INNOVATION OF BITCOIN – SATOSHI NAKAMOTO WHITE PAPER – SATOSHI NAKAMOTO IDENTITY

If we go back a little bit, we can see that there was an economic recession all over the world from 2007 to 2009, and about the same time in 2009, a white-paper titled "Bitcoin: A Peer-to-Peer Electronic Cash System" was released on the bitcoin.org website. In the front page of nine-page white paper written by Satoshi Nakamoto, he says Bitcoin is “A purely peer-to-peer version of electronic cash would allow online payments to be sent directly from one party to another without going through a financial institution.”. Although this nine-page white paper is quite complex, Satoshi Nakamoto describes on the second page, “We define an electronic coin as a chain digital signature.” In the eighth page under heading “Conclusion”, he wrote “We have proposed a system for electronic transactions without relying on trust”.

WHAT ARE CRYPTOCURRENCIES?

Remember that Bitcoin is the oldest and popular cryptocurrency system, and there are many more cryptocurrencies such as Dogecoin, Ethereum, Safe Moon coin and others. The cryptocurrency Bitcoin is not a Fiat currency, meaning it is not guaranteed at a price like gold. As per RBI “Every banknote issued by Reserve Bank of India ……. unless withdrawn from circulation, shall be legal tender at any place in India in payment or on account for the amount expressed therein, and shall be guaranteed by the Central Government.”

In conventional money, the Governor of the Reserve Bank of India guarantees the payment of equal sum, implying that there is always credibility, which Bitcoin or cryptocurrency will never have.

Another digital asset which has recently become very famous is NFTs (i.e. non-fungible tokens) which is nothing but the proof of originality of some pictures, videos etc. written by the original owner which means the NFTs holder will have the original token.

Bitcoin, however, is the most widely used by investors. The Bitcoin is algorithmed in such a way that after the year 2140, no bitcoins can be mined further and that is why the crypto supporters advocate the fact that Cryptocurrency will not experience inflation like any legal tender money. As per the supporters of Bitcoin, it is safe and legal tender money is fossilized concept. But there are lot of concerns and one of them, since Bitcoin is not governed by any country's laws or supervised by any authority, it is impossible to know how the price of Bitcoin swings or who rises or decreases it.

Now in many cases we see that the price of GPUs i.e. graphical processors that are used in mining is skyrocketing. Huge electrical energy is also big issue.

HOW THE LAW ENFORCEMENT AGENCY INVESTIGATE BITCOIN ? - WHY HACKERS USE BITCOIN ?

Another aspect to consider is how the investigating officials can gather money trail when the crime has been committed using Bitcoin. In a nutshell, Bitcoin incorporates features that use encryption and digital signatures to protect the Bitcoin network's security, thus it is a part of the virtual world but has nothing to do with its physical existence and due to which it cannot be traced out. We have seen the use of bitcoin in many heinous types of crimes starting from narcotic drugs sale to large-scale ransomware.

Now let us see the positions of law on bitcoin or different types of cryptocurrencies.

There are even countries who have come with laws defining Cryptocurrencies, namely Japan, Malta, Canada, Bahamas, Estonia, Latvia, Israel, Mexico, Austria, Czech Republic, Germany, Luxembourg, Slovakia, European Union and United Kingdom.

The Reserve Bank of India has issued a warning to users, holders, and traders of "Decentralised Digital Currency" or "Virtual Currency," such as Bitcoins, regarding the potential financial, operational, legal, customer protection, and security risks they are taking.

1-2-2017

The Reserve Bank of India has not granted any business or firm a licence or authorization to operate or deal in Bitcoin or any other virtual currency. As a result, anyone interacting with Virtual Currencies, whether as a user, holder, investor, trader, or otherwise, does so at their own risk.

5-4-2018

Consumer protection, market integrity, and money laundering are among the problems raised by virtual currencies, often known as crypto-currency and crypto assets.

The RBI's regulated firms like Commercial Payment Banks, Small Finance Banks, NBFCs are prohibited from dealing in virtual currencies or providing services to assist anyone in dealing with or settling virtual currencies. Regulated entities that already supply such services must end the arrangement within three months of this circular's publication.

A case was then filed in the Hon’ble Supreme Court challenging the Circular known as Internet and Mobile Association of India v. Reserve Bank of India, Writ Petition (Civil) No.528 of 2018, in which the Hon’ble Supreme Court set aside the aforementioned RBI circular.

Then a few days ago i.e., on 31-05-2021

The Reserve bank of India informed that, in view of the order of the Hon’ble Supreme Court, the prohibition circular over Virtual Currencies is no longer effective from the date of the Supreme Court judgement. Banks, as well as other entities may, however, continue to carry out customer due diligence processes in line with regulations governing standards.

CAN WE INVEST IN BITCOIN ? - CAN WE TRADE IN BITCOIN IN INDIA?

In the present circumstances, to put it another way, Bitcoin and other cryptocurrencies are neither illegal nor legal in India at the present, therefore individuals who trade in Bitcoin do so at their own risk. Twitter loses legal shield or Safe Harbour in India

For the last few weeks, we have seen Twitter versus India battle specially twitter versus Government of India rift and after repeated notices by Government of India to comply rules made under IT Rule 2021 or Social Media Rules 2021, Twitter being a social media giant does not care for that as per Government of India and hence the government announced that thus Twitter loses legal shield in India and thereby Twitter loses safe harbour in India as per section 79 of Information Technology Act. Twitter has to comply the IT Act, 2000 and IT Rules 2021 as well as has to appoint a Grievance Officer to deal with complaints as well as who shall acknowledge the complaint within twenty-four hours for the purpose of maintaining due diligence.

IT Rule 2021 also specifies that these social media giants have to provide information under its control or possession within 72 hours to the law enforcement agencies on requirement. Rule 2(w) of this Rule signifies the social media intermediary is such a concept through which users primarily or solely enables online interaction between themselves to create, upload, share, disseminate, modify or access information. Furthermore, as per the Rule 3, the intermediary shall remove the objectionable materials specifically obscene materials, within twenty-four hours from the receipt of a complaint made by an individual or any person aggrieved.

IT Rules 2021 | New Social Media Rules in India | Whether Social Medias will be banned?

There are lot of confusions going on relating to the newly introduced IT Rules 2021 which has come on 25^th February, 2021 and since 25^th May, 2021 there are lot of gossips and fake news going on and the questions before the people of India at large are:

Whether Facebook, Twitter, WhatsApp etc. social medias going to be banned?

Whether our private call, chat etc. data are read secretly without our permission?

What is there in IT Rules,2021 or Information Technology (Intermediary Guidelines And Digital Media Ethics Code) Rules, 2021?

As per Press Information Bureau, Government of India, we find the following statistics:

The Users of various significant social medias: -

• WhatsApp users: 53 Crore

• YouTube users: 44.8 Crore

• Facebook users: 41 Crore

• Instagram users: 21 Crore

• Twitter users: 1.75 Crore

RECENT CASES –

In one recent case i.e. FACEBOOK INC. VERSUS UNION OF INDIA & ORS., the issue relating to how and in what manner the intermediaries should provide information including the names of the originators of any message/content/information shared on the platforms run by these intermediaries and decryption of end-to-end encrypting chat-messengers who are to provide data in time of investigation etc. were raised and the question of any Rule to that effect was also discussed.

Making of the Rule…….

The Central Government introduced Information Technology (Intermediary Guidelines And Digital Media Ethics Code) Rules, 2021 due to –

Ø Large scale proliferation of social media by empowering the citizens and simultaneously rise of serious concerns and consequences which have grown manifold in recent years.

Ø Continuous spreading of fake news, abuse of social media in many ways attacking women by way of revenge porn, rivalries in abusive language, defamatory and obscene contents and blatant disrespect to religious sentiments.

Ø Skyrocketing misuse of social media by criminals, anti-national elements.

Ø Lack of control on OTT platforms, web series, etc.

Key Features of the IT Rules 2021 -

As per PIB, Government notifies Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 for the following purposes –

v Social media platforms were welcome to do business in India but they need to follow the Constitution and laws of India

v Social media platform can certainly be used for asking questions and criticism.

v Social media platforms have empowered ordinary users but they need accountability against its misuse and abuse

v The new Rules empower ordinary users of social media, embodying a mechanism for redressal and timely resolution of their grievance

v Rules about digital media and OTT focuses more on in-house and self-regulation mechanism whereby a robust grievance redressal mechanism has been provided while upholding journalistic and creative freedom

v The proposed framework is progressive, liberal and contemporaneous

v It seeks to address peoples’ varied concerns while removing any misapprehension about curbing creativity and freedom of speech and expression.

v The guidelines have been framed keeping in mind the difference between viewership in a theatre and television as compared to watching it on Internet.

Who have to comply the rule, 2021: Digital Media Including An Intermediary; Or A Publisher Of News And Current Affairs Content Or A Publisher Of Online Curated Content;
Significant Social Media Intermediary;
Social Media Intermediary;
Publisher Of News And Current Affairs Content;
Publisher Of Online Curated Content;
Intermediary In Relation To News And Current Affairs Content;
OTT Platforms And Publishers Of Films And Other Entertainment Programmes, Including Web Based Serials.

Various Parts of the Rule relating to Executing Authority:

The Rule has following three parts:

i) PART I: PRELIMINARY.

ii) PART II: DUE DILIGENCE BY INTERMEDIARIES AND GRIEVANCE REDRESSAL MECHANISM.

iii) PART III: CODE OF ETHICS AND PROCEDURE AND SAFEGUARDS IN RELATION TO DIGITAL MEDIA.

Needless to say, Part- II of these Rules shall be administered by Ministry of Electronics and IT, while Part-III shall be administered by the Ministry of Information and Broadcasting.

PART II: DUE DILIGENCE BY INTERMEDIARIES AND GRIEVANCE REDRESSAL MECHANISM

The present much-discussed law has its strong background in the following laws of India:

Section 5(2) of Indian Telegraph Act 1885 : Power for Government to take possession of licensed telegraphs and to order interception of messages.

ü Section 69 of Information Technology Act, 2008 :

Power to issue directions for interception or monitoring or decryption of any information through any computer resource.

ü Section 69A of Information Technology Act, 2008 :

Power to issue directions for blocking for public access of any information through any computer resource.

ü Section 69B of Information Technology Act, 2008 :

Power to authorise to monitor and collect traffic data or information through any computer resource for cyber security.

In this present IT Rules 2021, we can find Digital Media Ethics Code concerning Digital Media and OTT Platforms which is to be administered by Ministry of Information and Broadcasting.

For example, the OTT platforms have to classify their contents in terms of age as follows

Ø U (Universal),

Ø U/A 7+,

Ø U/A 13+,

Ø U/A 16+, and

Ø A (Adult).

Three-level Grievance Redressal Mechanism:

For ensuring observance and adherence to the code Ethics by publishers operating in the territory of India, and for addressing the grievances made in relation to publishers under this Rule, there shall be a three-tier structure as under –

Ø Level-I: Self-regulation by the publishers;

Ø Level-II: Self-regulation by the self-regulating bodies of the publishers;

Ø Level-III: Oversight mechanism by the Central Government

72 Hrs. Compliance to provide data to Government Agencies:

Intermediary shall, as soon as possible, but not later than seventy-two hours of the receipt of an order, provide information under its control or possession, or assistance to Government agency.

24 Hrs. to remove obscene materials etc.:

As per the Section 3(2)(b) of this Rule, the intermediary shall, within twenty-four hours from the receipt of a complaint made by an individual or any person on his behalf under this sub-rule, in relation to any content which is prima facie in the nature of any material which exposes the private area of such individual, shows such individual in full or partial nudity or shows or depicts such individual in any sexual act or conduct, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, take all reasonable and practicable measures to remove or disable access to such content which is hosted, stored, published or transmitted by it.

Some important provisions:

Rule 3(1) : What should not be published etc.

As per Rule 3(1) the intermediary shall not host, display, upload, modify, publish, transmit, store, update or share any information that,

(i) belongs to another person and to which the user does not have any right;

(ii) is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;

(iii) is harmful to child;

(iv) infringes any patent, trademark, copyright or other proprietary rights;

(v) violates any law for the time being in force;

(vi) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;

(vii) impersonates another person;

(viii) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;

(ix) contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;

(x) is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person;

It is further to be mentioned that as per the Rule 3 of IT Rules 2021, intermediaries have to preserve Evidence or retain Data for 180 Days.

In this Rule the social media has been divided into two parts, they are:

1) Significant social media intermediary.
2) Social media intermediary.

Significant social media intermediary being social medias who have large scale users above a threshold numbers should appoint and maintain following personnel to redress various issues relating to the law of the land: –

v Chief Compliance Officer,

v A nodal contact person needs to be appointed for 24x7 to coordinate with law enforcement agencies.

v A Resident Grievance Officer.

Identification of the First Originator for messaging Apps like WhatsApp etc.

As stated in the Rule 4(2), a significant social media intermediary providing services primarily in the nature of messaging shall enable the identification of the first originator of the information on its computer resource as may be required by a judicial order passed by a court of competent jurisdiction or an order passed by the Competent Authority under section 69 of the Information Technology (Procedure and Safeguards for interception, monitoring and decryption of information) Rules, 2009, which shall be supported with a copy of such information in electronic form.

“Safe-Harbour Protections” under Section 79 of the IT Act and Proviso Clauses:

There are lot of debate with respect to the instant messenger like WhatsApp etc. whether the privacy they offered by way of end-to-end encryption will be violated. But if one studies the proviso clauses of this 4(2) of this Rule, it will be clear that nothing of that sort has been there and on the contrary the messages or chat can not be intercepted or to be taken.

Consequence of Non-Compliance –

There are lot of uproar that various social media giant will be banned is absolutely false but after this Rule came into being they have to face rigours of law as provided in Rule 7.

Rule 7 specifies the consequences of Non-observance of Rules: Where an intermediary fails to observe these rules, the provisions of sub-section (1) of section 79 of the Act shall not be applicable to such intermediary and the intermediary shall be liable for punishment under any law for the time being in force including the provisions of the Act and the Indian Penal Code.

Few Other Important Issues:

Ø PART III of this Rule relates to Code of Ethics and Procedure And Safeguards In Relation To Digital Media
Ø This Rule specially Rule 16 provides for Blocking of information in case of emergency
Ø This Rule specially Rule 18 provides for Information to be Furnished within 30 days by the Publishers.
Ø This Rule provides the details of what should be there in Code of ethics.
Ø CODE OF ETHICS contains: – Rules for News and current affairs:

Norms of Journalistic Conduct of the Press Council of India under the Press Council Act, 1978;
Programme Code under section 5 of the Cable Television Networks Regulation) Act,1995;
Content which is prohibited under any law for the time being in force shall not be published or transmitted.
General Principles on Online curated content which contains Content Classification which may be on the basis of:

i) Themes and messages;

ii) Violence;

iii) Nudity;

iv) Sex;

v) Language;

vi) Drug and substance abuse; and

vii) Horror as described in the Schedule, as may be modified from time to time by the Ministry of Information & Broadcasting.

GENERAL GUIDELINE FOR CLASSIFICATION OF FLIMS AND OTHER ENTERTAINMENT PROGRAMMES, INCLUDING WEB BASED SERIALS:

This Rule relates to various concerns and they are:

(a) DISCRIMINATION

(b) PSYCHOTROPIC SUBSTANCE, LIQUOR, SMOKING and TOBACCO

(c) IMITABLE BEHAVIOUR

(d) LANGUAGE

(e) NUDITY

(f) SEX

(g) VIOLENCE: Classification decisions shall take account of the degree and nature of violence in a work

Recent observation –

Recently the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 has been challenged before the Hon’ble Kerala High Court.

Hence after perusal of the above Rule in my humble opinion, there is nothing which will going to ban the various popular social medias and there is nothing of unlawful interception of data. The rift for unlawful and lawful interception was, is and will always be there and everything depends upon how our law enforcement authorities will implement the Rules.

WhatsApp and Its Privacy Policy in India

In today’s ever-changing world where the age-old conventional technology has been defenestrated every day, data proved to be the most important thing and usually termed as “oil” or “air” of our society.

In celebrated case Justice K. S. Puttaswamy (Retd.) vs. Union of India, 2017, the right of privacy has been accepted by Hon’ble Supreme Court of India as one of our fundamental right and observed privacy as a part of right to life and personal liberty under Article 21 of the constitution of India. So, privacy is a fundamental right protected under the Indian constitution.

As per the report of Press Information Bureau Government of India, India has approximately 53 Crore WhatsApp users. We Indian have whole-heartedly welcome end-to-end encryption providing instant messenger WhatsApp, especially for its promised privacy system.

WhatsApp was bought by Facebook in 2014 and in 2016 WhatsApp introduced its changed Privacy policy and challenging the same a case was filed before the Hon’ble Delhi High Court being Karmanya Singh Sareen And Anr vs Union Of India And Ors, wherein as per order dated 23 September, 2016, Hon’ble Delhi High Court passed following order,

“we consider it appropriate to issue the following directions to protect the interest of the users of "WhatsApp":

i) If the users opt for completely deleting "WhatsApp" account before 25.09.2016, the information/data/details of such users should be deleted completely from "WhatsApp" servers and the same shall not be shared with the "Facebook" or any one of its group companies.

ii) So far as the users who opt to remain in "WhatsApp" are concerned, the existing information/data/details of such users upto 25.09.2016 shall not be shared with "Facebook" or any one of its group companies.

iii) The respondent Nos.1 and 5 shall consider the issues regarding the functioning of the Internet Messaging Applications like "WhatsApp" and take an appropriate decision at the earliest as to whether it is feasible to bring the same under the statutory regulatory framework.”

Again, the WhatsApp has introduced another Privacy policy and previously the last date was 28 February 2021 which was later in lieu of large scale protest extended to 15 May 2021. Recently we saw a landmark development in Telecom Industry in India As per news release by PIB, Telecom Department gives permission to Telecom companies for 5G Technology and Spectrum Trials The said trial will be in different rural, semi-urban and urban areas in India ..

5G technology is expected to have 10 times higher download rate than that of existing 4G. Even the this new 5G technology is Expected to have up to three times greater spectrum efficiency than its forefather 4G.

This 5G technology is expected to be beneficial to various core and crucial sectors including Agriculture, Education, Health, Transport, Traffic management. This cutting-age technology is expected to even revolutionize the growth of building smart cities, smart homes, and applications of Internet of Things in India.

The duration of the trials is for a period of 6 months. In the Press Release by Press Information Bureau also advocated the use of India's own designed 5Gi technology.

Now we have to see what will be health effects of the inception of 5G technology in India as people are long discussing about the apprehension of health hazards arising out it. We have long been witnessing various techno-legal-health issues arsing out of existing mobile infrastructure technology.

Be Aware Against Corona virus & Cyber Criminals

Entire India is facing a huge crisis arising out of unprecedent and shocking second wave of Corona virus attack which poses a challenge to every Indian, even putting of very survival. We Indian have more than 5000 years' old civilization and we are capable and confident to cope up with this sudden onslaught of the ever-changing mutating invisible enemy. There are reports of paucity of oxygen supply and beds in hospital, on which the Hon'ble Court has expressed concerns. In this situation, like the first wave of attack in the year 2020, various invisible crime like that of invisible virus, already been started in or through the virtual world. We can remember last year INTERPOL has warned the entire world against the rising cybercrimes in various countries including India. Recently following types of cybercrimes are skyrocketing :

i) Long standing fishing, vishing, various other types of online fraud including banking fraud which financially devastating people who fall victim to various types of online invisible trap.

ii) For the last few weeks people are being cheated on the plea of supplying oxygen cylinder or other types of medical instrument through various anonymous identities.

iii) People who are approaching social media for all needed help are sharing details of their private data, which ultimately falling at the hand of the fraudsters, who are playing with the privacy of the citizen.

In the present scenario, I think, the best remedy both in fighting against corona virus as well as cyber criminals, is the awareness. Again, as the Doctors are the health armies protecting us from the pandemic so also the investigating or law enforcing agencies should protect the people from organized crimes in virtual world. Please do the following:

i) Avoid any type of online money transaction from any untrusted site and only do the online banking from trusted banking site or app.

ii) Always keep safe the devise by which online money transaction is done. Never clicked any suspicious link or allow malware to enter your all-important devise.

iii) Never pay any money to any unknown person through online modes for purchasing oxygen or other indispensable materials in this pandemic period without verifying their credentials.

iv) Share the limited personally identifying data with the various online social medias so that fraudsters cannot use them for their wrongful purposes.

v) Avoid vishing or fishing calls impersonating banks or other organization or downloading any remote-control app as per the fraudsters' persuasion.

vi) In various part of West Bengal as well as various part of India, we have cyber police station or bank fraud units, wherein person duped or cheated can agitate their grievance. Also, in case of baking fraud, banks are to be intimated at the earliest after the fraud occurred.

vii) Please avoid any type of fake news and repot to the concerned person as per the latest IT Rules, 2021.

Lastly to repeat the same, awareness is the main weapon in this trying time, both in physical as well as in virtual life to combat both virus and cyber criminals. Let us hope that we shall overcome the tough time with ease.

আর্টিফিশিয়াল ইন্টেলিজেন্স মানুষের বর্তমান সভ্যতার এবং সমাজের প্রতিটি ক্ষেত্রে প্রতিদিন প্রতিনিয়ত প্রভাবিত করে চলেছে এবং আপনাদেরকে আরও বেশি করে প্রভাবিত করবে বলে মনে আশা জাগিয়েছে | মেশিন লার্নিং থেকে যাত্রা শুরু করে আর্টিফিশিয়াল ইন্টেলিজেন্স এখন ডিপ লার্নিং এর ক্ষেত্রে প্রবেশ করেছে যেখানে আর্টিফিশিয়াল ইন্টেলিজেন্স মানুষের ক্ষমতা বুদ্ধিমত্তাকে ছুঁয়ে ফেলবে বলে সাহস দেখাচ্ছে| পৃথিবীজুড়ে বিশেষত উন্নত দেশগুলোতে আর্টিফিশিয়াল ইন্টেলিজেন্স বা কৃত্রিম বুদ্ধিমত্তার প্রয়োগ বা সফল পরীক্ষা-নিরীক্ষা অন্যান্য ক্ষেত্রের মত বিচার ব্যবস্থার ক্ষেত্রে ও অনেকদিন থেকেই শুরু হয়ে গেছে এবং এ প্রসঙ্গে আমেরিকার আর্টিফিশিয়াল ইন্টেলিজেন্স সিস্টেম বা ব্যবস্থা, কম্পাস (COMPASS) বা [Correctional Offender Management Profiling for Alternative Sanctions] পৃথিবীজুড়ে সাড়া ফেলে দিয়েছে | অপরাধ করার ক্ষেত্রে বর্ণ বৈষম্য কি আদৌ একটা কার্যকরী উপাদান সে ব্যাপারে এই কম্পাস পৃথিবীজুড়ে এক বিরাট বিতর্ক তৈরি করে দিয়েছে এবং রোবটের হাতে বিচারব্যবস্থা ছেড়ে দিলে আগামী দিনে কি ভয়ঙ্কর সামাজিক পরিস্থিতি তৈরি হতে পারে তার একটা পূর্বাভাস আমরা পেয়ে যাচ্ছি | ন্যায়বিচার পরিচালনায় কৃত্রিম বুদ্ধিমত্তা বিশেষত মেশিন লার্নিং কিভাবে ব্যবহার হতে পারে তা দেখা যাক |

আদালত এবং তথ্য প্রযুক্তি –

কৃত্রিম বুদ্ধিমত্তা (Artificial Intelligence or A.I.) প্রযুক্তির ব্যবহার অগ্রগতির সাথে সাথে বিচার বিভাগগুলির মধ্যে মানবাধিকার, নজরদারি এবং দায়বদ্ধতার ওপর যথেস্ট প্রভাব সম্পর্কে আইনী প্রশ্নে জড়িত রয়েছে I কৃত্রিম বুদ্ধিমত্তার সম্ভাব্যতা ইতিমধ্যে অনেক বিচার বিভাগের দ্বারা অনুসন্ধান করা হয়েছে যার মধ্যে বিচার বিভাগ, প্রসিকিউশন সার্ভিসেস এবং অন্যান্য ক্ষেত্রে নির্দিষ্ট বিচার বিভাগীয় সংস্থা জুড়ে রয়েছে বিশ্বের বিভিন্ন ক্ষেত্রে অপরাধমূলক বিচারের জন্য, অনুসন্ধানী সহায়তা প্রদান করার জন্য এবং সিদ্ধান্ত গ্রহণের প্রক্রিয়াগুলি স্বয়ংক্রিয়তা প্রদান করার জন্য ।এখন প্রশ্ন হলো কৃত্রিম বুদ্ধি কীভাবে আদালত এবং বিচারকদের জন্য কার্যকর হতে পারে ? এবং কৃত্রিম বুদ্ধিমত্তা দরকারী করতে কি প্রয়োজন ?

বিভিন্ন প্রয়োজনীয়তা মেটাতে কৃত্রিম বুদ্ধিমত্তা বিভিন্ন উপায়ে কার্যকর হতে পারে –

তথ্য সংগঠিত করা - পাঠ্য নথি এবং ফাইলগুলিতে নিদর্শনগুলি সনাক্ত করার ক্ষেত্রে কার্যকর হতে পারে যা ম্যানুয়াল ফাইল গবেষণার চেয়ে দ্রুত এবং আরও নির্ভুল ।
পরামর্শ - পরামর্শদানে সক্ষম কৃত্রিম বুদ্ধিমত্তা, আদালতে মামলায় সম্ভাব্য পক্ষের জন্য কার্যকর হতে পারে, যারা তাদের সমস্যার সমাধান খুঁজছেন । “পরামর্শদাতা কৃত্রিম বুদ্ধিমত্তা” আইনজীবি পেশাদারদের জন্যও কার্যকর হতে পারে ।
ভবিষ্যদ্বাণী - আদালত সিদ্ধান্তের পূর্বাভাস দিতে সক্ষম বলে দাবি করে এমন কৃত্রিম বুদ্ধিমত্তা "ভবিষ্যদ্বাণীমূলক ন্যায়বিচার" পৃথিবীজুড়ে সাড়া ফেলে দিয়েছে |

ফলস্বরূপ, কাউন্সিল অফ ইউরোপ ন্যায়বিচার প্রশাসনে কৃত্রিম বুদ্ধিমত্তার ব্যবহারের জন্য নীতি নির্দেশিকা তৈরি করেছে যেখানে কৃত্রিম বুদ্ধিমত্তার জন্য কীভাবে আইনী তথ্যকে আরও ব্যবহারযোগ্য করে তোলা যায়, সেই সম্পর্কেও বলা আছে ।

আদালতে কৃত্রিম বুদ্ধিমত্তা দরকারী করে তুলতে কী প্রয়োজন ?
কিছু কৃত্রিম বুদ্ধিমত্তা ইতিমধ্যে অনুশীলনে নিজেকে প্রমাণ করেছে । এমন কোনও প্রমাণ এখনও পাওয়া যায়নি যেখানে রোবটরা বিচার করতে পারবে । কৃত্রিম বুদ্ধিমত্তা ইতিমধ্যে ব্যক্তি, মামলা-মোকদ্দমা এবং বিচারকদের তথ্য সংগঠিত করার ক্ষেত্রে সহায়তা করতে সক্ষম হয়েছে। আইনী তথ্যের গ্রন্থাগার যেমন সমৃদ্ধ হয়, তেমনই কৃত্রিম বুদ্ধিমত্তা পরামর্শ দিয়ে সহায়তা করতে পারে ।

বিশ্বস্ত কৃত্রিম বুদ্ধিমত্তা এর জন্য নীতি নির্দেশিকা : নির্দেশিকা অনুসারে বিশ্বাসযোগ্য কৃত্রিম বুদ্ধিমত্তা হওয়া উচিত –

(১) আইনী - সমস্ত প্রযোজ্য আইন ও বিধিবিধানকে সম্মান করবে এমন ।

(২) নৈতিক - নৈতিক নীতি ও মূল্যবোধকে সম্মান করবে এমন ।

(৩) শ্রমসাধ্য - একটি প্রযুক্তিগত দৃষ্টিকোণ থেকে সামাজিক পরিবেশ বা নীতি মেনে চলে এমন ।

বিশ্বাসযোগ্য বলে বিবেচিত হওয়ার জন্য কৃত্রিম বুদ্ধিমত্তা সিস্টেমগুলির যে প্রয়োজনীয়তাগুলি পূরণ করা উচিত :

প্রযুক্তিগত বলিষ্ঠতা এবং সুরক্ষা,
গোপনীয়তা এবং তথ্য পরিচালনা,
স্বচ্ছতা,
বৈচিত্র্য, বৈষম্য এবং ন্যায্যতা,
সামাজিক ও পরিবেশগত কল্যাণ,
দায়িত্ব;

কৃত্রিম বুদ্ধিমত্তা ন্যায়বিচার এবং বিচার ব্যবস্থার জন্য নতুন চ্যালেঞ্জ উত্থাপন করেছে । জুডিশিয়াল সিস্টেমস বা বিচার বিভাগ এবং তাদের পরিবেশে কৃত্রিম বুদ্ধিমত্তার ব্যবহার সম্পর্কিত ইউরোপীয় নৈতিক সনদ (European Ethical Charter) নীতিগুলির একটি কাঠামো সরবরাহ করে যা নীতি নির্ধারক, আইনসভা এবং বিচার পেশাদারদের গাইড করতে পারে যখন তারা জাতীয় বিচার প্রক্রিয়াগুলিতে কৃত্রিম বুদ্ধিমত্তার দ্রুত বিকাশের জন্য নিযুক্ত হয় |

ভবিষ্যদ্বাণীমূলক বিচার :
ভবিষ্যদ্বাণীমূলক ন্যায়বিচার হ'ল নির্দিষ্ট ধরণের বিশেষায়িত বিরোধের ফলাফলের জন্য ভবিষ্যদ্বাণী করার ক্ষেত্রে কৃত্রিম বুদ্ধিমত্তা দ্বারা প্রযুক্তির বিপুল পরিমাণ বিচার্য সিদ্ধান্তগুলির বিশ্লেষণ ।

কৃত্রিম বুদ্ধিমত্তা জড়িত হওয়া খুব সহায়ক হতে পারে :

উন্নত কেস-ল অনুসন্ধান ইঞ্জিন উপলব্ধ করা ;
অনলাইন বিরোধ নিষ্পত্তি (ODR);
খসড়া কার্যসমূহে সহায়তা;
বিভিন্ন রকমের বিশ্লেষণ ;
বিভিন্ন মানদণ্ড অনুসারে চুক্তিগুলির শ্রেণিবদ্ধকরণ এবং বিবিধ বা অসামঞ্জস্যপূর্ণ চুক্তিযুক্ত ধারাগুলির সনাক্তকরণ;
অভিযুক্তদের অবহিত করতে বা তাদের আইনি সহায়তা প্রদান করার জন্য "চ্যাটবটস"
পরিষেবা সরবরাহের প্রক্রিয়াটিকে স্বচ্ছ এবং সাশ্রয়ী করে তুলতে ।
কেবলমাত্র প্রাসঙ্গিক ডেটা সংগ্রহ করে বিচারকদের কাছে উপলব্ধ করা ।

ফ্রান্সের বিচার মন্ত্রকের উদ্যোগে 2017 সালে পরিচালিত দুটি আদালতে বিভিন্ন মামলা মোকদ্দমার ভবিষ্যদ্বাণীমূলক বিচার সফ্টওয়্যার পরীক্ষামূলক ব্যবহার করা হয়েছে |

অপরাধমূলক বিষয়ে "পূর্বাভাস" এর ব্যর্থতা :

আমেরিকাতে আর্টিফিশিয়াল ইন্টেলিজেন্স এর একটি প্রয়োগের ক্ষেত্রে কৃষ্ণ জনগোষ্ঠীকে প্রায়শই উচ্চ ঝুঁকি হিসাবে শ্রেণিবদ্ধ করা হয়েছিল, যদিও তারা দোষী সাব্যস্ত হওয়ার দুই বছরের মধ্যে তেমন অপরাধের সাথে জরায়নি | অন্যদিকে সাদা জনগোষ্ঠী, যারা কম ঝুঁকি হিসাবে শ্রেণিবদ্ধ হয়েছিল, তারা পরের দুই বছরের মধ্যে অপরাধ সংঘটিত করেছিল । এভাবে আর্টিফিশিয়াল ইন্টেলিজেন্স এর অ্যালগরিদম কৃষ্ণাঙ্গদের জন্য পুনঃসংশ্লিষ্টতার ঝুঁকিকে অতিরঞ্জিত করেছিল এবং সাদা জনগোষ্ঠীকে অবমূল্যায়ন করেছিল ।

ভারতবর্ষের বিচারব্যবস্থায় আর্টিফিশিয়াল ইন্টেলিজেন্স এর ব্যবহার:

উপরোক্ত আন্তর্জাতিক পরিস্থিতিতে কয়েকদিন আগে ভারতবর্ষে এক যুগান্তকারী ঘটনা ঘটে গেল যখন ভারতের মহামান্য সুপ্রীম কোর্টের বিদায়ী প্রধান বিচারপতি S A Bobde ভারতীয় বিচার বিভাগের জন্য কৃত্রিম বুদ্ধিমত্তা-চালিত গবেষণা পোর্টাল (Supreme Court Portal for Assistance in Court’s Efficiency) SUPACE চালু করলেন । SUPACE হল আদালতের দক্ষতায় সহায়তার জন্য সুপ্রীম কোর্ট পোর্টাল (Supreme Court Portal for Assistance in Court’s Efficiency)

এটি এমন একটি ব্যবস্থা যা প্রাসঙ্গিক তথ্য এবং আইন সম্বন্ধীয় তথ্য সংগ্রহ করে এবং এগুলিকে বিচারকের কাছে উপলব্ধ করে । এটি সিদ্ধান্ত নেওয়ার জন্য নয়, কেবল তথ্য প্রক্রিয়া করার জন্য এবং সিদ্ধান্তের জন্য কোনও ইনপুট সন্ধানকারী বিচারকদের কাছে এগুলি সরবরাহ করার জন্য। এটি বিচারকদের পক্ষে গবেষণা আরও সহজ করার জন্য তৈরি করা হয়েছে, যার ফলে তাদের কাজের চাপ সহজ হয় । এটির দ্বারা সময় সাশ্রয় হবে । এটি বিচার বিভাগ এবং আদালতকে বিলম্ব এবং মামলার দেরি কমাতে সহায়তা করবে । কৃত্রিম বুদ্ধিমত্তা মৌলিক অধিকারের ন্যায়বিচার উপলব্ধির ক্ষেত্রে আরও সুশৃঙ্খল, কার্যকরী, ব্যয় এবং সময়সীমাবদ্ধ উপায় উপস্থাপন করবে। এপ্রসঙ্গে উল্লেখযোগ্য জাতীয় জুডিশিয়াল ডেটা গ্রিডের (NJDG) প্রকাশিত তথ্য অনুসারে বিভিন্ন জেলা ও উপজেলা আদালতে ৩.৮১ কোটি মামলা এখনও বিচারাধীন রয়েছে । এতে 1 লক্ষেরও বেশি মামলা 30 বছরেরও বেশি পুরানো |

ভারতের মহামান্য প্রধান বিচারপতি S A Bobde কথায় যে সিস্টেমটি চালু হচ্ছে তা বিচারকের সিদ্ধান্ত নেওয়ার জন্য নয়, বরং সমস্ত তথ্য অনুসন্ধানের জন্য তৈরি করা হয়েছিল যাতে বিচারক সিদ্ধান্ত নিতে পারেন ।

এই সিস্টেমের বিরুদ্ধে নিম্নলিখিত কয়েকটি বিষয়ে উদ্বেগ প্রকাশ করা হয়েছে যা আমাদের আগামী দিনে অবশ্যই চিন্তা করতে হবে :

i বেকারত্ব বা নির্দিষ্ট কিছু পদে অপ্রয়োজনীয়তা সম্পর্কিত উদ্বেগ |

ii এই ব্যবস্থা অবলম্বন করা হলে বেকারত্বের বৃদ্ধি পাবে ।

iii বহুমূল্য বিচারকের রায় এর ক্ষেত্রে কৃত্রিম বুদ্ধিমত্তা কখনোই পথের কাটা হতে পারে না ।

বিশ্বজুড়ে বিচার ব্যবস্থাতে কৃত্রিম বুদ্ধিমত্তার ক্রমবর্ধমান ব্যবহারের জন্য আরও নৈতিক প্রশ্ন তৈরি করছে । কৃত্রিম বুদ্ধিমত্তা সম্ভবত মামলার মূল্যায়ন করতে পারে এবং বিচারকের চেয়ে আরও ভাল, দ্রুত এবং আরও দক্ষ উপায়ে বিচার প্রয়োগ করতে পারে - এইরকম চিন্তাভাবনা কিছু লোকের মনেই এসেছে |

আইনজীবি ও প্রশাসনিক পাবলিক সংস্থাগুলির সিদ্ধান্ত গ্রহণে, আইনী পেশা এবং বিচার বিভাগ থেকে শুরু করে বিভিন্ন ক্ষেত্রে কৃত্রিম বুদ্ধিমত্তা ব্যাপকভাবে প্রভাব ফেলতে পারে । উদাহরণস্বরূপ, আইনজীবীরা, তাদের ক্লায়েন্ট/মক্কেল এবং সামগ্রিকভাবে সমাজের সুবিধার সাথে কাউন্সেলিং এবং মামলা-মোকদ্দমা উভয় ক্ষেত্রেই আইনজীবীদের দক্ষতা এবং নির্ভুলতা বাড়াতে পারেন ।

তবে অনেক নৈতিক চ্যালেঞ্জ রয়েছে –

AI সরঞ্জামগুলির স্বচ্ছতার অভাব: AI এর সিদ্ধান্ত সর্বদা মানুষের কাছে বোধগম্য নয়।
AI নিরপেক্ষ নয়: এআই-ভিত্তিক সিদ্ধান্তগুলি অনর্থক, বৈষম্যমূলক বা পক্ষপাত দুষ্ট হতে পারে।
আদালতে ব্যবহৃত তথ্যগুলি অনেক ক্ষেত্রেই মানুষের চরম গোপনীয় তথ্য হয় তাই সেগুলোর গোপনীয়তা বজায় রাখা |
মানবাধিকার এবং অন্যান্য মৌলিক মূল্যবোধগুলির বা ন্যায্যতা বজায় রাখা |

পরিশেষে একটা খুব গুরুত্বপূর্ণ প্রশ্ন আমাদের প্রত্যেকের মনেই থেকে গেল এবং তা হল এমন কোন দিন কি আসবে যখন আমাদের মহামান্য আদালতের মহামূল্যবান রায়গুলো কৃত্রিম বুদ্ধিমত্তা বা আর্টিফিশিয়াল ইন্টেলিজেন্স বা রোবট দ্বারা চালিত হবে | যার উত্তর কেবল সময় দিতে পারবে !

DATA AND THE MODERN ERA:

• In today’s ever-changing world where the age-old conventional technology has been defenestrated every day, data proved to be the most important thing and usually termed as “oil” or “air” of our society. The avalanche of data or should I say Big data are the only business interest for the big entities of our complex society. It is ex-facie clear that our data is the centre of attraction for those entities. Some invincible data brokers qua data-analytics without our knowledge are collecting, packaging and selling our personal private data online and offline. Even the different e-commerce and social site companies are collecting, storing and tracking our data. Our life is converted into data package where we are only products. Our every purchase, every journey, every likes and dislikes, hobbies, thinking and thus every part of our life are digitised, tracked and logged. Today all around we can find a data war where unknown and invisible data brokers are stealing our data and profiling us. This unfair business.

• In the light of the above, we need to have legislation which will protect us from this gross attack on our cherished privacy and security. The corner stone of all the laws in the world is human dignity as we strongly believe the celebrated maxim “Salus populi suprema lex esto” [Let the good (or safety) of the people be the supreme (or highest) law]. But the innate difference between the progress of technology and law is due to the fact technologies are moved on rapid speed while law on the other hand moves slowly. Today with the more use of various algorithm the strain relationship of law and data analytics or Artificial Intelligence are becoming prominent. The intention of the privacy legislation is to put a tap on unauthorized collection, share management and use of one’s personal data. Online social media organisations are accessing one’s shared information and identifying a person and thus controls his autonomy. Any kind of algorithmic failure will jeopardise one’s identity and autonomy in the days to come.

GENERAL DATA PROTECTION REGULATIONS:

In the above backdrop European Union has come with one of the world’s most comprehensive regulation which is known as GENERAL DATA PROTECTION REGULATIONS or popularly known as GDPR. GDPR is the biggest revolution in the Data Protection Law of the World

Europe has its PRIVACY LAW or DIRECTIVES since 1990 and 1994 long before the GDPR came into effect.

HOWEVER –

It was placed in April, 2016 by EU Parliament

It came into effect on May 25th, 2018

It has 99 articles and over 200 Pages of long and complex regulations

Companies who have no physical existence but collecting and processing the personal data of Europe are governed by these regulations.

GDPR concerns on transfer of personal data outside Europe.

Data subject’s consent must be clear, freely given, informed and specific and can be withdrawn without any consequence.

The main function of GDPR is to protect the personal data of an individual assuring its proper security, governance, management and help in preventing personal data of the individual not being misused.

In GDPR compliance, companies have to implement solutions and processes that enable it to protect, discover, classify and monitor data.

As the Europe has previously the exposure to privacy law which helped her to put such a painstaking and elaborate in drafting such a huge legislation. Now let us see some of the important Articles of GDPR.

ARTICLE 1 : Subject-matter and objectives :

1. This Regulation lays down rules relating to the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data.

2. This Regulation protects fundamental rights and freedoms of natural persons and in particular their right to the protection of personal data.

3. The free movement of personal data within the Union shall be neither restricted nor prohibited for reasons connected with the protection of natural persons with regard to the processing of personal data.

ARTICLE 2 : Material scope

2. This Regulation does not apply to the processing of personal data:

(a) in the course of an activity which falls outside the scope of Union law

(b) by the Member States when carrying out activities which fall within the scope of Chapter 2 of Title V of the TEU

(c) by a natural person in the course of a purely personal or household activity

(d) by competent authorities for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security.

ARTICLE 3 : Territorial scope :

1. This Regulation applies to the processing of personal data in the context of the activities of an establishment of a controller or a processor in the Union, regardless of whether the processing takes place in the Union or not.

ARTICLE 4 : Definitions

For the purposes of this Regulation :

1) ‘personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

7) ‘controller’ means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law

12) ‘personal data breach’ means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed.

ARTICLE 5 : Principles relating to processing of personal data

1. Personal data shall be :

a) processed lawfully, fairly and in a transparent manner in relation to the data subject (‘lawfulness, fairness and transparency’)

c) adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (‘data minimisation’)

d) accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay (‘accuracy’)

f) accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay (‘accuracy’)

ARTICLE 6 : Lawfulness of processing :

1. Processing shall be lawful only if and to the extent that at least one of the following applies:

(a) the data subject has given consent to the processing of his or her personal data for one or more specific purposes.

ARTICLE 7 : Conditions for consent

1. Where processing is based on consent, the controller shall be able to demonstrate that the data subject has consented to processing of his or her personal data’

ARTICLE 9 : Processing of special categories of personal data :

1. Processing of personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation shall be prohibited.

ARTICLE 21 : Right to object

2. Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing.

ARTICLE 33 : Notification of a personal data breach to the supervisory authority

1. In the case of a personal data breach, the controller shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the supervisory authority competent in accordance with Article 55, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons. Where the notification to the supervisory authority is not made within 72 hours, it shall be accompanied by reasons for the delay.

2. The processor shall notify the controller without undue delay after becoming aware of a personal data breach.

ARTICLE 34 : Communication of a personal data breach to the data subject :

1. When the personal data breach is likely to result in a high risk to the rights and freedoms of natural persons, the controller shall communicate the personal data breach to the data subject without undue delay.

ARTICLE 52 : Independence :

1. Each supervisory authority shall act with complete independence in performing its tasks and exercising its powers in accordance with this Regulation.

ARTICLE 82 : Right to compensation and liability :

1. Any person who has suffered material or non-material damage as a result of an infringement of this Regulation shall have the right to receive compensation from the controller or processor for the damage suffered.

ARTICLE 83 : General conditions for imposing administrative fines :

6. Non-compliance with an order by the supervisory authority as referred to in Article 58(2) shall, in accordance with paragraph 2 of this Article, be subject to administrative fines up to 20 000 000 EUR, or in the case of an undertaking, up to 4 % of the total worldwide annual turnover of the preceding financial year, whichever is higher.

: IMPACT:

GDPR is already have a global impact to consumer in case of Personally Identifiable Information.

The GDPR has expanded the very definitions of personal data.

The companies dealing with the personal data have to notify any breach of data or hacking of the data of the organization concerning the personal data of the citizen of all the countries within 72 hours.

People also says that GDPR is a Defacto World Regulations.

The penalty in GDPR is severe. Non-compliance of regulations will result in fine upto 20 Million Euro or 4percent of annual global turn over, whichever is higher.

BRIGHTER side of the GDPR

Companies will get chance to reorganise its digital infrastructure and may earn confidence of global citizen.

The personal data of the citizens will be protected.

GDPR is preparation ground for the legislature and of the entire world for drafting and getting their data privacy law

: EFFECTS:

GDPR is a journey and not destination. As in fact it requires ongoing continues compliance. After the full compliance of GDPR, organisations have to show reasons to hold data and keep it safe. The companies have to approve your consent if they want to keep your information.

Every country other the European countries are closely watching and following the after effect or aftermath of GDPR came into effect.

The GDPR compliance is very high for companies as well as it is not a one-time investment but a journey with ongoing process and hence continues expenditure to be incurred.

Given in the existing corporate structure of India the big question is whether the Companies are ready to handle GDPR compliance or being forced to stop their operations in outside countries and operate the processing of their personal data.

আমাদের সমাজের একটি বৃহত্তর অংশ সরাসরি ই-বাণিজ্য সত্তা বা ই-বাণিজ্য সত্তার মার্কেটপ্লেস ব্যবহার করে বিভিন্ন অনলাইন প্ল্যাটফর্মের মাধ্যমে পণ্য বা পরিষেবা ক্রয় করছেন । প্রতিদিন বেশিরভাগ চুক্তি ভার্চুয়াল ওয়ার্ল্ডের (অপার্থিব বিশ্ব) মাধ্যমে তৈরি হয় যেখানে বৈধ চুক্তির কিছু বা প্রতিটি অংশ ভার্চুয়াল বিশ্বের মাধ্যমে সম্পাদিত হয়। যদিও, পূর্ববর্তী ক্রেতা সুরক্ষা আইন, 1986 এবং আমাদের বিদ্যমান চুক্তি আইন (Contract Act), ভার্চুয়াল বিশ্বে সংঘটিত কোনও অনলাইন চুক্তি সম্পর্কিত বিরোধকে আইনত বিচার করার কোনও সুযোগ দেয় না | যদিও তথ্যপ্রযুক্তি আইনের নিম্নলিখিত বিধানটি কিছুটা হলেও পরিস্থিতি সামলাতে চেষ্টা করে -

ধারা 10এ : ইলেকট্রনিক মাধ্যমে সৃষ্ট চুক্তির যৌক্তিকতা – কোন চুক্তি তৈরি হবার সময় প্রস্তাব পাঠানোর, মেনে নেওয়ার ও বাতিল করার ক্ষেত্রে, যখন যেমন হবে, যদি তা ইলেকট্রনিক মাধ্যমে প্রকাশিত হয়, তবে সে ক্ষেত্রে এই চুক্তি শুধুমাত্র এই কাজের জন্য ইলেকট্রনিক মাধ্যম অথবা পদ্ধতির ব্যবহার করা হয়েছে বলে অকার্যকরী বলে ধরে নেওয়া হবে না।

তবুও, আমাদের সাইবার বিশ্বে লেনদেনের বিপজ্জনক কার্যগুলি মোকাবিলার বা সঠিক বিচারের জন্য আমাদের একটি সম্পূর্ণ এবং উপযুক্ত আইন দরকার, যেখানে ক্রেতারা আসল বিশ্বের চেয়ে বেশি ঝুঁকিগ্রস্থ ভার্চুয়াল বিশ্বের পণ্য বিক্রেতা বা পরিষেবা সরবরাহকারীদের সাথে যোগাযোগ করে এবং যাদের মধ্যে একটা বড় অংশ মিথ্যা পরিচয় দিয়ে পণ্য বিক্রি করার নাম করে ক্রেতাদের ঠকানোর জন্য প্রস্তুত I এই অজ্ঞাত বিশ্বে দায়বদ্ধকারীর ঠিকানা, ব্যবসায়ের জায়গা ইত্যাদি নির্ধারণ করা আরও কঠিন যেখানে সবটাই একেবারে ভার্চুয়াল (অপার্থিব) ।

এই পরিস্থিতিতে একটি সুগঠিত এবং সুরক্ষিত আইন দরকার যা উপরের সমস্যাটির সমাধান করবে | সম্প্রতিকালে আমরা নিম্নলিখিত দুটি যুগান্তকারী আইন পেয়েছি যা প্রতিদিনের মানুষের অনলাইন কেনাবেচার ক্ষেত্রে একটি গুরুত্বপূর্ণ ভূমিকা পালন করবে –

(1) ক্রেতা সুরক্ষা আইন, 2019 |

(2) ক্রেতা সুরক্ষা (ই-বাণিজ্য) বিধি, 2020 |(1) ক্রেতা সুরক্ষা আইন, 2019 (Consumer Protection Act, 2019) এর কিছু গুরুত্বপূর্ণ ধারা নিচে ব্যাখ্যা করা হল :

1) নতুন আইনে ক্রেতা/ কনজিউমার (Consumer) এর সংজ্ঞা দিতে গিয়ে বলা হয়েছে যে কনজিউমার হল সেই ব্যক্তি যে অনলাইন ইলেকট্রনিক মিডিয়ার মাধ্যমে এবং অফলাইন মাধ্যমে কোন কোন বস্তু ক্রয় করে বা কোনো পরিসেবা গ্রহণ করে | এর অর্থ, বর্তমান আইনে সমস্ত রকম ইলেকট্রনিক মিডিয়ার মাধ্যমে অনলাইন-কেনাবেচা কে অন্তর্ভুক্ত করা হলো |

2) এই আইনে ই-কমার্স এর সংজ্ঞা দিতে গিয়ে বলা হয়েছে যে ই-কমার্স হলো দ্রব্য সামগ্রী কেনা বা কোনো পরিসেবা গ্রহণ করা যাতে ডিজিটাল দ্রব্য সামগ্রী অন্তর্ভুক্ত এবং যা ডিজিটাল বা ইলেকট্রনিক্স নেটওয়ার্কের মাধ্যমে সংঘটিত হয় |

3) এই নতুন আইনের ধারা নম্বর 17 তে কর্তৃপক্ষের কাছে যে অভিযোগ করার কথা বলা হয়েছে তাতে কনজিউমার এর অধিকার ভঙ্গ করা বা অবৈধ ব্যবসা বাণিজ্য করা বা মিথ্যা বিভ্রান্তিকর বিজ্ঞাপন প্রকাশ করা যা গ্রাহকের স্বার্থ বিরোধী, সে ক্ষেত্রে ডিসট্রিক্ট কালেক্টর (District Collector) অথবা উপযুক্ত আধিকারিকের কাছে অভিযোগ দেওয়ার সময় লিখিতভাবে অথবা ইলেকট্রনিক মাধ্যমে অভিযোগ দেওয়া যাবে |

4) এই আইনের ধারা 35 তে জেলা কমিশনের কাছে যে অভিযোগের কথা বলা হয়েছে সেই অভিযোগ অন্যান্য মাধ্যমে এবং ইলেকট্রনিক মাধ্যমেও পেশ করা যাবে |

5) এই নতুন আইনে সমস্ত রকমের নোটিশ যা জেলা কমিশন অনুমোদিত যখন যেরকম পাঠানোর দরকার হবে তা আগের মত পদ্ধতিতে বা ইলেকট্রনিক মাধ্যমে পাঠানো যাবে | অনলাইন নোটিশ, এক্ষেত্রে নোটিশটি ইলেকট্রনিক সার্ভিস প্রোভাইডারকে পাঠানো হবে যে একজন নোডাল এর মাধ্যমে এই পদ্ধতিটা সম্পন্ন করবে |

6) এই আইনের 94 তম ধারায় ই-কমার্স এর মাধ্যমে অনলাইন প্লাটফর্মে অসাধু কার্যবিধি বন্ধ করার জন্য কেন্দ্রীয় সরকার প্রয়োজনীয় ব্যবস্থা নিতে পারবে | এই প্রসঙ্গে উল্লেখযোগ্য যে ই-কমার্স প্লাটফর্মে অসাধু চক্র বন্ধ করার জন্য কনজিউমার প্রোটেকশন রুল কি হবে তার ওপরে একটি বিস্তারিত রুল বা বিধি যথা ক্রেতা সুরক্ষা (ই-বাণিজ্য) বিধি, 2020 আনা হয়েছে যা আমি নিচে আলোচনা করলাম | অর্থাৎ সদ্য পাস হওয়া উপভোক্তা সুরক্ষা আইনের উপরোক্ত বিধানের মধ্যে, ভার্চুয়াল বিশ্বে ক্রেতা দ্বারা লেনদেন অন্তর্ভুক্ত করা হয়েছে । এই আইনটি অনলাইন বিশ্বের ব্যবসায়িক উপভোক্তাদের সুরক্ষার জন্যও।

(২) ক্রেতা সুরক্ষা (ই-বাণিজ্য) বিধি, 2020:
এই রুলের গুরুত্বপূর্ণ কিছু বিধি নিচে বর্ণনা করা হলো –

i) এই ই-বাণিজ্য বিধি, সর্বত্র সমস্ত রকম দ্রব্যসামগ্রী বা কেনা বেচার ক্ষেত্রে যা ডিজিটাল ইলেকট্রনিক্স নেটওয়ার্কিং ব্যবস্থার মাধ্যমে সম্পন্ন হবে, তা অন্তর্ভুক্ত হবে |

ii) অনলাইনে বিভিন্ন প্ল্যাটফর্ম এর মাধ্যমে যত রকমের অসাধু ব্যবসা বাণিজ্য চলছে তা এই ই-বাণিজ্য বিধির অন্তর্ভুক্ত হবে |

iii) সবচেয়ে উল্লেখযোগ্য ধারাটি হলো, ভারতবর্ষে প্রতিষ্ঠিত নয় অথচ ভারতবর্ষে কোন দ্রব্য সামগ্রিক বা পরিসেবা প্রদান করে সেই সমস্ত ই-কমার্স কোম্পানিগুলোর ওপরেও এই বিধি লাগু হবে |

iv) ই-কমার্স সংস্থাগুলির বিশদ বিবরণ স্থির করতে, বিধি নম্বর 4 অত্যন্ত প্রগতিশীল এবং গুরুত্বপূর্ণ একটি বিধি |

v) এই রুল অনুযায়ী প্রতিটি ই-কমার্স কোম্পানিকে তাদের প্লাটফর্মে নিম্নলিখিত তথ্যগুলো প্রকাশ করতে হবে, যেমন
1) ই-কমার্স কোম্পানির আইনি নাম |
2) ই-কমার্স কোম্পানির ভৌগলিক অর্থাৎ কোম্পানির হেডকোয়ার্টারের এবং সমস্ত ব্রাঞ্চের ঠিকানা |
3) কোম্পানির ওয়েবসাইট এর নাম এবং তার বিস্তারিত তথ্য |

vi) কোম্পানির কাস্টমার কেয়ার এবং অভিযোগ নিষ্পত্তির আধিকারিক বা অফিসারের বিস্তারিত তথ্য যেমন তাদের ইমেইল অ্যাড্রেস, ফ্যাক্স নাম্বার, ল্যান্ডলাইন বা মোবাইল নাম্বার প্রদান করতে হবে |

vii) ই-কমার্স কোম্পানির ক্ষেত্রে তথ্য প্রযুক্তি আইনের 79 ধারার সাথে সামঞ্জস্য বজায় রাখার কথা বলা হয়েছে যা একটি গুরুত্বপূর্ণ পদক্ষেপ কারণ অনেক ক্ষেত্রে ই-কমার্স কোম্পানিগুলি তথ্যপ্রযুক্তি আইনের 79 ধারা উল্লেখ করে তাদের দায়-দায়িত্ব থেকে অব্যাহতি পাওয়ার চেষ্টা করে এবং সেক্ষেত্রে কোন উপভোক্তা আইন এতদিন না থাকায় ই-কমার্স এর মাধ্যমে অসাধু চক্র বেড়েই চলেছে এবং তার বিরুদ্ধে কোনো ব্যবস্থা নেওয়া বেশ কঠিন ছিল |

viii) কোনও বিক্রয়কারী ই-কমার্স সত্তার মার্কেটপ্লেসের মাধ্যমে বিক্রিত কোনও পণ্য বা পরিষেবাদি ফেরত নিতে অস্বীকার করবে না অথবা আমাদের কেনা বা কিনতে রাজি হওয়া এমন কোন পণ্য বা পরিষেবাগুলি সরবরাহ করার দায়িত্ব প্রত্যাহার করবে না অথবা অর্থ প্রদান করে ক্রয় করা কোন পণ্য বা পরিষেবা যদি ত্রুটিপূর্ণ হয় অথবা বিজ্ঞাপন সম্মত বৈশিষ্ট্যযুক্ত না হয় সেক্ষেত্রে বিক্রয়কারী বা পরিষেবা প্রদানকারী সেই অর্থ ফেরত দিতে অস্বীকার করবে না I এমনকি যদি কোন পণ্য বা পরিষেবা নির্দিষ্ট সময়ের পর সরবরাহ করা হয় সেক্ষেত্রে বিক্রয়কারী বা পরিষেবা প্রদানকারী সেই অর্থ ফেরত দিতে বাধ্য থাকবে I প্রকাশ থাকে যে, যদি প্রাকৃতিক দুর্যোগের কারণে কোন পণ্য বা পরিষেবা নির্দিষ্ট সময়ের পর সরবরাহ করা হয় সেক্ষেত্রে, এই উপ-বিধি প্রয়োগ করা হবে না I

ix) এই বিধিটি নিম্নলিখিত উপায়ে প্ল্যাটফর্মগুলিকেও পৃথক করে –
(i) ই-বাণিজ্য সত্তা এবং
(ii) মার্কেট প্লেস ই-কমার্স সত্তা

x) ছয় নম্বর বিধিতে অনলাইন মার্কেটপ্লেসে বিক্রেতাদের দায়-দায়িত্ব পরিষ্কার করে বলা হয়েছে এবং বিভিন্ন বিধিগুলি কি ভাবে প্রয়োগ হবে সেক্ষেত্রে বিধি আট-এ বলা হয়েছে যে, কেউ যদি এই বিধির কোন ধারা অমান্য করে তাহলে সে ক্ষেত্রে কনজিউমার প্রোটেকশন অ্যাক্ট 2019 অনুযায়ী উপযুক্ত ব্যবস্থা নেয়া হবে বা কনজিউমার প্রোটেকশন অ্যাক্ট 2019 প্রযোজ্য হবে |

আমার দৃষ্টিতে উপরের আইনটি যদিও ই-বাণিজ্য শিল্পের (E-Commerce) ক্রিয়াকলাপগুলির বিচার সংক্রান্ত একটি সম্পূর্ণ কোড নয় তবে এতে ভারতের অনলাইন ক্রেতাদের পক্ষে অবশ্যই একটি সুরক্ষার ব্যবস্থা রয়েছে |

Electronic Evidence| A Murder Case | Hacking

In today’s world in proving any case electronic evidence can play an important role. Hon’ble Justice Stephen Breyer of the US Supreme Court said, in the Article “Science in the Courtroom” that in this age of science, science should expect to find a warm welcome, perhaps a permanent home, in our courtrooms… Our decisions should reflect a proper scientific and technical understanding so that the law can respond to the needs of the public.

The recent judgements which are worth mentioning in India are as follows: "In Ziyauddin Burhanuddin Bukhariv. Brijmohan Ramdass Mehra [Ziyauddin Burhanuddin Bukhari v. Brijmohan Ramdass Mehra, (1976) 2 SCC 17] , this Court noted that new techniques and devices are the order of the day. Audio and video tape technology has emerged as a powerful medium through which a first-hand information can be gathered and can be crucial evidence.”

(Shafhi Mohammad v. State of H.P., (2018) 2 SCC 801: 2018 SCC OnLine SC 56 : (2018) 1 SCC (Cri) 860 at page 808)

The application of electronic evidence has further been facilitated by various amendments in criminal major acts or provisions of other acts which may be as follows:

As per Section 3 of Indian Evidence Act,

“Evidence”.—“Evidence” means and includes—

(1) all statements which the Court permits or requires to be made before it by witnesses, in relation to matters of fact under inquiry,

such statements are called oral evidence;

(2) all documents including electronic records produced for the inspection of the Court,

such documents are called documentary evidence.

Following provisions of Information Technology Act help provide a welcoming change in Electronic Records/Evidence appreciation:

Ø Section 3. Authentication of Electronic Records

Ø Section 3-A. Electronic Signature Authentication

Ø Section 4 of IT Act : Legal Recognition of Electronic Records.

Ø Section 5. Legal recognition of Electronic Signature.

Ø Section 10-A. Validity of contracts formed through electronic means.

Legal Recognition of Electronic Records:

Section 4 of IT Act, 2000:

Where any law provides that information or any other matter shall be in writing or in the typewritten or printed form, then, notwithstanding anything contained in such law, such requirement shall be deemed to have been satisfied if such information or matter is -

(a) Rendered or made available in an electronic form; and

(b) accessible so as to be usable for a subsequent reference.

So, every Learned Court has to welcome electronic evidence in trial.

For every case like the one I shall venture in discussion in this article, the following time-tested view is equally important:

As per Wikipedia, in forensic science, Locard's exchange principle holds as: "Every contact leaves a trace".

The most important criticism on digital evidence is that digital evidence can be easily altered.

However, in US v. Bonallo (858 F. 2d 1427 - 1988 - Court of Appeals, 9th 2002) a US court ruled that "the fact that it is possible to alter data contained in a computer is plainly insufficient to establish untrustworthiness".

Now let us see a conventional murder case investigated and tried with crucial electronic or digital evidence. For the sake of right to be forgotten, I am not inclined to divulge the details of the names of the offenders.

In JAGADDAL PS case, in West Bengal, long 8 months trial ended in conviction and the followings points are worth mentioning:

Ø Total 17 numbers of witnesses and two expert (CFSL) witnesses whose personal appearance waived u/s 294 Cr.P.C.

Ø There were more than 80 numbers of document exhibited and 09 numbers of material exhibited including electronic records.

Ø The entire trial was completed within 8 months approximately.

ØOne of the fastest, contested Murder case followed by Cybercrime cases in India.

Ø Prosecution in its written arguments very consciously established the time of murder through the chain of evidences which came up in trial with the help of medical evidences, relied and settled observation or opinions of medical expert in their celebrated journals as well as the innovative Electronic Evidences.

Ø Perfect blend of volumes of electronic evidences, non-electronic evidences, the vital evidence of traceability path starting from IP address to user details were produced before the court.

Ø The evidence of two witnesses who lastly saw the victim along with the accused persons on the date and just before the incident, also been successfully established by the prosecution.

Ø The precious electronic evidence is that during the period of incident to the arrest of accused persons, the cell tower location of victim and the accused persons were same, thus evidence was also been proved by the prosecution in the present case.

Ø The mother of victim with a shock of his only minor son’s missing for 11 days and subsequently murder, got completely devastated and collapsed by this heinous offence and lateron she fought back and boldly withstood two day’s rigorous cross-examinations after delivering clear and truthful evidence in examinations-in-chief.

Ø The evidence of brother-in-law (elder sister’s husband) of victim who got the first ransom call and lateron was bound to rush here-n-there for two days as per the directions of the accused persons, was also proved by the prosecution before the court. He also specified the name of one of the three accused persons who made such ransom call.

Ø The prosecution also succeeded in proving the procedure of Lunh Algorithm in such electronic evidence.

Ø The application of section 47 of Indian Evidence Act by the prosecution helped the case in fastest conclusion as well as also save the precious time of Ld. Court.

Ø The prosecution succeeded in proving the fact of Section 120A and 120B through the evidence of mother in whose presence the accused persons planned with victim for their Bandel visit and cousin brother of victim who lastly saw the victim alongwith accused persons.

THE GIST:

One lady a lodged complaint before local Police Station alleging that her beloved only son, (being the deceased herein) aged about 18 yrs left his residence for tuition. Also, her son-in-law at Delhi got one ransom call from the mobile No. of deceased and over such call the accused persons demanded Rs. 15,000,00/- as extortion money to release the victim otherwise they would kill the young victim. Thereafter he informed this to his wife and she conveyed this to her mother at Kolkata.

On searching for deceased here-and-there mother came to know from cousin brother cum friend of deceased, that he saw deceased and accused persons on the same day in the evening at place and on asking by him, the deceased revealed about his visit alongwith with accused persons and they were headed towards Railway Station.

Brother-In-Law after reaching Kolkata, started to search for the victim through every possible way. Brother-In-Law had uploaded one picture of the victim on his Facebook account timeline with an endorsement of “Missing” and also mentioned the phone number to contact. Later, one comment of “Call Kar” has been posted on the said Facebook Post from the Facebook account of the deceased.

Later during investigation, the dead body of the victim has been recovered by the officers of from the river Ganga. The investigation agency working with the URL of the Facebook account of the deceased ultimately found that the accused persons were using the Facebook account of the victim to make a representation that the victim boy was alive at that time and if ransom was paid, they would free him.

CHARGE HAS BEEN FRAMED ON THE FOLLOWING SECTIONS:

SECTION 365 of the Indian Penal Code - Kidnapping or abducting with intent secretly and wrongfully to confine person.

Section 300 in The Indian Penal Code - Murder

Section 302 in The Indian Penal Code - Punishment for murder.

SECTION 201 of the Indian Penal Code - Causing disappearance of evidence of offence, or giving false information to screen offender.

SECTION 34 of The Indian Penal Code - Acts done by several persons in furtherance of common intention.

SECTION 120B in The Indian Penal Code - Punishment of criminal conspiracy.

SECTION 66 of IT Act - Computer related offences.

SECTION 66C of IT Act - Punishment for identity theft.

The significant fact is that charges were framed against all the accused persons on the allegation of murder with hacking amongst other offences.

After nearly 8 months’ of trial the Ld. Court held all of the accused person as guilty and sentenced to life imprisonment.

PROBLEMS FACED: -

The most important and very unfortunate and peculiar incident occurred as when the trial was fixed for examination of the 1st Investigating Officer he suddenly disappeared for few days and subsequently found ill in an unknown place. After waiting for a considerable period the prosecution has submitted some medical documents and the whereabouts of the 1st I/O of this case. It was not possible for the prosecution to bring him before the Ld. Court and the 2nd I/O i.e. PW-17 has stepped into the shoes of the 1st I/O. The prosecution proved various documents and facts being the exhibited documents prepared by the 1st I/O through the 2nd I/O and facts referring from the case diary during the tenure of 1st I/O. as the PW-17 being the 2nd I/O has perused the entire CD and was fully acquainted with the handwriting and signatures of the 1st I/O being colleague in the same PS for a considerable period.

CORPUS DELICTI - In the present case the defence many a times tried to challenge the identity of the deceased (though the identification of the deceased is established beyond any doubt), and even if for argument’s sake we accept that the body found was not the body of the victim boy, even in that case also applying above ruling and others enumerated hereinafter, the prosecution case still hold good even in the absence of corpus delicti.

In the conclusion I am inclined to end this article with the following celebrated observations:

“[t]he potentially limitless application of computer technology to evidentiary questions will continually require legal adaptation.” (Penny v. Commonwealth, 370 S.E.2d 314, 317 (Va. Ct. App. 1988))

হ্যালো গুগল…….., মানুষ যখনই বিভিন্ন রকমের সার্ভিস বা সেবা পেতে চায় তখন তারা বিভিন্ন ব্রাউজার বা বিশেষত গুগলের মাধ্যমে সেই সমস্ত সার্ভিস প্রদানকারী কোম্পানিগুলির যোগাযোগ ফোন নাম্বার ইত্যাদি সার্চ করেন এবং সেখান থেকে পাওয়া ফোন নাম্বার বা বিভিন্ন তথ্যের ওপর নির্ভর করে বিভিন্ন রকম ভাবে প্রতিদিন প্রতি নিয়ত ঠকে যাচ্ছেন |

যেমন ধরুন কিছুদিন আগে এক ব্যক্তি বিদ্যুৎ সরবরাহকারী একটি কোম্পানির কাস্টমার কেয়ার নাম্বার গুগলে গিয়ে সার্চ করে পায় এবং সেই তথ্যের ওপর ভিত্তি করে অনলাইনে বিদ্যুতের বিল প্রদান করতে যান এবং পরিণতি এটাই হয় যে তার কষ্টার্জিত পয়সা সাইবার প্রতারকদের হাতে চলে যায়|

বহুবার বহুভাবে মানুষকে বারন করা সত্বেও, বোঝানো সত্বেও এই সহজ কথাটা বোঝা যাচ্ছে না যে গুগল সার্চ ইঞ্জিনে পাওয়ার বেশিরভাগ তথ্যই নির্ভরশীলতার যোগ্য নয় |

অনেক ক্ষেত্রেই অনেক জাল ওয়েবসাইট আছে যা দেখতে বিভিন্ন নামিদামি কোম্পানির বা তাদের কাস্টমার কেয়ার ডিপার্টমেন্টর ওয়েবপেজ বলে মনে হবে | কিন্তু এটা সম্পূর্ণ রূপে একটা ফাঁদ যাতে আপনি পা দিলেই আপনার গুরুত্বপূর্ণ নথি বিশেষত আপনার ব্যাঙ্ক অ্যাকাউন্টের নথি ইত্যাদি আপনার কষ্টার্জিত টাকা পয়সা আপনার ব্যাংক থেকে ক্রিমিনালদের হাতে চলে যাবে |

এই লকডাউন এর সময়ে এই ধরনের সাইবার ক্রাইম প্রচুর পরিমাণে বেড়ে গেছে I এই অবস্থায় নিজেদের সতর্ক রাখা বা সতর্ক থাকা ছাড়া আর কোনো রাস্তা খোলা নেই I তাই এই ব্লগ পোস্টের মাধ্যমে আমি প্রতিটি বাঙালিকে এই অনুরোধ করবো যে আপনি অনলাইনে যে কোন কাজে গুগল থেকে পাওয়া তথ্যের ওপর বেশি নির্ভর করবেন না বা অন্য সার্চ ইঞ্জিন থেকে পাওয়া তথ্যের ওপর বেশি নির্ভর করবেন না I কারণ এই তথ্যগুলো গুগোল বা অন্য সার্চ ইঞ্জিন দেয় না I তারা বিভিন্ন ওয়েবসাইট থেকে সার্চ করে একই ধরনের পেজ গুলো আপনাদের সামনে তুলে ধরে I কিন্তু আপনারা যদি সেগুলোর উপর নির্ভর করে ঠকে যান বা ফাঁদে পড়েন তবে ক্ষতি আপনাদেরই হবে |

সুতরাং আপনার যদি মনে হয় আপনি কোন ব্যাংকের অনলাইন সেবা নেবেন তবে নিজে ব্যাংকে গিয়ে বা ব্যাংকের নির্ভরযোগ্য অ্যাপ্লিকেশন ব্যবহার করেই আপনার টাকাপয়সা ইত্যাদি লেনদেন করবেনI কিছুদিন আগে এক ব্যক্তি একটি নামী সরকারি ব্যাংকের ব্যাপারে খোঁজখবর করেন এবং অনলাইনে সার্চ করতে গিয়ে উনি ফোন নাম্বারটা পেয়ে যান I কিন্তু সবই ছিল জাল, শুধুই ফাঁদ পাতা উনি সেটা বুঝতে পারেননি I তার ফলে তার কষ্টার্জিত মূল্যবান টাকা ক্রিমিনাল দের হাতে চলে যায় I

শুধুমাত্র জামতারা নয়, ভারতবর্ষ জুড়ে এখন ফিশিং স্ক্যাম বেড়ে চলেছে | বিভিন্ন ধরনের পদ্ধতি প্রয়োগ করে আপনাদের টাকা হাতানো হবে | আপনারা সাবধান হবেন যখন অনলাইন ট্রানজেকশন করবেন অনলাইন কাজ করবেন |

Hello Google ………………………………………Whenever people want to get different kinds of services then they search through different browsers or especially through Google for the phone numbers, contacts, etc. of those service providers and the phone numbers obtained from there are all fake and if anyone use this number etc. to do any economic transaction, then his or her hard-earned money may be siphoned to cyber fraudsters’ unlawful gain.

For example, a few days ago, a person went to Google and searched for the customer care number of an electricity distribution company and tried to pay the electricity bill through online based on that information but ultimately he was cheated.

This simple fact is not understood despite it has been told many times in many ways that most of the information you get in the Google search engine is not worth relying on.

In many cases it has been seem that there are fake websites that look like the web pages of different reputable companies or their customer care department. But it's completely a trap so that as soon as you step in, your important documents, especially your bank account, etc., will go to the hackers and your hard-earned money will be siphoned out from your bank account by the cyber fraudsters.

This type of cybercrime has increased tremendously during this lockdown and in this situation, there is no other way but to keep oneself alert and through this blog post I would urge everyone not to rely blind-fold on information obtained from any search engine for anything online. Because this information is not given by search engines like Google or any other search engine. They search from different websites and present similar pages in front of you.

So, if you think that you will take online services of any bank, then you can go to the bank yourself or use the reliable application of the bank to transact your money etc. A few days ago, a man inquired about a well-known government bank in his area and while he searched online, he got the phone number. But everything was fake, just a trap which he didn't understand. As a result, his hard-earned money went into the hands of criminals.

Phishing scams are on the rise not only in Jamtara but all over India. You will be cheated and your money will be siphoned by applying different methods. You have to be careful when transacting online.

इसलिए यदि आपको लगता है कि आप किसी भी बैंक की ऑनलाइन सेवा लेंगे, तो आप स्वयं बैंक जा सकते हैं या बैंक के विश्वसनीय application का उपयोग कर सकते हैं और अपने पैसे का लेन-देन कर सकते हैं I कुछ दिनों पहले, एक व्यक्ति ने एक प्रसिद्ध सरकारी बैंक के बारे में पूछताछ की और ऑनलाइन खोज करते समय, उसे फोन नंबर मिला। लेकिन सब कुछ नकली था, सिर्फ एक जाल। उसे यह एहसास नहीं था। नतीजा, उसकी मेहनत से कमाई रकम अपराधियों के पास चली गई।

অথবা ভার্চুয়াল ওয়ার্ল্ডে ঘুরতে ঘুরতে আপনি পৌঁছে গেলেন কোন ডেটিং সাইটে বা অনলাইনে বন্ধুত্ব করার সাইটে এবং সেখান হয়তো কারো সঙ্গে আলাপ হলো | এরপর আপনার মোবাইলের হোয়াটসঅ্যাপে একটি “হাই” আসবে | তারপর আপনাকে ভিডিও চ্যাটিংয়ে প্রলুব্ধ করা হবে এবং যদি আপনি সেক্স চ্যাট/ ভিডিও চ্যাটে অংশ নেন তাহলে আপনার ভিডিওটি সঙ্গে সঙ্গে রেকর্ড হয়ে যাবে এবং তার পরেই শুরু হবে আপনার ওপর বিভিন্ন রকমের মানসিক অত্যাচার I

কিভাবে চলুন জেনে নিই :

এর পরে আপনার কাছে একটি মেসেজ যাবে যে “আপনার বাজে ভিডিও আমাদের কাছে আছে আপনি যদি এত হাজার টাকা না দেন তাহলে এই সমস্ত ভিডিও গুলো অনলাইনে আপলোড করে দেওয়া হবে অথবা আপনার ফেসবুক বা বিভিন্ন একাউন্টে আপনার যে বন্ধুরা আছে তাদের পাঠিয়ে দেওয়া হবে”|

অর্থাৎ আপনি পড়ে গেলেন একটি ফাঁদে | এখন আপনার কাছে দুদিকে বিপদ ; আপনি লজ্জায় ভয়ে কাউকে ব্যাপারটা জানাতে পারবেন না, এমনকি অনেকে থানায় কমপ্লেন করতেও ভয় পায় |

অন্যদিকে যতক্ষন না আপনি টাকা দেবেন ততক্ষণ পর্যন্ত আপনাকে ব্ল্যাকমেল করতেই থাকবে I এই ধরনের কাহিনী, এই ধরনের অপরাধ এই মহামারীর যুগে একটা বড় আকার ধারণ করেছে I এই ধরনের ক্রাইম প্রচুর পরিমাণে সারা ভারতবর্ষে হচ্ছে I কিন্তু লজ্জায় ভয়ে ভিকটিমরা এগিয়ে আসছে না যার ফলে এই ধরনের অপরাধের বিরুদ্ধে সোচ্চার হওয়া যাচ্ছে না |

এমনকি ঠিকঠাক ইনভেস্টিগেশন হচ্ছে না কারণ ভিকটিমরা এগিয়ে এসে সাহায্য করতে ভয় বা লজ্জা পাচ্ছেন |

এই অবস্থায় এ কথা বলব, আপনি অনলাইনে কোন ভিডিওতে যখন চ্যাট করবেন খেয়াল রাখবেন আপনার শরীর যেন সম্পূর্ণরূপে জামা কাপড়ে ঢাকা থাকে এবং কোনরকম সেক্স চ্যাট ওয়েবসাইটে যাওয়ার আগে দশবার ভাববেন I কারণ যে কোন মুহূর্তে যে কোন ভাবেই আপনি যে কোন ফাঁদে পড়ে যেতে পারেন | তাই সাবধান !

তবে হ্যাঁ আপনারা এগিয়ে আসুন অভিযোগ করুন নির্দিষ্ট থানায় এবং এই সমস্ত অপরাধীদের পুরো চক্রটা ধরতে পুলিশকে সাহায্য করুন |

এখন কিছুদিন ধরে একটা সাইবারক্রাইম খুব বেড়ে গেছে, যেখানে পেটিএম বা বিভিন্ন কোম্পানির নাম করে আপনাকেকেউ ফোন করে বলছে আপনার পেটিএম অ্যাকাউন্ট আর ব্যবহার করতে পারবেন না বা আপনার বিভিন্ন রকমের অসুবিধা আছে বা আপনাকে এটা করতে হবে, আপনাকে ওটা করতে হবে এবং এগুলো করতে গিয়ে আপনাকে একটা মোবাইল অ্যাপ ইন্সটল করতে হবে |

এই মোবাইল এই অ্যাপটা বা এই অ্যাপ গুলো আর কিছুই নয় , টিম্ভিউয়ার বা রিমোট কন্ট্রোল সফটওয়্যার | যার মাধ্যমে বা যা একবার যদি আপনি আপনার মোবাইলে ইন্সটল করেন এবং আপনার আইডিটা শেয়ার করেন তাহলে ক্রিমিনাল আপনার মোবাইলের সমস্ত তথ্য অবলীলায় দেখতে পাবে, পড়তে পারবে এবং এরপরই আপনি যদি একটা ছোট 10 টাকার ইত্যাদি এমাউন্টের রিচার্জ করেন তাহলেই আপনার পিন বা অন্যান্য ব্যাংকিং তথ্য সঙ্গে সঙ্গে ক্রিমিনাল কাছে চলে যাবে এবং সে আপনার একাউন্ট থেকে টাকা বের করে নিয়ে আপনার কষ্টার্জিত টাকা সাফাই করে দেবে |

প্রতিদিন প্রতিনিয়ত বিভিন্ন ফোরামে আমি এই কথাটা বলে আসছি এবং এমনও হয় বলতে বলতে হয়তো হাঁপিয়ে যাচ্ছি, কিন্তু তা সত্ত্বেও প্রতিদিন প্রতিনিয়ত বিভিন্ন রকমের কমপ্লেন পাওয়া যাচ্ছে যেখানে মানুষের কষ্টের টাকা গরিব মানুষের টাকা এইভাবে বেরিয়ে যাচ্ছে | বেশিরভাগ ক্ষেত্রে এনি-ডেস্ক (AnyDesk) নামের রিমোট অ্যাপ্লিকেশন আপনার মোবাইলে ইন্সটল করতে বলেন | অনেক ক্ষেত্রে এরা আগে থেকে আপনাকে কিছু মেসেজ পাঠিয়ে রাখে যেন মনে হয় কম্পানি এই মেসেজটা পাঠিয়েছে এরপর আপনাকে ফোন করে বলবে আমি ওই কোম্পানি থেকে বলছি যে কোম্পানি থেকে ওই মেসেজটা গেছে আপনি এবার আপনার মোবাইলে একটা অ্যাপ ইন্সটল করুন আর যেভাবে বলছি সেভাবে করতে শুরু করুন | ব্যাস ! আপনার টাকা আপনার একাউন্ট থেকে হাফিস হয়ে যাবে | আপনার একাউন্ট ফাঁকা |

আপনাদের কাছে আমার অনুরোধ কখনো কোনো ফোন থেকে যদি আপনাদের কেউ ফোন করে বলে যে আপনার ফোনে একটি মোবাইল অ্যাপ ইন্সটল করুন, কিছুতেই করবেন না কারণ যদি করেন তাহলে কিন্তু আপনার মোবাইলের পুরো কন্ট্রোল অনেক দূরে বসে থাকা ক্রিমিনাল নিয়ে নেবে আপনার কষ্টের টাকা বেরিয়ে যাবে এবং আপনি আর কিছু করতে পারবেন না সুতরাং সদাজাগ্রত ধাকা সাইবারক্রাইম কে ঠেকানোর একমাত্র উপায় |

This mobile app or these apps are nothing but Team-viewer-type or remote-control software, through which or once you install it on your mobile and share your ID, the criminal will be able to read all the information of your mobile easily and then if you recharge a small amount, say, Rs. 10 /- , your PIN or other banking information will be visible to the criminal immediately and thereafter using your banking credentials the criminals will take out the hard-earned money from your account.

I keep saying this in different forums every day since long and it may be suffocating to say so, but still there are various complaints every day where people's hard-earned money is going out like this. In most cases, you are asked to install a remote application called AnyDesk on your mobile. In many cases it is heard that they send you some messages in advance as if the company has sent this message and then they will call you and tell you,” the message has been sent by the company. Now you install an app on your mobile and start doing as I say”. Be careful! Your money will be stolen from your account and Your account will be empty.

In such a repeated and recurring situation, my humble request to you all, if any one calls from any phone and asks you to install a mobile app on your phone, don't do it because if you do, then the full control of your mobile will be taken away by the criminal sitting far away. There is nothing you can do, so the only way to stop cyber crime is being aware of the fact and restrain yourself from being fooled as well as cheated.

मैं हर दिन अलग-अलग मंचों में यह कह रहा हूं और ऐसा कहते कहते मैं थक चुका हूं, लेकिन फिर भी हर दिन विभिन्न शिकायतें हैं जहां लोगों की मेहनत की कमाई इस तरह से निकल रही है। ज्यादातर मामलों में, अपराधी आपसे अपने मोबाइल पर AnyDesk नामक एक रिमोट एप्लिकेशन इंस्टॉल करने के लिए कहते हैं। कई मामलों में वे आपको पहले से एक संदेश भेजते हैं जैसे कि कंपनी ने संदेश भेजा था, तो अपराधी आपको कॉल करेंगे और आपको बताएंगे कि जिस कंपनी से संदेश आया है वह आपको उस कंपनी से बता रहा है और आपसे अपने मोबाइल पर एक ऐप इंस्टॉल करने के लिए कहता है और वे आपको बताते हैं उनके बताए हुए जैसे काम करने के लिए | व्यास! आपका पैसा आपके खाते से साफ कर दिया जाएगा और आपका खाता खाली है जाएगा I

मेरा आपसे अनुरोध है कि यदि आपको कोई भी फोन करता है और आपसे अपने फोन पर एक मोबाइल ऐप इंस्टॉल करने के लिए कहता है, तो कुछ भी न करें क्योंकि यदि आप ऐसा करते हैं, तो आपके मोबाइल का पूरा नियंत्रण दूर बैठे अपराधी का हो जाएगा और आपकी गाढ़ी कमाई बाहर चली जाएगी| और आपको कुछ नहीं कर पाएंगे इसलिए साइबर क्राइम को रोकने के लिए अलर्ट रहना ही एकमात्र रास्ता है I

Government of India today through Ministry of Electronics & IT decided to ban 118 more apps after banning previously various apps including TikTok etc, in,light of the facts that these apps are engaged in activities which detrimental to "sovereignty and integrity of India, defense of India, security of state and public order."

There are thousands of free tools or opensource software which may allure you to hack others but what will be the aftermath or the consequence of the same. There are thousands of videos or articles in various online platforms which will make you at least half-hackers. But in those articles or videos, everyone will avoid their responsibilities by saying that they are doing for academic purposes. I am not telling every hacking is bad for society. I myself a supporter of whistle-blower. You know in India we have the Whistle Blowers Protection Act which guards the lawful Whistle Blowers in India from all sort of attacks. But not everyone is hacking ethically. Segregation of hackers may be as follows on ethical line:

Ø WHITE HAT HACKERS: A white hat hacker or ethical hacker who hacks ethically.

Ø GREY HAT HACKERS: A Grey Hat Hacker sometime hack for good purpose …..sometimes for bad purpose…. i.e. sometime ethical and sometime unethical.

Ø BLACK HAT HACKERS: A black Hat Hacker hacks for unethical purpose. That means they are purely unethical.

Now the million-dollar (sorry million rupees) question is, who then hacks ethically. What is the yardstick of ethics? What is the authority who judges what is ethical or what is not? In this article and other forthcoming part of this article, I will try to find out the answers. Now let us know various steps of hacking. Definitely hacking is an art, the mechanism or the ways should and would differ from hackers to hackers. The indomitable patience together with creative attitude in the application of in-depth knowledge of how to code ultimately shows the path of success. In my opinion people who uses various tailor-made software or hacking application to trick innocent spectators are not hackers, they are only the followers or copying machines. In my humble opinion, hacker, without creativity or urge to create or apply and design new algorithm of software application is no hacker. Anyway, the following steps are thought to be the broad areas which one hacker has to undergo:

Reconnaissance: where the Hacker tries to collect information about the target.
Scanning: Thereafter the hackers scan the collected data and find some vulnerabilities or weakness in the system…….
Gaining Access: After scanning, it is gain access to the system by using Phishing Attack or Metasploit…or other ways…..
Maintaining Access: After entering into the system hackers maintain their access for various future exploitation or unlawful activities.
Covering or Clearing Tracks: Lastly it is clearing various evidences of identifiable information which relate the hacker with the crime.
The most important preparation before embarking upon hacking for an hacker is to make himself/herself completely anonymous.

As per NITI Aayog Report by 2020 India will going to have 730 million internet users. As per other resources India stands at third position in terms of total netizen in the world. Majority of the cyber catastrophe or incidence of breach results from hacking. Hence the billion-dollar Cyber security industry is actually the brain-child of the hackers, be it ethical or unethical. Is it not to create a problem, find a solution and get a promotion? One might disagree with me, but it is my own humble opinion.

The hygiene of the cyber or virtual ecosystem is in the hands of the hackers be it for creating hazards or disinfect the hazards. Especially in this lockdown period, where the number of Cyber crimes is skyrocketing and which has been supported by the recent INTERPOL report, issuing purple notice to its various member countries.

The relevant laws in India on hacking are as follows:

1) Section 43, 43A of Information Technology Act, 2000 for contravention wherein if you are a victim you can have your relief for upto rupees 5 Crore before Cyber Adjudicator, and

2) Section 66 and 72A Information Technology Act, 2000 for offences wherein if you are a victim you can have your relief before your nearest competent Criminal Court.

Hacker and Cracker (ethical or unethical):

Indian Court In Abhinav vs. State of Haryana, Cr. Misc. No. 9245 of 2008, has defined the term “Hacker” and “Cracker” and made distinction between “ Hacker” and “ “Cracker” on the yardstick of mens rea or intention or motive in adjudicating the offence of hacking. Section 66 of Information Technology Act also supports this view as civil contravention of section 43 of Information Technology Act will be converted into criminal activity if the offender has fraudulent or dishonest motive. This concept of mens of rea in hacking will get further support in a foreign judgement (in DPP vs. Bignell (1998)), wherein the Court observed that mere access to any computer resources is not an offence.

In my next part of this article I will delve in details on hacking, its ethics and law etc. But before the conclusion of this part of article I must mention my view on a vary serious issue and that is the mushrooming ethical hackers in the society. In various televisions programs or online media, people are coming and self-styling them as so-called “Ethical Hacker”. Who says they are ethical hacker? Very sorry state of affairs for the society. In this lockdown period these people have a very good business in the backdrop of skyrocketing number of cybercrimes. I know that there are many institutions who are offering “Ethical Hacking” course and even helping would-be-ethical-hackers to obtain some foreign company certificate. I have gone through the syllabus of some of the courses. They are showing tricks to hack, but for the part of ethics they are putting students in complete dark as Indian law never allows any private person to go and hack someone’s system, with a label of “Ethical Hacker”. Sometime they handover some study materials wherein few of the foreign laws are discussed which have zero application in India. Thus, from these private institutions, “Ethical Hackers” are born who can not see the day of light in Indian legal platform. Then the big question is who can be called as ethical hacker in India? Is it police personnel? Do they all know how to ethically hack? Let us find out.

Latest Consumer Protection Law to Safeguard Online Consumers In India

Today, the major portion of consumers in India like the other developed and developing countries are purchasing or availing goods or services or attempting to purchase goods or services through the cyber world. On the above score, e-commerce industry has thrived its best in the last few years. Specially, in the present situation of prolonged lockdown, testing the very existence of civilization, when people are hardly going out of their houses or avoiding direct purchase from the physical market or the physical world, the business of the e-commerce industry is reaching its pinnacle. People at large in the society are purchasing goods or services through various online platforms which may be either direct e-commerce entity or market place of e-commerce entity. Everyday majority of contract are made through virtual world wherein some or every part of a valid contract is executed through virtual world. Though, the previous Consumer Protection Act, 1986 and our existing Contract Act does not provide any opportunity to lawfully adjudicate the consumer disputes or disputes relating to an online contract taking place in the virtual world, the Information Technology Act provides the following provision to somehow manage the situation which is as follows –

Section 10A: Validity of contracts formed through electronic means. -Where in a contract formation, the communication of proposals, the acceptance of proposals, the revocation of proposals and acceptances, as the case may be, are expressed in electronic form or by means of an electronic record, such contract shall not be deemed to be unenforceable solely on the ground that such electronic form or means was used for that purpose.

But still, we need a complete and appropriate legislature or statute to address the herculean tasks of proper adjudication of transactions in cyber world where consumers are more vulnerable than the real physical world as there is every bit of possibility in the virtual world that the entity representing themselves as a product seller or service provider may be fake or having false identity. And in the anonymous world it was more difficult to fix up the liability where the address, place of business etc. are absolutely virtual and not physical. In the above backdrop a well codified or a drafted law or statute was the need of the hour and to address the above issue we recently got the following law which is worth mentioning -

(1) Consumer Protection Act, 2019:

The following provisions are worth mentioning in light of today’s discussion:

SECTION 2: Definitions - In this Act, unless the context otherwise requires,

(1) "advertisement" means any audio or visual publicity, representation, endorsement or pronouncement made by means of light, sound, smoke, gas, print, electronic media, internet or website and includes any notice, circular, label, wrapper, invoice or such other documents;

7) "consumer" means any person who—

(i) buys any goods for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment and includes any user of such goods other than the person who buys such goods for consideration paid or promised or partly paid or partly promised, or under any system of deferred payment, when such use is made with the approval of such person, but does not include a person who obtains such goods for resale or for any commercial purpose; or

(ii) hires or avails of any service for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment and includes any beneficiary of such service other than the person who hires or avails of the services for consideration paid or promised, or partly paid and partly promised, or under any system of deferred payment, when such services are availed of with the approval of the first mentioned person, but does not include a person who avails of such service for any commercial purpose.

Explanation. —For the purposes of this clause —

(a) the expression "commercial purpose" does not include use by a person of goods bought and used by him exclusively for the purpose of earning his livelihood, by means of self-employment;

(b) the expressions "buys any goods" and "hires or avails any services" includes offline or online transactions through electronic means or by teleshopping or direct selling or multi-level marketing;

(16) "e-commerce" means buying or selling of goods or services including digital products over digital or electronic network;

(17) "electronic service provider" means a person who provides technologies or processes to enable a product seller to engage in advertising or selling goods or services to a consumer and includes any online market place or online auction sites;

(37) "product seller", in relation to a product, means a person who, in the course of business, imports, sells, distributes, leases, installs, prepares, packages, labels, markets, repairs, maintains, or otherwise is involved in placing such product for commercial purpose and includes—

(i) a manufacturer who is also a product seller; or

(ii) a service provider,

but does not include—

(a) a seller of immovable property, unless such person is engaged in the sale of constructed house or in the construction of homes or flats;

(b) a provider of professional services in any transaction in which, the sale or use of a product is only incidental thereto, but furnishing of opinion, skill or services being the essence of such transaction;

(c) a person who—

(I) acts only in a financial capacity with respect to the sale of the product;

(II) is not a manufacturer, wholesaler, distributor, retailer, direct seller or an electronic service provider;

(47) "unfair trade practice" means a trade practice which, for the purpose of promoting the sale, use or supply of any goods or for the provision of any service, adopts any unfair method or unfair or deceptive practice including any of the following practices, namely:—

(i) making any statement, whether orally or in writing or by visible representation including by means of electronic record, which—

SECTION 17 : Complaints to authorities.- A complaint relating to violation of consumer rights or unfair trade practices or false or misleading advertisements which are prejudicial to the interests of consumers as a class, may be forwarded either in writing or in electronic mode, to any one of the authorities, namely, the District Collector or the Commissioner of regional office or the Central Authority.

SECTION 35: Manner in which complaint shall be made. –

(2) Every complaint filed under sub-section (1) shall be accompanied with such fee and payable in such manner, including electronic form, as may be prescribed.

SECTION 38: Procedure on admission of complaint. –

(4) For the purposes of sub-sections (2) and (3), the District Commission may, by order, require an electronic service provider to provide such information, documents or records, as may be specified in that order.

SECTION 65 : Service of notice, etc. - (1) All notices, required by this Act to be served, shall be served by delivering or transmitting a copy thereof by registered post acknowledgment due addressed to opposite party against whom complaint is made or to the complainant by speed post or by such courier service, approved by the District Commission, the State Commission or the National Commission, as the case may be, or by any other mode of transmission of documents including electronic means.

(2) Without prejudice to the provisions contained in sub-section (1), the notice required by this Act may be served on an electronic service provider at the address provided by it on the electronic platform from where it provides its services as such and for this purpose, the electronic service provider shall designate a nodal officer to accept and process such notices.

SECTION 94: Measures to prevent unfair trade practices in e-commerce, direct selling, etc. - For the purposes of preventing unfair trade practices in e-commerce, direct selling and also to protect the interest and rights of consumers, the Central Government may take such measures in the manner as may be prescribed.

SECTION 101: Power of Central Government to make rules. - (1) The Central Government may, by notification, make rules for carrying out any of the provisions contained in this Act.

(2) Without prejudice to the generality of the foregoing power, such rules may provide for, —

(q) the fee, electronic form and the manner of payment of fee for filing complaint under sub-section (2) of section 35;

The above provision in the newly passed Act includes within the ambit of consumer protection law, the transactions by consumer in the virtual world. This statute is also meant to protect the consumers dealing in online world.

(2) Consumer Protection (E-commerce) Rules, 2020:

The following provisions of the Rule provide the ambit of the Rule and amongst that the most important is the proviso clause which is as follows –

“2. Scope and Applicability. – (1) Save as otherwise expressly provided by the Central Government by notification, these rules shall apply to:

(a) all goods and services bought or sold over digital or electronic network including digital products;

(b) all models of e-commerce, including marketplace and inventory models of e-commerce;

(c) all e-commerce retail, including multi-channel single brand retailers and single brand retailers in single or multiple formats; and

(d) all forms of unfair trade practices across all models of e-commerce:

Provided that these rules shall not apply to any activity of a natural person carried out in a personal capacity not being part of any professional or commercial activity undertaken on a regular or systematic basis.

(2) Notwithstanding anything contained in sub-rule (1), these rules shall apply to a e-commerce entity which is not established in India, but systematically offers goods or services to consumers in India.”

That means if we go by the Rule 2(2), the big e-commerce companies which though not established in India but systematically offers goods or services to Indian consumer will also come under the purview of this rule. This is significant in light of the never-resolved jurisdiction issue in the cyber world as well as e-commerce industries. The e-commerce industries should not be spared on the practical difficulties as they have not establishment in India. This Rule also differentiates the platforms on the following ways –

(i) E-commerce entity and

(ii) Market place e-commerce entity

In light of anonymity and ambiguity in fixing the details of the details of e-commerce companies, the Rule 4(2) is very progressive and important one. The Rule 4(2) is as follows –

“4. Duties of e-commerce entities. ---

(2) Every e-commerce entity shall provide the following information in a clear and accessible manner on its platform, displayed prominently to its users, namely: --

(क) legal name of the e-commerce entity;

(ख) principal geographic address of its headquarters and all branches;

(ग) name and details of its website; and

(घ) contact details like e-mail address, fax, landline and mobile numbers of customer care as well as of grievance officer.”

There are other provisions in the Rule 4 relating to the definitions of the e-commerce entity, establishment of adequate grievance redressal mechanism, appointment of grievance officer, no scope of improper cancellation charges, explicit and affirmative actions from the consumer in proving their consent, appropriate refund mechanism, prohibition of any kind of manipulation int the price of goods and services and prohibition of any kind of discrimination between the consumers of the same class.

The above Rule specially in Rule 5 has defined the liabilities of the market place e-commerce entities in tune with section 79 of Information Technology Act.

Rule 6 provides the duties of seller’s on market place and among the various sub-rules, the following sub-rule is important –

“6. Duties of sellers on marketplace. –

(3) No seller offering goods or services through a marketplace e-commerce entity shall refuse to take back goods, or withdraw or discontinue services purchased or agreed to be purchased, or refuse to refund consideration, if paid, if such goods or services are defective, deficient or spurious, or if the goods or services are not of the characteristics or features as advertised or as agreed to, or if such goods or services are delivered late from the stated delivery schedule: Provided that in the case of late delivery, this sub-rule shall not be applied if such late delivery was due to force majeure.”

Finally, Rule 8 provides the execution of the Rule or the enforceability of the Rule which is as follows –

“8. Contravention of rules. — The provisions of the Consumer Protection Act, 2019 (35 of 2019) shall apply for any violation of the provisions of these rules.”

The above law in my view though not a complete code on the adjudication of the activities of E-commerce industry but definitely a Safeguard to the Online Consumers in India

Do we really have a Data-Independent / Data-Sovereign Country?

DATA AND THE MODERN ERA:

It is accepted that Data is the ‘Air’ or ‘Oil’ of the modern ear. An individual, along with his biometric or other personally identifiable information or data, is represented by a Data packet. There are people who are called as data brokers who deal with (collect, package, and even sell out) different types of Personally Identifiable Information of us i.e. our name, picture, contact details, location data, race, sexual orientation, genetic information and face orientation etc., without our permission or knowledge though we own those data. Even the different e-commerce and social site companies are collecting, storing and tracking our data. Our every purchase, every journey, every likes and dislikes, hobbies, thinking and thus every part of our life are digitised, tracked and logged.

The corner stone of all the laws in the world is human dignity but the modern-day technology especially artificial intelligence, Big data analytics etc. have posed a great challenge to various aspects of social justice, especially in the field of right of privacy. A few years earlier an analytic company had shown the world the nightmare of data analytics. Online social media organisations are collecting our shared information and making our virtual identification and thus controls our independence, autonomy and human right. Can you imagine that a simple algorithmic failure will destroy or jeopardize our valued human rights.

SCENARIO IN INDIA:

In Justice K.S.Puttaswamy (Retd) vs Union Of India, Hon’ble Supreme Court of India, overruling Kharak Singh and M.P. Sharma, on 24th August 2017 delivered a historical judgement by observing :

“Privacy constitutes the foundation of all liberty because it is in privacy that the individual can decide how liberty is best exercised. Individual dignity and privacy are inextricably linked in a pattern woven out of a thread of diversity into the fabric of a plural culture.

298. Privacy of the individual is an essential aspect of dignity. Dignity has both an intrinsic and instrumental value. As an intrinsic value, human dignity is an entitlement or constitutionally protected interest in itself…………………”

IT IS DATA -WAR ALL-AROUND!

The more data/ information one possesses, the more powerful he or she is in this world. Big data and analysis of the same with Artificial intelligence is now important part of cyber warfare of a country.

It is alleged that our personal data, our important national security data might be at the hand of some foreign companies who are working at the mercy of some foreign nations, amongst whom there are enemy countries, as well.

As per section 70(1) Explanation Clause of Information Technology Act,2000: “For the purposes of this section, "Critical Information Infrastructure" means the computer resource, the incapacitation or destruction of which, shall have debilitating impact on national security, economy, public health or safety.”

CYBER TERRORISM:

Like the terrorism in the physical world, nation’s integrity, unity sovereignty can be at stake if cyber terrorism is committed. The impact of cyber terrorism may be mightier than terrorism with AK 47 or RDX in physical world. Section 66F of the Information Technology Act, 2000 has given a greater idea of what is cyber terrorism.

NATIONAL CYBER SECURITY POLICY:

The National Cyber Security Policy, 2013 envisaged for protection of national security in or through the virtual world. In the said policy, strategies were fixed for creating secure cyber ecosystem but there is every doubt how much of these strategies were implemented.

One of the objectives of the policy was as follows:

“To enhance the protection and resilience of Nation’s critical information infrastructure by operating a 24x7 National Critical Information Infrastructure Protection Centre (NCIIPC) and mandating security practices related to the design, acquisition, development, use and operation of information resources.”

Again, one of the strategies of the above policy was as follows:

“To develop a dynamic legal framework and its periodic review to address the cyber security challenges arising out of technological developments in cyber space (such as cloud computing, mobile computing, encrypted services and social media) and its harmonization with international frameworks including those related to Internet governance.”

Present government is working on NATIONAL CYBER SECURITY STRATEGY 2020 (NCSS 2020), the Proposed vision of the policy “is to ensure a safe, secure, trusted, resilient and vibrant cyber space for our Nation’s prosperity” and has also come with Personal Data Protection Bill.

The question remains, when our valued data are at the hand of a foreign entities in this age of globalization, do we really have any control on our data or do we really independent in our virtual world. As today everyone has two-fold identities, one is physical and another is virtual. Hence, we need to be independent and sovereign in our virtual world as well. I think there is every doubt……

Let us hope for the best. Let us celebrate our 74th Independence Day.

National Cyber Security Policy -2013

65B Certificate Format | Certificate u/s 65B Indian evidence act

In my earlier blog-post, I have discussed about the latest judgement by Hon’ble Supreme Court of India, wherein in the event the original device can not be produced before the Learned Court, the party proving the electronic evidence has to give statement u/s 65B of the Indian Evidence Act. We know that in electronic evidence collection, it is not always easy to bring the original device before the learned Court, as in most of the cases the data are collected from internet or virtual world, where the data are stored in various server whose location in many cases is beyond India. Section 65A of Indian Evidence Act says :

“The contents of electronic records may be proved in accordance with the provisions of section 65B.”

Hence everyone who wants to adduce electronic evidence and where there is no possibilities that the original device can be brought before the Court, Certificate under section 65B is a mandatory one. Hence everyone should know how to write or draft certificate under section 65B of Indian Evidence Act, 1872. Let us see the law as to what should be the content of Certificate under section 65B of Indian Evidence Act which is as follows:

In Anvar P.V. vs. P.K. Basheer and Others (2014) 10 SCC 473), Hon’ble Supreme Court of Indian has observed that under Section 65B(4) of the Evidence Act, if it is desired to give a statement in any proceedings pertaining to an electronic record, it is permissible provided the following conditions are satisfied:

(a) There must be a certificate which identifies the electronic record containing the statement;

(b) The certificate must describe the manner in which the electronic record was produced;

(c) The certificate must furnish the particulars of the device involved in the production of that record;

(d) The certificate must deal with the applicable conditions mentioned under Section 65B (2) of the Evidence Act; and

(e) The certificate must be signed by a person occupying a responsible official position in relation to the operation of the relevant device.

কম্পিউটার , মোবাইল , স্মার্টফোন ইত্যাদি দ্বারা আজ জ্ঞাতসারে বা অজ্ঞাতসারে কোন না কোন ভাবে দিনের কোন একটা সময় আমরা সাইবার জগৎ বা এই ভার্চুয়াল জগতের মধ্যে ঢুকে পরি এবং এই আষ্টেপৃষ্টে বাধা জগতটার ক্ষতিকারক দিক থেকে আমরা কিভাবে বাঁচব তা আমাদের সকলকেই জানতে হবে । আমার মতে প্রতিটি সাধারণ মানুষের সাইবার ক্রাইম থেকে বাঁচার জন্য নিম্নলিখিত বিষয়গুলো জানা এবং মেনে চলা উচিত :

প্রথমত: আমরা এই ধরণের অভিযোগ থাকলে নিকটাবর্তী থানায় অভিযোগ জানাতে পারি। কোলকাতার লোকদের সুখবর তাদের জন্য লালবাজারে নির্দিষ্ট সাইবার পুলিস স্টেশণ আছে। অন্যজায়গাতেও এর বিকল্প ব্যবস্থা আছে। কোন রকম অশ্লীল মেল বা পোস্ট যদি আপনার কাছে আসে সেক্ষেত্রে নির্দিষ্ট থানায় অভিযোগের সাথে ঐ মেল বা পোস্টের একটা প্রিন্ট দেবেন এবং আপত্তিজনক সাইটের ইউআরএল সংরক্ষণ করুন এবং তদন্ত কর্তৃপক্ষকে সরবরাহ করুন|ফেসবুকের বা অন্য সাইটের লগ ফাইলের ডেটা অক্ষত থাকা দরকার।

থানায় অভিযোগ জানানো ছাড়া ও তথ্যপ্রযুক্তি আইনের যে কোন ধারায় অপরাধ করলে ৫ কোটি টাকা পর্যন্ত ক্ষতিপূরণের জন্য অ্যাডজুডিকেটারের নিকট আবেদন করতে পারেন। অ্যাডজুডিকেটার হলেন রাজ্যের তথ্য প্রযুক্তি বিভাগের সম্পাদক ।

তথ্য প্রযুক্তি (পাবলিক দ্বারা তথ্যে প্রবেশ করার ক্ষেত্রে অবরোধ করার কার্যপ্রণালী এবং সুরক্ষা) বিধি 2009 অনুযায়ী কোন ব্যক্তি নির্দিষ্ট প্রদ্ধতিতে উপযুক্ত আধিকারীকের কাছে সর্বসাধারণের দ্বারা তথ্যে প্রবেশের ক্ষেত্রে ব্লক বা বন্ধ করার জন্য অভিযোগ করতে পারেন বা নোডাল আধিকারীকের মাধ্যমেও অভিযোগ করতে পারেন।

মনে রাখতে হবে ইন্টারনেটে তথ্যের কমবেশী ৬০ শতাংশ, পর্নোগ্রাফির সঙ্গে সম্পর্কযুক্ত তাই সাইবার আইন বিশেষজ্ঞদের মতে ভারতীয় শিশু বা নারীদের একটি বড় অংশ এর লক্ষ্যবস্তু হতে পারে। তাই ফেসবুক ইত্যাদিতে বিচরণ করার সময় সাবধানতা রাখতে হবে। চেনা বৃত্তের বাইরের বন্ধুদের সাথে সতর্ক হয়ে তথ্য আদানপ্রদাণ করা উচিত। নাবালক ও নাবালিকাদের ক্ষেত্রে চরম সতর্কতা বাড়ীর অবিভাকদের নেওয়া উচিত।

অদ্বিতীয় এবং অনুমান করা শক্ত এমন পাসওয়ার্ডগুলি নির্বাচন করুন। বড় হাতের অক্ষর, ছোট হাতের অক্ষর, সংখ্যা এবং বিশেষ অক্ষর ব্যবহার করে একটি পাসওয়ার্ডে সর্বনিম্ন 10 টি অক্ষর থাকা উচিত I আপনার পক্ষে মনে রাখা সহজ তবে আক্রমণকারীর পক্ষে অনুমান করা শক্ত, একটি সংক্ষিপ্ত রূপ তৈরি করুন I

বিভিন্ন অনলাইন অ্যাকাউন্টের জন্য কখনও একই পাসওয়ার্ড রাখবেন না। যদি একটি পাসওয়ার্ড হ্যাক হয়ে যায় তবে আপনার অন্যান্য অ্যাকাউন্টগুলি আপস করা হবে না |

খুব সহজ হলেও একই প্রশ্ন প্রত্যেকের মনে বারবার আছে যে সাইবার ক্রাইম কি | বলতে গেলে সাইবার ওয়াল্ডে অর্থাৎ ইন্টারনেটের মাধ্যমে যে জগৎটাতে আপনারও যাতায়াত করেন সেই জগতে যে সমস্ত অপরাধগুলো সংগঠিত হয় তাদেরকে সহজ ভাষায় সাইবার ক্রাইম বলা হয় | তাহলে এটাই দাঁড়ালো যে সাইবার জগতে ঘটে যাওয়া অপরাধকেই সাইবার অপরাধ বলে |

In simple word, Crimes committed and or occurred in cyber world or internet world or virtual world where you frequently travelled through internet, are cybercrimes. So, it turns out that the crime that happens in cyber world is called cybercrime.

আপনি সাইবার ক্রাইমের শিকার হলে, আইনের ভাষায়, আপনার অভিযোগ লেখার ব্যাপারে কোন নির্দিষ্ট ফরম্যাট বা রুপরেখা দেওয়া নেই | আমাদের অন্যান্য অপরাধের মতো সাইবার অপরাধ কে দু ভাগে ভাগ করা যায় | ধর্তব্য অপরাধ (Cognizable offence) আর অধর্তব্য অপরাধ (Non Cognizable offence) এবং যদি ধর্তব্য অপরাধ (Cognizable offence) হয় তাহলে আপনি সাদা পাতায় আপনার অভিযোগটি সহজ ভাষায়, (সেটা বাংলায় হতে পারে হিন্দি হতে পারে ইংরেজি হতে পারে বা আপনার মাতৃভাষা হতে পারে) থানায় অভিযোগ করবেন | আপনি মনে রাখবেন যে আপনার অভিযোগের সঙ্গে যেন যে অনলাইন সাইট গুলো নিয়ে আপনার অভিযোগ সেই সাইটগুলোর ইউ আর এল সমেত স্ক্রিনশট নিয়ে আপনি আপনার অভিযোগ জমা দেবেন | মনে রাখবেন অনেক মামলায় অভিযোগ জানানোর সময় বা তার আগেই অপরাধ যে ওয়েবসাইট থেকে হচ্ছে যেমন ফেসবুকের পেজ থেকে হচ্ছে তাকে ডিলিট করে দেওয়ার ব্যবস্থা করা হয় যার ফলে তদন্তের সময় ইউ আর এল পাওয়া যায় না আর যার ফলে আইপি অ্যাড্রেস বা ইনভেস্টিগেশনে আর বেশি এগোনো যায় না | তাই যখনই আপনি অভিযোগ জানাবেন আপনার অভিযোগের আগে রিপোর্ট করে পেজগুলোকে ব্লক করে দেবেন না তার আগে ইউআরএল সমেত স্ক্রিনশট নিয়ে আপনি রেখে দেবেন যাতে তদন্তের সময় ওগুলো আপনি পুলিশ অফিসার কে দিতে পারেন |

If you are a victim of a cybercrime, how do you report it?

If you are a victim of cybercrime, in the language of the law, there is no specific format or outline for writing your complaint. Like other crimes, cybercrime can be divided into two parts and they are cognizable offenses and non-cognizable offenses. If it is a cognizable offense, you can lodge your complaint on the white page in simple language (it can be in Bengali, Hindi, English or in any of your mother tongue). Remember to submit your complaint along with a screenshot of the offensive online sites which relates your complaint. Keep in mind that in many cases, at the time of filing a complaint or before the crime is committed, the website from which the crime is being committed is deleted by the victim or his or her relatives, so that the URL is not available during the investigation of the case and the IP address cannot be obtained or investigation cannot be further proceeded. So, whenever you make a complaint, don't try to delete or block the pages by reporting to concerned sites and preserve screenshots or evidence otherwise, with the URLs so that you can give them to the police officer during the investigation.

It is a settle fact that in our modern age, Data is oil or air of this virtually physical era, where we are more concerned about our virtual presence than that of physical one. (o) “data” means a representation of information, knowledge, facts, concepts or instructions which are being prepared or have been prepared in a formalised manner, and is intended to be processed, is being processed or has been processed in a computer system or computer network, and may be in any form (including computer printouts magnetic or optical storage media, punched cards, punched tapes) or stored internally in the memory of the computer;

Let us understand the duties of the intermediaries or third-party service providers under Information Technology Act, 2000 which is Indian Cyber law.

Social sites and other online service providers must comply followings:

SECTION 43A. Compensation for failure to protect data.–Where a body corporate, possessing, dealing or handling any sensitive personal data or information in a computer resource which it owns, controls or operates, is negligent in implementing and maintaining reasonable security practices and procedures and thereby causes wrongful loss or wrongful gain to any person, such body corporate shall be liable to pay damages by way of compensation to the person so affected.

Section 72A. PUNISHMENT FOR DISCLOSURE OF INFORMATION IN BREACH OF LAWFUL CONTRACT

Save as otherwise provided in this Act or any other law for the time being in force, any person including an intermediary who, while providing services under the terms of lawful contract, has secured access to any material containing personal information about another person, with the intent to cause or knowing that he is likely to cause wrongful loss or wrongful gain discloses, without the consent of the person concerned, or in breach of a lawful contract, such material to any other person, shall be punished with imprisonment for a term which may extend to three years, or with fine which may extend to five lakh rupees, or with both.

What is Sensitive Personal Data?

Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011

3. Sensitive personal data or information.— Sensitive personal data or information of a person means such personal information which consists of information relating to;—

(i) password;

(ii) financial information such as Bank account or credit card or debit card or other payment instrument details

(iii) physical, physiological and mental health condition;

(iv) sexual orientation;

(v) medical records and history;

(vi) Biometric information;

(vii) any detail relating to the above clauses as provided to body corporate for providing service; and

(viii) any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise: provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of these rules.

As per GDPR ARTICLE : 4

‘personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

‘personal data breach’ means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed.

Will and Passwords: Controversy:

In making the will of one’s digital asset the person cannot mention the

password or other sensitive data in his Will as the said will my be

exhibited in any proceeding and proved in open Court of Law when probate is obtained, which may create a huge security breach issue.

Aadhaar, Locking Biometrics and Inheritance:

Among billions of Aadhaar numbers generated as per UIDAI website, there might be Aadhaar number of people who has already been expired. The scope of cancellation of Aadhaar number is absent even after the death of a person, but there is option that biometrics of the deceased can be locked. As per UIDAI, any resident with valid Aadhaar can avail the locking feature which empowers an Aadhaar holder to lock biometric.

Law of inheritance in India:

Inheritance may be through following ways:

Person leaving an will, which is a legal declaration carrying the intention of the person making the will with respect to his property or estate which will take effect only after his or her death.

Or by

Hindu Succession Act, 1956

Indian Succession Act, 1925

Or other personal laws

Some Instances:

1) In 2005 Yahoo! was ordered by a Michigan Court, to release emails of deceased to his father.

2) In 2018, One Dubai forum ruled that Twitter, Facebook, and others social media should deliver digital data is accordance with a legal will.

3) In France and Canada the owner of the data can make will or access to their digital assets.

4) Inheritance of digital assets are accepted in other countries as well.

5) In India we do not have any law to that effect specifically covering the inheritance of digital asset.

Indian Cyber law presently dealing with data namely Information Technology Act has from its purview barred Will and other documents, more fully mentioned in the Schedule I of the Act. As per section 1(4) of the said Act:

“Nothing in this Act shall apply to documents or transactions specified in the First Schedule:”

As per THE FIRST SCHEDULE [See sub-section (4) of section 1] amongst the documents, the following one is beyond the purview of Indian Cyber law:

“A will as defined in clause (h) of section 2 of the Indian Succession Act, 1925 (39 of 1925), including any other testamentary disposition by whatever name called.”

As if we can make a will of our movable and immobile physical assets then why not we're going to make a will or if we're not going to make an will then what will be the future of our digital asset that is data, and or if we die without making any will of our digital assets like that of our other assets acquired or inherited in our lifetime, what will be the fate of our data i.e. digital assets.

For example, can we make a will of our cryptocurrencies where it is legal!

In our Google account we might have sensitive information relating to funds in Google Pay, refreshing memories in Google Photos, important documents in Google Drive -----All these and many more in other sites, ………….your heirs may demand for their right inheritance.

If we live, if we come to this world the death is tagged with our life so everybody has to go, everybody has to die, but we do not want to accept that. The most important point is, now the time has come to think about what will be the fate of your digital data after our death and how much our legal heirs will go to enjoy your digital asset just like other assets. What is the law of inheritance of digital assets in India? How those digital assets be inherited by our heirs when we will no longer be there? What will be the fate of our Facebook account or our online banking accounts or our every kind of online social sites accounts, our virtual accounts, our virtual activities,the private and secure data, the digital currency, the digital assets in many ways, and what are the safeguard so that your data, your private data your acquired data, which you are the owner and these online social service provider are only the custodian?

In the legal side the conflict that Information Technology Act does not apply in case of Will and there lies the controversy between the Law of inheritance in India and Information Technology Act …..the need for planning of digital asset is the need of the hour, just like the other existing physical assets…but we need specific law to that effect.
