Without these things you are setting yourself up for failure.

Rick Ross said it in his song “I’m a Boss” know he can say that, for he as established his name, company and reputation as the Boss. Sean P. Diddy Combs is another great example of a true Boss. He as built his empire from the ground up, through the good, the bad and the most discouraging times in his life. Being an entrepreneur takes patients its not easy starting a company from scratch especially with little and no funds especially in today’s economy. It takes hard work, dedication, motivation and a mind to succeed. I have watch some of today's great men and woman who came from nothing to being an icon and role model for many in this entertainment industry. They have motivated us to fight for what we believe in and never give up on your dreams. My advice to all my entrepreneurs looking to make it in the entertainment industry is to network, research and learn the ins-and–outs of the industry your trying to get into. I found that Networking opens up doors to great and potential possibilities. You can’t imagine the people I had the opportunity to network with and how they have help guide me in the right direction. Find that person that can give you the guidance you need to make it in the industry, but never forget always protect yourself, your ideas and work. For as P.Diddy said in his song “Its all about the Benjamin’s” Its hard to find loyalty and honesty in this industry and if you are not careful you can lose it all within a wink of an eye. Can you be a Boss that when the finance is not there you would cut your own salary to pay your employee and keep your company afloat? That’s what it takes to be a good boss.

How to make it in the Reality TV World?

In todays entertainment industry reality show ideas that get produced, are often revolve around a specific issue or event that everybody can relate to, and out of that is built a game. They are in essence, game shows. But even more importantly, they are big fun, and often-dramatic social experiments. When we look at these reality show we must remember that some things are fun to play, and some things are fun to watch. To truly connect with an audience and have entertainment value in a show, you need both.

The quality of a reality-based show can span from awful to inspiring. But the reason viewers tune in is because we have an insatiable appetite for witnessing and being entertained by the human experience.

What one should know about putting a reality show together is to follow the following guidelines:

Ø Be Specific in your concept, and try several approaches.

Ø Choose concepts and subjects that are highly marketable

Ø Think of movie

Ø Identify Unique Professions or Lifestyles

When creating a reality show you need to give a production company executives the inside scoop that they would love to find a show that places contestants in some sort of "fish-out-of-water scenario" and would like it to involve a family. What a production company look for is for you to be able to deliver an approach to that concept that is totally unique and something they never would have thought of. When thinking of a Title this stage is very important, they should roll off the tongue easily, provoke conversations, and simply tell you exactly what you’re going to be watching. For example: "The Bachelor", "The Apprentice", "The Biggest Loser", "America's Got Talent", “Real House wife’s of Atlanta” are all good examples. Word play is always a good way to grab attention and create curiosity. “Meet the Parents”, "Wife Swap", and "Blind Date" are all specific to what their show is about, but use known phrases to create new titles that peak curiosity.

The Story is a critical element to define when developing a reality-based project. When you look at movies, look at the core concept and story elements of the film, and a reality show just might be staring you smack in the face. Lastly identify a unique profession or lifestyle is one of the simplest and most successful sub-genre of reality show is the documentary style series covering unique professions or lifestyles. These stories serve the insatiable curiosity viewers have to gain insight into other peoples lives and jobs. Bravo's "The Real Housewives of Orange County" is a guilty-pleasure glimpse into the spoiled and faux-glamorous lives of a certain group of women in Orange County, California.

Once you have completed these steps then you are ready to pitch your reality show, but before you contact a network, you need to get that WGA registration number, which is your way of registering your original idea in order to protect it. The easiest way to obtain this number is to go to the WGA registry page at http://www.wgawregistry.org/webrss/. For $20 you can register your pitch online. Once you have acquired your WGA number the big question is whom should you submit to? The Networks? An agent? Reality TV, Production Company? Most networks won't give you the time of day unless you're already attached to a successful project, but they are three that will Comedy Central, Discovery and MTV.

In this podcast Jonathan Arnold talks about how Copyright affects a comedian’s career and dose it really protect the comedian. Arnold stated that Copyright protects the comedian’s expression but not there idea. For example, when a stand up comedian does an imitation of someone else the imitation is not an infringement, because the comedian’s whole act is protected. Copyright doesn’t cover the imitation of another comedian because the completed developed package of this type of performance is covered under Copyright. For example as long as the jokes are not the same as the other comedians jokes, but the ideas are similar then the comedian is not at risk of Copyright infringement. Basically it’s how the joke is express that is protected, the comedian’s hand movements, and gestures are considered the comedian’s signature. The comedian’s signature is what needs to be protected especially in the comedy industry. The more a comedian develops their act, the stronger protection there copyright will be. It will make them a better comedian, and advance their career. Persona & delivery is another part of a comedian’s copyright, including the way they dress, their hair and jokes. Just like in the first example these things are similar to the whole package and can be copyrighted. But if another artist steals the comedian’s jokes or ideas and performs it better than them does this mean they can sue the other artist? No!

What can be Copyright is your entire sketch, joke, routine, the entire develop show, which becomes protected. The entire show is protected the sheer performance can be Copyright and registered with the Copyright office. It’s an added bonus to record the show to prevent the risk of any legal issues. Having original joke and having a lot of joke like 50-100 that can be edited and revamp in a number of ways. Developed and expanding will help in the development and packaging of your show that you want Copyright. Work on your persona of the joke, the setup, the delivery, this is the key to having your act Copyright. Once you have your complete package talk to a lawyer and register your materials with the U.S. Copyright Office.

As it relates to our company we have to take steps in copyrighting our videos, photographs, and scripts from our show. Our materials are what make us unique and we have to take those steps to protect our work from others trying to use our materials for monetary and publicity gains. I have learned something new for I would have never know that one can Copyright his or her show. This is big! For we produce shows twice a year and yes we have ownership of the footage, but I never took the steps of copyright our video with the U.S Copyright Office. What we would normally do is add our watermark to our video, photographs, etc. This was very informative.

Mark Pierson talks about Rights of Publicity. When we think about a photo shoot for a promotional campaign such as something I do for my company fashion week events. We hire the photographer and models to bring our creative ideas to life. Well the first thing we have to do is make sure that the models all sign Release Forms, giving us the right to use the photos in our marketing and advertising campaign. As Mark mentioned in the podcast, yes we have Copyright ownership of the photos taken but without the release form from the models in those photos we have no right. Because that model can then turn around and sue my company for the photo used without their permission. This is very important Photographers or Producers overlook this step a lot of time. Yes, the entertainment industry is fun, entertaining, and glamorous, but with all that comes scandal, controversies, and lawsuits. Professionals in the entertainment industry whether it is music, movies, television, or design have to be very careful when it comes to deal making. In this blog I am going to discuss three legal controversies that I found to be very interesting, I hope you feel the same.

In the entertainment industry there is always something going on. Being in the entertainment industry it is always best to know what legal liability issues that are going on. Believe it or not, this is vital to creating your business plan and running you business. Issues that I found relevant to my business is cases such as “backing out of an agreement to appear for a show” working with celebrity talents with our show we run the risk of that artist not appearing as agreed which could result in refunds of ticket sales profit lost and cancellation of show. Perfect example:

“LAWSUIT AGAINST BEYONCE”

In April 2011 “Gate Five” a video game developer filed a lawsuit against entertainer “Beyoncé” for backing out of an agreement to appear in the developer’s video game which resulted in Gate Five collapsing and the loss of 70 jobs. Beyoncé’s attorney argued that the singer was well within her rights of backing out of the agreement because Gate Five did not meet their part of the agreement by meeting a November 10 deadline of gaining funds. A New York Judge has ruled that the lawsuit will proceed.

In this case I’ve always felt that celebrities should not be treated any differently legally than a non-celebrity. Beyoncé agreed to appear in this video game, that has not been denied, but she decided to back out because of funding. Know lets say yes the funding deadline did pass, but lets take into consideration the consequences. I feel if the deal was good enough to agree too, than maybe Beyoncé could have funded the project herself, which would add something new and innovative to her well-established resume. Beyoncé is such a huge name and influence, Nevertheless her backing out of this agreement caused investors to turn away which resulted in the company going under. What happened to those people who lost their jobs? It seems these people weren’t considered when the thought of backing out of this deal came to mind.

When it comes to deal making, every aspect should be taken into consideration. If the deal falls through who will be affected? Where is the funding coming from? When are the deadlines? What needs to be done everyday leading up to the deadline? These are just a few questions that need to be answered at the deal-making table.

California band “One Direction” sue Sony and Syco (Simon Cowell entertainment company)

Another industry liability is Trademark infringement with a name. Choosing a name for your company or band can be a crucial thing. We often sit and brainstorm for a name that feels right and a name that represents what we stand for. Most of the time we do not realize the possibility that our chosen name could end up in a lawsuit. Unfortunately, it happens. For example a new and fast growing Britain Band “One Direction”. A Federal lawsuit in California has been filed by a California band also called “One Direction” against Sony and Syco (Simon Cowell entertainment company) requesting that all promotional material causing confusion and damage to the California base band (Dumon, 2012).

Louis Vuitton sued Akanoc Solutions, Inc. for contributory copyright and trademark infringement under the Copyright and Lanham Acts

Louis Vuitton sued Akanoc Solutions, Inc. (January, 2012) ("Akanoc"), Managed Solutions Group, Inc. ("MSG"), and Steven Chen (the owner of both companies) for contributory copyright and trademark infringement under the Copyright and Lanham Acts, respectively. MSG leased servers, bandwidth, and IP addresses to other companies, such as Akanoc, who then operated the servers and otherwise ran the business. Louis Vuitton alleged that some of Akanoc's China-based customers directly infringed on Louis Vuitton's trademarks and copyrights. Louis Vuitton sent the defendants eighteen Notices of Infringement documenting the infringements occurring on websites hosted by defendants, yet the defendants were unable to identify any action taken in response to the notices sent by Louis Vuitton and the websites continued to operate. Louis Vuitton alleged that defendants had actual knowledge of the website's activities, that defendants knowingly avoided learning of the full extent of infringing activities, and that defendants knowingly enabled the infringing conduct by hosting the websites and permitting them to display the counterfeit products. A jury found that all three defendants were liable for willful contributory trademark infringement and willful copyright infringement. It awarded statutory damages on both claims for each of the three defendants.

What I have learned from this liability issue is to be sure to file the necessary papers to protect your business name/band name. There are many things we have to be careful about because as you can see you can be sued when you least expect it. When starting or running your business it is imperative that we take the necessary steps to avoid these types of infringements. We also have to be sure that our right are protected against anyone who uses our works, name and photos for financial gain without permission our approval.

QUESTIONS EVERY PROJECT MANAGER SHOULD ASK BEFORE STARTING A PROJECT!

One of the many skills required of a project manager is the ability to ask searching questions and persevere until a clear answer is obtained. Many of the pitfalls in projects could be avoided if questions were articulated fully and if the answers were given clearly and in detail.
Too often areas of a project that should be clearly defined are not. Assumptions are made about who is responsible for what and, even worse; assumptions are made about what exactly the business objectives are and what benefits the project will deliver to the organisation.In our enthusiasm to get started on an exciting new project it is easy for everyone, not just the project manager, to rush through the early preparation stages of a project and get on to the exciting parts. But in uncertain economic times every project should be delivering substantial business benefits that can be accurately measured. The benefits might be time or cost savings, but equally they might be aimed at maintaining a certain reputation (or rescuing a failing one) so they are not always easy to measure and cannot always be accurately predicted in advance. Nevertheless, the expected benefits should be documented so it is clear to everyone involved why the project is needed.

No list of questions is ever exhaustive, but here are 20 questions a project manager should always ask, whatever type of project they are working on in any type of organization:

• What are the business goals the project is aiming to achieve?

• What business benefits will these goals deliver if achieved?

• What will be the consequences to the business (financial, reputation etc) if the project does not go ahead or fails to deliver the objectives?

• Are there any easy-to-implement alternatives to this project? Sometimes other solutions are available that do not require the cost implications of a full-blown project.

• Are there any disadvantages to implementing this project? Staff redundancies might be an obvious one, but there might be some that are less obvious.

• Who is the main stakeholder, with ultimate responsibility for driving the project forward? It is important that someone senior takes ownership of a project – that person should never be the project manager.

• Who is responsible for ensuring appropriate resources (time, people and money) are allocated to the project? This should be someone with the authority to allocate whatever resources are required.

• Who will be responsible for deciding whether the project goes ahead or not after the initial investigations? This will often be a group of people, sometimes with conflicting aims.

• Is the new project dependent on the successful delivery of a current project? If so, a full report on the status of the project already underway should be obtained before committing to the new project.

• What are the success criteria that will indicate the objectives have been met and the benefits delivered?

• Will new equipment/products be required to facilitate project delivery for example is new software needed?

• Will there be any necessary staff changes (redundancies or new hires)?

• Will existing staff require re-training, for example, to learn new business processes?

• Which individuals, teams or departments will be involved in the project?

• Who will be responsible for documenting the business requirements in detail?

• Who will determine interim and final deadlines? Projects where the marketing department, for example, decide on a deadline for an IT project have a far less chance of success than when informed estimates are made about the resources required.

• How much contingency will be available in the budget?

• Who will be responsible for making the decisions to include or exclude requested changes once the project is underway?

• Will the project deliverables need to be tested and, if so, by whom?

• Who will provide the final approval of the project deliverable?

There are many more questions that could be asked to ensure a project starts off with a good chance of success. But just as important as asking a question is getting a proper answer. The majority of people will have received appropriate training for project managers to help them develop a series of questions that is most relevant for their business. Asking these questions should not be a one-time event. As you progress with the project, these questions should be revisited often. If you don't get satisfactory answers the first time, that clearly shows that additional thought process is needed. The PM (Project Manager) can help coach the business through this thought process and ensure all are aligned on what the right answers should be and where there are gaps.

The reason I decided to write this post was because a few artists had recently approached me who asked me if I could connect them with good managers. There are a lot of misconceptions about what an artist manager does, and there are several types in the music business. I won’t go into all of them in this post. Most of them you won’t need until you’re touring and making some heavy cheddar anyway. The two primary types are the personal manager, and the business manager. Most artists who are trying to get their careers off the ground are usually looking for a personal manager.

Many artists look for managers before developing anything to manage. The more developed you are as an artist, the better your chances are of attracting a good manager’s interest. There are however, some of the major misconceptions about artist managers and what they do. Here are a few

1. Mangers should invest lots of money into the artist. It’s not a manager’s job to pay the costs for your recording projects, travel, or promotional material. While it’s not uncommon to find manager that’s willing to pay for the needs of an artist, they are not obligated to. Some managers feel that dropping cash to help their artists become successful is a worthy investment. Because this is not the manager’s role, he or she will usually make an agreement with the artist that this investment is repaid once the artist starts making money. This is outside of 15 to 20 percent commission managers already receive from the artist’s earnings. This commission is usually but not limited to, performances, merchandise sales, and in some cases money advanced by record labels. It’s rare that managers make agreements to receive percentages of the artist’s song publishing or writing. You should avoid these types of agreements if possible.

2. Another misconception is that managers should have lots of experience in the music business. While this is definitely an asset, it’s much more important that you have a manager that’s willing to hustle hard for you and be ambitious about learning the parts of the business that he or she doesn’t know. Your manager should be someone you have a tremendous amount of trust in because they will play some part in every facet of your music career. This is why it’s not uncommon to see artists with relatives as managers. Sometimes they are the best choice.

3. Managers are not attorneys! Unless your manager has an entertainment law degree, it’s not wise to have them negotiating contracts that can affect you for the rest of your life! Get an attorney to look over any complicated contracts.

4. Managers are not publicists. Publicists handle your PR (public relations), expand you visibility and help develop a marketing strategy for you. Good managers will do some of this for you until you’re signed or able to afford a professional publicist. It a nutshell, good managers want to minimize the chaos that can surround an artist so they can concentrate as much as possible on their music. Good managers are a trusted foot in your rump to make sure you make it to your appointments on time, and make sure that everything you need is there before your arrive. My advice is give managers a few months trial before you decide to make a long-term contractual bond with them. This provides an opportunity for the both of you to see if there’s a chemist.

Introducing Cathleen Lewis: Cathleen Lewis has over 18 years experience in integrated global marketing, branding, sponsorship and activation. She began a career in 1992 in advertising, where she worked in media and account management for number of large agencies including BBDO, DDB Needham and Ogilvy and Mather handling high profile accounts such as Universal Pictures, AT&T and Kaiser Permanente. In 1998, she joined Hilton Hotels where between overseeing global partnership strategy, she also successfully negotiated over 20 multi-million dollar deals including a sponsorship deal where Hilton became title sponsor of the largest theatre on Broadway. High profile enterprise level partnerships were also created with Clear Channel, several airlines, Intel, E*Trade and Coca-Cola. Based on her success in that Director level position, she was appointed to oversee Hilton Hotels’ Olympic sponsorship strategy through planning for the Beijing Olympics. In 2007, she joined former Vice President Al Gore and launched Live Earth, the global concert to raise awareness of the environment and global warming as their VP of Marketing and Communications. Since then, she has started her own consulting firm and has worked with several high-profile companies and startups including X PRIZE Foundation, Starbucks, TED Conference, and several venture backed start-ups among others. Interview:

CEO Cathleen Lewis of “Cathleen Lewis Consulting”. Took sometime out of her busy schedule to speak with me on different approach while conducting a negotiation.

Melisa Brown: Cathleen thank you for taking the time to speak with me. My first question to you would be; how do you use objective criteria during your negotiations?

Cathleen Lewis: “I think you should always site sources or examples that are relevant to what you are trying to get across our what your trying to negotiate for. So in the area of sponsorship if they think the price is too high, your going to site an example of someone paying more.”

Melisa Brown: How do you use leverage and power in your negotiation techniques?

Cathleen Lewis: “Its better to use positive leverage because you are giving them something they want. In any negotiation you always want to have that leverage to walk away and that is a position of power that is the optimal position to be in, Its better to make them feel like they need you more than you need them”.

Melisa Brown Counter Question: In the business you run now how have you used leverage and power?

Cathleen Lewis: “One way I tend to use leverage or power is for example if a potential client say my rates are two high, then I tell them that’s my rate and they need to find someone else. Even though you may say oh my god I want the business, you can’t simply lower your rates because you want the business, you have to stand strong and not lower your rates for then you will be lowering your rates for everyone.” You may end up loosing the business but that’s how it is.

Melisa Brown: When conducting a negotiation is Appreciation one of your main focuses?

Cathleen Lewis: Whenever I’m trying to get anyone I use appreciation. Because I hire third party contractor and when you let them know that they are doing a great job and they do good work they will want to work for you. You also want to tip them (Cathleen Laughs) but when you appreciate them, your work will always be completed on time and never neglected.

Melisa Brown: How do you use Affiliation during your negotiation technique?

Cathleen Lewis: Look for thing that you and the client can relate to and connect with people on. For example I just met with a client from Canada before speaking with you and since I use to live and work most of my life in California and Oregon, I am very familiar with that part of the country, so we could talk about Vancouver and DC and where she’s from. This helps a lot because it shows you know whom they are and were they are coming from. Even if its geography.

Melisa Brown: How do you Deal with negative emotions during negotiations?

Cathleen Lewis: This is a fun one! I love this part. You always want to acknowledge but not agree. And then make sure your speaking in a tone that is calmer and softer, not too much so that you seem condescending. This is the best way to tackle this situation.

Melisa Brown: So you have a client and they are really negative and loud how do you handle that and get them to calm down?

Cathleen Lewis: They will eventually stop talking. You just don’t say anything. In terms of activating sponsorship for big things like live Earth and the Olympics. Their was a lot of emotions involve because there was just not enough time to activate a lot of things, but a lot of money was being spent. You just have to remain calm because they will eventually see that they are acting unprofessional and stop talking. “ You can’t play in the sand box” because it will spiral out of control if you try.

Melisa Brown: Mutual benefit, do you focus on the benefits of both parties? And how do you come to a mutual benefit during negotiation?

Cathleen Lewis: I usually focus on the clients benefits, not necessary mine, because if I’m trying to get them to agree its more important for them to feel that they are getting all the benefits not you are.

Melisa Brown: Why wouldn’t you think of both party benefits?

Cathleen Lewis: I wouldn’t do business with them if I didn’t already know if they hire me what benefits are in store for me. When negotiating I always focus on their benefits not my benefits. In all my discussion it’s what I can bring to the table and what I can do for them. And what I can deliver. I don’t focus on this is a great client that’s going to build my carrier, the cost of my retainer, or a great client to build my roster etc. In this negotiation I am the seller and they are the buyer.

Melisa Brown: Dealing with dirty tricks and/or tricky tactics, how to you handle this situation?

Cathleen Lewis: What goes around comes around! I think that you have to handle yourself in a way you feel good about, you can confront the person, but you know and he knows who said it. But if they deny it you both know who said it and you know 100% and you know they are not going to come clean you just have to move on. When anything happen like that it best to move on. If you mire in those conditions, it is difficult to escape from. You just have to move on.

FAME ROCKS FASHION WEEK 2012 COVERED BY I.N. TV

The New York Fame rocked fashion week with a fabulous night of music, fashion and entertainment hosted by Recording Artist Keke Wyatt. Featuring celebrity guests, fashion VIPs and industry insiders. Designers from Project Runway debuted their fall 2012 lines accompanied by some talented up and coming music artist during the show.

Hosted at the Manhattan Center Grand Ballroom I.N-TV hit the red carpet and talked to celebrities and featured designers. Renee Graziano, Erica Mena, Dwight Eubanks, Coco and Breezy were among those who attended the event. Recording artist Keke Wyatt was pretty in red and proudly showing her baby bump. (She said this is child number six)...she also mentioned during the show it was her first time hosting and ended the evening with a short tribute to Whitney Houston by singing “I Will Always Love You”. Shontelle performed her hit Impossible and also sang her favorite Whitney song “I Wanna Dance With Somebody” the crowd which was quiet most of the night, got up out of their seats. Fame Rocks Fashion Week 2012 benefiting Music Unites was an amazing event showing support for the arts of music and fashion. Featuring high-end fashion lines from Cotrice, Elena V Designs, Nikki Blaine, Nico Lena, Veronica Spadaro, Stevie Boi, and The Estradas.

The fashion show combined the interesting element of live music side-by-side with the runway presentations. The correlations between the clothes, the walk of the models, the performers lyrics and vibe gelled perfectly to illustrate the power of music and fashion. Some of the highlights of the runway were the spirited performances by Kimberly Nichole and headlining songstress, Shontelle. There were many excellent designers participating, and those of special note were Elena V Designs (with fantastic hair by B Cosmo Inc!), Nikki Blaineand Veronica Spadaro. Speaking about the far reaching ability, power of music and fashion, even Miss Teen NY International 2012, Micaela Bishop, and Miss NY International 2012, Adele Scala, were in attendance that evening to show their support.
