Democracies facing the Covid-19 pandemic

1. The Covid-19 pandemic is the greatest public health crisis the world has faced in recent history. It has already claimed more than 1 million lives across all continents and has had unprecedented multifaceted, wide-ranging and possibly lasting consequences for the social, economic and political life of our societies. It has also been a crash test for governance systems and institutions at national and international levels.

2. In view of the exceptional nature of this public health crisis, governments in Europe enacted, under time constraints, a variety of immediate and extraordinary measures aimed at stopping, delaying or limiting the spread of the virus. These measures, whether or not introduced under a state of emergency or other special situation status, have had a significant impact on people’s daily, professional and social lives, on their enjoyment of fundamental rights and on the functioning of, and balance between, democratic institutions and processes.

3. The Parliamentary Assembly, while supporting States and public authorities in giving priority to saving lives and protecting populations, stresses that democracy, human rights and the rule of law cannot be allowed to become “collateral damage” of the pandemic. No public health emergency may be used as a pretext to destroy democratic acquis.

4. The Assembly notes that emergency situations, especially when a state of emergency is formally declared, generally have a detrimental effect on the system of checks and balances. It warns against the risk of abuse of emergency powers by governments to, inter alia, silence the opposition and restrict human rights. In this context, the Assembly stresses that all emergency measures introduced in response to the pandemic must be limited in duration and not exceed the duration of the emergency situation warranting them.

5. The Assembly underlines that, as cornerstone institutions of democracy, parliaments must continue to play their triple role in terms of representation, legislation and oversight, the latter being even more essential in times of emergency, when the executive acquires additional powers. The continuity of parliament and the media coverage of its work during a public health emergency are also essential insofar as they allow all major political forces to be represented and to participate in democratic decision making, thus also ensuring the legitimacy of government. Rising above party divisions, politicians must act with the utmost responsibility to minimise the harm to the population, economy, social structures and public institutions; address the causes of the crisis; and work in concert on a post-pandemic recovery plan which also prepares for future crises.

6. The Assembly is aware that assessment of the compliance of emergency measures with democratic standards cannot be undertaken without taking account of a specific country’s constitutional framework and legal order, as well as its democratic practice. While no internal context can justify departure from the democratic process and principles, the specific national context should be taken into account when evaluating a country’s conformity with its commitments and obligations.

7. Citizens’ confidence in public authorities and democratic institutions and processes is essential in times of crisis. Curtailing public debate and restricting the functioning of key elements of the democratic system may not only undermine democracy as such but also damage people’s adherence to, and the effectiveness of, any emergency policies and actions taken to address the primary causes of the crisis and protect the population.

8. In view of these elements and in line with the principles applicable to states of emergency drafted by the European Commission for Democracy through Law (Venice Commission), the Assembly calls on Council of Europe member and observer States, as well as States whose parliaments enjoy observer or partner for democracy status, to respect the system of democratic checks and balances and, in particular, to apply the following principles when facing a public health emergency:

8.1 limit, both in time and in scope, the declaration of the state of emergency and/or the application of emergency legislation and executive decrees, which must be adopted within the constitutional framework and comply with international standards, in particular those set by the European Convention on Human Rights (ETS No. 5) where appropriate;

8.2 ensure that parliaments have the power to:

8.2.1 exercise regular control at all stages of the procedure related to a public health emergency (namely its declaration, prolongation or termination);

8.2.2 review, and where necessary repeal, any emergency decrees where the executive has used powers normally belonging to the legislator;

8.2.3 conduct inquiries and investigations on the execution of emergency powers, even after the public health emergency has come to an end;

8.3 refrain from permanent changes to legislation, in particular concerning the electoral system, as well as constitutional amendments, organic laws or other long-term and fundamental reforms and referendums, especially constitutional referendums, until the end of the emergency;

8.4 enable the opposition to participate effectively in the approval or any extension of the state of emergency as well as in ex-post scrutiny of emergency decrees, in particular by introducing a requirement for qualified majority voting when prolonging the state of emergency;

8.5 respect the principle of loyal co-operation and mutual respect between national, regional and local authorities;

8.6 ensure, as regularly as possible, the availability of easily understandable, full and accurate information to citizens, by providing the media with access to State institutions, thus guaranteeing transparency and encouraging public debate.

9. The Assembly welcomes the fact that, since the outbreak of the Covid-19 pandemic, most parliaments of Council of Europe member States have continued to exercise, without interruption, their statutory duties relating to representing the interests of citizens, considering new legislation to alleviate the effects of the pandemic and overseeing the emergency measures introduced by governments. Parliaments have responded with flexibility and creativity by adapting their work to the extraordinary circumstances resulting from the pandemic and implementing, to various degrees, a combination of measures such as reducing the number of plenary sittings and limiting the number of members who can attend them; limiting work in plenary to a strict minimum (namely consideration of emergency legislation related to the pandemic and overseeing the emergency measures introduced by the government); increasing the use of modern communication technologies and platforms, and allowing online participation in committee meetings, plenary sittings and even in voting; and setting up new ad hoc structures for scrutiny and accountability regarding actions taken by the government in response to the pandemic.

10. The Assembly is aware that finding ad hoc solutions to continue carrying out parliamentary work has not been an easy task and may have raised issues of procedure, competence, authority, priorities, relations between majority and opposition parties and within party groups, as well as with government and citizens. It therefore calls upon the parliaments of Council of Europe member and observer States and parliaments which enjoy observer or partner for democracy status to take stock of their experience gained during the pandemic and use it to prepare for any future crises by:

10.1 introducing, preferably on the basis of a cross-party agreement, necessary changes to their internal structures, rules and procedures with a view to allowing an uninterrupted exercise of parliamentary duties in emergency situations;

10.2 carefully assessing the management of pandemics by governments, namely the execution of emergency powers, implementation of an exit strategy and preparedness for possible new waves of pandemics;

10.3 reviewing and, where necessary, revising legislation on emergency situations in a way that would ensure maximum efficiency while being fully compliant with fundamental principles of democracy, respect for human rights and the rule of law;

10.4 considering granting the opposition the right to chair relevant inquiry committees;

10.5 sharing experience and good practice of pandemic management with other parliaments using, in particular, multilateral parliamentary assemblies as platforms, and co-operating with international partners.

11. The Assembly notes that, since the outbreak of the Covid-19 pandemic, elections at various levels have been postponed in a number of Council of Europe member States, while in others their organisation has given rise to controversies either about the principle of holding elections during the pandemic or the specific modalities involved. The Assembly calls upon member States to apply the following principles, as devised by the Venice Commission, when deciding whether to hold or postpone elections during a public health emergency:

11.1 ensure that postponement is foreseen by law, that it is necessary, proportionate and limited in time;

11.2 involve all political parties, candidates and other stakeholders, including health authorities and experts, in the discussion concerning a possible postponement; a qualified majority in the parliament may be required, especially for longer postponements; judicial control by an independent and impartial national court should be possible;

11.3 ensure that the conditions for universal, equal, free, secret and direct suffrage are met, including by guaranteeing an open and fair electoral campaign and a meaningful public debate;

11.4 assess how far it is possible to compensate for limitations on door-to-door campaigning or public rallies by means of public or private media or the use of the internet, including social media; special attention should be paid to the authorities’ duty of neutrality, as well as to the obligation of the broadcast media to cover election campaigns in a fair, balanced and impartial manner in all of their programmes;

11.5 consider using different voting modalities such as postal voting, mobile ballot boxes, voting by internet or proxy voting, if provided for by law and if the conditions for universal, free, secret and direct suffrage are met.

12. The Assembly notes that the organisation of elections during a public health emergency raises legal and practical challenges for election observation, thus increasing the risk of possible fraud and manipulation of election results. In view of the importance of its election observation role, the Assembly resolves to consider modalities which would allow it to carry out election observation missions during such an emergency situation, in co-ordination with its institutional partners, in the framework of international election observation missions.

13. The observation of elections should continue to be an important tool for the assessment of the electoral process. Given the possible limitations on the presence of international observers, as well as the increased use of alternative voting mechanisms to replace voting in person, as a result of the pandemic, the Assembly should develop alternative modalities for the assessment of elections. The Assembly underscores that the assessment of the electoral process goes well beyond the physical observation on election day(s).

14. The Assembly, in line with its Resolution 2329 (2020) and Recommendation 2174 (2020) on lessons for the future from an effective and rights-based response to the Covid-19 pandemic, stresses the urgent need for an evidence-based, internationally co-ordinated and human rights compliant approach to public health crises. In the face of a pandemic – and the inevitable next one – that threatens humanity, the current international context must shift from rivalry among powers to an opportunity for multilateral co-operation that goes beyond partisan divisions.

15. Genuine and constructive multilateralism is essential for anticipating and addressing real threats and for restoring confidence in intergovernmental institutions, as well as for tackling the far-reaching health, economic, political, infrastructural and social implications of the current crisis. In this context, multilateral organisations, such as the World Health Organization (WHO), are central to finding common solutions to common problems and require support from all member States, including proper funding in order to act swiftly and issue recommendations based on evidence.

16. In light of the above, the Assembly calls upon member and observer States as well as States whose parliaments enjoy observer or partner for democracy status to:

16.1 seek and maintain a united global focus on pandemic preparedness and response, and to commit to building trust and a shared sense of purpose among all States;

16.2 positively respond to the United Nations Security Council’s call for a general and immediate cessation of hostilities in all situations and for the urgent need for unity and mutual support in the battle against a common enemy;

16.3 carefully scrutinise the way their national healthcare system coped or failed to cope with the pandemic, with a view to enhancing preparedness, resilience and responsiveness in the future;

16.4 share good practice in handling the pandemic;

16.5 raise awareness of disinformation and misinformation about the pandemic and ensure that individuals stay alert and abstain from spreading false or misleading content;

16.6 support the independent review of WHO’s co-ordination of the global response to the Covid-19 pandemic, ensure adequate funding for the organisation to make it independent of voluntary contributions and provide it with appropriate tools to effectively monitor the health situation in all member States;

16.7 strengthen the International Health Regulations (IHR) to improve preparedness and create a more efficient early alert and response system;

16.8 ensure that diagnostic tools, treatments and vaccines are accessible and affordable for everyone, in all countries, starting with those persons at highest risk, and adopt a common European approach, so that each of Europe’s 830 million citizens can benefit from equal protection from Covid-19.

17. The Assembly welcomes the fact that, in the face of the challenges raised by the pandemic, the Council of Europe bodies and institutions – in particular, the Parliamentary Assembly, the Committee of Ministers and the Venice Commission – as well as the Secretary General and the Commissioner for Human Rights have provided timely and adequate support to member States by sharing with their governments and parliaments tools, standards and guidelines aimed at ensuring compliance with the principles of democracy, human rights and the rule of law in their response to the pandemic.

18. Therefore, the Assembly resolves to develop further its co-operation with national parliaments by encouraging national delegations to share good practices and organising peer reviews on various aspects of the measures taken to address the consequences and implications of the pandemic, inter alia, through the organisation of parliamentary hearings with the participation of Council of Europe experts, with a view to developing viable and sustainable solutions and approaches for addressing similar crisis situations in the future.

Covid-19 vaccines: ethical, legal and practical considerations

1. The pandemic of Covid-19, an infectious disease caused by the novel coronavirus SARS-CoV-2, brought about much suffering in 2020. By December 2020, more than 65 million cases had been recorded worldwide and more than 1.5 million lives had been lost. The disease burden of the pandemic itself, as well as the public health measures required to combat it, have devastated the global economy, laying bare pre-existing fault- lines and inequalities (including in access to healthcare), and causing unemployment, economic decline and poverty.

2. Rapid deployment worldwide of safe and efficient vaccines against Covid-19 will be essential in order to contain the pandemic, protect healthcare systems, save lives and help restore global economies. Although non-pharmaceutical interventions such as physical distancing, the use of face masks, frequent hand washing, as well as shutdowns and lockdowns, have helped slow down the spread of the virus, infection rates are now rising again across most of the globe. Many Council of Europe member States are experiencing a second wave that is worse than the first, while their populations are increasingly experiencing “pandemic fatigue” and are feeling demotivated about following recommended behaviour to protect themselves and others from the virus.

3. Even rapidly deployed, safe and effective vaccines, however, are not an immediate panacea. Following the festive season at the end of 2020 and the beginning of 2021, with its traditional indoor gatherings, infection rates will likely be very high in most member States. In addition, a correlation has just been scientifically established by French doctors between outdoor temperatures and the disease incidence rate on hospitalisations and deaths. The vaccines are unlikely to be sufficient to bring down infection rates significantly this winter – in particular when taking into account that demand far outstrips supply at this point. It will thus not be possible to resume a semblance of “normal life”, even in the best of circumstances, until mid to late 2021 at the earliest.

4. For the vaccines to be effective, their successful deployment and sufficient uptake will be crucial. However, the speed at which the vaccines are being developed may cause a feeling of mistrust that is difficult to combat. An equitable deployment of Covid-19 vaccines is also needed to ensure their efficacy. If not widely enough distributed in a severely hit area of a country, vaccines become ineffective at stemming the tide of the pandemic. Furthermore, the virus knows no borders and it is therefore in every country’s interest to co-operate in ensuring global equity in access to Covid-19 vaccines. Vaccine hesitancy and vaccine nationalism have the capacity to derail the so-far surprisingly fast and successful Covid-19 vaccine effort, by allowing the SARS-CoV-2 virus to mutate and thus blunt the world’s most effective instrument against the pandemic so far.

5. International co-operation is thus needed now more than ever in order to speed up the development, manufacturing and fair and equitable distribution of Covid-19 vaccines. The COVAX Facility is the leading initiative for global vaccine allocation and access. Co-led by the World Health Organization (WHO), the Vaccine Alliance (Gavi) and the Coalition for Epidemic Preparedness Innovations (CEPI), COVAX uses funding from subscribing countries to support the research, development and manufacture of a wide range of Covid-19 vaccines and negotiate their pricing. Adequate vaccine management and supply chain logistics, which require international co-operation and preparation by member States, will also be needed in order to deliver the vaccines in a safe and equitable way. In this regard, the Parliamentary Assembly draws attention to guidance for countries, developed by WHO, on programme preparedness, implementation and country-level decision making.

6. Member States must already now prepare their immunisation strategies to allocate doses in an ethical and equitable way, including deciding on which population groups to prioritise in the initial stages when supply is short, and how to expand vaccination as availability of one or more Covid-19 vaccines improves. Bioethicists and economists largely agree that persons over 65 years old, those under 65 with underlying health conditions that put them at a higher risk of severe illness and death, healthcare workers (especially those who work closely with persons who are in high-risk groups) and people who work in essential infrastructure should be given priority for vaccination. Children, pregnant women and nursing mothers, for whom no vaccine has so far been authorised, should not be forgotten.

7. Scientists have done a remarkable job in record time. It is now for governments to

act. The Assembly supports the vision of the Secretary-General of the United Nations that a Covid-19 vaccine must be a global public good. Immunisation must be available to everyone, everywhere. The Assembly thus urges member States and the European Union to:

7.1 with respect to the development of Covid-19 vaccines:

7.1.1 ensure high-quality trials that are sound and conducted in an ethical manner in accordance with the relevant provisions of the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine (ETS No. 164, Oviedo Convention) and its Additional Protocol concerning Biomedical Research (CETS No. 195), and which progressively include children, pregnant women and nursing mothers;

7.1.2 ensure that regulatory bodies in charge of assessing and authorising vaccines against Covid-19 are independent and protected from political pressure;

7.1.3 ensure that relevant minimum standards of safety, efficacy and quality of vaccines are upheld;

7.1.4 implement effective systems for monitoring the vaccines and their safety following their roll-out to the general population, also with a view to monitoring their long-term effects;

7.1.5 put in place independent vaccine compensation programmes to ensure compensation for undue damage and harm resulting from vaccination;

7.1.6 pay special attention to possible insider trading by pharmaceutical executives or pharmaceutical companies unduly enriching themselves at public expense, by implementing the recommendations contained in Resolution 2071 (2015) “Public health and the interests of the pharmaceutical industry: how to guarantee the primacy of public health interests?”;

7.1.7 overcome the barriers and restrictions arising from patents and intellectual property rights in order to ensure the widespread production and distribution of vaccines in all countries and to all citizens;

7.2 with respect to the allocation of Covid-19 vaccines:

7.2.1 ensure respect for the principle of equitable access to healthcare, as laid down in Article 3 of the Oviedo Convention, in national vaccine allocation plans, guaranteeing that Covid-19 vaccines are available to the population regardless of gender, race, religion, legal or socio-economic status, ability to pay, location and other factors that often contribute to inequities within the population;

7.2.2 develop strategies for the equitable distribution of Covid-19 vaccines within member States, taking into account that the supply will initially be low, and plan how to expand vaccination programmes as the supply increases; follow the advice of independent national, European and international bioethics committees and institutions, as well as of WHO, in the development of these strategies;

7.2.3 ensure that persons within the same priority groups are treated equally, paying special attention to the most vulnerable such as older persons, those with underlying conditions and healthcare workers, especially those who work closely with persons who are in high-risk groups, as well as people who work in essential infrastructure and public services, in particular in social services, public transport, law enforcement and schools, as well as those who work in the retail sector;

7.2.4 promote equity in access to Covid-19 vaccines between countries by supporting international efforts such as the Access to Covid-19 Tools (ACT) Accelerator (ACT-Accelerator) and its COVAX Facility;

7.2.5 refrain from stockpiling Covid-19 vaccines, as this undermines the ability of other countries to procure vaccines for their populations, and ensure that stockpiling does not result in escalating vaccine prices for those who cannot stockpile; conduct auditing and due diligence to ensure rapid deployment of vaccines at minimum cost based on need and not on market power;

7.2.6 ensure that every country is able to vaccinate their healthcare workers and vulnerable groups before vaccination is rolled out to non-risk groups, and thus consider donating vaccine doses or accepting that priority be given to countries which have not yet been able to do so, bearing in mind that a fair and equitable global allocation of vaccine doses is the most efficient way of beating the pandemic and reducing the associated socio-economic burdens;

7.2.7 ensure that Covid-19 vaccines whose safety and effectiveness have been established are accessible to all who require them in the future, by having recourse, where necessary, to mandatory licences in return for the payment of royalties;

7.3 with respect to ensuring a high vaccine uptake:

7.3.1 ensure that citizens are informed that the vaccination is not mandatory and that no one is under political, social or other pressure to be vaccinated if they do not wish to do so;

7.3.2 ensure that no one is discriminated against for not having been vaccinated, due to possible health risks or not wanting to be vaccinated;

7.3.3 take early effective measures to counter misinformation, disinformation and hesitancy regarding Covid-19 vaccines;

7.3.4 distribute transparent information on the safety and possible side effects of vaccines, working with and regulating social media platforms to prevent the spread of misinformation;

7.3.5 communicate transparently the contents of contracts with vaccine producers and make them publicly available for parliamentary and public scrutiny;

7.3.6 collaborate with non-governmental organisations and/or other local initiatives to reach out to marginalised groups;

7.3.7 engage with local communities in developing and implementing tailored strategies to support vaccine uptake;

7.4 with respect to Covid-19 vaccination for children:

7.4.1 ensure a balance between the rapid development of vaccination for children and duly addressing safety and efficacy concerns and ensuring the complete safety and efficacy of all vaccines made available to children, with a focus on the best interests of the child, in accordance with the United Nations Convention on the Rights of the Child;

7.4.2 ensure high-quality trials, with due care for relevant safeguards, in accordance with international legal standards and guidance, including a fair distribution of the benefits and risks for the children who are studied;

7.4.3 ensure that the wishes of children are duly taken into account, in accordance with their age and maturity; where a child’s consent cannot be given, ensure that agreement is provided in other forms and that it is based on reliable and age-appropriate information;

7.4.4 support the United Nations Children’s Fund (UNICEF) in its efforts to deliver vaccines from manufacturers that have agreements with the COVAX Facility to those who need them most;

7.5 with respect to ensuring the monitoring of the long-term effects of Covid-19 vaccines and their safety:

7.5.1 ensure international co-operation for timely detection and elucidation of any safety signals by means of real-time global data exchange on adverse events following immunisation (AEFIs);

7.5.2 use vaccination certificates only for their designated purpose of monitoring vaccine efficacy, potential side effects and adverse events;

7.5.3 eliminate any gaps in communication between local, regional and international public health authorities handling AEFI data and overcome weaknesses in existing health data networks;

7.5.4 bring pharmacovigilance closer to healthcare systems;

7.5.5 support the emerging field of “adversomics” research, which studies inter-individual variations in vaccine responses based on differences in innate immunity, microbiomes and immunogenetics.

8. With reference to Resolution 2337 (2020) on democracies facing the Covid-19 pandemic, the Assembly reaffirms that parliaments, as cornerstone institutions of democracy, must continue to play their triple role of representation, legislation and oversight in pandemic circumstances. The Assembly thus calls on parliaments to exercise these powers, as appropriate, also in respect of the development, allocation and distribution of Covid-19 vaccines.

Neil Ferguson - The predictor

In 2009, Ferguson and his Imperial team predicted that swine flu had a case fatality rate 0.3 per cent to 1.5 per cent. His most likely estimate was that the mortality rate was 0.4 per cent. A government estimate, based on Ferguson’s advice, said a ‘reasonable worst-case scenario’ was that the disease would lead to 65,000 UK deaths. In the end swine flu killed 457 people in the UK and had a death rate of just 0.026 per cent in those infected.Why did the Imperial team overestimate the fatality of the disease? In 2001 the Imperial team produced modelling on foot and mouth disease that suggested that animals in neighbouring farms should be culled, even if there was no evidence of infection. This influenced government policy and led to the total culling of more than six million cattle, sheep and pigs – with a cost to the UK economy estimated at £10 billion.It has been claimed by experts such as Michael Thrusfield, professor of veterinary epidemiology at Edinburgh University, that Ferguson’s modelling on foot and mouth was ‘severely flawed’ and made a ‘serious error’ by ‘ignoring the species composition of farms,’ and the fact that the disease spread faster between different species.Does Ferguson acknowledge that his modelling in 2001 was flawed and if so, has he taken steps to avoid future mistakes?

Malaria killed a 4-year-old girl in Italy, raising fears that the mosquito-borne disease has returned to the country after decades.

Sonia Zago developed a high fever after returning home from a vacation in Bibione, a seaside town on the Adriatic coast near Venice.

As her condition worsened, she was taken to a hospital in the northern city of Trento. Within an hour of arriving, the girl had fallen into a coma and was diagnosed with malaria. Zago was then transferred to a hospital in Brescia that treats tropical diseases, but she died on Sunday night.

The girl had never traveled to a risk-prone country, raising questions about how she contracted the disease.

The Ministry of Health confirmed Tuesday that it had dispatched a team of experts to investigate.

Dr. Claudio Paternoster, director of the infectious diseases ward at Santa Chiara hospital in Trento, said that he had not seen a case of home-grown malaria during his 30-year career.

He said that Zago had been admitted to the facility about two weeks ago due to suspected diabetes and had shared a ward with two children who had contracted malaria while in Burkina Faso.

Mit 140 Straftaten, darunter 22 Raubüberfälle, vor seinem 14. Geburtstag gilt der afghanische Asylantenbub Ahmad A. derzeit als kriminellster und gefährlichster Jugendliche Oberösterreichs. Seit Sonntag sitzt er wieder in U- Haft, weil er in Perg eine Frau bedrohte und verletzte. Er hat in Oberösterreich zwei kriminelle Vorbilder.

Bis 26. Dezember des Vorjahres konnte der Flüchtlingsbub für seine kriminellen Taten nicht belangt werden. Nun wurde er, wie berichtet, als Mitglied einer Jugendbande, der 65 Straftaten mit 60.000 Euro Schaden vorgeworfen wird, ausgeforscht. Neben anderem hatte er mit einem 15- jährigen Rumänen im Oktober des Vorjahres in Ebelsberg eine Trafikantin mit einem Schlagring niedergeschlagen, um deren erst einen Tag alten BMW zu rauben. Da war der Bursch noch strafunmündig. Heuer saß er wegen falscher Zeugenaussage sowie eines Handyraubes jeweils 14 Tage in U- Haft, war erst am 2. März wieder auf freien Fuß gesetzt worden. Nur drei Tage später wurde Ahmad neuerlich festgenommen, weil er in Perg eine Frau attackiert und verletzt hatte. "Über ihn wurde wieder die Untersuchungsahaft verhängt", bestätigt die Linzer Staatsanwaltschaft. Der kriminelle Flüchtlingsbub bleibt zumindest die nächsten 14 Tage in Gewahrsam, dann wird bei einer Haftprüfungsverhandlung weiter entschieden.
Seine Eltern werden ihm nicht Herr, auch das Linzer Jugendamt kommt nicht an ihn heran. "Das ist derzeit der einzige derartige Fall", weiß auch Helmut Mitter als Leiter des Amtes für Soziales, Jugend und Familie nicht weiter.

In der Vergangenheit hielten auch zwei andere hochkriminelle Kinder die heimische Exekutive auf Trab: In den Achtzigerjahren verübte Engelbert H. im Raum Linz vor seiner Strafmündigkeit mehr als 60 Diebstähle. Mit 16 Jahren verbrachte er als "jüngster Gewohnheitsverbrecher Österreichs" viel Zeit im Gefängnis, wanderte dann nach Deutschland aus. In den Neunzigerjahren wurde dann der strafunmündige Fadil S. zum Schrecken der Justiz: Vor seinem 14. Geburtstag soll der Bosnier mehr als 160 Einbrüche, Raubüberfälle, Brandlegungen und Autodiebstähle verübt haben, kam als "krankhaft kriminell und gemeingefährlich" in die Psychiatrie. Später setzte er sich nach Ungarn ab.

Die brandaktuellen Zahlen der Kriminalitätsentwicklung in Oberösterreich haben es in sich: Ausländer begehen ein Drittel aller Straftaten. Brisant: Asylwerber begehen im Verhältnis zu ihrem Anteil an der Gesamtbevölkerung über 20mal so viele Sex-Delikte wie der Durchschnitt! In einer Pressekonferenz zum Schock-Thema ging die FPÖ Oberösterreich jetzt ausführlich auf die alarmierenden Zahlen ein.

Strafrahmen am unteren Ende erhöhen
Wie die Auswertung der Zahlen des Inneniministeriums aus fünf verschiedenen parlamentarischen Anfragen durch die FPÖ zeigt, stieg die Gesamtkriminalität in Oberösterreich um 5,7 Prozent von 62.666 Straftaten im Jahr 2015 auf 66.241 Straftaten im Jahr 2016.
Damit liegt Oberösterreich bundesweit an zweiter Stelle hinter Salzburg.

Haimbuchner: Mindeststrafen erhöhen
Oft rufen besorgte Bürger nach einer Erhöhung der Strafrahmen. Landeshauptmann-Stellvertreter Dr. Manfred Haimbuchner (FPÖ) betont jedoch, dass ein „reiner Ruf nach der Erhöhung von Strafrahmen nichts bringt“, weil Richter meistens beim unteren Drittel des Strafrahmens hängen bleiben würden.
Haimbuchner will deshalb am unteren Ende ansetzen und die Mindeststrafen erhöhen.

Ausländer begehen 1/3 der Straftaten
2016 waren von insgesamt 40.665 Tatverdächtigen 12.637 Fremde, also nicht-österreichische Staatsbürger. Das entspricht einem Ausländeranteil von 31,1 Prozent. Wie hoch der Anteil an Österreichern mit Migrationshintergrund ist, ist indes nicht bekannt und wird auch vom Innenministerium statistisch nicht erfasst.
Von den tatverdächtigen Ausländern sind mit 19,7 Prozent fast ein Fünftel Asylwerber.

Asylwerber: Überdurchschnittlich viel Sex-Attacken
Das ist aber noch nicht alles: Asylwerber begehen in einem unglaublich überproportionalen Ausmaß Sex-Straftaten! Die unter dem Punkt „Straftaten gegen die sexuelle Integrität“ zusammengefassten Straftaten werden zu 25,53 Prozent von Ausländern begangen von Ausländern begangen und zu 12,07 Prozent von Asylwerbern.
Dem Land Oberösterreich zufolge sind derzeit in Oberösterreich etwa 7.500 Asylwerber untergebracht. Bei etwa 1,4 Millionen in Oberösterreich lebenden Menschen beträgt der Anteil von Asylwerbern an der Gesamtbevölkerung ca. 0,5 Prozent. Asylwerber begehen demnach im Verhältnis über 20 mal so viele Sex-Delikte wie der Durchschnitt!

Allein die Zahl der Sex-Attacken stieg in Oberösterreich von 2015 zu 2016 um mehr als 12 Prozent an („Wochenblick“ berichtete)!

Problem: Kinder als Straftäter
Um der Lage der immer krimineller werdenden Kinder unter 14 Jahren Herr zu werden, möchte Haimbuchner die Strafmündigkeit herabsetzen. Man sei mit einer bisher nicht vorhersehbaren Kriminalität von Unter-14-Jährigen konfrontiert, die eine frühere Strafmündigkeit erfordern würde. Das zeigte unter Anderem der Fall von Ahmad A.: Der Afghane beging vor seinem 14. Geburtstag 140 Straftaten, davon 22 Raubüberfälle.
Einmal mehr betonte Sicherheitslandesrat Elmar Podgorschek (FPÖ) die Wichtigkeit der guten Zusammenarbeit mit der Polizei. Die FPÖ fordert nun eine echte Erhöhung von Personalstellen bei der Polizei sowie ein Revision der Schließung von Polizeiposten.

In March 2011, the Max Planck Institute published a landmark study on honor killings. The study analyzed all such crimes known to have occurred in Germany between 1996 and 2005. The report found that there were two honor killings in 1998 and 12 in 2004. By 2016, however, the number had jumped to more than 60, an increase of 400%, according to the website Ehrenmord.
The actual number of honor crimes presumably is much higher. Increased censorship by the police and the media, aimed at stemming anti-immigration sentiments, makes it impossible to know the names and national origins of many victims or perpetrators, or the true circumstances surrounding many murders, which often appear to be honor killings but are downplayed as "domestic disputes" (Familienangelegenheiten).
2017 is nevertheless on track to be a record year for honor violence in Germany; in the first five months of this year, there have been at least 30 honor killings, including the following:
May 18. In Berlin, a 32-year-old Bosnian, Edin A., murdered his former girlfriend, a 35-year-old German woman named Michelle E., after she ended their abusive relationship. He also abducted and tortured her 12-year-old son, who was forced to watch his mother's murder. Neighbors said they had repeatedly alerted the police about Edin A.'s violent behavior, but the police did nothing.
May 17. In Pforzheim, a 53-year-old Tajik man stabbed to death his 50-year-old wife at her place of employment, a Christian daycare center. It remains unclear if the woman was a convert to Christianity.
May 17. In Wardenburg, a 37-year-old Iraqi man stabbed to death his 37-year-old wife while she was asleep in her bed. The couple's five children, between the ages of four and 15, were at home at the time of the murder and are now living with relatives.
May 8. In Neuendettelsau, a 24-year-old Ethiopian asylum seeker, Mohammed G., stabbed his 22-year-old girlfriend in the stomach at a restaurant after she allegedly "provoked" him. The woman was five months pregnant; the unborn baby died in the attack.
May 4. In Freiburg, a 33-year-old Syrian asylum seeker stabbed his 24-year-old wife, a Kurdish Christian who had moved out of the couple's apartment, but had returned to collect some personal belongings. The couple's three children — aged six, three and ten months — are now in protective custody.
April 29. In Prien am Chiemsee, a 29-year-old Afghan man stabbed to death a 38-year-old Afghan woman, Farima S., who had converted to Christianity. The attacker ambushed the woman as she was exiting a grocery store with her two children.
April 23. In Syke, a 32-year-old Iraqi man, Murad B., strangled his 32-year-old wife, Mehe K., in front of the couple's three children, ages one, two and nine.
April 23. In Dresden, a 29-year-old Pakistani refugee, Shahajan Butt, murdered his girlfriend, a 41-year-old Vietnamese woman named Thu T. April 16. In Mainz-Finthen, a 39-year-old Egyptian asylum seeker stabbed to death his 32-year-old wife. Police said the couple had been arguing at the time of the attack. Their two children are being held in protective custody.
April 5. In Leipzig, a 34-year-old Syrian man stabbed his 28-year-old wife because she wanted a divorce. The couple's two children witnessed the attack; they are being held in protective custody.
March 31. In Gütersloh, a 43-year-old Syrian man burned his 18-year-old daughter with a cigarette and threatened to kill her. When the police intervened, the father refused to allow his daughter to leave the house. After police succeeded in bringing the girl to safety, the father and son attacked the police, who used pepper-spray to fend them off. The girl is being held in protective custody.
March 15. In Kiel, a 40-year-old German-Turkish man stabbed to death his 34-year-old Turkish wife in front of a daycare center. Neighbors said the couple, who were separated, had quarreled about moving their three children to Turkey.
March 4. In Duisburg, a 30-year-old Syrian asylum seeker, Mahmood Mahrusseh, stabbed his 32-year-old ex-girlfriend. The woman survived; her attacker remains at large.
March 3. In Mönchengladbach, a 32-year-old asylum seeker, Ahmed Salim, murdered a 47-year-old German woman, Nicole M., apparently after she ended a relationship with him. The man, who also uses the alias Jamal Amilia, was arrested in Spain. In his asylum application, he had written that he was from Israel. March 2. In Scheeßel, a 42-year-old Iraqi man stabbed to death his 52-year-old wife, also from Iraq. Police described the murder as an honor killing. The couple's children are now in protective custody.
February 25. In Euskirchen, a 32-year-old German-Turkish man stabbed to death his former girlfriend, a 32-year-old German woman who had begun dating someone else.
February 17. In Offenbach, a 32-year-old Turkish man, Volkan T., shot to death his former girlfriend, a 40-year-old woman, Silvia B. The man said he was angry that the woman, who had two children, had ended her relationship with him.
February 15. In Bielefeld, a 51-year-old Iraqi man tried to murder his 51-year-old wife by attacking her with a hammer while she was attending a German class at a local language academy. The man was apparently angry that his wife was mixing with other language students.

Czy można sobie wyobrazić, że polski wymiar sprawiedliwości gromadzi dowody zbrodni katyńskiej, a potem wszystkie oryginały oddaje Rosjanom? A tak się właśnie stało z wieloma kluczowymi dowodami zbrodni niemieckich popełnionych w Polsce w czasie II wojny światowej. Gdyby teraz Polska miała się procesować z Niemcami w sprawie odszkodowań za zbrodnie wojenne, nie bylibyśmy w stanie wielu naszych roszczeń udowodnić. Dużą część dowodów winy, w tym tysiące oryginałów zeznań świadków, fotografii i innych materiałów śledczych, dobrowolnie oddano niemieckim prokuraturom. Teraz nie wiadomo, gdzie są te dokumenty i czy kiedykolwiek je odzyskamy. To sprawa niebywała, nie mająca precedensu w żadnym europejskim kraju, szkodząca nie tylko pamięci o zbrodniach, ale też wizerunkowi Polski jako państwa prawa. Dokumenty przekazywała najpierw Główna Komisja Badania Zbrodni Hitlerowskich, a później jej następczyni - działająca przy Instytucie Pamięci Narodowej Główna Komisja Ścigania Zbrodni przeciwko Narodowi Polskiemu. Pośrednikiem między komisją a prokuraturami RFN była tzw. centrala w Ludwigsburgu, instytucja powołana w celu "poprawy wizerunku" niemieckich organów ścigania zbrodni wojennych.

Wielka czystka w archiwach
Sprawa przekazywania Niemcom dokumentacji zbrodni wojennych wyszła na jaw przy okazji 65. rocznicy wybuchu wojny. W 2004 r. ówczesny dyrektor IPN prof. Leon Kieres zwrócił się do podległych mu prokuratorów IPN, by przygotowali raport o stanie śledztw w sprawach zbrodni Wehrmachtu popełnionych we wrześniu 1939 r. I wtedy okazało się, że w tysiącach teczek znajdujących się w archiwach IPN brakuje nie tylko oryginałów zeznań czy zdjęć, ale nawet wiarygodnych kopii tych dokumentów. A bez oryginalnych akt zakończenie spraw, czyli ich umorzenie lub wydanie wyroku skazującego, nie jest możliwe. Jak informuje "Wprost" dr Antoni Kura, naczelnik Wydziału Nadzoru nad Śledztwami Głównej Komisji Ścigania Zbrodni przeciwko Narodowi Polskiemu, takich niezamkniętych postępowań może być nawet 10 tysięcy. Niektóre z nich są bardzo głośne, na przykład sprawa zbrodni niemieckich popełnionych na terenie obozów Gross-Rosen czy Treblinka. W kilkuset przebadanych dotychczas teczkach znaleziono jedynie adnotację: "wysłane do Ludwigsburga".
Zentrale Stelle der Landesjustizverwaltungen w Ludwigsburgu powstała w listopadzie 1958 r., a jej formalnym celem było archiwizowanie akt pohitlerowskich i przekazywanie ich do odnośnych urzędów prokuratury powszechnej. Choć centrala miała mieć charakter tymczasowy, istnieje do dziś i "stanowi urząd wymiaru sprawiedliwości, działający zgodnie z konstytucją" - jak wynika z wykładni niemieckiego Trybunału Konstytucyjnego.
Już wiosną 1959 r. na prośbę centrali w Ludwigsburgu Główna Komisja Badania Zbrodni Hitlerowskich w Polsce zaczęła przekazywać zawartość polskich archiwów partnerom z RFN. Tylko w latach 1965-1989 Polacy przekazali Niemcom 36 tys. protokołów zeznań, 150 tys. fotografii, kilkadziesiąt tysięcy mikrofilmów i 12 tys. kompletów materiałów z prowadzonych śledztw. W zamian strona polska otrzymała z Ludwigsburga... listę polskich gajowych i leśniczych współpracujących z RSHA (Głównym Urzędem Bezpieczeństwa Rzeszy).

Legalne bezprawie
Prof. Witold Kulesza, dyrektor Głównej Komisji Ścigania Zbrodni przeciwko Narodowi Polskiemu, twierdzi, że istniała podstawa prawna, by przekazywać Niemcom dokumenty. Tą podstawą było porozumienie podpisane między rządami PRL i RFN, stwierdzające, że dostęp do oryginałów naszych akt potrzebny jest Niemcom do skuteczniejszego ścigania za zbrodnie popełnione na terenie Polski. Prokuratorzy pionu śledczego IPN twierdzą tymczasem, że nie ma śladów podpisania takiego porozumienia między rządami. Zresztą zgoda polskiej strony, zważywszy, że RFN była wtedy krajem wrogim PRL ideowo, politycznie i militarnie, wydaje się czymś kuriozalnym. Opinię tę potwierdza znany prawnik, specjalista od spraw polsko-niemieckich, prof. Jan Sandorski z Uniwersytetu im. Adama Mickiewicza w Poznaniu. Twierdzi on, że nie było żadnego międzyrządowego porozumienia w tej sprawie.
Otrzymane z Polski dokumenty miały służyć uruchomieniu wewnętrznego śledztwa w centrali w Ludwigsburgu, a ponieważ nie miała ona uprawnień prokuratorskich, wysyłano je później, jako podstawę ewentualnych aktów oskarżenia, do urzędów prokuratury powszechnej w miejscu zamieszkania podejrzanych. Pikanterii sprawie dodaje to, że Ludwigsburg ani razu nie wystąpił do żadnego z polskich poszkodowanych o potwierdzenie zeznań czy chociażby złożenie jakichkolwiek wyjaśnień, nie mówiąc o tym, że po wykorzystaniu materiału dowodowego ani jednego z oryginalnych dokumentów nie zwrócono właścicielowi. Zmarły niedawno tropiciel zbrodni hitlerowskich Szymon Wiesenthal nie mógł zrozumieć, jak to się dzieje, że fotografie esesmanów mordujących Polaków, zarejestrowane w aktach GKBZH, są odnajdywane w niemieckich archiwach.
Osobą, która bezpośrednio decydowała o wysyłaniu akt do Niemiec, był nieżyjący już prof. Czesław Pilichowski, wieloletni prezes komisji. O wysyłce akt wiedziało jednak znacznie więcej osób. Niektóre z nich, choćby obecny wiceprezes IPN prof. Witold Kulesza, uważają, że nic złego się nie stało. Dopiero w styczniu 2005 r., po 46 latach ogołacania polskich zbiorów archiwalnych, ktoś zwrócił na to uwagę.

Polski antystandard
Z punktu widzenia polskiego prawa udostępnianie oryginałów akt - co jest skądinąd złamaniem światowego standardu w wymiarze sprawiedliwości - było nie tylko niedbalstwem, ale wręcz bezprawiem. Naruszeniem prawa było chociażby wysyłanie "stronie trzeciej" zeznań, fotografii i innych materiałów dowodowych bez powiadomienia poszkodowanych - ofiar lub ich rodzin. Tym bardziej że bez oryginałów dokumentów skuteczne domaganie się ukarania sprawców nie jest dziś możliwe. Większości dowodów nie da się odtworzyć, a świadkowie tych zdarzeń przeważnie zmarli. Nie wyjdą więc nigdy na jaw okoliczności zamordowania przez Niemców w lipcu 1942 r. jedenastu Polaków w Dmeninie koło Radomska. Podobnie jak okoliczności rozstrzelania dwudziestu Polaków w Olkuszu (w lipcu 1940 r.), kulisy zbrodni popełnionych w obozie jenieckim w Królewcu czy morderstw dokonanych w latach 1943-1945 przez gestapo w Tucholi. Akta tych i tysięcy innych spraw zostały w latach 70. przekazane w całości do Ludwigsburga. Niemieccy prokuratorzy, mający oryginały dowodów zbrodni, mogli przewlekać śledztwa czy opóźniać składanie wniosków. I to robili.
Można zrozumieć, że w PRL władze państwowe nie troszczyły się o elementarny interes ofiar. Dziwi takie postępowanie w III RP. - Polska może być dumna z tego, co zrobiła; otrzymaliśmy za współpracę z Ludwigsburgiem liczne pochwały, m.in. od Fritza Bauera, jednego z nielicznych prokuratorów naprawdę ścigających niemieckich zbrodniarzy - mówi "Wprost" prof. Witold Kulesza. Na pytanie, dlaczego ani Rosjanie, ani Francuzi z Ludwigsburgiem nie współpracowali, prof. Kulesza odpowiada: - Bo oni nie mają tego w zwyczaju.
Prof. Kulesza nadal opowiada się za współpracą z Ludwigsburgiem. W 2005 r. pracownicy IPN otrzymali podpisaną przez niego notatkę służbową, w której apeluje o pomoc dla centrum w Ludwigsburgu "w związku z tendencjami likwidacyjnymi tej instytucji". Innymi słowy, chodziło o wysyłanie do Ludwigsburga jak najwięcej akt. W uznaniu zasług dla polsko-niemieckiej współpracy prof. Kulesza jest często zapraszany do RFN na wykłady, prelekcje, a niedawno został także nagrodzony medalem przyjaźni.

Nie ma winnych!
Naczelnik Antoni Kura z IPN wraz z podległym mu prokuratorem Lucjanem Nowakowskim zwrócili się w kwietniu 2005 r. do ówczesnego prezesa IPN prof. Leona Kieresa o wyjaśnienie, dlaczego przekazywano Niemcom oryginały dokumentów. Na tej podstawie prezes Kieres, a później także wiceprezes Kulesza powołali komisję do zbadania okoliczności utraty dokumentów. Jej wnioski zostały przekazane ministrom sprawiedliwości - najpierw Andrzejowi Kalwasowi (SLD), a później Zbigniewowi Ziobrze (PiS). W piśmie z 5 lipca 2005 r. Kalwas pociesza prezesa IPN, że utrata dokumentów "nie ma miejsca", bo przecież "oryginał akt i dowody rzeczowe (...) podlegają zwrotowi, chyba że organ wysyłający się tego zrzeknie", oraz że "nic nie sprzeciwia się występowaniu o zwrot dokumentów". W równie optymistycznym tonie utrzymane jest pismo ministra Ziobry z 12 stycznia 2006 r. Przy czym minister Ziobro zachęca dodatkowo do "odtwarzania zaginionych dokumentów".
Wszystko wskazuje jednak na to, że dokumenty zostały stracone bezpowrotnie. Na jakąkolwiek prośbę czy sugestię ich zwrotu urzędnicy w Ludwigsburgu najpierw reagowali rozkładaniem rąk, a później zniecierpliwieniem. Na nasze pytania odpowiadają: "Nie piszcie do nas! Akt już w Ludwigsburgu nie ma". A gdzie są, tego nie wiadomo. Dyrektor centrali w Ludwigsburgu dr Joachim Reidel w piśmie do IPN sugeruje, że część akt może się znajdować w Bundesarchiv w Koblencji, Fryburgu lub Berlinie. Część została najprawdopodobniej zniszczona, uległ bowiem przedawnieniu okres ich przechowywania.
- Jeśli w tej sprawie mieliśmy wyłącznie do czynienia z użyczeniem akt dla dobra niemieckiego śledztwa, jak zapewnia centrala w Ludwigsburgu, to czym prędzej należy się zwrócić do strony niemieckiej o ich zwrot. Gdyby strona niemiecka z jakichś powodów zwrotu odmówiła, trzeba wystąpić do sądu o odszkodowanie. Innego wyjścia nie ma - mówi "Wprost" prof. Jan Sandorski.
Nie mając wielu dowodów niemieckich zbrodni, jesteśmy bezradni wobec działań takich osób jak Erika Steinbach, która na równi ze zbrodniami Niemców stawia rzekome polskie zbrodnie dokonywane podczas wysiedleń Niemców. Nie mając dowodów, nie potrafimy się przed takimi zarzutami bronić.

Kolejne przedwyborcze obiecanki cacanki dla poloni w niemczech
