CENTRE OF INDIAN TRADE UNIONS
K.HEMALATA
President
TAPAN SEN, M.P
General Secretary
30 January 2017
Press Statement
CITU strongly condemns the steps reportedly being taken by the government to gradually privatise the Indian railways. This measure is reportedly being started by handing over the running of the prestigious and heritage trains linking the hill stations.
Quoting railway officials, ‘Economic Times’ has reported that the routes linking Kalka and Shimla, Siliguri and Darjeeling and the Nilgiri mountains with the plains, Neral and Matheran and the Kangra valley railways would be among the first to be handed over to the private operators including foreign companies.
It has reported that the private companies, including the foreign corporates will not only run the trains but also maintain the lines and the stations and also own the station on these lines. They will reportedly be allowed to decide the fares after the approval of the Rail Development Authority of India that is going to be constituted.
Through this measure reported to `mark the beginning of corporate participation in running’ the rail network in India, the government is abdicating itself from its responsibility of providing affordable transport to the millions of poor and common passengers. The people will now be exposed to the market forces, not only in the matter of fares but also their safety.
Over 200 people have lost their lives in the three most recent train accidents in Uttar Pradesh and Andhra Pradesh. Thousands of posts related to maintenance and safety in railways are kept vacant. Instead of taking urgent measures to improve the safety conditions in the railways the government and the ministry of railways have decided to privatise the railways on the pretext of losses and the cost of maintenance. Privatisation will further reduce accountability endangering the lives of millions of railway passengers. The total negligence of the private operator in the Eastern Coalfields leading to the ghastly accident killing around 20 workers is the latest example of utter callousness of the private companies towards safety of the workers and the people.
These reported measures to privatise the railways totally contradict the repeated assurances given by the Prime Minister and the railway minister that the government had no intent to privatise the railway. Those criticising the move to privatise railways were even accused of ‘spreading lies’.
CITU demands that the moves to hand over the railway lines connecting hill stations to private players should be immediately stopped.
CITU calls upon the entire working class including the railway employees to unitedly fight against privatisation of the railways in any form. CITU calls upon the patriotic people of this country to strongly resist any measures to hand over the railways, the national wealth and lifeline of our country to private companies including foreign companies in whatever form.
Implementing OROP, 7th Pay Commission recommendations will not lead to cash crunch: Jayant Sinha

The Minister of State for Finance, Jayant Sinha, has said that implementing the One Rank One Pension scheme for military pensioners and the recommendations of the 7th Pay Commission will not bankrupt the nation.

The Union Minister of Finance Arun Jaitley had a meeting with the financial experts in New Delhi yesterday. Following the meeting, Mr. Jayant Sinha spoke to the mediapersons. He said –

“We are managing the country’s finances very well. Experts have appreciated our efforts. The government’s financial condition is very stable. Therefore, there wouldn’t be a cash deficit even if the government implements the recommendations of the 7th Pay Commission. Similarly, the government can very well manage the additional cash burden incurred by implementing the One Rank One Pension scheme for the military.

Implementing the OROP will result in additional expenses of Rs.8000-10,000 crores this year. The 7th Pay Commission’s recommendations will be submitted to the government in December this year. Giving increments to the Central Government employees will result in additional expenses to the Government. He confirmed that the government can comfortably manage these expenses.

A lot of important issues, including financial burdens, increasing employment opportunities and agricultural outputs, were discussed at the pre-Budget consultation. Some of the leading names in financial management in India had participated in the meeting. It is normal for governments to hold such meetings prior to the annual budget, but it is unusual that such a meeting was held with six months to go before the next Budget is due. Sinha said that the valuable suggestions that were given by the experts have made the meeting worthwhile, and have convinced them that holding such meetings in advance was a good move.

A number of useful suggestions were given on the schemes that have to be implemented in the current and the next Financial Years. The meeting also paved way for the joint implementation of many a schemes, he said.

Discussions on agriculture and the issues related to it took up most of the time at the meeting. “We discussed a number of suggestions on how to improve our agricultural production. We talked about financial deficits and ways to reduce expenses and austerity measures. We had also discussed public investment options and the importance of making them profitable.

“The other most important topic that we had talked about was the Ministry of Finance. We had discussed the need for increasing the loans offered to farmers, and to the micro-, small- and medium-sized enterprises, and the necessity for increasing job opportunity for youngsters. We had also discussed the steps that need to be taken to boost the large-scale and production-based industries, which are among the biggest sectors that offer employment.”

a) Whether the retired employees of the Defence Accounts facility as the orders from the DDGCS does not explicitly say so.

Yes. The retried employees of the Defence Accounts Department are eligible for the C.S. D Canteen facility

b) Whether the DAD Pensioners can get the application forms authenticated only from the office from which they have retired.

The authentication of the application forms may be carried out by the nearest Controller, under the jurisdiction, the pensioner is currently residing or the application is made. Also, the nominated Officers are directed to authenticate/countersign the application forms of any DAD pensioner, if the application is submitted to him/her.

The authentication is to be carried out, based on submission of the documents as required by the Canteen authorities.

c) What is termed as ‘Govt Order for Retirement?

The Part II. Office Order issued by the Controllers in respect of the retiring employee will suffice the requirement.

d) The said order does not speak about the eligibility of the Family Pensioners. Whether the same are eligible for the C.S.D Canteen Facilities?

The extension of CSD Canteen Facilities to the Family Pensioners is implied as the QMG branch letter dated 12.08.2015 does not make any distinction between the Retired Defence Civilian Employees and Family Pensioners. The term DAD Pensioners includes within its ambit the Family Pensioners also, as they are drawing pension authorized by PCDA(P) Allahabad.

Government approves hike in bonus ceiling from Rs. 3500 to Rs 7000

NEW DELHI: The Cabinet decided to double the wage ceiling for calculating bonus to Rs 7,000 per month for factory workers and establishments with 20 or more workers.

“The Payment of Bonus (Amendment) Bill, 2015 to enhance the monthly bonus calculation ceiling to Rs 7,000 per month from existing Rs 3,500 was approved by Union Cabinet here,” a source said after the Cabinet meeting.

The amendment bill will be made effective from April 1, 2015. Now the bill will be tabled in Parliament for approval.

The bill also seeks to enhance the eligibility limit for payment of bonus from the salary or wage of an employee from Rs 10,000 per month to Rs 21,000.

The Payment of Bonus Act 1965 is applicable to every factory and other establishment in which 20 or more persons are employed on any day during an accounting year.

The bill also provides for a new proviso in Section 12 which empowers the central government to vary the basis of computing bonus.

At present, under Section 12, where the salary or wage of an employee exceeds Rs 3,500 per month, the minimum or maximum bonus payable to employees are calculated as if his salary or wage were Rs 3,500 per month.

The last amendment to both the eligibility limit and the calculation ceilings under the said Act was carried out in 2007 and was made effective from April 1, 2006.

This amendment in the Act to increase wage ceiling and bonus calculation ceiling was one of ssurances given by the Centre after 10 central trade unions went on one-day strike on September 2.

The government had hinted at meeting workers’ aspirations on nine out of 12 demands submitted by the unions.

Revising Retirement age does not come under the purview of 7th Pay Commission.

Recently the news about retirement age is blown out of proportion in Social Media. In Social Media it has been signaled casually that the retirement age will be brought down to 58 years. Initially it was said that 7th pay commission going to recommend the criteria for retirement age as either 33 years of Service or 60 Years of age whichever comes first.

And gradually it is reduced to 58years of age or 33 years of service and finally ends up with 30 years of service or at the age of 55 years.

7th pay commission Vs Retirement Age

Does it worth to believe the news circulated in social media about 7th pay commission recommendation and retirement age..? We asked the Federation sources about this and they want to maintain anonymity told that it depends upon the individuals to decide whether it is true or not. We should not blame the media for everything. We should be able to know the difference between the news and rumors.

One of our Sources told that revising the retirement age will not fall under the purview of Pay commission. It should be decided by central government only. No Pay commission has recommended anything about Retirement age so far.
Federation Leaders were asked about this retirement age issue, when it became sensational in Print and e-Media, why don’t they come forward to clear the doubts on this sensational issue?. They told that they didn’t want do give importance to the rumors and hear says.

They said, “We need to clarify the doubts of our cadres across the country whenever it was rumored in social media about their service related sensational issues. But when sensational becomes routine, it’s not our business to respond to such hearsays on daily basis”

“As far as retirement age is concerned we know that 7th pay commission cannot recommend revising the retirement age of central government employees, since it does not fall under the purview of 7th Pay Commission. Even we won’t accept it if the central government tries to reduce the retirement age,” the sources added.

No more direct interviews from January 1, 2016 – Narendra Modi

“Cancelling the direct interview process will be of tremendous relief to the poor people who desperately look for recommendations, and will reduce the instances of frauds committed by brokers who promise jobs on payment of money.”

Prime Minister Narendra Modi has announced that the system of direct interviews for the Group B, C and D posts in Central Government offices shall be cancelled from January 1, 2016 onwards. Henceforth, clearing the written round is all it takes for qualifying. Direct interviews shall not be held anymore. The news has brought great relief to job seekers all over the country.

Here are excerpts from the Prime Minister’s Sunday weekly address to the nation, ‘Mann ki Baat,’ on the radio:

“On my Independence Day address, I had presented a suggestion that the direct interview round for entry-level employees in central government services should be cancelled. Following this, the Central Government has completed all the tasks required to remove the direct interview rounds for lower-level employments. Henceforth, there shall be no direct interview round for jobs of the Group B, C, and D categories in Central Government services. This shall come into force from January 1, 2016 onwards.

Direct interviews encourage irregularities and corruption. The system also leads to the exploitation of the poor by those in power. Money is being looted from the poor in the name of finding jobs for them. Most often, they don’t get the jobs even after paying money.

While pondering over it, I wondered why direct interviews have to be conducted for these recruitments. I have never heard anyone claim that they can completely analyze the behaviour and mindset of a person by simply talking to him or her for a few minutes. Cancelling the process of direct interviews will stop the people of the economically weaker sections from spending huge sums of money for recommendations and bribes to get the jobs. This will save them from the traps of brokers who con them and loot money from them.

7th Pay Commission likely to recommend work-from-home options for physically handicapped, women employees

“The 7th Pay Commission is finding out if there are possibilities for differently-abled and women employees of the Central Government to work from home.”

According to sources, the 7th Pay Commission has sought for the opinion of the Department of Information and Technology regarding this option. The 7th Pay Commission has asked to study the possibilities of differently-abled and women workers to perform simple and specialized tasks from home and stay connected via the internet and other telecommunication tools.

The 7th Pay Commission has asked the Department of Information and Technology to identify such jobs for the less than 10,000 differently-abled workers who are currently employed by the Central Government.

Sources also say that Flexi-time Working Hours options are being considered for the more than 3.5 lakh women who are employed by the Central Government.

Since it is impossible for both these segments of workers to work during night shifts, the 7th Pay Commission is looking for options to employ them in specialized monetary and supervisory works which could be performed from home. It is being said that the step will be of tremendous relief for employees who have to travel long distance to reach their offices, and for the employees who work in congested offices.

It can be inferred that the 7th Pay Commission is particular about giving priority to women and differently-abled workers. Sources say that the 7th Pay Commission believes that greater productivity could be expected from them.

It is a well-known fact that telecommuting and work-from-hope options have become very popular in the private sectors and highly specialized tasks are sometimes performed this way. The 7th Pay Commission wants to bring in this work culture to the Central Government jobs too.

Meanwhile, news and updates about the 7th Pay Commission continue to flow into the news media. The Commission is very likely to submit its report to the Government by the end of December. Sources say that the final stage of preparing the report is now on.

Speculations about 35 percent salary hike, increasing the minimum pay to Rs.21,000, 4 MACP promotions, modernizing the CGHS medical facilities, and most importantly, about the retirement age, continue to surface. Readers are requested to not believe in any of them because all of them are mere figments of the writers’ imagination.

Supreme Court ponders over revoking reservation in higher education

The Supreme Court has advised the state and central government to remove caste-based reservations in higher education and select students based solely on merit.

States like Andhra Pradesh, Telangana and Tamil Nadu had moved the Supreme Court on requesting permission to impose reservations in higher studies. The petition was looked into by the Supreme Court bench consisting of Justices Deepak Mishra and PC Pant.

Post Independence, no changes have been made in the reservation policies for higher education. Keeping the welfare of the nation in mind and for improving the quality of higher education, the caste-based reservation system must be removed and deserving students must be chosen based solely on merit.

The bench said that it hopes that the centre and the state governments will make apt decisions in this regard without any further delay and obstacles. Since Andhra Pradesh and Telangana are currently under the President’s rule, contrary legislations cannot be implemented in those states.

The issue of caste-based reservations for higher studies in the state of Tamil Nadu has been adjourned to November 4.

One Rank One Pension : Why not immediately notify the OROP for family pensioners and POTSs?

WHY NOT IMMEDIATELY NOTIFY THE OROP FOR FAMILY PENSIONERS & POTOs?

We might have all read an article couple of days ago appeared in Business Standard newspaper indicating that the due to weak financial position, the union government is mulling with the idea of pushing the implementation of OROP to next fiscal year, which means the implementation might be delayed at least by 5-6 months.

In my personal opinion both the previous and present governments have mishandled the OROP issue and they have perhaps failed to understand the real issues involved in their proper perspective. As suggested in my previous write up if the government would have chosen to introduce an element of age on retirement, in OROP, the expenditure on account of OROP would be less than half the currently estimated expenditure of 8300 crores per annum.

Going by the charts put out by various ESM blogs it appears that if OROP is implemented, every officer will be benefitted ten times more than the POTOs. Considering that there are ten times more POTO veterans than the veteran officers, the total expenditure on account of OROP will be divided equally between the officers and POTOs. So, if the age limit is introduced in OROP, then the GOI can save approximately 4000 crores every year. Anyway it would be difficult to do now and in any case, it can’t be done over night! This needs tremendous political will and high calibre administrative skill.

Therefore, in the present situation, the least that the government can do is to notify the implementation of OROP for Widows and POTOs immediately and pay the first instalment of arrears without much delay.

Needless to emphasise that the POTOs are those who retire at an young age of 33-37 years in public interest and therefore they are the one who deserve OROP the most. It was their pension which was drastically reduced from 75% to 50% in 1973 and it is for this very reason alone, they are eligible for OROP.

How can those who have served to the maximum permissible age or service, resulting in their pension increase by an additional 30%, agitate to claim OROP? Under what rules and on what logic??

Interestingly, the minimum amount of pension plus DR that an officer at the lowest rank is expected to receive under OROP is more than two months salary of a sepoy. What an irony! How much more Pension do they need to lead a decent life in their 60s, 70s & 80s?

In response to my last article published in this blog, one of the senior veterans mailed to me stating that the OROP is not meant to rectify the anomaly but meant to bridge the gap between the past and present pensioners. I have no reason to differ with him, rather I am in full agreement with him.

No doubt that the concept of OROP is exactly the same. But the concept is completely different from the reasons. The concept of OROP is applicable to all pensioners including para military personnel and civil pensioners. But the reasons are unique to each group. What did we do while demanding OROP? We have built up a strong justification for extending this benefit exclusively to military veterans by citing the three cardinal reasons, which I have elaborated in my last article.

In the absence of these strong and genuine reasons no government would have agreed to grant OROP only to military personnel. The agitating veteran leaders knew it more than anybody else. They also knew very well that unless they piggy back on these reasons which are applicable only to NCOs & JCOs, they have no chance of getting OROP at all. After all they have had no valid reasons of their own for such a demand. Therefore these reasons were articulated effectively and continuously in public platforms. The leaders have so cleverly and forcefully articulated these reasons in every available platform that public at large started believing that these reasons are true to all military veterans including the officers. I salute our leaders for this dubious achievement!

They did not stop at it. They were worried that their bluff will one day be called off. So they took full control of the agitation into their own hands and started dictating it. Simultaneously, they established back-channel contacts with the political leaders and bureaucrats to negotiate a deal favourable to them before it is too late. They have succeeded to some extent in this endeavour as well.

But, we now know of all these manipulations and we are not going to take them silently anymore. We will defend our justify and demand what is due to us with all our might and strength.

It would therefore be desirable if the officers who are not eligible for OROP on the basis the three reasons articulated by themselves, encourage the GOI to notify the OROP immediately at least for POTOs & Widows and refrain gracefully from further agitation so that the already existing gap between the officers and ORs in the perception of OROP does not widen any further.

The veteran community of NCOs and JCOs on their part should mobilise members for AFVAI and strengthen it so that we are never ignored or marginalised from now on.

The writeup also adds that the Centre did not consult with them prior to formulating the Terms of Reference for the 7th Pay Commission.

The Prime Minister has given his approval to the composition of the 7th CPC on 4th February 2014 and the Union Cabinet gave its approval to the 7th CPC Terms of Reference on 28.02.2014.
On 01.01.2011, when the Dearness Allowance touched 50%, the Central Government employees started to strengthen their demand to add it to the Basic Pay. Some of them demanded setting up of the 7th CPC on the plea that the residency period of any wage structure must not exceed 5 years, especially in the background that the pay revision in most of the PSUs takes place at the interval of 5 years. The Government turned a deaf ear to them.

After implementation of pay band and grade pay, there was plethora of anomalies, common as well as department specific. None of these anomalies were removed despite several rounds of discussions. And Government refused to discuss these demands either bilaterally or at the forum of JCM.

The Confederation of Central Government Employees successfully conducted a 2-day protest. Defence and Railway employees too were ready to join the protests. Just when it looked as if confrontation was imminent, in September 2013, the Centre announced the formation of the 7th Pay Commission. The protests were dropped when the Government accepted their demands.

While formulating the Terms of Reference, there was a general expectation that the Government would consider the 6-point demand that was debated upon at the Standing Council NC JCM meeting that was held on 24.10.2013.

6-point demands are…
The Commission should have a labour representative.
DA (as on 1.1.2014) to be merged and treated as pay for all purposes.
To include Gramin Dak Sewaks within the ambit of 7th CPC.
To grant Interim Relief @ 25% of Pay + GP.
To ensure that the 7th CPC recommendation will be effective from 1.1.2014.
To ensure parity in pension for all pensioners as per the 5th CPC recommendation.

They were also hoping that another meeting would be held before the final Terms of Reference were decided. But the Government made a discretionary decision regarding and 7th CPC Terms of Reference. None of the important demands presented by the association made the final list.

In its Memorandum to the 7th Pay Commission, the National Council has presented the twin issues, i.e. the need to grant interim relief and merger of Dearness Allowance.

The 98-page long report to the 7th Pay Commission prepared by the members of National Council JCM Staff Side, incorporating all the suggestions and demands presented by all the representative of employees involved. The National Council also hopes that all Central Government employees, Associations/ Federations/Unions would accept and support the demands raised by them in the memorandum.

The Memorandum consists of expectations and requirements of common for all the Central Government employees. No doubt they will submit separate memorandum on department specific issues.
The 7th Pay Commission is bound to take note of this report and its recommendations.

Source: CGEN.in
[http://centralgovernmentemployeesnews.in/2014/07/centre-made-a-discretionary-decision-on-7th-cpc-terms-of-reference-national-council-jcm/]

NO MERGER OF DA – FINANCE MINISTRY REPLY TO NATIONAL COUNCIL SECRETARY

NO MERGER OF DA – FINANCE MINISTRY REPLY TO NATIONAL COUNCIL SECRETARY

The All India Audit & Accounts Association has published a letter from Finance Ministry to National Council Secretary Shri Shiva Gopal Mishra on 17.6.2014, regarding the main demand of merger of dearness allowance with basic pay.

Finance Ministry said in the letter, 6th Central Pay Commission did not recommend merger of dearness allowance with basic pay at any stage and the recommendations has accepted by the Central Government vide resolution dated 29.8.2008.

The content of the letter is reproduced and given below for your information…

No.1(6)/2013-E-II(B)
Government of India
Ministry of Finance
Department of Expenditure
***

North Block, New Delhi
Dated 17th June, 2014

To
Shri Shiva Gopal Mishra,
Secretary,
National Council (Staff Side),
Joint Consultative Machinery for Central Government Employees,
13-C, Ferozshah Road,
New delhi-110 001

Subject : Merger of Dearness Allowance with Basic Pay – regarding

Sir,
This is in reference to letter No.NC-JCM/2014/DA/DP addressed to the Hon’ble Finance Minister regarding merger of Dearness Allowance (DA) with Basic Pay. In addition to this, Andhra Pradesh Chief Minister Chandrababu Naidu has also announced a number of incentives and schemes for the state government employees. While introducing the Bill in the state legislative, the Chief Minister said that the current laws were implemented in 1984. The retirement age for central government employees has been increased to 60. According to a World health Organization report, the average lifespan for Indians is 65 years. Now that the state has been bifurcated, Andhra Pradesh requires the service of experienced employees. Therefore, the age of retirement is being increased from 58 to 60.

In addition to this, a number of incentives and benefits are also going to be offered to the state government employees. Schemes will be launched to ensure that at the time of retirement, the employee owns a house. Medical insurance plans will also be given. All these schemes will be implemented in stages. He also said that absence due to participation in anti-bifurcation protests will be treated as leave. His speech was followed by the passing of the Bill recommending the increasing of superannuation age from 58 to 60 for State Government employees.

The retirement age for Central Government employees was increased from 58 to 60 in 1998. According to the World Health Organization, the average life expectancy for Indians is 65 years. There is now a requirement for experienced state government employees to sustain and ensure the growth and development of Andhra Pradesh. The State Government and its employees shall hand-in-hand toil for the development of Andhra Pradesh. New job opportunities should be created in public and private sectors.

The Government is very firm on implementing its project to guarantee employment for at least one person in each family in the state.

The resolution to increase the retirement age for State Government employees from 58 to 60 was passed unanimously and without debate in the state legislative meeting.

Source: CGEN.in
[http://centralgovernmentemployeesnews.in/2014/06/andhra-pradesh-government-hikes-retirement-age-to-60/]

Proposed Pay Scale of 7th Pay Commission for CG Employees – Published by NFIR

Proposed Pay Scale of 7th Pay Commission for CG Employees – Published by NFIR

National Federation of Indian Railwaymen published a draft pay structure for 7th Pay Commission, which is under consideration of all staff members of JCM National Council.
Concession of Air travel, which the Central Government employees have been enjoying for the past 6 years, comes to an end today. It is saddening to see that a scheme, that was so popular and enjoyed by all across ranks, has come to an end.

Travelling by airplane with the entire family is still not an ordinary feat for the majority of Indians. It therefore comes as no surprise that the ones who didn’t utilize this opportunity are regretting it.

For countless Central Government employees who completed a year in service and took their parents and siblings on a plane journey, it will be a memory worth cherishing for a very long time.

Former employees, who had served for 30-40 years but didn’t enjoy this facility, sure have their regrets. No matter how sophisticated and comfortable buses, trains and ships are, they can’t quite match the thrill of travelling by air.

There are no indications yet that the scheme could be extended, but one can be sure only after the 2014-15 General Budget is presented.

Source: 90Paisa
[http://90paisa.blogspot.in/2014/06/leave-travel-concession-air-travel.html]

J&K Employees Retirement Age hiked to 60, on par with Central Government Staff

Jammu & Kashmir Employees Retirement Age hiked to 60, on par with Central Government Staff

During the cabinet meeting of June 3 that was presided over by J&K Chief Minister, Omar Abdullah, it was decided to increase the retirement age of state employees from 58 to 60, on par with the Central Government employees.

It is worth mentioning here that the resolution marks the successful culmination of more than 6 years of protests and demands made by various employees unions across the state. In the Standing Committee meeting held under the chairmanship of the Secretary DoP&T, on 7th May 2014, the agenda item pertaining to merger of D.A. with pay was discussed by the JCM/Staff Side representatives. There has, however, been no positive response from the Official Side on the issue probably the VII CPC has started working on the terms of reference.

3. Now that the D.A. has become 100% of pay w.e.f. 01/01/2014 and another instalment of D.A. @ 6% of pay is likely to be granted by the Government w.e.f. 01/07/2014 as per the figures of Consumer Price Index, continuing D.A., without merger, is highly unjustified. In the past i.e. during the year 2004, the Government of India had merged 50% DA with pay for all purposes. Similar decision has, unfortunately, not been taken by the previous Government.

4. Seventh Central Pay Commission has already sent communications to JCM constituent organisations etc.. to submit Memorandums. At this juncture, it would be proper to convey to the Chairman, 7th CPC to consider the JCM (Staff Side) demand for merger of DA with pay with retrospective effect and send interim report to the Government for consideration.

NFIR, therefore, requests you to kindly consider our request and see that the Government makes reference to 7th CPC to consider DA merger with pay and to send its interim report to the Government for favourable consideration.

Thanking you.

Yours faithfully,

sd/-
(M.Raghavaiah)
General Secretary

Source: NFIR

Eligibility of officers to be considered for promotion by DPC- Fixing of Crucial Date–Dopt Orders

Eligibility of officers to be considered for promotion by DPC- Fixing of Crucial Date - Regarding.

No.22011/6/2013-Estt(D)
Government of India
Ministry of Personnel, Public Grievances and Pensions
(Department of Personnel and Training)

North Block, New Delhi
Dated the 28th May, 2014

OFFICE MEMORANDUM

Subject: - Eligibility of officers to be considered for promotion by DPC- Fixing of Crucial Date - Regarding.

The undersigned is directed to invite reference to the Department of Personnel and Training's Office Memorandum No. 22011/3/98-Estt(D) dated September 17, 1998 regarding subject mentioned above, which provides that the crucial date for determining eligibility for promotion in case of financial year-based vacancy year would fall on January 1, immediately preceding such vacancy year and in case of calendar year-based vacancy year also, the first day of the vacancy year i.e.1st January itself would be the crucial date.

2. In case of financial year-based vacancy year, there is a clear gap of 3 months between the crucial date of eligibility and the date of commencement of vacancy year i.e. between January 1 and April 1. Due to this gap, for any such vacancy year, even if the Departmental Promotion Committee (DPC) meeting is held in time as per the Model Calendar, there is always a possibility of few officers not fulfilling the eligibility criteria as on the crucial date of eligibility, though they are fulfilling the same as on the date of commencement of the vacancy year.

3. The matter has been examined in consultation with Union Public Service Commission. It has been decided that the crucial date of eligibility shall be 1 st April of the vacancy year in case of financial year based vacancy year i.e. where the Annual Performance Appraisal Reports (APARs) are written financial year-wise. In case of calendar year based vacancy year, i.e. where APARs are written calendar year-wise, the crucial date of eligibility shall remain as 1 st January of the vacancy year. It is also well known that on behalf of the National Council JCM Staff Side, the questionnaire had already been filled with the approval of all members and has been sent. (Click here to view the reply)

There is no uniform pay scale or promotion hierarchy for the Central Government employees. The departments functioning under each Ministry are evaluated separately. Promotions and pay scales are decided based on the post/category of the employees in each of those departments. Based on these segregations, the employee unions/associations of each department are preparing their Memorandums containing their demands and issues.

Various unions and associations of each of these departments are currently preparing their own memorandums to send to the 7th CPC. These memorandums also contain their long-standing demands and expectations.

It can be inferred that these memorandums, prepared by various associations of employees starting with Group ‘C’, right up to the Gazetted Officers Association, reflect their thoughts and demands.

Pensioners Associations are also participating in this in large numbers. It shows the fact that they believe that their requirements will be fulfilled by this Pay Commission.

The 7th Pay Commission is offering this rare opportunity that was not given in the previous Pay Commissions. Each issue has a number of different perspectives. This could lead to a consensus-based decision that appeases all. It is a healthy trend to watch so many people vying with each other to present their opinions and suggestions.

There is special curiosity and eagerness to read the Memorandums of some of the important Central Government and railway employee federations.

Given below are the links to some of the most prominent Central Government employee unions and associations:

Click to continue read of the article...

Why is Annual Increment denied to employees retiring in June?

Why is Annual Increment denied to employees retiring in June?

Until 01.01.2006, the date of implementing employee’s annual increment was fixed on the basis of his/her date of appointment or promotion option. After the 6th CPC, it was decided that 1st July of each year would be the uniform date of implementation of annual increment for all Central Government employees.

Employees who are appointed after January 1st are not eligible for that year’s annual increment on July 1. They qualify for annual increment only the next year.

The revised pay rules said that "If an employee is on leave or is availing joining time on the 1st of July, the benefit of annual increment in pay will be drawn only from the date on which he resumes duty and not from the first of July. Each year, employees who retire in the month of June are not given the annual increment of the year since they do not report to work on 1st July. Only those employees who resume duty on July 1st are eligible to receive the annual increment. Or, the day they report back to work is taken as the date for implementing the annual increment. Since there are no possibilities for the retired employees to return to work, they are not considered as qualified to receive the annual increment.

The revised pay rules states that only those who have been receiving the same basic pay continuously for 6 months are considered as qualified for annual increment. According to the another rule of qualification for increment, the person should have complete one year in service after receiving the annual increment. Therefore, despite being qualified, these employees are denied their annual increment.

There is an order that states that those who retire on July 1st should complete the retirement formalities in the month of June.

Instead of strictly looking into such technicalities, it would be a nice gesture on the part of the Government to extend the benefits of annual increment to those senior employees too who retire from service in the month of June.

Source: www.90paisa.blogspot.in
[http://90paisa.blogspot.in/2014/05/why-is-annual-increment-denied-to.html]

Expected DA - Status, as of March 2014

Expected Dearness Allowance from July 2014 for Central Govt Employees and Pensioners...

Expected DA- Status, as of March 2014

Expected Dearness Allowance from July 2014 : This time there is a considerable slackening in the pace of the expected DA. It looks as if there are plenty of reasons for it.

As of March, the AICPIN has increased by one point and is at 239. The rapid increase in Consumer Price Index (IW) has been brought under control now. Election is believed to be one of the reasons for it. Since price rise and inflation are under control, there is not much of an increase in All India Consumer Price Index for Industrial Workers. With a fall in the prices of essential commodities, the AICPIN points have actually reduced.

Another reason is the reduction of AICPIN by 4 points in December 2013. The Consumer Price Index, which was steadily rising till then, slumped by 4 points. It wasn’t much of a shock then because the Additional DA for the month of January 2014 increased by 10% and had touched 100%.
The All India Consumer Price Index for Industrial Workers Base Year 2001=100, which was at 243, fell by 4 points to end up at 239. It again fell by 2 points to touch 237, thus dampening the expectations surrounding the next additional Dearness Allowance announcements. It looks highly unlikely that the AICPIN would rise by 4 points to return to its previous levels.

To calculate the additional DA for July 2014 based on your expected or desired AICPIN points, click the link given below:
Simple Calculators for Central Government Employees…
