بِسْمِ اللَّـهِ الرَّحْمَـٰنِ الرَّحِيمِ

اَلْحَمْدُاللهِ رَبِّ الْعٰلَمِیْنَ وَالصَّلوةُ وَالسَّلَامُ عَلَى سَیِّدِالْأَنْبِيَاءِوَالْمُرْسَلِيْنَ

دعاؤں کا یہ خوبصورت مجموعہ ” مناجات مقبول، حکیم الامت حضرت مولانا اشرف علی صاحب تھانوی نور اللہ مرقدہ نے قرآن وحدیث کی دعاؤں سے منتخب فرمایا ہے۔ حضرت تھانوی نور اللہ مرقدہ نے ان دعاؤں کو سات حصوں میں تقسیم فرمایا تا کہ پڑھنے والوں کو سہولت کے ساتھ یومیہ ایک منزل پڑھنے کی سعادت مل سکے ۔

حکیم الامت حضرت مولانا اشرف علی صاحب تھانوی نور اللہ مرقدہ فرماتے ہیں یہ دعائیں خدا وند کریم اور جناب رسول اللہ صلی اللہ علیہ وآلہ وسلم کی بیان فرمودہ ہیں تو پھر اس کی قبولیت میں کوئی تردد اور شک نہیں ہونا چاہئے مگر شرط یہ ہے کہ دعاؤں کی تلاوت کرنے والے اخلاص، توجہ اور پختہ یقین کے ساتھ اللہ تعالی سے طلب فرماویں۔ ان دعاؤں کو پڑھتے وقت اگر قرآن کریم میں اللہ تعالیٰ کا یہ ارشاد
ترجمہ: "مجھ سے دعا مانگو میں تمہاری دعاؤں کو قبول کروں گا۔“
اور فرمان رسول صلی اللہ علیہ وسلم ” دعا مومن کا ہتھیار ہے" دعا عبادت کا مغز ہے اور اللہ کو راضی کرنے کا بہترین ذریعہ ہے۔ ملحوظ خاطر رکھا جائے تو مجھے یقین ہے کہ ان دعاؤں کو صدق دل سے پڑھنے والا کبھی محروم نہیں ہوگا۔

بسم الله حامدا و مصليا .

حضرت مولانا تقی عثمانی مدظلہ کی محنت اور فکر سے پاکستان میں اسلامی بینکنگ کا عملی نظام جاری ہوا تو اس کی عملی تفصیل جاننے کا تجسس ہوا۔ جب مولانا مدظلہ کے صاحبزادے مولوی عمران اشرف عثمانی کی انگریزی میں کتاب Meezan Bank's Guide To Islamic Banking بازار میں آئی تو اس کا مطالعہ کیا، مطالعہ پر اس میں جو چند واجب الاصلاح امور نظر آئے ان کو دلائل کے ساتھ تحریر کر کے مولوی عمران اشرف عثمانی کی خدمت میں بھیجا۔ کوئی جواب نہ پا کر اس مضمون کو اسلامی بینکاری کے چند واجب اصلاح امور کے نام سے ایک کتابچے کی صورت میں شائع کیا۔ شائع شدہ کتا بچہ بھی دار العلوم بھیجا گیا۔

دارالعلوم والوں نے نہ تو کوئی جواب دیا اور نہ ہی ان کی طرف سے افہام و تفہیم کی کوشش ہوئی۔ کوئی ڈیڑھ سال پہلے کمپنیوں کی محدود ذمہ داری پر اور تکافل پر لکھا اور ان کے غیر اسلامی اور غیر شرعی ہونے کو ثابت کیا۔ اس کی کاپی مولانا تقی عثمانی مدظلہ سمیت دار العلوم کے بعض اور حضرات کو بھی بھیجی۔ بعد میں اسلامی بینکنگ، کمپنی اور تکافل سے متعلق اپنے مضامین کتابی صورت میں شائع کرنے کے لیے دیئے۔ اپنے ان مضامین میں ہم نے اس بات کا اہتمام کیا کہ جو بات بھی ہو دلیل اور ثبوت سے ہو۔ پھر سب سے اہم بات یہ ہے کہ ہم نے رائج کردہ اسلامی بینکنگ کو سو فیصد رد نہیں کیا جس کے مندرجہ ذیل دو ثبوت ہیں:

1- ہمارے کہتا بچہ کا نام ہی یہ تھا ”اسلامی بینکنگ کے چند واجب اصلاح امور اور اصلاح کی سوچ اس وقت آتی ہے جب بنیادی نظام کا تحمل کیا جا سکتا ہو۔

2- اپنی کتاب ” جدید معاشی مسائل کے ص 133 پر ہم نے لکھا:
" جس کا (یعنی اسلامی بینکاری کا یہ فائدہ تو ہے کہ جو لوگ پہلے سو فیصد سود میں ملوث تھے وہ اگر اپنے مالی معاملات اور بینکوں کو چھوڑ کر صرف اسلامی بینک سے کریں تو وہ مثلاً چالیس فیصد سود پر آجائیں گے۔“
پچھلے سال ابھی ہماری کتاب پبلشر کے پاس زیر طبع ہی تھی کہ کراچی کے ایک بزرگ عالم تشریف لائے اور بتایا کہ کراچی میں اسلامی بینکاری پر غور و فکر ہو رہا ہے۔ ہم نے اپنی کتاب کی ایک کمپوز شدہ کاپی ان کو دی کہ اس کو بھی دیکھ لیں۔ ان کے بقول وہ حضرت مولانا سلیم اللہ خاں مدظلہ کے بھیجے ہوئے تھے۔ مولانا سلیم اللہ خان صاحب مدظلہ کی جانب سے کوئی تین سال پہلے ایک سرکلر جاری ہوا تھا کہ اسلامی بینکنگ پر اجتماعی غور و فکر کا ارادہ ہے۔ جواب میں ہم نے لکھا تھا کہ اسلامی بینکنگ پر جو بھی اعتراض اٹھایا جائے وہ مضبوط ہو کمزور نہ ہو۔ بہر حال ان بزرگ کی مزید بات سے اندازہ ہوا کہ غور و فکر تو ہو چکا ہے اب فیصلہ کا اعلان کرنا باقی ہے۔ اس کے لئے انہوں نے ہم سے ایک تحریر چاہی جس سے ہم نے معذرت کر لی۔ پھر ان حضرات کے فتوے کا اعلان ہوا۔ شروع میں ہمارا نام اس عنوان سے شامل ہوا کہ ہمارا مقالہ پڑھ کر سنایا گیا۔ وہ کونسا مقالہ تھا؟ ہمیں علم نہیں۔ بعد میں بعض حضرات نے ہمارا نام تائید کنندگان اور دستخط کنندگان میں شامل کر دیا جس سے ہمیں براءت کا اعلان انوار مدینہ میں چھپوانا پڑا کہ ہم نے نہ زبانی یا تحریری تائید کی اور نہ ہی کہیں دستخط کئے ۔ شاید ان بعض حضرات کا یہ عمل اس بنیاد پر ہو کہ ہمارے مضامین سے اسلامی بینکنگ کی کچھ مخالفت نظر آتی ہے۔ ان حضرات کی جانب سے ان کے فتوے کی تائید میں ” مروجہ اسلامی بینکاری“ کے نام سے ایک ضخیم کتاب شائع کی گئی۔

اصل تنازعہ تو ان دو جماعتوں کا تھا ، یعنی مولانا تقی عثمانی مدظلہ اور ان کے موافقین کا اور مولانا سلیم اللہ خان مدظلہ اور ان کے موافقین کا ۔ لیکن مؤخر الذکر جماعت نے جب ہمارا نام استعمال کیا تو شاید ہم بھی اس جماعت میں شریک سمجھے

جانے لگے۔ اگلے ڈیڑھ دو مہینے میں ہماری کتاب جدید معاشی مسائل اور مولانا تقی عثمانی مدظلہ کے دلائل کا جائزہ بھی چھپ کر آ گئی جو ہم نے دار العلوم سمیت بہت سے اداروں اور افراد کو بھیجی۔ اس بات نے ہمارے مخالف ہونے پر گویا مہر تصدیق ثبت کر دی۔

اب مولانا تقی عثمانی مدظلہ نے ”غیر سودی بینکاری کے نام سے ایک نئی کتاب لکھی ہے جس میں جہاں دوسری جماعت کی باتوں کے جواب دیئے اور اپنی بات کے اثبات میں دلائل دیئے وہیں ہماری چند باتوں کے بھی جواب دیے اور اپنے حق میں دلائل دیئے۔ خیر اس ناپسندیدہ صورتحال میں ایک پسندیدہ بات یہ بن گئی کہ

ہمیں اپنی بات پر مولانا مد ظلہ کا مدلل تبصرہ اور جائزہ پڑھنے کو ملا۔ ہم نے الحمداللہ اپنے دل میں یہ طے کر لیا تھا کہ اگر مولانا مد ظلہ کی بات درست ہوئی تو اس کو قبول کر لیں گے لیکن کتاب پڑھنے پر اندازہ ہوا کہ مولانا ہماری بات کا صحیح جواب نہ دے سکے۔ دوسروں کے بارے میں مولا نا مدظلہ نے جو کچھ لکھا اس کو تو وسرے جانیں ہمیں تو اپنی بات سے غرض ہے۔ اور جب بات صحیح اور غلط کی اور اس پر قائم کئے گئے دلائل کی ہے تو احقاق حق کی خاطر ہم ایک بار پھر قلم اٹھاتے ہیں۔ ہم مولانا مدظلہ کے دلائل کا جائزہ بھی لیں گے اور اپنے حق میں جو ممکنہ دلائل ہوں گےان کو مزید وضاحت کے ساتھ پیش کریں گے۔ ہم نے کوشش کی ہے کہ احترام کا دامن تھامے رکھیں لیکن دلائل پر نقد و تبصرہ کچھ آزادی کا تقاضا بہر حال کرتا ہے۔

مروجہ اسلامی بینکاری کے لئے نظام تکافل ضروری پشت پناہ ہے۔ اس کے غیر اسلامی ہونے پر ہم نے اپنی کتاب میں دلائل قائم کئے تھے لیکن مولانا مدظلہ نے اس پر کچھ کلام نہیں کیا۔ وجہ ہمیں معلوم نہیں۔ البتہ ان کے دارالعلوم کے مولانا ڈاکٹر

اعجاز احمد صمدانی صاحب اور مولانا مفتی عصمت اللہ صاحب نے ہمارےمضمون پر کچھ تبصرہ لکھ کر بھیجا۔ اس میں جو اہم نکات نظر آئے ان کا جواب بھی ہم نے یہاں دیا ہے۔
