Sage Senior Behavioral Health Unit

Cass Regional has partnered with Research Psychiatric Center of Kansas City, Mo., to operate the Sage Senior Behavioral Health Unit (BHU), which specializes in inpatient geriatric-psychiatric health services. The 10-bed unit was established to care for senior adult patients whose psychiatric symptoms have posed significant problems or safety hazards in their home environment. Patients come to the BHU from other long-term care facilities and private homes. Each patient has a personal treatment team to address both psychiatric and physical illnesses, which can often underlie psychiatric symptoms. Families are encouraged to participate in the treatment process.

Sometimes isolated and lonely, when they are unfamiliar with financial matters, the elderly can unfortunately be,easy targets for scammers. The National Center for Prevention of Elder Abuse estimates that these types of financial exploitation scams cost older Americans ore than $2.6 billion per year.

Watch this video as a young woman sits with an older lady in a diner. Onlookers gradually realize she's trying to get her to sign over the deed to her home. When victim goes to the bathroom, the scam artist reports her progress to an accomplice on her cell phone, making clear she is taking advantage of the senior citizen. Will people intervene?

In 2008, National Prearranged Services Inc., a Missouri-based seller of prepaid funeral services, collapsed, leaving about $600 million in unfunded liabilities. In a complaint filed on Aug. 6 in the U.S. District Court for the Eastern District of Missouri, regulators in various states accused company officials of "systematically loot[ing] the cash for their personal enrichment" in part by replacing whole-life polices sold to cover funerals with less-expensive term-life coverage—and pocketing the difference. Indicted on nine felony counts, including mail fraud and money laundering were NPS president Randall Sutton and former office manager Sharon Nekol Province.

Sad but true, unscrupulous sales of pre-paid funerals is a HUGE money maker! Whether the assets weren't there at the end of life, or the family didn't get the services they thought they paid for, or they ended up paying more in insurance premiums than the value of the policies. Prepaid funeral are a good solution for families who find themselves in a position of potentially having no estate to pay funeral expenses. As you should always do before making a large purchase read the "small print" and seek advise if there is something you don't understand.

Recognizing Undue Influence

I have had many questions regarding how to recognize undue influence, and then what to do after recognizing undue influence. First, I highly recommend the following book The corrupt and illegal practices Undue Influence ,helps to educate you further. Also, two free printable checklists addressing these questions are provided, good luck!

CHECKLIST A: Assessing Undue Influence

□    Gifts to persons (caregivers, service providers, friends) who are not the natural objects of the client's bounty

□    Gifts to anyone that are so large, given the size and nature of the client's estate, as to threaten the client's economic security

□    Loans, particularly if undocumented, to anyone; special scrutiny required if to non‑family members

□    Actions by client's fiduciary (attorney-in-fact, trustee, other) that reflect poor judgment or conflict of interest

□    Existence of estate-planning documents naming non‑family members as fiduciaries or beneficiaries

□    Existence of joint accounts with non‑family members

□    Evidence that client signs checks prepared by others

□    Bequest plans or other arrangements favoring one child, particularly if a caregiver

□    Evidence of physical harm (bruises, cuts, etc.)

□    Evidence of excessive dependence on a child or other person, particularly if such other person is critical to the client's independence and/or ability to avoid a nursing home

□    Material inconsistency between client's understanding of estate and its true value

□    Excessive fees charged by professionals (trustees, attorneys, Income tax preparers, stockbrokers, other)

□    Unconscionable terms of loans or other financial arrangements.

CHECKLIST B: What to do after Undue Influence IDENTIFIED

□ Require accountings from prior fiduciaries. Court procedures are available to compel such accountings.

□    Institute conservatorship/guardianship procedures to formalize authority in a third party who will be accountable to the courts.

□    Contact Adult Protective Services (or its equivalent) in the client's community.
[Caveat: Doing so may constitute a breach of confidentiality.]

□    Revoke or amend estate-planning documents that do not comport with client's wishes.

□    Commence civil action against person(s) who take financial advantage of client. Such actions may include elder abuse (in jurisdictions so providing), fraud, negligence misrepresentation, theft and breach of contract.

□    Commence civil action against person(s) who physically abused the client. Such actions may include elder abuse, assault, battery, wrongful death and violation of Patient Bill of Rights (if events occurred in a long term care facility).

□    Remove assets from accounts held jointly with suspected abuser.

□    Involve the police and raise possible criminal charges against abuser.

□    Draft documents (durable power of attourney, trust, other) to effect true, independent wishes of client.

□    Involve social worker, counselor, psychologist or professional geriatric care manager.

□    Involve professional, bonded fiduciary to manage assets for client.

Over five million Americans age 65 and over will be injured, exploited or mistreated by someone on whom they depend this year alone. Most disgusting is that the majority of abusers are family members and close friends.

Some seniors are befriended by con-artists. Some are deceived by bogus sweepstakes, lotteries and telemarketing scams. Some are pressured into making monetary gifts. Many seniors risk losing their homes through unfair or misleading home equity agreements An Age for Justice: Confronting Elder Abuse in America (Universities)or become victims of unscrupulous home repair contractors, trust mills, or peddlers of inappropriate financial products and services.
One of the best books I have read is: How To Stop Elderly Abuse: A Prevention Guidebook, because of it's content. One other book I recommend is: Protecting Yourself From Elder Abuse, no filler, just facts!

What is Undue Influence?

Undue influence is the most subtle type of mistreatment, and therefore the most difficult to detect. Since the elder person is unduly influence through fear, dependence, diminished capacity and other factors, the victim is unlikely to both willing and capable of reporting the abuse.

Many will not even be consciously aware of the undue influence. Here are signs that may indicate undue influence is being exercised over a client. These signs include:

The helper speaks for the client
The helper frequently corrects the client’s answers
The client consistently looks to the helper before answering a question
The client stops or changes an answer after the helper looks at, touches, or makes a movement towards the client
The client repeatedly asks the helper to answer a question for him or her
The helper refuses or is reluctant to allow the client to speak privately with the attorney or paralegal
The client appears confused or influenced by medication or alcohol.
