Can Goondas be detained under Preventive Detention indefinitely?

In various states in India there are a mumber of state acts to prevent the prejudicial activities of decoits and goondas and to curtail their anti-social activities.

The Acts will be such as:

“Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Acts”-

generally referred to as :

‘Goondas Prevention Act’.

The State authorities used to arrest dangerous goondas and remand them under police/ judicial custody to prevent such persons from indulging in further prejudicial activities, as the normal criminal/ legal procedures would take considerably long time to curtail the activities of such goondas.

There are possibilities of the above acts being misused to detain political leaders in certain cases.

Such custody of goondas is called “Preventive Detention” which enables the authorities to detain a person without trial in order to prevent him/her from committing certain types of offences.

However, such preventive detention cannot be made as substitute for the ordinary law and absolve the investigating authorities of their normal functions of investigating crime which the detenue may have committed.

Recently, a Supreme Court of India Bench comprising:

Justice Altamas Kabir and

Justice S S Nijjar

has ruled that:

A person cannot be detained under a preventive detention law so as to keep the detenue under perpetual custody, as authorities are bound to discharge their normal functions of investigating a crime and bring the accused to trial.

Preventive detention in most cases is for a year only and cannot be used as an instrument to keep a person in perpetual custody without trial.

Why did AAIDMK Chief J Jayalalitha expel Sasikala and Family from the Party?

Ms.J.Jayalalitha , the Chief Minister of Tamilnadu, had been very close to Ms. Sasikala and family. At present both the friends have been facing joint and several disproportionate wealth case/s in a Special Court in Bangalore.In the year 1996, after losing the General Elections, Ms. Jayalalitha announced that she was disassociating herself from Ms. V.K. Sasikala. However, after Ms. Sasikala was released from prison on bail, she returned to Ms. Jayalalithaa's Poes Garden residence.

At present it is reported that there is rift between Ms. J.Jayalalitha and Ms. Sasikala indicated by the resignation/transfer of the following 2 officials close to Ms.Sasikala and family:

Mr. A. Panneerselvam, Officer on special duty, Special Programme Implementation Department has resinged and

Mr. Pon. Manickavel, D.I.G, Intelligence has been transferred.

According to the AIADMK party sources the interference of Ms. Sasikala and her family members in the administration and political overreach are the reasons for their total removal from the party.

It is also said that Ms. Sasikala had been speculating with the aid of astrologers as to what would be the judgment in the ‘disproportionate wealth case/s, taken up for trial in the Special Court in Bangalore.

Perhaps, it was doubted by Ms. Jayalalitha that Ms. Sasikal and family have been in the process of identifying the next Chief Minister, in case Ms. Jayalalitha would have to go into Jail.`

On 20th December 2011, Ms. J.Jayalalitha expelled from all the Key Posts and even the Primary Membership of the AIADMK:

Ms. Sasikala Ms. Sasikala was sent out of Poes Gardens/ the residence of J.jayalalitha.) and

Mr. Natarajan, the husband of Ms.Sasikala, an ex- Public Relations Officer of the Government of Tamilnadu.

The other family members and persons close to Ms. Sasikala and family expelled from the AIADMK by Ms.J.Jayalallitha are the following 12 persons:

Sons of Ms. Sasikala's sister Ms. Vanithamani :

1. Mr.T.T.V. Dinakaran, who had also served as .Member of Parliament of both Rajya Sabha and the Lok Sabha.

2. Mr. V. Bhaskaran, who was the Managing Director of JJ TV before the launch of the Official Channel of AIADMK- Jaya TV. And he was arrested arrested on charges of Foreign Exchange Regulation Act (FERA) violations.

3. Mr. V.N. Sudhagaran, Son of Mr.T.T.V. Dinakaran, who was declared a foster son by Ms. Jayalalithaa in 1995, and disowned by her later. Ms Jayalalithaa organised the wedding of Mr. V.N. Sudhagaran in a very grand manner spending a huge sum of money. However, when the AIADMK was in power in the year 2001, he was arrested on charges of attempt to murder under Section 307 of the Indian Penal Code and provisions of the Arms Act, and the Narcotics Act, for allegedly possessing a revolver and heroin.

4. Dr. S. Venkatesh, a doctor, is the son of Ms. Sasikala's brother Mr.Sundaravadhanan. He was the secretary of Ilaignar and Ilampengal Pasarai (Youth and young women brigades).

The popular South Indian Glamour Queen- "Silk Smitha" was shockingly found dead in her apartment at Chennai on 23rd September 1996.Mr. Vadippatti Nagavara Prasad, the brother of Silk Smitha alleged that the death of his sister could not be suicide.

He had doubts that his sister had been murdered and sought police investigations into his sister's death.

However, the files related to the death of Silk Smitha were closed and her death was treated as suicide.

Silk Smitha was born on 2nd December 1960, at a very small village near Eluru, a town in Andhra Pradesh in a poor family. Her original name was Vijayalakshmi.

Due to poverty, she had to drop her school studies after 4th Standard. The girl Vijayalakshmi dreamed to become a cinema actress. And she came down to Chennai and stayed with her aunt.

Mr. Vinu Charkravarthi, a famous Tamil Film Actor/Producer and Director identified the potential in Vijayalakshmi as a glamorous actress.

He changed her name as "Smitha" and introduced her in the Tamil film, "Vandi Chakkaram".

Smitha played a glamour role in Vandi Chakkaram, with Actor Sivakumar as the hero and Ms.Saritha as the heroine and directed by Director Vijayan.

The name of the character "Silk" became a part of her name. And Smitha became "Silk Smitha".

Then Silk Smitha started to act in glamour roles and in dances in movies of:

Malayalam,
Telugu
Kannada and
Tamil.

After 15 years, the popular and successful Hindi Films/Hindi and Tamil Television Serials - Producer Ms.Ekta Kapoor found the life and death of Silk Smitha to be suitable for a successful Screen Play for a Hit Film. "Dirty Picture", a film in Hindi and Telugu was produced with this screenplay. Ms. Vidya Balan has played a role named "Silk" in 'Dirty Picture'. Hindi Actor Mr.Naseerudeen Shah has co-starred in this film as a Cinema Director.

Mr. Nagavara Prasad, the brother of Silk Smitha filed a Writ Petition in the Andhra Pradesh High Court, seeking a stay on the release of the film "Dirty Picture" based on the life and death of his sister.

According to Mr. Prasad, the screenplay is depicting his sister as a dirty character and the death of Silk Smitha had been wrongly shown as 'suicide'.

However, his writ petition was rejected by the Andhra Pradesh High Court and the film "Dirty Picture" was released on 9th December 2011, in Hindi and Telugu.

Upset by the release of "Dirty Picture", Mr.Prasad says that his sister had never been 'dirty' as shown in the film.

He has again lodged a police complaint seeking investigations into the death of his sister Silk Smitha.

If they wanted to make a film based on his siter Silk Smitha's life, they should have contacted him for consultations and approval. And Mr. Prasad is planning to file 'Criminal Defamation Suit' against the "Dirty Picture- Team".

The "Dirty Picture-Team" including Ms. Vidya Balan say that the film "Dirty Picture" might be inspired by Silk Smitha and it is not based on Silk Smitha's life and death.

According to them there had been many dance stars like "Silk Smitha", and it incidentally the name of the dancer character in "Dirty Picture" has been "Silk"

The released film "Dirty Picture" is reported to have received overwhelming response in all the centers. And the distributors are making arrangements for screening "Dirty Picture" in more theaters in Metros.

The complaint made by Mr. Prasad have added attraction to the film and the more fans would like to view the film.

However, we have to wait and see whether the allegations and complaints of her brother would bring the truth behind her death and do justice to Silk Smitha.

Offensive and Objectionable Contents in the Internet will be removed by the Indian Telecommunications Ministry!

Internet has grown very fast and the use internet and Social Net Works has also grown very much globally, and especially in India.

People express their ideas, opinions and comments on private and public matters in various social net works such as Facebook, Twitter and Orkut, and Search Engines such as Google and Yahoo publish the contents of the people in the internet.

Recentlly, some pictures depicting the Congress President Sonia Gandhi and Prime Minister Manmohan Singh in a bad light had been published in the internet.

Also, there have been some contents which could hurt the religious sentiments of a large section of communities in India.

And Mr.Kabil Sibal, the Indian Union Telecommunications Minister called the officials of :

Google,
Yahoo,
Microsoft,
Youtube and
Twitter

And told them that such contents are offensive and objectionable and should be removed from the internet immediately.

Mr.Kabil Sibal told them that while nobody minds satirical image of any public personality, it will not be acceptable if a certain form of them are shown and individuals should be protected. And the minister asked them to manually screen the contents before they are floated in the internet.

However, the officials from the Search Engines and Social Network Sites almost declined to give any written assurance as to remove the offensive contents or to screen manually all the contents before publishing in the internet, as it would be next to impossible. They said they will take any action only if the ministry comes out with court orders.'

Further to the meetings with the representatives/officials of the Search Engines and Social Websites, the Telecom Minister has told that:

The Indian government will not allow social networking sites such as Facebook, Twitter and Orkut to host 'objectionable' content and will take steps to screen and remove these.
The government did not intent to curb free expression but also could not tolerate and remain a mute spectator to 'objectionable' content that hurt religious sentiments or 'maligned' an individual's identity.
However this government does not believe in either directly or indirectly interfering in the freedom of the press
And the internet platforms should evolve a mechanism on their own to ensure that such contents are removed as soon as they get to know of the same.
The present Government of India, is not planning to have a ‘censor’ on the internet but decided to Remove from the internet all the offensive and objectionable contents.

To the doubts/questions as to what would constitutes 'objectionable'/’offensive’ and who would decide what is tantamount to 'hurting' religious sentiments or an individual's personal integrity and privacy the Government officials say that they will come up with guidelines.

The Search Engines and Social Network Sites would have to differentiate between what was controversial and what was illegal and anything that what went against statute has been removed by their team, including content that went against their own strict terms and conditions.

However, when contents are legal but controversial they do not and will not remove them as the people's differing views should be respected, so long as they are legal.

There is an opinion that as Mr.Kabil Sibal was wrong on the 2G scam with his 'zero loss' theory, he is very very wrong in trying to bring to India the Chinese model of controlling Internet.

Bus Fares Hike in Tamilnadu and Cyclists on Chennai Roads

The Government of Tamilnadu hiked recently:

Bus Fare,
Milk Prices and
Electricity Charges.

Affected by the hike in Bus Fares, people who used to travel by public buses from one end of Chennai to the other end at about 20 kms, to their offices/work places have now switched over to use their bicycles.And as most of the Chennai roads have:

neither padestrian footpaths

nor separate lane for the cyclists.

And the cyclists in Chennai City have to struggle in the fast moving traffic. The fatalities involving pedestrians and cyclistsl account for over 40 per cent of all road accident deaths each month. The number of accidents involving cyclists has been estimated as 400 per year.

The lack of infrastructure for cyclists and pedestrians of the elegant city of Chennai needs to be urgently addressed. And the government's proposal to upgrade 100 km of city roads to ‘world class' standards must incorporate facilities to cyclists and pedestrians.

Only as and if proper infrastructure is provided, fatalities would come down. And segregating traffic will also make traffic management easier for the Police.

A Woman in India cannot be Prosecuted for Adultery under Section 497 of the Indian Penal Code

One, Mrs.Sailaja alleged that another lady Ms.Kalyani was in illicit relationship with her husband and filed a case for Adultery under Section 497 of Indian Penal Code/IPC and of Wrongful Restraintwas in illicit under Section 341 of the Indian Penal Code/IPC.Ms.Kalyani filed a Petition in the Andhrapradesh High Court against the registration of the above cases against her in the lower court.And the Andhrapradesh High Court dismissed the petition of Ms.Kalyani.

And Ms.Kalyani made an appeal in the Supreme Court of India, against the Andhrapradesh High Court's dismissal of her petition against filing cases against her under Sections- 497 and 341 of IPC.

And a Supreme Court Bench of Justices Aftab Alam and R.M. Lodha, in the above appeal of Ms.Kalyani said that-

Section 497 of the Indian Penal Code [which deals with adultery] is currently under criticism from certain quarters for showing a strong gender bias, for it makes the position of a married woman almost as a property of her husband.

But in terms of the law as it stands, it is evident from a plain reading of the Section that only a man can be proceeded against and punished for … adultery.

The mere fact that the appellant Ms.Kalyani is a woman makes her completely immune to the charge of adultery, and she cannot be proceeded against is evident from a plain reading of Section 497.

Indeed, the Section provides expressly that the wife cannot be punished even as an abettor and ruled that:

Only a man can be proceeded against and punished for adultery, but the wife cannot be, even as an abettor and

The High Court was in error in not allowing the quashing application filed by the appellant and

The Supreme Court of India ultimately, allowed the appeal of Ms.Kalyani quashing the charges against her.

From the Supreme Court of India's ruling in the above case/appeal it is understood that, Mrs.Sailaja should have filed a case only against her husband under Section 497 of IPC.

This reminds me of one story/anecdote as below:

There was a man named say X, whose wife was a lady with no morals and she used to stay with any man on earth.

The husband Mr.X had been tolerating his wife's behaviour with much difficulty.

However, Mr.X lost his patience and decided to do something to bring an end to the matter.

One day Mr.X was going to his house along with his friend Mr.Y. Mr.Y was having a licensed pistol.

When they entered the house they found that Mrs. X was in bed with another man Mr. Z.

Mr. X on seeing a third person in bed with his wife, picked up the pistol from his friend Mr. Y and shot dead his wife.

And the other man Mr.Z who was in bed fled away.

Mr.Y said:

"Hai X! I thought you would shoot the fellow who was in bed with your wife. Why did you kill your wife, man?"

And Mr.X replied, "Hai Y! I cannot go on committing murders. Now,the matter has come to an end, you see."

In India, the ruling Dr.Manmohan Singh’s Government is planning to allow “Foreign Direct Investments” /FDI- in the Indian Retail Sector.The Opposition Parties in India are not in favour of the Government’s move and the following is a List of Indian and Foreign Retailers looking for possible tie-ups, based on the Government of India’s Final Decision to be reached with the Consensus of the Opposition Parties:

Future Group- promoted by Kishore Biyani, that runs-

Big Bazaar and Pantaloons – in talks for tie-up with foreign retailers, including Carrefour.

K. Raheja Group-promoted department store- chain – Shoppers Stop - open to a strategic partnership with global retailers,particularly in the food and grocery segment.

Bharti Retail- is already in partnership with- Wal-Mart –running several “Cash and Carry Stores” in India - will move to multi-brand retail if government allows FDI in it.

Trent-the retail arm of the Tata Group- in partnership with Tesco-planning to take forward their partnership to multi-brand retail stores.

If and as the above Retailers enter the Indian Retail Market and deal with almost all the domestic goods for the daily use of Indians, we have to see whether:

The Indian Farmers would get adequate price for their produce
The Indian Consumers would get their day-to-day requirements in good quality at reasonable prices
The Indian Local Retailers and their Employees at Metros will get alternate Business and Employment elsewhere or at the forthcoming 'FDI' Retailers.

Hindi is the "Official Language of India" and Not the "National Language of India"

In the year 2009, Mr.Suresh Kachhadia filed a Public Interest Litigation (PIL) in the Gujarath High Court, seeking mandamus to the Central Government of India, as well as the State Government of Gujarath to:

make it mandatory for manufacture of goods to print in Hindi, all the details of goods like price, ingredients and the date of manufacture, as the consumers are entitled to know the details of what they are consuming.

It was argued that:

As per the ‘Standard of Weights and Measures (Packaged Commodities) Rules’ such details on packets should be either in English or in Hindi in Devanagari script and
Because Hindi is the national language and is understood by a large number of people in the country, directions should be given to publish all such details in Hindi

A bench headed by Chief Justice S J Mukhopadhaya heard the above case and refused to issue directions that packaged commodities must contain details about goods in Hindi with the following observations that :

though a majority of people in India have accepted Hindi as the national language, and many people speak Hindi and write Hindi in Devangiri Script, Hindi is not officially the ‘National Language of India”.

According to Judgement by Gujarath High Court :

The Constitution of India has given Hindi the status of the “Official Language” and not the national language.
There is no notification ever issued by the Government of India, saying that Hindi is the National Language of India and hence
Hindi is the ‘Official Language of India and not the “National Language” of India.

The Charge Sheets have been issued to all 14 accused in the '2 G Scam' involving a very huge amount of loss to the Government Exchequer, and the Trial is about to commence.

And the people of India eagerly await one of the most important Judgements of the Indian Judiciary in the '2 G Scam' case.

In the State of Maharashtra in India, as in many other states, people have been using DL as a proof of Address Proof and Personal Id Proof for getting:
New Telephone Connections,
New Mobile Phone SIM Cards,
A Housing Unit in MHADA and/or
Other SRA Schemes.

The Maharashrta State Transport Department did not verify the addresses of the DL applicants. Many ‘Bogus’ Driving Licenses have been issued in the state.

As per a new Circular issued by the Chief Secretary of the State of Maharashtra Ratnakar Gaikwad, in the State of Maharashrtra, the Driving License will not be accepted as a Valid Address and Id Proof.

Already, the earlier ChiefSecretary of Maharashtra JP Dange had announced that Ration Card would not be accepted as Address Proof.

It will be much more difficult for people in producing Address Proof for getting telephone connections etc.

In India, Ration Card and Driving License have been a common items for Address Proof and Id Proof.

If and as the Government of various states in India do not accept Ration Cards and Driving Licenses as genuine, because fake ones are made, the Government must come out with a 'Genuine Address Proof', which cannot be and will not be faked, to the people.

Are the Life and Death of Bodhidharma in the Tamil Film "Ezham Arivu" Historically Incorrect ?

The recently popular Tamil Film “7th Sense”/”Ezham Arivu” directed by A.R.Murugadoss with Surya as the hero is about ‘Bodhidharma’, a Buddhist Monk.

Mr.Babu T.Raghu, the Founder of Sailum Zen Monastry in Bangalore has disputed the historical According to Raghu:

the movie is ‘completely erroneous’ and the life and legend of the 28th Zen Patriarch Bodhidharma has been distorted to suit the requirements of the movie script and hence the character of the monk has suffered extensively and none of the ‘historical' aspects as shown in the movie are correct and life and death of Bodhidharma have been wrongly depicted in the movie.

According to the historical accounts Bodhidharma took up Buddhism at an age of seven years and travelled to China, at an age of 150 years to spread the Dhyana culture of Mahayana Buddhism and confined himself to a cave and never spoke to people for nine years and
never fought with anyone.

The movie ‘7th Sense’ /'Ezham Arivu' has depicted Bodhidharma as:

a married man with two children and that

he took to Buddhism on the way to China and

he was shown as going to China to cure a disease and teach fighting skills to the villagers.

In the film the young Bodhidharma has been shown as practicing Martial Arts in Kanchi Town and as per the researcher Raghu Bodhidharma actually practiced Martial arts at ‘Sri Parvata (Nagarjunakonda) area in Andhrapradesh.

According to Raghu as Bodhidharma attained ‘Vajra Kaya’ status with immunity to diseases and poisons was to stay away from metros like Kanchi Town and showing that he stayed at Kanchi is wrong.

The movie has showed the exhumation of his body, however the historical accounts indicate that Bodhidharma's body was never found when the tomb was reopened.

According to the researcher Raghu, the Director Murugadoss should have exercised caution in declaring his version on the life and death of Bodhidharma. And Forgetting or neglecting a history is much better than distorting it.

While appreciating the freedom of artistic expression, the director should have at least made a disclaimer that this is one of the versions of the available legends, or that he adapted the story to suit the movie.

The reactions to the observations of the Researcher Rahgu by Director Murugadoss are expected to be available soon.

It is notable that there have been many comments on the screenplay of the film '7th Sense'./ "Ezham Arivu".

Such contrtoversies and comments will make the film more and more popular.

Can Jayalalitha Justify Prices Hike of Milk Power and Bus Travel in Tamilnadu?

In Tamilnadu the price of Milk, EB Tariff and the Bus Fares have been raised as per a sudden decision taken by the Chief Minister Ms.J.Jayalalitha and her Cabinet of Ministers.

According to Ms.J.Jayalalalitha, the ‘painful’decision to hike prices has been taken to revive:
• the milk producers' co-operative societies,

• Tamil Nadu Generation and Distribution Corporation (TANGEDCO) and

• transport undertakings that were on the verge of going bankrupt.

The total milk production in the State is150 lakh litres and , Aavin has been procuring only 22 lakhs litres and ‘Aavin’ is not able to pay milk producers even 45 days after they had supplied milk.
Due to the increase in the prices of diesel, tyres & tubes and the salary of the employees the Transport Corporations in Tamilnadu are having heavy un bearable burden. And the total loss of the transport undertakings in the last year was Rs. 6,150 Crores and the Government was releasing Rs. 60 Crores a month to sustain the transport corporations. And if the situation is allowed to continue there will be no Transport Corporation in Tamilnadu.

During the earlier DMK rule in Tamilnadu, the Government officials had recommended for prices hike in the Milk, Power and Bus Fares, and however, Mr.M.Karunanidhi turned down the recommendations to protect the poor people of Tamilnadu.

Ms.Jayalalitha has blamed that Mr.Karunanidhi had utilized the borrowings in schemes not benefitting the people but the ruling party and now he is shedding ‘crocodile tears’ over the Unavoidable price-hikes.

Tamilnadu Chief Minister , Ms.J.Jayalalitha has been left with no option but to hike the rates to ensure that these public sector undertakings continued to serve the people of the State, because the Centre had not offered any help to revive them.

Can We Book Train Tickets under Tatkaal Scheme?

Indian Railways has changed the train tickets reservation rules under ‘tatkaal scheme’, to meet the urgent requirement of the passengers who plan their journey at short notice.

According to the new rules for booking train tickets under ‘Tatkaal Scheme ‘, announced by the Indian Union Railway Minister Mr. Dinesh Trivedi on 11^th November 2011, train tatkaal ticketscan be booked 24 hours before the date of journey , instead of the present 3 days in advance.

And to stop black marketing in the sale of train tickets, booking ‘Tatkaal’ Train tickets between 08/ 00 am and 10/00 am will be barred.

And to stop misuse of ‘tatkaal scheme’ of traintickets reservations, CCTV cameras will be installed in front of the ‘ tatkal counters’.

The new tatkaal rules will come into force within a week’s time.

And also no duplicate ticket will be issued if and when the tatkal ticket is lost.

To avoid proxy booking, no money would be refunded in case a passenger cancels a confirmed ‘tatkal ticket’.

As and when the time for ‘tatkaal train tickets bookings’ was 5 days in advance of the date of travel,

The passengers booking ‘tatkaal’tickets used to get tickets for their urgent requirements while planning their journey at short notice.

However, when the time limit for ‘tatkaal bookings’ was reduced from 5 to 3 days, it has been more difficult for passengers booking tickets at the railways reservation counters and online.

With the further reduction in the time limit and the 8 am to 10 am barring the benefits of tatkaal train tickets will become much more difficult.

It is next to impossible to stop black marketing and misuse of train tickets, by reducing the number of days for booking ‘tatkaal’ tickets.

However, the Indian Railways will not realize the real difficulties of the passengers, and they may even scrap the ’tatkaal’ scheme.

So, the Train passengers should restrict their last minute planning for travel by train and practice travel by buses.

And persons who can afford may travel by flight instead of ‘tatkaal train’.

Mrs Sonia Gandhi Hits at Team Anna on 'Lokpal Bill'

The years long pending “Lokpal Bill” will be soon presented in the Parliament and implemented as a strong law to control corruption in India at high levels.

According to Mrs. Sonia Gandhi, the Congress Party President , they are committed to and effective ‘Lokpal Bill’.

Mrs Gandhi’s speech read in the Indian Parliament on 09^th November2011 in her absence has pointed out that it was the National Advisory Council (NAC) headed by her which had first started public consultations on the ‘lokpal bill’.

In her speech just after return after her surgery, Mrs. Gandhi has strongly condemned the ‘agitations threats’ by the ‘Team Anna’ and asked why there has been so much noise from them. Also she has confirmed that corruption in India cannot be eradicated overnight by speeches , fasting and agitations.

Mrs. Gandhi has asked the members of the ‘Team Anna’ to look into them for eradicating corruption, having in mind the allegations and charges in finance and funds, on some of the members of the ‘team anna’, especially, Mrs. Kiran Bedi.

It appears that Mrs. Gandhi appeals to “Team Anna” to first correct themselves, and asks them to explain how they can call their corruptive activities as ‘savings’ and ‘service’ and call the thing when done by others as ‘deadly sins’.

100 Years Old Indian Born Singh's Guinness World Record Pending for want of Birth Certificate

India born and London based Mr.Fauja Singh, completed a 42 km Marathon race at Toronto, Canada. on 16 October 2011.

Guinness Book of World Records has appreciated the achievement of Mr.Singh at the age of 100 years.

Singh will be the “Oldest Marathon Runner” in the Guinness Book of World Records, subject to proper ‘Age Proof’ of Mr. Singh.

Mr. Singh, a Punjabi Farmer moved to Britain in the year 1992, has got his Passport as his “Age Proof’. And as per his passport the Date of Birth of Mr. Singh is 1^st April 1911.

However, the Guinness Book of World Records has since refused to record Mr.Singh’s achievement in their book of records for want of a copy of the Original Birth Certificate of Mr. Singh. The Passport may be taken as a supporting document for age proof and only the birth certificate is the key evidence.

According to the trainer of Mr. Singh, the original birth certificate of Mr. Singh is not available and the “Guinness” is not inclined to accept any other evidence towards age proof of Mr. Singh.

Birth Certificate is very important for "age proof" for any matter. Check up your Birth Certificate and preserve it.

An Indian born Mr.Fauja Singh got a place in the ‘GuinnessWorld Book of Records’ for his accomplishment by completing a full distance Marathon when he finished the race in Toronto on 16th October 2011.However Mr.Singh was the last to finish the race by taking more than 8 hours. By the time he finished the race the finishing line and other track and pavilion arrangements have been dismantled by the workers.

The Marathon Winner Mr.Kenneth Mungara of Kenya took only 2 hours to finish the race and took the crown for the fourth successive year.

It is secondary whether you become a winner or not. And it is the spirit to complete the race as Mr. Singh did.

The Proposed Communal Violence Bill - Prepared by NAC and Discussed in NIC- Draft Bill Details

The following details are from the explanatory notes on "Prevention of Communal and Targeted violence (Access to Justice and Reparations) Bill, 2011"/Communal Violence Bill prepared by the 'National Advisory Council' (NAC):Dereliction of duty by public servants:

The bill recognizes offences of both:

omission and
commission.

Public servants who act or omit to exercise authority vested in them under law and fail to protect or prevent offences or act with malafide and prejudice shall be guilty of dereliction of duty with penal consequences.

Defining communal and targeted violence:

The provisions of this Bill will apply only when it is first established that the offence was 'targeted' in nature.

Offences under the Indian Penal Code shall be considered offences under this bill when they meet the definition of 'targeted'.

Breach of command responsibility:

The bill seeks to ensure that the power of holding command over the actions of others is indeed upheld as a sacred duty, and that there is culpability for those who are 'effectively in-charge'.

The chain of command responsibility may extend to any level where effective decisions to act or not act are taken.

Sanction for prosecution of public servants:

The bill proposes that if there is no response to a request for sanction for prosecution within 30 days from the date of the application to the concerned government, sanction to prosecute will be deemed granted.

In relation to certain offenses under the Indian Penal Code, 1860, when committed by a public servant, the requirement of obtaining sanction is being dispensed with.

Monitoring and accountability:

Monitoring and grievance redressal shall be the responsibility of the 'National Authority for Communal Harmony, Justice and Reparation' (NACHJR) and corresponding State Authorities for Communal Harmony, Justice and Reparations (SACHJR).

The monitoring mechanism of national and state authorities will also provide the 'paper trail' to ensure robust accountability of public officials in a court of law.

Composition of the NACHJR:

The bill proposes that NACHJR will have seven members of which:

four must belong either to a linguistic minority or religious minority in any state or to the SCs or STs.
No more than two members of the NACHJR may be retired public servants.

Offences of communal and targeted violence:

The Indian Penal Code (IPC) contains most offenses committed during episodes of communal and targeted violence. These have been appended in a schedule to the bill and shall be considered offences when they meet the threshold of being 'knowingly directed against any person by virtue of membership of a group'. The brutal forms of sexual assault (beyond the limited IPC definition of rape) and torture have been included in the bill. Additionally, it defines hate propaganda.

Victims' Rights:

This bill seeks to strengthen the rights of the victim in the criminal justice system, through certain provisions in their struggle for justice.

Relief and Reparation including compensation:

All affected persons; whether or not they belong to non-dominant groups in a state have been given justifiable rights to immediate relief, and comprehensive reparations, including compensation if they suffer any harm as a result of any offense of communal and targeted violence recorded under this Bill. No compensation for death shall be less than Rs.15 lakh. No compensation for rape shall be less than Rs.5 lakh.

The federal principle:

Advisories and recommendations of NAJCHR are not binding on state governments. All powers and duties of investigation, prosecution, and trial remain with the state governments."

The proposed 'Communal Violence Bill' intends to prevent and control targeted violence against the :

Scheduled Castes,
Scheduled Tribes and the

According to the draft bill prepared by the 'National Advisory Council' (NAC), the legislation is intended to:

enhance state accountability and
correct discriminatory exercise of state powers in the context of identity-based violence.

The proposed 'Community Violence Bill' was discussed at the 'National Integration Council' (NIC) on 10th September 2011, attended by all the members of NIC, including the Chief Ministers of the States in India.

However, the following five Chief Ministers skipped the NIC-Meeting for obvious reasons that they are against the bill:

How is the President of India Elected?

Eligibility and Conditions for the Candidate for the President of India:

Article 58 of the Indian Constitution sets the principle qualifications for becoming the President of India. Accordingly the person to be elected as the President of India must be:

a citizen of India
of 35 years of age or above
qualified to become a member of the Lok Sabha

A person shall not be eligible for election as President if he/she holds any office of profit under the Government of India or the Government of any State or under any local or other authority subject to the control of any of the said Governments, except the following:

The current Vice President.
The Governor of any State.
A Minister of the Union or of any State.

The President of India should not:

Be a member of either House of Parliament or
Be a member of a House of the Legislature of any State ,and if a member of either House of Parliament or of a House of the Legislature of any State be elected President, he shall be deemed to have vacated his seat in that House on the date on which he enters upon his office as President.
Hold any other office of profit.

Procedures for Election of the President of India:

The manner of election of President of India is as per Article 55 of the Constitution of India.

Whenever the office becomes vacant, the new President is chosen by an electoral college consisting of:

the elected members of both houses of Parliament and
the elected members of the State Legislative Assemblies.

The President of India is elected indirectly by the members of the Indian Parliament and by the individual States' Legislative Assemblies.

The election is held in accordance to the system of Proportional Representation by means of Single Transferable Vote method.

Each elector casts a different number of votes.

The general principle is that the total number of votes cast by Members of Parliament equals the total number of votes cast by State Legislators.

Also, legislators from larger states cast more votes than those from smaller states.

Finally, the number of legislators in a state matters; if a state has few legislators, then each legislator has more votes; if a state has many legislators, then each legislator has fewer votes.

The actual calculation for votes cast by a particular state is calculated by dividing the state's population by 1000,

which is divided again by the number of legislators from the State voting in the Electoral College.

This number is the number of votes per legislator in a given state.

For votes cast by those in Parliament, the total number of votes cast by all state legislators is divided by the number of members of both Houses of Parliament.

This is the number of votes per member of either house of Parliament.

The Voting will take place by secret ballot system.

Although, Indian presidential elections involve actual voting by Members of the Parliaments (MP'S) and the Members of the Legislative Assemblies (M.L.A.'s) , they will tend to vote for the candidate supported by their respective parties.

In India, the Office of the President of India was established on 26th January 1950, under Article 52 , Part V of the Constitution of India.
What is the role of the President of India?:-

The role of the President of India has got a vast range of duties and responsibilities and the President of India has got the supreme power as the first Citizen of India.

The President of India has got the formal and conventional privileged rights and powers to:

Summon both the Houses of the Parliament of India and prorogue them and
Dissolve the Lokh Sabha,

according to the advice of the Council of Ministers headed by the Prime Minister of India.

The President of India has got the privilege and powers and the responsibility to:

Inaugurate the Parliament by addressing after the General Elections and

At the beginning of the first session each year to outline the new policies of the government.

All the Bills passed by the Parliament (in both the Houses) will become ‘laws’ only after the approval of the President of India. The President has got the power to return any non-money bill for reconsideration. The President can also withhold any bill passed in the Parliament (in both the houses).

When both Houses of the Parliament are not in session and if government feels the need for immediate action, President can promulgate ordinances which have the same force and effect as laws passed by Parliament.

In the event of a hung parliament, where no party has absolute majority in the Lok Sabha, the President will invite parties to command the required support and form the government. If the majority is still not achieved President can call for a new election.

The President will appoint the Prime Minister and the other members of the Council of Ministers, distributing portfolios to them on the advice of the Prime Minister.

The President is responsible and empowered to appoint:

Governors of States
The Chief Justice, other judges of the Supreme Court and High Courts of India.
The Attorney General
The Comptroller and Auditor General
The Chief Election Commissioner and other Election Commissioners
The Chairman and other Members of the Union Public Service Commission
Ambassadors and High Commissioners to other countries.

The President will receive the credentials of Ambassadors and High Commissioners from other countries.

The President is the Commander in Chief and the Supreme Commander of the Indian Armed Forces.

The President can declare war or conclude a war , subject to the approval of parliament under the decision of the Council of the three Armed Forces Chief staffs, Military Secretary and President's Officer.

The President of India can declare three types of emergencies:

national,
state and
financial.

Financial Powers of the President of India:

All money bills originate in Parliament upon the recommendations of the President of India.

The President will cause the Annual Budget and supplementary Budgets before Parliament.
And no money bill can be introduced in Parliament without the assent of the President of India..

The President of India will appoint a ‘Finance Commission once in every five years.

Judiciary Powers of the President of India:

The president has got the powers to appoint:

the Chief Justice of the Union Judiciary and
other judges

on the advice of the Chief Justice.

No criminal proceedings can be initiated against the President of India during his/her term in office.

And the President of India is not answerable for the exercise of his/her duties.

The President of India has got the powers to grant a pardon to or reduce the sentence of a convicted person for one time, particularly in cases involving punishment of death.

The decisions involving pardoning and other rights by the president are independent of the opinion of the Prime Minister or the Lok Sabha majority.

And mostly the President of India used to exercise his or her executive powers on the advice of the Prime Minister of India.

However, there is no time limit within which the President has to dispose of a Mercy Petition for granting a pardon or commuting a death sentence to life time imprisonment.

Can the President of India play his/her role a the Head of the Nation independently?:

As per the Indian Constitution, the President of India is:

the Administrative Head of the Government of India and
the first Man/Woman of India.

However, in practice, the President of India mostly may appear to be a mere head for the name's sake nodding to the tunes of the ruling government.

In the past the President of India was referred to as a mere 'rubber stamp' affixing his/her assent to all the bills passed by the Parliament of India.

It depends on the person holding the post of the President of India to use the powers diligently and live up to the expectations of the Constitution of India.

In fact, the role of the President of India is having real independent and exclusive power to control the activities of the Parliament of India and the ruling government of India at the centre and the state governments.

During the times when the country is having a civil war or war against a neighboring country, the role of the President of India is vital.

The following is a detailed List of Public Sector/Nationalized /Private Sector/Foreign/Commercial Banks in India:

STATE BANK OF INDIA-Is the Largest and the Oldest Commercial Bank - Originated in the year 1806- and the First Commercial Bank nationalized in India in the year 1955 which is of and for the Government of India.

The following 7 commercial banks were nationalized and made the Subsidiaries of State Bank of India ( 4 in the year on 19th July 1960 and 3 on 19th July 1969) :

State Bank of Hyderabad (SBH)-Founded by the last Nizam of Hyderabad in the year 1941-(Nationalized in 1960),
State Bank of Mysore (SBM)-Established in 1913 as by (late) Dr. M. Visvesvaraya under the sponsorship of the then Government of Mysore- (Nationalized in 1960),
State Bank of Patiala (SBP)-Founded on 17th of November, 1917 by His Highness Bhupindar Singh, the Maharaja of the princely state of Patiala- (Nationalized in 1960),
State Bank of Saurashtra (SBS) ,
State Bank of Travancore (SBT)-Founded in the year 1945- (Nationalized in 1960),
State Bank of Bikaner and Jaipur (SBBJ)-Founded in 1963 at Jaipur- (State Bank of Bikaner founded in 1944 took over the State Bank of Jaipur founded in 1943)- (Nationalized in 1969) and
State Bank of Indore (SBIR)-Founded in the year 1963- (Nationalized in 1969)

The following 14 Major Commercial Banks were nationalized on 19th July 1969 during the then Prime Minister of India, Mrs.Indira Gandhi:

Central Bank of India-Founded by Sir Sorabji Pochkhanawala at Mumbai in the year 1911.
Bank of Maharashtra-Founded on 16th September 1935 at Pune
Dena Bank-Founded on 26th May 1938 by Devkaran Nanjee family
Punjab National Bank-Founded in Lahore in the year 1894
Syndicate Bank-Founded in Karnataka in the year 1925
Canara Bank-Founded on 1st July 1906 at Bangalore
Indian Bank-Founded on 15th August 1907 as a part of Indian Swadeshi Movement at Chennai (then Madras)
Indian Overseas Bank-Founded in the year 1937 at Chennai (then Madras)
Bank of Baroda-Founded in the year 1908 in Baroda
Union Bank of India-Inaugurated by Mahatma Gandhi in November 1919 .
Allahabad Bank-Founded by a Group of Europeans on 24th April 1865 at Allahabad
United Bank of India-Inaugurated by Mahatma Gandhi in November 1919 – nationalized in 1975
UCO Bank-Founded in 1943 by Birla at Kolkata (the then Calcutta)
Bank of India-Founded in September 1906 at Mumbai

IDBI Bank Ltd -IDBI-Industrial Development Bank of India was established as a subsidiary of Reserve Bank of India-RBI on 1^st July 1964. From 1^st October 2004 IDBI Bank Ltd started commencing as a Full Service Commercial Bank.

The following 6 Commercial Banks were nationalized in the year 1980:

Bank of Maharashtra-Founded on 16^th September 1935 at Pune
Corporation Bank-Founded in the year 1906 at Udupi in Karnataka
Dena Bank-Founded on 26^th May 1938 by Devkaran Nanjee family
Oriental Bank of Commerce-founded in Februray 1943 at Lahore
Punjab and Sind Bank-founded at Amritsar in the year 190
Vijaya Bank -established by Mr.A.B.Shetty on 23^rd October 1931
