Boston Legal - Episode 5.04 - True Love

Ep. 4 is called True Love, or as I like to call it Twu Wuv.

Looks like we’re in for another high-profile murder trial. This time Alan is defending the accused, a steely, cold man named Robert Brooks who’s the chief cardiologist at a renowned hospital accused of murdering a nurse with whom he carried on a brief affair. Alan seems taken with the defendant’s wife, Phoebe. Despite his high profile, he is denied bail, Judge Beacon noting the sophisticated way in which the death was made to look like a heart attack. She feels Brooks is crafty enough to escape, so she wants him locked up.

Judge Beacon is a no-nonsense type of judge, warning that anyone who tries to turn her courtroom into a circus could be subject to a spanking. This sets off some humming in Denny’s lap, so I can only deduce that he has an apparatus on his penis that is measuring his level of excitement, having just come off all those meds that were causing erectile dysfunction. At one point Alan tells Denny he has to make his penis stop buzzing.

Alan goes to the prison to visit Brooks and the two have a relationship much like dogs circling each other to mark their territory. Brooks tells Alan he had a relationship with the woman for 17 days, but he broke it off due to her emotional instability that started causing distractions at work. He tried to keep his distance, but she was persistent in trying to keep the relationship alive.

A neighbor claims to have seen Brooks’ car in her driveway the night of the murder but Brooks says the neighbor was mistaken. And, as it turns out, Nursy had quite a few cars in her driveway during any given week. If you know what I mean. And I think that you do.

Denny surmises that this will all work out for Alan’s benefit. The client is unlikeable, so the jury will rule against him, freeing up Phoebe for Alan. Alan denies this of course, but Denny seems to think this woman is Alan’s true love.

Nursy’s mom testifies that her daughter was afraid of Brooks because she told him she was going to tell Phoebe that they had resumed the affair. Her daughter told her that Brooks said she would pay for it. That she would be sorry. We sort of get the impression that maybe Phoebe was unaware of the affair resuming, and of course Brooks shakes his head and denies it.

Alan, of course, calls her on this and asks if—as a concerned parent—she did anything about it. He also tries to paint her as a bit of a media hound, loving the attention of giving interviews to talk about her daughter’s case.

During all of this, of course, Alan continues to antagonize the Judge, who whacks her gavel and sets off more of Denny’s buzzing.

The piece de resistance is a damning letter that Alan produces that demonstrates a pretty bad relationship between mother and daughter. There’s testifying from the neighbor, another nurse and the coroner who describes the drug used. Alan doesn’t think Brooks should testify.

In the end…everyone files in for the verdict, except Phoebe. It’s not clear if she’s already left her husband, or if we’re supposed to suspect more foul play. I suspect the leaving husband/leaving town.

Boston Legal - Episode 5.03 - Dances With Wolves

The ep starts out with a bang—literally—when Denny and Jerry are mugged in the parking lot at night. They’re in the middle of a discussion where Jerry is asking Denny to support him for partner this year and Denny is explaining to Jerry that being partner isn’t all it’s cracked up to be. (So I guess Jerry was given a clean slate when he was rehired! Cool.) An African-American man steps out of the shadows and pulls a gun on our boys. Jerry starts to turn over his watch and wallet. Denny – as only Denny can – points out that it’s going to look really bad for a black man to shoot a white big shot just as we’re trying to get a African American elected president. Somehow the guy doesn’t find this argument convincing. So Denny reaches for his watch, reaches for his wallet and—do you see where I’m going with this?—reaches for a gun and shoots the guy in a knee and both feet.

The next day, as Shirley and Alan are asking him if he’s okay two policemen come to Denny’s office to arrest him because he was carrying a concealed weapon. Heh heh. In pure Denny style, he was actually carrying multiple concealed weapons. They removed 3 from him the night of the mugging and 5 the day of the arrest.

Sack defends Denny in the courtroom of the eternally shocked Judge Brown.

Alan is busy with his own case. It seems that his (and Jerry’s) former sex surrogate/counselor Joanna is being sued by her ex-husband for custody of their daughter (age of daughter isn’t clear, but appears to be a pre-teen). Evidently (ex) hubby is very uncomfortable with his daughter growing into some very impressionable years with a mother who sometimes has sex for a living. Ex hubby is represented by our cynical friend, Emma Path.

They put the daughter on the stand, and she’s a pretty cool kid. Judge Stern, who really lives up to her name, is pretty good at keeping Alan in his place and wiping the smirk off his wise-cracking face. I can’t wait to see this chick. Also, in a conversation between Alan and Joanne while they’re waiting to go into court, Joanna tells Alan that the contempt she heard earlier in his voice directed at Emma wasn’t just contempt for another lawyer. It was contempt for a woman. She believes a part of Alan actually hates women. Needless to say, Alan takes umbrage. I’m pretty sure we can expect this to come up on the balcony.

For me, personally, the only cast member I'm concerned about is Sack. I hope he's still with us.

More intel on Phoebe, Alan's former flame
* She's in her 40s
* She's married, with children
* She feels that Alan ran out on their relationship. Which is a nice throwback to what we know about Alan dating back to The Practice, namely...he leaves. So, some nice consistency.
* It's not clear whether she was married when she and Alan were involved. But here's my interpretation: there's a conversation where Alan says that when they were together, all they talked about was fighting for the little guy. So, if they're even remotely trying to keep Alan's past history intact, I'd say that leaves three options. (1) They knew each other in law school when both may have been idealistic. They've both clearly strayed from that ideal at this point, in that Phoebe is representing a big tobacco company and Alan--before joining Young Frutt & Berluti was the top anti-trust attorney in the state,which has little to do with defending the little guy. Or (2) They knew each other while Alan was at YF&B and had his ideals about "the little guy" awakened. That's only 4-5 years ago, which makes Phoebe's marriage and motherhood fairly recent. Which isn't unheard of for a woman in her 40s. Just not as likely. Or (3) She was married and had children when they became involved. But she seems to bear more resentment toward his leaving than I'd think the typical married-woman-having-an-affair might have. If she were childless, it's still probable that she might carry a torch for Alan and regrets their affair came to an end. But I'd guess that most mothers having an affair would just look back on an experience like that as having dodged a bullet and moved on. Women might be willing to ditch a husband/bad marriage for a lover, but they're less likely to risk disrupting a family. Again, JMHO.
* Alan sees Phoebe for the first time on the opening day of the trial, and seeing her totally unnerves him (sorry...too much "shades of Lorraine" for my taste). And she asks him if he's had a nice life. Which again, makes me think she's from his far past as opposed to his recent past. And an aside here: seriously, in these big trials--like one against a tobacco company--don't both law firms know who is representing in court? I mean, there have been months and months (and months) of depositions and preparations for something of this magnitude. So to find out the day of the trial that Phoebe is representing strikes me as so monumentally bogus. Just sayin'.
* They share scenes of still-simmering attraction, but Phoebe accuses Alan of having lost his spark, his passion.

Other random intel:
* Bethany's legal expertise in the medical field is why she's helping here. Evidently she's provided a lot of work on expert witnesses and Alan wants to call only two, which causes her to walk out on Alan during an argument. No signs that she's walking out on the case. She's just really frustrated with Alan, and Katie agrees with her.
* Denny and Shirley have a conversation about Denny's declining sexual function. There's reference to a cheerleader costume, which sounds like a reference to their romantic past. Denny wants to at least borrow it, which implies he's asking her to wear it and she refuses. And Shirley makes a reference to her state of mind if she were to resign herself to being Denny's fluffer, which amuses me to no end.
* Just in time for Alan's closing, Denny has changed his cell ringtone from a woman moaning to the theme song to Rocky. Evidently, Boston's courthouses have lousy security checkin, because cell phones are not allowed in courtrooms, but Denny seems to sneak it past every time.
* The judge is Milton Brody, which I think is a new judge

* In the opening, Coast Guard officers Crane and Shore are in a speeding yacht heading toward…another yacht filled with beautiful women while this theme is supposedly playing. Our boys board the other boat and begin to issue “orders” to the nubile 20-somethings, based on the fact that we’re at war. Ah, yes…men in uniform.

* On the first day of the trial, Alan, Jerry, Denny and Bethany (yeah!) – are faced with a mob of media as they make their way to the courtroom. Evidently Jerry is carrying Bethany, and I’m not even going to speculate on whether or not that’s appropriate. I’m just going to assume he’s doing it to protect from her getting crushed by the mob. Just saying…

* The gang is representing a client whose father smoked cigarettes and died from lung cancer. He smoked for over 50 years. Again…just saying….

* During the trial, Denny’s cell phone goes off and the “ring tone” is a woman’s voice emulating sex. Alan gets mad.

* Opposing counsel is a woman named Phoebe who’s an ex-girlfriend of Alan’s! Oooh! And she’s tough in court! Oooh! That almost never happens! Again…just saying…

* One of the witnesses is a guy named Harvey Loper who has a lazy, wandering eye that distracts Alan when Alan is cross-examining.

* In other news….Alan and Denny are holding hands as Denny is at another doctor’s appointment to discuss Denny’s issue with erectile dysfunction. During the exam, Denny reveals how many meds he is taking for various ailments. The doctor is astounded. As the doctor reviews the list, he rattles off at least 21 different meds. Finally, he says that there are patients who are incorrectly diagnosed with Alzheimer’s because they’re over-medicated. Just for the record, this is an idea that’s just floated out there during this episode. Nothing definitive is stated, at least in this intel.

* For what it’s worth, the plaintiff (daughter of the dead smoker) is awarded the decision for a large sum of money.

Alan, Denny, Jerry and Bethany go to court against the tobacco industry. The lawyer for the opposing side is a former girlfriend of Alan's. When she questions the doctor, Alan is certain their case is shot. Denny is experiencing some "male" trouble and goes to the doctor, where he is shocked to learn he might not have Alzheimer's.

ABC will launch this fall with perhaps the most stable schedule of any network in years.

As expected, Alphabet web revealed a fall 2008 lineup that looks a lot like its fall 2007 sked – and that’s by design.

Just two new series made it on the sked: A revised U.S. adaptation of hit BBC thriller “Life on Mars,” and Ashton Kutcher-produced reality skein “Opportunity Knocks.”

"We're returning our dominant core group of shows from last fall," McPherson said. "The few openings we had we've filled with the kind of quality programming viewers have come to expect from ABC, and we have a very strong bench."

Also new to ABC, as expected: "Scrubs," which bows on the Alphabet on Tuesdays at 9 pm in the winter, while the "Dancing with the Stars" results show is on hiatus. "Scrubs" will be paired with new animated half-hour "The Goode Family," from Mike Judge, John Altschuler and Dave Krinsky.

Also in midseason: The untitled Tyra Banks/Ashton Kutcher show, which will air Mondays at 8 during the "Dancing" break.

ABC went into the upfronts with most of its major freshman entries renewed for next year. What’s more, many of the Alphabet net’s pilots have yet to be shot – and ABC Entertainment prexy Steve McPherson made it clear that he wouldn’t schedule any new shows without first seeing some tape.

ABC’s decision to stick with a mostly stable sked is also recognition that the net was performing well in the fall – until the writers strike, and of course “American Idol,” halted that momentum.

Other returning series include "According to Jim" and ABC News' "Primetime: What Would You Do?"

Denny wants to represent a female cattle rancher who is fighting against allowing cloned meat into the US food supply because she claims that cloned meat is too new to know whether or not it is safe. Denny asks Carl to handle it because he is falling in love with the woman and wants to be with her, not as an attorney, and Alan is busy. Alan and Shirley deal with her nephew, who seems to be a bit wacky and involved with politics, and realize the only way to deal with his problem is to sue the Democratic National Party.
