How to Get Your Insurer to Pay Your Hurricane Irene Claim

So, let's assume you did the right thing in getting insurance to protect yourself against those times when Mother Nature comes knocking. Your next challenge may be getting the insurance company to pony up the cash instead of trying to deny your claim.

"Families will have to dig deeper into their pockets, because insurers have been steadily increasing hurricane wind coverage deductibles and imposing other policy limitations," said J. Robert Hunter, director of insurance for the Consumer Federation of America and former federal insurance administrator and Texas insurance commissioner, in a prepared statement.

"This liability shift to consumers may take some by surprise, since disclosures are often buried in renewal paperwork that consumers may not understand or even read," he said.

"Because so many consumers experienced claims problems in the wake of Hurricane Katrina, we urge homeowners dealing with losses caused by Hurricane Irene to be vigilant with their insurance companies to ensure that that they receive a full and fair settlement," said Hunter.

How to Boost Your Odds of Getting Paid

If you want to increase the likelihood that your insurer writes that check, there is much to do.

Don't dillydally when it comes to reporting your claim: Insurance companies generally handle them first come, first serve, warns Hunter.

Once your claim is reported, get your claim number and write it down. Having that number will make your life -- and the insurance company's -- easier.

Find out a little about the adjuster who will come to your house to assess the damage. You want to know if he is an employee of the insurance company or an independent adjuster hired by your insurer. The answer matters: If the person is independent, get the name of the actual insurance company adjuster whom the independent adjuster is sending your information to, and find out whether they are authorized to make claim decisions and payments on behalf of your insurance company.

Beware of firms that demand up-front fees for services, regardless of the outcome they negotiate on your behalf with the insurance company. Public adjusters work purely on a contingency basis, ensuring that a homeowner does not pay anything unless he or she receives some form of settlement, says David Charles, president of Catastrophic Claims Consultants.

Build Your Evidence

Anticipate the possibility of push-back from the insurance company, and be ready to hit them with documentation. When you file a claim, CFA advises immediately starting a notebook detailing all your contacts with the insurance company. List the date, time and a brief description of what went down. If you need to amplify later, this will give you a leg to stand on. If an adjuster says he or she will not come out, for example, write it down. If an adjuster is a jerk, note that too.

You own a ton of stuff. Make a list of it all. Better still if you took photos of your possessions before the storm, but If you didn't, don't sweat it. "Those snapshots from a party may offer proof of your TV that was destroyed, or the rug that was ruined," says Phillip Sanov, an attorney with The Lanier Law Firm.

Do, however, take photographs of the damage before doing any repair work to your home. Also, make an itemized list of all damage sustained during the storm and its aftermath, advises Frank Keaney, who specializes in homeowners insurance with Amity Insurance. Do all you can to minimize secondary damage: Your homeowner's policy requires that you "mitigate damage," says Kevin Lynch, an assistant professor of insurance at The American College.

You'll want to do some homework by getting a repair estimate from a contractor to help you in talking with the adjuster. Hang on to receipts for any emergency repairs, and costs such as if you have to stay in a hotel. This may be reimbursable under the "additional living expense" portion of your homeowners' policy, says Keaney.

If needed, you can use weather data provided by the Forensic Weather Consultants at www.weatherconsultants.com, a company of forensic meteorologists who can substantiate hurricane based insurance claims.

It should go without saying, but be honest. Claim inflation invites claim denial, says Michael Huber, partner with the law firm of Ver Ploeg & Lumpkin.

Fight Back

Make sure you follow up on your case: Don't just file the claim, sit back and wait for your payment. Check in regularly with your insurance agent or company on the progress of your claim, says John Egan, managing editor of InsuranceQuotes.com.

If your insurer denies your claim or offers a piddly amount, don't just accept it. CFA advises demanding that the company identify the language in your homeowners' policy that served as the basis for denying your claim or offering so little. The company may be right and you may not know it. Once the company pinpoints the key language in the policy, you should be able to make this determination. Then too, it could be that the company has craftily put new limitations into the policy and didn't make them clear to you. If you feel misled, weigh whether you want to contact an attorney.

For example, says Hunter, the introduction of percentage deductibles (up to 10% of the value of a home), will greatly shift the cost of Hurricane Irene from insurance companies to consumers, as compared to earlier storms. The practice of shifting the cost of previously insured events back to consumers is acceptable, as long as consumers are clearly given the option to select the level of coverage they want with fully informed consent.

Another new way insurers can pull a "gotcha" is by putting a limit on replacement cost payments, which might come into play in the event that a home is totally destroyed. A typical cap is 20% above the face value of the policy. According to CFA, if costs surge because of the spike in demand for materials or labor following a major storm like Hurricane Irene (or if the state does not monitor price gouging sufficiently) this limit might apply. For example, if a home was expected to cost $200,000 to replace and that amount was the limit on the policy, the insurance company would pay no more than 20% more, or $240,000. If the surge in construction costs due to extreme demand caused the price of replacing the home to jump to $300,000, the homeowner would be short $60,000.

Know Your Rights

The squeaky wheel gets the grease. Do complain to the powers that be in the insurance company if you feel like a denial was unwarranted or the reimbursement too little. Don't stop there. Complain to your state insurance department: It will make an inquiry with your insurer. See a lawyer if you want to take it a step further.

Once the insurance company tells you the reasons for its action, it legally can't produce new reasons for denying payment or making a low offer at a later time. You have locked them in -- a major advantage for you.

If you review the policy and find that, without stretching your imagination, it seems plausible that you should get the full amount of your claim, you will likely win if you go to court. The CFA notes that courts consistently rule that if an insurance policy is ambiguous, the reasonable expectation of the insured party will prevail since the consumer played no part in writing the language of the insurance policy.

Expect the worst, but hope for the best. Said Hunter, "Not all insurance companies handle claims badly, so go into the claims process with an open mind. Be vigilant though, or you run the real risk of being shortchanged."

"Browser hijacking" is a type of online fraud. Scammers use malicious software to take control of your computer's Internet browser and change how and what it displays when you're surfing the web.

If you keep your computer updated with the latest security software and updates, and practice safe Internet browsing you're already doing a lot to keep the hijackers away.

But if you are already the victim of a hijacked browser there are several ways you can combat online fraud, free your browser from the hackers, and restore its settings.

Help restore a hijacked browser and boost browser security

The following six tips can help restore your browser's settings:

Stop cascading pop-up windows. If endless pop-up windows appear on your screen, you'll probably want to stop them first. To do this in Microsoft Windows 7, Windows Vista, Windows XP, or Windows 2000 while using Internet Explorer:
- Press CTRL+ALT+DEL, click Task Manager, and then click the Processes tab.
- Click IEXPLORE.EXE, and then click the End Process button.
This closes all instances of Internet Explorer. Then you can re-open the program to continue browsing as usual. To help prevent future attacks, you should also have a pop-up blocker turned on. The pop-up blocker is turned on by default.
To confirm that the pop-up blocker is on in Internet Explorer 9 click the gear icon and point to Internet Options. Click the Privacy tab and make sure the box is checked next to Turn on Pop-up Blocker.
If you still experience the other effects of a hijacked web browser, try the following:
Install Microsoft Security Essentials or another antivirus and antispyware program. Microsoft Security Essentials is free software that will help protect your computer from malicious software such as viruses or spyware. Many browser hijacking programs can be identified and removed by downloading, installing, and running Microsoft Security Essentials or a similar tool.
Run the Malicious Software Removal Tool. This can catch some, but not all, kinds of hijacking software.
Reset Internet Explorer settings. If you're using Internet Explorer and your home page has been changed, you can often reset it yourself.
Note If you use Microsoft Security Essentials, Forefront Client Security, Windows Defender, or the Windows Malicious Software Removal Tool and these tools have detected and removed hijacking software from your computer, these tools might change your home page and your search page to help protect against the malicious software.

Disable add-ons. Many browser hijackings come from add-ons, also known as ActiveX controls, browser extensions, browser helper objects, or toolbars. Internet Explorer 9 warns you in the notification area of your browser if an add-on is slowing your computer down. The fuss over a sign in Alabama at an electronics store reading "BBQ PORK RESTURANT (sic) IS SAFEST NO MUSLIMS INSIDE" shocked its longtime owner who said he doesn't understand why it's such a big deal.

Electronic Repair Company owner Chuck Biddinger, who put up the sign last week, said he meant the message as a joke. After all, he said, it wasn't even the most offensive one he had ever posted.

That award goes to a sign he posted last May that read "A dog is wiser than a woman - it does not bark at its master," earned heat from domestic violence groups in Alabama.

"The women's groups went ballistic," he told the Daily News when he picked up the phone at his East Lake, Ala., shop.

Biddinger said to pacify them he put a public service announcement urging victims of domestic violence to call a hotline.

But he said this sign, which has garnered national attention, has gotten more positive reaction than negative - and he has no plans to apologize to anyone offended.

"I have gotten a few complaints about it, but for every one complaint about it I've had, 10 people tell me that they like it and support it," he said.

He told local television station ABC 33/40 that while it was meant as a lighthearted joke, it was true.

"Muslims do not eat pork," he told the television station. "It's a known fact that Muslims have tried to commit crimes in this country."

On Friday, Biddinger said he planned to take the sign down sometime soon, but hadn't quite had the time to do it - and was still looking for something equally eye-catching. Signs outside his shop are changed every week, usually with jokes he receives via email chains.

Many of them are not politically correct. But the coverage of this one, he said, has been unbelievable.

"I never thought about that until it got picked up on the Internet and it went totally viral when I put this sign up," he said.

When asked by The News if he understood why this sign might have gotten more attention than other racist or sexist signs he may have posted, he replied, "No, ma'am."

After all, he said, he wasn't worried about people's feelings.

"For the local area, if I offend a few Muslims, there will be a lot of people who support it," he said.

Not to mention, all the coverage of his repair shop from the sign is good for business.

"I believe it's a positive," he said.

People interviewed by ABC 33/40 agreed, laughing at the words on the sign when a reporter showed it to them.

"I think it's hilarious to me that they would feel that way," one man said. "But I'm not offended about it at all."

1. “These cars cost me less than you think.”

As car dealers try to move inventory off their lots, consumers can exert more leverage in their buying power and try to negotiate the lowest price possible.

And, with online buying and selling, consumers can arm themselves with more research before making an offer: Car-buying sites like CarsDirect.com provide a car’s invoice price and the manufacturer’s retail suggested price (or MSRP), and consumer information hub Edmunds.com even lists cars’ invoice prices with various options.

What’s more, “holdback” allows dealers to pay up to 3% below invoice for vehicles. Here’s how it works: The dealer buys the car from the manufacturer at the invoice price. Then after the car is sold, the manufacturer reimburses the dealer for the cost of keeping it in inventory for 90 days. When a dealer sells the car faster than that, part of the holdback payment becomes pure profit, even if the car is sold at invoice price. “You’ll never get holdback money back from a dealer,” says Burke Leon, owner of BL Auto Enterprises, a Fullerton, Calif.-based dealership that sells nearly-new off-lease cars, and author of The Insider’s Guide to Buying a New or Used Car. But just knowing about it can help when a dealer whines that he can’t meet your price.

2. “Our lenders aren’t as tough as I’ll make them seem.”

Some car dealers will try to pass the buck regarding pricing and sales tactics. One common trick: Blame everything on the lender. For example, some dealers who don’t want to give you the price you’re asking for may tell you that the leasing company requires all deals to be based on the sticker price, says Mark Eskeldson, founder of CarInfo.com, which provides consumer-protection advice to car buyers, and author of What Car Dealers Don’t Want You to Know. That probably isn’t the case, since lenders can’t control a car’s price.

Likewise, some dealers will try to sell you an extended warranty, claiming that the lender requires it. Don’t be fooled. In its online “Facts for Consumers” report on auto-service contracts, the Federal Trade Commission tells car buyers to watch their backs: “If you’re told you must purchase an auto-service contract to qualify for financing, contact the lender yourself to find out if this is true.” The FTC also says that some people have had a hard time trying to get out of a service contract they signed up for thinking it was a standard requirement for their car loan—another good reason to ask questions before any papers have been signed.

3. “You could probably get this car cheaper on eBay.”

One of the biggest threats to bricks-and-mortar car dealerships today is direct sales over the Internet. Nearly one in four consumers looking to buy a late-model used vehicle went online to buy a car in 2007, a 44% increase from 2006, according to the most recent report by J.D. Power and Associates. EBay Motors alone has helped consumers sell more than 3.5 million cars on its website; That’s not surprising since as of January 2010, 21% of all online automotive minutes are spent on eBay Motors, according to the Nielsen Company. What might come as a surprise is the fact that car shopping on the Internet is saving consumers money — an average of $1,794 per purchase, according to J.D. Power.

Dealerships have been slow to catch on to the trend, but more are recognizing the value of promoting their brand online. FordDirect, for example, is a joint venture between Ford Motor and Ford dealers aimed at promoting Internet sales. Sales from FordDirect Internet referrals totaled more than 229,000 in 2009, a 7% increase over 2008 sales; this represents over 19.3% of total Ford retail sales, up from 15.5% in 2008.

4. “The old bait-and-switch is alive and well.”

It’s a tried-and-true tactic: You walk onto the car lot, your heart set on a certain model, but immediately, the salesperson starts ticking off all the reasons why that model simply isn’t good enough for you. Before you know it, you’ve signed on for something bigger and better and, naturally, more expensive.

These tactics can result in drivers signing up for leases so that they can afford the monthly payments on an expensive car, says Eskeldson.

Another problem is that car buyers often think they’re showing up at the lot with tons of information they found online that they can use to negotiate – but often that information isn’t helpful, says Phil Reed, an editor at Edmunds.com. Knowing the invoice price of a car, he says, isn’t enough since it isn’t in lockstep with the car’s true market value. True market value pricing takes into account several factors, including a car’s current inventory levels – the higher they are, the more willing a dealer will be to negotiate – the local market sale conditions, hidden pricing details (i.e., all those extra fees that get added on before you sign the contract) and available rebates and incentives.

5. “I’ll give you a great price—and then lowball your trade-in . . .”

If you’re trading in an old car, Leon explains, the dealer’s greatest potential for profit lies in giving you the lowest possible value on your trade-in. How come? Most people have no idea what their car is worth, and besides, you’re less likely to play hardball on this point when that new car is much more interesting. “They get you involved in loving the new car,” Leon says. “And your old car seems kind of punk in comparison, so they ‘do you a favor’ and get it off your hands.” For this reason, Leon recommends always settling on a trade-in price before considering a new or even a used car, despite the conventional wisdom of doing it the other way around.

Reed went undercover as a salesman in two Los Angeles-area dealerships and then wrote about it for Edmunds.com. During three months he saw firsthand how much money can be made in used car departments. One day, he says, he watched a man drive into the dealership’s parking lot, scurry over to the used cars, and then rush back to his car. “He said he had just traded in his Chevy Cavalier here,” Reed says, “and wanted to know what they were selling it for.” The discouraging answer: While the customer had gotten $5,000 for the car, its asking price on the lot was $12,000

In this lecture about addiction to drugs, sex, and alcohol I learn a
number of different things about how addiction works and how scientist
study the pattern to find what causes it and prevents it. Most of the
myths that Dr. Garza proved to be false was exactly what I always
assumed to be true.

One of the major myths that I thought to be true was that drugs, sex,
and alcohol affect everyone in the same way. As in high school there is
a very divers group of kids who are known to be addicted to different
things. Like for example the group of kids who do drugs, I know many
people who go threw that phase and come out like nothing happened, while
other get stuck with no way out weaken by the addiction. For example
cigarette smokers, my older sister is practically a chain smoker, she
has tried everything one can think of to quit but it never worked. Where
as my boyfriend, Jesse, was a social smoker ever since he joined the
military three years ago; I refused to go out with him because he drank
and smoked and he quit on the spot. As one may see how I quickly came to
the conclusion that my sister wasn't trying hard enough, and probably
just waiting for the medicine do all the work. On a more personal
observation, people who drink I always thought were liars. I transferred
from a very strict private school in Dallas, to a very small, barely a
3A, country school in the middle of nowhere, straight in to high school.
I became friends with the more outgoing crowd the partiers and I went to
a party of there's. Even though it tasted disgusting, I drank just as
much as the girls I went with and I wasn't making out with every guy I
saw, stripping on table tops, or throwing up on everything, and I
defiantly remembered everything the next day. So when the girls came to
me saying they couldn't control them self because they were drunk, I
didn't believed them, and I found new friends with better morals. I'm
still not completely sure 'how much' drinking really effects someone
actions. I now believe as Dr. Garza proved with the different test done
to monitor the brain activity that things like drugs and alcohol effect
people different. He also proved this concept again with the different
kinds of rats Dr. Garza test on; which reveal it took different amounts
of myth to keep the rats in that satisfied high. This explains why I
never got drunk and girls that drank just as much as I was way passed
what I would call drunk. It also explains why my sister has such a
problem with trying to quit smoking and Jesse quit without haven a
second thought about it.

Another major thing that I learn more about is how scientist studies
diseases as in addiction to different things. I guess I never put much
thought in how they do their research and get their data. I heard of mad
scientists who do test on humans before, which are how they say all the
different blood types evolved. Although I don't believe that Dr. Garza
is a mad scientist, I guess if people are willing to participate to find
a cure for their disease, its okay. I mean people do the same thing all
the time when they risk their life getting an organ transplant, even
though there is a chance their body could reject it, to find a way to
get through their disease. It was also interesting as well as shocking
to hear that methamphetamine addicts chose money over myth, even as low
as seven to sixteen dollars, even though there concealed in a hospital
for weeks with no other way to get what they were supposedly addicted
to. Another fascinating fact Dr. Garza stated was how the genetic makeup
of a person effects how prone to addiction a person could be. This
statement makes me wonder if I can control in a sense the genetic makeup
of my children. For an example if I marry someone who tried and found
some kind of displeasure in drugs and alcohol and never tried it again
just as I have, will that make our children dislike it and never want to
do it as well? Dr. Garza gave a fascinating lecture that left many minds
continuously thinking about the different concepts and how they connect
in a bigger picture. I truly appreciate this chance to listen in on what
scientists today are studying; I don't believe that students get enough
great opportunities such as these. There for I want to thank you for
letting us sit in.

Bin laden on British Airways

It just seems like a bad time for any firm with the word "British" in its title. We know all too well the various setbacks experienced by the oil giant once known as British Petroleum; now British Airways has drawn much unwelcome attention to itself with a photo touting its new mobile-boarding pass system as it appears to expedite the air travel of al-Qaida leader Osama bin Laden, the world's most wanted man.

The photo appeared in the LHR News, the company's internal staff magazine covering London's Heathrow Airport. The image accompanied an article spelling out the benefits of the mobile-boarding setup, which permits users of mobile digital devices to print out their boarding passes on the fly. The boarding pass reads "Bin Laden/Osama" and appears in the graphic panel of a user's iPhone. (AT&T reception in remote Pakistani caves is apparently better than anyone might have guessed.)

What's more, the image features a frequent-flier number for passenger bin Laden — so much for all those airport terrorist watch lists — and has him flying first class on Oct. 26, 2010. As the travel site Gadling.com mused, "sadly, knowing the brilliant minds behind the anti-terror organizations, the terror level will be raised to 'red hot' on October 26, 2010, while airport police all over the world try to figure out which airport the most wanted terrorist in the world will be flying to."

So how did this happen? The short answer is that no one knows — or at least, no one's telling if they do. A British Airways spokeswoman told ABC News reporter Scott Mayerowitz that "a mistake has been made in this internal publication and we are working to find out how this occurred." And in response to a follow-up call from Yahoo! News, another spokeswoman for the airline remained firmly on message, saying, "We're still working to find out how this occurred at this time."

The gaffe could be the result of a tasteless prank that got out of hand — but current speculation is running toward the theory that it's the handiwork of a disgruntled employee. British Airways is currently locked in a labor dispute with the union representing its cabin-crew workers, and the strike has grounded flights for thousands of travelers in one of the busiest travel times of the year. At issue in the labor fight is a proposed cut in the base salaries for new flight attendants. The company estimates that it has lost more than $150 million in revenue during the dispute.

Between the union woes and the Osama PR setback, British Airways executives must be fondly reminiscing about last summer, when the major controversy was the airline's plan to sell ad space on its online boarding passes.

Be Prepared to Have Your Tweets Become Public Record

When Twitter first exploded onto the tech scene, most predicted the
website to be a passing fad. Now that tweeting has become a part of the
English lexicon and is being used by everyone from Barack Obama to
Charles de Gaulle Airport, the Library of Congress plans to create a
public record archive of every tweet since March 2006. Though private
accounts and direct messages will not be a part of the archive, a
majority of the 50 million tweets sent daily are public.

While Twitter is the first social media site to be fully archived in the
Library of Congress, it is not the first or only form of electronic
communication to be stored. Everything from e-mails to text messages is
stored in some capacity. In recent high profile court cases, text
messages have become pertinent in establishing alibis and character
references, while emails are regularly used as evidence involving
government officials. Who knows if Twitter accounts will be the next
form of communication to enter a court room?

By preserving the 140 character messages to be freely searched by the
general public, the Library of Congress is taking a unique step in
recording history. While the value of what a high school student in Iowa
has said about the latest episode of How I Met Your Mother may not be as
important as the first tweet by Twitter co-founder Jack Dorsey, it will
provide future generations with a unique perspective about present day
culture and trends.

UNFAIR JUSTICE IN PLANO, TEXAS. TRAFFIC VIOLATION BY MAIL

I just received a traffic violation from the Plano Police Department in Plano, Texas. Wow, what a sneaky way to make money and help with the city budget. Since the car is in my name, even though my daughter's friend was driving but I was the ONE who got that violation and I am the one who has to pay. May be I should call a law office who is not in Plano, Tx. but in Dallas, Tx. or Richardson, Tx. or even Oak cliff, Tx. but certainly not in Plano- and talk to a lawyer like a personal injury attorney since I feel that I am badly injured by this case. Today I was reading about this postal worker who got tired of delivering
mail so he just took it to his garage

The United State Postal Service has recovered approximately 20,000
pieces of mail — some of them more than a decade old — from a
Philadelphia postal carrier's garage.

Special Agent Scott Balfour says it took three mail trucks to remove the
letters. The carrier worked in the city's Bustleton neighborhood.

Now drivers can sit back, relax and enjoy the ride behind the wheel of a vehicle that can drive itself.

The GM company will showcase three versions of its pod-like concept vehicle, the EN-V (Electric Networked-Vehicle), at the 2010 World Expo in Shanghai. The international event runs from May to October.

The three cars, labeled with Chinese names, are the blue Xiao (Laugh), the red Jiao (Pride), and the black Miao (Magic).

The electric-powered two-seaters boast speeds of up to 25 miles per hour; are equipped with GPS; and can communicate with other vehicles to allow it to maneuver through busy city traffic.

EN-V is "an ideal solution for urban mobility that enables future driving to be free from petroleum and emissions, free from congestion and accidents, and more fun and fashionable than ever before," said Kevin Wale, President of the GM China Group.

"What we're talking about here is completely redoing the automobile," says Michael Albano, director of product and technology communications at General Motors International Operations.

Drivers could opt to switch off the vehicle's auto pilot, which would utilize an elaborate system of GPS systems, digital maps, roadway and vehicle sensors, cameras and other devices.

The idea of allowing the car to take over may sound alarming to some, especially given the recalls due to unintended acceleration and other problems with some Toyota vehicles. But GM's experts say there would be fail-safe backups to prevent problems.
