Family Justice Review : My Version!

This Autumn The Ministry of Justice in London will publish its findings of the Family Justice Review to which I participated as part of the Partners Group who has contributed to this enquiry for the past 18 months. I have already detected a number of shortfalls, therefore I have set out my Version of how it should read from my first hand experience at entering Family Court in March 2004. My contact with Family Court Judges, Solicitors, Barristers, CAFCASS, Social Services and Police ultimately to the CSA and above all the impact this has on my Children for when this should have been ‘in their best interest’. Instead what I witnessed between March and October 2004 ranged from inconsistency to outright corruption. Therefore I embarked on what has become almost 8 years of research worldwide within input right across the United States, Canada, New Zealand, Australia, Singapore, Greece and a number of European Countries. I have converted my findings into a frank and honest Blog and I regard this Blog as the defining culmination by this reluctant campaign.
I hope that any shortfall in the Ministry of Justice version on the Family Justice Review can be made up from my contribution here and both could lead to this God awful law being reformed!
C.S.A./CAFCASS: For me The Coalition Government could make immediate savings by disbanding both of these ineffectual organisations, neither have a place in Family Justice as I will show in the following paragraphs:-

SOCIAL SERVICES: I believe Social Services has no place in Family Court (they are ill-equipped) and rather like CAFCASS will offer the Family Judge a snapshot and spurious testimony to which a Judge feels duty bound to apply, making CAFCASS and Social Services his scapegoat for the future, to offer irreversible orders to whom nobody beyond that Judge can scrutinise.

Social Services should only be called upon in the case where there is a ‘History’ of Violence or Abuse prior to a couple coming to Court NOT as a weapon of false allegations once they have arrived at Court. Social Services should be left to concentrate on Child Welfare so Horror Stories, such as Baby P, Victoria Climbie and Khyra Ishaq are reduced.

FAMILY COURT JUDGE: Of the 6 or so Judges I came before most were reasoned balanced people who even if I regard their view as against me I saw the reasoning behind it. I did however come before one patronising and biased Judge who seemed to perpetuate premise of Single Parenting and by strange coincidence at this time I read an article that said Ambitious Judges who go against the Father have greater chance of promotion and so was the case here. This D.J. reserved my case for her sole consideration but was made up to H.H.J. during the process so failed to appear at the final hearing, instead a fellow D.J. whom I regarded as her ‘Lacky’ sat in and just went along with the biased Judges’ rhetoric.

Closed Court precludes any balance analysis of proceedings and when Jack Straw as our one time Justice Minister attempted to ‘Open’ the Court, he was met by derision by the very Judges who should have been called to account. Camilla Cavendish, who won an award for her Family Law column in The Times, was one of the first Journalists to be invited into Family Court in Ipswich and it was clear to me that at that time the same safeguards put in place for sensitive criminal cases could apply to Civil Laws, i.e. Child A, Family XYZ or even a serial number Journalists could refer to a case when given out to news of Parliament.

Judges either willingly or otherwise collude with Barristers and Solicitors in perpetuating this corruption where financial gain can be achieved by their Court, rarely do they benefit either party, least of all the children involved and due to the closed nature of these Courts there is no accountability (if you appeal is it likely one Judge will contradict another).
Money is the fuel to injustice and closed courts hide this fact from public scrutiny!
BARRISTERS AND SOLICITORS: The moment a couple steps into the Family Solicitors office they are perpetual conflict and whilst some Solicitors claim to offer Arbitration services (mine and my ex-partners did not), this goes against the grain of what they want to do, which insures they plunder the Legal Aid system for Mum whilst rendering Dad bankrupt with no regard to the Child’s welfare as they are supposed to subscribe to in Court. The Barristers take a similar line, I spent an entire duration debating the safety of allowing my Children to ride on their Go-Karts near the Road and the last 2 minutes for me to be told to leave the Family Home! All Smoke and Mirrors I’m afraid which because claimants should they want to perpetuate false allegations, which on one occasion for me was that I was an alcoholic (in fact I drink less alcohol in a year than some do in one weekend) spurious as in fact at the time I was employed to drive 40 tonne trucks for Salisbury’s, Tesco and M & S, I doubt if these would have allowed such a person to take charge of a £100,000 vehicle and Loads of a similar value.
The Law Society, or whatever they call themselves these days, cannot make a complaint against a firm of Solicitors for fear of being sued, they do not have the teeth to regulate as they should!
GRANDPARENTS: At the beginning of June this year I read a copy of The Mature Times and was dismayed to learn that the Family Justice Review did not see the merit in giving Grandparents rights of contact with their Grandchildren. I am of the view that when Parents maybe in dispute and possibly separating, who better to offer stability and continuity to children than Grandparents or other Family Members where appropriate.( Thanks Sir Bob).
Surely this would be better then Social services making their trademark snap-shot appraisals that all too often can result in children ending up in irreversible care. The very people who Social Services and family court should be serving , the children end up living a life full on the regrets instilled by this very system. I have an example of a case where a parents dogs often barked, it turned out they had kennels so the RSPCA were called but no problems were found none the less the Social Services got wind inspected the home and an 8 year old girl was put into irreversible care even when it was later proved there was no problems here either!

Police: The police have no role to play in family (civil) law as they can only deal with criminal law but it does illustrate the starkest discrimination the law has to offer.
In my case the initial court order allowed contact with my children to take place via the schools so as to avoid conflict with the mother we would each collect and return them to school at our contact times and this worked fine for over one year.Sadly , and with the help of the biased judge contact was changed so it had to take place outside the former family home. So as per the revised court order I would show up at the prescribed time and place ready to take my sons on for the evening or weekend etc, but then the mother would start withholding the youngest which caused more problems when it later turned out she was bribing him to stay whilst my eldest was almost penalised for coming with me. When I objected to my son being with held, ( he was always pleased to see me after school) the police would be called and in spite of me waving my court order almost Chamberlain style they were unable to enforce it on the mother but were happy to arrest me for breaching the peace if I did not leave confusing the old boy so by 2007 he to was with held and to this date I have not had any of the Court appointed contact and all the police will say is take the mater back to court, what is the point? Mothers are regarded as ‘civil’ whilst Fathers are seen as criminal!

Childhood is such a short span of time we should protect it at all costs!

Children: Children in all walks of life have been given rights in order to protect them and this is right and proper.Except, I believe, between the ages of 11 and 16 where I feel Parental responsibility should not be overruled by a child’s right when all to often they are too young to reason the ramifications. It cannot be right that a child can sue a parent for a relatively minor dispute or indeed be allowed to make false allegations just ask the teacher too!
However in the sacred secret world of Family Court who’s continued rhetoric is ” in the children’s best interest!” seldom allow the children to be heard and all the judge has to work with is a contrived interpretation from a court reporter (SS or CAFCASS) where mother has been the dominating force so the children end up acting on her will not what they truly want which in most cases is to see as much of both parents as possible in spite of separation!
I will go into this more in the paragraph headed The Process further on. I do however believe that children who reach secondary school age should be given the right to alter a court order as their live will become more flexible in their teens and they may just wish o pop in and see either parent at odd times and should not be constrained by an order designed to show them routine and stability in their younger years. Also there may be times a child wants to play football and have dad there during mum’s contact and mum may want to take them to the cinema during dads contact this should be agreed amicably and not by seeking to score points off each other or try to show one parent in a better light then the other. Mothers should no longer be seen as the resident parent and father as the absent one, they should be equal in their parental responsibilities.

PARENTAL RESPONSIBILITY: The most important role a person can have in life is that of a Parent. We all come to it with trepidation and rely on our Parents’ experience to handle the initial ‘shock’, but by the time a second child comes along skills are gained and we feel more relaxed, but nonetheless most parents will still have their childrens’ best interests at heart.
One of my children had a soft nature so would cry or object to the slightest thing when young. My other Son was more robust and would walk in with blood dripping from his knee from a football injury but would say nothing. As a caring Dad I would apply the same level of care to both children just in case.

I would link PR to equal Parenting, both Parents would appear on the Birth Certificate should be subjected in law to being responsible for their Child’s Welfare to the age of 18 or leaving home/full time education. Not only in the case of nurturing, education, feeding and home security but as a child gets older and is capable of breaking the law whilst their age all to often enables them to be immune from the law and at such times I believe the Parents (BOTH) should be liable for Fines, Reparation even imprisonment in the case of a Child committing a serious offence such as Rape or Murder.

This I believe would focus the minds of Parents from the start (and maybe would be under age Parents) that it is down to them to make the best effort to do the right thing for their children and not to enter into such an undertaking without considering such facts that could lead to legal ramifications.

I would give credit to much of my opinions on child welfare to Shaun Bailey. He is a wise head on young shoulders and certainly inspires me, I just wish others would listen to this quietly spoken champion of the young!
Education:
As a Sub-Heading to this paragraph I would seek to align School with a remit of PR. We entrust Teachers with the care and welfare of our Children for a larger part of their childhood than we see them ourselves so in respect to the Teachers and our responsibility as Parents we should share the task of instilling morals, respect and responsibility onto young minds. Children should be controlled and disciplined when needed by Parents and equally by Teachers. I would also suggest this points to the Education fraternity.

1.Children to be monitored throughout their Primary years including Pre-School and a Report drawn up in the Final Year of Primary School that outlines an individuals’ potential, so that any shortfalls are clearly identified before they move onto Secondary Education and endeavours are made to eradicate such shortfalls before the end of Year 6.
2.Year 6 should be seen as a preparatory year in readiness for what the Child will have to face at Secondary School and to be aware of Peer pressure, Media pressure, the importance of what they can attain from an appropriate Education, Legal Studies, so rights and ramifications can be investigated then finally Sex Education, as by age 11 children would have some understanding today.
3.A true appraisal of an individuals’ ability assessed, so those who excel in academia can follow that route. Those who do not, should be encouraged in aspects they do excel at, such as, Sports, Arts, Music etc and so long as they are supported in the basics of Reading and Writing, should from Year 7 be directed toward vocational training so they can learn Skills and Trades more appropriate to their ability.
4.National Service seems to carry some form of stigma who went through it in the Post War Years. I would however, advocate those children who seek to leave School without Qualification at the earliest leaving date, should be made aware they will only be eligible for Benefit which will only be paid by attending some form of apprenticeship or Further Education culminating in the completion within a minimum 3 Year Course, that they will then leave with a recognised Qualification or Vocational Skill, otherwise the previous 3 year benefit payment will be refundable to the Educational Authority.
It is important that we start now as this proposal will take at least a generation to come through in real terms and a better attitude will emerge by those given this opportunity as our Citizens of the future.
The last question asked on the M.O.J enquiry was ” What question should we have asked?” I offered the suggestion that the number of suicides attributed to failing Family Courts and CSA worldwide should be considered!

THE PROCESS: FAMILY JUSTICE REFORMED: Separating Parents should BOTH be eligible for £500 in Legal Aid so as to arrive at a conciliatory process for the ultimate benefit and security of the children and should submit their claims simultaneously to an Arbitration Service such as ACAS for a jointly agreed order referring to:-

Shared Care
Parental Responsibility
Contact (Reviewable when a Child reaches Age11)
Residency
Financial Settlement and Maintenance
This Contract should be binding and presented to a Senior Judge who will also confirm this is Legal and Binding and up to both parties to ensure it works otherwise it is enforceable on each Parent.

Solicitors and Barristers would not be required at this stage as there would be no disputes and therefore would not need to be perpetuated.

Social Services and CAFCASS need not apply, unless there is a history of Violence, Abuse or threat to the Childrens’ Welfare by EITHER Parent. If the Judge has any concerns he should have access to the Familys’ Medical history and thereafter order an investigation so as to prevent false allegations arising at point of separation.

Once it is made clear that this order is binding and enforceable on BOTH Parents, should they wish to return matters to Court it will have to be at the individuals’ own expense as no future Legal Aid will be available and this should focus minds by all concerned to get it right first time.
I have sought to remove the financial incentives and conflict from the Family Court so there would be very rare need for Solicitors, Barristers and social services there!
Grandparents should also have rights of access after separation, but where possible to have access to coincide with the Parents Contact, but above all to be there to show support, stability and continuity to very young children.

Childrens’ Schooling should not be disrupted and both Parents should stay in close contact with the School as often as possible.

Parents should also keep the Children with the same Family GP and notify each other of any concerns that may occur during their respective contact times.

What would Dad have made of all this?

My late father would have been 90 today! Having sat in the rear gunner turret of the Lancaster 'Just Jane ' in a Lincolnshire farm yard,
looking out onto rainy open fields a few years ago, I wondered just just how he must have felt doing it for real almost 70 years earlier, already 200 miles from home and about to set off into the black skies over Germany and at the age of just 23 how could he contain such fear?

As part of Squadron35 Pathfinder group he would have be among the first crews to leave, later the same squadron was ear marked for the Tiger Force destined for Japan, but the Americans dropping the atom bomb meant he was spared this having survived numerous raids over Nazi Germany, instead the freshly painted white Lancaster's of his Squadron where given the honour of 'Goodwill tour' of the USA in recognition of that countries contribution to the war. I was dismayed when our Lame-Duck prime Minister claimed to an equally Lame - Duck US president that we were junior partners in the second world war. (Click on this blogs title to see the response from the PM to my complaint to this comment). I doubt if my father his Australian pilot Bob Newbiggin, his fellow crews from New Zealand, Canada, Poland and Singapore, as well the gallant day light raider from the USAF would have considered any of them as junior partners. Bomber Command lost 56,000 in night time sorties whilst the USAF lost over 44,000 in their day light raids. All this was done n the name of our freedoms, our right to vote and the democracy we all too often take for granted today!

We were denied the right of a vote on the EU referendum this week yet the majority of UK citizens want it, and whilst the capitalist protesters have closed St. Paul's for the first time since WW2 and before, I would appeal to them that no matter how just they feel their call is please make way this November to allow those who have made the ultimate sacrifice for our freedoms to be remembered with dignity, it is the authorities who are at fault not the common people!

Blundering Cameron also set out an assault on so called 'absent' fathers' on fathers day in June seeking to align them with drink-drivers! Well as a professional HGV driver of 35 years who has been alienated from his sons ages 15 and 12 for the past 4 years by the very system he and his ministers are content to preside over,in spite of wide ranging corruption at many levels I must object. Once again I have had a 4 page explanation from the Ministry of Justice giving the PM's view and indeed the Governments ethos on Family Justice and I will probably publish this before 5th November 2011.

So on the 5th November 2011 some 67 years after my dad was carrying out exercises over RAF Bottesford, I will be standing at Churchill's feet in Parliament Square, London with my banner saying enough is enough of this and justice must prevail, and unlike the capitalist protesters I know exactly what I am demanding; Justice in the family Court, and its affiliated agencies and equality in parenting so we can at last see JUSTICE4CHILDREN here in the UK and around the world!

World Focus (5th Nov) London!

Remember remember the 5th of November, Gunpowder, treason and plot..........
The Family Justice Review currently being looked at by the Ministry of Justice in London is due to be published shortly ( this Autumn) Whilst I believe chairman David Norgrove is acting in good faith and is truly seeking justice in the murky world of family Law, I believe the Government's motives are merely cost saving!
I have contributed to this review for over one year now both the 5 questionnaire and the more forthright 32 question version including the last question which was what question should we have ask ( which I felt was quite impressive ) and I used the opportunity to raise the issue of suicides as a result of CSA and Family court injustice.

Whilst I did tell fellow campaigners to give this a chance when they were describing it as a fudge , I have to say early aces to some of the views expressed by David Norgrove and his team are a little disappointing;

David Norgrove expressed his thanks for the cooperation by the so called legal professional, whilst Family Court Judges rely too heavily on spurious snap-shot testimony by CAFCASS or other Social services Court reporters with irreversible damaging consequences!

Solicitors and Barristers seek to agitate already tense situations so they can plunder the legal aid budget and render dads bankrupt , there is very little chance of conciliation here!

Mr. Norgrove has already ruled out giving more rights to Grandparents when it seem commonsense that in many cases where parents are in disputed the best way to show children a continuity in their life style must be (where possible) through access to Grandparents or other extended family members I hope the panel will reconsider this one!

I was pleased to see that the Review wants to give children more say the only area of their rights where they are ignored are the secretive Family Courts and whilst I hope this does not prove to be a gimmick, it is time children certainly 10 years and up should have a say in their futures!

I would hope the BBC Question Time programme or similar would have a dedicated debate to this review and include interested parties included the Justice Minister, DWP Minister, Erin Pizzey, Sir Bob Geldof, John Hemming MP among others!

.....If we have anything to do with it family injustice will STOP!

This week presents some challenges for me, in addition to the 19th being 4 years to the day my sons went AWOL, I will have the regret of those lost years for the rest of my life and regret I would not wish on my children, when the blame lies on just one person! At this point I would like to pay tribute to my friend Wee Cheng in Singapore who has raised awareness of Parental Alienation more then anyone else I know and I hope he and I and others will find peace of mind one day!

I was also expected to attend one of three court appearances with the CSA on 21st, but having been given 3 times and 3 locations it transpires the location close to my home was not changed and it remained in Norwich some 2+ hours drive away, so at the 11th hour have to hope I will not be recorded as missing but prepared to be seen another day, just one more episode in the smoke and mirrors world of the CSA!

And to cap it all I will be 53 this Friday Ho Hum, lets make some noise that day and get the media on side!!

I hope the party conference season will not become a good time to publish bad news from the Family Justice Review, and it goes unnoticed!!

Family Justice Review : PROTEST!

I would call upon all like minded folk to follow the many Family Justice, Child Welfare, Social Services, Grandparents and CSA groups and protest at Parliament Square London over the weekend of the 4th to 7th November 2011.

Last time I parked my van at the feet of Churchill I received a £120 fine for congestion charge

This for me represents our civil rights march of the 21st Century, and unlike our 406 years of celebrating failure (an English thing) lets get it right this time and get our message across to the heart of Government through protest and in the meantime bombard their lackey's, the media and news organisations, with our message loud and clear!

Short of declaring US diplomatic immunity ,I wonder what our war time leader would have made of constraints on entering our capital city when he had fought for freedom of speech!

It may seem a little disingenuous to protest when the Family Justice Review has yet to be published, and may still be by that day, but early revelations show it is likely , as many campaigner have said , to be a fudge or whitewash, just to appease those who want to see something being done.

Those of us who have been oppressed by these draconian laws for too long will want to see a more robust approach and society as a whole will need to see evidence of action being taken at grass roots level to show enforcement of parental responsibilities for the young still at school through to those of an age when they participate in riots. We have been forced to remain silent......till NOW!

Ministers Content To Preside Over Corruption!

Lord Justice the Rt. Hon Ken Clarke MP has done about as much as his predecessors, Lord Falconer and Lord Straw, in Family Justice Reform...a big fat ZERO!

The Rt Hon Dominic Grieve QC MP, serves as our Attorney-General, and who, I am told, will not consider individual cases, so whilst he saw fit to intervene in the case of Chris Jefferies who appeared to be 'Tried by media' over the Jo Yeate's murder in Bristol last Christmas, he fails to see the merit of asking why so many dads are going to prison simply for being a DAD!

The Rt Hon Iain Duncan-Smith MP has shown some pragmatic thinking when it comes to our family values in the modern age, yet he is still content to preside over an organisation (CSA) with in his DWP remit that goes beyond normal conventions of recognised law and are prepared to act in a way akin to the former KGB and Gestapo in their tactics!

The Rt. Hon Michael Gove MP who, as Children's Minister, was prepared to speak on behalf of the Home Secretary in the wake of the recent riots in England last month with his characteristic robust manner, although he still seems more then content to maintain the Status Quo established by the last Government over children's services and our failing social services.

The one thing his predecessor, Ed Balls MP, got right during his tenure in this office was to sack a failing Children's services director for her negligence.

If he as own of our law makers from the Upper house is unable, or is it unwilling to put this law right who does he expect will? Lord Justice's Ward, Wall and Woolf should also seek to disband the appalling CAFCASS too whilst they are at it!

So what of the so called legal professionals? Barristers and Solicitors who are content to plunder the legal aid purse for Mum whilst rendering Dad bankrupt. Just how is this serving the best interest of the children? History tells us that Adolf Hitler came up with the slogan of In the best interest of the children knowing everyone will follow in the belief it was true, in family court it most certainly is NOT!

Well all we have to look ahead to is the publication of the Family Justice Review in the coming weeks, but things already do not bode well. Interim reports from it's Author David Norgrove show he is more then content to complement the legal professionals for their submissions to his call, whilst they are plundering legal aid and failing our children on a daily basis! It is time they all had a wake up call! I am also disappointed that Mr. Norgrove cannot see the merit of giving Grandparents parental rights, especially at a time their own children could be having problems. I have long been inspired by the dignity and resolve of my friend Wee Cheng in Singapore.

I wish I had his stamina to promote the case for Parental Alienation Awareness as he has across the world, especially as I arrive at my forth year to the day (19th September) since my 2 sons were willfully withheld by their mother. Now aged 12 and 15 I will never recapture those lost years at a time most crucial for a Dad to be with his kids especially in these days of massive peer and media pressure, and my anticipated regret that I may never rekindle any form of meaningful relationship with them again. I only hope and pray they never have the life of regret I surely will because of the actions of one person condoned by an appalling system!

There are many great organisations around the world who highlight the plight of children taken from a traditional family setting and deprived contact with the 'non resident' parent, most often the Dad but also on occasion Mum. The law seems to discriminated between good and bad parents and conversely benefits the bad parents where good parents try to normalise the situation as much as possible!

http://www.paawareness.org/Whilst the corrupt systems from around the world allows for a vengeful mother to use her children as tools, weapons or bargaining chips for their own self serving financial gains Parental Alienating will thrive and appears to be actively condoned by Family Court , so called child welfare organisations and in time the public as a whole. Extended family are swept up in it so whilst one family benefits from regular visitations grandparents uncles and aunts from the alienated family do not! Police, schools and other public bodies tend to take the side of the alienating family as doubt is cast on the integrity of the alienated family who never get to prove their case.

So when people are scathing about feckless and runaway dads firstly consider those of us who are branded as 'absent' when as in my case I would have loved to have been prime carer as I wanted the best I could do for my children. At the same time consider the mothers (in the main) who deliberately set out to have children, then gain all the benefits the state has to offer including limit less legal aid when it all inevitably goes wrong and then how the courts and CSA actively encourage this behaviour allowing the mothers case to be taken as read whilst the father is seldom heard. The Mother could win a million on the lottery but the CSA will still purse a father to the point of him living on a park bench or.......Suicide!

I have the prospect this month of 'celebrating' 4 years of Parental Alienation on the 19th,the last time I had meaningful contact with my children in spite of court orders allowing regular access. On the 21st I have been summoned to court for CSA arrears in spite of the process sending me bankrupt and unlikely to recover anytime soon whilst the mother walks a way with the former family home sold to the tune of £240,000 for her. I am left with difficulty paying a premium mortgage on a second family home provided for on truck driver wages close to the former one and both schools! All this I did in the true best interest of my children, yet I could face Jail!

On the 23rd September I arrive at my 53rd Birthday!

I have contacted the Attorney- General and ask him to consider the injustice I have incurred over the past 7 years but once again he has deferred this to the Ministry of Justice. I had hoped he would also consider the plight of Dave Hawksworth as he seems more interested in high profile cases as with the support he offered to Chris Jefferey's who appeared to face trial by media last December over the Jo Yeates murder in the city at Christmas.

To this end I call on the BBC to broadcast a special edition to coincide with the forthcoming Family Justice review due for publication this autumn. I would hope to see contributions not only from the Reviews chairman, David Norgrove but also Shaun Bailey, John Hemming MP, Lynne Featherstone MP. Camilla Cavendish Times journalist, Iain Duncan Smith DWP minister, Lord Justice Ward, Ken Clarke,Jack Straw and London Mayor Boris Johnson, Even Sir Bob;
together they could hold the key to solving this burning issue!

What hope I ask when our eminent Law Lord complains of injustice himself in The Times on 1st May 2008 and again in Bristol in 2009 yet as a law maker surely he has the power to fix it?
The ineffectual Lord Justice Falconer did nothing to advance the reform of family justice, Jack Straw did not enforce his open court policy for fear he may offend the very judges that needed scrutiny, and Ken Clarke who was seen napping during the PM's speech following the riots still remains oblivious to the problem.

I truly hope the publication of the forthcoming review does not prove to be the fudge many of us are expecting!

The Prime Minister's words on Thursday condemning the riots and putting robust measures in place to deal with the aftermath in London then other parts of England does not go far enough to prevent such an uprising occurring again.

( Is that the Justice Minister asleep as the PM speaks?)

You may need to enforce parental responsibility and be aware that all too often the rights designed to protect children especially within the legal grey area between the ages 11 to 16 will undermine PR giving children to act in a manner they a rarely mature enough to understand the long term ramifications on their own lives. This also gives cause for concern in the classroom where a teacher has to tread carefully with any form of reprimand whilst the kids are free to abuse the adult with impunity. Is it therefore any wonder many have little or no regard for the law or the police who have to enforce it? If parents where made to be responsible for their children's actions in the form of fines or even imprisonment until they were 18 or leaving home, wouldn't this make them think twice of firstly having children when they are often still children themselves, and secondary make them more considerate in ensuring their children do learn right from wrong and the true meaning of respect from an early age, and not the street cred version!

David Cameron made some ill timed remarks on Father's Day seeking to ostrasise Dads further then they have been already,being discibed as absent, feckless of runaway when more often then not it is the very system that alienates many fathers from their children.

Nick Clegg said on the Nick Ferrari LBC Breakfast show he saw no coralation between the riots of this past week and the Governments policy of reducing police numbers. It would appear the deputy Prime Minister needs an education in common sense as anyone can see if you cut back front line officers you pave the way to lawlessness and he went on to suggest if you wish to protest you are welcome to attend Parliament Square in a law abiding manner.

Well I did ( and called Nick Ferrari and Vanessa Feltz to tell them) that I had parked my van in the late Brian Haw's spot in part as tribute to him , and sat there eating my Mcdonalds breakfast, but before long I had my details taken and was moved on I even coped for a congestion charge penelty for not leaving London early enough! (£120 fine, I have 36p in my account!)

It is time this Government and others wake up and smell the coffee as if the current Family Justice Review being carried out by David Norgrove at the Ministry of Justice proves to be the fudge many campaigners believe it will prove to be, then the malise generated by the Ministry of Justice will encourage mob Rule and Jeremy Kyle fodder will reign supreme!

If my experience of Family Court injustice is replicated in every town, in every county here in the UK, and then throughout the world is it any wonder why society as a whole is imploding on it's self, the terrorist from with in you might call it! Daveyone.

Having spent £35,000 in family court to attain a joint residency order, 50/50 contact and shared care agreement, in the knowledge that the mother of my children would never act in a conciliatory way, I went on to provide a second family home just 1/2 mile away and close to both schools. I worked in the belief I was doing what was in my children's best interest by showing them stability and a seamless relationship even after separation from their mother.

Jumping through every hoop the Family Justice system had to offer, I went about arranging flexible working opportunities so I was always able to attended for contact and any school function such as parents evenings, sports days, school plays, etc.The whole process put a great stain on me but nonetheless I did my best until the whole process bankrupted me to the tune of £70,000.

My ex was able to capitalise from this by attaining the former family home for a peppercorn rate whilst I had to rely on early access to a private pension fund to avoid my own home being repossessed. I was advised of both these arrangement in the same days post in 2005.

Today I noted the former family home which was marketed in the local paper/estate agents has now been sold and as this is now mortgage free shall benefit my ex and her new partner to the tune of £240,000 whilst the CSA continues to purse me for £7,000 in back payments. They fail to consider all the expenditure I have encured over the past 7 years or indeed the fact my ex has wilfully withheld my children for almost 4 years knowing this rates her as a single parent with sole care and can make the most of all the system has to offer in legal aid and CSA support. I once again stand to lose my home and few possessions!

Whilst responding to the Mail on Sunday lead story 17/7/11 Clares Law, I would acknowledge there has to be safeguards in place when taking a chance of meeting someone through the Internet, but commonsense should prevail in any situation for an experienced adult and even more rigorously for children, however this may be seen to undermine their human rights. Safety and parental responsibility should overrule this in such cases.

I can also understand the outcry for a new law that would follow such a heinous crime, but this should not solely be aimed at violent men!

I had hope with the demise of the Labour Government a more pragmatic approach would be adopted by this Tory lead coalition but it seems clear that from David Cameron's attack on so called absent dads on father's day there will be more feminist biased as purveyed by messers Harman, Greer and Blears..
What I object to is the biased leaning of Clare's Law, would it be possible with our overstretched cops to provide such information on violent men or as I would advocate on women too, after all in this age of equality, George Orwell's or otherwise, it should be the case!
Why? Well my indirect findings from 7 years research in the Family Justice system here in the UK and globally has shown that just as many women commit violence on men as the stereotypical man does this most often in the arena of domestic violence in the confines of the home and what is more I have found more women commit abuse against children then men not only physical by psychological abuse too. This manifests it's self most commonly in the form of Parental Alienation; This is when one parent, (most often the mother), uses here children as weapons, tools or bargaining chips to gain what she wants in Family court, legal aid or CSA. The Father is all too often left helpless and broke.

What happened to a mother's maternal instinct when she is prepared to mess with the short span of time that is child hood.

I contribute to a campaign originated in Australia; National Black Ribbon Day which aims to highlight domestic violence against men and suicides. Staying in Australia some 15,972 men have taken their lives as a result of the unjust system purveyed by the CSA

It is likely that numbers in Canada and the UK are double that and in the USA it is over 100,000 per year where the correlation has been made between returning service personnel coming home to a violent or abusive situation or finding their former partners have left taking children and home with them!I would also warn most vehemently against false allegations.

This too is weapon in a woman's arsenal for her benefit and the authorities will go into overdrive to prove this to be true when it is a spiteful lie that could have a catastrophic out come not only on the man but the family as a whole. Courts lap it up when what started as a regular family argument escalates to even just an item of furniture or some other inanimate object getting broken this too is deemed as violence and you guessed it once again it is the man who will take the wrap even if the woman instigated, provoked or even committed physical violence on this occasion. False allegations also undermine the true cases of violence and no right minded person should condone this practice.

A good day for bad news!

14th July was a tough day for me as it was the 12th Birthday of my youngest son whom the mother has willfully with held since 19th September 2007 (Parental Alienation), so the fact I was able to hand him a birthday card on his way to school ( with my car parked on the obligatory service station with CCTV) was a double edged sword, as I was glad he appeared OK, his school reports suggest he is doing fine as does the knowledge that he and his team mates had won the local under 12's football league this past season. I was also able on that day to wave to my eldest son who at 15 I barely recognise,but I still had to drive away with that deep feeling of loss almost like a hunger in the pit of my stomach. Why ,when I had done all the right things in Family court was I now here in this isolated place?

This morning I heard Yasmin Alibhai-Brown of The Independent suggest to Nick Ferrari on LBC,suggest there were more important news items to discuss then the ongoing 'Good day for bad news' story that is Murdoch! I had to agree as I believe it is now that Family Justice reform should be top of the news agenda and to some degree was heartened by the other Murdoch stable mate The Times that seemed able to question the current role the press has in advising the public and indeed Camilla Cavendish who for many years has written extensively on Family Law asks in the 14th July edition; 'Will this judge really be on the people's side?' Referring to Lord Justice Leverson who is to investigate Murdoch/Hackingate, she goes on to say; If regulation of the press is too tight it will benefit the corrupt and overpowerful - not the ordinary citizens. I say in light of the Murdoch revelations and David Cameron's extreme efforts to bring the complaints against the Press, Police and indeed the Politicians out in the open, I wish he would show such vigor when it comes to Family Justice which for some time I have regarded as the terrorist from within that undermines children, their families and society as a whole!

MPs demand rethink on allowing media into the family courts: planned access "conflicts with child privacy rights"

The Justice Select Committee has concluded that provisions in the Children, Schools and Families Act to allow the media into the family courts should be abolished due to conflict with a child's rights to privacy and to have his or her voice heard before decisions are taken that affect his or her life. The report also warns that legal aid cuts will result in more people going to court without lawyers.

As reported by Francis Gibb in the same days edition of the Times, we now see the very same MPs in the form of Sir Alan Beth MP seeking to censor family courts once again ( Camilla Cavendish was in fact on of the first reporters allowed into a court in Ipswich to reveal it's workings) when there is nothing stopping a judge from putting the same safeguards in place for sensitive family courts as they do in criminal court such as Child A, Child B or Family XYZ and where appropriate a reference number could be issued to the press where regulated issues may be addressed and allowed into the public domain, but the censor really has a more sinister reason as does the whole ethos of these secret courts and that is to protect the failing Family court Judges who all too often are able to use court reporters from CAFCASS or the Social Services as scapegoats when they get is wrong and their final judgements prove irreversible and a disaster for the children and families involved!

I'm writing to let you know that finally after 4 months of sweat, blood and tears, I'm departing for Bali this Tuesday morning to participate in the International Bali triathlon.

As mentioned, I'm extremely grateful, fortunate and humble with the support i've received throughout this crazy journey.

This challenge has served many purposes such as raising funds, exposure to my chosen charity and perhaps self development and I have no regrets.

Family Justice Review:deadline 23rd June 2011: Summery!

I wonder if just a few months is enough to fully consider all the facts relating to this enormous subject,I feel it is such a mammoth task more time may be required and I offer you all my research gleaned over the past 7 years and 3 years of publishing my findings from first hand experiences as well as other people's testimonies.

The misgivings I have uncovered in the family law system not only here in the UK but across the world has ramifications most especially on our young, their families and society as a whole and I hope the endeavours of your review will see it as a matter of urgency that these injustices are addressed and not some cost cutting expediency for this coalition Government. ( I apologise for my cynicism but years at the wrong end of family law will do that to a man!) Many of my contemporaries consider this could just be a fudge or whitewash but after completing the very detailed questionnaires last September feel this review should be given a chance and I was gratified for the final question which read 'what question should we have asked if you feel something has been missed?' to which I replied that I hoped you will consider the number of suicides that take place each year ( In Australia where records are kept 16,000 people have taken their lives through Family Court failure and CSA intimidation since November 2007 ) I would suggest in the UK and Canada the totals are probably double that in the USA it runs into 100,000's where the correlation between returning service personnel who then have to face broken relationships at home is just to much for one man to bear!!

Legal Professionals: There is great incentive for Solicitors and indeed Barristers rather then seek conciliation to cause still further agitation in sensitive matters as they can then make the most of the legal aid budget or rendering a parent, most often the father, bankrupt, all under the watchful scrutiny, of the Judge but of course all behind the secret family court. There is now a call for these judges to be scrutinised and courts to be opened up using the same safeguards as in criminal courts (Child A etc). I know you commended the work of theses so called professionals in your early considerations, but please look again as there is a darker side to this industry then I believe you are aware.
Grandparents: Once again I was dismayed by your early findings which much maline Grandparents.The role of the Grandparents is vital and I believe holds the key to fundamental reform of our failing Family Court system. Why is there such widespread Social Services or CAFCASS intervention in hitherto normal families? Surely if parents are experiencing difficulties the priority in the child's true best interest (not necessary the same as the court mantra wheeled out time and again.) is to keep the children within family care and Grandparents or extended family seems a more prudent and beneficial way to offer children stability then to rely on spurious snap shot reports from strangers which weak judges rely upon for their judgements.Grandparents should be equally responsible as parents in such cases and the law should reflect this.

Police: The Police have no real role in Family law proceedings and will admit as much , they are unable to enforce a court order on a mother who withholds her children in spite of dad standing there with his court orders waving over his head Chamberlain style ( and as much worth as the letter the war time leader was holding then) The Police unable to act will caution such a father that he could be arrested for breaching the peace and should return matters to court, but what for if the court order he has is not worth the paper it is written on?

CAFCASS: In my view should be disbanded as they have become lackeys or scapegoats for judges who can point to their reports when things go wrong, as they all too often do. Rather then rely on Social Services at all the courts should have access to previous family history records from a family doctor, so false allegations that emerge at these sensitive times can swiftly be quashed!

CSA : Should also in my opinion be disbanded as not only has it failed for over 20 years the tactics they employ are little more the draconian which I have likened to Gestapo and KGB as there is no accountability for their Sex discrimination Race discrimination or their breaches of human rights. Financial matters should be settled at court as part of the summing up process and in conjunction with contact and PR agreements.

I hope the Family Justice Review has recognised Parental Alienation which most often happens when the so called resident parents stops the so called absent parent (new name required here) is stopped from enjoying contact with his children ( More often Fathers but on occasion Mothers ) it should be outlawed as the psychological child abuse it is when a parent uses their own children as ransom to attain more money from a father or the system as she will show she is sole parent in spite of court orders to the contrary. Once again something the CSA will accept without the need to purse all the facts!

False allegations of abuse or violence should be dealt with as robustly as the genuine cases they undermine, and again Family GP records should be admissible to court or at least to the judge when it is clear there were no incidents before one parent wants to earn more kudos in this arena.

The solution I have arrived at for sometime and by coincidence a fellow campaigner did in Canada is to make legal aid available to both parties at the outset and one court appearance to be included in that cost. This will then focus minds on both parents doing the right thing for their children including contact arrangements and financial matters there after if a party wishes to return matters to court it has to be at their own expense and only refundable if proven that the alternative parent has not acted appropriately and stiff penalties for either parent who fails to adhere to the letter and spirit of the court order. This should mean no requirement for CAFCASS, SS or CSA intervention as long as the orders until the children reach secondary school age (12) can be enforced.

Family Courts should be opened to press and public scrutiney with the same safeguards in place for sensitive criminal cases but it is the Judges who we need to scrutinised. Once and for all recognise the biased and bigotry that exists in this industry and there should be law that makes both parents equal and responsible for their children in to adult hood. Mothers do not always know best and childhood is such a short span of time, lets get it right in their true best interest!
I rest my case!

Family Justice Review deadline 23rd June 2011: Social Services

Why is so much faith put in Social Services when children are involved in Family Court as when it all goes wrong all they have to do is role out that same old mantra " We will learn from this and move on !" well they do move on but rarely learn from it and even get compensated when they themselves get it wrong, and they in turn act as scapegoats for failing family court judges who can then sight their inaccurate reports as to why they made their (all too often irreversible) judgements!

I wonder why Social Services are called upon to report on fairly mild cases in family law. If there were previous cases of violence or abuse this would be on record as a matter of fact and once again why is it most often assumed it is Dad who is the abuser? In the 7 years I have been researching this subject I have found more women abuse then men and all to often it is the hidden abuse of psychology that a mother will use to 'persude' a child to act in such a way when even a relatively young child knows it to be wrong, but fears going against the resident parent as he/she has to live with that parent daily. The cruelest of abuse is Parental Alienation something Social Services doesn't even recognise yet whilst it allows a vindictive parent to use a child like a tool or even a weapon and at the worst extreme for ransom it is left to the non resident parent to anticipate the regret those children will feel in later life,those lost years in the relatively short span of time that is childhood that can never be replaced.

I believe Courts should have access to past medial records from the family doctor as this would quickly show up the false allegations that arise in family court so one parent may take advantage over another false allegations should also be dealt with as a crime and severe action including prison should be imposed even if it means taking the mother away from the children , she may then realise she is not serving her kids best interest by lying!

What chance have were mere lay people in this corrupted industry, when even those at the head of legal departments in Social Services fail to serve the children's best interest as that of this Council Leader

Family Justice Review deadline 23rd June 2011: Legal Professionals.

At a time when the watchword should be conciliation and balance and maybe just a slight sway toward 'equal' parenting responsibilities this already biased arena will be made more of a battle ground thanks to, rather then in spite of, the legal professional when they become involved!

The Family Solicitors seem able to act with impunity, if you challenge their actions even when working for you there is very little that can be done as I found out to my cost. The law society who are supposed to regulate malpractice in the legal profession are all to often be reluctant to act as they know the solicitor can sue them, whilst there are no punitive measures the legal guardians can take.

Solicitors will agitate matters more so they can plunder the legal aid pot for mum whilst sending dad bankrupt!

Barristers also realise their lifestyles may be enhanced by further conflict so fail to seek conciliation in sensitive family court matters , and why should they at fees in the region of £2000 for a 10 minuet court appearance who would seek to resolve matters when you have a judge ready to lap it all up as they expect and 80% of the time against the dad and 100% not in the best interest of the children involved!

Police are ill equipped to deal with civil matters and are quick to acknowledge this as any action they take will soon move from a mother failing to adhere to a court order but rather seek to arrest dad who happens to have turned up at his prescribed contact time and it is so much easier to arrest him for breach of the peace. Further biased in this industry shows they consider mum civil and dad criminal and once again the need of the children are ignored or more often coerced as they are compelled to say what the resident parent (most often mum) has groomed them to say regardless of fact.

We need civil enforcement officers who are able to act as a go between or mediator but with the teeth to enforce a court order equally on either offending parent not just penalising dad and depriving quality time which could be so essential to the young as they rise through their educational terms and face many dangers, peer and media pressures a reassuring dad should be on hand to say! All this could of course be prevented and big savings made (the true motive for this review rather then seeking justice I fear) and I would invite you to read my views on the final chapter in this series 'Summery' that will appear on the final day of submissions on this blog on Thursday 23rd June 2011.

Family Justice Review deadline 23rd June 2011: Family Court.

When I first entered family Court in March 2004 the presiding judge on the day His Honour judge Hayward-Smith. I wondered what all the fuss was about as I found a judge here who told the opposing Barrister to ".. sit down as it seemed clear to him that in this case it was the father who was seeking to offer stability and maintain a Status Quo for his children in spite of separation!"
It took another 7 months however to attain that status quo in the form of a court order that spelled out in clear terms that having been granted Parental responsibility (a given to all parents on birth certificates since then) both parents should enjoy a joint residency order, shared care agreement and 50/50 access to both children what could be more in the children's best interest then equal access to both parents living in close proximity to each other and equal distance to the schools, certainly till both children were of a mature age, probably at secondary school (present day) to make their own minds up as to which parent to visit on particular days and not so rigid as this order designed to offer routine and stability in their former years. His Honour Judge Vilgeon (who reminded me a little of Leo J Carroll who stared as Mr Waverly in Man from Uncle) summed up the day with what he described as fatherly advice that it was now incumbent on both of us to make this order work, something I was swift to embrace whilst the mother was determined to undermine it form day one in March to that day, 20th October 2004 when she set about unravelling this hard fought for order in the best interest ( I had hoped ) for our children!

From that date to present day the mother, with the aid of a particularly biased judge in the form of Her honour Judge Pearl , unravelled all that work with such insistence that contact, which had been via school collection and return time so as to avoid conflict, now become adjacent to the former family home which was sure to cause conflict. It was like this judge and the so called impartial CAFCASS reporter had become my ex partners own special advisers and whilst I struggled to keep up to her demands as well as legal bill I found the hoops they expected be to jump through became smaller and smaller till it was impossible!
Today in spite of that original order that remains in place the mother has withheld my children for 45 months with impunity and from the perspective of HHJ Pearl actively condoned her Parental Alienation which extends to the extended family, school, doctors police and anyone else who becomes involved, whilst all the time it was meant to offer the children, who I believe most right minded people would agree, stability structure and as near normal family life in their best interest.

I tried to take matters to a further court to have this systematic destruction stopped but it was clear from the out set one judge would not over-rule another, yet this is exactly what Pearl did to Vilgeon and there is no mechanism available to enforce the order on the mother yet when I turned up for contact at the prescribed time and place with my order waved above my head almost Chamberlain style, as with the war time Prime Minister it was not worth the paper it was written on and in fact I was nearly arrested for breach of the peace when it was her not adhering to the letter and principle of what HHJ Vilgeon had offered in 2004.

The advice from the ill informed police was to return matters to court as they saw it as a civil matter as far as the mother was concerned, yet they were quick to try to make Dad a criminal as they can administer this easier themselves.
So my question to Lord Justice Ward and his cronies who bleat on about;
"Vengeful mothers leave good fathers powerless to see child," says judge
who is it but these failing law makers who are expected to put this right and in these times of supposed equality why can't Family Court orders be enforced on both parent rather then just dads? It is time the secrecy that hides the corruption and biased bigotry in these courts be exposed as in any other walk of life they would be regarded as sex discrimination, race discrimination and a breach of fundamental human rights especially against the children who's voices are never heard, yet these hypocrites claim to serve their best interest. If this is the case open the courts to public scrutiny as with criminal courts and in especially sensitive cases the media instructed to describe them as Child A, Child B, Family XYZ or use a press Id code relating to a specific Court orders otherwise this system along with it's accomplices in the form of CSA ,CAFCASS, Social Services and the money greedy legal professionals will continue to act like latter day gestapo of KGB with impunity!

What could be more appropriate for a Father but to defend those he holds most dear? His Children!

I had hoped comments such as those passed by our leader the Rt Hon David Cameron PM this father's Day, were going to be lost in the myths of time following the departure of Messer's Harman and Balls (Both of them, Mr. & Mrs that is). But no the same old rhetoric is being purveyed as this Government clearly sees that there are more votes to be had from single mothers then dads who have done all they can through the courts, as well as trying to retain their sanity and offer normal lifestyles to those they hold most dear, their kids! http://business.timesonline.co.uk/tol/business/law/article3850658.ece

Yet on the whim of a selfish self serving mother the law empowers to enact their vengeance time and again with impunity whilst the father all to often on modest wage is made to pay and pay to the point of ruin just to have some parental responsibility for his kids in a world fraught with danger as well as media and peer pressures. In spite of being jointly responsible for my children, the mother can with hold the children with no chance of redress from the courts, and systematically drip drip poison in their young impressionable minds, as I learned today from school, my son's want nothing to do with me in spite of me receiving a happy Father's day card from my step daughter yesterday, 45 months to the day since I last had any form of contact with my son's. The pain this has inflicted on me I would not wish on any of my fellow man, and yet even in the face of this adversity actions such as returning their cloths, toys and equipment to them in the belief they would soon out grow them or may wish to have them after a few moths absence, was done in good faith by me, whilst the mother will interperate this as " See he doesn't want to know you after all!" God I would give a limb just to see my own father, who would have been the same age as the Duke of Edinburgh, back in my life for just one day, so you can imagine what I would (and have done) for my own sons just a few moments on a football touch line for instance, is that too much to ask?

Mr. Cameron continued his sanctimony by saying how his own father had inspired him,

well I have news for him so did my own father who I am sure would rock in his grave if he was aware that the freedoms that he and many others fought for in the 1940's were now allowing Parental Alienation to become the mainstream of our society and a Government that was puny in opposition , show the same traits now when they should be showing robust leadership on a most fundamental of issues affecting our seldom heard children TODAY!

45 months to the day since my children were wilfully withheld as the Family Law system allows a mother to alienate her children from a loving Father just so she can claim to be a sole carer, and in spite of court orders to the contrary, this kind of injustice must end, how much more anticipated regret has a father got to take for his kids?

Federal Member for Dawson George Christensen attacks the Gillard Labor government's changes to the Family Law Act which will water down provisions giving non-custodial parents (mostly fathers) equal access to their children.

It is right this should find a wider audience and indeed that Australia as well as many other countries in the world undergo similar reviews hopefully leading to reform as in the UK right now , I hope I have done this justice Steve and please take a look at what is occurring on my sister ship by clicking on this blog title!

Family Justice review: Deadline 23rd June 2011 : CAFCASS

CAFCASS (click blog title for more) is in effect court appointed social workers who are instructed to make a snap-shot of your family then make a report with far reaching and long term consequences for your family who may never recover from in a life time.

Although I only had limited contact with this erroneous organisation, I was given the heads up by my McKenzie friend, the late Ian Mackay, spokesperson for Families need Fathers who pointed out that my 'impartial' court reporter, who at my final hearing that lasted from 9:00 am to 4:00pm spent 90% of the time with my ex-partner, had herself an ex-partner who was part of the FNF org. How was her judgement ever going to be balanced, when the main reason being that my barrister was keen to cross examine her?

CAFCASS has become the lackey of poor judges who can point at their reports as an excuse for making the wrong , and all too often irreversible judgements. CAFCASS has become the scapegoat for an already failing system and allows false allegations to have credence in these secret and sinister court rooms.As all that is required by them is to present the required report to expatiate matters swiftly to the judges liking which is more often then not far from just!
All too often they pander to feckless runaway dads who have little regard for their kids and self serving money grabbing mothers who want their own 'rewards' that the children rarely see the benefit of . Meanwhile Good loving Dads are being alienated from their children and undemanding and caring mother are not getting all they are entitled to in support of their children.

"Since the high profile cases such as Baby Peter, Victoria Climbe, and Khyra Ishaq social services have been keen to cover their backs and avoid the chastisement they face when things go wrong and they pretend to learn from it and move on , the trouble is they do not learn, they remain incompetent and out of their depth and as a result great swaths of innocent families are being caught up in their net of lies a deceit"Davey
