Mastermind behind Cash-For-Vote case

Arresting of Amar Singh and two other Ex-Members of Parliament of BJP is not absolute and perfect justice. Amar Singh acted as broker to mobilize votes for survival of Congress Party led UPA government. In return Amar Singh and his political party Samajwadi Party was likely to be awarded by UPA in some way or the other. Obviously UPA and Congress Party are the main culprits who used Amar Singh and his Party SP as a tool to serve their self interest.

Similarly MPs of BJP was in no way beneficiary of Cash -for - Vote game played by the then UPA government. BJP simply exposed the dirty game of Congress Party. There is no doubt that Congress Party has misused their power on Delhi Police to turn the game in their favour and on the contrary to ensure punishment to those who help the party and those who exposed the dirty game of the Party.

Here it is worthwhile to mention that India has submitted a list of hard core terrorists to Pakistan demanding their handover to Indian government to enable India to prosecute them and punish them as per Indian Laws. Everyone knows that hard core terrorists pointed out by Indian government never came in person to attack on Parliament or to carry out terror attack in Mumbai or elsewhere but they hatched a conspiracy to destabilize our country..

Ms Pragya Sadhwi and her colleagues who have been put in jail on the charges of hatching a conspiracy and a plan to carry out terror attack in some places in India (it is alleged ) never went in person to commit terror attack.

It is the demand of absolute and perfect justice that real mastermind behind all illegal acts are brought to justice and severe and harder punishment is given to such conspirators than those who personally put the dirty plan into action.

As such I am of clear cut view that court has not given perfect justice by sending Amar Singh and other two Ex-MPs to jail. I am very much confident that in due course Court will look into the underlying story and punish those persons who were real instrumental in hatching conspiracy to mobilize votes for UPA which face serious crisis of majority of votes in Parliament and which had almost lost vote of confidence in the year 2008. Real beneficiary of Cash-for –Vote was Congress Party and not Amar Singh or Bhartiya Janta Party. There is no doubt that Intention of Congress Party was bad, not that of BJP or SP or Amar Singh and other MPS who have been produced as accused by Delhi Police in Delhi court.

It is well known to all that as per existing rule book and as per Criminal Laws of the country ,guilty of committing murder is given lesser punishment compared to a person who is guilty of hatching a conspiracy to kill a person.

It is a bitter truth of Indian Judiciary, Indian politics and Indian administration that most of VIPs such as ministers, Heads of department, CEOs of Public Sector undertaking. Senior IAS officers, Senior police officers usually give illegal instructions verbally and through phones to their subordinates and hence they never come into picture whenever their evil works are exposed, their ill motivated decisions are brought to the notice of judiciary and when scam masterminded by such Very Important Persons are tested and tried in court of law.

In all high value scams and in all cases of big value corruption VIPs are acquitted and low level junior staff are made scapegoat. Lalu Yadav was acquitted and made Railway Minister and junior clerks and officers punished by court in Rs.1000 crore Chara Ghotala of Bihar. It is the culture of Congress Party

Instead of punishing tax evaders and those who create black money and park the same in foreign banks,Congress Party led UPA government is trying to trap and torture Baba Ramdeo and his team, Anna Hazare and his team and all those who try to raise voice against corrupt politicians. Current government at center is trying to provide relief to Hasan Ali by filing revision petition in Supreme Court in Black money case but not interested at all to frame strong Lokpal Act to bring about real reformation in corrupt system.

Team Anna has to understand this great loophole of Indian legal system and try to make the proposed Jan Lokpal stronger and effective so that it can catch the real culprit who masterminds the dirty game from behind the scene without leaving any witness or substantial documentary evidence.

Time has come when court will have to discover the real culprit to give justice to those who are obeyed their order or who helped them to get rid of other severe punishment. In present Cash-for-Vote cash Manmohan Singh Prime Minister and Sonia Gandhi, high command of Congress Party acted as Bin Laden or Daud act in every occurring terror attack in India. There are Bin Laden in all offices and all departments who execute their dirty plans through their devoted juniors and hard core flatterers.

Do no raise voice against injustice, corruption or anr criminals

Thousands of Bank frauds aggregating to more than one thousand crores of rupees,lacs of court cases pending against willful defaulters involving about one lac crores of rupees as bank loans, IT defaults worth more than Rs. one lac crores against lacs of individuals and firms (75000 crores only from Hasan Ali and crores of rupees from corporate houses, film star, politicians etc ),hundreds of cases of corruption against MPs, MLAs, Ministers, bank officials, politicians, IAS and IPS officials, judges ,CAs, advocates are pending in various courts and in the office of CBI and they are unable to neither recover the legitimate dues nor arrest and punish the real culprit.

No look out notice has ever been issued against hard core criminals, fraudulent share brokers, land mafias, money extortioner, naxal criminals, VIP killers etc . Lalit Modi like various VIPs are still moving freely in the society or going on foreign tours despite several serious lapses and financial irregularities detected. Various central ministers and state chief ministers and state ministers have been found to be indulged in corrupt practices and who have caused loss to the tune of thousands of crores of rupees to the Nation are ignored by powerful CBI and other agencies.

But CBI has shown its might, its power and its effectiveness to trap criminals by issuing Look out notice against a petty and innocent person Bal Krisnna, an associate of Ramdeo Baba. If there is a will there is a way. CBI perhaps wants to establish its effectiveness by arresting a person like Bal Krishna or Ramdeo Baba. If government wants to teach a lesson to any person, even if he is perfectly honest and innocent, it may do so with the help of various agencies under its control. On the contrary if government wants its agencies not to touch any VIP criminal, no power on earth can even point accusing finger towards a real criminal and no criminal cases lodged in court or in CBI can be allowed to pursue till its logical end.

All departments and ministries are behind Ramdeo Baba as if he is the greatest enemy and dangerous terrorist on the earth and all government officials have been advised to trap and torture Ramdeo Baba and his followers by hook or by crook even on flimsy ground. No look out notice against lacs of criminals who are freely moving here and there despite the fact that serious criminal charges are pending for disposal against them in various courts and in the office of CBI for years together .

Political criminals and scam masters are rather made Governors and given the post of CEO and Director in various PSUs. Governor who recommended passport of Hasan Ali is not taken to task but Balkrishna who made commendable and valuable research in Ayurvedic medicine and who invented and taught various natural cure for various diseases working in association with Baba Ramdeo Baba has suddenly become a thorn in the eyes of rulers of our country.
Shameful indeed.
It is worthwhile to mention here that government did not think it wise of punish babus and officers who recommended and who signed passports issued in favour of Hasan Ali or Balkrishna or many other foreign terrorists having genuine passport issued ingenuinely or fake passport caught in the past.CBI has no courage to arrest Manmohan Singh r whose cabinet decided to allow Mr. Raja to cause loss of lacs of crores of rupees to Indian exchequer.
Now you decide whether it is good governance or bad. It is reformation or deformation of society. It is democracy or dictatorship. Whether government is communal or secular, government is of the people for the people or only for VIPS and of VIPs.

From my view point, this government is good for bad people and bad for good people. Indian judiciary is used by criminals to get rid of punishment and common men are afraid of the government and police system even in telling a spade a spade.

Supreme Court Teaches Lessons To Central Government

When the Supreme Court rose to the occasion
The Supreme Court has, with its latest set of rulings, observations and orders hauling up the government, yet again established its supremacy as the apex judicial body in India.

On July 15, responding to a public interest litigation filed by a non-governmental organisation which fights for the rights of sewage workers, an SC bench comprising Justices G S Singhvi and A K Ganguly gave the government a two-month deadline to ensure that such workers have better working conditions and protective gear.

The bench was responding to a PIL that highlighted recurrent deaths of sewage workers trapped in manholes.

The bench, in a 45-page judgement, added that it would be failing in its duty if it did not accept genuine PILs, and shot back at critics who have often grumbled about 'the unnecessary piling up of PILs in courts at a time when cases have already been pending for long years', accusing them of 'elitist behaviour'.

As the courts have been used to vindicate the rights of the wealthy and affluent, did not the sewage workers, who belong to the lowest strata of the society, have an equal right to make an honest living, asked the SC.
In the past, the court has pulled up the government on many issues, be it black money, clubbing of housewives, prostitutes and beggars in the census, or criticising the prime minister for alleged inaction in the 2G spectrum scam. While some constitutional experts welcomed the decisions, others wondered if the judiciary was overreaching itself.

We bring you a chronological summary of these SC rulings. Whether this is indeed an overdose of judicial activism is for you to decide:
'Bias against women is shockingly prevalent in the work of census'
On July 4, 2010, the SC expressed dismay at clubbing housewives with beggars, prostitutes and prisoners under the 'economically non-productive' category in the census, describing the approach of the statuary authorities as "callous" and "totally insensitive."

A bench comprising Justices G S Singhvi and A K Ganguly observed that it was indicative of a strong bias against women.

"This bias is shockingly prevalent in the work of census. In the census of 2001, it appears that those who are doing household duties such as cooking, cleaning of utensils, looking after children, fetching water, collecting firewood have been categorised as non-workers and equated with beggars, prostitutes and prisoners who, according to census, are not engaged in economically productive work," Justice Ganguly said.

"We often forget that the time spent by women in doing household work as homemakers is the time which they can devote to paid work or to their education. This lack of sensitiveness and recognition of their work mainly contributes to women's high rate of poverty and their consequential oppression in society, as well as various physical, social and psychological problems," the judges observed.

'Give food grains to the poor, not rats'

In a country where millions go with just one meal a day and one third of the population lives below the poverty line, it is criminal that the government would allow food grains to rot. The court also thought the same, and on August 12, 2010, intervened, and asked the government to distribute the grain that was getting damaged among the poor.

The court was reacting to media reports that nearly 17.8 million tones of grain was being stored under tarpaulin across the country, and was gradually rotting.

On August 31, 2010, the Supreme Court made it clear that it had ordered free distribution of foodgrains to the poor instead of allowing it to rot, and rejected Union Agriculture minister Sharad Pawar's contention that it was a suggestion which could not be implemented.

"It was not a suggestion. It is there in our order. It is part of our order. You tell the minister about it," a bench of Justices Dalveer Bhandari and Deepak Verma told the government counsel Additional Solicitor General Mohan Parasaran.

"We have to develop a culture of zero tolerance towards corruption. Unless immediate and urgent steps are taken, the ultimate effect will be on the poorest citizen who is deprived of legitimate entitlement for food grains," the bench observed.

The apex court suggested that the government can also explore its suggestion for enhancing the allocation of food grains to the states to overcome the problem of rotting grains in government godowns.

'Why not legalise corruption?'

On October 10 2010, stating that "nothing moves without money", the Supreme Court expressed concern over the growing corruption in government machinery.

"It is very unfortunate that there is no control over corruption in the country. There is rampant corruption particularly in the department of Income Tax, Sales Tax and Excise Department. Nothing moves without money," a bench of Justices Markandeya Katju and T S Thakur said.

In a sarcastic vein, the bench said "Why doesn't the government legalise corruption so that a specific amount is fixed for every case?"
"Let us say if a man wants his case to be settled, he can be asked to pay Rs 2,500. That way, every individual will know how much bribe he has to pay. There is no need for any bargaining by the official and the people will also know beforehand how much they have to pay without any worry," the bench said.

"Poor government officials, we can't blame them also because of the growing inflation," the bench said.

In another case, the bench also ticked off a senior counsel after he appeared in a cheque bounce case for an accused.

"We did not expect at least a counsel of your stature to appear for such people. Mahatma Gandhi was also an advocate, but he never appeared for such people," Justice Katju observed.

The senior counsel initially shot back, saying, "My Lord, in that case I would be losing most of my clients!" a remark that had the court room burst out laughing.

Later, the counsel said he would definitely keep the court's suggestion in mind while appearing in future cases.

SC raps prime minister for alleged inaction in 2G scam

On November 20, 2010, the SC pulled up Prime Minister Manmohan Singh for taking very long (almost 11 months) to decide if ex-telecom minister A Raja can be prosecuted for his involvement in the 2G scam.
A bench comprising Justices G S Singhvi and A K Ganguly observed, "The alleged inaction and silence is worrying us."

Raja was indicted in a report by the government's auditor for costing the government nearly Rs 1.76 lakh crore by refusing to auction the spectrum in January 2008.

In November 2008, former law minister and Janata Party leader Subramanian Swamy wrote to the prime minister, asking for permission to prosecute Raja.

The SC made it clear that Swamy's report against Raja was not vague, since he had clearly referred the process of giving undue benefits to some telecom companies.

"For good governance, there must be some time-limit for granting sanctions, if not three months. But 11 months is too long," the bench observed.
'You should behave with some responsibility'

On January 21, 2011, the Supreme Court severely criticised Telecom Minister Kapil Sibal for making statements undermining the Comptroller and Auditor General of India's report on the 2G spectrum scam and asked him to behave with some sense of responsibility.

A forthnight earlier, Sibal had rejected the estimates of the CAG on the loss of Rs 1.76 lakh crore on account of allocation of 2G spectrum to telecom operators, saying, "It had no basis and was utterly erroneous."

"It is unfortunate. The minister should behave with some sense of responsibility," the bench of Justices G S Singhvi and A K Ganguly said.
Sibal had said that the "CAG has done injustice to itself and the Opposition is doing injustice to the aam aadmi."

The bench also sought the reply of the Telecom Regulatory Authority of India for allegedly not taking action against the telecom firms and defaulting in meeting their roll out obligations.

The bench also directed the Central Bureau of Investigation to go ahead with the probe into the scam without getting influenced by anybody's statement.
"In our opinion, the CBI which is conducting the investigation into the 2G scam is expected to carry out the probe without being influenced by the statement made by anybody, anywhere, including the press," the bench said.
SC quashes the appointment of Central Vigilance Commissioner

Dealing a big blow to the government, the SC quashed the appointment of P J Thomas as Central Vigilance Commissioner, on March 3, 2011.

The apex court held that the recommendation made by the high-powered panel -- headed by Prime Minister Manmohan Singh -- did not consider the relevant material and therefore its advice "does not exist in law".

Thomas was an accused in the 1991-92 palmolein oil import scam in Kerala. The price of import was higher than the fixed international price, and cost the exchequer a loss of Rs 2.32 crore. The import order was signed by Thomas, who was then Kerala's food secretary.

Thomas was accused No 8 in the case.

A bench comprising Chief Justice S H Kapadia and justices K S Radhakrishnan and Swatantra Kumar said, "We declare that the recommendation made by the high-powered committee is non-existent in law. Which means that the recommendations made on September 3, 2010 for appointment of Thomas as CVC does not exist in law. Consequently, the appointment of Thomas goes."

In comments that came as an embarrassment for the prime minister, the bench severely criticised the committee for not considering the relevant material.

The bench reprimanded the panel for not considering the pending criminal case against Thomas in the Palmolein import case and the recommendations of the department of personnel between 2000 and 2004 for initiating disciplinary proceedings against him.

'Why didn't you cancel Reliance Infocomm's licence?'

On February 11, 2011, the SC slammed the government for not cancelling the licence of telecom giant Reliance Infocomm for illegally tapping the telephone of politician Amar Singh on the basis of forged orders.

Reliance Infocomm had intercepted Singh's telephone between October 22 and December 21, 2005 on the basis of two letters of the 'competent authority'. The letters had several grammatical errors and subsequently it was found that the signatures of officers were forged.

"There were gross errors in the letter on which the interception was done. The government should have cancelled the licence of the service provider per se," a bench comprising Justices G S Singhvi and A K Ganguly said.

"Anybody's communication can be intercepted by the unscrupulous service provider. It is an extremely dangerous situation that is happening," the bench observed while criticising the government for its inaction.

"Can you see where things have reached? It has sunk so low. The government doesn't seem to have taken action in a serious matter. Why has the government not taken any action," the bench said, adding, "All of you are in league and the court is the soft target".

The court was hearing a petition filed by the former Samajwadi Party leader who had sought judicial inquiry into the illegal tapping of his telephone allegedly at the behest of his political rivals, including the Congress.
Interestingly, on May 12, 2011, the SC dismissed Singh's petition, and also lifted a February 27, 2006 ban on publication of his illegally recorded conversations.

'Appointing tribals to counter Maoists is unconstitutional'

On July 5, 2011, the Supreme Court restrained the Chhattisgarh government and the Centre from appointing tribals as special police officers and arming them to counter Maoists, terming the step as "unconstitutional".

Asking the Chhattisgarh government and the Centre to desist from appointing the tribals as SPOs and arming them for countering the Naxals in any manner directly or indirectly, a bench comprising Justices B Sudershan Reddy and S S Nijjar said that the appointment of tribal youths as SPOs was "unconstitutional".

The bench said the eligibility criteria including the educational qualification and training of the tribals to combat Maoists goes against the provisions of statutes and the Constitution.

It said the creation of Koya Commandos and Salwa Judum was in violation of the Constitution. The special police officers have been given the name Koya Commandos after that of a tribe in the Dantewada region.

The issue of SPOs had arisen during the hearing of a petition against the existence of the Salwa Judum (vigilante groups) in Naxal-hit regions of the state to fight Maoists.

The petition was filed by sociologist Nandini Sundar, historian Ramachandra Guha, former bureaucrat E A S Sarma and others seeking a direction to the state government to refrain from allegedly supporting the Salwa Judum.

During a hearing on the issue on May 4, 2011, the state government had justified the appointment of SPOs saying they have excelled in performing police duties.

It had also asserted that in anti-Maoist operations, the SPOs were of immense help in their role as guides, translators, spotters and on certain occasions they have saved the lives of regular security personnel while preventing more than dozen Maoist attacks on relief camps and helped security forces in anti-Naxal operations.

However, the court was of the view that arming tribals would lead to a "dangerous" situation if they turned against the State.

The court had also questioned the training programme of the SPOs.
"You are playing with the so-called SPOs. What will happen if they turn against the State. God save this country," the bench had said during the last hearing.

SC's no confidence in government on black money

On July 4, 2011l, the Supreme Court appointed a high-level Special Investigation Team headed by former apex court judge BP Jeevan Reddy to monitor the investigation and the steps being taken to bring back black money stashed away in foreign banks.

A bench comprising Justices B Sudershan Reddy and S S Nijjar directed that the High-Level Committee constituted by the government to look into the issue of black money would "forthwith" be a part of the SIT.

The bench also directed the government to disclose the names of all the persons who were issued show cause notices by the authorities in connection with the probe into the black money issue.

Opening of Padmanabhaswamy temple vaults

The discovery of treasure well over Rs 90,000 crore from the vaults of Sri Padmanabhaswamy temple in Thiruvananthapuram in Kerala a few weeks ago stunned the nation.

How the temple amassed so much wealth is no secret. In 1750, Marthanda Varma, the then king of Travencore abdicated his throne in favour of Lord Padmanabha, declaring himself and his descendants as servants of the deity, following bloody infighting for the throne.

By doing so, Varma ensure that his kingdom was no longer prone to future attacks by neighbouring kingdoms, since Travencore was now ruled by a deity. In turn, the neighbouring kings made generous donations to the temple vaults to appease the god. And soon, the coffers were flowing with gold, and valuables.

While all major temples of the area were handed over to the Travancore Devaswom Board after merger of the princely state with the Indian Union after 1947, control of the Padmanabhaswamy temple was retained by the royal house through a covenant with the government.

Though the last royal ruler Sree Chithira Tirunal Balarama Varma left the entire treasure untouched he was made 'Rajapramukh' (status equivalent to Governor) after the merger.

Following the discovery three centuries later, authorities rushed to secure the treasure. Soon, heated discussions were flying to and fro, about how the wealth should be preserved and utilised.

Speculations were rife on the eventual fate of the wealth -- whether it will be used for charitable purposes or remain with the temple authorities.
The law in such cases stipulates that only the temple deity has a 'right' over this wealth.

As per Indian laws, a temple deity is considered to be a juristic person. A juristic or a legal person is entitled to the wealth it has been given and can even fight a legal battle to keep it.

The Supreme Court stepped in, and appointed a seven-member panel to oversee the opening of the vaults. The team, however, was unable to open vault 'B', even after repeated efforts.

Then, on July 8, 2011, the SC bench comprising Justices R V Raveendran and A K Patnaik restrained the committee from opening the vaults.

The bench asked the petitioner Raja Marthanda Varma, erstwhile Prince of Travancore, and the Kerala government to come out with appropriate suggestions for ensuring the sanctity and security of the ancient temple, which has come to the limelight following the discovery of the huge wealth.
Rs 90,000 crore found in Kerala temple belongs to Lord Vishnu

The Supreme Court on Wednesday appointed a curator to look after the Rs 90,000 crore treasure found at the Sri Padmanabhaswamy temple in Thiruvananthapuram, Kerala. Speculations have been rife on the eventual fate of the wealth -- whether it will be used for charitable purposes or remain with the temple authorities.

The law in such cases stipulates that only the temple deity has a 'right' over this wealth.

As per Indian laws, a temple deity is considered to be a juristic person. A juristic or a legal person is entitled to the wealth it has been given and can even fight a legal battle to keep it.

Padmanabhaswamy, an incarnation of Lord Vishnu, is the presiding deity at the temple.

According to Advocate General of Karnataka Ashok Harnahalli, "All this wealth belongs to the deity since it has been given in the name of the idol. Some people have demanded that this wealth be used for public good. But this is not possible as per the law. If ornaments and other treasure had been given to the temple, it is in the name of the deity which has sole right over it".

Know about Black Money

I reproduce my write up of the year 2009

It is beyond imagination that government of India will be able to bring all money black or white to India. I am unable to understand when and how government will be able to ascertain the color of money until foreign bank provides true information on all accounts and Indian inspecting officers have willingness and enough resources to reconcile the same with IT return of the same person in India to assess the true colour of the money.

There are many reasons behind it. Some of the reasons are submitted below.

Foreign bank will not agree to share information with our country as long as there is mutual agreement between the two countries for mutual share of information.

As per Indian law I think even Indian bank or Indian government has got no right to share information of any account of any person in India with foreign bank or any foreign based authority.

Foreign based banks as learnt from various articles in this respect do not ask for much information about person ,opener of accounts as much as person opening account in Indian banks are supposed to provide to the banks (strictly as per KYC norms)

Income tax officials are not so much honest and sincere that they will try to catch such person. Had they been so much sincere and honest they could have caught black money at least hundred times of what amount is said to be parked in Swiss bank or any other foreign based bank. In fact it is they (IT personnel) who teach taxpayers method of saving tax and how to evade tax because they get bribe in cash or kind from such taxpayers.

Government of India is made of dirty politicians and they do not have real willingness to make such stringent rules which forces Indian taxpayers or Indian Income earners to declare the income truly, honestly and correctly in their IT returns. Because survival and development of India Politicians lies on the existence of black money only

Entire politics of India runs on black money and without help of such black money any political party or any individual contesting election cannot imagine of spending crores of rupees in election. Most of the candidates in current election has declared income and declared capital of less than one crore but he will spend not less than five crores to win the election. Wherefrom such money comes is such question which none can answer correctly.

Majority of government officers have huge unaccounted money and it is they who can afford buying a house worth more than a crore in the mid of the town. None of honest employees in any department can imagine of purchasing a house worth even twenty to thirty lacs in white money (house in India is traded in two parts, one white money and another part of cost is in black money) because real cost of such house including black money is always more than at least sixty lacs.In India there are hardly one out of 100 house worth more than a crore is registered in true value of the house. Government can easily count such houses in each town and find out real tax evaders if they are really interested to catch black money.

Obviously it s an open secret that there are plenty of black money in Indian economy and Indian government has failed to curb it despite promises and hue and cry made by several VIPs and despite shedding crocodiles tears by so many politicians. Therefore one cannot even dream of getting Indian black money parked in foreign banks. Doing politics is one thing and doing something real is entirely a different story.

Lastly I would like to suggest government of India to discard adherence of KYC norms and remove anti money laundering act and ask all banks to open account in any manner in the name of any true or false person and allow money to be deposited in Indian bank. In this way entire black money will come back either in bank or in circulation. At least money will not be parked in foreign banks in Indian banks accept money freely.

This is desirable because government of India cannot control effectively inward and outward remittances taking place through banking channel despite all claims and assurances of controlling authorities. Money going abroad through fictitious import and export still persists in trade and growing day by day. Not to speak of money being imported or exported, even arms and ammunition are being imported in disguise to spread reign of terror by terror groups and Indian government remain silent spectator .Inspite of several steps taken by government of India for last two three decades and inspite of several stringent laws in this regard to curb spread of black money transaction ,our law enforcing agencies in collusion with politicians have miserably failed to effectively enforce existing rules and ensure finish of black money from the system.

Why Anna Hazare

Harshad Mehta the great cheater in share market got success in motivating CMD, GMs and DGM of the various banks by extending them costly gifts and cash and it was he who could cause loss to various banks in hundreds of crores of rupees. Government of India could not learn lesson from this event. They could not assess and visualize the level and dimension of corruption prevailing in the banks when top ranked officers are indulged in earning money through illegal ways.

Madhu Koda and Mr. A Raja could get success in causing thousands and lacs of crores of rupees to the government only because top ranked bankers and top ranked administrative officers in government departments supported them. Other junior clerks do not have guts in the present system to raise voice against corrupt officers or become whistle blower in fear of repercussions. Malicious role of bank officials cannot be denied in Ketan Parikh scam, UTI scam or even in 2G or CWG scam. But none of regulating agencies is interested to take against the erring top officials and modify the system.Lacs of cases are therefore pending in various Lower courts, district courts, High courts ,various tribunals and Supreme court.

Indian bank, Global Trust Bank , many private banks ,many regional rural banks and at least one hundred cooperative banks were caught in unhealthy lending leading to huge capital loss and even merger of such bank or closure of such banks.RBI and Ministry of Finance could not understand how much deep rooted is the disease of cancerous corruption in the bank. When top ranked officers are corrupt they cannot allow honest officers to hold creamy posts.

In the recent past Central Bureau of Investigation caught eight top ranked officers including CEO of financial Institutes involved in bribe led lending, but RBI officials could not visualize that when top of any financial institute are so much corrupt, there must be a team of corrupt officers down the level who blindly supported CMD or ED or GM of that bank.

Survival of fittest is no more hold good in modern era. Now survival is possible only for those who know the art of flattery and art of bribery.

Historic LIC housing Finance scam did not open the eyes of regulator of financial institutes only because top ranked officers and minister get money in selection of ED and CMD of PSU banks and in turn CMD of financial institutes get money for giving promotion to officers working under him. In such dirty and corrupt atmosphere officers at lower level have to earn money through illegal sources either in lending or in contractual works and share the same with his bosses to get quick promotion and choice posting superseding many seniors. It is open secret that these corrupt top ranked officers do not leave any clue of corrupt dealings and they do not allow bribe lending leaving behind an documentary evidence. These corrupt officers do not declare such bad advances as Non Performing Assets as long as adequate safety measures are taken to safeguard the actual lender. They are able to manage even vigilance officers and CBI officers to get rid of them.

These clever top officers resort to telephonic pressure on field functionaries and in case of exposure of their evil work they trap other junior officers and sacrifice them on the altar of honesty and discipline.

All this is possible only when top ranked officers get huge discretionary powers to select officers, promote officers and transfer reluctant honest officers as per his whims and fancies.

This is possible only because courts are unable to deliver judgments even in two or three decades.

The reign of injustice and climate of corruption grows and grows only because judiciary is beyond the reach of common men, only because justice is too much costly and only because there is shortage of good advocates and honest judges who are devoted and sincere in their job and who allows the case to die a natural death in a decade or two until the main culprit top officers is retire from his service safely.

This is why thousands of cases filed against corrupt bank officials are languishing in the offices of CVC, vigilance offices, CBI, Ministry of Finance or Banking Division without any punitive action against erring officials.

This is not astonishing to anyone in the country that one lac crores of bank finance is unrecoverable and treated as bad assets by banks and more than three lacs crores of bank’s lending is though bad but not declared to save the image of the bank, to keep the share value up and to boost up the morale of credit officers but in fact bad assets are not declared as Non Performing Assets mostly to save the corrupt officers. Even courts are unable to recover the money from willful defaulters. So many fast track court also failed to achieve the goal of recovery because corruption is rampant in all offices.

This is why people of India need to support movement launched by Anna Hazare and his team against corruption.

Cancer of Corruption can be cured

Many politicians have now openly admitted that it is not possible to remove corruption from life and corruption is deep rooted in the system. People in general have also accepted the corrupt practices as routine way of business.

However it is very much necessary to try to reduce it if complete stopping is not possible.

I however do not believe that it is not possible to make India free of corruption when it was made possible by our great leaders to make India free from the clutches of British rule.

Right to recall is one step to create fear in minds of corrupt politicians and corrupt officers working in government departments in particular and all evil doers in general.

To make judiciary active, sincere, honest and effective is another step to give quick punishment to perpetrator of injustice. It is necessary to make police and judges accountable to public and force them to catch hold of real culprit within shortest period of time. By action courts and police both have to demonstrate that all criminals are punished in shortest period.

Third way is to inculcate good habits right from the beginning of one’s education and promote good students in all sphere of education life.

Fourth is to stop corruption in recruitment, posting and promotions. Departmental heads and ministers are in general applying their power of discretion to earn illegal money in doing whimsical promotion, transfers and posting of service class people which gives rise to flattery, bribery and ultimately corruption for survival. Such unhealthy practices results in growth of corruption practices. As such corrupt officers sitting at top post should be sent to jail first to send the desired message down the line.

Fifthly all honest persons, effective officers , devoted political workers have to brought in focus and given all powers to deal with corrupt service men and corrupt politicians. Media should give maximum coverage to good work of good officers instead of giving news of accidents, murders, rapes or bollywood actors and actress. When players of cricket can be made Hero of the Nation by media there is no doubt to me that real performers in other walk of life should be given more weightage by media.

Government should not allow politicians spending in political rallys, election campaigns or buying voters by offering gifts in cash or kind. None of government functionaries should be permitted to spend a single pie in extending welcome to ministers or high rank officers. None of businessmen, contractors, service providers or service men and none of government departments or PSUs should be allowed to extend financial support to political contestants. No function should be permitted by district administration which is organized for welcoming a leader or an officer or for inauguration or for any purpose. Government can provide a common platform at its own expenses for popularizing a scheme or for politicians contesting election at panchayat or village level. Not a single pie should be spent on flattery and to make this plan fully successful our government should take lesson from other developed countries.

There is no question of government funding for election. Rather contesters in election should go door to door for campaigning. Every contestant has to show their performance and prove that they can serve people of India if they are given opportunity. Role of money should be completely made zero. Person selected from a group of say 5000 voters should then be made member of district level elected body. Member so elected for District level assemblies should selected educated member for state assemblies and then for Parliament. Such process will give true power to Panchayat level workers and remove corruption from the root. Further this process will save crores of rupees which are spent by the government and politicians on conduct and process of general election.

Last but not the least media should stop news, discussion and debate on caste and community. Any person or group of person making analysis of voters or servicemen or officers or politicians or organizations based on caste and community should be punished. By hook or by crook Indian government or the people of India have to create an atmosphere where every citizen of India voluntarily give due respect to rule of law and there is fear of law in minds of all people. Rule enforcing agencies and monitoring agencies must have full liberty to punish breaker of law without any fear of repercussion from politicians or top ranked officers. Money mafia or naxal elements who are extorting money from people of India must be booked to task and put in jail until they exhibit change in habits or show reformation in their mind.

Merit and only merit should be highlighted in all sphere of life. Honest and sincere workers who have been posted in remote or critical areas or who have been shunted away by gang of corrupt officers and corrupt politicians should be brought back to mainstream and given powerful post by removing and weeding out corrupt officers.

I would like to say here that movement of Anna Hazare is very much commendable but it can get the desired success only by support of politicians under the existing framework set for functioning of various legislative and executive organs of the government. Political parties have to come together and unitedly fight against corruption and if needed dethrone existing government if it does not listen. Mahatma Gandhi and Jai Prakash Narayan got success in their goal only because they had political support as well as public support.

Message for Kapil Sibal, HRD minister

If a child is not getting admitted in school, or he is not getting proper education in school ,then who is responsible for such sorry state of affairs prevailing in most of the state run or stated aided schools?

If poor common men are not getting required medical care and needed medical facilities at government run hospitals , then who is responsible, punishable and accountable for such mismanagement in government run hospitals?

If fake medicines are supplied in hospitals or sold from medicine dealers who is responsible and accountable for it? If doctors do not attend their duty honestly, then who is supposed to take disciplinary action against them punish them? Unwarranted pathological tests are prescribed by unscrupulous doctors to patients in nexus with owners of pathological labs, and then who will hang such inhuman doctors?

Officials and babus of various Municipalities and Municipal corporations are not passing construction map without taking bribe or passing unlawful construction after taking bribe, then who is supposed to take action against such corrupt officials?

Fake and inflated Bills of unscrupulous contractors as well as suppliers are passed in all government offices only after payment of shares of bribe to various officials and ministers. Whose duty is to stop such malpractices prevalent in government offices, public sector undertakings and public sector banks and insurance companies?

Chartered Accountants put their valued signature without making adequate checking of books of records. CAs verify books of accounts as less as possible when they get commission as much as they desire, otherwise they delay the process. Judges do not decide the case as long as they get f their share in illegal money advocates collects from their clients. Who is supposed to trap such corrupt judges?

Officials of pollution control board issue clearance certificate after taking bribe, Income tax officials passes assessment order after taking bribe, custom officials clears shipment after taking bribe, passport official issue passport after taking bribe ,and so on ………. who is responsible for such illegal practices?

Scam in thousands and lacs of crores of rupees are detected in various departments under central government, have any minster or departmental head punished without the intervention of court?

Lacs of crores of rupees are declared as Non Performing Assets in public sector banks, why is government not taking adequate steps to recover the money from such willful defaulters and why the government is not punishing CMD, ED and DGM of such banks who is promoting unhealthy practices cleverly and getting retired without facing any punitive action from any corner?

Why vigilance officers POSTED IN VARIOUS BANKS AND PSUs and officials of Anti Corruption Bureau or official of CBI themselves take bribe and close the case lodged against various corrupt officials?

Why is government silent spectator of all such unhealthy practices prevalent in government offices and why is government continuously silently watching Chirharan of Draupdi for decades together?

Do the government and ministers think themselves great by pointing out their accusing fingers towards member of opposition parties? Why is central government not taking appropriate action against state government which is not performing as per central directives? Why do you hesitate to accept the performance recorded by Nitish and Narendra Modi government?

Before maligning and before character assignation of Narendra Modi your government do not introspect and admit willful and inordinate delay in punishing the guilty of Anti Sikh Riot or Bofors scam or stamp scam or share ghotala or UTI scam and so on……

Is Manmohan trying to hide his fault by pointing out his accusing finger towards Mr. Advani or Mr. Narendra Modi who is appreciated by all learned Indians.?

Why hundreds and thousands of clerks and officials involved in Chara Ghotala of Bihar state were punished but the then chief minister Mr. Lalu Yadav who masterminded the scam was made railway minister. Why not real culprits involved in stamp scam not punished even after lapse of two decades? Why Manmohan Singh and his flatterer minister kept silence for two years on various scams and why did he not take any action against corrupt officials to demonstrate that he is active, efficient and capable?

Last but not the least why various departments entrusted to stop corruption is not functioning honestly and why Lok Pal Bill or judicial reformation has not been put into effect for last four decades though central government has promised to do so many times? Why leaders of Congress Party and other partners of UPA hesitant in supporting movement launched by Anna Hazare against Corruption.

Corrupt Government

It is reported that 300000 crores of rupees Indian black money is parked in foreign banks by big shots, tax evaders, officers and politicians. Government does not want to take action against them because the black money is earned and remitted to foreign banks only by indirect support of ministers ,officers, politicians and domestic banks. More than 300000 crores of black money is circulating in domestic economy.

More than 300000 crores of rupees as tax defaults is not recoverable from High net worth businessmen and professionals because it is these tax defaulters who provide monetary support to politicians in winning the general election. These tax defaulters give huge money in the shape of bribe to top ranked officers, public representative and powerful ministers and get rid of all actions. Government does not want to recover overdue tax from such defaulters.

More than 300000 crores of rupees are locked in various public sector banks as bad assets (80000 crores of rupees as declared Non Performing Assets (NPA) and rest hidden as restructured and stressed assets). Government does not want to recover Tax from big value defaulters because such defaulters are closely associated with CMD, ED, General Managers of bank or various powerful people from political field or related to government officials directly or indirectly. Government does not want to recover money from small value defaulters because these defaulters known as villagers, farmers, or small traders are the vote banks of ruling party and hence government think it wise to waive small ticket loans ( during last election government waived 75000 crores of rupees).

More than 300000 crore valued fake notes and fake stamps are in circulation and government is unable to stop addition of fake notes and fake stamps in the economy.

More than 300000 cases are pending in various high courts of the country and more than thirty lac cases are pending in district level courts and government is unable to take any action against erring judges or corrupt advocates and government officers. Most of the cases are directly or indirectly associated with VIP of the society. Or else courts are unable to deliver judgment in want of adequate manpower and suitable infrastructure. More than 300000 cases have been referred to CBI by various state or central governments for investigation and necessary action. These cases are finally closed when the case is related to VIP and case is not pursued properly when CBI officials get bribe money to dilute the intensity of the complaints.

Government gives license to high net worth tobacco manufacturers and wine manufacturers. Government allows manufacturing of Pan masalas, cigarettes and wine with an instruction to print a warning on each pack such as “ chewing of tobacco is harmful for health “, “Use of wine is dangerous for life”. But government fines and threatens to impose heavy penalty on small shop keepers, pan vendors who sell pan masalas. Government does not want to punish who manufacturers of such harmful product because politicians and officers receive heavy illegal money and costly gifts from them. Government gives hundreds of licenses in a small town and allows open sell of wine but punish who consume it. This is India.

Use of plastic bags, utensils and other products are found to be harmful by government and hence government impose penalty on shop keepers who sell goods in plastic bags and individuals who carry goods in plastic bags. But government does not want to punish manufacturers of various plastic products because officers and ministers receive huge money from manufacturers of these products.

Government officers huge money as bribe in allowing encroachment to businessmen, shop keepers, real estate developers, home owners, flat builders, park owners etc . It is officers of municipalities and municipal corporations who approves map for construction and who allows deviation in construction after taking huge money as bribe. When court gives orders for removal of encroachment small shop keepers, road vendors, vegetable sellers are beaten and their shops are broken but rich persons are spared because they can give bribe to officers once again to get rid of destruction of illegal construction.

This is India, the great India, shining India. This is Manmohan Singh brand reformation. This is the story of economic liberalization, globalization and privatization. This is the result of Gross Domestic Product said to be in two figures and for which Government led by Manmohan Singh feel proud of .This is India which is ranked 87 in the world and treated as one of the most corrupt countries in the world. India is still great because politicians of India know how to befool innocent and illiterate voters of the country on the basis of caste or community or regionalism and religion or by way of reservation. This is India where flatterers and corrupt rich persons are given ticket by political parties to fight general election and poor but talented persons are rejected. This is India where criminal can become MP or MLA but not intellectuals. This is India where corrupt officers are appointed as Vigilance officer and made Chief vigilance officer of the country to stop corruption. This is India where tax officials guide how to evade tax and police officials guide thieves how to get rid of punishment. And so on………. …………………………..But everybody talks of reformation.

It is worthwhile to mention here that almost all top ranked officers have properties worth tens of crores of rupees in various names and at various places though their total income earned during the period of their entire life is not even one crore of rupees. When most of officers and most of the politicians are corrupt there is very little hope that action, real action will ever be taken against corrupt person. Government is made of corrupt people only and then it is foolish to expect any justice from such government. Officers and politicians in general are birds of same feather.

Rape OF Human Resources IN Government Offices

How many years of service is enough for bank management to assess and judge the potential, character, knowledge, capability, capacity, attitude, managerial skill, innovative skills, creative ideas, ,initiative, willingness, honesty and integrity etc of an officer for giving promotion to him from one grade to another grade, or from one scale to other?

10 years, 20 years, 30 years or more?

Educational qualification of a staff, record of performance during preceding years and his capacity to satisfy customers is already tested by management during his posting at various branches and offices. What else is then required to be tested by Interview panel to judge whether one staff is suitable for promotion or not?

Quality of an officer is already tested by bank management in span of more than 10 years and even thirty years of service and hence it is foolish to expect from members of Interview panel that during one to three minute interaction with the candidate in Interview process they will be able to extract something additional from the candidate.

Obviously Interview process is used to reject good officers and select officers who may be bad performer but who are the choice of members of Interview panel constituted for promotion process. Officers who are flatterer and who earn bribe and honestly share with their bosses or who is choice of some VIPs can be selected in preference to really good performers only by using weapons of rejection handed over to members of Interview panel.

If 10 to 30 years of service is not adequate to estimate the suitability of an officer for promotion to higher scale I think officers who judge and who are supposed to decide the suitability of an officer for promotion to higher grade or higher scale are incompetent and of doubtful integrity. Obviously such officers should be shown the exit door first.

On the contrary if an officer is not fit for promotion to higher scale even after 10 to 30 years of his service, such incompetent officers should be removed from service or given CRS.Only stopping of annual increment is not enough to penalize such non performers.

It is worthwhile to mention here that officers who work sincerely but not found fit for promotion either by corrupt member of Interview panel in interview process or due to biased rating in Annual appraisal reports are given assignment of higher responsibility by bank management. Such senior officers perform the best but they are not given even annual increment. They are kept in stagnation for three years irrespective of their performance. Juniors who do not perform are getting increment every year without any hindrances whereas seniors who perform better are denied even annual increment. It is justified or not only God knows.

But if an officer has to pass through ordeal of interview for getting promotion to higher grade scale does not seem justified from any angle of consideration. Interview and appraisal system in banking industry prevalent for promotion is totally unjustified, illogical and ill motivated. Such unwarranted processes give enough scope for injustice. Such Interviews are nothing but paves the way for arbitrary promotion to person who are not good for the health of the bank.

This is worthwhile to state that officers who are selected for promotion are invariably found to be guilty of causing loss to bank in subsequent years. It astonishes that officers of negligent and fraudulent character, officers who are charged with various lapses and against whom disciplinary action has been initiated, are selected in faulty promotion processes prevalent in banking industry and conducted by greedy and corrupt senior officers. This is why bad officers are posted as Branch head who do not know how to deal with customers and how to protect the interest of the bank. As a result NPA is increasing year after year in Public sector banks and the government is silent spectator of mischievous acts of top ranked officers.

CBI is more often than not asked to investigate into fraud or any matter related to loss of money to bank or any other office, but I am of strong opinion that CBI investigation should be conducted into all recruitment and promotion processes which are taking place and which took place during last 10 to 30 years. This can only reveal the ongoing corrupt and unhealthy practices in the system which leads in unhealthy practices and rise in corruption. Permanent Solution to this cancerous disease of bribe or flattery oriented recruitment, posting, promotion in government offices can only pave the way for real reformation in banking industry in particular and government department in general.

Revolt against reign of Injustice is inevitable

People sitting at top posts are supposed to be more responsible, sensible, active, effective, honest and serious to their job. because it is politicians and top ranked officers who act as bacon light for others, it is politicians and ministers whose mischievous actions are followed by subordinates, juniors and youngers.

If Netas are corrupt, dishonest and non performer, Indians babus , administrators or officers cannot imagine of doing good performance without flattery to corrupt politicians and without following corrupt practices. If politicians, ministers, judges and public representatives are busy in earning bribe and commission and when they help businessmen to earn wealth through illegal ways and means common men cannot dream of happiness, prosperity and peaceful life.When industrialists are given full freedom to earn more and more profit , Indian rulers cannot provide any relief to common men suffering from pain of price rise.

If prime Minister, Home minister, Finance minister and even President of India prefer sitting on public complaints or simply forward the letters of grievance received from public to concerned department without ensuring its logical conclusion, people of India cannot get relief from any other departments said to have been established to look into cases of corruption or injustice or torture meted out to common men. When office decency and decorum is broken by top ranked officers, juniors cannot be expected to follow the rules of decency. When ministers are not disciplined and when MLA and MP are exhibiting indecent behaviour in Parliament and state assemblies, the working class in government department cannot be loyal to common men.

When a corrupt person is appointed as Chief Vigilance Commissioner of India , it is foolish to imagine that such corrupt CVC will select good officers for the post of vigilance officers for other PSUs.When vigilance officers are themselves corrupt they cannot stop corruption in any office they are posted as vigilance officer.

When Chief Justice is corrupt, the appointment and promotions of other judges will naturally be based on bribe and flattery and when judges in general are corrupt the victim or the aggrieved person cannot imagine of quick justice from any court in the country.

When CMD or ED or GM of a bank or PSU is corrupt, good and performing bank officers cannot survive with dignity if he does not follow the path shown by such corrupt top bosses.

When transfer, posting and promotion of government servants depends on bribe and flattery, India cannot imagine of a good working culture and India will continue to rank higher and higher in the list of most corrupt countries.

Politicians and especially ruling politicians are as good as parent for ruled class and when parent are incompetent, corrupt, drunkard,dishonest,liar, cheater, fraud master, scam leaders and so on ---- children cannot be good mind.

In such position some of grown up children think it wise to revolt against their parent when they understand the values of life.This is why people in our country are now raising voice of revolt against perpetrators of injustice.

What the hell is going on

Prime Minister Mr. Manmohan Singh is habituated to commit mistake and then accept responsibility if he is exposed by Supreme Court or rebuked by opposition parties. In all cases of scam exposed in last two three years it is only Supreme Court that has forced the government as also CBI to initiate investigation against corrupt officials and ministers. Otherwise advocates of Congress Party like Kapil Sibal, Manu Singhwi, Digvijay Singh left no stone unturned to close the chapter of 2G, CWG, and Adarsh Society like scam etc. Even in case of appointment of CVC or in case of black money government tried its best to shut the mouth of crying media and that of leaders of opposition parties but the court did not find any merit in lame excuses submitted by the ruling party leaders.

Flatterers of Sonia or PM even tried to reignite communal issues and trap BJP and NDA so that people stop raising voice against corruption or price rise or against the killings of Maoists. Leaders of Congress Party are busy in discovering a few cases of corruption against BJP ruled states but they are not getting success in their mischievous goal. They always try to point out their accusing finger towards BJP leaders to conceal all their blunders coming to light but they fail to do so because BJP and NDA rules states have been developing by leaps and bounds. But they cannot befool intelligent Indians for long.

The remarks "what the hell is going on in the country" given by the Supreme Court in case related to black money parked in foreign banks is very much disheartening not only for the government but also for entire country. But it is painful that the leaders of Congress Party are shamelessly accepting the adverse remarks without realizing the moral responsibility and quitting the government. Even now government can demonstrate through quick and effective action against hundreds and thousands of corrupt officials sitting at op posts in various departments.

People of India who understand the dirty politics of Congress Party and danger of rampant corruption in the country are very much in anger and very much eager to throw out the government of UPA as soon as possible if given the opportunity. At least Indians living in USA have taken the lead to start movement like Dandi March which was undertaken by Late Gandhi ji against British rule.

If our Prime Minister possesses any amount of self pride in him, at least now, PM Mr. Manmohan Singh should offer to quit the post after facing so much humiliation of the government in the court and in the Parliament.

Time has come when all non-Congress party leaders should forget their ideological differences should come together to oust Congress Party from power before it is too late and before the nation faces situation like Egypt or Libya or failed state like Pakistan

Malkangiri DM and Godhra judgement

The 1989 kidnapping of Rubaiya Sayeed was an act carried out by members of the Jammu Kashmir Liberation Front a Kashmiri Muslim militant organization, on December 8, 1989 in Jammu and Kashmir. The kidnappers demanded the release of five of their comrades in exchange for Rubaiya's release. The government accepted their demands and freed the jailed terrorists.

Similarly after prolonged negotiations with the Taleban government and the Kandhar plane hijackers, three hard core terrorists were released by Indian government in exchange of all the hostages trapped in hijacked plane in Kandhar in December 1999.

These two historic incidents paved the way for more and more kidnapping of important persons in various naxal prone areas in the country to force the local government to release their naxal colleagues languishing in jail for long or to get their other demand accepted by ruling government.

During last two decades and more several incidents of kidnapping have taken place in various parts of the country and in most of the cases ruling government had to bow down. Still government state as well as central, had totally neglected the dangers of growing naxal activities and allowed it to grow without any break till last year when Mr. P. Chidambram was made Minister of Home affairs

Naxals in the state of Orissa have after all succeeded in forcing the government of Orissa to release their men. This has proved that naxals have grown in their fighting capacity. The incident of Orissa and the subsequent step by ruling government to release the jailed naxals as demanded by kidnappers has once again substantiated the fact that all states governments as well as central government took a very casual approach on the danger of naxals even after the sad incident in 1989 and 1999. The Orissa incident has once again established that Government has been totally failed in taking a coordinated approach on handling the problem faced by people living in naxal affected areas during last two decades.

Still there are various politicians of various political parties who are sympathizers of naxal element because they use to take the help of naxal forces in winning the election. There are many social activists, media men, journalists, NGOs who still talk of negotiation with naxals and plead of various measures to bring naxal in the mainstream of the society. They ignore the fact that naxals are basically criminals and they have huge money power as well as armed power. They use to extort money from all affluent person including police personnel. Businessmen and service men have to give huge amount of money to local naxal people to survive in the area peacefully but it is painful and dangerous that even police person, IAS and IPS OFFICERS have to give money to naxals for their safety.

It is open secret that Illegal and coercive methods are used by naxal elements to collect money from local rich people and there is none to stop them. This is not a new phenomenon but this has been continuing for last three to four decades. Naxals have developed very good relation with top bureaucrats, social activists, politicians, ministers and local powerful persons and slowly growing in numbers. Casual, ineffective and negligent action of ruling government during last three decades has resulted in growth of network of naxals to such an extent that naxals can now dictate terms to elected government by abducting one or two socially respected or powerful persons.

I hope all political parties at state or central level will now learn the lesson from the past and try to treat the criminal as criminals. They should not try to mix the issue of poverty with that of crime .All types of criminals should be punished and punished in a period of fixed time, say three months by local courts, six months by district courts and in one year by High courts. Any political interference in the matter of crime results in boosting up the morals of crime doers.

It is due to incompetent judiciary in our country that criminals use the judicial system to postpone the decision on criminal cases. On the contrary innocents and victims are afraid of knocking the doors of police or the court in want of justice.

It is due to delayed justice that hundreds and thousands of persons are languishing in jail for years and years .It is due to inefficiency of court that 61 alleged culprits had to pass their valuable ten years in jail for visibly no fault as because they were acquitted by Gujrat Special Court in Godhra case on 22nd of February 2011.There may not be anything more painful that innocents are put in jail for several years even without trials and without even charge sheet.

It will not be an exaggeration to say that top ranked officers, ministers, MP and MLAs, heads of various departments are also acting as naxals in their area of operation to exploit their contractors, staff working in various offices and common men .Only difference is that naxals are using armed power to commit their crime and High ranked officers and ministers are using their pen power to accumulate more and more wealth. It is true that bullets fired by naxals are reaching the ears and eyes of lacs of people whereas bullets fired by white collared powerful person through their pen are not visible to common men. Both groups are looting money and exploiting poor and weak people of their area in their own style. Both are brand of extremism and both are committing crime after crime, scam after scam only because they are not afraid of police or court action.

Top ranked officers are whimsically transferred to remote and critical places if they do not do what ministers desire and on the contrary given arbitrary promotion and given cream posting if they do what ministers desire and earns bribe and share with ministers. Similarly junior officers are transferred to critical and remote by top officers and this dirty chain continues till the bottom and ultimately it helps in creating unhealthy corrupt culture. Injustice in recruitment, transfers, posting and promotions breeds frustration and depression and eventually inaction by good officers. Good officers cannot be even whistle blowers against corrupt officers in fear of repercussion, burning, killing in the hands of corrupt but powerful naxals , powerful officers and powerful politicians.

To add fuel to fire, top ranked powerful officers and ministers are now a days earning money even in recruitment. Departmental heads are conducting examinations only for showing to people but actually they are selling the recruitment in the name of reformation and earning huge money by making direct recruitment of their choice. After all there is none to stop such dirty practice prevalent in all government run departments and offices. Hundreds and thousands of cases are pending in various courts of the country for several years and decades against injustice in promotion, recruitment and transfers. Justice is never available to victimized good workers till his life. Talented candidates are rejected in examinations and interviews. Good workers and good students are more often than not, to face frustration in life. And this results in boosting up of morals of bad elements like naxals.

I therefore always say that weak judiciary is the root cause of all maladies prevalent in the country. Both kind of exploitations can be stopped only by efficient police and judicial system.As of l now, there is no justice with good workers in government run offices and hence bad people grow and become more and more powerful .These bad people with the support of bad politicians are tarnishing the image of the country and it is they who real hurdle in real development of the country.

Advocates of Congress Party and CBi

Kapil Sibal , Ms Sonia Gandhi, Mr. Rahul Gandhi, Mr. Digvijay singh, Mr. Chidambram , Mr Pranab Mukherjee, Mr. Manish Tiwari, Mr. Manu Singhwi , Manmohan Singh , the great Prime Minister, the great economist and the great reformer and all VIP leaders of Congress Party were ridiculing CAG report only a few days ago. Loyal advocates named above of Congress Party left no stone unturned to shut the mouth of crying leaders of Opposition parties demanding JPC in 2G scam.
Mr. Kapil Sibal was so much shameless that he even challenged the CAG report and named the report as bullsheet.Top leaders of Congress Party were openly denying the charges and frequently told the media that there was no truth in 2G scam. It is they who spoiled 20 precious days of the Parliament and not members of opposition parties. It is usual practice that thieves after committing robbery willfully cry “thief, thief, thief “ to get rid of police action. Similarly leaders of Congress Party were blaming NDA government for 2G scam and never accepted JPC.

It is only Supreme Court that has made them silent , otherwise they would have never accepted that there was a scam and could have saved Raja and his associates in 2G scam. Congress Party is full of corrupt leaders and hence number of exposures of scam during the tenure of UPA is increasing. Even other partners in UPA are masters in scam.

CBI the main puppet in the hands of ruling party is also taught a lesson by Apex Court. This is why at least some important persons have been arrested. Now it depends on CBI whether they submit charge sheet with full support of oral witnesses and adequate documentary evidences or allows the case to be rejected as other cases elated to VIP and powerful rich persons were rejected in the past.

Leaders of Congress Party named above should now at least cover their faces and go deep into hibernation.
They do not have now any moral right to preach sermons to public, to innocent voters and to world community.

Entire world has seen and witnessed the exposure of one after other scam. FIIs will no doubt fly away from Indian market slowly if the growth of Corruption is not stopped by any revolutionary leader. People are now very angry and they will dethrone Congress leaders if they do not mend their behavior and stop malpractices completely. Till now, none of action of Congress party leaders is able to demonstrate that they are working seriously and honestly to stop malpractices.

Black Money

Politicians often talk of black money parked in Swiss Banks but always fail in their exercise to bring back the same in our country because they are not honest in their utterings.They made unprecedented hue and cry before last general election on huge amount of black money parked in Swiss Banks but politicians of all parties became almost silent after the declaration of election result. What they say and what they mean to do is always different. India is still rated rate as one of the top corrupt nations. It is worthwhile to mention here that India is rated as one of the top ranking hunger inflicted state of the world even though Indian leaders claim and feel proud of achieving comparable GDP growth in the economy and said to be decoupled with global recession or global financial meltdown.

Madhu Koda ex-CM of Jharkhand and his associates could accumulate hundreds of crores of rupees through corrupt means because he knew the power game and corrupt game being played in the country in all the states. Koda is bird of the same feather and he is not new or his case is not an isolated case of corruption in India. Latest story on extent of corruption in CWG is well heard and read by Indians. In fact there is no dearth of cases of large scale corruption, fraud, scam and cheating in our country.

Rulers, leaders ,politicians, CEO or head of any organization first pull together all his flatters on whom he can blindly rely and throw away all honest persons who can put hindrance in their task of earning or printing money. In this way evil work of the ruler does not come to fore as long as one of the corrupt officers raise ugly voice against the system not because of his sudden thirst for patriotism but due to his puncture the effort of other corrupt person who has been enjoying larger share of ill earned wealth.

As a matter of fact rulers of this country could not stop corrupt practices in the system prevalent in our own country and could not stop formation of black money within the country and hence they could not and cannot force foreign country to declare name of Indians who have parked money in Swiss bank. Similarly when investing agencies like CBI, ED, Vigilance, IT officials and other regulating agencies are themselves corrupt they cannot stop spreading cancer of corruption in the Indian body system. And the most vital point is that when rulers themselves are corrupt they cannot endanger their own money parked in either Swiss Bank or in Indian financial and real estate sector.

It is rightly said by the great writer Munsi Prem Chand.
"Jab Rakchak hi Bhakchak Ban jaye to vinash nishchit Hai"

When almost every minister at Center and almost every minister in each State government is indulged in making money through corrupt means, when officers in general are involved in corrupt game played by politicians and when all officers entrusted with the duty of stopping and removing corruption from the system and finally unearthing ill earned money are busy in making money through corrupt means who will make serious efforts to unearth money held in Swiss Bank.

Persons or group of person who have kept their black money in Swiss Bank are none other than politicians and government officers. When top officers and top ministers are corrupt one cannot imagine of businessmen and professionals abiding by Indian rules and following rule of ethics. It is government officers and politicians who make survival of honest service men, honest businessmen and professionals difficult and force them to manufacture black money and share with corrupt officials to live peacefully. Honesty has rather become curse for government servants as well as businessmen and professionals.

Black money is not only in Swiss bank, it is parked in banks in India too. Black money is concealed in form of gold, land and building, apartment, big bazaars, farm houses, private professional colleges and in almost all big houses. Black money is visible to all whose eye is not jaundiced with the decease of black money. Nine out of ten multi storied residential building and commercial complex in Metros and big towns are constructed by ill earned black money only. It is open secret. As such it is not necessary to focus attention on money parked in Swiss Bank and make politics out of it but is more important to focus on black money parked in India and which is visible in India itself.

It is necessary for almost all politician and officers working in government and government departments to introspect and look into their heart whether they are really honest. Politicians in general cannot afford contesting and winning an election without the help of black money received from businessmen and at the same time without the indirect support of controlling officials none of the businessmen can imagine of tax evasion.

Without the support of corrupt officers, none of the contractors in India can carry out their tendered allotted work. More than fifty percent of value of contract work allotted by government to contractors is consumed in distributing commissions to corrupt officers and politicians. Ministers cannot even organize a rally without the financial support from local corrupt officers, black money of rich businessmen and professional.

I therefore feel that work of purification should start from our own land, our own offices, our own banks, our own politics, and our own administrative system. Politicians should stop playing foul game of putting blame always on foreign agencies for every lapse on their part if they are really interested to see India shining.

India must stop flattery culture because this flattery culture is the root cause of all evils. None of government servants can dream of good posting and timely promotion without indulging in flattery to big bosses and powerful politicians. It is therefore necessary to make transfer, posting and promotion fully transparent and remove all bottlenecks which gives scope of whimsical decision in the matter of posting and promotions. It is the need of the hour to punish those who are misusing their delegated powers and who promote flattery culture by taking arbitrary decisions.

CBI, Vigilance department, Band, IT department, IB ,Anti corruption offices ,custom officials all such regulating agencies which are established for prevention and elimination of corrupt practices should be made more powerful and given sufficient man power to carry out their holy job. Any officers found indulging in corrupt practice in such department should be punished severely without any discrimination based on caste, community or religion.

Political interference in administrative matters, police action and judiciary must be stopped even if for this matter rules of the land are needed to be altered, made more severe and non-discriminatory. Delegation of power in few hands at any levels and in any offices gives scope for corruption and hence the power must be diluted to the possible extent in such a way that it does not cause delay in execution of plan and projects. Officers who misuse power must be punished immediately.

And last but not the least, MLA and MP who rule the country should not be elected by votes of illiterate and criminals but selected from top IAS and IPS officers, toppers of colleges, reputed social reformers, successful bankers, reputed honest businessmen and from persons of undisputed character. System of garlanding and gifting top officials and political leaders as also that of giving red carpet welcome to top officers must be stopped immediately. Practice of spending crores of rupees in inaugural functions or in felicitating top officials or ministers must be stopped forthwith through an ordinance at least for one year to start with.

Judiciary should be provided adequate quality man power so that pendency in court is made zero and justice is made available in shortest span of time to all aggrieved Indian citizen. An environment has to be created in the country where criminals of all nature have fear of action in their mind and in their core of heart.

It is tragedy that in our country police actions in our country is against good citizens and punitive action through court orders is also possible against good citizens. Actual crime doers use judiciary to perpetuate their reign of crime .If this fear of action is ensured at all levels I am very much sure that black money from Swiss Bank or Indian Banks will automatically come on the floor and people will be motivated to use the money for constructive purposed rather than parking in foreign or Indian bank.

Honesty is the best policy has to be proved at ground level. Merit and merit has to be respected in our country if we Indians really want India to grow at grass root level.
GDP growth shown by ministers to International agencies is not at all helpful and pleasant for majority of Indians who are unable to even afford their normal livelihood and manage respectful life.

It is worthwhile to mention here US President Mr. Obama has taken many steps to reform US banking culture taking lessons from 2008 financial crisis. On the contrary our government is still unaware of growing sickness in Indian banks only because we Indian know how to play with data, sink and swim in the sea of data.

Even USA, pioneer of reformation, liberalization, privatization and globalization has started revisiting and cutting short the policy of outsourcing, policy of concentration of power in few hands, policy of complete freedom to trade icons and policy of complete freedom to banking industry so that more and more employment opportunities are generated for US citizens, expenses on executives is cut to size, and corrupt practices in US system is put an end for good and forever.

Why not Indian politicians learn lesson from their masters at least and ensure transparency in all their action and why do they not discard vote bank politics based on caste, community, religion and region is a big question to answer and a big challenge for those whose vision is to see India really shining in the world.

IBA has misused to recover illegal money from PF optees in banks to pay pension to retirees.

Subject: Illegal recovery from PF optees in PSU Banks
And
Misuse of usual delay in judicial process

I would like to draw your kind intervention in the matter of second offer of pension being given to bank employees who did not accept pension offer in 1993/95 when pension scheme was first introduced in banks in lieu of contributory provident fund.

After prolonged movement by bank employees for almost 15 years and after 30 months agitational programme, Indian banks Association (IBA) signed an agreement with United Forum of Bank Employees (UFBU) on 27th of April. Till 25th of April 2010 there was never a talk among leaders during last 15 years that there will be recovery from PF optees from their arrear if they are given second option for pension. But in the eleventh hour, union leaders who are mostly retired employees were ill motivated by IBA and it is they played a mischievous role to introduce a discriminatory clause in the agreement which enables banks to recover 2.8 times of revised salary of November 2007 from such employees who opts for pension.

Obviously those who opted for pension in 1993/95 got free option for pension whereas those who will opt for the same benefit after 15 years prolonged movement will have to purchase the same by paying Rs.50000 to more than one lac rupees. This discrimination is clearly in violation of spirit of Equality of Law granted under Indian Constitution.

Since the agreement was signed by a few say 20 union leaders on behalf of eight lac bank employees IBA got an upper hand in executing even legally invalid clause. In such position bank employees all over the country started condemning the said bipartite settlement, formed fresh unions and finally filed writs in various high courts.

On 24th June 2010 Madras High Court granted interim stay on recovery from PF optees.

But IBA and bank management in nexus with mischievous union leaders filed another writ in the same court for vacation on stay on the false but emotional plea that retired employees are on the verge of death and banks are unable to start pension payment to them because they have no fund and they not got refund from retired employees.

Court due to its busy schedule heard the petition on 10th of August 2010, considered the pain of retired employees and vacated the stay.

IBA and union leaders in particular and people of India understand it very well that once the court case is filed in any Indian court, it will take a decade or two decade in getting final judgment on any issue. In such situation banks can execute the disputed agreement.

It is open secret now that banks will not only spend lavishly on advocate to prolong the hearing , torture the fighting employees and but also try its best to weaken the fighting intensity of employees who have moved courts in the large interest of three lac retired and three lac serving employees.

Obviously bank employees for none of their fault will have to pay Rs.50000/ to more than one lac to purchase pension offer which is absolutely illegal and not reasonable from any angle of consideration. Such discriminatory recovery never occurred in any department in our country. This historic blunder is going to be committed by bank management and bank employees will become victim of faulty judicial process as everyone knows that it takes High courts and Supreme Court two to three decades in deciding any case.

I therefore make an earnest appeal to you to advise finance ministry, banking division, law ministry and IBA to bring about necessary change in the agreement or else government of India should promulgate an ordinance and make bank employees at par with Central government employees and nullify the said discriminatory agreement. In the recent past when dispute arose between IRDA and SEBI government of India with the help of ordinance nullified the effect of court case filed by IRDA against SEBI.

Alternately you can ensure expeditious judicial process by appointing special bench in Supreme Court combining writs filed at various High courts to decide the issues of writ in fixed time frame of 30 days. .

It is the most disheartening and sad story of Indian judicial system that courts are used in general and in practice not to get justice but to perpetuate reign of injustice. Courts seldom award punishment to guilty person in time but spend so much time in the process of judgment that the victim is either extinguished or the very purpose of filing a case is defeated or loses physical, mental and financial energy to such a pitiable extent that the case filed for justice is ultimately left unattended and become useless and endless. Even the veteran criminals get relief once the police files case in any court. It is very easy to prolong the judicial process as per whims and fancies of the criminal and at least till all witnesses or all plaintiffs are finished or become ineffective.

For your ready reference and to enlighten you more on the subject I submit hereunder some important points related to pension rules and subsequent agreement prevalent in banks.

1. In the Pension Regulations 1993/1995 there is no provision for collecting money from employees to make up the short-fall in pension fund. If at all any short fall is faced it should be made good by the banks themselves. Then on what basis banks are now asking employees to contribute for short fall?

2. In 7th, 8th, 9th bi-partite settlements 8.25%, 9.25%, 13% of additional cost of pension was carved out of wage load and given to banks to make-up the shortfall in pension fund. This amount belongs to both Pension Optees and PF optees, but used for paying pension to Pension Optees only. Therefore is there any logic in asking funds now from PF optees only?

3. In the Pension Regulation 1993/1995 there was a clause stating that pension will not be paid to those employees who participates in any strike. In 1999, this clause has been removed, but no fresh option is given to PF optees to join pension scheme then. Why?

4. In Railways and RBI fresh options were given to employees to join Pension Scheme several times without asking single paisa. Then why in Banks, Employees are asked to contribute towards Pension Fund?

5. If all the employees would have opted for Pension in 1996/1995 itself, how banks would have managed Pension Fund?

6. In State Bank of India three retirement benefits are being given to employees. viz. PF+Pension+Gratuity. In Public Sector Banks only two benefits are available. Even for that second benefit Employees have to pay in every wage revision settlement. Does it mean Bank Employees are not given two retirement benefit, but they are given only 1.5 benefits i.e., half of what SBI employees are getting?

7. When SBI associate banks are merged with SBI, Govt. is ready to extend Pension Benefit to those Employees of associate banks without asking anything from employees. Where from money comes to meet this additional expenditure?

8. Banks are ready to incur expenditure to the extent of 14% (10% of B.P. +D.A) towards PF for new recruits from 01.04.2010, but not ready to pay more than 10% for PF optees. Why?

9. Pension Regulation 1993/1995 provides for paying pension only on superannuation, i.e. after 60years of age only, but at the time of VRS2000 it is modified /amended to give pension to even employee of 40years. Because of this act of Banks only, Pension fund dried up. Is it not true?

10. Hence, we PF optees feel principle of natural Justice is denied to us and it is clear cut violation of fundamental Law of Equality before justice granted by Constitution of India to each citizen of India.

I am fully confident you will take all possible steps to give justice to six lac bank employees who have been badly affected by said agreement. It is worthwhile to mention here that bank management has already recovered Rs.1800 crores from serving employees who will be given second offer for pension as per said Agreement. Not only this , even trade unions participating in the said agreement has realized more than two hundred crores from bank employees as Levy or their remuneration or fee for negotiating with IBA and for signing on the said agreement.

Injustice with bank employees

I submit some points hereunder highlighting reign of injustice in banks perpetuated by team of officers sitting at the helm of affairs in collusion wit union leaders.

There is practically no stagnation for central government employees as per last pay commission recommendation and as accepted by government of India.

Why is there stagnation for bank employees particularly when bank is not in a position to accommodate so many candidates in higher scale, when there are fewer vacancies?

For none of fault of senior officers, they are denied promotion as also annual increment. It is really a fun that they are not given even full terminal benefits when they resign at their own.

When banks do not find such senior officers for promotions, bank should not hesitate in accepting resignation of such officers and allow full pension and retirement benefits. Why officers who resign are not allowed pension, leave encashment or refund of accumulated bank's contribution in PF etc. Bank can remove an officer as per its choice but staff cannot leave the job without loosing his rightful terminal benefits.

Officers who have transferred from outside states to North East States were getting so many incentives as per 1984 circular or as per guidelines of IBA as prevalent for central government employees working in other sectors in eighties. Why these incentives have not been revised during last 25 years?

Special allowance fixed Rs.1200/ or Rs.1500/ for specified area is common for all staff posted in North East region. What about additional benefits for those who are transferred from other states to North East?

For outsiders, there was a provision of Rs.1500. p.m. in 1984 when Rs.1500/ was a significant amount compared to prevailing scale of pay for officers at that time. Now even that Rs.1500/ (it should be at least 10000 in view of price rise and scale rise during last 25 years) or 12.5% of pay has been abolished.

Originally North East posting policy was framed for enthusing employees to serve in north eastern based branches for two years and then they were given preferred posting. Unfortunately this holy policy is now misused by greedy and corrupt executives to sideline good officers from their path of earning illegal money and golden gifts.

Incentives of NE posting have also been snatched and left on whims and fancies of executives. Preferred posting after completion of two years tenure also lies on the mercy of top officials. ED or top executives in banks do not have fear in mind in violating the existing policy or misusing the same in the name of bank’s exigencies.

After all what union leaders are doing?

There are lacs of bank employees who are continuously working in rural areas, say for one or two decades or even more.

On the other hand there a few lacs of bank employees who are continuously posted in Metros and Urban areas.

Unfortunately residual a few of employees are facing frequent transfers from one corner to the other corner of the country.

It clears defeats the very purpose behind rural posting policy and NE posting policy framed by government of India. Banks do not hesitate in violating its own transfer policy or promotion policy. Officers posted continuously in rural areas seldom get promotion because their fate depends not on performance but on whims and fancies of Interview panel. Members of Interview in general award marks based on merit of employees on points such as flattery, gifts and welcome kits. Justice is nowhere visible.

After all what union leaders are doing?

Answer is that they are also standing in the same que in which a team of flatterers are standing to get maximum benefit from higher bosses, cream posting, reckless earning through credit lending or waiver of loan without any fear of action from higher bosses and get preferred promotions for their flatterer members if they so like.

Why huge arrear to the amount of two lacs or three or four lacs are being paid to executives as per 9th Bipartite Settlement and only a few thousand to middle management officers considered senior officers. Even peons and junior clerks are getting arrear to the extent of one lac rupees. Even junior officers are getting more. Obviously pay scale fixed for various scales is not based on principals of equality but based on whims and fancies of IBA team and union leaders. Pension optees are getting more and PF optees are getting noting in comparison. Why discriminatory treatment is being allowed by union leaders even in fixation of revised pay in 9th BS, not to speak of discrimination with PF optees desiring to offer for pension.

Are senior officers in middle management so bad they are not fit for promotion, increment, pension and even equal rise in wage revision? If so why are they not given offer of VRS as given in the year 2000?

Why CMDs of various banks then talk of crisis of talented officer in bank and why do they express apprehension for painful future when a good number of officers will retire?

If there is a will there is a way. When government is formed of corrupt persons and that of flatterers, when administration is manned by corrupt and flatterers when judiciary is weak, ineffective, costly and centre of corruption, any one in Government cannot dream of taking step to reduce corruption in the system or to punish corrupt people.

And people who try to move against the main stream gets tired very soon and finally succumb to death.

It is therefore better to say All is Well sir, No problem sir, everything will be o.k. sir, I am there don't worry, I will manage it, I will manage media people, I will manage CBI people and so on. These wordings are a few permanent wording of flatterers.

Media men are not getting any interest or attractive news in the reign of injustice pervading and prevailing in banking industry. A few executives by using their mobile phones using some flatterer Branch Managers ges success in extending credit to unscrupulous borrowers and sacrificing huge amount in compromise and waiver of loan scheme just to earn some illegal money.

Banks assets worth thousands and thousand of crores of rupees are locked and lost in bad borrowers every year whereas government of India, RBI and all regulating agencies remain silent spectators. People have seen how NPA rose 500% this year in Indian Bank but regulating agencies are not ready to accept that similar pain will occur to other banks too in near future. There is in fact none to bell the cat.
Banks management, government of India and RBI loudly say with a sense of pride that Indian Banks are not affected by global slowdown or recession or sub prime crisis but IBA says that banks are not in a position to pay pension to bank employees and hence begging for sharing of pension cost from bank employees.

IBA has filed affidavit in Madras High Court that banks are facing fund crisis and not in a position to pay pension to retirees and hence praying for stay granted by the same court on 24th June 2010 on illegal and unjustified recovery from PF optees agreed in 9th Bipartite settlement .

How much shameful and painful it is that staff of banks who served banks for 30 to 35 years in bank and contributed his entire energy for growth of bank has now to run from pillar to post or knock the door of courts to stop reign of injustice.

Are Banks earning profits by simple exploitation of staff??

I want to know Facts of Pension Fund of Banks

Justice in fact already miscarried on Historic Day for bankers i.e. 27th April 2010, now actually passing through washing operation in hope of getting justice.

Banks already deducted at source not only TDS on entire arrear (including the amount which is deposited in pension fund), it already recovered 2.8 times from PF optees but it willfully ignored offering pension letter in fear of Writ filed at Madras High Court.

It appears to IBA as if Madras High court had stayed pension offer and allowed recovery from PF optees. Please verify from contents of court order. Please re look into wording of order given by learned Judge whether stay was on pension or on recovery.

Pension is social security, Mr. Ashok Goel rightly admits it and he has true apprehension in his mind that Banks may not offer pension option if recovery is stopped by learned court. He along with Sri Pradip Kumar learned advocate of Supreme Court is truly and rightly worried of pain of PF optees retiring in coming days if they are not given second option of pension.

Sir I like to add one line here that heaven is not going to fall even if pension offer is not given, PF optees will survive with his head high and with dignity. God will give them adequate food at least better than our Union leaders who signed the said “Historic Agreement” because their own conscience will curse them.

Banks are giving pension out of fund created by PF contribution (Bank’s portion) refunded to them. Has any bank spent any amount from expenditure account in the past as central government use to do for their employees every year?

I raise some questions and hope anyone who knows about the same will reveal the clear picture.

What is total accumulated fund in pension account?

What amount is deposited every month by bank in pension fund on behalf of pension optees?

Or whether it may be confirmed that banks are actually crediting bank’s contributory share in pension fund for each pension opees each month (as in the case of PF opees )? I doubt banks are doing so.

What amount is actually paid by a bank every year to it’s retire employees? And what amount is refunded to retirees every month on an average?

Can anyone mathematically assess the clear picture of anyone bank to ascertain and forcefully confirm that in future banks will face crisis if fresh recovery is not made from PF optees?

Had our learned leaders not agreed for sharing in 7th and 8th Bipartite, bank employees could get higher salary and higher PF contribution. In fact , it appears to me that IBA reduced wage hike during 7th and 8th Bipartite Settlement but did not make actual credit in pension fund what they saved on account of lesser wage hike.

Can anyone confirm that banks are maintaining two separate funds, one for PF optees and another for pension optees? If not, how IBA or UFBU came to conclusion that banks will face crisis of fund if they agreed for second option of pension?

And if there are two separate funds in each bank, can anyone say what is the real balance accumulated in pension fund , what they are likely to get from PF fund if they offer pension offer and what monthly accretion will happen in pension fund keeping in view bank’s contribution of 10% and monthly interest?

Whether pension fund is prudently and wisely managed to earn profit or used as a tool to inflate bank’s operational profit or deposit?

Whether it is not true that banks are parking PF/Pension fund in fixed deposit and earning less interest compared to what they use to pay to employees?

Can anyone confirm that there are no avoidable expenditure from such funds?

Whether Banks are using profitably the amount which is accumulated out of employee’s share in PF of 10% and withheld with bank with PF Trustees? This fund is in hundreds of crores of rupees with each bank and banks need to invest the fund to earn maximum profit and give dividend to employees and not simply park them idly.

Above mentioned questions will help in knowing the probable burden to each bank if all PF optees switch over to pension. These facts are necessary because an employee suffers and lives in crisis for 30 to 40 years when he serves the bank only to make his residual life of hardly 10 years painless and pain free.

As an individual everyone who is afraid of not getting pension offer should ponder over following questions

1. How much amount he is going to sacrifice (Bank’s contribution in PF) on his date of retirement keeping in view fresh addition and interest accrual. (In other words when will he retire and by that time what will be the expected growth and what will be the final accumulated amount when he or she retires.)
2. How many years he or she will then survive, a rough estimate
3. Whether the amount he will get (if he does not get pension offer) will not be adequate to give him pension at Bank's rate of pension till he survives or his family survives to get pension offer. Please be practical
4. Finally say whether banks will gain or you will gain.
5. How much banks are expected to gain if we take into consideration the average age of bank employees, especially bank officers.

Now say whether mountain is going to fall if pension offer is denied to PF optees.
Yes mountain may fall on family if one dies during the serving period or you say in case of premature death. Out of three lac PF optees in bank for whom entire dispute has come on the floor in banking industry, there will be hardly a few thousand cases of premature death and in whose cases banks will have to pay pension for a longer period though with lesser amount of pension. For this one or two thousand of death cases banks is worried so much they are bent upon giving worries to entire banking community. I think Insurance companies in such cases may give better return if the same amount (which is deposited by banks in PF fund every month) is given to them.

Now everyone will perhaps agree to protest disputed recovery from PF optees and prefer justice instead of blindly purchasing pension offer in the name of social justice.

IBA and UFBU are jointly trying to impose injustice in the name of social justice.

How many Banks have obeyed the stay order of Madras High Court and not recovered 2.8 times of November 2007 salary from PF optees?

How many banks have not yet started paying arrears as per 9th BPS.?

How many banks have issued pension offer till date and if not why have they recovered from PF optees? Already three months are likely to complete after the date of settlement. Why bank is so slow on the issue of pension offer and so fast on the matter of recovery and similarly why union leaders are so anxious on recovery of levy of Rs.3000/ from their members and not worried for delay in offer of pension? Union leaders are getting farewell gift of five lacs or ten lacs on their retirement from Union Fund. Is this the way to use hard earned contribution made to Unions and Associations by poorly paid bank employees?

Days are not far when union leaders will distribute accumulated union levy amounting to hundreds of crores of rupees among themselves and ask for separate fee if they fight for any aggrieved employee. Are union leaders not more dangerous than our management bosses? I say this because union leaders have threatened to expel officer from their association if they do not pay union levy of Rs.3000/ on account of so called successful historic agreement. Management never dared to issue dismissal threatening to officer employee if they fail to obey any instruction of boss.

Why are employees keeping mum on illegitimate recovery and bent upon getting arrear at the earliest even if it is discriminatory? Why are they afraid of even lodging their protest before accepting arrear payment?

Bank management has signed a historic victory agreement when they have vertically divided the employees in two segments and created an unbridgeable split in banking unity and created dilution in their intensity to fight against the reign of injustice perpetuated by management.

And Bank union leaders on the contrary has committed a historic blunder by signing a discriminatory and divisive agreement on 27.04.2010 for some or the other vested interest and clearly betrayed the cause of unity for which they used to struggle under the banner of communist parties.

At least pension optees are now in support of the agreement. It hardly matters to most of them how loudly PF optees cries and weeps though in the past they all always used to be on the same platform and UFBU was also formed for the same purpose. Banking unity was an example in the community of labour class or working class.

Banks are not in the grip of flatterers. Those who are yes-men are getting timely promotion and getting best posting and in this way a team of flatterers are generated by bank management who blindly support of all action of the management right or wrong. Even union leaders do not fight against such lollipop like promotions and transfers because they say that ultimately their members are getting promotions and cream posting or choice posting though the same may be at the cost of others genuine right. At least veteran union leaders are enjoying posting in Metros and capital towns, they need not perform bank’s job, they may do their side business, they may take share from dirty dealings in credit decision or contract offers corruption and they may get sweet request from corrupt officers for reduction of punishment and so on. Lastly they may get huge gifts from top branch managers, big bribe earners, big customers and last but not the least huge money from union fund on their retirement and on attending an inquiry from Union Fund. Similarly union leaders now plead that the said agreement is good in the light of social security though they know and understand from the core of their heart that recovery from PF optees is not justified from any angle of consideration.

This is called divide and rule policy. Intelligent, talented, experienced, valued and visionary leaders of bank management who occupy the important seats of core committee of IBM as also that of United Forum of Bank Unions are very well aware and they all realize from the core of their heart that injustice has occurred with PF optees, retirees and those who have resigned. They all know very well that courts cannot deliver justice in decades and decades and this is why they are least bothered of courts also. They have gained sufficient experience by giving undue promotions to even charge sheeted officers and by rejecting even good officers. In every circular enlisting name of officers getting promotion they used to mention “subject to court decisions on various writs going on in various courts”

In the same way IBA is bent upon making recovery from PF optees subject to court decisions. But at the same time God knows whether they will issue pension offer or not. Reason for not issuing pension offer, bank will say they are waiting decision from courts. It is not surprising at least for me that even so called union leaders are also keeping mum on this matter for which they feel proud and say that the agreement is historic.

Government of India does not listen without Strike, Bharat Bund or violent agitation programmes disturbing public. Government does not understand the language of peaceful protest or peaceful movement, or letters to Prime Minister or Finance Minister or even President of India. Ministers are awakened from their deep slumber only by agitations, arsoning, loot, strike, violant agitation, burning of shops ad buses, stopping of train services etc.....There are hardly a few hundred internet viewers out of ten lac bank employees who are aware of what is happening in various courts. Even IBA is least bothered of interim stay granted by Madras High Court.

Bank employees who struggled for 30 months to get second option for pension and for their wage revision are subjected to huge loss by ill-motivated trade union leaders and visionless officials of IBA team who participated in 30 month long process of negotiation.

This agreement has almost cheated PF optees on the plea of second option of Pension and IBA is almost ready to go against the MOU signed months ago. They are obviously bent upon putting into action the discriminatory, unjustified and divisive clause of Bipartite Settlement against the interest of three lacs employees called PF optees . Their main motto is to divide the United Forum of Union of Bank employees and dilute the intensity of bank unions and militancy of bank employees.

Some of the Bank unions filed a writ in Madras High court and also in various other high courts. Madras High court granted stay on execution of recovery clause no. 32 of the said Bipartite Settlement which was signed at Industry level on 27th April 2010 by Indian Bank’s Association and United Forum of Bank Unions.

But Banks are bent upon making a recovery of 2.8 times of November 2007 salary from those employees who will get second offer of pension (not yet served by any bank) after 15 year long struggle. In defiance of stay granted by Madras High Court.

Banks have not released arrear and not submitted second option of pension to all employees as per spirit of the said agreement. On the contrary banks without any fear of court are going against the spirit of stay order of Madras High Court and making forceful recovery from three lacs employees.

Are they not committing contempt of court?

Media is silent and least bothered of fate of three lac employees.

Opposition parties, ruling party all are silent.

Why?

"Asli Chehra" - TRUE FACE OF BANK UNIONS
Immediately after the settlement, most of the unions patted their back for the so called "historic settlement". Slowly as they started facing volley of questions from the members, they came out with various theories to justify their action, which included the so called legal opinion and IBA's stiff attitude which forced them to agree to recovery from only PF optees to the tune of 2.8 times of the November 2007 pay. An impression was being created by them as if they were not in favour the same till 26th April, 2010, but somehow they were cornered so much that they had to agree to the terms set by IBA. If that would have been the case, then they would not now oppose the petition pending in Madras High Court. That shows the double standards.
But soon the bankers will be able to see the "Asli Chehra" (i.e. True Face) of these union leaders. These union leaders will now not be able to beat around the bush and befool the members by shedding crocodile tears. They have to take a stand in the Madras High Court, as to whether they are in favour of payment by all employees / officers @ 1.6 times or they favour 2.8 times only from PF optees. Some of these unions have already been exposed. Let us see what does the market reports say as at the end of June, 2010.
It is reported that during the course of hearing of the case at Madras High Court, while opposing the interim stay granted by Madras High Court, advocates of IBA, and AIBEA and NCBE, requested for vacation of the stay. AIBEA and NCBE were represented by one of the top most firm namely M/s Aiyar & Dolia and wanted vacation of the interim stay on recovery of 2.8 times only from PF optees to be vacated. So the stands of these two unions are very clear now. They will be using the members’ funds (including PF optees) for payment to the law firms and fighting case against them. However, the Hon’ble Judge advised them to file their counter affidavits and Ordered continuation of the Stay Order. Next hearing has been fixed for 6th July 2010.
Vide circular No. 98 dated 29th June, 2010. AIBOC has declared "We are in constant touch with the IBA and the Convenor of UFBU, to initiate appropriate steps to vacate the stay, at the earliest, to enable IBA to issue necessary instructions to member Banks on the Pension offer". Thus, AIBOC is also likely to oppose the move and appears to be in favour of payment by only PF optees".
(Remember, the stay is not against the Pension offer or issuing circular by IBA, it is only against immediate recovery of 2.8 times of pay of November, 2007 from PF optees. )
The stand of other unions will also be clear within a week, as court in its orders says ""Notice to respondents returnable by 06.07.2010. There shall be an interim order of stay". (all major unions are respondents in this case). The reports indicate that NOBW may support the petition filed by Canara Bank Workers Unions. Similarly, BEFI may not oppose the petition of Canara Bank Workers union. The protest by INBEF has already been incorporated in the affidavit filed in the Court.
If the above reports are true, then 29th June 2010 would be regarded as a sad day in the history of trade union movement of Banking Industry. Souls of great leaders like Parawana Ji would be feeling really sad and dejected.
Till now they have been propagating that they have been forced by the circumstances and situation to accept contributory pension scheme in banking industry. They are giving so many logics and have been pleading as to why they could not make IBA agree to the Pension Scheme in its original form of 1993. We are unable to find any logical reason from Unions wherein it joined hands with the union of the Management i.e. IBA to defeat the efforts of bank employees.
Duniya ke Mazdooron ek ho - Duniya ke mehanatkashon ek ho ka naara laagene waale aaj majdooron ke khilaf hi Court main jaa pahunche.
TESTING TIME IS NOT FAR WAY NOW. NOW THESE UNION LEADERS WILL NOT BE ABLE TO SAY THAT IBA DID NOT LET THEM SUFFICIENT TIME AND CORNERED THEM SO SUCH THAT THEY SIGNED THE SETTLEMENT ON 27TH APRIL, 2010. THEY HAVE SUFFICIENT TIME OF OVER A WEEK TO DECIDE WHETHER THEY WANT TO PROTECT THE INTERESTS OF PF OPTEES OR WANT TO DO WHAT IBA IS SAYING.
It has also been reported that some Banks have issued strict instructions for payment of arrears to all the employees / officers by 30th June, 2010 or so, after keeping 2.8 times of the pay of November, 2007 in suspense account. This clearly gives an indication that banks are in a hurry to pay arrears so that they can deduct 2.8 times from the arrears of PF optees before orders of Madras High Court are delivered to them through IBA. In court they will take the plea that notice of stay was not received by them and arrears have already been paid. As Canara Bank has also rushed to pay the arrears today after keeping the 2.8 recovery in suspense, Canara Bank Workers Union is likely to give a strong protest letter on 1st July, 2010 at their Head Office. Canara Bank Workers Union has informed that they are proceeding to Bangalore to personally handover the letter along with a copy of the court order and get the acknowledgement.
Now all the bankers have to take a final call as to whether these union leaders are with the workers or are working against them. We know it is a difficult task as they have to eat their own words. They have issued number of circulars justifying as to why and how they were cornered to agree this changed stand on the night of 26th and 27th April, 2010. However, this is the time when they can correct the mistakes as PF optees have shared the burden of pension even in the last two Bipartite settlements (7th and 8th). This information is now shared by almost everybody (which was not known earlier to 99% of the PF optees).
The unions opposing the petition will be spending lacs of rupees in the legal battle. All this money can be saved if they simple say that we do not oppose the petition and are in favour of the same.
LET PF OPTEES DECLARE THAT THEY WILL QUITE THEIR UNION (WHICHEVER IT MAY BE) IF THEIR UNION OPPOSES THE PETITION FILED BY CANARA BANK WORKERS UNION AT MADRAS HIGH COURT. LET COURT DECIDE THE CASE ON MERITS.

UPDATE ON THE ORDERS ISSUED BY VARIOUS HIGH COURTS AGAINST RECOVERY OF 2.8 TIMES OF NOVEMBER 2007 PAY
In order to ventilate the grievances of the employees, Writ Petitions have been filed in various Hon’ble High Courts.
(A)The First Writ Petition was filed before the Hon’ble Andhra High Court bearing number Writ Petition No. 8237 of 2010 where in Hon’ble Court has passed following orders:
“ORDER: Interim order dated 13-04-2010, to continue, subject to final orders to be passed in this WPMP. Any settlement also, shall be subject to final orders in this WPMP.
Post after Summer Vacation, 2010.”
(B) Writ Petition No. (C) No.3729/2010 has been filed before Hon’ble Delhi High Court, where Hon’ble Court has passed following Orders on 28.05.2010:
“Issue notice to the respondents to show cause as to why rule nisi
be not issued, returnable on 30.07.2010. Necessary steps be taken within seven
days.”
(C) Subsequently, Division Bench of Hon’ble Allahabad High Court while disposing Special Appeal No. 947 of 2010 passed following orders Orders:
“Issue notice.
Respondents are allowed three weeks time to file counter
Affidavit.
List thereafter”

(D) And now recently a Writ Petition bearing no. WP 12269/2010 has been filed before Hon’ble High Court of Judicature at Madras, in the matter of Clause No. 32 of the industry level Wage Revision Settlement dated 27.04.2010 and also clause (1) of the Pension Settlement of even date, seeking a direction from the Hon’ble Court to quash the above clauses only in so far as the said clauses require the provident fund optees now in service to contribute 2.8 times of the Nov 2007 revised pay, if they want to opt for the pension scheme.
Hon’ble Justice K Venkataraman, who heard the matter has ordered an interim stay and the next date of hearing, has been fixed on 06 July 2010. A copy of this order is enclosed.
From what is stated here in above, it is evidently clear that Clause 32 of Settlement dated 27.04.2010 and Clause (1) of Pension Settlement dated 27.04.2010 has become subject matter of judicial scrutiny by the Hon’ble Courts and Hon’ble Madras High Court has passed orders to stay the operation of these clauses.

Ray of justice for bank employees

It is a matter of great pleasure that Madras High court has granted interim stay on the clause authorizing banks to deduct 2.8 times of November revised salary from the arrear of PF optees who are likely to opt for second option of Pension, an opportunity granted under 9th Bipartite Settlement signed between IBA and leaders of unions of various banks. I congratulate officers of Canara Bank unit who initiated the legal battle against discriminatory settlement signed by union leaders in banks and I take this opportunity to condemn IBA team under the leadership of Mr. M V Nair who left no stone unturned to divide the officer’s fraternity by introducing various discriminatory and unconstitutional clauses in the said settlement.

It is open secret that bank management is made of flatterers and yes-men who are least bothered of ethics or constitutional values or even the quality of assets of banks. They are least bothered of genuine grievance of loyal and devoted workers who think, act and even dream for the benefit of banks they are associated with. It is banks where even posting and promotions are effected not based on merit but on the strength of an officer in yesmanism and his ability to flatter his bosses and capability in earning illegal money and sharing with the same with the bosses.

In such position officers annoyed with discriminatory elements of the said settlement have got a great relief after the stay granted by Madras High Court .I hope even now our Finance Minister and Prime Minister will understand the facts related to agreement mentioned above and perpetual reign of injustice prevailing in banking industry particularly PSU banks. I hope Government of India will act against dirty elements in Banking industry and especially in IBA and get rid of them before it is too late.

I would like to add here that if justice is not delayed in courts and good advocates become available at reasonable cost in all towns and cities I think thousands of cases will be filed against reign of injustice perpetuated by bank management.

I am ready to extend my whole hearted support to all those who have initiated legal battle against the bank and who have contributed directly or indirectly in the fight to get justice. I pray judges to quicken the process at their best so that bank management may not take advantage of judicial delay in carrying out their whimsical decisions based on vested self interest.

If finally high court scraps the clause of discriminatory recovery from PF optees the signatories of the said settlement should own responsibility and resign on moral ground. When a mistake is committed by a staff in a branch of a bank, the branch head of that branch is held responsible and punished suitably by higher management of the bank. Then why not top officials who signed the said 9th Bipartite Settlement which is found to be illegal, unconstitutional (violation of fundamental right of equality before law enshrined in the Constitution) should be punished suitably by Ministry and Government of India. The higher officials must have vision and future repercussion of illegal and discriminatory clause of the agreement they sign.

One telephonic call is enough to make or mar one's career and hence every right or wrong instruction from boss is carried out by juniors easily even at the cost of lives of innocent people or safety, security, unity and integrity or even pride of the nation. This is why that even after lapse of 25 years, culprits of Sikh Riots of 1984 and Bhopal Gas Tragedy of 1984 are still roaming free. None of VIPs who were actually master mind in the greatest scam and scandal could be punished; it may be Bofors case, Chara scam, Ruchika-Rathore case stock scam UTI ghotala, stamp scam or any small case of fraud or misuse of HRD policies perpetuated at low level. It is ironical that good persons are made victim for ill works of bad person, it is the saddest part of Indian administration and Indian politics. When courts are incapable and dishonest, the scope of even justice from judiciary cannot be dreamt of.

It is not the systemic failure but it is the system prevalent in India. In India corrupt person get priority in all fields and honest and devoted workers are shunted out or placed at a critical and difficult place. Extradition of Anderson demanded by few politicians is not going to serve any purpose other than an attempt to befool Indian citizen once again. Political parties are blaming each other but none of them appears to be seriously sympathetic towards the pain of common men. We live in a country which is for rich people, by rich people and of rich people. It is rich man’s democracy

In all big cases of political scam or administrative corruption or any scandal two and three decades are wasted in judicial proceedings in a very easy way and in a very casual and normal way. Indian courts usually deliver justice after two three decades. As such Bhopal gas judgment does not appear that much astonishing in India.

No doubt foreigners laugh at Indian style of functioning in all sphere and fate of big cases involving VIPs of the country. Such cases are either languishing in courts for last two or three decades or in such cases, actual culprits are acquitted or lightly punished.

Even Law minister shamelessly accepts that the justice is not only delayed but buried. Judgment on Bhopal Gas mishap has made it more crystal clear that any Indian cannot expect justice from Indian court until he has money and muscle power to build pressure on advocates and judges. And persons who are having money and muscle power have the capacity to mould the decision in their favour and unfortunately in such heinous task they get full fledged support from politicians, ministers and administrative bosses.

Entire talks of judicial reforms going on in political arena for last two- three decades are nothing but Bakwas and it is politicians who are fully responsible for making mockery of Indian democracy as well as judiciary. Even PM admits the cancer of corruption but fail to eradicate it. President of India prefers to be deaf and dump and think it wise to remain silent spectator of Chirharan of Draupdi (innocent citizen) apparently to respect spirit of the Constitution.

It will not be untrue to say about Indian judicial system, that culprits become very happy when a case is lodged against them in any court. Police may be managed with some difficulty and after heavy payments but courts and even CBI people can be managed comparatively easily and comfortably .Judgments can be manipulated in collusion with advocates or heavy weights comparatively easily and more comfortably. Not only this even ruling political party get rid of public protests and hotshots from angry members of opposition parties once they sanction CBI inquiry or lodge FIR in Thana and lodge case in Indian court against any big criminal act or terror act. After all who is bothered of whether such CBI cases or CBI inquiry eventually proves to be futile exercise.

Reserve bank of India

Government framed policy for posting of bank employees in Villages as also for posting in North Eastern States to promote rural banking and to help development work in rural areas and North Eastern states. But management of banks have always misused this excellent policy to discard non-flatterers and to torture those employees who do not indulge in corrupt practices and who do not implements bad orders of the executives.
RBI or any investigating agency on honest inquiry will find that some officers have been working in villages for two or three decades whereas flatterers of the top officials of the management have been allowed to work in Metros for decades together. When an officer do not provide gifts to General Manager, he is posted in North Eastern States on the plea of Non Performance whereas those who commit fraud or indulge in irregular credits but always provide golden gifts to GMs, DGMs, AGMs in the name of some function either of inauguration or customer’s meeting are allowed to remain in big towns.
Some officers are simply creating bad advances and some others are constrained to recover the bad advances merely to save the corrupt officers from punishment. This is why loans or advances become Sub Standard in one or two years of its disbursement. It is also a bitter fact that such bad advances are concealed by gifting Auditors and inspectors and treated as good advances till the sanctioning officer wither is promoted or get safe exit from the bank. Honest workers are made scapegoat for the misdeeds of big executives.. It is undeniably truth that excellent results exhibited through annual balance sheets are due to devoted work of good performers and it is they who are salvaging banks from the misdeeds of bad officers. As such shining balance sheet of a bank should not give conclusion that the results shown are hard work of top officials sitting in AC rooms but that of field workers who are head of a branch and who is doing hard worker even under acute manpower shortage. In banks manpower is adequately provided only to flatterers even if he has caused banks crores of rupees. Until RBI or CBI catch hold of corrupt executives and punish the evil performers and at the same time award those officers who have been whimsically kept away from promotions and unless good officers are given respectable posting and promotions one cannot imagine of any rise in intrinsic value of any bank
On the contrary PSU banks are facing erosion in intrinsic value due to dirty implementation of apparently good HRD policies. In the name of Interview any employee can be deprived of and denied of promotion. Power makes executive corrupt if the decisions made by them are not transparent and subject to review. Root cause of persistence and promotion of such corrupt officers is due to the bitter fact that even courts fail to provide justice in decades together and this is why management bosses indulge in whimsical promotions, arbitrary transfers and postings.
I request bank officers to send their personal experience and story of corrupt officers to me at dkjain49709@rediffmail.com so that such illustration may be incorporated in PIL to be filed in the court. These information will be helpful in seeking information from bank under Right to Information Act to expose the true colour of officers who have been holding top posts in the bank and who have been getting continuous shelter from Banking division, RBI and Ministry of Finance. The aggrieved officer may also send the real story about them, how they have been cheated by their bosses, how they have been denied promotion and how they have been given always critical posting. After all how long you will bear with injustice in fear of repercussion from higher authorities. One has to come out of imaginary fear and expose the true picture of bad officers. How long meritorious and talented officer will face humiliation and posting against their dignity.
I will come with name of AGM,DGM ,GM,CM and BM and tell the officer community and Government of India how reign of injustice prevails in the banking industry. I need your cooperation in making a strong case against some of CMDs who are recognized as star performers but under the shelter of such CMDs ,their left and right hand officers who themselves are facing CBI charge sheets are exploiting power for self interest.
