Waterproofing Company's Employee Injured in Crane Collapse at Fanueil Hall in Boston

An accident in Boston has left an employee of Chapman Waterproofing injured, after a crane holding scaffolding collapsed yesterday.

Fortunately the man was treated for "non-life threatening injuries" at the local hospital.

The Climate Prediction Center of the National Weather Service issued an El Nino Advisory July 9, 2009 for the winter of 2009-2010. El Nino occurs when there are warmer than normal ocean surface temperatures in the Pacific Ocean. Changes in the ocean affect atmosphere and climate patterns and atmosphere changes affect ocean temperatures. It means that this coming winter is predicted to be a rainy one.

I'm repairing some decks at a clients house in Ventura. The other day I stopped in to check on the crew and inspect the job.

Two doors down, a home that just sold ten days ago was being sawn apart...

so curiosity got the better of me and I walked over to see the carnage...

Weak stomach's beware!

So here's this beautiful home, all dry-rotted in the 2 decks...they had tile over a hot mop type waterproofing...which leaks like a sieve, and caused probably a 100k worth of damage.

The cans for the lights in the ceiling are rusted!. The ceiling on the second floor deck is out, blue sky, looking at me...oh what a mess.

Westcoat Just Compltes First Web Broadcast of Their Training In San Diego

So I've been watching a Westcoat web broadcast of a training session on stamping and coatings for concrete...kudo's to them for such a feat. It looked like around 26 people was the high online, they say they had around 60 in attendance so that's a good turnout.

Watching from the comfort of home is nice, but it's also nice to mingle and meet other contractors too. And you miss the nice lunches the manufacturer puts on too...

If they put up a tape/video of the session for others to see that would be cool...other manufcaturer's should take note...marketing is the buzz word now and sitting on your laurels won't get you new leads.

This ad I found on Craigslist is for all you damn stupid fools who want to save a few bucks on your deck waterproofing and fixing leaks...

The clown contractor here is unlicensed and probably uninsured. Liability insurance is not essential when your a hack contractor. Oh and btw, bet they don't have workers comp insurance either. CSLB is going to be running stings looking for cheats on workers comp...

So yes, the clown contractor on craigslist will save you some money up front...just hope no one gets hurt on your property, they usually find that the property owner just became the "de-facto" employer and will order a judgment up against you to pay for the hurt workers medical care, living expenses, taking care of his/her family...that kind of thing, maybe for the rest of their lives.

What else is at risk...oh, no factory support from Dex-O-Tex, they don't have unlicensed contractors authorized to put their prouct down...neither does any other company. Bet this clown goes to Jet Coatings for his materials...they sell to anybody.

What else...Oh, he's using a cell number...yeah you'll be able to find him later on after he cancels that number and moves to another...just send a letter to the address he gave ya!

So, yes, go ahead and call the clown contractor, but no one wants to hear yer crying later on!

Ruling on construction defect claims is criticized

The legal waters swirling around construction defect claims have gotten murkier for both residential and commercial contractors due to a recent decision by the Oregon Court of Appeals.

In Abraham v. T. Henry Construction Inc., et al., a residential construction defect case, the court tried to clarify when a contractor can be sued for negligence. The main issue was the statute of limitations, which is longer for a negligence claim than a breach-of-contract claim.

In a 2003 case, Jones v. Emerald Pacific Homes Inc., the appeals court ruled that an owner who had a contract with a contractor could sue for negligence if the contractor had violated a standard of care that was independent of any contractual duty. This non-contractual duty is called a “special relationship.” In Abraham, the court held that, among other things, a contractor’s responsibility to comply with applicable building codes creates the type of special relationship necessary for a negligence claim, according to a case summary by Portland law firm Stoel Rives.

Eric Grasberger, a Stoel Rives attorney who represents owners, developers, designers and contractors, said that prior to the Abraham decision, owners could make a strong case for the existence of a special relationship because owners must trust contractors to carry out certain “means and methods” of construction.

“You can’t be there to watch them hammer every nail or put every shingle on the roof, so the owner trusts the contractor to do that,” he said.

Generally, negligence claims would go to trial so a jury could determine whether a special relationship existed. The benefit of going to trial is that most cases settle before ever reaching a jury, Grasberger said.
However, the Abraham decision weakens the special relationship argument, a detriment for owners. It also allows owners to file negligence claims based on breaches of state building codes, which could bode badly for contractors, he noted.

“Most defect cases, 90 percent of the time, are water intrusion cases. I don’t think it’s too hard to show a breach of the Oregon uniform building code in most water intrusion cases,” Grasberger said.

MORE LIABILITY FOR HIRING
UNLICENSED CONTRACTORS

A recent decision by the California Court of Appeal reinforces the importance of avoiding unlicensed contractors. If associations hire unlicensed contractors, they could be liable for wage and hour claims filed by employees of the contractor. Although the case involved a general contractor and its subcontractors, associations who hire unlicensed contractors can be deemed a "general contractor" and the unlicensed contractors as "subcontractors." This means that any unpaid workers will be considered employees of the association and the association will be liable for paying those workers, even it the association already paid the contractor. Sanders Construction v. Cerda (2009) 175 Cal.App.4th 430.

RECOMMENDATIONS. Homeowner association boards should verify each contractor's license with the Contractors State License Board. In addition it should get proof of insurance. Boards should also add a provision to their contracts requiring contractors to indemnify the association for any wage and hour claims by its employees.

So often the deciding factor in selecting a waterproofing contractor is price; customers can't decipher the trade jargon on a bid and don't do their due diligence in researching companies before spending their hard earned money...

Someone once said, "You can't spend a little and get a lot." With waterproofing, that's double true...good luck to those unfortunate enough to be watching water pour in their home from a leaky deck that got waterproofed by the cheapest guy; it's about to cost you 10x more than you thought!

Errant Welding Sparks Condo Disaster-Entire Complex Burn Down, Suit Filed

Suit blames welders for Galveston condo fire

GALVESTON - A Galveston homeowners' association blames two businesses for a fire that destroyed its condominium complex in June, recent court documents say.

Maravilla Homeowners' Association claims the misconduct and overall negligence of Adam's Welders and Hudak & Dawson Construction Co. led to a four-alarm fire within the Maravilla Resort Condominiums on Galveston's West End the afternoon of June 3.

"The defendants owed a legal duty to the plaintiff to exercise ordinary care," the lawsuit, filed Oct. 1 in Galveston County District Court, says.

According to the original petition, the defendants were performing construction work at the property.

It adds workers were welding handrails connected to the building, which had been almost fully rebuilt after Hurricane Ike, when some wayward sparks ignited the inferno.

A Galveston County Daily News article on June 4 reported that the blaze spread between the upper floors.

Hey I bet you were so busy this year that as a contractor you didn't evn know that the mechanic's lien law forms have changed!

There's new rules about liens and notifying owners about their property being lien'd. Tell the truth, I was busy too and didn't know, til I read about it in my local Builders Exchange Bulletin.

So last week in my journeys through Thousand Oaks, I went by an HOA I had bid on for some deck work. I wanted to see if the competitor who got the job had started and see if what I predicted (dry-rot and other issues) had come true...

so as I drove through the complex, I didn't see any trucks or other construction related activity, until I rolled around a corner to see the BMW pictured above with the trunk open. I saw someone working on a deck nearby so I stoppe dto see what was up...

Sure enough, this worker is working on the deck, and he's working out of his trunk of his car...with cans of Life Deck in the rear that he had just bought at the store...

I'm ok with Associations hiring companies like this...it assures my future with a hack like this.
