Overturned Convictions Loom Over Menendez’s Corruption Trial

NEWARK — They were two of the most notable corruption convictions in recent political history, two entrenched New York power brokers seemingly brought to justice, their cases reverberating well beyond the wood-paneled walls of the Statehouse in Albany.

And in a span of less than three months, both convictions were overturned.

The legal turn of events in the cases against Sheldon Silver and Dean G. Skelos, the two former New York State legislative leaders, is almost certain to resonate in another corruption case unfolding just across the Hudson River in the federal courthouse here where the defendant is United States Senator Robert Menendez, a Democrat from New Jersey.

What has given Mr. Silver and Mr. Skelos a reprieve was the ruling last year by the United States Supreme Court overturning the conviction of the former Virginia governor Bob McDonnell. In its unanimous decision, the court severely narrowed the definition of the kinds of official acts a politician must perform to be considered as having partaken in an illegal quid pro quo.

Making phone calls, arranging meetings or offering support on an issue no longer qualified as an “official act” as defined by the court. Instead, an act had to be more directly tied to an elected official’s office, such as offering a government contract or writing legislation.

In all three cases, the indictments were filed before the Supreme Court ruled in the McDonnell case and Mr. Skelos and Mr. Silver were convicted before the Supreme Court ruled.

But Mr. Menendez’s trial had not started when the ruling was issued and his defense team considered the decision as providing a legal cudgel to have the senator’s case dismissed. They filed a motion in July, after Mr. Silver’s case was overturned, arguing that the McDonnell ruling “changed the legal landscape for bribery prosecutions” and that the indictment, as it stood, could not “be reconciled with the Supreme Court’s guidance in McDonnell.”

However, the judge hearing Mr. Menendez’s trial, Judge William H. Walls, denied the motion.

“Whether the acts alleged in the Superseding Indictment satisfy the definition of an ‘official act” under McDonnell is a factual determination that cannot be resolved before the Government has the opportunity to present evidence at trial,” Mr. Walls wrote in his decision.

But, he added, the court reserved the right to revisit the possibility of dismissing the case after “the conclusion of the presentment of evidence at trial.”

Yet as a result of the ruling by a federal appeals panel overturning Mr. Skelos’s conviction on Tuesday — attributed in large part to faulty jury instruction — as well as the decision in Mr. Silver’s case, legal experts say prosecutors in Mr. Menendez’s case have a well-defined higher bar to clear. And that bar needs to be carefully explained by the judge in his instructions to jurors.

“To put it another way, if Menendez had been tried before McDonnell, it almost certainly would have had a flawed jury instruction, the type that would have gotten reversed,” said Ricardo Solano, a former federal prosecutor.

The McDonnell ruling has “made it much more difficult for the government and it made it much more difficult to define actual acts that were taken,” said Michael Weinstein, a former trial attorney for the Department of Justice. “Not a setup, not a meeting, but a real action that the representative took. That’s a higher burden and a higher standard than had existed previously.”

The Menendez defense argued along the same lines in its motion.

The charges against Mr. Menendez stem from three separate issues that the government is attempting to show were official acts taken by the senator on behalf of Dr. Salomon Melgen, a wealthy ophthalmologist and donor from Florida, in exchange for lavish gifts and political contributions.

In one case, prosecutors say that Mr. Menendez personally intervened in visa applications for three of Dr. Melgen’s friends. Mr. Menendez is also accused of pressuring the State Department and Commerce Department to help resolve a contract dispute involving Dr. Melgen in the Dominican Republic. And in the third case, prosecutors say that Mr. Menendez pressured the Department of Health and Human Services to resolve a billing dispute involving Dr. Melgen.

In its motion, the defense argued that, “The acts in this case are even farther removed from McDonnell, as none of the official acts that Senator Menendez allegedly sought to influence were acts that he could take or that even could be taken by anyone within the Legislative Branch,” and that they would not fall under “official acts” taken by a senator, such as introducing legislation.

Mr. Menendez’s lawyers specifically cited Mr. Silver’s case, saying the “official authority” theory offered by prosecutors in that case, which a federal appeals panel found to be “overbroad,’’ was “the same theory that animates” the indictment in Mr. Menendez’s case.

Some legal experts said the rulings in the Silver and Skelos cases were actually somewhat of a gift to prosecutors and Judge Walls because it offered more clarity about how higher courts are interpreting the McDonnell decision.

“If you think about Menendez now, it has the guidance of both the McDonnell decision and the Second Circuit in Silver and Skelos,” said Shira A. Scheindlin, a former federal judge, referring to the court that overturned both convictions. “The judge knows exactly what the charge has to be.”

The same, she said, goes for prosecutors.

“They can read this and if they haven’t put in some evidence and they now think they have to, or if they haven’t, they will,” she said, referring to the Skelos opinion. “The prosecution benefited from the timing, because they know exactly what they have to do to get a conviction and make it stick.”

Perhaps mindful of the legal landscape, the prosecution has been exceptionally explicit in detailing the timing of the reported gifts from Dr. Melgen and the actions said to have been taken by Mr. Menendez. “Pay close attention to the timing in this case,” Peter Koski, the lead prosector, said in his opening statement.

And the rulings overturning the convictions against Mr. Skelos and Mr. Silver, legal experts noted, were narrowly focused and do not mean that corruption cases against politicians cannot be won. In the Skelos ruling, the panel said that a properly instructed jury had enough evidence to render a guilty verdict.

“The court is not saying that politicians can do whatever they want, it’s just the instructions to the jury need to be really crisp as to what are official acts and what are not official acts,” said Jeff Cramer, a former federal prosecutor. “Skelos is going to be retried. Silver is going to be retried.”

Still, Mr. Cramer said, the McDonnell decision and the rulings that have followed have injected a level of uncertainty for prosecutors in all political corruption cases going forward, including Mr. Menendez’s.

“I don’t think any prosecutor who has been doing this for a period of time would have guessed that this would have been the outcome,” he said.

Spain: Police Dismantle 2 Russian Criminal Gangs; Arrest 11 for Money Laundering

Spanish police said Wednesday they dismantled two Russian criminal organizations and arrested 11 in connection with laundering more than €30 million (US$35 million).

Among the detained are Marbella Football Club’s President, Alexander Grinberg, and Arnold Tamm, a close associate of Semion Mogilevich, who has been on the FBI’s most wanted list since 2009 for a multi-million dollar fraud scam.

The statement claims that the criminals are members of two Russian gangs that established themselves in Spain and are suspected of having used Marbella FC, a water bottling company and a golf course in Malaga to launder over US$ 35 million.

Grinberg allegedly used the institutions as a “business card” to access political positions and entrepreneurs in the area to facilitate their activities.

After investigating the gangs for four years, police this week raided 18 properties in Malaga seizing large amounts of cash, 23 high-end vehicles, and various firearms among other items.

Those arrested will appear in court on Friday.

Costa Del Sol, in southern Spain which includes the city of Malaga has long been a hotspot of foreign capital and organized crime. Last month, Spanish police dismantled an international criminal network that used commercial flights to smuggle Iranian citizens into the UK arresting the majority of over 100 individuals in Malaga.

Business Leadership South Africa (BLSA) announces that it has today suspended the membership of both Eskom and Transnet with immediate effect.

This follows BLSA's engagement with the two state-owned enterprises in connection with extensive allegations of corrupt behaviour over a long period.

BLSA CEO Bonang Mohale said, "South Africans have been rightly disturbed in recent times at the numerous allegations of corrupt behaviour and colossal failures of corporate governance and accountability at both Eskom and Transnet.

This behaviour is entirely at odds with the values of BLSA, captured in our Integrity pledge. Neither of the SOEs were able to give BLSA comfort that they appreciated the seriousness of the issues at hand, or that they had the requisite will and purpose to put their houses in order. This left BLSA with no choice but to suspend their memberships from the organisation. We have to live by our values and will take a zero-tolerance approach to any organisation found in breach.

With regard to Eskom in particular, as the country's national electricity is a strategic asset and due to multiple governance and operational failures, and a stretched balance sheet, now represents systemic risk to the economy as a whole. Until and unless a non conflicted, experienced and permanent Chairman and Board are appointed - who in turn appoint an experienced and honest executive team - Eskom will loom large over the economy as a threat to stability and economic growth.

There are thousands of honest Eskom employees doing honest and brave work in the face of a seemingly endless pattern of corruption at the top."

BLSA repeats its earlier appeal that government should proceed expeditiously to set up the judicial investigation into State Capture recommended nearly a year ago by the then Public Protector, Thuli Madonsela. Any employees found to have been in breach of the law should be prosecuted.

Slovakia has a new legislation tool to combat the murky businesses of shell companies

In mid-September the state-run rail operator Železnice Slovenskej Republiky (ŽSR) withdrew from a controversial contract with Transprojekt on renting out Bratislava’s main railway station to Transprojekt for 50 years. This was not because Transprojekt had not fulfilled its promise to refurbish the dilapidated station, but because Transprojekt failed to meet its new obligation. It did not register with the so-called anti-shell register and has not demonstrated who is its real owner. This enabled ŽSR to withdraw from the contract. Now there is a chance of the stalemated reconstruction of the Bratislava train station moving forward. This is one of new anti-shell law’s first fruits.

“Along with central register of contracts, this register is currently the best tool for checking who is doing business with public institutions,” writes Gabriel Šípoš, head of the ethics watchdog Transparency International Slovakia (TIS), in his analysis of the new legislation’s impacts and benefits.

The Justice Ministry has prepared the Act on the Register of Public Sector Partners, also called the anti-shell law, with the aim of increasing transparency in the relations between the state and its business partners. Now anybody can simply monitor and check with whom the state is doing business and who is really benefiting from it. Companies publish their ownership structure in the register, up to the end beneficial owners, said Peter Bubla, spokesperson of the Justice Ministry.

“We believe that the goals [of the law] are being fulfilled,” Bubla told The Slovak Spectator.

The new law became effective on February 1. The register replaced the Register of Beneficial Owners, which was limited only to public procurement. The new legislation obliges public sector partners to be registered in the Register of Public Sector Partners maintained by the District Court of Žilina. This obligation pertains to entities receiving one-time funding not exceeding €100,000 or in the aggregate not exceeding €250,000 per calendar year, in the case of repetitive performance. Companies obliged to enter the register had time until the end of July to re-register from the Register of Beneficial Owners.

Based on the new legislation, a public sector partner cannot register directly itself. The registration must be performed via an authorised person, i.e. a law attorney, notary or auditor. The authorised person is responsible and must verify, along with the public sector partner, the correctness and completeness of a public sector partner’s data registered in the register.

Currently there are 12,732 companies in the register.

Interesting revelations

Following the transition period the Slovak media started digging into available data and uncovering the intricate ownership structures of some companies. The Sme daily has disentangled the ownership structure of the business group belonging to Andrej Babiš, the Czech politician of Slovak origin. And the Trend daily looked at who actually owns the Hornonitrianske Bane Prievidza (HBP) private mine, which supplies brown coal to the dominant electricity producer Slovenské Eleketrárne, generating electricity under a governmental support scheme, Šípoš pointed out.

In some cases the new tool has confirmed rumours or “backstage” information about who really owns which company, while in some cases the register has provided new findings. In other cases the published information has raised doubts and questions, said Bubla.

“In the latter cases we expect the lodging of a qualified complaint with the District Court of Žilina in order to find out in a subsequent proceeding whether the information in the register is correct or not,” said Bubla.

On September 27 Transparency International lodged complaints pertaining to about 60 companies in which the public functionaries were not properly determined, Šípoš told The Slovak Spectator.

“Only the verdicts of the District Court of Žilina will reveal whether the register will contribute to the uncovering of big fish,” said Šípoš, asking whether, for example, the owner of the Medical Group involved in the Pieštany CT scandal is really the lawyer Juraj Koval and not somebody around Pavol Paška. The latter, of the ruling Smer party, resigned from the post of the speaker of parliament after the scandal broke out.

Šípoš points out the two main changes the new register has brought about: the extension of competence, since the original one was limited to public procurement, and external verification via authorised persons. So now it is possible to have a look at whether the improved register has created greater transparency.

“While the first one has been beneficial from the very beginning, the verification through an attorney raises questions instead,” said Šípoš.

The fees authorised persons are asking for the verification procedure are quite high, while companies will have to repeat the procedure next year in case they do business with the state. Šípoš believes that it may be worth thinking of changing the current scheme so that companies themselves enter data into the register under the threat of high fines. Then the control and checking of data would focus on questionable firms.

Technical imperfections

Experience has shown that the good intentions of the new legislation is being undermined by the shortcomings in the large and useless administrative burden, the system’s technical problems and the unpredictability of the registering court, according to the Ružička Csekes law firm.

Ján Azud, a partner at Ružička Csekes, also points out that entering the members of top management into the register, in cases where for objective reasons it is impossible to determine the end beneficial owner, does not offer any added value in terms of the law’s objective but a huge administrative burden for supranational corporations.

“In the case of such companies, dozens to hundreds of people commonly meet the definition of ‘top management’,” said Azud.

Azud further mentions the issue of personal data protection, since the register and verification documents must contain the permanent residence of registered people. But foreign companies and their management are worried about their privacy since in their countries such addresses are not available in publicly accessible registers.

The Justice Ministry points out that this is brand new legislation without an equivalent even in Europe and it is logical that it has raised some questions in practice. The Ministry admits to the need of analysing this legislation’s effects and maybe reassessing its impact so that it does not increase companies’ red tape and costs above a reasonable level.

“It’s coming out that there are transactions that don’t need to be followed,” said Bubla, adding that this may change in the future.

The ministry is collecting all the complaints and comments on the law, and if their analysis reveals that some legislative changes are necessary, the ministry will change the law.

UN anti-corruption obligations. Role of Australia

The claim

Prominent barrister Geoffrey Watson SC has criticised Australia's failure to establish a federal anti-corruption watchdog, telling ABC's RN Breakfast that it puts us "out of step with our international obligations".

Mr Watson, the former counsel assisting the NSW Independent Commission Against Corruption, said: "Australia is a signatory to a United Nations declaration against corruption … We're a signatory to a convention. By failing to put in place an appropriately funded, appropriately skilled agency, we're in breach of that agreement as we speak."

He repeated the claim later that day in a speech to the Accountability and the Law Conference, arguing that the agreement "obliges Australia to create and maintain an independent anti-corruption agency" and that we "remain in breach of that obligation".

So are we in breach of our international obligations by not having a federal anti-corruption body?

RMIT ABC Fact Check takes a look.

The verdict

Mr Watson's claim that Australia is in breach of its treaty obligations is debatable.

Yes, Australia is bound by the United Nations Convention against Corruption, which includes a requirement to "ensure the existence of a body or bodies or persons" with the power to combat corruption "through law enforcement".

But the convention allows nations to use whatever system best suits their particular circumstances, and their approaches can be wide and varied.

In Australia's case, our "multi-agency" integrity system relies on a variety of state and Commonwealth bodies to investigate corruption in the public sector.

Included among these agencies is the national watchdog for investigating Commonwealth public sector corruption — the Australian Commission for Law Enforcement Integrity.

Experts and advocates are divided on whether this system is sufficient for Australia to comply with its treaty obligations, the result of their different interpretations of the convention's requirements.

Some argue that we will not be meeting our obligations until our system is made to be effective by being comprehensive.

For the Australian Commission for Law Enforcement Integrity to meet this expectation, its funding would need to be increased, its jurisdiction expanded and its ability to instigate investigations broadened.

Others say that simply by having federal law enforcement officials who are not subject to political interference could get Australia across the line.

And while they argue that a single, national watchdog might be desirable, it may not be necessary for meeting our obligations.

Most countries considered "cleaner" than Australia in terms of corruption do not have such a body.

What kind of conduct are we talking about?

Corrupt conduct is not necessarily the same as criminal conduct.

The Attorney-General's Department has described it as "one end of a continuum of other undesirable behaviours".

In fact, there is no agreed definition. One Senate joint committee noted that:

"While at superficial level there is a common understanding of what corruption means … [t]here is no internationally agreed definition of corruption; nor is there consensus about the range of activities that are seen to constitute corrupt conduct."

To keep it simple, Fact Check uses a definition from the global anti-corruption advocacy network Transparency International: "the abuse of entrusted power for private gain".

An example of this could be a politician granting "access" in exchange for money.

AJ Brown, the head of Griffith University's Public Integrity & Anti-Corruption research program and a board member of Transparency International Australia, told Fact Check that "the federal anti-corruption issue is focused very squarely on public integrity and anti-corruption for the Federal Government".

That means the conduct of public servants and parliamentarians.

What are Australia's international obligations?

The UN's Convention against Corruption imposes a wide range of obligations on its 182 participating states, covering areas such as corruption prevention, law enforcement and international co-operation.

Australia ratified the UN convention on December 7, 2005.

Mr Watson told Fact Check he was referring to the convention's Article 36, which states that:

"Each State Party shall, in accordance with the fundamental principles of its legal system, ensure the existence of a body or bodies or persons specialised in combating corruption through law enforcement. Such body or bodies or persons shall be granted the necessary independence, in accordance with the fundamental principles of the legal system of the State Party, to be able to carry out their functions effectively and without any undue influence. Such persons or staff of such body or bodies should have the appropriate training and resources to carry out their tasks."

Australia's approach to fighting corruption

A national anti-corruption watchdog has been on the agenda for many years. The Greens, for example, have introduced three Bills on the subject since 2010.

In January 2017, leading lawyers and academics penned an open letter calling on Prime Minister Malcolm Turnbull to establish a federal anti-corruption body.

A Senate Select Committee is again considering the idea and is expected to report its findings this month.

The Commonwealth Government remains opposed to creating such a body, with the Attorney-General's Department arguing in favour of the current multi-agency approach:

"Dispersing responsibility for anti-corruption between a range of agencies promotes accountability and transparency and protects against abuse of power within Australia's anti-corruption framework. Agencies responsible for combating corruption have also developed expertise and institutional knowledge for dealing with specific corruption risks."

At the state level, specialist anti-corruption bodies have existed for some time. They are focused on corruption in the state public sector — including, in some cases, state parliamentarians — but have varying powers; for example, in their ability to initiate investigations.

These bodies are not courts but some can recommend that charges be laid.

At the Commonwealth level, responsibility for investigating public sector corruption is shared by a range of agencies with different jurisdictions and powers, as outlined in a 2012 UN review.

Federal bodies that fight corruption

The Australian Criminal Intelligence Commission

The Commonwealth Ombudsman

The Australian Federal Police (including the Fraud and Anti-Corruption Centre)

The Australian Commission for Law Enforcement Integrity (ACLEI)

However, corruption involving Commonwealth parliamentarians can only be addressed through political mechanisms, such as elections or (in rare cases) a royal commission.

Alleged criminal conduct, though, would still be investigated by law enforcement agencies.

Does a multi-agency approach fit with the UN convention?

As the convention's technical guide explains, Article 36 specifies the need for people, or a body or bodies "whose core focus must be law enforcement" — including investigative and possibly prosecutorial functions.

The guide also makes clear that "the convention only sets minimum standards" and that adjusting its requirements to suit Australia's "specific domestic situation" is entirely within the rules.

That doesn't mean there isn't room for improvement.

In his interview, Mr Watson called Australia's approach "piecemeal". Transparency International Australia has also described Australia's system as having "significant gaps and weaknesses".

And the Accountability Round Table, an independent advocacy group dedicated to improving government integrity, has argued that putting everyone in charge means no-one is in charge:

"[T]he multi-body approach and shared responsibility results in no body having ultimate responsibility and each body involved being likely to assume that all is well because there is someone else making sure that no corruption is occurring."

Does Australia already have a national anti-corruption body?

Transparency International Australia, in a 2017 submission to the Senate, said "it is not correct that the Australian Government has no anti-corruption agency".

They said the Australian Commission for Law Enforcement Integrity is "an anti-corruption agency with strong experience and high strategic capability", albeit "one with a limited jurisdiction, and insufficient resources, powers and profile".

Griffith University's Professor Brown told Fact Check that, unlike the Australian Federal Police, which is only interested in criminal matters, the Australian Commission for Law Enforcement Integrity will investigate any corruption issue: "And that's really broadly defined. In fact they can almost define it for themselves."

The type of corruption the commission can investigate is also "far, far broader than any of the state anti-corruption commissions," he said.

The Law Council of Australia has argued that, aside from the commission, "there is no dedicated Commonwealth authority mandated to address claims of misconduct or corruption within federal Parliament and Commonwealth agencies more broadly".

And the Accountability Round Table has said that the Australian Commission for Law Enforcement Integrity is "the only body with any relevance" to Article 36.

However, the commission can only investigate corruption within specific law enforcement agenciesprescribed by legislation (for example, the Australian Criminal Intelligence Commission, the AFP, the Department of Immigration and Border Protection and prescribed aspects of the Department of Agriculture and Water Resources).

And, according to its 2015-16 annual report, it had just 52 staff.

What does the UN have to say?

In May 2012, the UN released a summary review of Australia's progress towards implementing the UN Convention against Corruption.

It recommended that Australia continue developing "a comprehensive national anti-corruption action plan, which will include an examination of how to make anti-corruption systems more effective".

There was, however, no mention of Australia failing to meet its Article 36 obligations.

In fact, the reviewers noted Australia's "effective system for co-ordination and sharing of intelligence among anti-corruption institutions" and praised the establishment of the Australian Commission for Law Enforcement Integrity as "a leading anti-corruption institution" and evidence of our "significant proactive approach to anti-corruption".

Assistant Professor Cecily Rose, from Leiden University's Grotius Centre for International Legal Studies in the Netherlands, told Fact Check that an uncritical review does not necessarily mean Australia has properly implemented Article 36.

"Sometimes the reports that are produced through this review process clearly indicate that a state has not complied with a particular provision. Most of the time, however, the reports are more nuanced, and indicate that there is room for improvement."

Fact Check found evidence of this less-than-critical language in the UN's review of Zimbabwe.

Despite the country being frequently ranked among the world's most corrupt, the report makes no mention of non-compliance with the convention.

Ultimately, getting a definitive answer on Australia's compliance may be unlikely unless it comes from an international court, such as the International Court of Justice.

But Dr Rose said that while another state could conceivably take Australia to court over an alleged breach of the convention, this probably wouldn't happen.

"It's hard to see why another state party would be motivated to pursue such a claim," she said.

The experts who agree

Stephen Charles QC — a former Victorian judge who advised former premier Ted Baillieu on establishing Victoria's anti-corruption body, IBAC — has described the Australian Commission for Law Enforcement Integrity as "Australia's principal excuse for doing little or nothing to comply with Article 36".

Mr Charles, who is a member of the Accountability Round Table, told Fact Check there is "absolutely no question that Australia is in breach" of the UN convention.

His position echoes that of the Round Table, which has said that to satisfy the obligations of the convention, anti-corruption bodies must be able to carry out their functions "effectively".

And such bodies are not effective unless they "cover the whole of the domestic public sector and cover the activities of all government agencies".

Mr Charles said that state corruption bodies cannot summon or investigate Commonwealth public servants or parliamentarians, and the Australian Commission for Law Enforcement Integrity's jurisdiction is much too limited for this.

The commission, he said, was also "completely unable to carry out the function" required by the UN convention because it had neither the specialisation nor the resourcing needed for it to be effective.

"Among other things, its workforce is about half of Victoria's IBAC," he said.

He added that the Australian Commission for Law Enforcement Integrity was not sufficiently independent to satisfy the convention. That's because an investigation can only begin when a Commonwealth agency head refers information about corruption — in their own agency — to the Integrity Commissioner.

Those who disagree

On the other hand, Professor Brown told Fact Check that he does not believe Australia is failing to meet its obligations under the UN convention.

While he believes establishing an anti-corruption watchdog would make us "more compliant with the spirit and the purpose of [the convention]", he noted that "the lack of a federal independent anti-corruption agency in and of itself doesn't put us in breach of Article 36".

"There are a lot of countries that don't have independent anti-corruption agencies … and they're not regarded as being in breach," he added.

Part of the reason we're compliant, he said, is because the article is so broadly worded.

First, it allows for either a body or bodies or persons. And second, though it requires that these groups be given "the necessary independence" to do their job effectively, this is about setting a minimum standard of independence for law enforcement officials so they can choose what to investigate or whom to prosecute.

"It really means that the officials … have effective independence to fulfil those roles that isn't subject to direction by the executive government of the day or subject to party political control," Professor Brown said.

He told Fact Check that this requirement is satisfied (at the Commonwealth level) by bodies such as the AFP (whose staff have the discretion to charge) and the Commonwealth Department of Public Prosecutions (which has the independence to choose whether to lay charges or prosecute).

This line of reasoning is echoed by the British Government, which in 2011 argued that it complied with Article 36 by creating anti-corruption teams within its existing law enforcement and prosecutorial bodies, for example, the Crown Prosecution Service.

Adam Graycar, a Professor of Politics and Public Policy at Flinders University and a former head of the Transnational Research Institute on Corruption, agreed that Australia was meeting its obligations.

"We are not in breach," he said. "We do have a number of agencies at the federal level and we have agencies at the state level."

Pointing to the existence of ICAC equivalents in every Australian state, he said: "The [UN convention] didn't orient itself to federal systems, and they're different [to national systems]."

"We have an Auditor-General, which would probably meet the criteria of Article 36; the federal police might meet the criteria of 36 because they have a corruption and fraud office."

He also described Article 36 as "very broad", but called the UN framework "one of the most useful conventions because it focuses the attention, and it gets governments to take the issue seriously and deal with it in whatever way they see fit".

Professor Graycar referred to other countries in Transparency International's Corruption Perceptions Index, a respected measure of corruption across countries.

For the past two years, it has ranked Australia as the 13th least-corrupt country.

"In the top 10 [countries], only one [Singapore] has a national anti-corruption agency. The rest don't."

ADVOCATE NAEEM BOKHARI’S 2ND LETTER - TO THE CHAIRMAN CENTRAL BOARD OF REVENUE, ISLAMABAD.

Update: I just read it. Please do read it in its entirety as it is the 2nd brilliant eye opening letter by the Advocate Naeem Bokhari, which might also have some unforeseen happenings attached to it. My comments follow the post.

Dear sir:
I write this letter as an Officer of the Supreme Court of Pakistan; as an Advocate of the apex Court and the High Courts; as an Attorney who has paid more income tax from his earnings than many of my friends and colleagues, and as a patriot who has a stake in the dispensation of economic justice, intimately and vitally interested in the efficient functioning of Central Board of Revenue, Pakistan.

Many Commissioners of Income Tax and Collectors of Customs know me for decades, as a person endowed by nature with a pleasant disposition and acceptance of human failings. As a true patriot and well wisher of the Country, I gave my sincere observations to Mr Iftikhar Muhammad Chaudhry, the former Chief Justice of Pakistan which proved beneficial for him as well as the Country and saved both from a bigger disaster. In same manner, I submit myself with these sincere facts towards the Central Board of Revenue as I also want to see it on a high pedestal of dignity, compassion and justice, tempered with mercy.
I have seen Central Board of Revenue headed by Mueen-uddin Khan, Syed Mohsin Asad, Miyan Iqbal Fareed, Syed Riyaz Naqvi and Riyaz Malik and how the CBR functioned under them in the 1980s/1990s.
I was appalled at the manner in which the Central Board of Revenue remained under the reins of mismanagement and corruption. I was horrified by the move of former Chairman CBR, Riyaz Malik, who got extended the serving contract periods of all the CBR Members hired from the private sector, on the pretext of Tax Reforms. This was clearly designed to block your posting as the Chairman CBR by getting extended his own tenure in the name of Tax Reforms. The accelerated issue of the notification transferring and posting you as the Chairman CBR put Riyaz Malik’s move to rest.
I believed that you were vigorous, capable of lifting up the Central Board of Revenue, creating an espirit-de-corps among your officers, restoring the dignity and grandeur of the Central Board of Revenue, particularly considering the long tenure before you.
Alas this has not come about!!!
I am not perturbed by your strategy of single-outing yourself from the department you head through harsh and contemptuous attitude towards the staff and officers (despite my belief that it’s the mutual respect and morale boosting through providing a sense of belonging that would have improved the working of the CBR and raised its image in the eyes of everybody. Over reaction by blaming officers to be corrupt, superseding tens of officers on charges of corruption without any justification or even instancing a single case for the corruption and portraying yourself to be someone alien - on a different planet despite using all the benefits of that planet is just fluff, not the substance of an office).
I am mildly amused at your desire to be present on every TV Channel by sacrificing already set important official meetings and engagements, disregarding the awaiting officers and staff. I am titillated by your being so close to the some selected ‘Business Community’ that a tax consultant, Mr. Shabbar Zaidi, a Chartered Accountant of A.F Fargusons claims that all his budget proposals have been incorporated and passed to make Law, without a single exception, since you took the office as the Chairman, CBR. It’s like asking India to devise a strategy to resolve Kashmir dispute, and then implementing that strategy in letter and spirit without pointing a finger on any point.
I am not perturbed that Mr. Abdul Razzak has been appointed by you as Member Audit who does not even know the ABC of tax management and his only credit is that he is related to you and has the reputation of being someone with “magical hands” as he can get anything approved from you within no time overriding any concept of institutional jurisdiction. His career is said to have remained dependent on you as by using your authority in previous assignments/postings, you have always got him appointed on important positions for the reasons best known to you.
My grievances and protests are different.
I am perturbed that the Central Board of Revenue should issue a clarificatory statement on this behalf. I am perturbed that the Member Admn. should summon, Member HRM to his chambers on this account that how this illegal appointment was made by sacrificing merit and a huge remuneration is being paid whereas the audit is suspended for the last three years. Isn’t it a unnecessary and worthless burden on the national exchequer!!
I am appalled that you are so intolerant to discussion and criticism that you can even sacrifice efficiency and integrity for that. It is an open secret that for this sole reason, the well reputed, honest and efficient grade 21 officer of Customs, Mr. Ramzan Bhatti was first removed from the post of Member Customs and posted as DG Internal Audit. Eventually, he was thrown out from the Revenue Division to the Law and Justice Division as he was not ‘behaving’ up to your ‘expectation level’.
You are well known for your friendly gestures for the business community, but I am disturbed with the extent of these friendly relations which knows no bounds. Your closest business friend, Mr. Raja Zarat, known as Bawan Shah, is presently under prosecution in NAB custody and faces more than eight FIRs. It is an open secret that all important posting and transfers in the department used to be made with the consent of Bawan Shah. Mr. Azhar Majeed Khalid, a close associate of Bawan Shah, knew very well why Mr Afzal Bhaati, another competent and honest officer of Customs was made OSD and he was given the dual charge of CARE and Collector Appraisement Karachi. Now when people blame Mr. Azhar Majeed for giving his official ‘CARE Software Password’ to Bawan Shah, I only feel pity for the officer, as how could he ever say no!!. When Bawan Shah ruled the department through your good self and got his people posted on various places in the department, why those officers would not have given compliance to him. Bawan Shah during his rule, used to give open threats to the officers, of dire consequences and whole department saw it happen in real. Mrs. Rifat Abidi, a grade 20 officer, was first posted as Collector Audit, Sales Tax House, Karachi; who granted DTRE approvals to various companies of Bawan Shah in one day. After performing her this job in Sales Tax, she was moved to Port Qasim as Collector Customs to clear fake exports of Bawan Shah. Similarly, mis-declared imports in the name of DTRE through Appraisement Collectorate became a matter of routine. No officer in the department from Collector to Inspector could dare to open or check the import or export containers of Bwan Shah because of the fear of your good self sir.

I am more perturbed with the fact that instead of feeling some kind of guilt, now you openly blame the department and the officers for their connivance with the Bawan Shah, as if you had nothing to do with it. You have recently dismissed a DC, Mr. Nasir Khan who was posted in the Sales Tax Refund Collectorate Karachi on your directions on the recommendation of Bawan Shah. In case the officer deserved dismissal, what the Chairman should deserve on whose directions the officer was posted in refund and was bound to accept the orders received from Bawan Shah!!

Sir, NAB investigations have been initiated against 11 DCs of Customs and the total toll to be investigated comprises of 82 officers. All these officers are now being accused of helping Bawan Shah in one way or the other, for the reason that you had transferred them on key positions on the recommendation of Bawan Shah. It is more disturbing to know that this NAB investigation has been started on the recommendation of Central Board of Revenue. It seems the plan is to execute the weak in order to save the ‘strong real culprit’. When you are well aware that these officers were helpless and had no option but to comply with the orders of Bawan Shah, thanks to your close alliance with him, then at least you should be under a moral obligation to save these officials who were too weak to fly against the wind. They are not well connected like you. You can hush the NAB inquiry, still pending against you in capacity of Secretary Petroleum (which you remained for 6 long years), but these 82 people are not that lucky. They are not that resourceful to hush the NAB reference. Their families are frightened, their morale is at lowest ebb; all they wonder is what could they do and their dismay is that the same Chairman is now vocal against them who was mainly responsible for this mega tax fraud in the history of Central Board of Revenue.
My grievances concern the manner in which the last and highest position of Central Board of Revenue is dispensing justice, under your leadership.
Dear Sir, the dignity of officers is consistently being violated by you. They are treated harshly, rudely, brusquely and nastily. They are not heard. They are not allowed to present their case. There is little scope for difference of opinion. Mr Wahid Khursheed, an efficient Addition Collector was thrown out from the Central Board of Revenue when he expressed his personal opinion against your decision to post 22 Income Tax officers in the Customs/Sales Tax Wing. The words used in the department for Central Board of Revenue under your leadership are “The Mad House”, where no one knows who has to do what. There exists an Audit Wing, whose Member is drawing huge salary, whereas the audit is suspended since 2004. Then there is Customs Intelligence which is performing the job of Audit Wing. Sales Tax Wing does not know what is the dividing jurisdiction line between the Audit Wing, Intelligence Wing and Evaluation & Internal Audit Wing. Previously, you had handed over the Administration to HRM Wing, now again the Admn. Wing is separate. There is chaos everywhere. The officers are cowed down by aggression from the Board, led by you. All they receive from you is arrogance, aggression and belligerence. You also throw away the file, while contemptuously announcing: “This is rubbish”.
Yet this aggression is not for everyone. When Mr. Imtiyaz Dev, an Additional Collector related to Chaudary Shujaat appears, your worthy demeanour and appearance is not just sugar and honey. You cannot tolerate corruption, but for him you rang up Mr. Rashid Ahmed, Collector Refund Karachi to ‘evenly’ distribute the charges and give him “important” assignment. The Collector accordingly called the Additional Collector in his office and gave him the charge of his choice. Two times Mr. Imtiyaz Dev was transferred from the Refund Collectorate to the Directrate of Customs Valuation on consistent complaints of corruption, but on your directions, the transfers were cancelled which is on record. You misused your authority to favour him for reasons unknown to many, but not all! Presently, the officer is enjoying ex-Pakistan leave after reaping the benefits of “important” assignment given to him on your direction. It is only an instance to reflect double standards employed by you while administering Central Board of Revenue and its field departments. Apart from violating the dignity of officers, which the Constitution commands to be inviolable, the officers suffer discrimination at your hands.
I am not only raising the issue of verbal onslaughts and threats to officers, transfers on the basis of personal likes and dislikes and nepotism, demoralizing the officers by superseding them without any reason or justification, and reminding them time and again that “This is the new Central Board of Revenue”.
The way in which worthy Chairman manages CBR is not conducive to the process of justice and efficient functioning. In fact, it obstructs due process and constitutes mishandling of the prime institution responsible for the smooth sailing of national economy.
I am pained at the way official bribe has been given to the business community in your tenure. In the name of facilitation, sweeping measures have been taken to unduly favour the ‘selected’ business community. We must call it official bribe which the tax payers have received from the tax collectors for the first time in the history of this country under your Chairmanship. The moto is ‘deposit tax or take refund on your choice and don’t worry there will be no audit or check of any knid’. Since your coming into office, they have been granted excessive liberty to evade as much tax as they can and they are doing so tirelessly. If you consider CBR is achieving revenue targets because of your measures, it would only be a wishful thinking. It’s the direct outcome of economic boom due to the flow of foreign capital in the form of increased remittances, foreign loans and aids plus the impact of inflation and devaluation of rupee. Due to your over exaggerated facilitation measures; the Income Tax department has become totally toothless and ineffective. Self-assessment and annual audit go hand in hand in any tax system through out the world. In case of Pakistan, self-assessment has been introduced in Income Tax, Sales Tax and recently in Customs, but audit has been suspended. Various tax frauds, especially in case of refunds are the direct outcome of your this measure. It was your sole decision to suspend the audit in 2004, when the whole department was not in favour of it. 3 years later, today, you can analyse the wisdom behind those arguments which you had turned down at that time. On one hand audit was suspended and on the other, strict instructions were passed to field departments to dispose of refunds on priority. The combined effect came in the form of a number of tax frauds – top of it the biggest refund scandal of your friend – The Bawan Shah Group of Companies. Everyone knows your relationship with Bawan Shah. Your stays at his residence whenever you visited Karachi and the inauguration of his Shifa Eye Hospital Karachi are the memories still fresh in the minds of many.
Presently more than 72 refund cases are being investigated in NAB, more than 50 in Customs Intelligence and around 40 in the Directorate of Internal Audit – all thanks to your policies pursued for the last more than 3 years.

I am further pained by the credit you claim for automating the Central Board of Revenue, whereas it is well known what STARR and CARE soft-wares have played havoc with the department. Due to STARR, illegal refunds worth billion of rupees were paid unduly and due to CARE, thousands of containers were cleared without charging any customs duty thus giving tax loss of billions of rupees. In the face of it when you claim to have done miracles within the tax administration, this is referred to as a “Media Circus” in the department.
Sir, this communication may anger you and you are in any case prone to get angry in a flash, but do reflect upon it. Perhaps you are not cognizant of what your close collegues feel and say about you.
Dear Sir, before a final call arises from the upper echelons of state (as in the case of former Chief Justice of Supreme Court, Mr Iftikhar Muhammad Chaudhry), before the field formations stand up collectively and before the entire matter is placed before the Chief Executive, there may be time to change and make amends.
I hope you have the wisdom and courage to make these amends and restore serenity, calm, compassion, patience and justice tempered with mercy to country’s Central Board of Revenue.
Dear Sir, we all live in the womb of time and are judged, both by the present and by history. The judgment about you, being rendered in the present, is adverse in the extreme.

TI Pakistan to launch USAID 'Anti-Fraud Hotline' next month

ISLAMABAD (November 02, 2010) : US Agency for International Development (USAID) and Transparency International Pakistan head signed a co-operative agreement on September 22, 2010 here, for the "Anti-Fraud Hotline" Project. Syed Adil Gilani has been designated as the Chief of Party for five-year period of the project - The Anti Fraud Hotline to be launched in December 2010.

The objective of the project is to ensure transparency and prevention of corruption in the utilisation of grant to be provided to Pakistan by USAID, including the $7.5 billion of Kerry Lugar Bill. TI Pakistan will disseminate information in the areas and sectors, where USAID funds will be disbursed, through print and electronic media, billboards, flyers and posters, banners and pole mountings.

Citizens and civil society organisations will be encouraged to report corruption and register their complaints direct through 'Anti-Fraud Hotline' website or send it to TI Pakistan by email, phone, fax, mail by visit to Transparency International Pakistan office.

For transparency and non-discriminatory policy of USAID, all procurements will be open for national suppliers/consultants /contractors, and international suppliers/consultants/contractors for specified procurements under the terms of the grantee agreements. US NGOs procurements will be open to Pakistani as well as US suppliers/consultants/contractors and the UN agencies.

All complaints will be uploaded onto the "Anti-Fraud Hotline" either by the complainant through web, or by TI Pakistan staff dealing with complaints. Each complaint will be automatically allotted a number if made through web, and given a number by TI Pakistan staff, which will be in continuous serial.

The complainant will be sent mail in case email address is given, or informed through mail about the company registration and compliant tracking number. The complainant will be able to track the status of complaint through web, or contact Transparency International Pakistan for the progress and result. Transparency International, a global corruption watchdog, will run the telephone line to help monitor more than $7.5 billion (£4.81billion) promised over the next five years as part of a package to help stabilisePakistan as it battles with militants along its border with Afghanistan.

The move risks angering the government of Pakistan which has criticised Transparency International for increasing the nation’s corruption rating.

Activists have already warned that they face intimidation and harassment when carrying out their work.

On Tuesday, Syed Adil Gilani, the chairman of Transparency International Pakistan, said he had received three death threats from government officials since signing up to run the hotline.

With millions of dollars in aid pouring into Pakistan after this year’s devastating floods, allegations of financial mismanagement have been widespread.

“One to one, I was told not to keep on working as we are,” he said. “I was told that Karachi is not safe and there are many target killings.”

The fraud hotline is one of a number of anti-corruption projects that USAID, the US government’s donor agency, is working on with the Pakistan government.

“This is a normal oversight mechanism in many countries where we work,” said Bob Wilson, USAID mission director when he announced the hotline.

Last month, Transparency International’s annual corruption perception index ranked Pakistan as the 34th most corrupt country in the world — a rise of eight places, putting it on a par with Mauritania and one place below Zimbabwe.

President Asif Ali Zardari on Monday said that the government did not want a clash of institutions and deemed that “democracy is the best revenge”.

Speaking at the 21st All Pakistan Newspapers Society (APNS) Awards distribution ceremony at Awan-e-Sadr, he said, “We strengthened the institutions by giving more powers to the Parliament and we are willing to work and fight for a better democracy.”

The president said that the PPP did not take the path of aggression after the assassination of Benazir Bhutto because it could have threatened the institutions.

“I am here for a larger cause to fight the mindset — which is definitely going to affect our coming generations if not fought now,” the president said.

He said “we will have to take this challenge”. It is the mindset which took away Benazir Bhutto, Salman Taseer, Shahbaz Bhatti and thousands of Pakistanis. We are not against mardrassas but we are against the mindset.”

The president said the federation would file a reference in the Supreme Court to revisit the judgment of the “judicial murder” of former prime minister Zulfikar Ali Bhutto. Pakistan Peoples Party has decided to get the case reopened, he added.

President Zardari said the first PPP government of Benazir Bhutto in 1988 had put the country on the road to democracy and freedom of the press. She lifted a ban on import of newsprint and made it free for everybody, he added.

The president asked the APNS to set up a body for rationalising the distribution of advertisements to the media.

Later, the President gave away awards to the APNS members, journalists, advertising agencies for achievements in their fields.

The president handed life-time achievement awards to senior members of APNS including Majid Nizami, Syed Fasih Iqbal, Sharif Farooq, Mustafa Sadiq, Mahmood ul Aziz, Masudah M. Ahmed, Prof S.B. Hassan.

LAHORE, Feb 27: Corruption is the main cause of terrorism and violence being witnessed by the country and today we declare a crusade against the menace, Human Rights Society of Pakistan president Senator SM Zafar declared here on Sunday.

He was addressing the 30th human rights awards ceremony held by the Society at a local hotel.

Four awards for 2010 were given to as many eminent persons for their human rights activities and struggle for `amelioration of the condition of the people of Pakistan`. Those who were given awards are; Pakistan Tehrik-i-Insaf chairman Imran Khan, Mr Justice K M Samdani (retired), Senator and journalist Syed Fasih Iqbal and special education expert and chairperson of “SAHIL”, an NGO, Dr Maneezay Bano.

Mr Zafar said Pakistan was passing through the worst phase of lawlessness and violence these days. The increasing incidence of terrorism, target killing, extra judicial killing, dacoities, murders, abduction for ransom and investigations had made the lives of the people miserable. A careful study of the entire situation would reveal that the main cause of such heinous crimes and violence was corruption of the ruling class and an unequal distribution of wealth in the country.

He said that according to an estimate if 40 wealthiest families of the country transfer about half of their foreign assets back to Pakistan “we can not only clear all our foreign debts but can make Pakistan one of the fast developing countries of Asia.” He said as compared with these 40 families, no less than 40 per cent of Pakistan`s population, about 60 million people, were living below the poverty line and deprived of basic human rights. They had no future at all, he added.

Corruption, he said, was also a deadly weapon against merit. “Appointments made without merit give rise to inefficiency and false pride and the officials instead of serving the people start behaving like rulers as in the police department. Corruption denies the people justice.”

He said the Quaid-i-Azam had in his address to the first Constituent Assembly on august 11, 1947 had identified corruption as a cancer and had emphasised on rooting it out. “Thus the HRSP declares jihad against corruption from today by giving its human rights award to a brave man of Pakistan, Imran Khan, who has already launched a crusade against corruption in the country.”

He said Pakistan came into being on the basis of right to self-determination as an overwhelming majority of the Muslims of the sub-continent had voted for it to seek their human rights and self-respect. But, he lamented, during the past 63 years the rulers had disappointed them. “Enough is enough. The hot waves of the change are blowing. The civil society is rising and it has already won the battle for an independent judiciary and now the goal of complete independence is not far away which, Faiz Ahmad Faiz had been dreaming to realize,” he said.

He said real democracy and winning elections through fraud and malpractice were altogether different phenomena. He hoped the Election Commission would ensure free and fair elections, saying for this the Society would give The EC a special award.

The Society considered Imran Khan for the award for earning great fame by winning the 1992 cricket World Cup and then after his retirement from the game establishing a cancer hospital in memory of his beloved mother.

The HRSP has already given its 2008 award to Imran Khan for rendering great service to the people through his hospital where the treatment was given irrespective of patients` financial status.

The Society also recognised Khan`s political role in launching a war against corruption of the powerful.

Mr Justice K M A Samdani started his career as a lecturer at Islamia College, Peshawar and later joined civil service in 1955. In 1961 he switched over to the judiciary and became an additional district and sessions judge. Later, as a law secretary he confronted military dictator Ziaul Haq when the general in a meeting said he wished he could hang all secretaries upside down. To this, Mr Samdani retorted that he too would like to do the same with corrupt generals. After the meeting Gen Zia summoned him to force him to seek an apology for his remarks, but Mr Samdani replied; “Call another meeting of the secretaries, withdraw your words and I shall also withdraw mine.” Such a courage before a ruling military general is rare. As a high court judge he gave outstanding decisions, including the release of Z.A.Bhutto on a bail despite immense pressure. He also refused to take oath as a PCO judge. He is also a good columnist.

Senator Syed Fasih Iqbal is a leading journalist hailing from Quetta where he is the editor of daily Balochistan Times and Urdu daily Zamana. Starting his career as a journalist in 1955, he had been a human rights activist. He organised civil society in Balochistan and worked hard to awaken the conscience and consciousness of the people of the province to their civil rights. He helped them in getting their grievances addressed by not only highlighting these in his newspapers but also using his influence for the purpose. He has been brave enough to bear the pressure of Baloch Sardars and tribal chiefs as a representative of the downtrodden. He has been honoured with Hilal-i-Imtiaz and Sitara-i-Imtiaz for his meritorious services.

Dr Muneezay Bano is a social and human rights worker running an NGO, SAHIL, for the past 15 years which is working for the education and welfare of special children. She is an MPhil (Special Education) from Oslo, Norway, and a PhD from Punjab University. A special symbol dictionary for the special children is her great achievement. She is also a recipient of an award by the International Talent Art Club for her services for the special children. She is also working for the welfare of children in various jails of the country.

The Governance and Democracy in Pakistan

The constitution of Pakistan is being re-engineered again. Well, one must not be surprised or cry about this activity, as this has been a trend in the ruling system of Pakistan since the first peace of document "Objectives Resolution" was produced on March 12, 1949. Though the ‘causes’ and the ‘needs of the time’ are given whenever this poor document is altered but the fact of the matter remains the same that every ruler has used the constitution to control the situation in their favour and remain in power.

To understand the shortcomings in the governance and the democracy in Pakistan, one must find explanations for the weaknesses in political tolerance and identity. Analytically, there appear to be sets of reasonably autonomous and enduring beliefs and values within Pakistan that have important consequences in the societal and ultimately political spheres. Popular expectations of authority, in particular toward those who govern, must be understood and presumably altered if Pakistan is to realize the kind of system that permits a sustainable democracy. Legal provisions and better people seeking public office are important, but progress in building civic virtue or civic spirit will also have to occur. In the absence of such a culture, factional anarchy and authoritarian rule remain thrive.

Historically, the political culture in Pakistan is a strong product of its past that links to the pre-partition British Rule. What Pakistan's leaders knew best from this inheritance was the so-called viceregal system that made little or no provision for popular awareness or involvement. The system was designed to rule over a subjected population and intended to keep order and collect taxes. In fact, what the British bequeathed was often a contradiction between theories of governance and their practices. Ideals of representative government and equality before the law were incomplete transformations. The territorial issues and border conflicts with India, the socio-cultural differences within the country, struggle for a share of power between the states and the early death of the founder of Pakistan Mohammad Ali Jinnah are those realities which not only politicized the policy-making elites and their willingness in introducing the fair democratic procedures but also encouraged the non-democratic elements including the army. Consequently, even after half a century the country could not get cleaned from the feudal, tribal andpunchayat systems and sectarian segregations and the public has been left untutored in the kind of vigilance usually needed to hold political leaders accountable.

Pakistan was without a formal, written constitution until 1956. The democratic myths that so often sustain a system were thus only weakly instilled, and precedents were created that undermined those few parliamentary and democratic norms that could be drawn upon. It did not help that in the early years non-party prime ministers were appointed by the head of state rather than by those who had to appeal to an electorate. Mass involvement in politics, if defined by rallies and periodic opportunities to vote, certainly increased over the years. Street demonstrations helped to bring down governments, namely Ayub's in 1968, Yahya Khan's in 1971, and Zulfikar Ali Bhutto's in 1977. Yet while these actions strengthen feelings of efficacy, none can be easily equated with democratic processes.

The weakness of democratic practices in Pakistan can be explained in many ways. Some observers stress constitutional and electoral provisions among institutional factors said to have undermined responsible and responsive government. Others point to the quality of Pakistan's leadership over most of Pakistan’s history, namely, that Pakistan has been let down by unprincipled political figures motivated by raw ambition, material gain and vested interests.

The subsequent education of people to accept democracy through meaningful participation in their political affairs is minimal. Without wide public awareness and an effective public opinion, the political system gives wide berth to ambitious and corrupts political leaders. Benazir Bhutto and Nawaz Sharif, the two times democratically elected prime ministers, are the perfect examples of the corruptions at the leadership level. Instead of including a broad citizenry in the political process, power is concentrated in the hands of an elitist bureaucracy and over-ambitious military. The country's semi-feudal system with its sets of obligations and hierarchy provided similarly inhospitable soil for building a democracy. The traditional power brokers, the wealthy, large land-holding families, are prepared to give their allegiance to anyone who promised to protect their material interests and way of life.

The civilian government succumbed to military rule that sought to legitimize itself with the public by attacks on democratic ideals and political institutions in hopes of leaving them in disrepute as well as decay. Despite the revival of democracy from time to time, it is predictably held in suspicion. One of the tenets of civil society, the concept of a legitimate opposition, naturally won little acceptance among competing political elites or within the larger public. These outpourings marked a breakdown in law and order, and reflected above all an absence of trust in authority. Such anomic movements may have heralded demands for better representation but in themselves were more the signs of frustration and anger than of belief in a more pluralistic, tolerant political system.

The election of 1970, the first to be held on the basis of universal suffrage, appeared to be a watershed for democracy. Zulfiqar Ali Bhutto -who was the creation of a military ruler, Ayub Khan - provided the strongest hope for a politics that would involve the masses and socialize them to democratic and socialist ideals. The mass mobilization of the electorate by his Pakistan Peoples Party (PPP) succeeded in communicating with many rural voters. People listened to Bhutto and other political leaders not only at rallies but over radio and television. The issues of the day were articulated forcefully and clearly, such that voters had meaningful choices to make. And these masses demonstrated that they could throw off, if it really served their interests - the feudal assumptions that usually shaped their attitudes and actions. Yet rather than build up his popular movement on the democratic ideals of supremacy of the people, in power Bhutto shed much of the regime's populist ideology and strongly personalized his rule rather than working through participatory institutions and educating the public to their value. By his 1977 re-election campaign, he had come to rely on feudals and discarded many of the political allies who had stood with him earlier. Above all, Bhutto had failed to deliver the fair governance and a true democracy. While he had opened up for the future the possibility of more participatory politics, the civic virtues that would be needed to buttress it were in the end discredited.

Pakistan could indeed become a crucible for determining whether extensions of democratic practice are likely to provide a successful means of accommodating militant Islamic political movements. The country's experiences suggest that militant Islamic parties may be moderated when given a democratic option - an honest opportunity to compete. The popularity of Islamic parties in many cities and towns, according to this reasoning, is largely of a protest variety, coming from the denial of a more open political process. However, many analysts also seriously question the compatibility of Islamic doctrines with more liberal conceptions of democracy. Very likely the best reason to insist on the appropriateness of democratic values and institutions is that, from an ideological-constitutional standpoint, democracy does not represent an alien goal. Pakistan was founded on many of these precepts, and as ideals they continue to resonate widely. Such basic ideas as representative government and rule of law remain part of the Pakistani society's aspirations for itself. To be sure, there has been a rejection at the emotional level of some aspects of western culture and disgust with secular political institutions. Replacement with authentic Islamic institutions is the widely accepted ultimate objective. The kind of civil society and underlying culture appropriate for Pakistan should not be expected to mimic western experiences. Any democracy in Pakistan will have to take into account certain Islamic prescriptions and other legacies. Experiencing and mixing western democratic system with Islamic laws will continue to create more loopholes in the ruling mechanism.

In general, opportunities for a fair governance, true democracy and civil society in Pakistan can only flourish when democratic practices are allowed to prevail under the supremacy of unchanged constitution. The repeated dismissal or overthrow of elected regimes, alterations in the constitutions that suit to existing ruler, leaves no positive memory and little chance for institutions to adapt and supportive values to root.

Though the elections sometime are tainted by design or overzealous officials, the regular elections will ultimately provide democratic practices to the contestants in which losers accept defeat and winners are magnanimous in victory, the greater the chances for an electoral process capable of surviving inevitable challenges. The inefficient and incapable politicians may continue to participate and seek power but the people of Pakistan will also learn and understand better the democratic values and responsibilities over the period.

The link between human development and quality of governance is strong and well established and is at the core of development issues in Pakistan. This is reflected in the national strategies to attain MDGs through, Improved governance and consolidating devolution, both as a means of delivering better development results and ensuring social and economic justice. These considerations underpin UNDP Pakistan's efforts in supporting governance processes and institutions that would improve their response to the needs of Pakistani citizens. The governance interventions are aimed at making policy formulation and implementation more effective and participatory; enhancing the credibility and effectiveness of key governing institutions; and supporting initiatives for citizens involvement in decisions that affect their lives. In this context the governance programme is working with the Government of Pakistan and national partners in three core areas of intervention: (i) devolution support; (ii) strengthening governing institutions; and (iii) economic governance.

Pakistan has introduced a devolved system of governance that is aimed at improving the quality of and access to public services delivery at the local levels. UNDP Pakistan supports government institutions in policy formulation and implementation of devolution at the national, provincial and local levels.

Strong, credible and effective governing institutions that have the confidence of the citizens and the ability to deliver their mandate are the foundations of sound governance. UNDP Pakistan supports capacity strengthening of the key governing institutions such as Parliament and Election Commission of Pakistan and other public sector organizations and enables their engagement with other partners in civil society to improve the relevance and effectiveness of their mandate.

Under the economic governance component, UNDP Pakistan is also involved in issues of public-private partnerships, advocating global compact, promoting corporate social responsibility, policy research on globalization and strengthening aid coordination.

NANNING: Pakistan People’s Party Chairman Bilawal Bhutto Zardari called upon political parties in Asian countries to enforce highest standards of transparency and accountability in government and institutions to ensure that people remain invested in the political process.

Addressing the International Conference of Asian Political Parties (ICAPP), Bilawal said Asia was expected to contribute more than half of the world’s economic output, restoring the world’s largest continent to the position of economic dominance it had held 300 years ago.

“We may be witnessing the birth of a new world order,” he said and pointed that everyone was calling the 21st century the “Asian Century”. Bilawal is heading a five-member delegation comprising KP Governor Barrister Masood Kausar, PPP General Secretary Senator Jahangir Badar, PPPP MNA and General Secretary Raja Pervaiz Ashraf, and Special Assistant to the Chairman PPP Hashaam Riaz Sheikh. Pakistan’s Ambassador to China Masood Khan was also present at the conference.

The conference is being attended by about 150 delegates representing 53 political parties from 26 countries of Asia including Turkey, Japan, Iran, Uzbekistan, South Korea, India, Bangladesh, Laos, Nepal, Sri Lanka, Singapore, Cambodia, Malaysia and Indonesia. The PPP chairman said ICAPP as a gathering of Asia’s top political leadership is an exceedingly important forum in the 21st Century, which in itself is a tribute to the foresight and vision of the organisation’s founding leaders.

He said the Asian Declaration issued at the end of the first ICAPP in Manila 11-year ago is to read a manifesto for today. “That document touches on all the major issues of our times and its call for Asian countries to strengthen economic cooperation, guard against future financial crises and establish an Asian Monetary Fund (AMF) resonates more deeply today than they did even in 2000,” he added.

“These words should give us pause as Asia teeters on the brink of a second global recession that is not of its making – barely three years after it weathered the first,” Bilawal said. He urged for reflection on the first ICAPP’s appeal to Asian governments to do more to address poverty and economic inequalities. He said economic development should be for the people, not at the expense of the people.

“We in Pakistan have initiated the Benazir Income Support Programme, which serves the dual purpose of poverty alleviation and women’s emancipation. Over 80 billion rupees have been distributed to four million women living in poverty,” he said. The PPP chairperson said there is something prophetic about the declaration’s appeal to Asian countries to seek the peaceful resolution of regional disputes and act in unison against trans-national crimes.

He said force alone will not defeat terrorism and extremism – unless it is force tempered with political engagement and economic development. Referring to the heavy rains and flooding in Sindh and Balochistan in which millions have been displaced, placing an enormous burden on the people, he said, “We are a resilient nation and we will fully recover.”

“It is worrying that some unable to reach the necessary compromise to address their own internal structural economic flaws instead choose to demonise emerging Asian economic superpowers,” Bilawal added. This dangerous short sightedness could lead to paranoid overreactions with catastrophic consequences, he said, adding, “I dread the return to the divided world, a world of competing spheres of influence, a world of cold wards, a world of hot wars, a world of cyber wars and a world of economic wars. We want a united world of equals not a divided world of rivals.”

فوج واقعی امن و امان قائم کردے گی اور کیا واقعی سارے لٹیروں اور مجرموں سے ملک کو پاک کرکے قومی اثاثوں کی حفاظت کرے گی؟ اگر یہ سوالات آج سے 30 برس پہلے کئے گئے ہوتے تو یقینا ان کا جواب دینا مشکل ہوتا اور لوگ باگ قیاس کی بنیاد پر ان کا جواب ڈھونڈنے کی کوشش کرتے۔ مگر آج ان کا جواب دینا چنداں مشکل نہیں ہے۔ بس ذرا ماضی قریب کی تاریخ کو کھنگالتے ہیں اور حال پر ایک نظر ڈال لیتے ہیں۔ کرپشن کی تاریخ اتنی ہی پرانی ہے جتنی حضرت انسان کی۔ مگر پاکستان میں آج جو صورتحال ہے وہ جنگ زدہ علاقوں میں بھی نہیں۔ ذوالفقار علی بھٹو کا دور کہا جاتا ہے کہ کرپشن سے بھر پور تھا۔ اور ان کے دور میں جام صادق علی کا نام سرفہرست تھا۔ ایک روایت کے مطابق بھٹو نے جام صادق سے کہا تھا کہ بس اتنا خیال کرلینا کہ مزار قائد کو نہ بیچ دینا۔ مگر اس جام صادق کی جائیداد اور بینک بیلنس کا اگر آج کے کسی منافع بخش منصب پر براجمان ایک میجر سے بھی کیا جائے تو جام صادق کی کوئی اوقات نظر نہیں آئے گی۔ ضیاءدور کے تمام جنرلوں اور دیگر فوجی افسران کے اثاثہ جات دیکھ لیجئی، مشرف دور کے افسران کے اثاثہ جات دیکھ لیں۔ مزید کسی دلیل کی ضرورت نہیں۔ اس کے علاوہ منظم کرپشن میں بھی فوج کا کوئی ثانی نہیں۔ اس وقت سب سے بڑی لینڈ مافیا آرمی ویلفیئر ٹرسٹ ہے۔ دیگر دونوں افواج گو اس سے بہت پیچھے ہیں مگر اتنی بھی نہیں۔ بحریہ فاو ¿نڈیشن کا گو کہ بحریہ سے کوئی تعلق نہیں ہے مگر اعلیٰ افسران کے ساتھ رابطے نے اس کو بحریہ کا نام استعمال کرنے کی اجازت بھی دی ہوئی ہے ۔ اسی طرح تینوں مسلح افواج کے پبلک تعلیمی ادارے بھی عوام کو لوٹنے کا آسان ذریعہ ہیں جو تمام وسائل مسلح افواج کے استعمال کرتے ہیں یعنی عوام کے ٹیکسوں پر پلتے ہیں۔ آرمی کا جو اہلکار وہ ٹیکس بھی ادا کرنے کو تیار نہ ہو جو دہاڑی کمانے والا ایک عام مزدور بھی ادا کرتا ہے تو وہ ملک کی کیا خدمت کرے گا۔ جی ہاں ان کے تمام اسٹورز پر جو سامان دستیاب ہے اس پر کسی قسم کا کوئی سیلز ٹیکس یا ایکسائیز ڈیوٹی نہیں ہے۔ یہ ٹیکس ہر پاکستانی شہری ادا کرنے پر مجبور ہے۔ یہ افسر و اہلکار بلا کسی ڈیوٹی کے سینما پر فلم دیکھنے کے بھی حقدار ہیں اور رعایتی ٹکٹ پر ریلوے و فضائی سفر کے بھی۔ اس وقت مجھے پھر ایک پرانا واقعہ یاد آرہا ہے۔ شکیل ڈھنگرا ایک تاجر رہنما ہے۔پرویز مشرف کا نیا نیا مارشل لا لگا تھا۔ اس وقت شکیل وفاق ایوان ہائے صنعت و تجارت پاکستان کی کمیٹی برائے کسٹم کا سربراہ تھا اور کراچی کی بندرگاہوں پر مس ڈیکلیریشن کے ذریعے اسمگلنگ یا کسٹم ڈیوٹی کی عدم ادائیگی کے خلاف برسر پیکار تھا۔ میں روزنامہ دی نیوز میں بزنس رپورٹنگ کررہا تھا۔ ایک شام شکیل کا پر جوش فون موصول ہوا۔ کہنے لگا یار اب سب کچھ ٹھیک ہوجائے گا۔ کراچی بندرگاہ پر فوج آگئی ہے۔ مس ڈیکلیریشن کرنے والوں کا رنگ اڑا ہوا ہے۔ اب سب کو دیکھ لوں گا۔ اس کے جواب میں، میں نے کہا۔ اوئے بھولے بادشاہ۔ یہ کرپشن کیوں ختم ہوگی۔ بس حصہ داروں کا اضافہ ہوجائے گا۔ میں نے کہا کہ تمہارے خیال میں جتنی بھی اسمگلنگ ہوتی ہے وہ سب کی سب کراچی کی بندرگاہ سے ہوتی ہے۔ یہ تو پوری مقدار کا عشر عشیر بھی نہیں ہے۔ پوری پاکستانی سرحد پر فوج یا نیم فوجی دستے رینجرز ، لیویز اور فرنٹیئر کانسٹیبلری تعینات ہیں۔ ان نیم فوجی دستوں کے تمام افسران کیپٹن سے لے کر میجر جنرل تک فوج کے حاضر سروس افسران ہوتے ہیں۔ پھر تھر کے راستے بھارت سے ہونے والی اسمگلنگ اب تک کیوں نہیں رکی؟ افغانستان اور ایران کو پابندی کے باوجود ٹرکوں کی لائن گندم، چینی اور کھاد وغیرہ لے کر جارہی ہوتی ہی، ان کو کوئی کیوں نہیں روکتا؟ کوسٹ گارڈ ساحلوں پر تعینات ہے پھر کیسے اسمگلنگ ہورہی ہے۔ ان سب جگہوں پر تو پہلے سے فوج تعینات ہے۔ میں نے شکیل سے کہا کہ بھائی بلدیہ میں وہ بد عنوانی کو روکے گا جو پہلے کنٹونمنٹ بورڈز اور ڈیفنس ہاو ¿سنگ اتھارٹی میں ختم کرے۔ اسپتالوں میں وہ معاملات صحیح کرے گا جو پہلے اپنے اسپتالوں کے معاملات شفاف کرلے۔ یہ دنیا کا اوپن سیکرٹ ہے کہ اسلحہ کی خریداری پر آفیشل 3 فیصد کمیشن پیش کیا جاتا ہے۔ اور اگر معاملہ ذرا ادھر ادھر ہو تو یہ فیصد بڑھ جاتا ہے۔ آخر آج تک قوم کو کیوں نہیں بتایا گیا کہ امریکا نے ایف سولہ طیاروں کی رقم میں کتنی کٹوتی کی تھی اور کن کن مدات میں کی تھی۔ کچھ اسی طرح کا تاثر اس قوم کا نیب کے قیام پر بھی تھا۔ ہماری قوم بھی شکیل ڈھنگرا کی طرح ہر ایک سے آس لگالیتی ہے۔ کہتے ہیں کہ مومن ایک سوراخ سے دو بار نہیں ڈسا جاتا۔ مگر اس ایک سوراخ سے تو یہ قوم متعدد مرتبہ ڈسی جاچکی ہے۔یہ کے ای ایس سی اور پی ٹی سی ایل فوجی دور میں ہی مفت بانٹی گئی تھیں۔ پی آئی ای، پاکستان اسٹیل اور ریلوے اس حال کو اسی دور کے کارناموں کی وجہ سے پہنچی ہیں۔پی ایس او اور گیس کمپنیاں آج برے حال میں کے ای ایس سی کو بزور قوت مفت ایندھن فراہم کرنے کی پاداش میں پہنچی ہیں۔ اب دوسرے رخ کی طرف آتے ہیں کہ کیا ہم پھر کسی ایک نئی سازش کا شکار ہونے جارہے ہیں۔ عالمی سازش کاروں کو جب اس خطہ میں ایک نئے کھیل کا آغاز کرنا تھا تو وہ ضیاءالحق کو برسراقتدار لے آئے اور جب وہ ان کے کام کا نہیں رہا تو راستے سے ہٹا بھی دیا۔ اسی طرح جب دوبارہ ان سازش کاروں کو اس خطہ میں ایک نئے راو ¿نڈ کا آغاز کرنا تھا تو وہ پرویزمشرف کو لے آئے۔ اس نکتہ کو صاف کرلیجئے کہ مشرف کا مارشل لاءاچانک نہیں آیا تھا بلکہ اس کی منصوبہ بندی بہت پہلے سے ہورہی تھی۔ نواز شریف نے تو ان اطلاعات کے بعد کہ بغاوت تیار ہی، پیش بندی کے طور پر مشرف کو ہٹانا چاہا تھا جس میں وہ ناکام رہے۔ اس کھیل میں جنرل عثمانی ساتھ دینے کے لئے تیار نہیں تھے اس لئے رکا ہوا تھا۔ آخری وقت تک جنرل عثمانی نے پس و پیش کی اسی وجہ سے مشرف کا طیارہ فضاءسے زمین پر نہیں آسکا تھا۔بعد ازاں دیگر جنرلوں کی اس دھمکی پر کہ اگر انہوں نے یہ ایکشن نہ لیا تو خود ان کے خلاف بغاوت ہوجائے گی۔ جنرل عثمانی نے کراچی ایرپورٹ کو ٹیک اوور کیا اور مشرف فضاءسے زمین پر آپائے تھے۔ یہ بات مشرف کے دل میں تھی اسی وجہ سے جنرل عثمانی کو موقع ملتے ہی کھڈے لائن لگادیا گیا اور ریٹائرمنٹ کے بعد نہ تو کسی جگہ کھپایا گیا اور نہ ہی روایت کے مطابق منصب سفارت پیش کیا گیا۔ عالمی سازش کار بہت پہلے سے اس سازش کی آبیاری کررہے تھے اور جب خدمت کا موقع آیا تو مشرف نے ان کو مایوس نہیں کیا بلکہ انہی کے الفاظ میں انہوں نے توقع سے بڑھ کر خدمت کی۔ اب چند معصوم افرادکے علاوہ دیکھیے کہ اس کا مطالبہ کون کررہا ہے۔ سب سے پہلے ایم کیو ایم جو ایک فوجی آمر ضیاءکی پیدا کردہ اور دوسری زندگی کے لیے مشرف کی احسان مند ہے۔ ایک تو ایم کیو ایم کو فوجی آمریت ہی راس آتی ہے دوسرے اس کے آقا برطانیہ یا عالمی سازش کا روں کے ایجنٹ کی بھی یہی منشاءہے۔ اسی طرح ایم کیو ایم کے زیر اثر تاجر رہنما یا عالمی سازش کاروں کے براہ راست ایجنٹ این جی اوز ایک دوسرے سے بڑھ کر یہ مطالبہ کررہے ہیں۔ دوسری جانب کنٹرولڈ میڈیا اور پھر تنخواہ دار اینکر پرسنز اس کی ہمنوائی کرکے ماحول تیار کررہے ہیں۔ اللہ خیر کرے کہ یہ کس نئی سازش کی منصوبہ بندی ہے۔ فوج آنے کا مطلب ہے کہ خطہ میں ایک نئی جنگ۔ کم از کم تاریخ تو یہی بتاتی ہے۔

Sexual harassment of female students

ISLAMABAD: The Quaid-e-Azam University (QAU) administration on Saturday broke long pause and finally shown doors to its two officials found guilty in molesting female students in the campus. On Saturday, after a five hours long meeting to reach the syndicate decision officially announced, QAU administration fired two guilty officials controller examinations Sardar Muhammad Babar Khan and Information Technology Department (ITD) lecturer Noor Mustafa Awan, who according to probe committee constituted by QAU VC were found guilty in separate harassment incidents. According to final decision under the lights of syndicate members, the administration of QAU had shown the doors to Khan by putting him on forced retirement while Awan has been terminated with immediate effect. According to sources, Babar was nearing retirement at the end of this year but the syndicate members after found him guilty penalized him by forced retirement. Similarly, the lecturer has also been terminated. Sources told Daily Times, Khan in the reply of charge sheet against him stated that he was in that profession for the last 25 years and there was not such a single complaint against him. He said all allegations put on him were fabricated as the administration of QAU wanted to remove him from this post and to appoint its favorite persons.In the reply of charge sheet Awan stated that he respected his professional teaching career and some elements involved him in that case of harassment. In the meeting held last month, the inquiry committee was apprised that Khan was involved in first incident of molestation of a female student on June 17, was not of fair character as number of such complaints went un-noticed against him from female students. The committee members further said that in 2009, Khan was allegedly involved in sexual harassment of a female student but that was successfully pushed under the rug internally. In other similar incident involving Awan with a female student of ITD on July 8, the inquiry committee members said that Awan’s flawless character was tarnished on the day as they found that he committed the assault.

Besides, on August 10, 2011 Islamabad High Court (IHC) Chief Justice Iqbal Hameedur Rehman dismissed the QAU examination controller’s plea. Making the QAU Syndicate, VC Dr Masoom Yasinzai and Chairman Professor Dr Saqib Ali as respondents, Babar had filed a writ petition before the court challenging the show cause notice of August 4, issued to him by the university syndicate. The petitioner maintained that he had worked as examination controller at the university for the last six years and had a good reputation. On June 17, 2011, female student of second semester MSc at the university accused Babar of sexual harassment.

لاہور (رپورٹ : شاہین حسن) بحیثیت ملک تعلیم کے شعبے میں ہماری کارکردگی کبھی بھی قابل قدر نہیں رہی ہے۔ اس کی بنیادی وجہ تعلیم کے فروغ کا ملکی ترجیحات میں شامل نہ ہونا ہے۔ اس کا اندازہ اس سے لگایا جاسکتا ہے کہ اکنامک سروے آف پاکستان 2009-10 کے مطابق 2006-07 میں ملک کی کل قومی پیداوار میں سے حکومتی سطح پر تعلیم پر صرف کرنے کے لئے 2.5 فیصد رقم مختص کی گئی جو 2009-10ء میں کم ہو کر 2 فیصد رہ گئی۔ ملک میں تعلیمی نظام کا اندازہ تعلیمی ڈھانچے (انفرا اسٹرکچر) سے لگایا جاسکتا ہے۔ پاکستان ایجوکیشن اسٹیٹکس 2009-10ء کے مطابق ملک کے 15 ہزار (9.8 فیصد سرکاری) اسکولوں کی سرے سے بلڈنگ ہی نہیں اور ان اسکولوں کے بچے کھلے آسمانوں تلے گرمی اور سردی کی شدت کے ساتھ تعلیم حاصل کرنے پر مجبور ہیں۔ 53 ہزار (32.7 فیصد) سے زائد اسکولوں میں طلبہ کے لئے پینے کے پانی کا کوئی انتظام نہیں۔ 57 ہزار (35.4 فیصد) اسکولوں میں بیت الخلا کا کوئی وجود نہیں ہے جس سے بچوں خصوصاً بچیوں کا مشکل حالات میں تعلیم کے حصول کا اندازہ لگایا جاسکتا ہے جبکہ ملک میں سب سے زیادہ 96 ہزار (59 فیصد) سے زائد سرکاری اسکول بجلی کی سہولت سے محروم ہیں۔ بنیادی سہولتوں سے محروم اسکولوں کا اگر صوبوں کی سطح پر موازنہ کیا جائے تو بجلی کی سہولت سے محروم کل اسکولوں میں سب سے زیادہ 41 فیصد اسکول صوبہ سندھ میں ہیں۔ پنجاب میں بجلی کی سہولتوں کے بغیر چلنے والے اسکول 24 فیصد خیبر پختون خواہ 13 اور 10 فیصد بلوچستان میں ہیں۔ یہ امر قابل ذکر ہے کہ ملک میں بیت الخلا، پینے کے پانی، چار دیواری اور بغیر بلڈنگ اسکولوں کی سب سے زیادہ تعداد بھی صوبہ سندھ میں ہی ہے۔ اکنامک سروے آف پاکستان 2010-11ء کے مطابق ملک کے بیت الخلا سے محروم کل اسکولوں میں سے 37.5 فیصد، پانی سے محروم، 44.7 چار دیواری کے بغیر 44.9 جبکہ بلڈنگ سے محروم 67 فیصد اسکول سندھ میں ہیں۔ پنجاب میں 21.8 فیصد اسکول بیت الخلا 13 فیصد پینے کے پانی 21.8 فیصد چار دیواری اور 6.6 فیصد اسکولوں کی بلڈنگ نہیں ہے۔ خیبر پختون خواہ میں 12.6 فیصد اسکول بیت الخلا 16.9 فیصد پینے کے پانی 15.6 فیصد چار دیواری اور 2.6 فیصد بغیر بلڈنگ کے اسکول ہیں جبکہ ملک کے کل بیت الخلا سے محروم اسکولوں میں سے 14.6 فیصد بغیر چار دیواری کے 2.6 اور بلڈنگ سے محروم 4.7 فیصد اسکول بلوچستان میں ہیں۔ منسٹری آف ایجوکیشن کے اعداد و شمار کے مطابق دیہاتوں میں 65.5 اسکولوں میں بجلی، 40.6 فیصد میں پانی، 38.5 فیصد میں بیت الخلا اور 40.2 فیصد اسکولوں کی چار دیواری نہیں ہے۔ اس کے مقابلے میں شہری علاقوں میں 35.8 فیصد اسکول بجلی، 6.7 فیصد پانی، 30 فیصد بیت الخلا اور 27.9 فیصد چار دیواری کی سہولت سے محروم ہیں۔ مجموعی طور پر ملک میں سہولتوں سے محروم کل اسکولوں میں سے 88 فیصد بجلی، 96 فیصد پانی، 83 فیصد بیت الخلا اور 85 فیصد چار دیواری کے بغیر اسکول دیہاتوں میں ہیں۔

تاریخ کا ہیرو

بانی پاکستان قائد اعظم محمد علی جناح کے یوم ِولادت پر خصوصی مضمون

نومبر1995ءمیں نشر ہونے والے شہزادی ڈیانا کے انٹرویو نے کچھ ایسے سوالات اٹھائے ہیں جو میرے موضوع سے متعلق ہیں۔ ہم نے اپنے عہد کی اس افسانوی شخصیت کا اندازہ لگایا جسے بے جا مداخلت کرنے والا بے ادب میڈیا گھیرے ہوئے ہے۔ مختلف ثقافتی اور سیاسی تناظر میں پیدا ہونے والی کہانیوں سے تشکیل پانے والے حقائق میں اصل ڈیانا کون سی ہے؟ بری بیوی، چالاک سازشی یا 1990ءکی دہائی کی عظیم خاتون یا انگریز شہنشاہیت کو تباہ کرنے والی عورت؟ تو پھر کیا ہیرو شخصیات اب محض ماضی کا قصہ بن چکی ہیں۔ محض کارلائل کے زمانہ کی یادگار؟

ہم ان سوالات کا تجزیہ بانی پاکستان قائد اعظم محمد علی جناح کی شخصیت کے تجزیہ سے کریں گے۔ جناح کو ہیرو قرار دیا جاسکتا ہے اگر اس اصطلاح کی تعریف ان معنوں میں کی جائے کہ وہ ایک ایسی شخصیت تھے جن کے دل ودماغ اعلیٰ ترین صلاحیتوں کے حامل تھے، جنہوں نے تقریباً ناممکن کام کر دکھایا (ایک قومی ریاست کی تشکیل) اور (انگریزوں، ہندووں اور سکھوں کی) ایک بہت سنجیدہ اور بڑی مخالفت کے مقابلہ میں کامیابی حاصل کی۔

اسلام نے برصغیر کے مسلمانوں کو شناخت کا احساس دیا۔ مغلوں اور دوسرے شاہی خاندانوں نے انہیں زمینیں دیں اور علامہ اقبال جیسے شاعروں نے ان میں اپنی منزل کا تصور اجاگر کیا۔ جناح کی شخصیت کی عظمت اس حقیقت سے سامنے آتی ہے کہ تحریک پاکستان کی رہنمائی اور پاکستان کی تخلیق کے دوران انہوں نے برصغیر کے مسلمانوں کو یہ تینوں چیزیں دیں۔

یہ کہانی برصغیر کے مسلمانوں کے عروج کے بعد مکاری اور فریب کاری کے ذریعے ان کے درجہ بدرجہ زوال حتیٰ کہ1857ءکے حتمی انجام سے شروع ہوتی ہے۔ اس سال مسلمانوں نے اپنی گزشتہ عظیم سلطنت کی آخری یادگار بھی گنوادی۔ جب ایک دہائی کے بعد ہنٹر نے مسلمانوں کے متعلق لکھا تو اس سے بہت پہلے انہیں اپنے مستقبل کے متعلق خطرات کا احساس ہوگیا تھا۔ اگلی صدی کے دوران یہ احساسات بڑھتے رہے۔ بنگال کی تقسیم کے کچھ سالوں بعد ہی 1911ءمیں بنگالی مسلمانوں سے ان کا صوبہ چھین لیا گیا اور1964ءمیں اسلام کی سیاسی قوت کا استعارہ سلطنت عثمانیہ بھی ختم ہو گئی۔

گاندھی کے منظر عام پر آنے اور اس کی بدولت ہندو برادری کو تحفظ اور اعتماد کا احساس ہونے کی وجہ سے مسلمانوں میں مزید بے چینی پیداہوئی۔ راشٹریہ سیوک سنگ اور دوسری ہندو انتہا پسند جماعتیں1920ءکی دہائی میں قائم ہونا شروع ہوئیں اور ایک تسلسل کے ساتھ منظم فرقہ وارانہ تشدد کا آغاز ہوگیا۔1930ءکی دہائی میں ایک ہندو نظریہ ساز گولواکر اس بات کا پرچار کررہا تھا کہ مسلمانوں کے ساتھ ایسا سلوک کرنا جائز ہے جو ہٹلر نے یہودیوں کے ساتھ کیا۔ مسلم لیگ کی تحقیق پیر پور رپورٹ کی صورت میں متشکل ہوئی جس میں سنگین نوعیت کے الزامات کی ایک طویل فہرست تھی۔ اس مایوسی کے عالم میں مسلمانوں نے کسی ہیرو شخصیت کی تلاش شروع کردی۔

30ءاور40ءکی دہائیوں میں جناح کی تحریک نے مسلمانوں کے زوال کو روکا اور اسے ناقابلِ تردیدفتح میں تبدیل کردیا اور پاکستان کی تخلیق کی جو اس وقت دنیا کی دوسری بڑی اسلامی مملکت تھی۔ جناح جدید صلاح الدین ایوبی بن گیا، اگرچہ یہ صلاح الدین شاہی انگریزی بولتا تھا اور انگریزی لباس کا شوقین تھا جس کا ذوق اسے لنکن ان میں قیام کے دوران پیدا ہوا تھا۔ ماضی کے مسلم ہیرو یا تو حکمران تھے یا جاگیردار یا جہاد کی بات کرنے والے مولوی تھے یا صوفی۔ جناح کا تعلق ان میں سے کسی کے ساتھ نہیں تھا۔ اس کے علاوہ کئی لوگوں کی نظروں میں جناح بہت زیادہ مغربیت زدہ تھے۔ بہت زیادہ قانون پسند تھے اور خواتین اور اقلیتوں کے حقوق کے ضرورت سے زیادہ علمبردار تھے۔ ان حقائق کے تناظر میں جناح کا معروف لیڈر بننا ممکن نظر نہیں آتا تھا۔

اس کے باوجود جناح کی شخصیت برصغیر کے مسلمانوں کے رگ وپے میں سرایت کر گئی جس نے ان کے اندر جوش وولولہ پیدا کیا اور عوام ان کی پرستش کرنے لگے۔” وہ ایک خدا کی طرح تھے۔ اگرچہ ہم مسلمان انہیں خدا نہیں کہہ سکتے۔ وہ ہماری نجات تھے“۔ یہ الفاظ سر عبداللہ ہارون کی بیٹی زینت کے تھے جب انہوں نے1940ءمیں قائداعظم کو پہلی مرتبہ دیکھا۔ یحییٰ بختیار نے1943ءمیں قائداعظم کی ایک تصویر اتاری جس میں وہ مسلم احساس تفاخر کی تجسیم نظر آتے تھے۔ یحییٰ بختیار، جو اب سینیٹر ہیں، ان احساسات کو یاد کرتے ہیں جو قائداعظم کو پہلی مرتبہ دیکھتے ہوئے ان کے دل میں پیدا ہوئے۔ وہ ایک ٹرک کی چھت پر بیٹھے تھے اور ہزاروں پر جوش لوگوں نے انہیں گھیررکھا تھا۔

” ایسا لگتا تھا کہ وہ دہلی کے فاتح ہیں“۔

پاکستانیوں نے قائداعظم کی شخصیت کو افسانوی ہیرو کا درجہ دیا۔ لیکن پاکستان کے باہر ہندووں اور انگریزوں کے زیر قبضہ ذرائع ابلاغ نے انہیں انگریز راج کے آخری سالوں میں ہونے والے سیاسی ڈرامے کا ولن قرار دیا۔ دلائل یہ ہیں کہ جناح پاکستان کا مطالبہ کرتے تھے کیونکہ وہ ”خبطی“،”جنونی“،”مغرور“ اور”خبطِ عظمت“ کا شکار تھے۔( ان میں سے کچھ الفاظ ماونٹ بیٹن اور نہرو نے استعمال کیے ہیں) یہاں تک کہ ماونٹ بیٹن نے قائداعظم کے بارے میں انگریزی حروف” بی“ سے شروع ہونے والا نہایت ہی نازیبا لفظ استعمال کیا۔ مسلم جدوجہد کو فرد واحد کے تناظر میں دیکھنے اور جناح کی تذلیل کرنے کے رویہ نے ثابت کردیا کہ وہ مسلمانوں کے احساسات کو سمجھنے میں ناکام رہے تھے۔

ماونٹ بیٹن کے خیالات کو، جو پہلے وائسرائے تھے اور جنہوں نے میڈیا کو اپنے ذاتی مقاصد کے لیے ایک کندہتھیار کے طور پر استعمال کیا، کئی ابلاغی اداروں نے مشتہر کیا جن میں بی بی سی کی ٹی وی سیریل خاص طور پر قابل ذکر ہے جو ان کی زندگی پر بنائی گئی تھی۔ ایسی کتابیں شائع کی گئیں جن کے عنوانات میں ماونٹ بیٹن کے لیے تقدیس تھی مثلاً کیمپ بیل۔

جانسن کی” ماونٹ بیٹن کا مشن“(1953ئ) ماونٹ بیٹن کی فلم دیکھتے ہوئے تکلیف دہ احساس ہوتا ہے کہ ہمارے کان کچھ اور سن رہے ہیں اور آنکھیں کچھ اور دیکھ رہی ہیں۔ پہلی مرتبہ جب قائداعظم کو ماونٹ بیٹن اور ان کی اہلیہ سے ملاقات کرتے ہوئے دکھایا جاتا ہے تو قہقہے اور ہنسی مذاق واضح نظر آتے ہیں۔ ہم جانتے ہیں کہ جناح نے گھر واپس آکر ماونٹ بیٹن کے متعلق بہت گرم جوشی سے گفتگو کی لیکن ماونٹ بیٹن کی رائے تھی” میرے خدایا! بہت سرد مہر آدمی تھا“۔

سررچرڈ ایٹن بورو کی فلم ”گاندھی“ سیدھے سیدھے ماونٹ بیٹن کے تعصبات کی توثیق کر دیتی ہے۔ یہ ذہن میں رکھنا بہت ضروری ہے کہ اس فلم کو نہرو اور ماونٹ بیٹن کی نام موسوم کیا گیا اور اس کی تشکیل میں اس وقت کی بھارت کی وزیراعظم اور نہرو کی صاحب زادی اندرا گاندھی نے بہت ماونت کی تھی۔” گاندھی“ میں اس بات کا خیال رکھا گیا ہے کہ اس فلم کو دیکھ کر لاکھوں لوگوں کے ذہنوں میں یہ تاثر پیدا ہو کہ قائداعظم محمد علی جناح بدخُو اور مفسد تھے۔ المیہ یہ ہے کہ کئی نوجوان پاکستانی خاص طور پر برطانیہ میں رہنے والے قائداعظم کو اسی فلم سے جانتے ہیں۔ اس عالم میں ذرائع ابلاغ کی حقائق کو مسخ کرنے کی طاقت اور اپنے ہیرو سے نوجوانوں کی عمومی لاعلمی ثابت ہوجاتی ہے۔

ماونٹ بیٹن کا یہ لائحہ عمل بہت مشکل تھا کہ ہندوستان کو متحد رکھا جائے اور اقتدار پر امن طور پر ہندوستانیوں کے حوالے کردیا جائے۔ لیکن ہندوستان میں اپنی آمد کے بعدانہوں نے غیر جانبداری کو ترک کر کے اس مقصد کو اور زیادہ مشکل بنا لیا۔ ان کا کہنا تھا کہ پاکستان کا منصوبہ” پاگل پن“ تھا، اگرچہ اسے ہندوستان کی دوسری بڑی سیاسی جماعت کی حمایت حاصل تھی۔ جناح نے درست طور پر ماونٹ بیٹن کی درخواست رد کی کہ تقسیم کے بعد اسے پاکستان اور بھارت کا مشترکہ گورنر جنرل بنا دیا جائے۔ ماونٹ بیٹن نے قائداعظم سے پوچھا تھا ”کیا تمہیں احساس ہے کہ تمہیں اس کی کیا قیمت چکانا پڑے گی؟“۔ جناح کا جواب تھا ”کئی کروڑ روپے“ پھر ماونٹ بیٹن نے کہا” یہ تمہیں تمہارے تمام اثاثوں اور پاکستان کے مستقبل سے محروم کرسکتی ہے؟“ یہ واضح ہے کہ اگر جناح پہلا پاکستانی تھا تو ماونٹ بیٹن پہلا پاکستان مخالف تھا۔

ماونٹ بیٹن اور محمد علی جناح کے مابین ہونے والے اعلیٰ سطح کے خفیہ اجلاسوں کے نوٹس ہمیں ان دونوں کرداروں اور ان کے مقاصد سے متعلق ان کی حکمت عملی کے بارے میں بتاتے ہیں۔ قائد اعظم ہر صورت میں پاکستان چاہتے تھے اور کوئی بھی چیز انہیں اس سے نہیں روک سکتی تھی۔ ماؤنٹ بیٹن کی ہر سنہری پیشکش کو انہوں نے دھتکار دیا۔ ہر دلیل اور دھمکی کی مزاحمت کی۔ ماؤنٹ بیٹن محمد علی جناح کے دو اہم صوبوں پنجاب اور بنگال کو آدھا آدھا کاٹ دے گا، ماؤنٹ بیٹن جناح کو فوج نہیں دے گا، ماؤنٹ بیٹن نے محمد علی جناح کو متحدہ انڈیا کی وزارت عظمیٰ کی پیشکش کی۔ ہر لالچ اور دلیل کی ناکامی نے بالآخر ماؤنٹ بیٹن کو مشتعل کر دیا۔ جناح کو لنگڑا لولا اور تباہ حال پاکستان قبول کرنا تھا یا پھر ماؤنٹ بیٹن، انہیں کسی بھی طرح کی کوئی پیشکش کیے بغیر اقتدار کانگریس کو منتقل کر کے انڈیا کو چھوڑ جانا تھا۔ یہ بات ناپختہ تھی لیکن وقت قائد کے ہاتھ سے تیزی سے نکل رہا تھا اس لیے قائد کے پاس ایک ہی انتخاب تھا جیسا کہ محمد علی جناح نے کہا کہ ”کرم خوردہ“ اور ”کٹا پھٹا“ پاکستان یا پھر کچھ بھی نہیں۔ صاف ظاہر ہے قائد اعظم کے پاس صرف ایک ہی راستہ تھا جو انہوں نے اپنایا۔ لیکن ماؤنٹ بیٹن کی صرف ایک ہی حکمت عملی تھی کہ وہ ہر طرح پاکستان کے حقیقی تصور کو صوبائی (پنجاب اور بنگال)، ضلعی (گوردارسپور اور فیروز پور)، ریاستی (کشمیر) کی سطح پر قتل کر دیتے۔

ماؤنٹ بیٹن نے پنجاب سے برطانوی افواج کو وعدہ کرنے کے باوجود وہاں سے ہٹا لیا جس کی وجہ سے وہاں فرقہ وارانہ فسادات پھوٹ پڑے، نتیجتاً 10 لاکھ افراد ہلاک ہوئے (ماؤنٹ بیٹن نے ایک طویل عرصے تک ان اعداد و شمار کو چھپائے رکھا)۔ بالآخر ابتدا ہی میں اثاثوں کی تقسیم میں پاکستان کے حصہ کو دبا لیا گیا۔ گاندھی کے احتجاجاً مرن بھرت رکھنے پر کچھ حصہ پاکستان کو دیا گیا۔

اگر مورخین نے جناح کی ذات کو توڑ موڑ کر پیش کیا ہے تو یہ بھی درست ہے کہ انہوں نے ایڈوینا ماؤنٹ بیٹن (ماؤنٹ بیٹن کی بیوی) اور نہرو کے درمیان عشق و محبت کے معاملات کی بھی پردہ پوشی کی ہے۔ اب شائع ہونے والے خطوط، تصاویر ان دونوں کے مابین گہری دوستی اور پُرلطف تعلقات کا منہ بولتا ثبوت ہیں۔ اعلیٰ سطحوں پر زنا کاری جیسے معاملات پر مسحور ہونے کے بجائے، جیسا کہ پینوراما پروگرام کا مرکزی نقطہ تھا، ہمیں پٹڑی سے نہیں اترنا چاہیے۔ ہمیں صرف اس رومانوی تعلق سے تقسیم کی سیاست پر رونما ہونے والے اثرات میں دلچسپی ہے جس سے جناح اور اس کا پاکستان کئی طرح سے متاثر ہوا۔

کیا نہرو نے ایڈوینا کو دیوانہ نہیں کر دیا تھا، وہ اس قابل نہیں تھا کہ جناح کے بارے میں اسے مکمل طور پر قائل کر سکے، وہ اس قابل بھی نہیں ہو گاکہ مستقبل کی ریاستوں، پاکستان اور انڈیا، کے بارے میں تقسیم کے منصوبے اور اہم معلومات حاصل کر کے اور فرمانبردار وائسرائے کے فیصلوں پر اثر انداز نہ ہو سکے۔

خفیہ طور پر مستقبل کی ریاستوں کی حد بندی کو دیکھنے کے بعد جب نہرو نے انہیں تبدیل کرنے پر اصرار کیا تھا تو ماؤنٹ بیٹن نے اس کا دوبارہ خاکہ کھینچا تھا۔ نہرو نے جب شمال مغربی سرحدی صوبہ کے گورنر سر اولف کارو کے بارے میں شکایت کی تو ماؤنٹ بیٹن اسے برخاست کرنے پر فوراً تیار ہو گیا۔

ایڈوینا نے بہت موثر انداز میں عوامی سطح پر نہرو اور اس کے مقصد کے لیے مہم چلائی۔ ایک طاقتور اور امیر عورت ایڈوینا نہ صرف اپنے شوہر پر اثر انداز ہوئی بلکہ اس نے لندن کی اہم شخصیات کو بھی اپنا ہمنوا بنایا۔ یہ بات ریکارڈ پر موجود ہے۔ ایڈوینا کا دورہ کشمیر واضح طور پر نہرو کی حمایت میں ایک سیاسی بیان تھا، اس معاملہ کا برطانوی ذرائع ابلاغ نے خوب چرچا کیا۔ یہ ایک غیر معمولی اور بہت اہم بات تھی کیونکہ برطانوی نو آبادیاتی نظام کی تاریخ میں اس سے پہلے کسی بھی مقامی باشندے، خواہ اس کا تعلق کسی بھی اعلیٰ نسب خاندان سے ہو، کی رسائی وائسرائے کے گھر تک نہیں ہوتی تھی جبکہ نہرو ایک ایسے شخص کی شکل میں نمودار ہوا جو وائسرائے کے دفتر کو اس کے بیڈ روم سے کنٹرول کرتا تھا۔

برطانوی مورخوں نے عمومی طور پر اس معاشقے کو یا تو نظرانداز کر دیا یا اسے دھندلا دیا۔ یہاں تک کہ فلپ زیگلر نے 1985ءمیں لارڈ ماؤنٹ بیٹن کی 800 صفحات پر مشتمل جو ”سرکاری سوانح حیات“ لکھی اس میں بھی مصنف نے ان کی دوستی کو جلد بازی میں صرف چند پیرا گرافوں میں بیان کیا جن میں صرف اس کی خوبصورتی پر زور دیا گیا۔ بایں ہمہ ماؤنٹ بیٹن کا تعلق شاہی خاندان سے تھا اور اس کے بھتیجے نے ملکہ سے شادی کی تھی۔ ماؤنٹ بیٹن ایک شاندار جنگی ہیرو بھی تھا۔ ایسی صورت حال میں آج بھی ایک کنٹرولڈ میڈیا اور دوستانہ دیومالا حقیقت کی صورت گری کرتے ہیں۔

ابتدائی دہائیوں میں بھارت کے اندر بھی نہرو کے لیے عزت کی وجہ سے وہاں خاموشی طاری رہی۔ بھارت کے صدر رادھا کرشنا کے بیٹے سروپالی گوپال کی کتاب کی تین بڑی جلدیں، جن میں نہرو کا مطالعہ کیا گیا ہے، میں بھی نہرو اور ایڈوینا کے تعلقات سے صرف نظر کیا گیا ہے، لیکن یہاں یہ بات سمجھ نہیں آتی کہ پاکستانی سکالر ماؤنٹ بیٹن سے اس قدر تعلق کو دریافت کرنے اور اس کے تقسیم کے عمل پر رونما ہونے والے اثرات کو منظر عام پر لانے میں کیوں ناکام رہے۔ شریف المجاہد کی کراچی سے شائع ہونے والی 800صفحات پر مشتمل اتھارٹیٹیو سٹڈی آف جناح میں ایڈوینا کا ذکر تک نہیں کیا گیا۔

مورخین ہمارے سامنے ماؤنٹ بیٹن کی مکمل تصویر پیش کرنے میں ناکام رہے ہیں۔ یہی وجہ ہے کہ جناح کے بارے میں ماؤنٹ بیٹن کا برطانوی موقف وسیع طور پر قبول کیا گیا اور جب دوسری نسل نے اس پر تبصرہ شروع کیا تو اس موقف کو ان کی صحافتی تحریروں میں داخل کیا گیا (کرسٹینا لیمب اور ایما ڈنکن اس کی مثال ہیں) تو چند لوگوں نے اسے چیلنج کیا۔ گزشتہ چند سالوں میں اینڈریو رابرٹ جیسے کچھ نوجوان برطانوی مورخوں نے تقسیم ہند کی روایت دیو مالا کو مسترد کر دیا اور اس عمل میں ماؤنٹ بیٹن کے کردار کی خوب خبر لی۔ ارون شورائی جیسے ہندو اور ایم جے اکبر جیسے مسلمان دونوں نے جناح کے بارے میں منفی معیار والے موقف کو قبول کیا۔ تاہم کچھ نمایاں ہندوستانیوں، جن میں نرد چودھری، راج موہن گاندھی اور ایم ایم سروائی شامل ہیں، نے اس سٹیریو ٹائپ معیار کو چیلنج کیا ہے۔

نرد چودھری نے اپنی سٹڈی آف انڈیا فرام 1921-52ء”دی ہینڈ گریٹ انارک“ میں لکھا ہے کہ ”محمد علی جناح وہ واحد آدمی ہے جو ہندوستان میں برطانوی استعمار کے ذلت آمیز خاتمہ میں کامیابی اور عزت سے باہر آیا“۔ افسوس کی بات ہے کہ پاکستان میں محمد علی جناح کی اتنی خدمت نہیں کی گئی جس کی ضرورت تھی۔ پاکستان اپنی مقامی مارکیٹ میں قائد پر ایک بھی بین الاقوامی معیار کی سوانح عمری پیش نہیں کر سکا۔ قائد اعظم کے بارے میں لکھی جانے والی دو بہترین سوانح عمریاں غیر ملکیوں، ہیکٹر بالیتھو نے 1950ءاور سٹینلے والپرٹ نے دس سال پہلے لکھیں۔ ابھی تک پاکستان اس قابل نہیں ہوا کہ وہ جناح پر ایک ایسی مشہور فلم بنا سکے جس میں جناح کی کہانی بیان کی گئی ہو۔ اٹین بورو کی فلم اس لیے بہت یادہ پاور فل تھی کیونکہ اس نے اس وقت یہ کام کیا جب یہاں مکمل خلا تھا۔

زینت اور بختیار جیسے کئی پاکستانیوں کو یقین ہے کہ پاکستانی سیاستدان جناح کے اعلیٰ تصورات کی وجہ سے مشکل میں ہیں اسی لیے انہوں نے قائد اعظم کو پس پشت ڈال رکھا ہے اور ان سے عقیدت صرف لفظوں کی حد تک محدود ہے۔ ان کی تصویر کرنسی نوٹ پر ہے یا دفاتر میں دیواروں پر لٹکانے کے لیے استعمال ہو رہی ہے۔ سوانح عمری کسی ایک فرد کی زندگی سے کہیں زیادہ ہوتی ہے جس میں یہ بھی ہوتا ہے کہ اس کے دوست کون تھے اور نقاد کون۔

اگر ہم چاہتے ہیں کہ سوانح عمری اور تاریخ اتنی ہی درست ہو جتنا کوئی حقیقت ممکن ہے.... اور وہ ثقافتی اور سیاسی تعصبات کی عکاس نہ ہو.... تو ہمیں اپنی سوچ کے دھاروں اور طریقیاتی پہنچ کو وسیع کرنا ہو گا۔ علاقائی، ثقافتی، بشریات اور عام لوگوں سے انٹرویو کرنے کی ضرورت ہے کیونکہ ان چیزوں نے بہت سارے مورخین کی تنگ نظری پر مبنی اور گمراہ کن حقیقتوں کو درست کرنے میں مدد دی ہے۔ کسی بھی طبقے کی طرف سے جاری کردہ دیو مالا، جس میں دوسروں کے کردار کو منفی طور پر اور تاریخ کو مسخ کر کے پیش کیا گیا ہو، کو چیلنج کرنے کی اشد ضرورت ہے۔ سکولوں اور کالجوں کو ضرورت ہے کہ وہ اپنے طلبا کو ہمسایہ ملکوں کی ہیرو شخصیات کے بارے میں تعلیم دیں۔ اسرائیل عربوں کے بارے میں، بھارت پاکستانیوں کے بارے میں اور یہ ملک بھی اسی طرح کریں۔

اسی طرح پاپولر ذرائع ابلاغ کو بھی مستقل طور پر یہ یاددہانی کرانے کی ضرورت ہے کہ وہ مسبوکہ باتیں نہ دہرائیں (مثلاً جناح سرد مہر تھے، وہ کبھی مسکراتے نہیں تھے، مسلم عظمت رفتہ) یہ اختصار نہ صرف گمراہ کن ہے بلکہ خطرناک بھی ہے۔ ڈیانا اور اس کی پیش رو ایڈوینا کے درمیان صرف ایک نسل کا فاصلہ ہے لیکن معاشرتی اقدار، طاقت اور میڈیا کے اصول و قواعد میں بنیادی تبدیلی رونما ہو چکی ہے۔ ایڈوینا اور ماؤنٹ بیٹن نے جو کچھ اس وقت کیا اگر وہ آج کے ثقافتی ماحول میں ایسا کرتے تو فرار نہ پا سکتے۔

برطانیہ اور اس جیسے ممالک، جہاں ایسا دانشورانہ اور ثقافتی رجحان ہے کہ جس میں ہیرو شخصیت کے کپڑے اتارے جاتے ہیں، شاید بہت آگے تک پہنچ چکا ہے۔ وہ تمام لوگ جو ایک مرتبہ ہیرو کے استھان پر رہے ہیں صحافتی بغض اور عداوت کا نشانہ ہیں یا سوانح نگار ان کے کارناموں کے بجائے ان کی جنسی زندگی میں زیادہ دلچسپی لے رہے ہیں۔ کوئی بھی نمایاں شخصیات خواہ وہ وزیر اعظم ہو یا شاہی خاندان کا کوئی فرد کیا وہ موجودہ افراتفری کے ماحول میں عداوتی روایت شکنی کے اس ”گٹر پریس“ سے اپنی عزت طویل عرصے تک بچا سکا ہے۔ ایسی عوامی شخصیات کی غیر موجودگی، جن پر ہم بھروسہ کر سکتے ہوں، نے عمومی عالمی خطرات اور روایتی اقدار کی ٹوٹ پھوٹ، وسیع پیمانے پر پھیلتے لسانی اور مذہبی تشدد نے امن اور بھائی چارے کی دائمی فضا کے بارے میں پریشانی پیدا کر دی ہے۔ اس طرف کوئی دھیان نہیں دیتا۔ سربیا کے صوبہ کوسووو کا میدان جنگ ہو یا یروشلم اور ایودھیا کی عبادت گاہ، یہی ایک وجہ ہے کہ لوگ کیوں ماضی کی آسان اور یقینی دیو مالا کی طرف لوٹ جاتے ہیں۔

مسلم دنیا بھی اپنے استبدادی فوجی آمروں، تنگ ذہن مذہبی شخصیات اور بدعنوان جذبات انگیز خطیبوں کی وجہ سے صلاح الدین ایوبی کی تلاش میں ہے۔ محمد علی جناح کی دوبارہ جانچ پڑتال نہ صرف انصاف بلکہ سچائی کی تلاش کے لیے بھی ضروری ہے۔ اس کے علاوہ اس وقت جبکہ ہمیں ایک روشن خیال اور دیانتدار و قابل عمل مسلم رہنما کی مثال کی ضرورت ہے وہ بھی مل جائے گی۔

ہمیں اس وقت اپنے دور کو برا اور خبطی کہنے کے بجائے اس میں موجود ان ہیرو شخصیات کو پہچاننے کی ضرورت ہے جو ہمارے درمیان موجود ہیں، جو ان لمحات میں اپنے لوگوں کے لیے لطیف تمناؤں اور آدرشوں کی صورت گری کر سکیں۔

ٹرانس پیرنسی انٹرنیشنل پاکستان ایک غیر ذمہ دار تنظیم؟

ملکی وغیر ملکی غیر سرکاری ادارے اکثر و بیشتر ملکی حالات خصوصاً تعلیم، صحت ، امن و امان، گڈ گورننس اور کرپشن کے حوالے سے سروے و خصوصی رپورٹیں شائع کرتے رہتے ہیں۔ ان میں بعض اداروں کے بارے میں کہا جاتا ہے کہ وہ نیک نیتی سے یہ رپورٹیں بناتے ہیں جبکہ بعض ادارے اپنے اپنے مفادات کو مد نظر رکھ کر کچھ باتوں کو بڑھا چڑھا کر پیش کرتے ہیں۔

اسی طرح کی ایک رپورٹ گذشتہ سال کے آخر میں ٹرانس پیرنسی انٹرنیشنل نے کرپٹ ممالک کے حوالے سے جاری کی تھی۔ جس کے مطابق پاکستان میں کرپشن میں بے انتہااضافہ ہوا ہے اور 2009ءمیںپاکستان کرپٹ ترین ممالک کی فہرست میں 42ویں نمبر پر تھا لیکن 2010ءمیں پاکستان 34ویں نمبر پر آگیا۔

ٹرانس پیرنسی انٹرنیشنل ایک گلوبل سول سوسائٹی تنظیم ہے جس کا دعویٰ ہے کہ وہ پوری دنیا میں بدعنوانی کے خلاف جہاد کر رہے ہیں۔ یہ تنظیم1993ءمیں بنائی گئی جس کا مرکزی دفتر بلجیم کے شہر برسلز میں اور مرکزی سیکرٹریٹ جرمنی کے شہر برلن میں ہے۔ جرمنی میں اس تنظیم کے ساتھ 90کے قریب ادارے منسلک ہیں جو ہر سال جرمنی کے مختلف اداروں میں پائی جانے والی بد عنوانی کے بارے رپورٹیں جاری کرتے ہیں جبکہ بین الاقوامی بدعنوانی کے حوالے سے اس تنظیم کے مزید چار شعبے ہیں جن میں ایک ڈیسک افریقہ اور مڈل ایسٹ کے ممالک میں ہونے والی کرپشن اور ایک امریکا ( جن میں لاطینی امریکا کے ممالک بھی شامل ہیں ) ،ایک ایشیا پیسیفک کے ممالک کیلئے اور آخری شعبہ یورپ اور سنٹرل ایشیا کے ممالک پر نظر رکھتا ہے۔

اس تنظیم کی 178کے قریب ممالک میں شاخیں ہیں ۔ ان میں ایک ” ٹرانس پیرنسی انٹرنیشنل پاکستان“ کے نام سے پاکستان میں کام کرتی ہے۔ پاکستان میں اس تنظیم کی شاخ فروری2001ءمیں بنائی گئی جس کا صدر دفتر کراچی میں ہے۔ ٹرانس پیرنسی انٹرنیشنل پاکستان کو مئی 2002ءمیں ٹرسٹ ایکٹ 1882ءکے تحت کراچی میں رجسٹرڈ کرایا گیا جس کے چیئرمین سید عادل گیلانی ہیں اور ایگزیکٹو ڈائریکٹر سعد رشید ہیں جبکہ مشاورتی کمیٹی میں خورشید انور، واجد جواد، شہانہ کوکب، سید سلیم احمد اور عابد شیخ شامل ہیں۔

ٹرانس پیرنسی انٹرنیشنل پاکستان کی طرف سے 2010ءمیں جب رپورٹ جاری ہوئی تو اخبارات اور دیگر ذرائع ابلاغ میں اسے خاصی جگہ دی گئی۔ اس پر بحث و مباحث کا سلسلہ شروع ہوا تو ایسے لگتا تھا کہ پہلے جیسی رپورٹوں کی طرح اس رپورٹ پر بھی کچھ دن بحث جاری رہے گی اور پھر بات آئی گئی ہو جائے گی۔ مگر اس رپورٹ سے نہ صرف حکومتی ایوانوں ، سیاسی افراد اور دیگر سرکاری و غیر سرکاری اداروں میں بحث کا ایسا سلسلہ شروع ہوا جو ابھی تک جاری ہے بلکہ یہ بحث ایک لڑائی کی صورت اختیار کر گئی ہے۔ اس رپورٹ کو اگرچہ بہت سی جگہوں پر درست قرار دیا گیا اور متعدد کی جانب سے جانبدارانہ رپورٹ کہلائی جبکہ ٹرانس پیرنسی انٹرنیشنل پاکستان کے چیئرمین اور تنظیمی ڈھانچے کے حوالے سے تحفظات کا اظہار کیا گیا۔

ٹرانس پیرنسی انٹرنیشنل پاکستان کی اس رپورٹ میں دعویٰ کیا گیا تھاکہ ایک سال کے دوران پاکستان کی وفاقی حکومت کے مختلف محکموں میں 300ارب روپے کی کرپشن ہوئی ہے۔ٹرانس پیرنسی انٹرنیشنل پاکستان کے چیئرمین عادل گیلانی نے اس کرپشن کی بنیادی وجہ ملک میں احتساب کا کوئی موثر طریقہ کار موجود نہ ہونے کو کہا جس کے باعث کرپشن بڑھتی جا رہی ہے۔ انہوں نے کہا کہ ٹی آئی پی نے قومی احتساب بیورو(نیب) کو کرپشن کے چند ایک معاملات سے آگاہ کیا تھا لیکن بیورو نے ایک بھی کیس میں کوئی کارروائی نہیں کی۔ انہوں نے کہا کہ کرپشن کا سب سے بڑا کیس حکومت کی جانب سے شروع کیا جانے والا رینٹل پاور پراجیکٹ ہے جو فی الوقت سپریم کورٹ میں زیر سماعت ہے۔ کرپشن کی فہرست میں یہ پراجیکٹ سرفہرست ہے۔ انہوں نے دعویٰ کیا کہ رینٹل پاور پراجیکٹس کے تحت حکومت نے کم از کم 14 ٹھیکے دینے میں پبلک پروکیورمنٹ ریگولیٹری اتھارٹی (پی پی آر اے) کے قواعد کی خلاف ورزی کی۔ اس بات کی نشاندہی ایشیائی ترقیاتی بینک (اے ڈی بی) کی رپورٹ میں بھی کی گئی تھی اور اس سے 2 ارب ڈالرز سے زائد کا نقصان ہوا۔ عادل گیلانی نے کہا کہ ٹی آئی پی نے سپریم کورٹ کو بھی اس معاملے میں ہونے والی کرپشن اور بے ضابطگی سے آگاہ کیا تھا۔ انہوں نے کہا کہ ٹی آئی پی نے پاکستان سٹیل میں ہونے والی کرپشن کے متعلق بھی کئی اداروں کو لکھا۔ پاکستان سٹیل کی جانب سے سامان کے حصول اور فروختگی کی پالیسی کے نتیجے میں 22 ارب روپے کا نقصان ہوچکا ہے۔ انہوں نے کہا کہ اگرچہ حکومت نے کرپشن کے اس معاملے کو نظر انداز کردیا تھا لیکن یہ سپریم کورٹ میں زیر سماعت ہے۔ عادل گیلانی نے پاکستان ریلویز کی جانب سے امریکا کے تیار کردہ 150 لوکوموٹوز (انجن) کے حصول کے ٹینڈر میں بھی پبلک پروکیورمنٹ ریگولیٹری اتھارٹی (پی پی آر اے) کے قواعد کی مبینہ خلاف ورزی کی بھی بات کی۔

اس رپورٹ پر تنقید اور ٹی آئی پی کے چیئر مین کے حوالے سے تحفظات کا سلسلہ گورنر پنجاب سلمان تاثیر نے شروع کیا جب انھوں نے ٹیویٹر ڈاٹ کام پر ٹرانس پیرنسی انٹرنیشنل کے چیئرمین کیخلاف الزام لگایا کہ عادل گیلانی کو کے پی ٹی سے کرپشن کے الزامات کے باعث نکالا گیا تھا لہٰذا جو شخص کرپشن کی بنیاد پر ملازمت سے نکالا جائے اس کی کرپشن کے خلاف رپورٹ غیرجانبدارانہ نہیں ہو سکتی۔ انھوں نے ٹر انس پیر نسی انٹر نیشنل کو فراڈ قر ار دیتے ہوئے کہا کہ یہ تنظیم ملک کو نقصا ن پہنچا رہی ہے۔ جبکہ جمہوری وطن پارٹی کے مرکزی سیکرٹری جنرل عبدالروف خان ساسولی نے کہا کہ ٹرانس پیرنسی انٹرنیشنل پاکستان کے چیئرمین عادل گیلانی وزیراعظم یوسف رضا گیلانی کا قریبی عزیز ہونے کاتاثر دے کر لوگوں کو بلیک میل کر رہے ہیں۔ انہوں نے حکومت سے اپیل کی تھی کہ عوام کو ان کی بلیک میلنگ سے بچایا جائے۔ پاکستان سٹیٹ آئل کے ایم ڈی عرفان قریشی نے کہا تھا کہ ٹرانس پیرنسی انٹرنیشنل کا چیئر مین پی ایس او کو بلیک میل کرتاہے او ر ا#±س کے لگائے جانے والے تمام الزامات کا حقیقت سے کوئی تعلق نہیں۔سینٹ کی قائمہ کمیٹی برائے پٹرولیم کے سامنے ایم ڈی پی ایس او عرفان قریشی نے بتایا تھا کہ عادل گیلانی 1991ءمیںخود کرپشن کا مرتکب رہا ہے اورا#±س کو وہاں سے نکالا گیاتھا۔ سند ھ اسمبلی کی قا ئم مقا م سپیکر شہلا رضا کی صدارت میں ہونے والے اجلاس میں ٹرانس پیر نسی انٹر نیشنل کے خلا ف ایک مذمتی قرارداد منظورکی گئی جس کو پیپلز پارٹی کے رکن اسمبلی شرجیل انعام میمن نے پیش کیا تھا۔شرجیل میمن کاکہنا تھا کہ عادل گیلانی جمہوری حکومت کو بدنام کرنے کی ساز شیںکر رہے ہیں۔شازیہ مری نے خطاب کے دوران کہا کہ پاکستان کو کرپشن کے نام پر بدنام کیا جارہا ہے۔ان کاکہنا تھا کہ کرپشن کو اپنے ملک کی بدنامی کے لیے استعمال کرنا غداری ہے۔رکن اسمبلی رفیق انجینئر کاکہنا تھا کہ جب سے ملک بنا ہے کرپشن موجود ہے۔انہوں نے کہا کہ خود ساختہ این جی اوز ملک کمزور کرنے کے لیے کام کررہی ہیں۔

عادل گیلانی نے بھی اپنی صفائی اور رپورٹ کی سچائی کے حوالے سے بیانات دیے اور گورنر پنجاب ، رکن سندھ اسمبلی شرجیل انعام میمن اور دیگر کو قانونی نوٹس بھجوائے۔ گورنر پنجاب کو بھجوائے گئے قانونی نوٹس میںعادل گیلانی نے کہا کہ ”مسٹر سلمان تاثیر آپ نے اعلیٰ حکومتی منصب گورنر پنجاب کے عہدے پر فائز ہوتے ہوئے کسی نو عمر لڑکے کی طرح کے رویہ کا اظہار کیا ہے اور 3 جون 2010ءکو ٹیویٹر پر عادل گیلانی کے خلاف بلا جواز ریمارکس دیے ہیں، یہ جانتے ہوئے کہ یہ ریمارکس غلط ہیں۔ اس طرح عادل گیلانی کونہ صرف عوام میں بلکہ ایک بین الاقوامی سائٹ پر بدنام کیا“۔ کسی ایسے شخص سے یہ توقع کبھی نہیں کی جاسکتی کہ وہ پاکستان کے سب سے بڑے صوبے کا گورنر ہو اور اس طرح کی بچگانہ حرکات کرے جو کسی گورنر کو زیب نہ دے“۔ جبکہ شرجیل انعام میمن کو بھیجے گئے قانونی نوٹس میں عادل گیلانی نے کہا ہے کہ وہ سرعام معافی مانگیں یا پھر ان پر 50 کروڑ روپے ہرجانہ کا دعویٰ کیا جائے گا۔ عادل گیلانی کا کہنا ہے کہ انہیں غیر ملکی ایجنٹ بھی کہا جا رہا ہے۔ لیکن یہ لڑائی اس وقت شدت اختیار کر گئی جب عادل گیلانی نے ٹرانس پیرنسی انٹرنیشنل کو ایک خط لکھ کر اسے بھی اپنے ساتھ شامل کر لیا۔ عادل گیلانی نے خط میں لکھا کہ اس رپورٹ کو جاری کرنے کے بعد انھیں قتل کی دھمکیاں دی جا رہی ہے۔ جس پر ٹرانس پیرنسی انٹرنیشنل کے سربراہ ہیوگیٹ لیسیلی نے صدر آصف علی زرداری اور چیف جسٹس افتخار محمد چودھری کو ایک خط ارسال کیا ہے جس میں کہا گیا ہے کہ وہ اس معاملے میں مداخلت کریں۔

اس پر حکومت پاکستان کی ہدایت پر ایف آئی اے نے تحقیقات شروع کر دیں۔ ٹرانس پیر نسی انٹرنیشنل کے چیئرمین عادل گیلانی پر نہ صرف سیاسی حلقوں اور سرکاری اداروں کی طرف سے الزامات لگائے گئے بلکہ این آئی سی ایل کے سابق چیئرمین ایاز نیازی اور تین ڈائر یکٹرز نے باقاعدہ ان کے خلاف درخواست بھی دائر کی۔ جس میں انھوں نے عادل گیلانی کو نیشنل انشورنس کمپنی لمیٹڈ (این آئی سی ایل) میں کئی ارب روپے کے سکینڈل میں ملوث قرار دیا۔جس پر ڈائریکٹر ایف آئی اے پنجاب ظفر قریشی نے عادل گیلانی کو21سوالات پر مشتمل ایک سوالنامہ بھیجا اور ساتھ ہی انھیں23دسمبر کو طلب بھی کیا۔ اس سوالنامے کا عادل گیلانی نے جواب داخل کیا بلکہ انوسٹی گیشن آفیسر کو ایک علیحدہ خط بھی بھیجا جس میں ا#±نہوں نے کہا کہ مجھے ا#±مید ہے کہ اِن سوالات کے جوابات کے بعد 23دسمبر کو ایف آئی اے کومجھے بلانے کی ضرورت باقی نہیں رہے گی۔

این آئی سی ایل کے سابق چیئرمین ایاز نیازی نے ایف آئی اے کو ایک بیان میں بتایا تھا کہ انہیں قاسم امین دادا نے مبینہ طور پر یہ پیشکش کی تھی کہ اگر میں ٹرانس پیرنسی انٹرنیشنل کے ساتھ ایم او یو سائن کر لوں تو وہ میرے خلاف سپریم کورٹ میں زیر سماعت کرپشن کے مقدمات ختم کرا لیں گے۔ ایف آئی اے کے 21میں سے صرف پانچ سوالات این آئی سی ایل لینڈ سکینڈل کی چھان بین سے مطابقت رکھتے تھے، جبکہ دیگر تمام سوالات ٹرانس پیرنسی کے سربراہ کے ذاتی پس منظر اور ان کی سرگرمیوں اور یہ کہ ٹرانس پیرنسی پاکستان میں کس طرح کام کرتی ہے سے متعلق ہیں۔ ان سوالات کے جوابات ملنے کے بعد تفتیشی افسر نے کہا کہ عادل گیلانی نے اپنے جوابات میں کئی جگہ متضاد باتیں کی ہیں اور وہ ایک سوال کے جواب میں دیے گئے اپنے موقف پر دوسرے سوال کے جواب میں ہٹ جاتے ہیں۔ لہٰذا اب ایف آئی اے نے انھیں بذات خود10جنوری کو طلب کر لیا ہے۔

عادل گیلانی اور ٹرانس پیرنسی انٹرنیشنل پاکستان کے حوالے سے وفاقی وزیر داخلہ رحمن ملک کا کہنا ہے کہ ٹرانس پیرنسی انٹرنیشنل ایک کھوج لگانے والی ایجنسی ہے اور اس تنظیم کو پاکستان میں کام کرنے کی ہر گز اجازت نہیں دی جائے گی۔ قانون کے مطابق یہ صرف میڈیا سے بات چیت کر سکتی ہے اور سرکاری داروں سے اطلاعات اکٹھی نہیں کر سکتی۔ انہوں نے یہ بھی کہا تھا کہ سرکاری افسروں سے معلومات کے عوض رشوت دینے پر اس کے خلاف قانونی کارروائی کی جائے گی۔ اب یہ دیکھنا ہے کہ کیا حکومت نے اپنی سبکی کو ختم کرنے کے لیے عادل گیلانی کے خلاف تحقیقات شروع کی ہیں یا واقعی وہ جانبدارانہ رپورٹیں جاری کرنے کے ذمہ دار ہیں؟

ٹرانس پیرنسی انٹرنیشنل کا کرپشن پری سیپشن انڈیکس مختلف ممالک میں کرپشن کو جانچنے کیلئے دنیا کا سب سے قابل اعتبار پیمانہ سمجھا جاتا ہے۔ کرپشن پری سیپشن انڈیکس کے تحت ممالک کو صفر سے دس تک پوائنٹس دیے جاتے ہیں اورجس ملک کو جتنے زیادہ پوائنٹس ملتے ہیں وہاں کرپشن اتنی ہی کم ہوتی ہے اور جن ممالک کے پوائنٹس کم ہوتے جاتے ہیں وہاں بدعنوانی کی سطح اتنی ہی زیادہ ہوتی جاتی ہے۔کرپشن پری سیپشن انڈیکس کے ذریعے دنیا کے178 ممالک کی درجہ بندی کی گئی۔ ان میں سے تین چوتھائی ممالک نے صفر سے پانچ تک پوائنٹس حاصل کیے ہیں جس سے ظاہر ہوتا ہے کہ کرپشن بدستور ترقی کی راہ میں بڑی رکاوٹ ہے۔رپورٹ کے مطابق پاکستان 2.3 پوائنٹس کے ساتھ34 ویں نمبر ہے جبکہ گزشتہ سال پاکستان کا نمبر42 واں تھا۔ فہرست میں پاکستان کے آٹھ درجے نیچے آنے کا مطلب ہے کہ یہاں بدعنوانی میں اضافہ ہوا ہے۔ پاکستان کی نسبت بھارت بدعنوان ممالک کی فہرست میں90 نمبر پر ہے۔ صومالیہ دنیا کا بدعنوان ترین ملک ہے جبکہ افغانستان اور میانمارمشترکہ طور پر دوسرے نمبر پر ہیں۔رپورٹ کے مطابق عراق کرپٹ ترین ممالک کی فہرست میں تیسرے نمبر پر ہے۔اگر دنیا کے سب سے کم بدعنوان ممالک کی بات کی جائے تو ڈنمارک ، نیوزی لینڈ اور سنگاپور9.3 پوائنٹس کے ساتھ مشترکہ طو رپر دنیا کے سب سے کم بدعنوان ملک ہیں جبکہ فن لینڈ اور سویڈن مشترکہ طورپر دوسرے اور کینیڈا تیسرے نمبر پر ہے۔

ایسے سیکولر ازم پر بات کرنے کی ضرورت ہے جس کی بنیاد ہماری اپنی تہذیبی تاریخ پر ہو

”عائشہ صدیقہ پاکستان کے اہم اخبارات میں باقاعدہ سے مضامین لکھتی ہیں۔ انہوں نے کنگز کالج لندن سے1996ءمیںپی ایچ ڈی کی۔ وہ ملٹری ٹیکنالوجی، دفاعی شعبے میں فیصلہ سازی، ایٹمی ہتھیاروں، اسلحے کی خریداری، اسلحے کی پیداوار سے لے کر جنوبی ایشیا میں سول، ملٹری تعلقات جیسے موضوع پر کام کر چکی ہیں۔ وہ دو کتابیں تحریر کر چکی ہیں۔ انہوں نے ڈیفنس سروسز میں ڈپٹی ڈائریکٹر آڈٹ کے طور پر بھی کام کیا ہے۔ حال ہی میں ان کو بعض گمنام کالوں کے ذریعے ہراساں کرنے کی کوشش بھی کی گئی۔ ان کا یہ انٹرویو بہت سے انکشافات کرتا ہے۔

ہم شہری: اپنے پس منظر بارے ہمیں کچھ بتائیے۔ یہ بھی بتائیے گا کہ آپ کس وجہ سے سول سروس میں گئیں اور پھر کیوں اس سروس کو چھوڑ دیا؟

عائشہ صدیقہ: میں لاہور میں پیدا ہوئی اور وہیں پر پلی بڑھی۔ اگرچہ میرے خاندان کا تعلق بہاولپور سے ہے جس سے میرا بھی بہت تعلق ہے لیکن میرا دل لاہوری (لہوری) ہے۔ میں نے 1988ءمیں سول سروس ذاتی وجوہ کی بنا پر جوائن کی تھی۔

1979ءمیں میرے والد فوت ہو گئے تھے اور میں بچپن میں ہی اپنی والدہ کے ساتھ وراثت کے معاملات سے نمٹنے میں تنہا رہ گئی تھی۔ جب میں نے کنیئرڈ کالج لاہور سے بی اے کیا تو میری والدہ جو کہ ناول نگار بھی ہیں، جمیلہ ہاشمی، انہوں نے مجھے سی ایس ایس کرنے کا مشورہ دیا۔ جب انہوں نے میری طرف سے اس تجویز کی مخالفت ہوتے دیکھی تو ایک دن انہوں نے مجھے بتایا کہ دیکھو بیٹا تمہارے ساتھ تو والد ہیں نہ چچا اور نہ ہی کوئی بھائی جو تمہاری مدد کرے، اپنی بقا کے لیے تمہیں خود اپنے قدموں پر کھڑا ہونا ہے۔ قدموں پر کھڑے ہونے کا مطلب اس ملک میں روابط بنانا ہے۔ تو یا تو تمہیں لکھاری بن کر نام کمانا چاہیے(اس سے مراد فکشن رائٹر تھا) یا پھر سول سروس میں شامل ہو جاؤ۔

ایک طرح سے یہ اچھا فیصلہ تھا کیونکہ میں نے اکتوبر 1978ءمیں سی ایس ایس کا تحریری امتحان دے دیا تھا جبکہ میری والدہ جنوری 1988ءمیں جب اس دنیا سے رخصت ہوئیں تو مجھے اپنے پاؤں پر کھڑا کر کے چھوڑ کر گئیں۔ مجھے سمجھ آ گیا تھا کہ بطور سول سروس کارکن ہونے کے دنیا آپ کے لےے کس قدر مختلف ہوتی ہے۔ ڈپٹی کمشنر بہاولپور جو کہ ایک پکا ڈی ایم جی (ڈسٹرکٹ مینجمنٹ گروپ) افسر تھا اور بھورے صاحب کے ساتھ ایک قسم کے مہربان روپ کے ساتھ پیش آتا ہے، اس نے میرے ساتھ اپنا رویہ تبدیل کر لیا۔ اب میں طبقہ عوام سے نہ تھی بلکہ حکمران طبقے کا حصہ تھی۔ یقین کیجیے حکمران طبقے سے ہونے کے فیوڈل، بیورو کریٹک ماحول میں بہت معنی ہوتے ہیں۔

میں آڈٹ اینڈ اکاؤنٹس سروسز میں تھی اور یہاں میں نے مختلف عہدوں پر کام کیا۔ اسی دوران میں وار سٹڈیز میں پی ایچ ڈی کرنے کنگز کالج لندن گئی۔ میں 1996ءمیں لوٹی، پھر سول سروس میں شامل ہو گئی اور وہاں2000ءتک رہی۔ اپنے استعفیٰ سے پہلے میں نے ایک سال پاکستان بحریہ میں بھی کام کیا۔ نصف سال میں نے ڈائریکٹر آف نیول ریسرچ کے طور پر کام کیا۔ سول سروس میں نے جن اسباب کی بنا پر جوائن کی تھی اب وہ نہیں رہے تھے اور اب میں نے اپنا اکیڈمک مستقبل بنانے کی طرف توجہ کی۔ مجھے اپنے فیصلے پر کوئی افسوس نہیں ہے۔ میں سوچتی ہوں کہ سول سروس میں بیورو کریٹک کیرئیر میرے لیے مناسب نہیں تھا۔

ہم شہری: آپ کے تحقیقی طریقہ کار میں اس تجربے نے کس قدر مدد کی جو آپ کو بطور ڈائریکٹر آف نیول ریسرچ ہوا؟ جیسا کہ بعض کا خیال ہے کہ اسی تجربے کی وجہ سے آپ نے سکیورٹی اسٹیبلشمنٹ کی معیشت کا ٹھوس تجزیہ کیا۔

عائشہ صدیقہ: نیوی میں میرا تجربہ بہت دلچسپ رہا۔ اصل میں سی این ایس جو کہ اس وقت ایڈمرل فصیح بخاری تھے ان کے ذہن میں ایک آئیڈیا آیا کہ انہیں اپنے لیے کام کرنے والا ایک سویلین رکھنا چاہیے۔ وہ اس طرح سے نیوی میں ایک تبدیلی لانا چاہتے تھے لیکن کسی بھی قسم کی تبدیلی کی مخالف قوتوں نے ایسا نہ ہونے دیا۔ لیکن یہ بہت دلچسپ تھا۔ نیول افسروں کی اکثریت سسٹم کو اوپن کرنے اور اس میں ناگزیر تبدیلیاں لانے کی مخالف تھیں۔ تقریباً ڈیڑھ سال یہ کام کرنے کا تجربہ میرے حساب سے بہت دلچسپ تھا۔ اس نے مجھے اس حقیقت سے دوچار کیا کہ سویلین اور ملٹری پرسانل دو مختلف انواع ہیں اور سب سے بڑا گناہ اس ملک میں (ملٹری کی نظر میں) بحث و مباحثے کرنے والا سویلین ہونا ہے۔ جہاں تک نیول ہیڈ کوارٹر بارے میری تحقیق ہے اس نے صرف میرے کام کی تصدیق میں مدد کی اور میں نے اپنی معلومات کا بہت کم حصہ اس سے حاصل کیا۔

ہم شہری: کامران شفیع جب ”ڈیپ سٹیٹ“ کی بات کرتے ہیں اور اس بارے اپنا فہم بیان کرتے ہیں تو ان کا کہنا ہے کہ اس سے مراد خفیہ سروسز، آرمی اور سول نوکر شاہی کا اتحاد ہے اور سول نوکر شاہی اوّل الذکر دونوں کے ماتحت ہے۔ اس اصطلاح بارے آپ کے اندازے کیا ہیں؟

عائشہ صدیقہ: ڈیپ سٹیٹ کے اور نام بھی ہیں۔ بعض اوقات لوگ اسے اسٹیبلشمنٹ بھی کہتے ہیں۔ میرا یقین ہے کہ ڈیپ سٹیٹ کے ممبران دو طرز کے ہیں۔ ایک پرائمری کردار ہیں اور دوسرے ثانوی کردار۔ وردی، بے وردی نوکر شاہی اس کے بنیادی ناگزیر کردار ہیں جبکہ ثانوی کردار کے حامل عدلیہ، بزنس اور صنعتی اشرافیہ کے لوگ ہیں۔ ان میں مذہبی اشرافیہ، میڈیا اور سیاسی جماعتوں کے لوگ بھی شامل ہیں۔ یہ ثانوی کردار پرائمری کرداروں سے اپنے تعلقات کی بنا پر کم یا زیادہ اہم ہوتے رہتے ہیں۔

یہ لوگ اپنے مشترکہ مفاد کی وجہ سے باہم جڑے رہتے ہیں اور یہ مشترکہ مفاد ہے کہ ترقی پذیر ریاست کے اندر سماجی، سیاسی طور پر آخری طاقت ان کے پاس رہے۔ اسٹیبلشمنٹ نے کبھی اپنی طاقت کو نہیں گنوایا، حتیٰ کہ ذوالفقار علی بھٹو کے انتخاب کے دور میں بھی۔ وہ بھی اقتدار سے اس وقت باہر کر دیے گئے جب ان کا تعلق اسٹیبلشمنٹ سے ٹوٹ گیا تھا۔ تو نتیجہ یہ نکلتا ہے کہ پاکستان اتنی ہی ڈیپ سٹیٹ ہے جتنا کوئی تصور کر سکتا ہے۔

ہم شہری: وکی لیکس کے نام پر ہمارے خود سے ”آزاد میڈیا“ کے منصب پر فائز میڈیا نے جو خود ساختہ جعلی لیکس چلائیں اس پر اسے بڑی خفت اٹھانا پڑی ہے۔ تو کس حد تک ہمارا میڈیا، صرف پرنٹ اور الیکٹرانک میڈیا ہی نہیں بلکہ بلاگرز بھی، ڈیپ سٹیٹ کے ساتھ بندھے ہوئے ہیں؟

عائشہ صدیقہ: میڈیا ہمیشہ اسٹیبلشمنٹ کے ساتھ جڑا رہا ہے۔ ہمیں نہیں بھولنا چاہیے کہ پہلے جو اخبارات تھے وہ ریاست کی مدد سے مضبوط ہوئے تھے۔ پھر بعض اخبارات نے بائیں بازو کی ٹون اپنائی کیونکہ ریاست خود کو ذرا مختلف رنگ میں پیش کر رہی تھی۔ لیکن حقیقت اپنی جگہ پر ہے کہ اسٹیبلشمنٹ سے میڈیا کا تعلق بہت پرانا ہے۔ یہ تعلق اب اور زیادہ مضبوط ہو چکا ہے اور اس کی وجہ نیشنلسٹ ایجنڈا کا عام فہم ہونا ہے۔ میڈیا کے جو نئے ارکان ہیں وہ ابھی کم تربیت یافتہ ہیں اور بہت متکبر بھی۔ انہیں پتہ بھی نہیں چلتا کہ کیسے اسٹیبلشمنٹ انہیں استعمال کر لیتی ہے۔ میں اس بات پر مصر ہوں کہ اسٹیبلشمنٹ کے نقطہ نظر سے ہمدردی رکھنا اور اس کا ایجنٹ ہو جانا دو مختلف چیزیں ہیں۔ جھوٹی وکی لیکس ریاست پر میڈیا کے غیر صحت مندانہ انحصار کا محض ایک عکس ہے۔ حقیقت یہ ہے کہ انفارمیشن مرکزی سطح پر کنٹرولڈ ہے۔ بہت سے ایسے صحافی حتیٰ کہ سینئر صحافی بھی موجود ہیں جو معلومات تک رسائی کے لیے خوشی خوشی ایسی شراکت میں شریک ہو جاتے ہیں۔

یہاں پر غلطی اور قصور میڈیا مالکان کا بھی ہے جو ہیومن ریسورسز پر زیادہ سرمایہ کاری نہیں کرتے چنانچہ صحافیوں کے پاس بھی سوائے اس کے اور کوئی راہ نہیں ہوتی کہ کوئی ایجنسی والا ان کو اہم کہانیاں دے۔ یہ قدرے پیچیدہ تعلق ہے۔ جب ایجنسیوں کے تنخواہ دار صحافی سرکشی کرتے ہیں تو انہیں سزا بھی دی جاتی ہے۔

ہم شہری: جب حامد میر / خواجہ ٹیپ سٹوری سامنے آئی تو بہت کم لوگوں نے اس پر توجہ دی۔ اس میں آپ بھی شامل تھیں۔ اس سٹوری کو جس طرح سے دفن کر دیا گیا اس سے اندازہ نہیں ہوتا کہ ہمارے میڈیا میں اخلاقیات کی سخت کمی ہے؟

عائشہ صدیقہ: حامد میر تو ایکسپوز ہو گیا لیکن اور بہت سے ہیں جو یہ کام کرتے ہیں۔ وہ معلومات کو ڈیپ سٹیٹ کو فائدہ پہنچانے کے لیے توڑ موڑ کر پیش کرتے ہیں۔ حتیٰ کہ معتبر اخبارات جیسے ڈان ہے وہ بھی پلانٹ کردہ سٹوریز صفحہ اوّل پر شائع کرتے ہیں۔ حال ہی میں میرا نام تحریک طالبان پاکستان کی ہٹ لسٹ میں ظاہر کر دیا گیا۔ یہ سٹوری اخبارات میں اس وقت شائع ہوئی جب ایک ایجنسی کے ہرکاروں نے میڈیا کے دفاتر کے دورے کیے۔ یہ وہی ایجنسی ہے جو مجھے بھی پریشان کرنے کے لیے عجیب و غریب کہانیاں سناتی رہی ہے۔ شاید وہ چاہتے ہیں کہ میں ملک چھوڑ جاؤں۔

میرا کہنا یہ ہے کہ میڈیا ہو سکتا ہے آج زیادہ ذرائع رکھتا ہو لیکن اس میں آزاد روح کی کمی ہے۔ یہ1980ءکے میڈیا سے کم ہمت رکھتا ہے جو کہ اس وقت بہت سی عملی رکاوٹوں کا شکار تھا، اس کے راستے میں کئی جسمانی رکاٹیں حائل تھیں لیکن وہ سوچنے میں آزاد تھا۔

ہم شہری: ہماری ”شہری کلاس“ کے اکثر تجزیہ نگار لفظ فیوڈل پر حد سے زیادہ زور دیتے ہیں اور ایسا نظر آتا ہے کہ اس لفظ کو ”دیہی پاکستان“ کی تفہیم کے مترادف قرار دیا جا رہا ہے۔ اس میں بعض سیاستدانوں کو نیچا دکھانے کا جذبہ بھی کارفرما ہے۔ ایک طرف تو جاگیردار اشرافیہ کی ملکیتی جاگیریں کم ہو رہی ہیں تو دوسری طرف شہری سیاسی جماعتیں اپنے لینڈ مافیا گروپ مضبوط بنا رہی ہیں اور ہر مرتبہ بحث میں فوج کے رئیل اسٹیٹ بزنس اور جاگیروں کو خارج کر دیا جاتا ہے۔ تو کیا یہ کہنا ٹھیک ہو گا کہ اربن کلاس کا فیوڈل ازم کا جو فہم ہے اسے اپ ڈیٹ کرنے کی ضرورت ہے؟

عائشہ صدیقہ: فیوڈل ازم کی اصطلاح تو اب فیشن بن گئی ہے۔ میرے خیال میں یہ موجود ہے لیکن الگ شکل میں۔ حقیقت یہ ہے کہ جاگیرداری نظام اب دوسری شکل میں ڈھل چکا ہے۔ کارل مارکس نے تو اسے ”طریق پیداوار“ تصور کیا تھا۔ تو اس تناظر میں تو جاگیرداری کی شکل بدل چکی ہے۔ اکبر زیدی کی تجزیاتی تحقیق بتاتی ہے کہ بہت بڑی تعداد میں بڑی جاگیریں کم ہو گئی ہیں۔ میرے خیال میں صنعتی کاروباری اشرافیہ اور جاگیردار آپس میں گھل مل گئے ہیں۔ وہ زمین کو سیاسی سرمایہ کے طور پر مالی فوائد حاصل کرنے کے لیے (ریاست اور دوسری جگہوں سے) استعمال کرتے ہیں۔ جو چیز مسئلہ بنی ہوئی ہے وہ رویہ ہے۔ مارکس نے تو کبھی اس اصطلاح کے سیاسی اور ثقافتی معنی بیان نہیں کیے تھے۔ ہماری جو ریاستی نوکر شاہی ہے وہ بھی فیوڈل ہے، حتیٰ کہ ہمارے جو اربن پروفیشنل ہیں ان کے بھی فیوڈل رویے ہیں۔

ہم شہری: ہماری اربن کلاس کیوں چھوٹے قومیتی گروہوں کو کسی حد تک نظر انداز کرتی ہے؟

عائشہ صدیقہ: اس طبقے کے ساتھ مسئلہ یہ ہے کہ یہ شیطان اور گہرے نیلے سمندر کے درمیان کہیں پھنسا ہوا ہے۔ میرا نہیں خیال کہ انہیں کبھی چھوٹے ذیلے قومی گروہوں کا خیال بھی آیا ہو گا۔ لیکن حقیقت یہ ہے کہ ان کی حرکت کا سبب بین الاقوامی دوڑ میں پیچھے رہ جانے کا احساس ہے۔ ان کے نزدیک اگر پاکستان کا بین الاقوامی سطح پر بُرا امیج نہ ہو تو چیزیں ٹھیک ہو سکتی ہیں۔ ان میں ذیلی قومی گروہوں کے تناؤ بارے سوچنے کا یارا نہیں ہے۔ دراصل اس قسم کی سوچ کے پیچھے ہمارے معاشرے میں ترقی کی ناہمواری کارفرما ہے۔ وہ جو آگے جا چکے وہ پیچھے رہ جانے والوں کی طرف دیکھنا نہیں چاہتے اور وہ اسے اپنا قصور بھی نہیں مانتے۔ ایسی سوچ سارے جنوبی ایشیا میں پائی جاتی ہے۔ آپ کو معلوم ہونا چاہیے کہ ہندوستانی مڈل اور اپر کلاس بھی ذیلی قومی تحریکوں کے بارے میں ایسے ہی بولتی ہیں۔

ہم شہری: کیا ہماری ’ڈیپ سٹیٹ‘ جہادی، فرقہ وارانہ ملیشیاؤں کو خارجہ اور مقامی پالیسی میں استعمال کرنے کی غلطی تسلیم کر چکی ہے اور تزویراتی گہرائی کے فلسفے کو دفن کر چکی ہے؟

عائشہ صدیقہ: نہیں۔ دراصل ہم کبھی بھی اقتصادی، سماجی یا ثقافتی مسابقت کی اصطلاحوں میں نہیں سوچتے بلکہ ہمیشہ ملٹری، سٹریٹیجک طاقت کی اصطلاحوں میں مقابلے کی سوچتے ہیں۔

ہم شہری: نوجوانوں کو انتہا پسند راستوں کا مسافر بننے سے کیسے روکا جا سکتا ہے؟

عائشہ صدیقہ: ہمیں اپنی نئی نسل کو بچانے کے لیے نیا راستہ اپنانا ہو گا۔ یہ راستہ مغربی لبرل ازم پر انحصار کرنے والا نہ ہو بلکہ ہمیں ہمارے اپنے تہذیبی لبرل ازم کے ذرائع تلاش کرنا ہوں گے۔ بدقسمتی سے ہماری تعلیم یافتہ اشرافیہ جب اپنے مذہب اور کلچر سے سامنا کرتی ہے تو یہ لبرل طرز فکر کے الٹ مظاہرہ کرتی ہے۔ ہمیں ایسے سیکولر ازم پر بات کرنے کی ضرورت ہے جس کی بنیاد ہماری اپنی تہذیبی تاریخ پر ہو۔
