&lt;span style="line-height: 1.4em;"&gt;Dopo il taglio degli oneri per cittadini e imprese contenuto nel decreto approvato una settimana fa e ancora in attesa di pubblicazione sulla Gazzetta Ufficiale sta per scoccare l'ora del fisco. Al Consiglio dei ministri di martedì prossimo potrebbe approdare il Dl sullo snellimento degli adempimenti tributari. Ma il suo oggetto potrebbe essere anche più ampio visto che, insieme a una serie di norme anti-evasione, è atteso un pacchetto di correttivi al federalismo municipale.&amp;nbsp;&lt;/span&gt;&lt;span style="line-height: 1.4em;"&gt;Che potrebbe essere mini, se si decidesse di intervenire solo sull'esenzione degli immobili dei Comuni o dell'edilizia popolare, o maxi, se fosse invece accompagnato da un aumento della manovrabilità delle aliquote in abbinata a una revisione parziale del patto di stabilità.&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

Da gennaio 2012 verrà introdotta l’imposta municipale propria (Imp)&amp;nbsp; fino al 2014,&amp;nbsp; poi dal 2015 ci sarà la vera e propria Imposta municipale unica (IMU) sui possessori d’immobili compresa l’abitazione principale e le sue pertinenze. Per abitazione principale s’intende l’immobile, nel quale il possessore dimora abitualmente e risiede anagraficamente. Per pertinenze dell’abitazione principale s’intendono esclusivamente quelle indicate nelle categorie catastali C/2, C/6 e C/7. La base imponibile dell’imposta è costituita dal valore dei fabbricati. Esso si determina moltiplicando il valore della rendita al 1° gennaio dell’anno d’imposizione, rivalutato del 5%, per i seguenti moltiplicatori:&lt;/div&gt;

• 160 per le abitazioni classificati nel gruppo catastale A e nelle categorie catastali C/2, C/6 e C/7, con esclusione della categoria catastale A/10;&lt;/div&gt;
&lt;div class="p1"&gt;
• 140 per i fabbricati classificati nel gruppo catastale B e nelle categorie catastali C/3, C/4 e C/5;&lt;/div&gt;
&lt;div class="p1"&gt;
• 80 uffici: fabbricati classificati nella categoria catastale A/10;&lt;/div&gt;
&lt;div class="p1"&gt;
• 60 immobili produttivi: fabbricati classificati nel gruppo catastale D;&lt;/div&gt;
&lt;div class="p1"&gt;
• 55 negozi: fabbricati classificati nella categoria catastale C/1.&lt;/div&gt;
&lt;div class="p1"&gt;
Per quanto concerne il valore dei terreni agricoli esso è determinato applicando al reddito dominicale risultante in catasto al 1° gennaio dell’anno d’imposizione, rivalutato del 25%, un moltiplicatore pari a 120.&lt;/div&gt;
&lt;div class="p1"&gt;
L’aliquota di base dell’imposta è dello 0,76% e può essere aumentata o diminuita dai comuni fino allo 0,3%.&lt;/div&gt;
&lt;div class="p1"&gt;
L’aliquota per l’abitazione principale è dello 0,4% e può essere aumentata o diminuita dai Comuni fino allo 0,2%.&lt;/div&gt;
&lt;div class="p1"&gt;
Sull’immobile strumentale d’impresa l’aliquota può essere poi ridotta dai Comuni fino allo 0,4% se posseduto da soggetti passivi Ires o se è dato in locazione. La nuova imposta municipale propria (Imp) prevede l’introduzione di una detrazione per la prima casa di 200 euro per il momento. In base ad un nuovo emendamento, ancora in fase di approvazione, si prevede un ampliamento della detrazione fino ad un massimo di 400 euro (per ogni figlio convivente sotto i 26 anni sarà possibile aggiungere 50 euro alla franchigia di esenzione fissata a 200 euro). Questa detrazione verrà compensata dall’introduzione dell’Imu anche per gli immobili all’estero (0,76% del valore degli immobili).&lt;/div&gt;
&lt;div class="p1"&gt;
Nel caso in cui l’abitazione è adibita ad abitazione principale di più soggetti passivi, la detrazione va ripartita tra gli stessi in base all’effettiva destinazione dell’immobile.&lt;/div&gt;
&lt;div class="p1"&gt;
Il versamento dell’imposta a differenza di quanto previsto per l’Ici potrà essere effettuato in 4 rate anziché due (marzo, giugno, settembre e dicembre).&lt;/div&gt;
&lt;div class="p1"&gt;
Inoltre, la nuova Imu (imposta comunale unica) a partire dal 2014 dovrebbe conglobare anche la Tarsu (tassa per lo smaltimento dei rifiuti solidi urbani) e la Tia (tassa igiene ambientale).Entrambe hanno lo stesso scopo ossia coprire i costi derivanti dalla raccolta, trasporto e smaltimento rifiuti.&lt;/div&gt;

Rotto ogni indugio la Regione Lombardia prende una decisione "storica". Prevede che dal 1 gennaio 2012 ogni annuncio immobiliare debba obbligatoriamente riportare la classe energetica dell'immobile oggetto di compravendita. Le multe previste sono salatissime ed è quindi sconsigliabile il fai da te per chi non è del mestiere.&lt;/div&gt;

Il decreto liberalizzazioni, pubblicato martedì scorso in Gazzetta ufficiale, contiene alcune novità sull’edilizia per gli enti locali e le imprese di costruzioni.&lt;/div&gt;

Nell’articolo 56 del d.l. n.1/2012&amp;nbsp; il provvedimento prevede che i Comuni possano&amp;nbsp;decidere di&amp;nbsp;&amp;nbsp;&lt;strong style="background-attachment: initial; background-clip: initial; background-color: transparent; background-image: initial; background-origin: initial; border-bottom-width: 0px; border-color: initial; border-image: initial; border-left-width: 0px; border-right-width: 0px; border-style: initial; border-top-width: 0px; margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px; outline-color: initial; outline-style: initial; outline-width: 0px; padding-bottom: 0px; padding-left: 0px; padding-right: 0px; padding-top: 0px; vertical-align: baseline;"&gt;ridurre l’aliquota di base (IMU)&amp;nbsp;fino allo 0,38 per cento&lt;/strong&gt;&amp;nbsp;per i fabbricati costruiti e destinati dall’impresa costruttrice alla vendita, fino a&amp;nbsp;che permanga tale destinazione e non siano in ogni caso locati, e comunque per un periodo non superiore a tre anni dall’ultimazione dei lavori.&amp;nbsp;&lt;/div&gt;

La grande illusione delle categorie catastali ha lasciato per anni 
l'amaro in bocca a centinaia di migliaia di proprietari che, a fronte di
 case praticamente identiche, hanno subìto pesanti sperequazioni 
fiscali. E tutto per un numero: perché il loro immobile è stato inserito
 nella categoria catastale A/2 (civile) anziché A/3 (economica). La 
differenza ufficiale, riportata qui a fondo pagina, è difficile da 
capire, eppure si tratta del 70% del patrimonio abitativo: 11,3 milioni 
le A/2 e 11,8 milioni le A/3. In sostanza, nei piccoli centri, molti 
hanno avuto la sfortuna di vedersi classare l'immobile con 
«caratteristiche costruttive residenziali» invece che con 
«caratteristiche di economia e impianti indispensabili».&lt;br /&gt;

Dal 2013 anche il bonus sulla riqualificazione energetica degli edifici entrerà a regime, ma ribassata al 36%.&amp;nbsp;La detrazione del 36% per interventi di ristrutturazione diventa strutturale. L’agevolazione fiscale viene estesa a interventi su edifici danneggiati da calamità naturali, è utilizzabile per le ristrutturazioni, creazione di posti auto, superamento delle barriere architettoniche, messa in sicurezza dell’abitazione, cablatura degli edifici.&lt;/div&gt;

Le spese e gli onorari a carico dell’aggiudicatario sono esclusivamente quelle maturate dopo la vendita andata a buon fine (registrazione, trascrizione e voltura del decreto) mentre tutte le altre voci devono essere sopportate dalla procedura (verbali d’asta, predisposizione del decreto, progetto di distribuzione, pubblicità, comunicazioni e notifiche).&amp;nbsp;&lt;/span&gt;&lt;br /&gt;

1) Segnalazione obbligatoria - L'obbligo di segnalazione in anticipo del dispositivo elettronico è una regola a cui siamo ormai tutti abituati. Diverso ma frequente è il caso esaminato all'inizio di quest'anno dalla Suprema Corte con la decisione 680/2011 A contestare la multa, infatti, è stato un automobilista che provenendo da una strada secondaria si era immesso sulla statale in un punto successivo al cartello di segnalazione dell'autovelox. Ricevuta la multa per eccesso di velocità aveva sollevato ricorso, lamentando «di non aver incontrato alcun cartello segnalante la successiva presenza dell'autovelox»......&lt;/div&gt;

Non hanno funzione di copertura dei piani sottostanti in quanto, essendo strutturalmente autonomi rispetto agli altri piani, possono esistere indipendentemente dalla presenza di altri balconi sulle facciate dell’edificio: pertanto, non assolvendo funzione di copertura del piano sottostante, non soddisfano utilità comune ai due piani l’un l’altro sovrastante e non danno alcun vantaggio ai condomini che non ne siano proprietari.&lt;/span&gt;&lt;br /&gt;

Fino al 2009 per le cause civili il cui valore non superava i 1100 euro l’accesso alla giustizia era gratuito; a partire dal gennaio dell’anno 2010, invece, si è pensato bene di far pagare 30 euro, diventati 33 nel luglio dello stesso anno e 37 il 6 luglio scorso.&lt;/span&gt;&lt;br /&gt;
&lt;span style="background-color: white; font-family: sans-serif; font-size: 15px; line-height: 19px; text-align: justify; text-indent: 20px;"&gt;L’intervento di luglio è stato il più devastante ed invasivo, essendo stato previsto il pagamento del contributo unificato anche per materie che prima rientravano nella fascia di esenzione, quali le liti di separazione, divorzio e lavoro. Prima di procedere con una rapida e non esaustiva carrellata delle novità, ci sia consentito esprimere una considerazione di carattere meta-giuridico.&lt;/span&gt;&lt;br /&gt;

&lt;a name='more'&gt;&lt;/a&gt;Fare l’Avvocato oggi è difficile. Vallo a spiegare al cliente che prima di ottenere giustizia da un “giudice” deve pagare una “mazzetta” obbligatoria al mediatore (ossia ad una SPA accreditata presso il Ministero della Giustizia), poi deve pagare un contributo unificato sempre più caro (allo Stato) e, a quanto sembra, dovrà pagare anche per ottenere la “motivazione” della sentenza (sempre allo Stato). Dimentichiamo qualcosa ? Ah si... ci sarebbero pure gli onorari dell’Avvocato. E si, occorre spiegare al cliente che negli esborsi indicati non sono comprese le spese dell’Avvocato. Ahi noi! Comunque.....&lt;br /&gt;

&lt;span style="background-color: white; font-family: sans-serif; font-size: 15px; line-height: 19px; text-align: justify; text-indent: 20px;"&gt;Tale riforma si caratterizza per le maggiori garanzie in capo ai contribuenti.&lt;/span&gt;&lt;br /&gt;
&lt;span style="background-color: white; font-family: sans-serif; font-size: 15px; line-height: 19px; text-align: justify; text-indent: 20px;"&gt;I punti salienti riguardano l’innalzamento del limite di 20mila euro (non più 8mila) affinchè l’ente creditore possa iscrivere l’ipoteca sull’abitazione principale del contribuente moroso.&lt;/span&gt;&lt;br /&gt;
&lt;span style="background-color: white; font-family: sans-serif; font-size: 15px; line-height: 19px; text-align: justify; text-indent: 20px;"&gt;Si tratta, tuttavia, di un limite ancora basso in considerazione del valore degli immobili aggredibili. In quanto tale, i relativi proventi percepiti dal Comune (o dal diverso gestore preposto alla riscossione) non possono essere assoggettati a imposta sul valore aggiunto, che invece colpisce solo i corrispettivi delle prestazioni di servizi liberamente richiesti. In soldoni, la Corte ha chiarito che il corrispettivo che i cittadini devono pagare per la raccolta e lo smaltimento dei rifiuti, è una tassa e non una tariffa.&lt;br /&gt;
