HTC, Huawei, ZTE did not violate FlashPoint patents

HTC Corp and others did not violate digital camera patents owned by Apple Inc spinoff FlashPoint Technology to make their smartphones, the U.S. International Trade Commission said on Friday.

FlashPoint Technology, which filed the complaint in 2012, had originally accused Taiwan-based HTC, China's Huawei Technologies Co Ltd and ZTE Corp of infringing four patents for smartphone cameras. One of the patents was dropped as the case proceeded.

An administrative law judge found in a preliminary decision on September 30, 2013, that two HTC smartphones - the HTC Vivid and HTC Droid Incredible 4G LTE - infringed upon one FlashPoint patent, while Huawei and ZTE were cleared.

The commission, which reviewed the judge's ruling, said in a final decision on Friday that none of the accused companies infringed the patents and it terminated the investigation.

If the companies had been found guilty of violating the patents, the smartphones could have been banned from the United States market.

The ITC is a popular venue for patent lawsuits because it can ban infringing products from the United States more easily than district courts.

The ITC will rule that a patent has been violated if the accused company infringes the patent and if the patent owner uses the patent in the United States.

GoDaddy eyes initial public offering

Web hosting company The GoDaddy Group Inc is preparing for a second run at an initial public offering, according to two people familiar with the matter, as the 2014 tech IPO pipeline continues to grow.

GoDaddy, the Internet domain registrar and web host known for its racy ads, would join a number of high-profile technames expected to go public this year in the wake of Twitter Inc's successful debut. They include "Candy Crush" developer King Digital and cloud services providers Box and Dropbox.

The company is in the process of selecting underwriters for its IPO, one of the two sources said on condition of anonymity.

GoDaddy was not immediately available for comment.

GoDaddy had filed to go public in 2006 but was told at the time that it would be required to take a 50 percent haircut -- a percentage that is subtracted from the par value of assets that are being used as collateral -- on its initial public offering.

The company instead decided to pull its filing, citing unfavorable market conditions.

The company, founded in 1997, was eventually acquired by a private equity consortium led by KKR & Co and Silver Lake in 2011 for $2.25 billion. Silver Lake declined to comment while KKR did not immediately respond to a request for comment.

Other private equity buyers included Technology Crossover Ventures.

GoDaddy, which provides website domain names, is famous for airing bawdy commercials with scantily clad women for the past decade during the Super Bowl.

Samsung debuts wearables and latest Galaxy smartphone

Samsung Electronics unveiled a new smartwatch and fitness band along with the latest version of its Galaxy smartphone on Monday, demonstrating how the battleground for innovation is shifting from the hand to the wrist.

The world's biggest smartphone maker set a trend less than six months ago for wearable devices that link to mobile handsets with its Galaxy Gear watch, which has seen rivals like Sony and Huawei follow in its wake.

Samsung is taking a less glitzy marketing approach to control costs. It has also performed a U-turn, abandoning its previous heavy focus on sweeping hardware improvements to highlight more subtle features in its devices and accessories in a bid to appeal to a wider audience.

"With the Galaxy S5, Samsung is going back to basics," JK Shin, co-chief executive and president of Samsung's mobile business, told an audience of Samsung employees, partners and media at the annual Mobile World Congress technology trade show in Barcelona. Samsung will roll out the S5 globally on April 11, with pricing details yet to be disclosed.

"Our consumers do not want eye-popping technology or the most complex technology," he said. Instead, they want beautiful design, a better camera, faster connectivity and technology that would help them keep fit, Shin said.

Market expectations for the new S5, one of Samsung's marquee product launches this year, remain subdued given its comparative lack of innovation.

"The Galaxy S5 has great features and will probably sell well due to massive marketing support," Forrester Research analyst Thomas Husson said. "But is the total product experience it offers differentiated enough to continue the sales success story? Is it enough to bet on fitness and fingerprint sensors to beat Apple - rooting the experience in people's daily lives? I don't think so."

The Galaxy S5, which will be available in April, has a slightly bigger screen than its predecessor, at 5.1 inches compared with 5 inches, improved camera technology and better protection against water and dust, Samsung said.

It also has a fingerprint scanner on the home button, which rival Apple introduced in the iPhone 5S last year. The function can be used to protect data and provide security credentials in a swipe.

At a relatively low-key launch event in Barcelona, Samsung also unveiled the Gear 2 smartwatch, which runs on the Tizen operating system rather than Google's Android software, and a stripped-down version called Gear 2 Neo, which doesn't have a camera.

The devices can monitor the wearer's heart rate, a function used in increasingly popular health and fitness apps, or individual programs.

The Samsung Gear Fit, also targeting the fitness sector, has a heart rate monitor, too, as does the Samsung Galaxy S5 itself, a first for a smartphone, Samsung said.

The Gear Fit has a curved touch-sensitive screen and its features include a pedometer, Samsung said.

Being overweight is so common in Europe that it risks becoming "the new norm", with around a third of teenagers now heavier than is recommended for their health.

"Our perception of what is normal has shifted; being overweight is now more common than unusual. We must not let another generation grow up with obesity as the new norm," said Zsuzsanna Jakab, the WHO's ( World Health Authority) regional director.

She blamed a combination of high levels of physical inactivity, coupled with a culture that promotes cheap, convenient foods high in sugars, fats and salt. This combination, she said, "is deadly".

Lack of exercise is a key part of the problem.

The WHO recommends children aged 5 to 17 should get at least 60 minutes of moderate to vigorous physical activity a day, and adults should do at least 150 minutes of moderate exercise a week.

Joao Breda, a WHO expert on nutrition, physical activity and obesity, said peoples' living environments - including the layout of town, cities, schools and workplaces - are crucial to increasing rates of exercise.

"We need to create environments where physical activity is encouraged and the healthy food choice is the default choice, regardless of social group," he said in a statement released with the report.

"Physical activity and healthy food choices should be taken very seriously in all environments - schools, hospitals, cities, towns and workplaces. As well as the food industry, the urban planning sector can make a difference," he added.

The WHO, however, that some countries, including France and some Scandinavian countries, have managed to contain the obesity epidemic "through a whole-of-government approach".

It said many policies in these countries - such as promoting vegetable and fruit consumption in schools, taxing certain foods to reduce intake, controlling advertising, employing good surveillance and monitoring, and taking action to promote physical activity - had combined to help keep obesity levels stable.

WhatsApp will add free voice-call services for its 450 million customers later this year, laying down a new challenge to telecom network operators just days after Facebook Inc scooped it up for $19 billion.

The text-based messaging service aims to let users make calls by the second quarter, expanding its appeal to help it hit a billion users, WhatsApp CEO Jan Koum said at the Mobile World Congress in Barcelona on Monday.

Buying WhatsApp has cemented Facebook's involvement in messaging, which for many people is their earliest experience with the mobile Internet. Adding voice services moves the social network into another core function on a smartphone.

On Monday, Chief Executive Mark Zuckerberg defended the price paid for a messaging service with negligible revenue. He argued that rival services such as South Korea's KakaoTalk and Naver's LINE are already "monetizing" at a rate of $2 to $3 in revenue per user per year, despite being in the early stages of growth.

Media reports put WhatsApp's revenue at about $20 million in 2013.

"I actually think that by itself it's worth more than 19 billion," Zuckerberg told the Mobile World Congress. "Even just independently, I think it's a good bet."

"By being a part of Facebook, it makes it so they can focus for the next five years or so purely on adding more people."

WhatsApp's move into voice calls is unlikely to sit well with telecoms carriers.

WhatsApp and its rivals, like KakaoTalk, China's WeChat, and Viber, have won over telecom operators' customers in recent years by offering a free option to text messaging. Telecom providers globally generated revenue of about $120 billion from text messaging last year, according to market researcher Ovum.

Adding free calls threatens another telecom revenue source, which has been declining anyway as carriers' tweak tariffs to focus on mobile data instead of calls.

WITH, NOT AGAINST

Since the advent a decade ago of Skype's voice over Internet service, which Microsoft Corp has acquired, and the rise of Internet service providers like Google Inc, telecom bosses have gotten used to facing challengers whose services piggyback on their networks. But carriers complain that the rivals are not subject to the same national regulations.

Mats Granryd, the CEO of Swedish mobile operator Tele2, said he was happy to partner with the likes of WhatsApp because of the additional data traffic they generate. But he shared the concerns of other network operators that they must operate under strict national regulations that Internet companies are not subject to.

"They (Internet firms) need to be regulated a little bit more and we need to be regulated a little bit less," said Jo Lunder, who Russian mobile network operator VimpelCom.

Vodafone CEO Vittorio Colao said he did not understand how such an important acquisition as the Facebook-WhatsApp deal could go unchallenged at a time when European network operators were facing intense regulatory scrutiny.

"These types of deal are a clear indication that the world is changing and the regulations don't fit anymore," Colao said on the sidelines of the conference.

Both Facebook and WhatsApp CEOs have cast themselves as partners to telecoms network operators.

On Monday, Koum also announced a partnership with E-Plus, the German subsidiary of Dutch group KPN, under which it will launch a WhatsApp-branded mobile service in Germany.

The European Parliament is set to vote on Monday night on a package of proposed telecoms market reforms which among other provisions would restrict the ability of carriers to charge internet companies like Facebook to give them an enhanced service in handling their network traffic.

Annoyed

I must admit I am slightly annoyed at people who smoke and drink who will put their cigarettes, alcohol and in some cases drugs (cannabis) before food, electricity and gas.

I did smoke myself up till January of this year. One week it was really cold and I was faced with the choice of putting gas on my meter or buying cigarettes. I made the logical choice for my children and me and bought the gas so we could have heating. From then I have not smoked.

Yet I have a friend who has children who will go without gas, electric and food, making her children do the same just so she can buy cigarettes. I heard her making arrangements to buy cannabis BEFORE going food shopping for her family.

When I approached her about this, she said she knew she should not put her cigarettes and cannabis first and had not thought of it that way.

How can a mother allow her family to go without when she could so easily give up the cigarettes and give them more. She would have more money to buy more food, and as a side benefit be healthier?

I cannot understand the mentality of these people, when I was put in the same position to choose, it was a no brainer, not hard, took no thinking, I just quit...

Well I thought this would be easy to do, you know eat healthy and lose weight become fit and healthy. WRONG!!!

There is so much information about food, so many misleading comments made, so many companies wanting to make money from you.

So far I have found out Sugar is bad, fat is bad, carbohydrate is bad, too much meat is bad, veg is good and so is fruit as long as pesticides and fertilisers have not been used.

Then there is the fact they are not as tasty cos they have been grown to order in hothouses, then the Supermarkets wasting loads cos they do not look good enough.

Then there are the diets...
Low Fat, High fibre, protein, carb free, the list is endless, but don't forget exercise...
Is that 30 mins a day or interval training or spinning or classes or yoga, pilates or more?

This is more confusing than I anticipated, then I have to be careful not to slip back into my Anorexia ways, but then I am tempted to be Pro Ana cos its what I know.

I am responding well to my treatment for Anxiety, depression and panic attacks. The new meds I was given seem to be working a treat, I have had the dosage upped by the Doctor but they seem to be working well.

So now instead of obsessing about my weight and getting depressed even more, then comfort eating I have decided to eat a healthier diet permanently. So out have gone all the processed foods all the time and in has come more fresh fruit and veg.

This has lead me to start researching about all the additives and preservatives in food.

I have been learning an awful lot and am preparing some more blogs on each topic as I think they are very interesting and am enjoying the research. I hope to do the first topic next week, till then, have a wonderful time and enjoy yourself.

I do hope this girl is alive and well, if anyone has seen her then please do contact the police and let them know.

I do not want to offend anyone with my views and must say I do have questions related to Madeleine McCann's disappearance.

From the reports over the years we are lead to believe that Madeleine along with her brother and sister were left alone in the holiday apartment asleep. They were checked by their father and he was chatting outside so the front door of the apartment was not an option as to the entry and exit of the alleged abductor. There was also disputes as to whether the window was a viable entrance and exit for the alleged abductor. There are also rumours as to whether cadaver dogs detected the scent of Madeleine on various items including her stuffed toy. Plus the rumours of Blood, DNA evidence in the boot of the hire car.

I myself am a mother, living in the UK. One question I have is why did social services not prosecute the McCann's for neglect? I am sure the authorities would have no hesitation of removing my remaining children and accusing me of neglect if I left 3 children under 5 alone while I was in a Tapas bar.

I have in the past experienced the way social services conduct enquiries, which leads me to ask how the McCann's have been able to avoid the confidentiality clause the authority place you under?

Now it was reported Mrs McCann was finding Madeleine's behaviour to be attention seeking after the twins were born, so why would an abductor steal a toddler when a baby was there? Would it not make more sense that a baby would be easier to pass off than an older child? Would Madeleine not wake up and kick up fuss when a stranger had hold of her? This is considering the McCann's stated Madeleine had been attention seeking.

Now when the investigation into her disappearance was ongoing why were the McCann's bothered by what their family and the press would say? Surely the only thing on your mind would be the safe return of your child.

Why did they feel the need to hire expensive legal teams and why have they made money under the guise of a charity? They have now written a book that they are going to profit from.

From information in the public domain I have noticed that when opinion did not match the McCann's clear disputes with no substantial evidence were made and possible law suits followed from the McCann camp.

It seems now 5 years on more people are questioning what really happened on that fateful night when Madeleine disappeared and are not accepting what they are being told.

I do hope Madeleine is alive, but that opens up more questions.

If she is found, what happens if she does not remember the McCanns?

What if she is happy and wants to stay where she is?

Would it be fair to remove her from a family that she knows and put her with one she does not know?

This is assuming she is safe and well.

If on the other hand Madeleine did die, whether it be by accident or murder, then I hope the persons responsible for the death and concealment for the last 5 years are brought to justice.

I hope the British Review will answer all the questions I and many others have.

Somebody needs to be held accountable for the disappearance of that little girl, whether it is "alleged accident", "alleged murder" or "alleged abduction"...

Sorry I have neglected my blog recently, I have had a bad time with my mental health and weight, so from today I am going to be writing about how exercise (moderate, walking the dog for a couple of hours), and healthy diet is going to help me lose weight and feel mentally healthy.
