As previously stated, the specifics vary from state to state, particularly the number of repair attempts that constitute “reasonable” and the number of days that the vehicle must be out of service in order to qualify. In some states, repairs that affect the brakes or other safety equipment need only one repair attempt to qualify as “reasonable.”&lt;br /&gt;&lt;br /&gt;Restitution is fairly consistent from state to state; it usually requires the manufacturer to either replace the vehicle with one of comparable value, or refund the purchase price, along with &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Tax" title="Tax" rel="wikipedia"&gt;taxes&lt;/a&gt;, registration and delivery fees. Some states leave the option of replacement or refund to the manufacturer, but most give the option to the consumer.&lt;br /&gt;&lt;br /&gt;What should you do if you think you have a lemon? You should:&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Make sure that you document everything elating to repairs of the vehicle, including when and where it was repaired, who signed the work order and what work was done. You should contact the manufacturer in writing, alerting them to the nature of the problem. You should consult with your state’s &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Attorney_general" title="Attorney general" rel="wikipedia"&gt;Attorney General&lt;/a&gt;’s office to learn how your state’s law affects you directly.&lt;br /&gt;&lt;br /&gt;You may have to go through an arbitration process; this involves both you and a representative of the manufacturer explaining your respective situations to a panel that will then provide a ruling.&lt;br /&gt;The arbitration ruling is usually binding on the manufacturer; they will have no recourse should the panel rule in your favor.&lt;br /&gt;Generally, if you don’t agree with the panel’s ruling, you still have the option of filing a &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Lawsuit" title="Lawsuit" rel="wikipedia"&gt;lawsuit&lt;/a&gt; in court.&lt;br /&gt;&lt;br /&gt;You may wish to hire an attorney to represent you; there are plenty of &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Lawyer" title="Lawyer" rel="wikipedia"&gt;lawyers&lt;/a&gt; who specialize in lemon law cases, and they can probably bring the case to a solution more quickly than if you handle the case yourself. However, how the consumer feels about his or her experiences with the vehicle may also assist a jury in determining whether the vehicle is a lemon. “In many states, whether impairment is substantial is determined from the point of view of the consumer, not the manufacturer,” Taylor said. “This suggests a subjective standard, from the point of view of the particular consumer in each case. If you decide to do this, you should not accept a &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Refinancing" title="Refinancing" rel="wikipedia"&gt;refinancing&lt;/a&gt; agreement because it will create a financial obligation that is way beyond the original agreement. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; font-style: italic;"&gt;You should instead demand a refund. Here, you will receive the full purchase price of the vehicle minus a reasonable allowance for vehicle use. The same happens if the vehicle was leased thus this agreement ends so you should not be charged any penalties for ending it early. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; font-style: italic;"&gt;Some manufacturers will not refund or replace your vehicle. When this happens, you have to file for a hearing through the manufacturer’s informal dispute settlement program before you can bring this matter to court. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; font-style: italic;"&gt;No fees are paid during the settlement program. You simply have to submit your complaint together with a copy of your documents. A decision will be made after 40 days and you can accept or reject the decision. If you accept, the manufacturer has to comply within 30 days.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; font-style: italic;"&gt;If you are not satisfied, you can assert your right in court as the lemon law allows by getting the help of a &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Law" title="Law" rel="wikipedia"&gt;lawyer&lt;/a&gt;. You will then contact the Auto Line as defined by the owner's manual, request and complete a claim form. The BBB forwards the claim to the manufacturer, and the manufacturer is given opportunity to resolve the issue. &lt;/span&gt;&lt;br /&gt; &lt;br /&gt;&lt;span style="font-weight: bold; font-style: italic;"&gt; If you are happy with the resolution proposed, it's settled. If you are not satisfied, the Bureau begins the arbitration which means you get to explain the details to an arbitrator at the BBB offices. Bring all of your records of correspondence and put right work. The manufacturer has a chance to speak, and then a decision will be made concerning your claim. Arbitration decisions are normally made within 40 days of filing the claim for lemon law protection.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt;&lt;span style="font-weight: bold; font-style: italic;"&gt; Arbitration decisions are binding to the manufacturer, but not to you- the customer. It takes time which is why you should always keep records &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Maintenance%2C_repair_and_operations" title="Maintenance, repair and operations" rel="wikipedia"&gt;repair and maintenance&lt;/a&gt;. Once this is received, they have to respond within 10 days to take the proper action and another 10 days to fix the vehicle. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Should the problem still exist, you can settle this dispute through an &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Arbitration" title="Arbitration" rel="wikipedia"&gt;arbitration&lt;/a&gt; program. Some companies have one that is state-certified. If the program fails to issue a decision within 40 days or you are not happy with the ruling, you can bring this matter to the Florida New Motor Vehicle Arbitration Board. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Cases that are approved will be scheduled within 40 days. The panel will be composed of three individuals who are knowledgeable about the lemon law as well as have automotive technical experience and a background in engineering. If your vehicle falls outside such guidelines, you can check what federal &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Warranty" title="Warranty" rel="wikipedia"&gt;warranty&lt;/a&gt; &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Law" title="Law" rel="wikipedia"&gt;laws&lt;/a&gt; may apply. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;In order for the &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Lemon" title="Lemon" rel="wikipedia"&gt;lemon&lt;/a&gt; law to apply in your situation, you have to give the manufacture some time to try and fix the problem. If they are unable to fix it after 3 attempts, you can already write them a formal notice stating that if this matter is not resolved, you have no other recourse but to demand for a refund or replacement. The manufacturer has 7 days to comply with this or face &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Arbitration" title="Arbitration" rel="wikipedia"&gt;arbitration&lt;/a&gt;. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;If nothing still happens, a hearing will be scheduled and a panel of experts will be called in to review your case. During the hearing, you will have to present documents that show you gave the manufacturer ample time to repair the problem. This law also applies to leased vehicles. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;When the ruling is made in favor of the customer, you can choose whether to get a refund or have this replaced. Just remember that the manufacturer may appeal that ruling just like you if it did not go your way. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Should this happen, you can take this matter to court hoping that a judge will look favorable on your situation. If you win, you don’t have to worry paying for legal fees because under the law, the manufacturer is required to shoulder it. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;It will take some time to find a &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Lawyer" title="Lawyer" rel="wikipedia"&gt;lawyer&lt;/a&gt; that will handle your case. You can get help from the office of the &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Attorney_General" title="Attorney General" rel="wikipedia"&gt;Attorney General&lt;/a&gt; or look online to find someone who specializes in these matters. So you know that this person will be able to devote their time and effort, ask them some questions like what is their workload, how often have they done this and the length of time it will take before a decision is made. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;If you think that the fees that the lawyer will be charging are way beyond your budget, don’t worry because if the judge sees that your &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Automobile" title="Automobile" rel="wikipedia"&gt;car&lt;/a&gt; is indeed a lemon, the manufacturer will be instructed to pay for the legal fees. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;The Rhode Island lemon law only applies to new cars so if you can’t argue this if you are driving an old car. Will you be able to tell at once if your car is a lemon? The answer is no because this is something you will know in time when you are already behind the wheel and get the chance to drive it.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;If a problem appears, take note of it and keep track if it happens again. Remember, one instance is not enough to tell you that your car is a lemon. If you happen to own a towable recreational vehicle, it must first be titled and registered in Texas to be eligible.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Your used vehicle may also be covered under the Lemon Law if it is still within the manufacturer’s original warranty and not an extended service &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Contract" title="Contract" rel="wikipedia"&gt;contract&lt;/a&gt; or if the problem started while it was still under warranty and it continues to exist.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;To know if the Texas lemon law is applicable, your vehicle must meet certain conditions. The vehicle must have an abnormal condition or serious defect, the defect is covered by the manufacturer’s warranty, the defect is reported to the dealer during the warranty term, you must give the manufacturer a letter stating the problem and ample time to repair the problem and the problem still persists after everything was done. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;There is nothing in the lemon law that states the number of times that the customer has to wait before filing a complaint. For many, four times seems to be sufficient. This may happen two times to repair the same problem of defect within the first 12 months or 12,000 miles whichever comes first or twice more during the 12 months or 12,000 miles after the second repair was done without any improvement. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Some will tell you to undergo the serious &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Occupational_safety_and_health" title="Occupational safety and health" rel="wikipedia"&gt;safety hazard&lt;/a&gt; test where the vehicle in question was once brought into the shop during the first 12 months or 12,000 miles whichever comes first and once during the 12 months or 12,000 miles after the first repair attempt. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;The Texas lemon law may also apply if the vehicle has been out of service for a total of 30 days or more during the first 24 months or 24,000 miles and there were at least two repair attempts during the first 12 months of 12,000 miles after this was delivered to you with no changes in the vehicle’s condition. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;If you happen to experience one of these three scenarios, you must file your Lemon law complaint as soon as possible so the Motor Vehicle Board will be able to help you.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;A hearing will be conducted and before going in, be sure to prepare all the necessary documents so you can prove your case in front of the &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Administrative_law" title="Administrative law" rel="wikipedia"&gt;Administrative law&lt;/a&gt; judge. You should present your own testimony since you are the owner of the vehicle, the testimony of witnesses, receipts, letters and other documents which are needed. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;A decision with regards to your case will be made within 150 days after receiving the complaint and paying for the filing fee. To better understand the Pennsylvania Lemon Law, we have outlined the important aspects of it that every car owner should be familiar with.&lt;/p&gt;&lt;p&gt;1. Pennsylvania Lemon Law covers all new cars that were purchased in the state of Pennsylvania. The vehicle must have a Pennsylvania &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Vehicle_registration_plate" title="Vehicle registration plate" rel="wikipedia"&gt;license plate&lt;/a&gt;.&lt;/p&gt;&lt;p&gt;2. The Pennsylvania Lemon Law only covers vehicles that were purchased for personal or family use. Vehicles purchased for commercial purposes are not covered by the Pennsylvania Lemon Law.&lt;/p&gt;&lt;p&gt;3. All covered vehicles must have a maximum &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Seating_capacity" title="Seating capacity" rel="wikipedia"&gt;seating capacity&lt;/a&gt; of 15 individuals. Larger vehicles are not covered by the Pennsylvania Lemon Law. In addition, motorbikes, trailers, and other recreational vehicles are not covered by the law.&lt;/p&gt;&lt;p&gt;4. Pennsylvania Lemon Law states that repairs to particularly defective vehicles must be performed by the vehicle maker within 12,000 miles, or 12 months of purchase, or the period of time specified in the original warranty. All repairs must be shouldered by the manufacturer.&lt;/p&gt;&lt;p&gt;5. The Pennsylvania Lemon Law gives the manufacturer a total of 3 opportunities to fix the vehicle. If all these tries failed, or if your car has been under repair for more than 30 days, the Pennsylvania Lemon Law obliges the manufacturer to grant you a prorated refund, based on your mileage, or give you a replacement vehicle of comparable value.&lt;/p&gt;&lt;p&gt;6. According to Pennsylvania Lemon Law, you must have your car repaired only at authorized service centers. Vehicles that have been repaired at unauthorized shops will not be covered by the Pennsylvania Lemon Law.&lt;/p&gt;&lt;p&gt;7. Pennsylvania Lemon Law states that the costs for repairs and towing services are to be shouldered by the manufacturer.&lt;/p&gt;&lt;p&gt;8. Pennsylvania Lemon Law does not cover defects resulting from the owner's negligence or misuse of the vehicle.&lt;/p&gt;&lt;p&gt;9. Pennsylvania Lemon Law prohibits returned defective cars from being resold in the market, unless they have passed the state's standards. This is another way that the Pennsylvania Lemon Law protects our &lt;a class="zem_slink" href="http://en.wikipedia.org/wiki/Consumer_protection" title="Consumer protection" rel="wikipedia"&gt;consumer rights&lt;/a&gt;.&lt;/p&gt;&lt;p&gt;10.
