 There’s no questioning that divorces are stressful for all parties 
involved.  Some divorcing spouses may choose to mediate instead of 
litigate, and the choice of mediation can carry many benefits.&lt;br /&gt;
&lt;br /&gt;


 Mediation is a form of alternate dispute resolution where a 
qualified third party negotiator helps to negotiate a settlement.  In 
dissolution of marriage cases, each spouse can be represented by his or 
her own attorney, but may choose to go before a licensed court-approved 
mediator, often a barred attorney, to reach an agreement on child 
custody, support, alimony and the distribution of assets.&lt;br /&gt;
&lt;br /&gt;


 One benefit to mediation is the cost.  By using facilitated 
negotiation, couples can often workout their differences together and 
avoid costly court and attorney fees.  Another benefit to mediation is 
the time frame.  A litigated divorce can take years to reach a final 
judgment, where sometimes a mediated divorce can be resolved in several 
months.&lt;br /&gt;
&lt;br /&gt;


 Mediation allows the divorcing parties to be in control of their 
outcome, where judicial outcomes can be rigid and define a winner and a 
loser.  A consequence of this type of resolution often brings about more
 compliance in a divorce settlement, because both parties feel that they
 have worked hard to negotiate a final agreement. &lt;br /&gt;

Kristy Garside has been advocating on behalf of impoverished Rhode Islanders since law school, when she received her J.D., from Roger Williams University School of Law in 2004.&amp;nbsp; She has been an active participant in the Rhode Island Bar Association’s Volunteer Lawyer program for many years.&amp;nbsp; Garside offers her family law and elder law knowledge and expertise to the volunteer program, which provides legal assistance to low-income clients who are financially unable to obtain legal representation.&amp;nbsp; She is among over 1000 private attorneys in the State of Rhode Island who volunteer their time for this program. &lt;br /&gt;

&lt;br /&gt;
The first &quot;mistake&quot; referred to was to ignore the tax consequences of retirement &lt;b&gt;funds&lt;/b&gt;. Our office happens to be very knowledgeable regarding retirement accounts because we study the plans for our own clients, and we are also often hired by other attorneys to assist their clients in drafting the documents required to divide the retirement assets. &lt;br /&gt;
&lt;br /&gt;
In order for an employer to give a portion of an employee&#39;s pension or retirement account (ex. 401(k), savings plans, etc.) to someone other than the employee, a document that is separate from the divorce decree or settlement agreement must be drafted, submitted to the court, and then sent to the employer. We are often hired to draft such orders, also known as &lt;b&gt;Qualified Domestic Relations Orders&lt;/b&gt;, or QDROs. These orders have to address all the provisions of the plan, including but not limited to: the amount awarded, what happens if the employee dies prior to or after they retire, and when the former spouse can begin to collect his or her portion of the pension.  &lt;b&gt;You do not always need to wait until he or she retires before you can get your share! &lt;/b&gt;&lt;br /&gt;
&lt;br /&gt;
You may think it would be common sense for an attorney to understand the plan and to know what the value of that plan is before they attempt to negotiate a settlement, but this is not always true. We are available to &lt;b&gt;consult with attorneys &lt;/b&gt;if they have questions, and advise one party or the other how the terms of the Order could be written to achieve the most favorable result. &lt;br /&gt;
&lt;br /&gt;
If you are getting divorced, and your attorney does not seem to have a handle on how the retirement plan works or what the value of that plan is in today&#39;s dollars and in the future, I suggest you call our office before you sign a settlement agreement. &lt;br /&gt;

&lt;b&gt;&lt;br /&gt;&lt;/b&gt;With RILS&#39;s, help Terese was able to obtain legal guardianship of her two grandchildren who were orphaned when their mother died as a result of domestic violence. Terese was determined to protect the children from their mother&#39;s abuser despite having limited means of supporting herself.&lt;br /&gt;
&lt;br /&gt;
Terese&#39;s daughter had worked until her death and was entitled to substantial state and federal tax refunds. The daughter also had money in the bank. Terese was told there was no way she could access any of this money without a probate order.&lt;br /&gt;
&lt;br /&gt;
Her Safe Family Unit attorney referred her to &lt;span style=&quot;font-size: large;&quot;&gt;&lt;b&gt;RILS&#39;s Low Income Tax Payer Clinic (LITC&lt;/b&gt;).&lt;/span&gt;  Attorney Elizabeth Segovis obtained an order naming Terese as the personal representative for her daughter&#39;s estate and then assisted her with the IRS. &lt;br /&gt;

In the end, Terese was able to recover almost $10,000 to assist her with her grand- children&#39;s care. &lt;br /&gt;

Far too often the attorneys do not understand the plan, nor do they understand what they are &quot;giving up&quot; to the other side by not knowing they have options.  For example:  The parties can divide a pension based on a formula calculated as of the actual retirement date, or use a formula that &quot;freezes&quot; the pension amount at the date of separation or divorce.  These options have vastly different results, although there are legitimate reasons why one should more appropriate than another.       &lt;br /&gt;

Island.  Economic stability is giving unhappy couples confidence in 
their ability to support themselves in separate households. Experts 
credit the rebounding of the real estate market, improving unemployment 
numbers and the healthy stock market for the increase in new divorce 
filings.  In recent years, many couples have felt forced to remain in 
unhappy marriages because one or both spouses may have been unemployed 
or fearful of a job layoff, or because the marital residence may have 
been an “underwater” property, with no equity to divide in a marital 
settlement agreement. The recovering economy also results in couples 
having more disposable income and being able to hire family law 
attorneys to represent them in long-awaited divorces.&lt;br /&gt;

When a husband and a wife (the parties) get divorced, “qualified” 
plans such as 401k plans are divided by the husband and wife by means of
 a Qualified Domestic Relations Order (a QDRO) which is a court order 
directing the plan administrator to break up the participant’s 401k into
 a portion for the “participant” and a portion for the “alternate 
payee”. The parties can also waive the pension rights of the other in a 
Property Settlement Agreement (the “Agreement”).&lt;br /&gt;
&lt;br /&gt;
In one case decided in March of this year, the parties waived rights 
to the pensions of the other in their Agreement. The husband had 
previously (before the divorce) named his wife as his beneficiary of the
 401k. After the divorce a QDRO was never completed, the husband did not
 change his beneficiary and he died. Due to a prior decision decided by 
the US Supreme Court in 2009, the wife received the total 401k plan 
because she was the named beneficiary even though she had waived it.&lt;br /&gt;
&lt;br /&gt;
But the recent case was brought before the Third Circuit Court of 
Appeals and it was decided that although the surviving wife was entitled
 to the proceeds because she was the named beneficiary on the plan 
documents, the estate of the deceased participant could sue her under 
the contract (the Property Settlement Agreement) for the benefits she 
wrongfully received due to her waiver of those benefits.&lt;br /&gt;
&lt;br /&gt;
This case reminds us all to follow through after a divorce. First, 
all assets&amp;nbsp; should be reviewed to make certain that your ex-spouse is 
not your named beneficiary; and, secondly, you must make sure that all 
&lt;a href=&quot;http://www.counselfirst.com/qualified_domestic_relations_orders_qdro.html&quot; target=&quot;_blank&quot;&gt;QDRO&lt;/a&gt;s are completed as soon as possible after you are in court.&lt;br /&gt;
&lt;br /&gt;
I would not want to be the attorney for the participant who died. The
 attorney’s fees to file such an appeal through the Federal Courts must 
have been very high and my guess is that a malpractice case will be 
brought by the estate of the husband against his attorney.&lt;/div&gt;

The father (ex husband) filed an action in Family Court to compel visitation with the 6 year old child. Mom could not afford an attorney, but she wondered what she could plan on happening that day in court. She wondered whether she needed to bring her daughter and whether the matter would be completed that day given that she has to fly in from California to contest it.&lt;br /&gt;
&lt;br /&gt;
I will not go into the detailed answers to all of her questions here, but wanted to point out that it is ALWAYS BEST to consult an attorney for such a matter, because if she filed papers on her own, she could have missed the opportunity to file a motion to dismiss the action, because it probably should be heard in California!&lt;br /&gt;
&lt;br /&gt;
Jurisdiction in child custody matters can be tricky for attorney, nevermind a lay person. Some attorneys will not take the time to warn a person about such things when they hear &quot;I cannot afford an attorney,&quot; but we will, to the extent we can.&lt;br /&gt;

The House of Representatives passed the Veterans&#39; Compensation Cost-of-Living Adjustment Act of 2012 (H.R. 4114).&amp;nbsp;&lt;/h2&gt;
&lt;br /&gt;
Although this is seen by many as a formality, passing the COLA is often pushed to the end of the year. According to House Committee on Veterans&#39; Affairs press release, taking care of this now ensures that Vets will be given the benefits they were promised without any last minute &quot;political tug-of-war.&quot; If signed into law, H.R. 4114 would increase the annual cost-of-living rate for veterans, which goes into effect on December 1, 2012. It is estimated that this year&#39;s COLA will be approximately 1.9 percent. The legislation now heads to the Senate for consideration.&lt;br /&gt;

It is only at this time of year where, for most (if not all) of our clients, we also need to think about the potential income tax return and refund.
&lt;br /&gt;
&lt;br /&gt;
It is important to note that if you are in a contested divorce situation, then your attorney should at least consider asking the court for a restraining order with regard to spending the 2011 refund.  Specific options include restraining the parties from cashing the refund until further order of the court, or perhaps more commonly, asking the court to order that the funds be deposited into an &quot;escrow account&quot; so that those funds are not spent without an agreement of the parties or by further court order.  A restraining order can also be useful in child support cases that have not been running through the Child Support System.  (Those child support cases which are running through the system should be intercepted if someone owes money to  the custodial parent automatically.)  
&lt;br /&gt;
&lt;br /&gt;
Parties can be tempted to file together without speaking to their attorney because the case is in the early stages, there aren&#39;t any issues yet, or the promise of &quot;quick cash&quot; is alluring.  However, doing so could be a mistake for tax reasons, as well as the fact that the funds could be easily deposited into a joint account, and then removed by one party. It is much easier to &quot;hold&quot; the funds, than it is  to &quot;chase&quot; the funds.

As 2012 begins, many people will find themselves with new health benefits and higher deductibles, or, increasingly, with no health insurance at all, particularly in the 50—64 year old age category. Additionally, the latest focus of healthcare reform has become prevention, or wellness, vs “sickness” care. Companies are struggling to find solutions to health cost inflation, and new paradigms are emerging that feature “worksite” clinics, and direct, affordable pre-paid primary care (another story here). I offer one such program, &lt;b&gt;Medical Membership Plans&lt;/b&gt; (MMP). 
&lt;br /&gt;
&lt;br /&gt;
A MMP is a prepaid primary care plan for companies and individuals ($84/month individual, $99/family), where care is delivered by a national network of urgent care centers. There are no co-pays, no deductibles, no pre-existing conditions, and care generally includes all services that can be delivered at the urgent care center (x-rays, injections, labs, etc.) This plan is open to all, and is a membership plan, not health insurance. Many clinics are available, al?though, geographically, some areas are better covered than others— e.g. Worcester and Boston area, MA, great, Cape Cod, not so good. RI has many clinics available, and CT has good coverage in the urban areas. Call me (Robin) for more information, or a list of participating providers in your area. The MMP model may help drive down health costs.

The legislation will need to be revisited by March, but for those of you who received a notice and expected your benefits to end as of January 1, 2012, you now have a bit of a chance to re-group in the event the checks will stop coming as of March 1, 2012.

A common mediation Question: “My spouse does not want to mediate. He or she says that we already have agreed upon the terms of the divorce property settlement. He wants to hire an attorney for a flat-fee price. I want to mediate. What are my options?&lt;br /&gt;
&lt;br /&gt;
Your spouse may not want to mediate because your spouse may see it as unnecessary. The agreement is “done” in your spouse’s mind. If the offer is “fair and equitable”, your spouse could be correct. The “fly in the ointment” is that your spouse may be viewing things through his (or her) own prism or may not have considered all issues. In the final analysis, the offer may not be “fair” to you (or to an attorney you have consulted). In that case, you could still negotiate the terms of the property settlement with the help of your attorney and still do it inexpensively provided that your spouse and attorney are flexible enough to accept a counter-offer or that the “back-and forth” negotiations do not require too many attorney contacts.&lt;br /&gt;
&lt;br /&gt;
“Flat fee” quotations for divorce representation can be problematical because a case can easily move from a $2,000 “nominal” (uncontested) case to a $6,000 to $10,000 case (each) or more. I take it that the flat fee price assumes that you will agree upon the terms of the agreement quickly. When I wear my attorney hat, I do not give flat fee quotations unless and until both parties are represented by counsel and have reached an agreement; or, unless I have prepared an agreement on behalf of one person and the other has accepted it, with or without counsel. The fact is that many clients come in thinking that they have a “done deal” but once all issues are surfaced, they do not. While one person can decide not to engage an attorney, I never advise it. One attorney can never represent two persons with opposing interests, even if they are in agreement.&lt;br /&gt;
&lt;br /&gt;
Mediation tries to assist the divorcing couple to reality-test the offers and counter-offers and to make certain that they understand all issues. We have a high rate of success in guiding couples through the process so that they reach a “Memorandum of Understanding”. That memorandum is then taken to an attorney to draft a Property Settlement Agreement (the contract) and to file all other papers to complete the divorce. Even in that case, we recommend that the non-filing person hire an attorney for at least the limited purpose of reviewing the contract prepared by the Plaintiff’s attorney.&lt;br /&gt;
&lt;br /&gt;
So, my first recommendation is to mediate. It is like an insurance policy because it gives both of you some assurance that you will not end up in a contested divorce. The second option is that you hire your own attorney to review any and all offers from your husband and to negotiate in good faith. There is nothing in this second scenario that prohibits you and your attorney from reaching an Agreement at a reasonable price.&lt;br /&gt;
&lt;br /&gt;
I would not recommend that you proceed without an attorney under any circumstances.&lt;br /&gt;
&lt;br /&gt;
I can mediate for both of you as was originally intended. In that case his attorney can still represent your spouse during the mediation and post-mediation. It might be worth one session of 1.5 hours to discuss where both of you are in the process.&lt;br /&gt;
&lt;br /&gt;
I can also represent you individually and negotiate with your husband’s attorney.&lt;br /&gt;

&lt;br /&gt;
We covered benefits available to the military member, their spouse and/or children if they die while enlisted, disabled military members, and other benefits for retired Veterans. &lt;br /&gt;
&lt;br /&gt;
It continues to amaze me that there are benefits available that the military members and their families may or may not be aware of. &lt;br /&gt;
&lt;br /&gt;
&lt;b&gt;Top Five Things I Took Away From the Program&lt;/b&gt;&lt;br /&gt;
&lt;br /&gt;
1. A military member must complete a DD Form 93, together with their estate planning documents, in order to determine who will get the $100,000 death benefit if the member is killed on duty; who will get their remains, who will get the flag at the funeral, and even letting the military know who should be told first in the event you are killed. The military will follow the Form, regardless of the terms of the Member&#39;s Will. &lt;br /&gt;
&lt;br /&gt;
2. Disabled Veterans claims can take several months, or even years to complete. If appealed with the help of an attorney or Veterans&#39; Group, there is a high success rate to overturn the original decisions. &lt;br /&gt;
&lt;br /&gt;
3. The Veteran can get disability benefits for drug and/or alcohol abuse of they can prove that such abuse is directly caused from another diagnosis as a result of a service connected disability. &lt;br /&gt;
&lt;br /&gt;
4. There are new diagnoses added to the list that a Veteran can collect for, where payments can be made retroactively from the original claim.&lt;br /&gt;
&lt;br /&gt;
5. If you know Veteran or a Military Member (or their family) that have questions, please do not hesitate to contact our office or direct them to their nearest Veteran Administration Office. &lt;br /&gt;

Our client had since moved out of state, and needed to appoint a Power of Attorney to attend the closing on his behalf.  We also reviewed the closing settlement statement with regard to disbursement of the final proceeds.  We were able to point out that overdue motor vehicle taxes should have been allocated to the ex-Wife’s portion, and that our client should not be responsible for those.  This resulted in a savings of more than $800.00 to our client.&lt;br /&gt;
