Reports have it that her boyfriend wanted to use her for ritual purposes, in his quest for wealth.

For the whole 8 months, she was being fed only twice a week, and it’s a ‘miracle’she survived her ordeal.

Missing Budget: Saraki, Buhari Meet Behind Closed Doors

According to The Punch, Saraki and Buhari met at the presidential villa in Abuja but the former Kwara state governor refused to disclosed details of their meeting to state house correspondents who had thronged the premises of the villa to know details of the meeting.

After exchanging pleasantries with the Director-General of the Department of State Security (DSS), Lawal Daura, who was also in the Presidential Villa to also confer with Buhari, Saraki had showed interest in answering questions by journalists.

But when he was asked about the report that the budget was missing, Saraki expressed surprise and refused to comment. Instead, he just laughed slightly before rushing into his waiting car without answering the question.

Supreme Court aborted CCT, to begin full blown hearing on the 13-count criminal charge preferred against BUKOLA SARAKI by the Federal Government.

Temporary reprieve came the way of the Senate President, Dr. Olubukola Saraki, yesterday, as the Supreme Court aborted bid by the Code of Conduct Tribunal, CCT, to begin full blown hearing on the 13-count criminal charge preferred against him by the Federal Government.

In a ruling, yesterday, a five-man panel of justices of the apex court, led by Justice John Fabiyi, directed the CCT to ‘tarry awhile’ to enable it look into Saraki’s appeal.

It will be recalled that the Justice Danladi Umar-led tribunal had on November 5 declined to suspend hearing on the case.

The tribunal, while refusing to hands-off the matter, stressing that the federal government to call witnesses to testify against the Senate President on November 19.

Justice Umar anchored his decision on Section 305 (c) of the newly-enacted Administration of Criminal Justice Act, ACJA, 2015, which he said gave the tribunal powers to conclude the trial and pass sentence, but suspend execution until such a time the appeal before the higher court was considered and decided.

The decision infuriated Saraki’s lawyers who walked out on the tribunal, even as they accused the panel of engaging in “an act of rascality” by refusing to accord respect to judicial hierarchy.

CCT should halt proceedings until…

However, in its ruling, yesterday, the Supreme Court ordered the CCT to stay its proceedings to enable it look into legal issues raised before it by Saraki. Though government had at the tribunal opposed Saraki’s move to stay his trial, it, however, made a U-turn at the Supreme Court yesterday, saying it would not go ahead with the trial until the appeal was determined.

Prosecuting counsel, Mr. Rotimi Jacobs, SAN, entered an undertaking that “no unusual step will be taken by the Federal Government”, in relation to the charge against Saraki.

He, however, sought an accelerated hearing of the appeal, adding that the Federal Government had already filed a counter-affidavit where it adduced reasons Saraki should be allowed to face trial. He told the apex court that the 25-paragraph counter-affidavit was sworn to by one Samuel Adeyemi on November 10.

Rotimi said his decision to enter an undertaking on behalf of the Federal Government was to protect the validity of Section 306 of the ACJA, 2015, which he said forbids the granting of stay of proceedings in a criminal trial.

He argued that the essence of the section would be defeated should the apex court issue an express order directing the tribunal to stay its proceedings.

“I can give an undertaking not to proceed with the case before the tribunal, but for your lordships to grant stay is what I am concerned about. I am worried about what it will portend for the criminal justice system and for Nigeria”, Rotimi submitted.

Nevertheless, in their unanimous ruling, the Supreme Court judges gave both Saraki and the Federal Government seven days each to file and exchange their briefs of argument.

“In view of the fact that the learned counsel to the respondent has given an undertaking that no unusual step will be taken, it is imperative to state that all the parties, including the Code of Conduct Tribunal, should tarry a while to enable this court determine the appeal before it.

“In effect, further proceedings at the CCT should be stayed, pending the hearing of the appeal. Hearing date will be communicated to all the parties”, Justice Fabiyi ruled.

Prior to the ruling, Saraki had, through his team of eight Senior Advocates of Nigeria, led by Mr. J. B. Daudu, challenged the competence of the 13-count charge and the jurisdiction of the CCT to entertain same.

He maintained that the CCT panel erred when it decided to go ahead with the trial, despite pendency of the appeal before the apex court. Saraki’s lawyer argued that the Justice Umar-led panel ought to have shown respect to the Supreme Court, being the highest court of the land.

He said: “The dignity and finality of the apex court must be preserved at all times to uphold the sanctity of the rule of law and avoid anarchy.”

Saraki sought the intervention of the Supreme Court after he failed to persuade a three-man panel of justices of the Court of Appeal in Abuja, to quash the criminal charge against him.

In his appeal marked SC/852/2015, he prayed the apex court to invoke its powers and quash the 13-count criminal charge against him.

He wants the Supreme Court to set aside the judgement of the appellate court which had on October 30, granted the Federal Government the nod to go ahead with his trial.

He applied for: “An order staying further proceedings in Charge No: CCT/ABJ/01/2015 between Federal Republic of Nigeria vs Dr. Olubukola Abubakar Saraki fixed for hearing on November 5 and 6, 2015 pending the determination of the appeal before the Supreme Court against the judgment of the Court of Appeal dated October 30, 2015.”

Saraki’s grounds of appeal

In his seven grounds of appeal, Saraki, asked the apex court to overrule the appellate court, void all the steps that the Justice Danladi Umar-led tribunal had taken so far, as well as, quash the 13-count criminal charge against him.

He contended that the appellate court panel, led by Justice Moore Adumein, erred in law when it affirmed the competence of the proceedings of the CCT which sat on the appellant’s case with only two members against the three provided for in the provisions of Paragraph 15(1) of the Fifth Schedule to the 1999 Constitution.

Saraki’s lawyer, Daudu, also faulted the majority decision of the appeal court where it held that there was lacuna regarding the quorum of the tribunal.

He argued that the application of the Interpretation Act to hold that two out of three members of the tribunal could validly sit “is to circumvent and reduce the number prescribed by the Constitution for the due composition of the CCT”.

Similarly, Saraki faulted the majority decision of the appeal court where it held that the CCT was a court of limited criminal jurisdiction and that the charges were validly initiated by a Deputy Director in the Federal Ministry of Justice, Mr. M.S. Hassan, in the absence of a substantive Attorney-General of the Federation.

More so, he challenged the decision of the appeal court which held that Saraki had been properly served with the charges, at a time when his legal team only filed motion for conditional appearance before bench warrant was issued against him by the CCT.

Saraki’s lawyer further argued that the court of appeal erred in law for refusing to hold that the tribunal violated the order of the Federal High Court in Abuja which he said ordered the tribunal to appear before the court to show cause why its proceedings against Saraki should not be halted.

According to him, the appeal court erred in law when it held that the Administration of Criminal Justice Act 2015 was applicable to the proceeding of the tribunal.

The appellate court had in two-to-one split decision on October 30, dismissed Saraki’s appeal against the ruling of the Justice Umar Danladi-led tribunal. Whereas the duo of Justices Adumein and Mohammed Mustapha dismissed Saraki’s appeal and ordered him to submit himself to the CCT for trial, another member of the panel, Justice Joseph Ekanem, held that the 13-count charge was incompetent, even as he discharged the accused person.

Saraki was in the charge before the CCT, marked ABT/01/15 and dated September 11, 2015, alleged to have falsely declared his assets, contrary to the constitutionally requirement.

He was accused of deliberately manipulating the assets declaration form that he filed prior to his assumption of office as the Senate President, by making anticipatory declaration of assets, as well as, operated foreign bank account while in office as a public servant.

The offence was said to have been committed while Saraki held sway as governor of Kwara State.

He was also accused of breaching Section 2 of the CCB and Tribunal Act, an offence punishable under section 23(2) of the Act and paragraph 9 of the said Fifth Schedule of the 1999 Constitution,

President Muhammadu Buhari’s plan for Nigeria’s oil and gas sector for the next four years, Dr. Ibe Kachikwu Minister of State for Petroleum Resources, made this known.

Kachikwu who doubles as the Group Managing Director of the Nigerian National Petroleum Corporation (NNPC), said in Abuja that the government would pay more attention to increasing Nigeria’s crude oil and gas production within this period to earn more revenue from there.

He also stated that the Petroleum Industry Bill (PIB) which has remained dormant for years would be revived and represented to the National Assembly, albeit with new or reviewed terms.

According to him, the president has directed him to change the age long perception of Nigeria’s petroleum industry as being corrupt and opaque. He added that going forward, the ministry of petroleum resources would have to imbibe new operational character that is in line with standard practices.

President Muhammadu Buhari has sought the approval of the National Assembly to pay the N413bn approved last week as subsidy claims to oil marketers across the country.

The Federal Government stated on Wednesday that it was making efforts to pay the outstanding subsidy claims in a week’s time.

The newly sworn-in Minister of State for Petroleum Resources, Dr. Ibe Kachikwu, admitted that the marketers had yet to receive the approved amount and explained that it was going through a process.

Kachikwu spoke at the headquarters of the Federal Ministry of Petroleum Resources in Abuja shortly after he was inaugurated.

He said, “If you know this President, you will know he doesn’t pay lip service (to issues). The money was approved by the President and it has not reached the marketers there is a process that our constitution requires in terms of approving this sort of expenditure. It is an extra-budgetary approval.

“So, the President is taking time to write to the National Assembly to apprise it of the need to do this. I was one of those who pushed heavily for that money to be paid because when you don’t do that, most of their factories are closing, their capacity to import is almost going down, their staff members have not been paid for some months and the NNPC does not have the singular capacity to import all the products required in this country. So, those are the clear facts.

“He stressed that as far as the president is concerned, there are very clear directions and one is that the perceptions and working atmosphere about this ministry must change. We are working on that at the NNPC but people here who supervise the NNPC must change.”

According to him, the president has directed him to change the age long perception of Nigeria’s petroleum industry as being corrupt and opaque, that the ministry of petroleum resources would have to introduce new operational character that is in line with standard practices.

“So, do we want to pay? Yes. Have we provided for the money? Yes. But do we need approval from outside the executive to implement that? Yes. So, it is going through a process. I do urge them (marketers) to be a bit patient; the President is working hard on this and I’m sure in a matter of a week, or so, you will have this issue resolved.”

On fuel queues at filling stations, Kachikwu said there was enough supply of petrol, adding that the country currently had enough of the product to last for about 22 or 23 days.

“The absence of product is not the issue. What is the issue is the usual panic-buying by Nigerians. The number of trucks that have been moved around over the last three days are in excess of 4,000, whereas the total normal utilisation yield is about 2,500 trucks. Again, there are people who store products and the DPR has sealed a lot of such stations in the last one week,” he added.

Kachikwu told workers at the Ministry of Petroleum Resources that work was going to be very intense, adding that the capacities of the managing directors of agencies under the ministry would be reviewed.

He said, “We need to sit down and map out very clear deliverables. I will imagine that in the first couple of months, we will let the MDs of the various parastatals work with us to understand what the agenda of this administration is. But fairly quickly, we will also sit down and see whether they are in the capacity to deliver those results.

“I am not saying that I’m going to change people, but we will absolutely require you to show an ability to deliver the sort of change mantra that we are looking at. As far as the President is concerned, there are very clear key deliverables. It is going to be a bumpy ride but let’s join the race.”

Kachikwu noted that the 445,000 barrels of crude oil being supplied to the Nigerian National Petroleum Corporation on a daily basis might be reduced in the coming months, adding that statistics showed that the country might not be consuming up to 40 million litres of petrol daily.

Chad imposes state of emergency in Boko Haram-hit area

The government of Chad has imposed a state of emergency in the hostility flares up region Lake Chad saying it has become a gathering point for Boko Haram fighters.

The announcement on Monday came as two female suicide bombers reportedly attacked a mosque in northern Cameroon, killing three people, and a day after a similar assault killed two others in Chad.

Lake chad region is the node between Nigeria, Cameroon, and Niger and is frequently targeted by Boko Haram.

Under the decree, the governor of the remote region will have the authority to ban the circulation of people and vehicles, search homes, and recover arms.

The government said health, education, and economic development in the area must also be a priority as authorities struggle to stem Boko Haram's recruitment drive.

"President [Idriss] Deby has ordered the minister of finance to unlock a fund of 3 billion CFA francs [$4.8bn] for development in the region," according to an official statement read on national
radio.

Pro-Biafra protesters block major road in Port Harcourt

Angry protesters took to the streets and block major roads in the Nigerian city Port Harcourt on Tuesday (November 10), they protests against the detention of the leader of a Biafran separatist movement.

It would be recalled that the Nigerian police had last week said they arrested more than 80 members of the separatist movement during a protest across the oil-rich south-south against the detention of Radio Biafra director Nnadami Kanu.

According to Bayelsa police spokesman, Anisim Butswa, the 78 men and five women were detained in a motorpark in Yenagoa, the capital of Bayelsa state, "because they want to foment troubles and unleash chaos."

Nigerian President to swear-in ministers Wednesday

According to the media office in Abuja Nigeria's President Muhammadu Buhari will officially inaugurate a new Federal Executive Council on Wednesday, November 11, 2015.

According to a statement issued on Wednesday by the presidential spokesperson, Femi Adesina, the ministers-designate will take their oaths of office in the Council Chambers of the Presidential Villa before the commencement of the inaugural session of the council.

The swearing-in ceremony will begin promptly at 10:00 Hours and the ministers-designate are expected to be seated in the Council Chambers by 09:30 Hours at the latest.

Each minister-designate can only be accompanied to the swearing-in ceremony by a maximum of two guests, Adesina said.

Also, following the confirmation of their nominations by the Senate, President Buhari will tomorrow at the Presidential Villa, preside over the swearing-in of Prof. Mahmood Yakubu as Chairman of the Independent National Electoral Commission (INEC), and five others as National

Commissioners of INEC.

The swearing-in of Prof. Yakubu, Amina Zakari, Solomon Adedeji Soyebi, Prof. Antonia Taiye Okoosi-Simbine, Dr. Muhammed Mustafa Lecky

and Alhaji Baba Shettima Arfo is scheduled for 11:00 Hours in the Council Chambers of the Presidential Villa.
