Austin : Alleged serial rapist found deceased - Esme Barrera

APD update on Jan. 1, 2012 E. 31st Street Burglary with Intent to Commit a Felony

On January 1, 2012 at about 5 a.m. in the 300 block of E. 31^st Street, a woman was attacked by an unknown male suspect in her home. The Austin Police Department DNA Laboratory conducted a thorough examination of all the evidence recovered from the crime scene. During the examination, DNA scientists were able to locate a male DNA profile from evidence at the scene. Sex Crimes detectives recognized similarities between one of the events that occurred during the early morning hours of January 1, 2012 and a series of attacks that occurred in South Austin last summer. Detectives requested DNA comparisons from APD’s DNA laboratory using the evidence in the E. 31^stStreet case. DNA scientists manually compared the DNA profile that they obtained from E. 31^st Street and were able to link that (unknown) suspect profile to four assaults that occurred in South Austin:

Assault with Injury that occurred July 1, 2011 at about 3:43 a.m. in the 4300 block of S. Congress Avenue
Attempted Sexual Assault that occurred July 8, 2011 at about 5:37 a.m. in the 1400 block of S. Congress Avenue
Assault with Injury that occurred July 8, 2011 at about 6:41 a.m. at S. 1^st Street and Barton Springs Road
Assault with Injury that occurred September 11, 2011 at about 8:30 a.m. at Comal and Haskell Streets

The suspect description in each of the four earlier unsolved cases involved a Black male suspect with a similar physical build described in each.
On January 12, 2012, Homicide detectives responded to the 3000 block of Guadalupe on a deceased person call. The decedent’s roommate returned home after a holiday break and found his roommate James Loren Brown, Black male, 11/20/1986, deceased from an apparent suicide. During the investigation, the Homicide detective and a Crime Scene Unit (CSU) specialist noted that the residence was a short distance from the 3100 block of King Street, which is where Esmeralda Barrera was murdered on January 1, 2012. There had also been an assault with injury about 30 minutes before the murder in the same block. The victim in that assault described her assailant as a Black male and provided information for a composite sketch. The Homicide detective and CSU specialist observed that a photograph of Brown at the scene resembled the composite sketch and Brown had a similar physical build. No apparent reason for the suicide was found during the preliminary investigation.
On January 13, 2012, Homicide detectives returned to Brown’s residence and seized several items. APD DNA scientists were able to isolate a DNA profile from one of the seized items and compared it to the unknown male profile from the E. 31^st Street case. On January 25, 2012, DNA scientists were able to confirm that the tests results linked Brown to the E. 31^st Street case. Therefore, Brown is also a suspect in the four other unsolved cases that have been connected through DNA evidence. The circumstances of the four unsolved cases are similar to the circumstances of the assault with injury that occurred about 30 minutes before Esmeralda Barrera’s murder and in the same block.
The Austin Police Department Homicide Unit is investigating James Loren Brown as a suspect in the two other cases that occurred on King Street during the early morning hours of January 1, 2012. This includes Esmeralda Barrera’s murder. We consider Brown a suspect, but there is a considerable amount of investigative work to be completed. The DNA scientists are examining a significant amount of items that were seized from Brown’s residence. APD’s Digital Analysis Response Team is also examining electronic items seized from Brown’s residence. Homicide detectives are conducting interviews to learn more about Brown, and Sex Crimes detectives are re-interviewing and presenting photograph lineups to victims in possible other cases where no DNA evidence was present.
Homicide detectives will maintain all investigative efforts to either continue to include Brown as a viable suspect in Esmeralda Barrera’s murder or exclude Brown from further consideration.
We are still very early in the investigation into this new lead, and we are asking for assistance from the public. First and foremost, we are asking anyone who saw or had contact with James Loren Brown on New Year’s Eve or during the early part of January 2012 to contact the Homicide Tip Line at(512) 477-3588. Homicide detectives are also seeking information from anyone who knew James Loren Brown, especially anyone who may have received or bought property from Brown.
The Austin Police Department wishes to express its gratitude to the Austin community for all the help and support received over the last few weeks. We will continue to work diligently to identify who murdered Esmeralda Barrera and hopefully bring some closure to her family, many friends, and those in the community who have grown to know Esmeralda and embrace her memory.

Austin : City of Austin and other major companies to hold job fair at Parmer Events Center

Event will focus on building a stronger community

The City of Austin, in partnership with Travis County and other local employers, will host the Community Job and Resource Expo January 25 in an effort to build a strong community by providing opportunities for career development, job opportunities and community services.

The free annual event will be from 2 to 7 p.m. at Palmer Events Center, 900 Barton Springs Road. It is sponsored jointly by the City of Austin and Travis County human resources departments.

Last year’s City of Austin Job Fair was attended by more than 3,500 job seekers. “We are fortunate that the improving economy is yielding more opportunities for jobs in the Austin area and believe this year’s community job expo will be successful in connecting job seekers with potential jobs,” said City’s Human Resources Director Mark Washington.

The event will include more than 50 employers and non-profit resource agencies.

Attendees will learn about more than 1,000 available part and full time positions throughout the community in the areas of information technology, customer service, public events, maintenance, community service, recreation, administration and finance.

Participants will have opportunities to meet face-to-face with human resources professionals, and representatives from the City of Austin and Travis County, as well as other employers and temporary staffing agencies including; Apple One, Capital Metro, e-Bay/PayPal, Evins Personnel Consultants, Inc., Express Employment Professionals, Goodwill Staffing, Hawkins Personnel Service, Home Depot, Keystaff, Inc., Lowes, McDavid Automotive, Peak Performers, Pflugerville ISD, Seton Family of Hospitals, State of Texas, Time Warner Cable, Univision Radio Broadcasting, and Wells Fargo.

Additionally, the expo will provide dozens of volunteer opportunities for participants. Workshops on interviewing and resume writing will be available as well as a free computer lab.

Free parking will be available in the Palmer Events Center garage.

Those attending the fair will be able to turn in job interest forms to hiring agencies at the event and participants are encouraged to apply for a City of Austin job online before the event. Participants are encouraged to bring current copies of their resumes.

The RAND Corporation and Mary Catherine Kelly Beyond the Long Shadow of 9/11

As many of you have surmised, Mary Catherine is a pseudo name to protect her and her family from additional retaliation by RAND’s law firm, representatives and insurance company. Unbeknownst to Mary is the fact that RAND’s surrogates were and are informing future employers that she is not eligible to return to RAND while leaving out the fact that RAND told Kelly to look for new employment less that 20 days after September 11, 2011— Pentagon ground zero. So it appears that MC Kelly is not telling the truth about her work experience. However she is speaking the truth about her DoD detail. It is RAND not articulating the truth. Kelly understood from the paper work and DoD officials that her position would continue for FY 2002 at the Pentagon.

Not until the last few months ending in 2011 did Kelly learn that RAND maintains a couple of records stating she was an IPA. Yet orally RAND states that she was strangely never an IPA assigned to DoD. Why is The RAND Corporation denying that Mary Catherine Kelly was ever detailed to the DoD as an IPA for FY 2001 and FY 2002? A fiscal year begins in October and ends on the last dayof September (October 1, 2011-September 30, 2012 is FY12)? Why would RAND representatives after 10 years finally inform Mary Catherine that she NEVER served as an IPA detailed to the DoD during FY01 & FY02? And the DoD can’t seem to find any of her national security clearance records. The fact is that the DoD paid RAND to pay Kelly. RAND was not using any of its own funds for Mary Catherine’s salary and benefits to her knowledge. In fact after completion of her IPA, Mary Catherine was obligated to share what she learned at the DoD with RAND. But what did RAND convey to DoD as the reasons why Mary Catherine would not be completing her DoD detail? RAND never shared those communications with Mary. Why?

One of the problems RAND has created for Mary Kelly and the federal government is that her employment cannot be verified, if one relies solely on RAND's documents and statements. It also provides RAND and the Insurers with on-going justifications why they should not be required to reimburse Mary for her out of pocked medical expenses pursuant to a 2003 award. Kelly is fighting several wars: receiving her out-of pocket medical expenses directly related to being in ground zero on 9/11/2001 and trying to stay focused on her medical treatment using her own funds and cleaning up her credit ratings since she has taken from Peter to pay Paul. Companies don't hire those with a bad credit rating. Which FFRDC, if any, would strongly advise an employee to seek new employment after she barely survived a deadly attack at the Pentagon and was working to “stand-up” one of DoD’s first office in homeland security and defense? The wealth of knowledge about the inner workings of the DoD would have been invaluable to RAND and any other FFRDC or defense contractor.

Instead RAND trampled on Mary’s career and health. Mary now fears that RAND’s plans are to ask the courts to determine who should be responsible for her medical care directly related to 9/11 especially if she does not qualify under the Zadroga Act which tilts additional future health care towards those located in New York City. In Chapter Fifteen “The Link Between National Security and Compensation for Terrorism Losses” in The LONG SHADOW of 9/11, RAND’s authors acknowledge that it would be “…an unfair burden would fall on the victims themselves (to pay for their own medical care)......that could exacerbate the economic and psychological effects of the attack and serve the terrorists’ interests.” Yet, RAND does not mind placing the economic and psychological burden on Mary Catherine. “Little guidance has emerged from the courts on when private firms can be held responsible for losses caused by terrorist attacks.”

Are RAND and its Insurers using Mary Catherine’s experiences in 9/11 as a “test” case to escape reimbursing her while providing free health care to those employees who were not located in ground zero and set a legal precedence for all other corporations? RAND’s competing theories: having Mary Catherine responsible for her own 9/11 health care versus publically advocating for a compensation system that could “promote social cohesion and unity”. With RAND’s close affiliation with the U.S. military, is Mary Catherine vulnerable to the 2012 Defense Authorization Act which allows for the unlimited detention of American citizens? Due to RAND’s blood relationship with the Legislative, Executive and Judicial branches of government, should Mary Catherine live in fear that her experiences with the federal government’s representative RAND makes her susceptible to the provisions of the 2012 Defense Authorization Act? Will she be labeled as an “enemy” of the State under the provisions of the Act?

Would Mary Catherine be held in detention so that RAND could continue speaking about survivors of terrorists attacks (even natural disasters) with a forked tongue ? Who is really in control of RAND and why would RAND risk its corporate reputation on one 9/11 survivor? Mary Catherine is still paying for her own 9/11 medical care -100% out of pocket. Her credit has been ruined. Her employment has been unstable since RAND advised Mary to seek new employment opportunities less than 20 days after 9/11/2001. And RAND still denies that she was detailed to the DoD. But friends in high places continue to protect each other. And RAND is protected by Kelly’s own representatives: U.S. Senators Cornyn and Hutchison. Now that is loyalty at the cost of a constituent and the truth. RAND is still a FFRDC receiving funding from the federal government to conduct policy studies impacting very aspect of our lives but their work behind the scenes is another story.

On another front, the local bar counsel in Washington DC ruled that there was not enough evidence to determine that Kelly’s former attorney maintains any original documents or that he failed to return Mary Catherine's files timely. Is timely delivery considered more than 4 months in any other jurisdiction? Mary Catherine responded to her former attorney's withdrawal notice by asking him to send all files to her either in hard copy or on disc by email and certified mail. Neither the former attorney nor his world-wide law firm would respond to Catherine's simple request for her files. Simultaneously, this venerable law firm never informed Mary Catherine that they were writing the administrative body presiding over the case for the release of all of her sealed records subject to protective order and never informing Kelly of their actions to one administrative judge in particular.

How could Mary find new representation as soon as possible with either no documents or time frame to anticipate receipt of her files? The local bar counsel disregarded Mary's notice that the electronic files were different than the hard copies. Her lawyer was the repository of every document in this case: depositions , errata sheets as well as award documents. He cannot locate crucial evidence given to him for safe keeping. So where are the rest of the Kelly’s files including the video of her opening of the 9/11 mortuary bar returned to Mary after it was recovered in ground zero by the Pentagon (DoD).

Multiple Aggravated Robbery Suspects Identities Sought.

Dallas-Dallas Police Robbery Detectives are asking for the public’s assistance in identifying two suspects who are responsible for up to seven aggravated robberies.

The most recent offense occurred at 11:15 a.m. on January 7, 2012 at the EZ Money Loan Services located at 5365 Spring Valley Rd. This offense is documented on case # 5625-Z

The two suspects entered the location, jumped over the counter, and demanded money from the register and safe. One of the suspects was armed with a chrome semi-automatic handgun. The suspects forced the employee to a back room when they discovered she could not open the safe. They then took the money that was in the register and fled the location by unknown means.

Suspect #1 is described as a black male in his early 20’s, standing 5’08” and weighing 150 lbs., wearing a white hooded sweatshirt, red t-shirt and black or blue cap with a red bill.

Suspect # 2 is described as a black male in his early 20’s, standing 6’00” and weighing 220 lbs., wearing dark jeans and a dark hooded sweatshirt.

The two suspects are also believed to be responsible for the following offenses:

Yesterday, the city of Austin had a press release announcing a $3 million grant from the U.S. Department of Housing and Urban Development(HUD). Austin was one of twenty-seven cities throughout the nation to receive funds. This is a welcome site for the Colony Park neighborhood and surrounding neighborhoods.

In July, Colony Park was firmly placed on the front page of the Austin American-Statesman due to a crack down nationwide on Cartels, in particular the La Familia was busted in the neighborhood. Then in September, the newly built Turner-Roberts Recreation Center was ordered to be shutdown, due to cracks and an unsuitable foundation. On November 30, 2011, the Statesman ran another story about the problems at Turner-Roberts Rec and once again Colony Park was prominently featured on the front page.

So, it was only fair to the community that they were chosen to receive this funding. Austin received more than any of the twenty-seven cities. This project will mix single family residences with mixed-use developments. The surrounding neighborhoods consist of the L.B.J neighborhood, Lakeside neighborhood, Park Place neighborhood, Sendero Hills Neighborhood and several trailer parks along with other smaller neighborhoods.

Some of the residents requested high end retail and plenty of green space for walking, jogging and cycling. This neighborhood lacks jobs and seems to be an island from the rest of Austin due to no shopping areas or grocery stores. A grocery store definitely should be assessed in order to bring all these neighborhoods together to a central location.

The event brought out Mayor Lee Leffingwell, Councilmember Mike Martinez and a host of HUD representatives and city officials.

Congressman Lloyd Doggett(Austin) was scheduled to attend but had a change of plans prior to the press conference.

Sarah Jackson, with the Colony Park neighborhood association stated,

"I see it as a positive thing, because when you have an area like you do Mueller, you just see something positive for your neighborhood," Jackson said. "You know, because it just looks rich looking,".

Mueller, another mixed-use development in east Austin, is a successful development, to whom Colony Park residents wish to pattern their new development after.

City officials stated that it would take about three years to fully understand what will be developed on this city-owned land.

With all the previous negative accounts of Colony Park, this deal will surely leave a sweet taste in the community's mouth once established.

In the past few weeks, there has crept onto the scene, a number of disturbing incidents involving high profile sports figures allegedly molesting black boys.

One of the main reason this is continuously happening, is that many of the disadvantaged children's parents choose not to participate in their child's future. They leave others to care for their children such as non-profit organizations who claim to have their children's best interest at hand. When it is only the round brown that they only seek to receive. Not saying all parents are like this, but there are some who don't care and really are happy to get rid of the children for the weekend to be served up on a platter to these vampires.

Not only are we looking at the parents, but why is pedophilia so prevalent in our society? Is it that the rich are keeping this process alive, by preying on poor children, who grow up in single parent households and are in search of positive role models? What are the symptoms that we should look for with this sickness of pedophilia? I've noticed that in order to treat a sickness, we must diagnose the problem.

Pedophilia is a problem that must be addressed in the Black communities like yesterday. This illness is destroying the fabric of our families and causing us to spiral into a state of homosexuality. I hear people claim that they are born gay, but the problem of homosexuality seems to stem from pedophilia. Not saying I'm anti-homosexual, I'm just trying to address some of our ails as a community of people who have been downtrodden by so many other contributing factors, including slavery, aids, drugs, lack of education and other issues.

First, a Gay Duke official tried to serve up his adopted son, who was five, to an undercover officer. Then the Penn State scandal exploded; another one leaked a few days later- former Boston Red Sox Manager sexually molested black boys.

With all that being said, Black man, it's time to stand up and be a father to your children, whether you want to or not, our survival depends on it. Now, some whites may say that all these racial issues are old and should stop, but I beg to differ and will say that the U.S.A was founded upon racial factors and will die upon it, which leads to my last and final point.

The United States of America, standing for out of many comes one, says to me that if we continue to look down upon Blacks and not help with their problems or have compassion to their issues, this will be the death of America as we know it.

November 16, 2011 (WASHINGTON) – Tomorrow, November 17, Rep. Bennie G. Thompson (D-MS), Ranking Member of the Committee on Homeland Security, will sponsor a briefing on Capitol Hill to explore the viewpoints of representatives from the Brennan Center for Justice, Center for American Progress, and the American Civil Liberties Union. The briefing is entitled: “Islamist Radicalization: Myth or Reality?”

In recent months, an active national debate concerning the existence of “violent Islamist radicalization” within the United States and among U.S. citizens has been revived. Recent media reports have detailed partnerships between the New York City Police Department and the Central Intelligence Agency. Federal funds have been used to train local police officers in clandestine intelligence-gathering practices deployed in predominantly Muslim-American neighborhoods, raising serious questions about the constitutionality, practicality, and effectiveness of these surveillance tactics. Additionally, private funding sources have supported entities that encourage the belief in a domestic threat of Islamist radicalization within the United States . Unfortunately, this incendiary atmosphere has failed to provide a forum for rational, fact-based discussion of the possible extent of radicalization and potential methods to address it. This forum will lay the foundation for such a discussion.

Austin's Turner-Roberts Recreation Center to Remain Closed Indefinitely

With the closing of the Turner-Roberts Recreation Center in Austin, completely leaves a void in the neighborhood it was built to accommodate. In 2008, the long awaited Colony Park Recreation Center, now named for Dorothy Turner and Velma Roberts, who long fought for this parks and recreation project to be established in this neighborhood, within the city of Austin.Turner and Roberts, who founded the Black Citizen's Task Force, were avid civil rights activist for the voiceless in East Austin.

In September of 2011, the community found out that the recreation center was scheduled for closing to repair construction errors that had been created from a lack of oversight on behalf of the Parks And Recreation Department.

In April 2011, MLAW Consultants and Engineers were hired to do a preliminary report of findings. Also a revised copy was sent out in May 2011, to which it was stated that "Construction errors appeared to have contributed to the majority of the distress and non-performance of the foundation and some of the concrete masonry unit walls." It was also mentioned that there were three leaks found under the gymnasium floor, that may have had an impact on the floor shifting. There were drainage issues near the back and sides of the building from the air conditioning and also from rain storms that would accumulate.

Journeyman Construction, who was the general contractor on the project, wasn't available for comment. We also tried contacting Victoria Air Conditioning and Phoenix Irrigation who were also unavailable for comment. Journeyman Construction received nearly Four million dollars for this project.

With the closing of this much needed rec center and the sudden explosion of gang activity, creates a unique situation for the residents of Colony Park, Lakeside, Sendero Hills, and LBJ neighborhoods.

All interested parties should attend the meeting below and call for some action to be taken within the Parks and Recreation Department for the lack of oversight when it comes to East Austin. Now is the time residents let city officials know, that this will no longer be tolerated as business as usual on the east side.

The 2012 City of Austin Charter Revision Committee has established several ways to engage the community as it considers possible charter recommendations including geographic representation through districting, term limits and the authority for City Council to make certain appointments.

Dallas Complete Streets to meet with citizens regarding Ledbetter/Camp Wisdom Corridor

Dear Citizen,

If you haven’t received an e-mail or information on this already, we would like to introduce the Dallas Complete Streets Initiative the City is working on currently. This initiative will develop a new approach to designing your streets that are “complete” in accommodating all users, children, old, physically disabled, bicyclists, and transit users in a safe and efficient manner, while complimenting more transportation choices like cars, bikes, train, buses, streetcar, etc. The key focus of this new approach will be about what neighborhoods want to see on their streets. The City of Dallas will host a series of workshops and open houses (see attached flyer for details) to inform the public about the Complete Streets Initiative and seek input on how streets can better serve the needs of the community. Each open house and workshop will feature a different pilot street project and give residents the opportunity to learn about and provide input on the Complete Streets Initiative and share ideas for future improvements.

The workshop for your area is scheduled on Wednesday, November 9, 2011 at UNT-Dallas, 5:30 to 8:00 p.m.(see attached flyer for details). This afternoon, a group of Occupy Dallas demonstrators marched from City Hall to a Chase Bank located at Main and Akard. Once there, the demonstrators blocked the entrance ways to the bank, thus not allowing patrons to utilize the bank. Representatives with Chase Bank asked the demonstrators to leave the property in the presence of Dallas Police Officers. The demonstrators were told they would not be arrested if they complied with the criminal trespass warning and vacated the property; however, numerous demonstrators refused to leave. As a result, 23 individuals were subsequently arrested for Criminal Trespass. One police officer received minor injuries to his leg during the incident.

            Fort Hood, Texas, has played a highly  prominent role in the Global War on Terror,                deploying more members of the Armed Force into overseas theaters of combat 

             since September 11, 2001.

            On November 5,  2009, 13 Americans – 12 service members and one civilian employee 

            of DoD  – were killed and 32 were wounded  in an attack at the military base at

            Fort Hood. This tragedy was the deadliest terrorist attack within the United States

            since September 11, 2001.  

            In the wake of the brutal September 11, 2001, terrorist attacks on the United States, 

            Federal Government set a historicalprecedent when  it awarded the victims of those                attacks who were members of the Armed Forces with the Purple Heart medal

            and the victims of those attacks who were civilian employees of the Department 

            of Defense with the Secretary of DefenseMedal for the Defense of Freedom.
