İn its 1976 conference Dimbleby, Lord Hailsham warned of elective dictatorship. The only thing that, in modern times, prevent the UK becoming a dictatorship is the European Convention on Human Rights. This allows the citizen to challenge even an Act of Parliament on the basis that it violated the European Convention which, after all, the United Kingdom has solemnly agreed to respect international law. Indeed, the United Kingdom was among the first signatories of the Convention and the United Kingdom has adopted most of the memoranda of understanding between member states after the Council of Europe. A challenge to an Act of Parliament does not mean that courts may say that the law is null or "unconstitutional". Since the Law on Human Rights 1998, most courts can do is make a declaration of incompatibility and then it is for Parliament to address the incompatibility, for example, to amend the law. This way is called "the supremacy of Parliament" is maintained.
Just what does that "supremacy of parliament" entail? It means that Parliament may enact any law it wishes. According to the theory there is no mortal power which can prevent Parliament doing just what it likes. Here is a short list of things it has done in recent times. The list is based on the book "Just Law - The Changing Face of Justice - and why it matters to us all" by Baroness Kennedy of the Shaws QC.

Introduced internment without trial for non-citizens suspected of terrorist links - (later replaced by control orders);

repeatedly attempted to remove trial by jury - (attempts have usually failed only thanks to the House of Lords);

introduced retrial of those acquitted of certain serious offences, thus eroding the double jeopardy principle;

attacked the independence of the judiciary;

placed serious limits on access to justice through cuts to legal aid - (with even more to come);

streamlined extradition processes so that British citizens can be removed without insufficient protections.

The list is just a few of the things done by various elected Parliaments over recent times. The list could be extended several times over. The ability to use the European Convention on Human Rights has helped to moderate this tide of authoritarianism which has emanated from within British governments irrespective of political persuasion.

It is disturbing that the "Policy Exchange" think tank is urging Ministers to withdraw from the European Convention on Human Rights - see BRINGING RIGHTS HOME.

The document concludes that the time has now come for the UK government to consider whether or not it wishes to remain tied to an "inefficient, unaccountable and remote court" or "whether our own constitutional reforms have done enough to ensure that the British judiciary is itself capable of considering those questions as the final appellate court." They urge British governments to take great care to respect "core" human rights thereby reducing the scope for clashes with the judiciary such as those which developed in recent years. (The use of the word "core" suggests a minimalistic vision of what human rights entails in the modern world).

Next they wish the government to consider whether the present method of appointing justices to the UK Supreme Court provides for sufficient parliamentary scrutiny. "If Parliamentary Sovereignty is to remain the most important factor underpinning the legislative process, then Parliament must be able to consider what the views are of a candidate for the Supreme Court on how they are likely to interpret legislation ..."

Thirdly, the UK government should begin negotiations with the Council of Europe to make substantial reforms to the operation of the European Court of Human Rights. They wish to see the number of judges reflecting more accurately the populations of the 47 member States. Very importantly, they argue that the European Court should take a "strict constructionist" view of the meaning of articles and not use the "expansionist idea" of the convention being a "living instrument." On that view, the Convention's meaning would be stuck back in the 1950s which, by any reckoning was a very different time to the modern world. For example, it would not have been possible for the European Court to develop the concept of a "family" so as to bring within the concept groups of persons other than "man, wife and child."

They argue that in some areas - e.g. Article 8 (Privacy) - matters should be left entirely to national courts and in other areas there should be a very wide "margin of appreciation." Obviously, such developments would reduce the scope for the European Court to adjudicate in those areas.

They wish to see the proposed negotiations take no more than 2 years and, if they do not succeed (i.e. if the UK does not get its way), then the UK should consider withdrawing from the court's jurisdiction. It is highly questionable whether a Council of Europe Member State could simply withdraw from the court's jurisdiction whilst remaining a signatory to the convention and withdrawal from the Convention would necessitate withdrawal entirely from matters European (including the European Union). The economic consequences of that are probably incalculable at the present time.

A fourth proposal is that Parliament should repeal section 3(1) of the Human Rights Act 1998. This provides that "so far as it is possible to do so, primary legislation and subordinate legislation must be read and given effect in a way which is compatible with the Convention rights." Thus, we would be taken back to the strictly literalist approach for reading legislation which was once so close to the hearts of many a British lawyer.

justiciable" - (i.e. matters on which the judges will not or may not pronounce).

This is heady and dangerous stuff which is cleverly and persuasively presented so as to appeal to those who dislike various decisions which have gone against the U.K. The latest bête noire is prisoner voting. It will also appeal to power-seeking politicians for whom Parliamentary Supremacy is a "power-sustaining device." The time is coming for people to weigh in the balance the real consequences of allowing Parliamentary Sovereignty full sway - (given how demonstrably authoritarian it has already been) - and the check on Parliamentary activity which is ultimately provided by the European Court of Human Rights. Would a U.K. Supreme Court packed with Judges who are to the liking of the politicians meet the bill? Somehow, for all the siren voices, I doubt it

Continental Europe, the Anglo-American LAW WITH LAW AND AGENCY proceedings COMPARATIVE INVESTIGATION OF THE COURT

Continental Europe, the Anglo-American LAW WITH LAW AND AGENCY proceedings COMPARATIVE INVESTIGATION OF THE COURT
Around the Anglo-American Law within the framework of the theory of comparative law (Common Law), Legal Environment of Continental Europe with the style of one of the most important factors determining the form of legal thought özelliklerdir1. For example, the German Commercial Code are available in the "right and true view" theory (true and fair view) based on the true problem is not the same everywhere and the truth emerges. "Truth" Is it the same everywhere? This concept in the UK is the money? Here are the questions and issues like that, different legal environments olmaktadır2 cause.
Notable features of the method of legal thought in continental law, and all legal areas is based on abstract legal normlara3 olmasıdır4 been systematized. British Common Law 'when there is the traditional method of a law based on the event

Common Law 'in the courts of law and the development of previously issued in this way takes place depends on the decisions of the court. In contrast, Continental Europe 'in the development of the abstract and general rules of law in the form of putting çıkmaktadır6.
One of the general differences between the two legal environment, based on case-law of the science of the Common Law and Continental Europe, whereas olmasıdır7 scholastic science. Because England was dominated by lawyers at large, Continental Europe 'in the profesörlerdir8.
One other difference is related to the understanding comments. Continental Europe 'for the unforeseen problems, even if the norm is reached with the interpretation that what is envisaged. In the Common Law system, which the judge will reach a decision yakındır9 impossible to know in advance.
In addition, Continental Europe, corporate law in the abstract, the Common Law at the concrete is considered to be. In this context, Continental Europe 'eksizliği understanding of the legal system in question, while the Common Law' by examining the decisions to develop the most appropriate solution çalışılır10.
Common Law legal system and legal system of Continental Europe in this way after putting the basic differences, the continuation of the study, taking into consideration the scope of work in terms of law of Continental Europe, Latin and German legal circles within the framework of separation, and the organizations of the trial court proceedings on the properties of these two systems will be discussed.
PART ONE
Continental European Law
I. As General
The common feature that can be included in the legal community in continental law system, Roman law or Roman law may affect the historical process, these countries-affected countries to be expressed in terms of impact on other countries edilebilir11. To be sure, the legal problems of these countries in the Common Law System of countries, especially with the United States, mostly yakındır12. The biggest difference, in terms of judicial procedures and methods of solution çıkmaktadır13.
At this point, in Latin, French and Italian law as the basis of law in terms of environment, in terms of the German legal environment would be appropriate to examine the procedures for the trial of German and Swiss law.
II. LATIN LEGAL ENVIRONMENT
A. FRENCH JUDICIAL ORGANIZATION
French law, especially civil trial etkilemiştir14 many countries around the world. However, especially in Italy, the French Civil Code etmiştir15 serve as a model to various countries.
1. General Features and Principles
Ø The principle of independence and impartiality of Judge:
Impartiality of the judge, the judge could not be assigned automatically, just in case the decision may positively or negatively, and stated that this decision had to give eder16. The independence of the judge, that the administration karışamaması gelir17 judiciary. Both of these concepts, is applicable to judges, prosecutors, depending on directives in regard to becoming more limited as the uygulanır18.
Ø Recognition of equal procedural rights and defense of the right to:
Cases seen in the same procedural rights to parties the right to defend the well-known and provided in full. Equal recognition of procedural rights, files and documents to be seen, given the right to rest, gıyaptaki as a result of a decision to invite only be given in compliance with içermektedir19.
Ø The principle of public openness:
The principle of openness applies to the public for hearings and decisions. Yapılabilir20 hearing closed to the public for security reasons.
2. Courts Organization
There are two basic ayrım21 French judicial organization:
that law and criminal courts
that the courts of the Administration.
Arm of the courts of law and punishment, the court's first degree is a very special one. Subjected to discrimination in the courts of appeal, and other reference sheet date. Authority among the courts of first instance for resolving the problems to be resolved and a high court vardır22.
a. Law Courts
Law courts, courts of first instance, appeal courts (jurisdictions d 'coverage) and to the courts of appeals are divided into three.
Separation of the competent courts of first instance courts of general and special mention konusudur23.
Cour d 'appel, one court of second instance. Here, each step of the courts of first instance for vardır24 Senates.
Cour de cassation, the Union law aimed at ensuring that the courts and the appellate mahkemesidir25 above. The appellate court, five-law, three general, a trade, has a job and social security tribunal. Cour de cassation, supervises the implementation of law, not the event. The appellate court decision contrary to the court of revision düzeltmeyip, infects. After the recent reforms, appellate court also given the privilege of making the final decision. The appellate court decision to send back to the trial court and disrupt, but it is not connected to the first-instance court. The appeal court is given a different, an event gider26 general assembly.
b. Criminal Courts
Criminal courts, investigative judge and the appellate court's investigative office of the courts of his investigation and the decision may be subject to discrimination in the courts. Should be noted that the investigative judge in charge of the case till the opening. Necessarily the most competent person crimes investigative judge. Misdemeanor crimes and the involvement of discipline is weaker. If there is sufficient basis for opening an investigation of the case or the judge closes the file gönderir27 competent court for consideration.
Decision in terms of division, it is possible to say that the three basic distinction. Violation of laws, misdemeanors and offenses (criminal court is heavy.) Authorized a special bölümlerdir28 terms.
c. Administrative Courts

Administrative courts in general are similar to civil courts. There are more than one special court and a three-stage system mevcuttur29.
Conseil d 'Etat, court reporting and opinion organ.
Cours administratives d 'coverage, the administrative court of appeal niteliğindedir.
Tribunaux administratifs, administrative courts.
d. Dispute Tribunal (Tribunal des conflits)
The task was set up to resolve disputes about.
Negative jurisdictional disputes that count every step in case of dispute the court's self-görevsiz court judge to find a way permits. In addition, the court thinks görevsiz also send the case directly.
Positive task uyuşmazlıklarındaki administration, the administration of the courts the power to rape the other against their protected status.
Conflict court, one can give a decision on the status of the case, decisions about the dispute when it comes to the subject of the case revealed.
3. Law of Limitation of Roads
In France, the administration falls within the jurisdiction of the courts of individual types of litigation has led to problems counted. Therefore, the basic pillars of the French administrative law and public service to the public power, is also a measure kaçınılmazdır30 task.
4. Evidence Değerlendirilmesi31
French law on the evaluation of the evidence made a distinction between civil and criminal courts. Law courts interpret the regulatory process, but the law can not do moderation. Criminal courts, statutes and administrative jobs and interpret the law as well as the eligibility check. Indeed, trial in criminal cases, indispensable.
B. ITALIAN JUDICIAL ORGANIZATION
1. Ordinary Courts (Magistratura ordinara)
Civil and criminal jurisdiction of the courts in charge are as follows: Magistrate judge, magistrates court, court of First Instance, the Court of the application, the Appellate Court, Youth Court, Judge of Prisons, Prison Mahkemesi32. In this concrete case, the courts shall decide whether they are in charge.
2. Civil Procedure
Civil trial tasks in the first degree is organized in three stages.
Magistrate judge the most important tasks, a certain amount of money which is moved on the subject of articles on the subject of lawsuits and the money is still a certain amount of traffic conflicts.
Magistrate's courts, regardless of the value of the subject of controversy, the attacks on tenure, disputes over immovable properties, rent, lease revenue bonds and resolve disputes arising from joint possessions. In addition, magistrates' courts, tax, some family law work, not be determined if the value of the subject of controversy in charge.
Courts of first instance, magistrates and magistrates' courts, unlike the three judges judge, and decide together verirler33 acts.
First Instance Courts, magistrates 'courts and magistrates' court judge acts as a reference against the decisions. Court of First Instance against the decision of court of application of the high court. High court will decide if the delegation and the delegation of judges is composed of three judges.
Highly as the court of appeals court decisions of all applicants, in terms of the decisions of magistrates' court of first instance judge in charge of the decisions and the application may be made. Decision of the trial court referred to it will break again, with the opinions of the court of appeals in deciding bağlıdır34. CHAPTER TWO
Anglo-American Law (COMMON LAW) 60
I. ENGLISH COMMON LAW 'I

A. GENERAL FEATURES
English common law, including both the French legal environment of the continental European legal environment schemes, including both the continental European law, German law is quite farklıdır61 schemes. The basis of this difference, since British law, high courts in a very long historical process created by the event hukukuna62, in rare cases, the areas still held by the courts of law are discussed metinlerine63 dayanmasında lies.
Common Law ', some legal institutions, procedures and traditions very different from judging whether the difficulties encountered when comparing the Continental Avrupasındaki institutions. There are also Civil Code, Commercial Code, such as whether the Civil Procedure Law, the legal concepts that are systematically arranged in not in question. This technique of law legal system, legislation or interpretation of the law or the facts of life, not according to the conceptual determination of the court decisions are based on groups and events. In addition, this legal system carefully discussed issues of vital relations decisions taken under observation in a systematic manner and not abstract, concrete and gerekçelendirilmektedir64 historical perspective.
B. ENGLAND IN JUDICIAL ORGANIZATION
UK 'private law, expressed in their daily legal relations arising from the transactions edilmektedir65. Private law, contract and commercial law, tort law, property law, such as içermektedir66 areas.
Public law, constitutional and government bodies in various fields kapsamaktadır67 transactions.
In addition, the distinction between criminal and civil jurisdiction konusudur68 question.
In the UK courts inferior court first (lower court) and the superior court (the superior court), divided into two. There is a definite advantage in terms of duties and authority of the superior court. Therefore, the trial court in a case sub-tasks and sub-degree to the jurisdiction of the court to enter the opening with the top rating in court can be opened directly. However, the court in this case, the lower degree of upper degree gönderebilir69 court.
1. Lower Courts of Law Degree (Civil Inferior Courts) 70
These courts are available all over the country Magistrates 'Courts71 and Country Courts72' stop.
Magistrates 'Courts' is located in the magistrates have not studied law (justice of the Peace). Mainly on issues related to criminal law jurisdiction of those courts. Generally, small theft, extortion look at the events. Mümkündür73 proceedings usually simple to say that. Yoktur74 not have to have the jury members. However, the jury necessarily must have a severe punishment in case of a special court called the Crown Court75 authorized.
Private law relations, Magistrates' Courts are mainly responsible for family law. The amount of child support between the spouses, children inside or outside marriage, alimony request, the decision-making separation, custody rights over children, adoption is quite a wide range of issues such as the approval authority sahiptir76.
Country Courts' purpose flour, private legal relations of parties in disputes arising from them is less than the amount or value is to provide a solution as quickly as possible with a trial.

2. Top Degrees Law Courts
a. High Court of Justice77
High court of justice of the courts of first instance and the lower rating as the court of appeals is responsible for their decisions. Country Court 's High Court of Justice to place the end of the duty of the authority başlar78. Litigation over the issue of the value of the amounts of certain real property and equity cases in excess of the amount of certain cases in the High Court of Justice shall be authorized again. Despite all these rules, High Court Justice in a case judge wants to look at the lower values. In such a case, Country Court 'to send and not send a completely left to the discretion of this court.
b. Court of Appeal79
This court is overlooking the affairs of private law and criminal law consists of two separate affairs minister. High Court 's, Country to a certain extent, Court of criminal law and private law and the Court of Appeal to appeal against decisions about to apply. Here, the decision is based on the interpretation of legal checks. Yet the determination of fact by the court of first instance depends. This court does not accept new evidence, new evidence submitted tutmuştur80 subject to very stringent requirements.
c. House of Lords81
House of Lords, both England and Scotland and Northern Ireland have their own separate schemes for the court of the biggest high court. Court of Appeal in reviewing the applications against the decisions of court officials deadline. Vakıalarla this court can not decide on either accepts or rejects the application. Application is accepted, the case, again, the trial court to decide about the fact gönderilir82.

d. PRIVY Council
This institution rather than the court, the king or queen is an institution engaged in legal consulting. To base their decisions, not just British laws, as well as consideration of the case emerged in the country's local law alır83.
II. ORGANIZATION OF AMERICAN JUDICIAL
British law as a distinctive form of American legal thought etkilenmiştir84. However, in Continental Europe with the American civil proceedings civil proceedings, English law compared with the Continent Avrupasına, taşımaktadır85 more similarity.
The country's federal structure of American law, the courts system belirler86. One of the most prominent feature of this system, operating side by side at the federal level and the federated states, the courts varlığıdır87.
In the U.S. is not the only federated states, the federal government also has several court. Supreme courts, at the beginning of this comes from Court88. 18. century in the courts of first instance primarily Court89 District, then the Court of Appeal90kurulmuştur appeals court.
Federal court system of states is quite different. Simple events are seen by judges of peace. The judges are usually people who have not studied law. This procedure of trial judges use a very acid.
Large cities have Municipal Court. The more educated judges in courts, usually traffic works, small businesses look at criminal law and civil affairs. Every federal appellate court decisions gave them the state is high.

The majority of federal courts are the state of civil law relations. This work is authorized under certain circumstances these are the Federal Constitutional Court in counted. For example, if the U.S. side of the case, the trial of the case opens the federal laws based on one of the parties in different states, If they (if different from residence), the Federal Court yetkilidir91 exceeds a certain amount in the case.

CONCLUSION
Legal way of thinking in common with the historical past, the most important influence the formation of community law ölçütlerdendir. Of course in legal circles in the country, although many similarities in terms of court procedures sometimes differ from each other.
Continental European countries, including legal system when, in general, observed that the separation of public law and private law. In addition, the organizations of the court of first instance (civil courts, criminal courts, etc..) And is shaped as the top rating of the courts. French judicial organization, especially Italy, Germany and many European countries has affected the trial procedure and organization of the judiciary in these countries is of proximity.
Common Law System in the United Kingdom at the current organization of the judiciary and the judicial organization in the United States are examined, a significant feature of this system, unlike continental Europe of the rule of law and not by the rules of written law, "the event law" is shaped by the so-called criteria. Although the similarities between the trial procedure of the United States and Great Britain, the legal solution in terms of the methods of the U.S. system of Continental Europe to Britain is thought to be closer than that.

New laws to combat illegal immigration in the U.S.

New laws to combat illegal immigration in the U.S.
Earlier today a session in the Legislative Council study committee on fraud in public benefit programs revealed that fraud in unemployment compensation claims is likely to rise this year for the third consecutive year in a row as claims themselves rise. From the Milwaukee Journal Sentinel article on the issue:
Fraud in Wisconsin's unemployment insurance program between 2007 and 2009 more than tripled to $17.7 million, according to state figures. That figure will likely grow in 2010 as more jobless workers file for benefits amid continued high unemployment, increasing the opportunities for fraud, Bergan said. ...

Members of the committee such as Sen. Bob Jauch (D-Poplar) and Sen. Alberta Darling (R-River Hills) talked about the need to devote more state resources and effort to detecting fraud. They also discussed the possibility of empowering a state agency such as the Department of Justice to help prosecute some cases of benefits fraud that overworked district attorneys are currently unable to handle.
I have seen an increase in the number of telephone calls to my office of people being accused of fraudulently misreporting their unemployment claims and are distressed at the Unemployment Insurance Division's demand of repayment of large sums of money and the potential of criminal charges brought forth. I always advise people before they considering filing to ensure they are eligible because receiving benefits does not always mean you are eligible as the Department sometimes makes errors or the employer appeals demanding a hearing where an administrative law judge can overturn the investigator's decision which would result in repayment.

DOL Releases Fact Sheet on Break Time for Nursing Mothers Under FLSA

DOL Releases Fact Sheet on Break Time for Nursing Mothers Under FLSA
The fact sheet provides general information on the break time requirement for nursing mothers in the Patient Protection and Affordable Care Act (“PPACA”). From the fact sheet:

General Requirements
Employers are required to provide “reasonable break time for an employee to express breast milk for her nursing child for 1 year after the child’s birth each time such employee has need to express the milk.” Employers are also required to provide “a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public, which may be used by an employee to express breast milk.”

The FLSA requirement of break time for nursing mothers to express breast milk does not preempt State laws that provide greater protections to employees (for example, providing compensated break time, providing break time for exempt employees, or providing break time beyond 1 year after the child’s birth).

Time and Location of Breaks
Employers are required to provide a reasonable amount of break time to express milk as frequently as needed by the nursing mother. The frequency of breaks needed to express milk as well as the duration of each break will likely vary.

A bathroom, even if private, is not a permissible location under the Act. The location provided must be functional as a space for expressing breast milk. If the space is not dedicated to the nursing mother’s use, it must be available when needed in order to meet the statutory requirement. A space temporarily created or converted into a space for expressing milk or made available when needed by the nursing mother is sufficient provided that the space is shielded from view, and free from any intrusion from co-workers and the public.

Coverage and Compensation
Only employees who are not exempt from the FLSA’s overtime pay requirements are entitled to breaks to express milk. While employers are not required under the FLSA to provide breaks to nursing mothers who are exempt from the overtime pay requirements of Section 7, they may be obligated to provide such breaks under State laws.

Employers with fewer than 50 employees are not subject to the FLSA break time requirement if compliance with the provision would impose an undue hardship. Whether compliance would be an undue hardship is determined by looking at the difficulty or expense of compliance for a specific employer in comparison to the size, financial resources, nature, and structure of the employer’s business. All employees who work for the covered employer, regardless of work site, are counted when determining whether this exemption may apply.

Employers are not required under the FLSA to compensate nursing mothers for breaks taken for the purpose of expressing milk. However, where employers already provide compensated breaks, an employee who uses that break time to express milk must be compensated in the same way that other employees are compensated for break time. In addition, the FLSA’s general requirement that the employee must be completely relieved from duty or else the time must be compensated as work time applies. Beneficiary’s claim that account was ‘payable on death’ account despite decedent’s failure to finish paperwork before death survives demurrer.
A California Court of Appeals reversed the probate court’s decision in ADRIA E. UNDERWOOD v. VALERIE PEARCHE et al. The case involved $2 million from the estate of James Donald Gardner, who died on October 11, 2006. Appellant claims that the money should go to her and her daughter (decedent’s mother and sister) because that was the decedent’s intention, even though he didn’t complete the necessary paperwork prior to his death. Respondents (decedent’s ex-wives and children) claim that the money should go to his children. The probate court granted respondents’ demurrer, without leave to amend. The appellate court reversed this decision.

On January 23, 2009, Adria Underwood (decedent’s mother) filed a petition, to determine the ownership of the decedent’s property. She listed those with possible interests in the decedent’s estate as herself, Valda Pollard (decedent’s sister), Carmia Eldridge (decedent’s sister), Danielle Ricchiuti (decedent’s minor daughter), Mari Ann Ricchiuti (defendant’s ex-wife and legal guardian of his daughter), James D. Gardner, III (decedent’s minor son), and Valerie Pearce (decedent’s ex-wife and legal guardian of his son).

On June 14, 2006, decedent opened an account with Atlas Funds and deposited $1,008,661.80. On June 19, 2006, decedent opened an account with Wells Fargo Investments and deposited another $1,008,661.80 into that account. Appellant alleged that decedent “executed the necessary documentation for the Atlas account to be registered as a ‘payable on death’ account, with appellant and decedent’s sister (Carmia Eldridge), as equal beneficiaries of the account in the event of his death.”

By September 2006, decedent had transferred all money from both accounts into a Wachovia Securities account. Appellant alleged that “Wachovia staff had prepared an ‘application for registration of account in beneficiary form transfer on death direction,’ which would confirm that appellant & Eldridge were equal beneficiaries of the Wachovia funds.” Appellant alleged that Gardner died before he had a chance to sign the application.

On February 23, 2009, Mari Ann Ricchiuti (on behalf of her daughter), filed an opposition to the appellant’s petition. Ricchiuti claimed that because the decedent never completed the paperwork for the Wachovia accounts, they couldn’t be considered POD, despite the Atlas account’s documentation as such. She also claimed that “decedent never established POD terms for the Wells Fargo account initially, so there was nothing to maintain or transfer when the monies in that account were transferred to Wachovia.”

On February 25, 2009, Valerie Pearce (on behalf of her son) filed a demurrer to appellant’s petition. Pearce claimed that “appellant failed to plead with certainty whether appellant’s claim of the existence of a Totten trust of POD account is based upon ‘the terms of a written contract carried over from decedent’s Atlas account, or oral contract based upon decedent’s conversation with Wachovia employees, or a contract implied by conduct when Wachovia drafted an Application for Registration of Account in Beneficiary Form Transfer on Death Direction that was never executed by the decedent’.” Pearce also contended that appellant didn’t establish sufficient evidence to support the idea that decedent intended to create an express oral trust.

On March 23, 2009, appellant filed an opposition to the demurrer, stating that she had adequately pleaded facts to survive a demurrer.

On April 9, 2009, the probate court sustained Ricchiuti’s opposition and Pearce’s demurrer, without leave to amend. The court found that “as a matter of law, the failure to sign the form resulted in the failure to create a POD account.” They also concluded that appellant insufficiently plead the creation of an oral trust because she used the same facts to support the creation of the POD account. They said that “the intent to create one thing cannot be used to support the intent to create another thing.”

The appellate court, however, found that appellant’s allegations sufficiently support a cause of action. Unless you have been living under a rock over the past five years, you've heard that using a cell phone while driving, or text messaging, could dramatically increase your risk of an accident. These risks increase several times if you're using an Android, iPhone, Blackberry or any other smart phone.

It shouldn't take super smarts to understand that using a phone that allows you to surf the web, send e-mail, and perform a dozen different activities while driving, increases your accident risks. It will however take super smarts to figure out effective solutions that can combat these risks. Simply asking people to switch off their smart phones while driving does not seem to work as well as Las Vegas car accident lawyers had hoped.

Meanwhile, there's yet another study into the effects of distracted driving, specifically the use of cell phones and texting devices. This one comes from researchers at the University of North Texas Health Science Center. The researchers took accident and fatality data from state agencies, distracted driving accident data from the NHTSA, and cell phone and text messaging data from the Federal Communications Commission. They have concluded that there have been about 16,000 traffic accident fatalities between 2001 and 2007, all attributed to cell phone use and text messaging while driving.
Smart Phones Mean Not so Smart Driving
That is a staggering estimate, but it is highly likely that these are conservative estimates. Many states do not have policies in place requiring police officers to note down whether cell phone use was a factor in an accident. Several states, including California, have bans on text messaging or the use of handheld cell phones while driving. It's very possible that many accidents caused by distracted driving are slipping under the radar. It is highly unlikely that a motorist will come right out and admit he was texting or talking on the cell phone at the time of the accident.

The Texas researchers believe the accident risks from distracted driving have imploded with the popularity of smart phones. The typical iPhone for instance, has thousands of applications that you can download that allow you to do everything from making a reservation at the newest restaurant in town, sending an e-mail invite to friends, and looking up directions to get there, all at your finger tips.
Tuesday, June 8, 2010 by Emery B. Ledger
The United States population is aging at a rapid pace. The government is worried about how they are going to provide Social Security to the millions of Americans that become eligible to receive it every year. Companies have cut back on pensions because people are living longer and they can’t afford to pay them. Census date tells us that the percentage of people living in the United States over the age of 65 is three times higher than it was a century ago. That should be good news for those of us that haven’t reached our twilight years yet. With advances in medicine and better quality of life, we should be able to look forward to living longer and better lived. Unfortunately, that may depend on who is taking care of us when we get there.

Estimates are that by the year 2020, there will be over 55 million people in the United States over the age of 65. Those same estimates tell us that over 13 million of those will be over the age of 85. Not surprisingly, with the “graying of America” comes the need for more long term care facilities and long term care workers. While only about 8 percent of those between the ages of 65 and 80 require long term care, that rate jumps to over one-third for those aged 85 and older. So who is caring for our elderly and can we trust them to offer them the care and respect that they deserve? If you feel that you loved one has been injured by negelect in an nursing home contact a lawyer as soon as possible.

Many long term care facilities do an excellent job of taking care of our elderly. They abide by state and federal regulations and hire only conscientious and caring employees. Sadly though, there are far too many facilities that do not follow regulations and do not screen their employees well. This then leads to a variety of forms of elder abuse. Elder abuse can be physical, emotional or financial. Neglect and mistreatment are also forms of abuse of the elderly. All too often, the employees working at a long term care facility have not had the proper training or have not been screened well enough to be given the enormous responsibility of caring for elderly patients. Many times, a staff member may simply be having a bad day and their anger or frustration gets taken out on an elderly patient. Occasionally, the situation is worse and a facility is blatantly ignoring the needs of its patients and appears to only be worried about cashing their checks each month.

While long term care facilities are generally required to have licensed physicians and nurses on staff, the people that are actually caring for your loved one may not even be certified, must less licensed. Whether they are certified or not, if they are employed by the facility then they are expected and required by law to abide by the rules governing long term care and are expected to treat our elderly with care, compassion and dignity. If they breach that duty, then they – and the facility for which they work – may be liable in a personal injury negligence lawsuit. A Personal injury lawyer will evaluate your claim. A negligence lawsuit brought by an elder abuse attorney may require the caregiver and/or facility to compensate your loved one for any injuries they have suffered as well as hold the facility accountable for their mistreatment of your loved one.

These suggestions were passed on to me by an excellent, experienced attorney who wishes to remain anonymous:

1. In jury selection you will be engaging in several efforts at once -picking the jurors who are best for your case, educating the jury, developing your challenges for cause, figuring out who these people are, and letting the jury know you are way cooler than the DA. On challenges for cause, when you develop them the judge may swoop in and try to rehabilitate the juror by asking, "You will follow my instructions, won't you?" in some menacing fashion from on high, black robe billowing. If this happens during your voir dire, you can may still be able to ask the juror afterwards about his or her original concerns, and revive the challenge. If a juror says "I think I can be fair" or answers the judge's questions (or yours or the DA's) in an equivocal way that's not enough to avoid the challenge for cause. (People v Arnold [96 NY2d 358, 363]). Make sure that your challenge is on the record - in case the judge incorrectly denies the challenge.

If a judge tries to rehabilitate the jurors as a group with general questions after you're done, you should object or oppose this, and ask for the judge to do individual voir dire as to the individual issues. If the judge refuses to do that, you may have an issue to preserve. More on that below. You should also ask for an opportunity to question the jurors again if the judge rehabilitates them. Yes, t.This may irritate the judge, but that's not the goal. If the judge doesn't let you question after the judges' questions, in the next pass (if there is one) ask the jurors, if they have expressed a concern that presents a challenge for cause, to remember that concern if the judge asks them at the end of your questions whether they can follow his/her instructions.

If you have a challenge for cause issue you want to preserve for appeal (meaning that you believe that the court incorrectly denied a challenge),
YOU MUST EXHAUST YOUR PEREMPTORY CHALLENGES.
Be aware, this can be scary stuff. You have to use all your perempts, but you don't want to have lots of jurors left to select when you do this (unless it's a case you are unlikely to win and this is your best issue). You may wind up where the DA has challenges left and you don't. So you'll have to weigh how important preservation of this issue is against what your jury pool is looking like and your feelings
about the case.

2. Jury instructions: As you try more cases, you will learn about the different kinds of jury instructions you may request. It's worth taking a look at the CJI and scanning the charges of general applicability. (http://www.nycourts.gov/cji/index.htm). You can weave some of the language and issues into your cases.

Among the charges you should check out: (I'm not sure if these are the
exact titles in the CJI)
1. Credibility - this will almost always be read to the jury. It helps to know what the jury will be hearing
2. Expanded identification - one witness identification case - you should request this instruction in a one witness ID case.
3. Circumstantial evidence - moral certainty - read this one.
4. Drug trafficking expert - for when the cop testifies as an expert, this instruction reminds the jurors a cop is still just another witness who can be believed or not
5. Consciousness of guilt
6. Failure to promptly complain
7. Justification - regular and use of deadly physical force.
8. Missing witness

Many charges have legal requirements you must meet in order to get the charge. Sometimes judges mix them up. If you are basing your case on a charge, or part of your defense on a charge, such as missing witness, justification, failure to promptly complain, identification, make sure you read the case law about when you're entitled to that charge (or ask one of the more experienced attorneys to give you the cases or point you in the right direction). Please be aware, with respect to justification, that if the court concludes that you're not entitled to the charge based on the body of law on justification (and courts will reach this conclusion at
times) you won't get the charge. With missing witness, even if the judge doesn't give the charge, you can still argue it. Also with missing witness - careful what you wish for - you have to ask for it at an early enough point in the case that the DA can have the opportunity to bring the witness in. And they might. (For specific phrasing on the timing requirements, check the case law.)

Please also be aware that if you put on a case, the DA may seek a missing witness charge against you if there's a witness you didn't call, who was not cumulative, who would be expected to testify for you, and who was available.

When You Are Faced With a Debilitating Vehicle Injury

What the future holds for second DUI offenders and their license in CA
Saturday, June 5, 2010 by Matthew J. Ruff
Last year the california legislature enacted the assembly bill that would allow a second time DUI offender to get a restricted license after only a 90 day suspension, this marks a huge departure from the normal suspension that is one year according to a Seal Beach DUI Attorney . The new law effectively reduces the period of mandatory suspension on a second DUI from two years to 90 days and the DMV will have to give the CDL back or face a violation of the law. But how does the suspension relate to the APS order that may have also been imposed? That is the question many DUI lawyers are asking but answers are not forthcoming.

The new law goes into effect in July and I guess we DUI lawyers will have to wait until then to see how the law will be laid out. Your comments about the DUI law will be appreciated, both good and bad. Lastly, many have asked whether people that refused a test would also be eligible for the reduced suspension, again, we will need to wait until July to see how the DUI gods will look down on us.

FERS & CSRS Disability Retirement: Waiting

Saturday, June 5, 2010 by Robert R. McGill
Waiting for a decision to be rendered by the Office of Personnel Management for a submitted Federal Disability Retirement application, either at the Initial Stage of the Process, or after filing additional medical documentation and legal arguments at the Reconsideration Stage of the process, can be an agonizing time. It

is easy to say, "Patience is the key", when each day passes without a word. A call to the Office of Personnel Management will rarely yield any positive results. Yes, there are some supervisors and contacts which can be helpful in the process, but ultimately too much undue pressure can sometime backfire. Is there a statutorily mandated time-frame within which OPM must respond and make a decision? Normally, they will inform you that they try and make a decision within 90 days of whatever the beginning of the time-frame they ascribe, but it can take much longer. The key to the entire process is to survive the time of waiting, however long that may take. Survival is best endured if one recognizes at the beginning of the process, that this is one process which can take a long, long time.
Thursday, June 3, 2010 by Michael R. Reitman
A DUI offense is a serious charge with potentially long-term consequences. You need to be confident in your choice of representation and certain that your New Jersey drunk driving defense law firm will fight for the compensation you deserve.
To aid your research in finding the right New Jersey drunk driving lawyer to represent you, consider these tips from Tobin, Reitman, Greenstein, Caruso, Wiener & Konray.

Research tips on selecting a DUI attorney in New Jersey

Look online
You may be able to get a quick overview of your options by researching for New Jersey drunk driving defense firms on the Internet.

Request law firm info
Many New Jersey DWI law firms are happy to provide you printed or electronic material about them. Most firms would also entertain your questions to evaluate their abilities as your potential NJ accident law firm.

Prescreen prospective law firms
Before going to the time and effort of meeting with several firms, call your top choices and ask some basic questions in order to evaluate the law firm’s potential. Questions might include the following:

•How long has your practice been in existence?
•How many DWI defense cases have you previously represented?
•How many DWI defense cases has your firm won?
•How does your firm charge for its services?
•Have your attorneys handled cases similar to mine?
•Can you provide references?

Meeting with your selected New Jersey DWI lawyer
Your instincts, in addition to how the attorneys at a firm make you feel, are vitally important to selecting the firm that best represents your interests. Discuss the attorneys’ current caseload. A large caseload indicates the respect and trust that clients put in the firm, but it may also mean you are sacrificing individual attention if the caseload is too large. It is important that you receive the personal guidance and advice your case requires.

A New Jersey drunk driving defense firm that will fight for you
Not all firms have the same reputation that Tobin, Reitman, Greenstein, Caruso, Wiener & Konray have earned.
Choosing a local Fountain Valley personal injury attorney can be a big advantage when going to a local OC court. Not only are local attorneys well known in the court system, they are also familiar with the local judges and juries, as well as California and local municipal codes and other regulations and laws specific to Fountain Valley. A local respected attorney in Fountain Valley can be a huge life-link when it comes to winning an accident or catastrophic claim. Using an Orange County injury law firm who has ties to that community and surrounding businesses is a good thing.

You also want to choose an accident attorney who has handled many personal injury claims and doesn’t let big insurance companies, like major corporations, such as cruise lines, tour boats and casino tour bus excursion conglomerates, and their attorneys step all over your legal rights. Hire an aggressive OC attorney who makes your opponents cringe when they have to go before them.
If you have been in a car accident and you have done any research on attorneys or car accident claims at all, you have probably come across the term negligence. But what exactly does negligence mean when it comes to car accidents, and how can you tell if a driver was negligent in causing your accident? If you know that someone was negligent and collided with you, then you will have what you need to decide to contact an attorney. A personal injury attorney can help you collect damage from the insurance, or the negligent driver.

Negligence is defined as the acting in a way that no rational person would act or failing to act in the way that any other person would. For instance, someone who drives under the influence of alcohol or drugs is certainly negligent. They are aware of the effect of alcohol or drugs on their behavior and yet they still choose to get behind the wheel of a car, intentionally putting hundreds or thousands of people at risk from their impaired driving. A drunk driving attorney can often prove negligence if the person was under the influence behind the wheel.

Another type of negligence that at attorney can help you with is failing to follow traffic laws while on the roadways. Failing to follow traffic laws that are put in place to keep drivers and passengers of vehicles safe is negligent, since the driver is aware that it is unsafe to break traffic laws. Your attorney may look at police reports and talk to witnesses to determine if the other driver was breaking traffic laws when the accident occurred. If traffic laws were clearly violated, your attorney may be able to prove that they were negligent and collect compensation for you.

A very common example of negligent driving is when a driver is allowing themselves to become distracted. This can come in the form of a driver talking or texting on a cellphone, or dealing with kids in the backseat of the car. There are some drivers who actually do their makeup and hair on the way to work and concentrate very little on the road. A car wreck attorney can help you to determine if the other driver was distracted.

Whatever type of negligent behavior that the other driver was exhibiting to cause your accident, an attorney is the first person that you should call after making sure that your medical issues are dealt with. You will probably have many expenses as a result of the car accident, which can include medical bills, physical therapy, medication, vehicle repairs and towing and storage, and an attorney can help you to make sure you receive compensation for all the costs incurred. Make sure that you contact an attorney early, as there may be a window you have to file in.

Dietary drug may cause liver damage

My LawyersFind a LawyerBy Practice AreaBankruptcyBusiness LawChild CustodyCriminal LawDivorceFamily LawImmigrationLabor & Employment LawPersonal InjuryReal EstateWills & ProbateMore... Dietary drug may cause liver damage
Tuesday, June 1, 2010 by Steven J. Klearman
The FDA issued a warning regarding the use of the marketed drugs Xenical and Alli. The warning identifies rare but serious liver injuries. Both weight-loss medications contain the active ingredient, Orlistat.

There are currently thirteen reported cases of serious liver injuries throughout the world. The United States currently accounts for only one reported case. Currently, a cause-and-effect relationship has not been established.

As a precaution and first step the FDA has approved new product labels, which outline the potential risks associated with the drugs. The agency lists and identifies symptoms users of the medications should be cognizant of. The symptoms include: itching, yellow eyes or skin, dark urine, loss of appetite, or light colored stools.

The small number of cases makes it difficult to establish a causal relationship between the use of the drug and liver injury. If there is a link, it will become more apparent as knowledge of the symptoms and potential risk disseminates among the people using the drugs.

Ervin Brown
Personal injury refers to physical harm as well as harm to the emotions and mind. The same standards of negligence, incompetence, or deliberate misconduct apply. Winston-Salem injury attorney B. Ervin Brown, II, explains some cases where personal injury may not necessarily be a physical injury.

People who suffer physical injury as the result of an accident, negligence, or deliberate actions of another may also suffer mentally or emotionally as the result of ensuing lost wages and high medical costs. The mental and emotional suffering may not be limited to the person who suffered the physical injury. Severe accidents can also affect the family members of the injured party.

This may be seen in wrongful death cases. Survivors may seek to recover from the loss of a family member, but may also seek to recover for trauma if they witnessed the family member maimed or killed. It should be noted that some courts require the other family member to be present at the time of the physical injury or to be in the same zone of danger. In the case of injury as the result of a drunken driver incident, some courts may allow for damages only from other passengers in the vehicle who may have been traumatized by the event.

When one spouse in injured, the other may be able to recover compensation for loss of society and companionship of the injured party.

If an injury was caused by intentional conduct, courts often allow the victim to recover for emotional distress even if there was no physical injury. Assault, kidnapping, or defamation of character do not usually involve physical injury.

Invasion of privacy or trespass may be seen as personal injury. For example, a teenage girl may be traumatized by the unwanted intimacy of a physical search by school officials.

Personal injury cases that do not involve physical injury are often far more complex and difficult to settle. Building a strong case requires time to conduct a thorough investigation and involve in-depth research on the part of an attorney.

How to Negotiate with Investors for Your Start Up Capital

Tuesday, June 1, 2010 by Doron F. Eghbali

Every start up needs lots of financial backing to build a brand and bring in customers or clients. Nonetheless, the sine qua non for starting up a business and successfully sustaining it is money. Many start up entrepreneurs wonder what would be the figure they should sacrifice to secure needed capital from investors. Although the answer is virtually different in each case, there are some guidelines to be strictly followed.

SOME GUIDELINES

1. Some Money Now, Some Money Later: Investors seek to value your start up and based on that valuation they decide whether and how much they should lend you money. Almost always, a start up with a website, business plan and entrepreneurs' aspirations is valued less than a profitable and viable business. As such, investors often ask for a bigger share of the pie in the beginning in the form of equity. This means in addition to low valuation of the start up you have to still give up more equity in your business. As a rule of thumb, you should never give up more than 20 to 30% of equity.

What you do is to raise some money in the beginning with low valuation and more equity largess. However, you will have to raise more equity later when your business has proved to some extent profitable and investors value your business higher.

In fact, if you have to give up more than 20 to 30% of equity in your start up- business to investors, then you had better stay on the sidelines and not launch your start up since at the end your business might be profitable but you will not see the profits.

2. Some Debt Some Equity: It is prudent to think of debt financing along equity financing to the extent possible and prudent. Debt could be straight or convertible. This means investors would have a chance to convert their debt to stocks if and when the company becomes profitable or goes public. The investors feel protected since they are often paid first even if the company goes under. However, you should pay higher than prevailing market interest rates to lure investors. In addition, debt financing might have serious tax consequences and as such your debt/equity ration should stay below 75%. This means you must have at least 25% equity in your start up.

Family law cases

Tuesday, June 1, 2010 by Patricia A. Trent
Family law cases are among the most difficult for a client to endure because the people involved are loved ones and the outcome of the case will have a lasting effect on the family. The Las Vegas family law attorneys of Trent, Tyrell & Phillips know that it is important to find a tough but caring attorney when you need help in a family law case.

Some family law attorneys in Las Vegas may not be tough enough to deliver the results that you deserve in your family law case. Others may provide impersonal legal counsel that does not take into account the emotions of the family members involved. The best option when faced with a family law case is to find a Las Vegas family attorney that can balance showing care towards your issue while aggressively pursuing your goals through settlement or litigation.

There are several steps you can take to make sure that you choose a family law attorney in Las Vegas who will show care toward your sensitive situation while remaining tough for your needs.

•Compile a list: Writing down what you want in an attorney makes the selection process easier. You definitely want to choose an attorney who has experience in the type of case you are faced with. You may also want to decide on how much you are willing to pay for the services of an attorney. When you have made a list of the criteria you want your attorney to address, it is time to start searching.
•Research and interview potential attorneys: Ask friends and family for suggestions for a suitable family attorney in Las Vegas. Search the Internet using the criteria you laid out in your list. When you have narrowed your choice down to a few possible Las Vegas family attorneys, set up an interview with each of them. During these interviews, take notice of how the attorney reacts to your questions and concerns. A caring but tough attorney will take the time to listen to the details surrounding your case and your goals and then offer a clear strategy for how he or she plans to achieve those goals.
•Make an informed decision: Once you have had a chance to meet with various potential family attorneys in Las Vegas, it is time to choose the one that best fits your needs. Review your original list as well as any notes you may have taken during your research and interview sessions. In the end, your decision should come from your gut. There should be one candidate that stands above the others, a Las Vegas family attorney that is caring but able to help you make tough decisions.

Sticker Shock to Appeal in Georgia, Part II -- The Case of Being "Two Days Late"

Tuesday, June 1, 2010 by Andrew Agatston
I received a phone call from an attorney in Kansas City last week, who had read my previous blog post about the unconscionable law passed by the Georgia General Assembly this session raising the cost of transmitting each page of documentation needed for our appellate courts to decide an appeal by -- if you can believe it -- 667 percent.

I called it "sticker shock" that will "close the doors to justice." He called it a few other things. He is assisting a client who has a meritorious appeal in Georgia, and when he called the county clerk's office to see how much it would cost to transmit the record to the Georgia court of appeals, the clerk of court told him $3,100.00.

The clerk also told him that he just missed the $1.50 per page charge by two days. Two days late means his client, if she can afford the appeal, will be charged $10.00 per page. Needless to say, this lawyer in KC, Missouri was stunned.

To Georgia legislators, this new fee is seen as . . . well, I can't start to explain what our legislators were thinking. To this KC lawyer, it felt like an administrative scam, it felt like a rip-off. But most of all I think his concern was his client would not be able to afford to appeal due to, in his words, his client being charged an amount that has absolutely no logical relationship to what transmitting the record to the court of appeals actually costs.

When a clerk of court can e-mail all of the documents in the court record to a lawyer -- for free -- but now charge that same lawyer's client $3,100.00 to print out the exact documents, something has gone haywire. To highlight the absurdity, he and I talked about what it would cost for him to fly first class to Georgia, offer to take the clerk's file himself to Kinko's and copy every page, bring the court file back to the clerk, then go have a five-star dinner somewhere. Without knowing his hourly rate, I estimate he could not that at least two times for the $3,100.00, depending on the restaurant he chose.

Cost of filing an appeal in Georgia? Priceless! Or should I say, Shameless!

Best regards.

Auto Accident Lawyers in Los Angeles

Tuesday, June 1, 2010 by Robert W. In Los Angeles, negligent drivers cause disastrous auto accidents nearly everyday. Accidents cause thousands of deaths and hundreds of thousands of injuries across the country every year.
McGill
Changes in life occur at critical times, and whether the critical time-period is determined by the medical condition, or other events, what is always important is to take the affirmative steps yourself, as opposed to waiting for events to spiral out of control. Rarely should one await for the Agency to "do something" which is advantageous to one's situation. In filing for Federal Disability Retirement benefits under FERS or CSRS, it is

important to always be the one to take the lead on everything -- from obtaining the proper medical documentation, to ensuring that the Agency is completing their portion of required forms, to making sure that a Federal Disability Retirement packet is fully and completed formulated, such that it will prove one's case by a preponderance of the evidence and meet the legal criteria for an approval. Time is of the essence in each Federal Disability Retirement case, especially when time conspires against one's own interests.
