Gov. Charlie Crist says there's still hope for a gambling deal between the state and the Seminoles, despite what a leading Florida legislator said last week.

"To me, it seems so obviously the right thing to do," Crist said. His reasoning: the tribe would contribute $150 million to education and create 40,000 jobs - in exchange for exclusive rights to blackjack and other table games at its seven Florida casinos.

Last week, House Speaker Larry Cretul, R-Ocala, told a top federal regulator that the two sides had reached an "impasse." He asked the National Indian Gaming Commission to shut down the tribe's gambling operations throughout the state. Legislators said the Seminole games are illegal.

"I don't think that's going to happen," Crist said. "People can ask for things all the time. Even I ask for things."

Crist visited the Seminole Hard Rock Hotel & Casino on Monday to commemorate the 40th anniversary of the United South & Eastern Tribes, a non-profit, inter-tribal organization. Speakers there called Crist "an honorable man and a friend of the tribe," and greeted him with three standing ovations. He did not address the gambling deal with them.

In 2007, Crist and the tribe came to an agreement that would bring blackjack to the tribe's casinos in exchange for $150 million in payments, but the courts determined that Crist had no authority to negotiate such a deal. The Legislature has since offered its version to the tribe, who sat down with Crist and made a counteroffer in the summer. The Legislature might discuss it at a special session in December.

Casino proposals tend to produce strange alliances, and this year's Issue 3 is no exception.

Supporters include the all-Democrat Cleveland City Council and former Ohio Republican Chairman Robert T. Bennett. Among the opponents are the conservative Citizens for Community Values of Cincinnati and ProgressOhio, a liberal advocacy group.

This year's casino campaign hasn't exactly upended the coalitions that formed on both sides of failed gambling measures in 2006 and 2008, but it has produced a couple of notable defections.

The Fraternal Order of Police of Ohio, which was neutral in 2006 and opposed to a casino measure in 2008, is a prominent supporter of Issue 3. NAACP chapters in Columbus, Cleveland and Cincinnati, which either opposed or stayed on the sidelines of the two prior campaigns, have endorsed this year's measure. Cincinnati Mayor Mark Mallory also is a first-time backer.

Issue 3 opponents aren't able to point to prominent supporters of previous measures who switched to the "no" side this year. But they said the old coalition -- made up of religious leaders, most statewide elected officials, good-government groups and small-business advocates -- is standing strong against the current proposal.

"The people we've been communicating with have stayed pretty tightly opposed," said Melanie Elsey of Vote No Casinos, which also fought the 2006 and 2008 gambling measures. "We still have a strong concern with what this will do to families and individuals in terms of addictions and other problems."

The biggest shift this year is support from the Fraternal Order of Police and some urban organizations and leaders.

The police union was swayed by promises of casino taxes for cities and counties -- which employ the vast majority of its members -- and a dedicated funding source for police training statewide.

Its support might make the difference in this year's campaign, said state Sen. Bill Seitz, a Cincinnati Republican who has supported gambling in Ohio but opposes Issue 3.

"I think those little ads with the cops are pretty damned effective," Seitz said.

The union's secretary/treasurer, Mark Drum, said this year's proposal is far better written than prior gambling issues and guarantees funding for local communities.

"I do think we have a strong voice, and (voters) listen to that," Drum said.

Issue 3 would place casinos in the downtowns of Columbus, Cleveland, Cincinnati and Toledo. The 2006 measure would have allowed slot machines at racetracks, which are mostly in suburban areas, and two locations in downtown Cleveland. The 2008 proposal would have authorized a single casino in rural Clinton County.

Urban groups and leaders cited Issue 3's potential to create jobs in downtowns and reverse the trend toward higher unemployment.

In announcing the Columbus NAACP's endorsement of the measure, chapter President Noel Williams noted that unemployment statewide is approaching 12 percent and the figure is roughly twice that in minority communities.

The local NAACP is among the few organizations in central Ohio to support this year's proposed constitutional amendment. Most of the area's leading business groups, including the Columbus Partnership and the Columbus Chamber, oppose the measure, as they have previous gambling issues. This is the first issue that would place a casino in central Ohio.

Although the mayors of the other three casino cities all support Issue 3, Columbus Mayor Michael B. Coleman has not taken a position. His spokesman, Dan Williamson, said Coleman is being lobbied by both sides.

"I know there's a lot of interest out there among the interested parties, but I don't think it's more than any other issue," Williamson said.

The endorsement sweepstakes might be a big deal for partisans on both sides of the ballot measure, but it's not likely to make a huge difference with voters, said Paul Beck, an Ohio State University political-science professor.

"There's probably a significant number of voters (that) will relate to the issue on (a gut) level right away," Beck said. "They don't need to know who's endorsing on both sides."

In a court ruling out of the UK, a British court has ruled against the Commonwealth of Kentucky's attempt to seize gambling domains. Pocket Kings Limited which owns the domain and gambling site, Fulltiltpoker.com bought a suit seeking declaratory relief against its registrar Safenames Limited ("Safenames"), and the Commonwealth of Kentucky (note that Safenames.com did NOT turn over the domain to Kentucky)

The British Court ruled that it would not recognize or enforce the orders currently made in the Kentucky proceedings or any subsequent order for the seizure or forfeiture of the domain name.

"English courts have no jurisdiction to entertain an action (I) for the enforcement either directly or indirectly of a penal, revenue or other public law of a foreign state or (2) founded upon an act of state."

""So far as I am aware there is no authority on the question whether the forfeiture of assets used in the commission of a crime under local law is to be regarded as penal for the purpose of this rule. Regardless of the categorization of this type of forfeiture as a civil remedy under US law, it seems to me to be a provision distinctly penal in nature, requiring as it does the confiscation without compensation of an asset, on the ground that the owner, or at least the user of it, has been guilty of a criminal offense.

""I therefore conclude that the Kentucky proceedings are not enforceable in English law as being penal or governmental in nature. It is not therefore necessary for me to consider whether the Kentucky proceedings breached the principles of natural justice."""

It should be noted that, although Kentucky was served with notice of the proceedings in the British court, they failed to either appear or to submit any brief or other writing argument in the case.

Bottom line if you have your gambling domain registered with Safenames, rest assured, the British court is not going to uphold the seizure order of the Commonwealth of Kentucky.

Gambling Money For New Vikings NFL Stadium?

The NFL has claimed for years that they are anti-gambling, but again on Monday there was proof of how the league and gambling go hand in hand when it comes to generating revenue. A lawmaker in Minnesota is proposing slot gambling as a way to help finance a new Vikings stadium.

Republican legislator Tom Hackbarth is attempting to bring slot gambling to the two horse tracks in Minnesota. His attempts failed earlier this year, so now he is tying the slot gambling into something that everybody in Minnesota cares about-the Vikings.

Originally, Hackbarth wanted to create a constitutional amendment that would have brought a casino to Minnesota to pay for the stadium. His latest twist, however, is to expand the gambling options at horse tracks in the state.

"I don't know what else we're going to do if we don't go to gaming," said Hackbarth. Time is running out for the state's lawmakers who must have a plan in place before the Vikings lease at the Metrodome runs out at the end of the 2011 season.

Hackbarth has some clout in the state. He has been a legislator for the past seven terms and he believes that the slot gambling may be the only solution at a time when funding for a new stadium has run dry.

The NFL has not yet been notified about the legislators plan, but they have shown recently that they can not only co-exist with gambling, but that they can endorse it. NFL owners voted in favor of allowing teams to partner with state lotteries this past year.

Already, there have been advertisements on the NFL Network for lottery scratch off gambling tickets in New Jersey and Maryland. The Giants and Redskins are just a couple of the many teams that are using their name and logos on the lottery gambling tickets.

The one form of gambling the NFL still claims to be against is betting on their sport. The league, in conjunction with other major sports leagues, successfully kept single game betting out of Delaware, a state in which there are no NFL teams.

Critics have now argued that the NFL has a double-standard when it comes to gambling. These critics believe that the NFL's anti-gambling message has lost some of its value when the league agreed to partner with the state lotteries.

Atlantic City Casinos Continued Slashing Jobs In September

Atlantic City casinos cannot withstand much more of the pounding they have been given over the past couple of years. The latest setback came in September, when the industry cut over 1,000 jobs in an effort to keep operating costs down.

The casino industry in AC has been ravaged by casinos in neighboring states. Pennsylvania, New York, and Connecticut have all expanded their casino gambling options, and it has led to a major decrease in business in AC.

For the better part of the past three decades, Atlantic City casinos had the market cornered. That all began to change in recent years with surrounding states deciding to change or expand their gambling laws. People are no longer coming from these other states to gamble in Atlantic City.

In September, the casino industry in AC cut 1,067 jobs. It is not unusual at this time of year for the casinos to terminate employees, but the amount this year was much higher than in previous years.

The industry still powers AC, but the work force has now been cut to 37,337 employees. That figure is almost 4,000 employees lighter than it was just twelve months ago. Revenue at the casinos continues to drop, and as it does, employees are falling with it.

In July of 1997, when Atlantic City was at its peak, employment was over 51,000. That means that over the past two decades, more than 14,000 jobs have been lost, with many of those layoffs coming over the past two years. source>>>

PayPal Share in Online Gambling Market Grows

Payment solutions provider PayPal is moving back into the online gambling market, and in a big way, after inking a deal with e-wallet provider Neovia.

The deal means PayPal will be offered as a payment method to gamblers who use Neovia's Netbanx payments system. However, PayPal will not accept bets from users based in the United States.

The deal was lauded by general manager for merchant services Cameron McLean as one that would offer "PayPal an excellent way to reach this significant (gambling) audience."

Welcome Back
PayPal has stayed largely away from online gambling since a 2002 decision by its parent company eBay after the United States government accused it of violating the law by transferring funds to offshore gambling websites.

The world's largest e-wallet provider company had signed some smaller deals recently in the online gaming markets, including with online casino 32Red.

But the Neovia deal is a significant move because of the size of the new partner - Neovia is used by more than 1,500 gambling websites and is among the largest e-wallet provider companies going around.

Quarterback Ryan Colburn had a mediocre outing, going 14-for-29 for 187 yards, a touchdown, and two interceptions. He did, however, demonstrate a great deal of toughness, surviving several punishing hits from the Broncos defense.

The Bulldogs defense could not handle Chris Petersen's offense at all. Boise had 480 yards as quarterback Kellen Moore threw three touchdowns and running backs Jeremy Avery and D.J. Harper combined for 293 yards and a touchdown.

Cincinnati looks like a team set on repeating as Big East champion, jumping out to a 3-0 start with wins against quality foes Rutgers and Oregon State. The Beavers served as the latest Bearcat victim, losing 18-28 last Saturday in Corvallis. Cincinnati produced 408 yards in the victory, 332 of which came through the air.

Quarterback Tony Pike further increased his stock with a 31-for-49, 332 yard, two touchdown performance. Pike had a solid season last year, but he has taken his game to a new level this year, completing over 70-percent of his passes and producing four touchdowns to every one interception.

Wide receivers D.J. Woods and Mardy Gilyard were the chief contributors to Pike's dissection of the Oregon State secondary. Woods caught seven passes for 117 yards and a touchdown while Gilyard had nine catches for 65 yards and a score.

Cincinnati's defense gave up a modest 344 yards to the Beavers, but they held Oregon State's best player, running back Jacquizz Rodgers, to just 73 yards in 20 carries. The Bearcats front seven limited the OSU ground game to a 2.9 yard per carry average.

Majority of Ohio Voters in Favor of Casino Gambling

The winds of change may be reaching the State of Ohio as latest polls show that 56% of respondents in a recent poll support legalized casino gambling in Ohio. This comes after years of solid defeats for similar measures in recent. Issue 3 comes to a public vote in November.

Also polled by Quinnipiac University Polling Institute was the Governors decision to allow slot machines at Ohio Race Tracks. 60% of those asked said they agreed with Ted Strickland's plan to expand gambling and help reduce the deficit by one billion dollars if the measure sees the light of day. This, of course, was before the Ohio Supreme Court muddied the waters with their decision earlier today saying his actions would need to be voted on by the public and may delay the slot machines from being installed by their projected date of May 1st and causing an enormous shortfall in the already fragile state budget. source>>>

Barney Frank Online Gambling Bill Gains Four New Co-Sponsors

Representative Barney Frank is gaining more support now than he ever has in his effort to overturn the Unlawful Internet Gambling Enforcement Act. This past week, Frank picked up four new co-sponsors for his latest online gambling Bill.

The list now has been run up to fifty-eight co-sponsors. Representative Frank has said that he will bring the Internet gambling debate to the forefront in Congress in the Fall, and it looks as though he will have plenty of support by then.

The latest representatives to join the online gambling crusade are Rep. Lynn C. Woolsey of California, Rep. Christopher S. Murphy of Connecticut, Rep. William Lacy Clay of Missouri, and Rep. Adam B. Schiff of California.

The UIGEA has come to the forefront recently with bank accounts being seized by authorities in the US. The accounts have been connected to payouts for US online casino customers. The most recent of these accounts have been linked to Golden Casino, a prominent online casino with a strong reputation.

Revenue fall raising concerns for states betting big on casino and lottery income.

Recession-weary Americans aren't gambling the way they used to -- and that could be a problem for many U.S. states already struggling with record budget gaps due to the weak economy.

State revenues from all sources of authorized gambling fell 2.8% in fiscal 2009, according to a report from the Rockefeller Institute of Government released Monday. It was the first decline in data going back at least 20 years.

"It's not a huge decline, but it's sobering," said Mark Marchand, director of communications for the Rockefeller Institute.

Lottery income, the largest source of state gambling revenues, fell 2.6%. It was the first annual drop in lottery revenue going back to 1970, according to the group.

Income from casinos fell 8.5%, while revenue from pari-mutuel wagering, which includes dog and horse racing, sank nearly 15%.

However, revenue from race tracks that also host electronic gambling machines such as slot-machines, or "racinos," increased by 6.7%, largely because of new racinos opening in Indiana and Pennsylvania, the report said.

Lucy Dadayan, a Rockefeller Institute senior analyst, said the decline in gambling revenue is a red flag for states planning to expand gambling activities to help pay for social services.

"Expenditures on education and other programs will generally grow more rapidly than gambling revenue over time," Dadayan said in a a statement. "Thus, new gambling operations that are intended to pay for normal increases in general state spending may add to, rather than ease, long-term budget imbalances."

Over the past year, the report said 25 states have proposed or considered expanding gambling activities, according to the report.

The decline in gambling revenues comes as the U.S. economy struggles to recover from one of the longest recessions on record. The report said the drop in gambling revenue was "likely influenced by the current economic downturn."

Of the 41 states with major gambling revenue, 28 states reported declines over the year, with 14 states reporting decreases of more than 5%, according to the report.

However, the study did not include income from Native American casinos, which are active in 32 states, because comprehensive data were not available.

Twelve states showed growth in revenue collections from the major sources of gambling.

While the report said gambling revenue plays a "relatively small" role in state budgets, this year's drop comes after several years of sustained growth.

Overall gambling revenues increase by 60% over the previous decade, from $15 billion in fiscal year 1998 to $24 billion in fiscal year 2008, according to the report.

Kentucky Supreme Court to Hear Internet Gambling Case

n January, the Kentucky Court of Appeals ruled by a 2:1 margin that the Kentucky Justice and Public Safety Cabinet did not have jurisdiction to seize 141 internet gambling domain names. In October, the Kentucky Supreme Court will hear the case.

The Cabinet appealed immediately following the Court of Appeals decision, which kicked off the 2009 calendar year in the online poker world. Now, attorneys for the Interactive Media Entertainment and Gaming Association (iMEGA) and Commonwealth of Kentucky will take to the floor of the state's Supreme Court on Thursday, October 22nd at 11:00am local time. On the 10-month turnaround, iMEGA Chairman Joe Brennan told Poker News Daily, "My understanding is that the October 22nd date is fairly expeditious when it comes to the Kentucky Supreme Court. Usually, appellate courts don't hear things that quickly when there's nothing driving it. The fact that the court is going to hear oral arguments so soon confirms that it has an interest in the subject matter."

A bevy of organizations have submitted documents supporting iMEGA's challenge against the Commonwealth of Kentucky, including the Poker Players Alliance (PPA), eBay, and the American Civil Liberties Union (ACLU). iMEGA is represented by Jon Fleischaker of Dinsmore and Shohl, which is based in Louisville, Kentucky. Brennan forecasted, "We saw the briefings that the Governor's attorneys brought to the table and they don't have a lot they can hang their heads on other than making a claim for a Federal ban on internet gambling that doesn't exist. There's no Federal law against gambling on the internet and no law in Kentucky. I'm pretty sure we're going to beat them again."

Last September, the Commonwealth seized the 141 internet gambling domain names in question, including those belonging to PokerStars, Full Tilt Poker, and Ultimate Bet, on the grounds that they constituted "gambling devices," a term traditionally reserved for physical objects like dice and slot machines that you'd find in an illegal casino. In October, Judge Thomas Wingate upheld the Commonwealth's actions, which were prompted by Governor Steve Beshear. iMEGA then sought the intervention of the Court of Appeals, which agreed with the trade association by a 2:1 vote in January.

The news comes on the heels of iMEGA falling short in its constitutional challenge of the Unlawful Internet Gambling Enforcement Act (UIGEA). A three-judge panel in the Third Circuit Court of Appeals disagreed with many of the organization's basic arguments, but ruled that internet gambling may be legal in the U.S. dependent upon state law. On the UIGEA, the Court declared, "The Act itself does not make any gambling activity illegal. Whether the transaction... constitutes unlawful internet gambling turns on how the law of the state from which the bettor initiates the bet would treat that bet, i.e., if it is illegal under that state's law, it constitutes 'unlawful internet gambling' under the Act." IMEGA claims the decision could pave the way for legal internet gambling in 44 states.

iMEGA can appeal the Third Circuit's ruling, although no decision has been made as to whether the organization will pursue that course of action. Brennan explained, "If we were to do something, it'd be applying to the Supreme Court or starting a new challenge against the UIGEA regulations. At this point, I wonder what the best use of our resources is. The Government managed to get the UIGEA upheld in a way that the states have a right to determine what kind of gambling is allowed within their borders." The Third Circuit dismissed iMEGA's claims that the UIGEA should be "void for vagueness" and that the 2006 law tramples on privacy rights, among other arguments.

Ohio Voters Now In Favor Of Legalized Casino Gambling

People in the state of Ohio have never been in favor of casino gambling. Voters have had several opportunities over the past couple of decades to approve casinos, and they have turned down the chance every time. That, however, may change this year.

A recent Quinnipiac University poll finds that Ohio voters for the first time are supporting legalizing casino gambling. The poll, which was conducted September 10th -13th, shows that fifty-eight percent of the respondents support the casino plan on the ballot for November.

This is not the first poll that has illustrated the change in stance. Ohio has been one of the states hit the hardest by the economy, and casino expansion would mean jobs for thousands of Ohioans. Casino revenue would also mean that state lawmakers would not have to raise taxes.

"The time just seems right for Ohio to finally legalize casino gambling," said CGW Legal Analyst Bob Brice, "Other states that have been against casino gambling in the past have changed their views, and it is just natural progression that the people of Ohio would eventually want the casino gambling option in their own backyards."

There has been a wave of casino expansion all across the US. While some states enter the casino market for the first time, others have expanded their options to include full table games. Casinos have become the main source for beating the trying economic times.

The Quinnipiac poll surveyed 1,074 voters in Ohio and while the numbers still indicate that people are in favor of the casino plan, it is not as strong as the last poll. In July, a poll suggested that sixty-one percent of voters wanted casinos in the state. source>>>
