An extension of the post-study work arrangements from 2013.

Post-study work arrangements for university graduates will be available for:

Graduates who complete their Bachelor degrees after at least two academic years’ study in Australia will be eligible for a two year stay;
Graduates who complete their Masters degrees after at least two academic years’ study in Australia will be eligible for a three year stay; and
Graduates who complete their PhD after at least two academic years’ study in Australia will be eligible for a four year stay.

The existing Temporary Skilled Graduate (Subclass 485) visa, which provides for a stay of 18 months for those with qualifications in eligible fields of study, will still be available.

The announcement also states that post-study work arrangements would apply to Bachelor or higher degree graduates from other education providers accredited to offer degree level programs, in addition to university graduates.

Work and Holiday Visa for Argentina

Minister Bowen today announced that Argentina has been added to the list of countries which have access to the Work and Holiday (Subclass 462) visa arrangements.

Work and Holiday visas are currently available for Bangladesh, Chile, Indonesia, Iran, Malaysia, Thailand, Turkey and the USA.

On 12 October the Minister announced that Papua New Guinea (PNG) would be added to the list.

PNG will have 100 visas, and Argentina 500.

The actual date of these visas being available has yet to be announced.

New English Language Tests for Student Visas from 5 November 2011

From 5 November 2011, the department will accept English language test results from the following alternative tests to the International English Language Testing System (IELTS) for Student visa purposes taken in any country:

Test of English as a Foreign Language internet-based test (TOEFL iBT)
Pearson Test of English (PTE) Academic
Cambridge English: Advanced (CAE) test (also known as Certificate in Advanced English).

Carer Visa ไม่ง่ายอย่างหลายๆคนคิด

Carer Visa คือ visa ที่ทำขอ PR ให้คนใน family เพื่อมาดูแลคนป่วย ซึ่งคนไทยเราอาจจะไม่คุ้นเคยนัก เพราะไม่ค่อยมีคนไทยขอ Visa แบบนี้กัน คนไทยส่วนมาก พอเริ่มแก่ตัว ก็อยากจะกลับเมืองไทย ไปอยู่กับครอบครัวกัน เพราะ culture ของคนไทยเรา เราชอบอยู่กันเป็นแบบ big family พ่อ แม่ ลูก ปู่ ย่า ตา ยาย ลูง ป้า น้า อา อยู่ด้วยกัน แต่อ่านไว้ รู้ไว้ เป็นความรู้หน่อยก็ดีนะครับ

หลายๆคนคิดว่า พอตัวเองป่วยหรือไม่สบาย ก็สามารถทำเรื่อง sponsor เอาลูกหลานมาดูแลได้เลย อยากจะบอกว่ามันไม่ง่ายอย่างที่คิดนะครับ

สิ่งที่หลายๆคนควรจะทราบคือ:

- คนป่วยต้องไป check กับหมอของ Department of Immigration เท่านั้น จะเอาใบรับรองมาจากหมอส่วนตัว หรือหมอทั่วๆไปไม่ได้
- เนื่องด้วยรัฐบาลที่นี่ก็มีสวัสดิการ อะไรเยอะแยะมากมายอยู่แล้ว และทางรัฐบาลเองก็อยากให้คนใช้สวัสดิการเหล่านั้น แทนที่จะ sponsor เอาคนมาจากที่อื่นเพื่อมาดูแลคนป่วย

อย่างที่บอกแหละครับ ไม่ง่ายอย่างที่คิดกัน การที่เราจะยื่นเรื่องทำ carer visa ได้นั้น case เราต้อง strong จริงๆ ถึงจะทำเรื่องได้

Getting private health insurance for visa 457 is not that hard or expensive like many people think.

I just talked to Medibank Private Health Insurance about 10 minutes ago.
Here are the things that everyone should know.
- It's true that you need to buy the private health insurance for 4 years, but you can make arrange to pay this on monthly basis, work out be at $105.00 per month, as of today.
- There is no contract, so you could cancel this anytime. If your visa application is not successful, then you can just simply ring them up and cancel your policy.
- As of today, it got 30 days cooling off period. So, if anything go wrong with your visa application within this 30 days, you can just call it off and get your money refund...

oh...BTW... I am doing this not to promote Medibank or whatever. I didn't get any commission or any benefit of doing it. This is purely for a benefit of people who are worries (some of my clients do) about the cost of 4 years private health insurance that they need to pay when they submit their visa application; 457.

It's not that hard as you might think...people...ask or consult the one who knows...:)

working visa ที่คนไทยเรารู้จักกัน แต่ถ้าเรียกอย่างเป็นทางการ ก็คือ visa subclass 457 ซึ่งหลายคนก็ให้ความสนใจกันพอสมควร โดยเฉพาะคนที่ทำงาน ร้านอาหาร ร้านนวด และคนทำงานเลี้ยงดูคนแก่ สาเหตุก็คงเป็นเพราะพวกที่เรียนที่ TAFE หรือ private college ต่างๆ นั้น ไม่สามารถเอาสาขาวิชาที่เรียนมาไปขอ PR เองได้ หลายๆคนก็เลยกะจะทำ working visa แล้วให้นายจ้างทำเรื่องขอ PR ให้ทีหลัง

หลายคนสนใจและสอบถามข้อมูลกันเข้ามาเยอะ แต่ก็อยากจะบอกว่า working visa นั้น ไม่ได่ทำกันได้ง่ายๆนะครับ เพราะตอนนี้รัฐบาลก็พยายามสงวนงานไว้ให้คน Oz เหมือนกัน และที่สำคัญคือ นายจ้างต้องจ่าย minimum salary rate ตามเงื่อนไขของ visa subclass 457 ซึ่งตอนนี้ minimum salary rate ตามเงื่อนไขของ visa subclass 457 ก็ตกอยู่ที่ $49,330 ต่อปี ซึ่งตรงจุดนี้ก็อยากจะให้ ทุกคนระลึกถึง condition ตรงนี้เอาไว้ด้วย ยังไงเสีย ก่อนที่จะตัดสินใจอะไรลงไป ก็แนะนำให้ทั้งนายจ้างและลูกจ้างให้คุยกันถึงจุดนี้ด้วยนะครับ

หลังจากที่ทำงานทางด้าน "immigration" มาได้สักระยะหนึ่ง ผมก็ได้สังเกตุเห็นปรากฏการณ์อย่างหนึ่ง นั่นก็คือ หลายๆคนพยายามแทบจะทุกวิถีทางเพื่อที่จะได้ PR หรืออยู่ที่นี่อย่างถูกต้อง อย่างถาวร หลายๆคนอยากอยู่ที่นี่ เพื่อชีวิตและความเป็นอยู่ที่ดีขึ้น หรือไม่ก็เหตุผลส่วนตัวอีกหลายๆอย่าง

แต่ในขณะเดียวกัน ก็มีอีกหลายคนที่ได้ PR หรือได้มาอยู่ที่นี่ได้ไม่ยากนัก โดยเฉพาะเด็กๆที่ติดตามแม่มาอยู่ที่นี่ เพราะแม่แต่งงานใหม่กับสามีฝรั่ง ง่ายๆ สั้นๆ คือลูกแทบไม่ได้ทำอะไรเลย เพราะแม่ดิ้นรนและดำเนินเรื่องทุกอย่าง คนเรานะพอได้อะไรมาง่ายๆ ก็มักไม่เห็นคุณค่า ก็ใช้ชิวิตไปวันๆ ไม่เรียน ไม่ทำงาน รอเงิน support จากรัฐบาล

ซึ่งก็ตรงกันข้ามกับคนอีกกลุ่มหนึ่งซึ่งมีความรู้ความสามารถ มีการศึกษาดี แต่ต้องรอเข้าคิว กว่าเรื่อง PR จะได้ทำการ

ก็อยากเหลือเกินนะครับ ขอร้องคนที่ได้ PR กันหลายๆคน ให้เห็นคุณค่าของ PR ที่ท่านได้มา (อย่างง่ายดาย)กันนิดหนึ่ง เรียนหนังสือ ทำงานทำการ จ่ายเงินภาษีให้กับรัฐบาล ทำเป็นให้เป็นประโยชน์ต่อสังคมนิดหนึ่ง ตอบแทนบุญคุณประเทศและแผ่นดินที่มาอาศัยเค๊าอยู่กันหน่อย อย่าทำตัวเป็นปลิง ที่คอยแต่จะดูดเลือด ขอเงินรัฐบาลกิน สงสารคนที่เค๊าทำงาน จ่ายเงินภาษี support พวกคุณกันหน่อย หรือไม่ก็เห็นใจคนอีกหลายๆคนที่เค๊าอยากจะได้ PR กันมั่ง

ลูกชาย 19 จะสามารถสปอนเซอร์เค๊าได้มั็ย

เมื่อวาน มีพี่คนไทยคนหนึ่งโทรมาปรึกษา เพราะพี่คนนี้เพิ่งแต่งงานใหม่ กับสามีฝรั่งชาวออสซี่ พี่เค๊ากำลังจะทำเรื่องขอ PR และอยากจะเอาชื่อลูกชายใส่เข้ามากับใบสมัคร พร้อมกันเลยทีเดียว แต่ลูกชายอายุ 19 แล้ว ไม่ทราบว่าจะสามารถทำเรื่องไปเลยทีเดียวพร้อมกันได้มั๊ย

คำตอบก็คือ ทำเรื่องไปเลยทีเดียวพร้อมกันไม่ได้นะครับ เพราะลูกชายตอนนี้อายุ 19 ปีแล้ว ลูกที่สามารถทำเรื่องไปเลยพร้อมกันทีเดียวกับแม่ต้องมีอายุต่ำกว่า 18 ปี นะครับ

แต่ก็ไม่ได้หมายความว่า แม่จะไม่สามารถสปอนเซอร์ลูกได้เลยทีเดียว แม่ก็ยังสามารถสปอนเซอร์ลูกได้นะครับ เพียงแต่ต้องรอให้แม่ทำเรื่องผ่านก่อน แล้วค่อยทำเรื่องสปอนเซอร์ลูกทีหลัง สรุปก็คือ ต้องทำเรื่องแยกกัน ทำพร้อมกันเลยทีเดียวไม่ได้

แม่ก็ยังจะสามารถทำเรื่องสปอนเซอร์ลูกได้จนกว่าลูกจะถึงอายุ 25 ถ้าลูกยังไม่แต่งงาน และถ้าแม่ยัง support ลูกในหลายๆเรื่อง โดยเฉพาะเรื่องการเงิน

แต่ทั้งนี้และทั้งนั้น แม่และลูกก็ต้องมีหลักฐานนะครับ show ว่าแม่ยัง support ลูกอยู่ๆหลายเรื่อง ถ้ามีการโอนเงินให้ลูกอะไรประมาณเนี๊ยะ แม่ก็ต้องเก็บหลักฐานเอาไว้ show

เนื่องด้วย Spouse Visa มี 2 ขั้นตอน:
- ขั้นตอนแรก, ยื่นเรื่องผ่าน แล้วแม่ได้ Temporary Residency status หรือ TR
- ขั้นตอนที่ 2, ถ้า 2 ปี นับจากวันที่ยื่นเรื่องใบสมัคร คู่สามี-ภรรยา ยังอยู่ด้วยกัน แม่ก็จะได้ Permanent Residency status หรือ PR

แม่ก็สามารถทำเรื่องสปอนเซอร์ลูกได้ หลังจากที่ผ่านขั้นตอนแรกนะครับ คือได้ TR แม่ไม่จำเป็นต้องรอให้ถึง 2 ปี เพื่อทำเรื่องให้ลูกชาย

แทบทุกอย่างก็ต้องใช้ IELTS

จากการสังเหตุการณ์ของพี่จอห์น ก็เห็นว่าไม่ว่าจะเป็นหางานทำที่นี่ หรือจะขอ PR หรือ migrate มาที่ออสเตรเลีย เราก็ต้องมีผลสอบ IELTS กันทั้งนั้น เพราะออสเตรเลียเป็นประเทศที่ใช้ภาษาอังกฤษในการสื่อสาร ในการทำงาน และในการดำรงประจำชีวิต หลายๆคนอาจจะโต้แย้งว่า "ก็ไม่เห็นจำเป็นเท่าไหร่ เพราะคนไทยก็อยู่แต่ในกลุ่มคนไทย ทำงานกับคนไทย ก็ใช้แต่ภาษาไทย" ก็ขอบอกนะครับว่า นั่นเป็นความคิดที่แคบไปนิดหนึ่ง ก็อยากจะให้มองอะไรในวงกว้างกันนิดหนึ่ง เพราะเราจำเป็นติดต่อสื่อสารกับ เพื่อนบ้าน หน่วยงานรัฐบาล และเพื่อความเป็นอยู่ที่ harmonious กันมากขึ้น ก็ได้แต่หวังว่า society ที่นี่จะสามารถอยู่ด้วยกันอย่าง harmony

พี่จอห์นก็มีลูกค้าหลายคนที่สอบ IELTS กันหลายรอบ ก็อยากจะบอกว่าเพิ่งท้อนะครับ ก็แนะนำให้มองไปจุดหมายทีเราอยากจะได้ อยากไปให้ถึง ถ้าจุดหมายนั้นจำเป็นต้องใช้ผลสอบ IELTS คือมันก็ต้องใช้ มันหลีกเลี่ยงไม่ได้ ดังนั้นเราก็ต้องแพลนว่า เราจะทำยังไงถึงจะสอบ IELTS ให้ได้ ที่ผมอยากจะแนะนำก็คือ อยากให้รีบสอบกันตั้งแต่เนิ่นๆ อย่ารอให้ถึงเวลา จวนเจียน แล้วก็รีบร้อน กระวนกระวาย ไปสอบ เพราะบางทีเรามั่นใจ แต่ก็ไม่อยากให้ over-confidence ก็อยากจะให้ลองไปสอบกันดูก่อน เพราะอย่างน้อยเราก็จะได้รู้ว่าความสามารถของเราอยู่ในระดับใหน ถ้าเราสอบผ่าน เราก็สามารถเก็บผลสอบเอาไว้ใช้ได้ โดยเฉพาะใช้ในการสมัคร PR ซึ่งก็สามารถเก็บไว้ใช้ได้ 2 ปี

สิ่งที่อยากจะแนะนำก็คือ:

สอบกันตั้งแต่เนิ่นๆ

เนื่องด้วยทางรัฐบาลของ Australia ได้มีการเปลี่ยนนโยบายทาง immigration อยู่เรื่อยๆ โดยเฉพาะ skilled migrant category ซึ่งก็มีการเปลี่ยน Skilled Occupation List อยู่บ่อยมาก นักเรียนไทยเราก็โดนร่างแหไปด้วย หลายๆคนก็เลยหันเหอยากขอทำเป็น working visa แทน

ที่ให้คำปรึกษามาหลายๆ case รู้สึกว่าจะคิดขัดกันที่ภาษาอังกฤษ คือผลสอบ IELTS เนี๊ยะที่ทาง immigration แจ้งมา ให้ได้อย่างต่ำ 5 เนี๊ยะ ไม่ใช่ผลเฉลี่ยนะครับ เพราะคนเข้าใจผิดกันเยอะมาก จริงๆแล้ว ต้องได้อย่างต่ำ 5 ทุกอย่าง ไม่ว่าจะเป็น speaking, listening, writing และ reading นะครับ

ก็อยากจะให้ทุกคนให้ความสำคัญกับการสอบ IELTS นิดหนึ่งนะครับ

Student Visa English Language Requirements

Some Student visa applicants are required to provide the results of an English language test.

As of 20 May 2011, the International English Language Testing System (IELTS) test is one English language test option accepted by the department for Student visa purposes. The department can also accept an English language test result from test of English as a Foreign Language (TOEFL) and the Occupational English Test (OET) in 14 countries where IELTS is not available.

However, the department will shortly be able to accept the following English language test options for Student visa application purposes:

TOEFL in all countries
Pearson Test of English Academic (Pearson) in all countries
Cambridge English: Advanced (CAE) from Cambridge ESOL (Cambridge) in all countries.

Equivalency scores for TOEFL, Pearson and Cambridge are being finalised and will be announced shortly. Test results from these alternative test providers (or in the case of TOEFL, from applicants in countries other than the 14 previously specified) will not be accepted for Student visa purposes until after this process has been completed. This is expected to be in place later this year.

The department will continue to accept a test result from IELTS. Current testing arrangements and equivalency scores for IELTS will not change.

The department will be closely monitoring the implementation of the new test providers and a review will be undertaken to determine whether these should be extended for the use with other visa programs.

Cookery & Hairdressing

มีหลายคงสงสัยว่า ตอนนี้เรียน Cookery หรือ Hairdressing อยู่ และตอนที่รัฐมนตรีออกมาประกาศ new SOL เมื่อวันที่ 8 Feb 2010 ตอนนั้นถือวีซ่านักเรียนอยู่ ซึ่งก็ยังเข้าข่ายช่วง transition period อยู่ และอยากทราบว่า จะสามารถขอวีซ่าอะไรได้มั่ง

ก็อยากจะบอกนะครับว่า

- ตอนนี้ Cookery และ Hairdressing ทำเรื่องขอ PR โดยตรงไม่ได้นะครับ
- ขอได้เฉพาะ TR (Graduate Visa, subclass 485) ซึ่งก็จะได้วีซ่าอีกแค่ 18 เดือน (1 ปีครึ่ง) ซึ่ง 18 เดือนนี้เราก็สามารถลงเรียนอะไรได้เพิ่ม หรือเรียนสาขาอื่นที่สามารถขอ PR ได้

แต่

- Cookery และ Hairdressing ยังสามารถขอวีซ่าทำงานได้นะครับ Long Business Stay (subclass 457) แต่ต้องมีนายจ้างเป็นคน sponsor นะครับ ยังไงๆก็มองๆหานายจ้างเอาไว้หน่อยก็แล้วกัน :)
- พอทำงานกับนายจ้างได้ 2 ปี ก็สามารถทำเรื่องขอ PR ได้ โดยให้นายจ้างเป็นคน sponsor (อีกเช่นเคย)

ก็หวังว่า blog นี้จะสามารถแก้ข้อข้องใจของใครหลายๆคนได้บ้างนะครับ

Visa Assistance for Japanese Nationals

The Minister for Immigration and Citizenship, Chris Bowen, has issued a media release advising all Japanese nationals in Australia who are unable to fly home or are on temporary visas to contact the Department of Immigration and Citizenship as soon as possible.

‘DIAC will take the circumstances in Japan into account when dealing with requests for visa extensions and will consider, on a case by case basis, the options for Japanese in Australia whose visas to remain here are about to run out.'
Australian citizens in Japan should contact DIAC immediately if they wish to travel to Australia with their children if those children are not Australian citizens.

‘Australian citizen parents located in Japan who have children born overseas who have not applied for, or been approved for, Australian citizenship by descent should contact DIAC to discuss the most appropriate way for their children to travel to Australia,' Mr Bowen said.

DIAC will also look at extending the validity of time-limited requirements for visa applicants located in Japan if the assessment of an application has been delayed by events there.
In view of the disaster in Japan, the Australian Embassy's immigration staff in Tokyo will work throughout the weekend to address urgent migration issues.

PASSPORT ASSISTANCE FOR AUSTRALIANS AFFECTED BY JAPANESE TSUNAMIThe Foreign Minister, Kevin Rudd, has announced that Australians who have lost their passports during Japan’s natural disaster will not have to pay to replace them. New changes to Student Visa (onshore)

OVERSEAS STUDENT HEALTH COVER (OSHC): Since 1 January 2011 it has become mandatory that all international students take out OSHC to cover the entire duration of their proposed stay in Australia. This includes the period after the course has finished but before the visa expires (can vary from one month to four months depending on length of course and when the course finishes). Evidence of the OSHC must be provided regardless of Assessment Level (including AL1 countries who previously were granted based only on declaration). The only students exempt from taking out OSHC are those with specific overseas students reciprocal health care arrangements with Australia, namely Belgium and some students from Norway and Sweden.

ก็อยากจะบอกน้องๆนักเรียนหลายๆคนนะครับว่า การที่เราเรียนจบอะไรสักอย่างเนี๊ยะ ไม่ได่ขอ TR หรือ PR ไปสะหมด เราต้องดูสาขาที่เราเรียนก่อนว่า เป็นสาขาอาชีพที่ ออสเตรเลีย ต้องการหรือเปล่า เริ่มศึกษาตั้งแต่เนิ่นๆ ไม่ใช่กะจะไปสอบ IELTS ทำโน่น ทำนี่ เตรียมตัวกันยกใหญ่เลย แต่ปรากฏว่า สาขาอาชีพ ไม่ได้อยู่ใน list ของ immigration แบบนี้ ก็ต้อง plan B, plan C นะครับ ว่าจะทำยังไง

- เรียนในสถาบันที่อยู่นอกเมือง (regional) ได้ 5 points

- Designated Area Sponsorship ได้ 5 points

คะแนน หรือ points ที่ต้องผ่าน คือ 65 นะครับ

New Points Test for General Skilled Migration (GSM) Announced

The Minister for Immigration and Citizenship, the Honourable Chris Bowen MP, has announced the new Points Test for General Skilled Migration (GSM) on 11 Nov 2010.

Designed to complement the new Skilled Occupation List (SOL) that came into effect on 1 July, the Points Test is "proposed to take effect from 1 July 2011, subject to passage of supporting legislation through the Parliament. It will apply to anyone lodging an application from 1 July 2011."

The new points test will not apply to unfinalised applications lodged prior to 1 July 2011.

The new points test will not change the generous transitional arrangement in place until 31 Dec 2012 for former international students.

Amongst its features:

Distinction between 40/50/60 point occupations abolished, those points removed from test
Age points adjusted to reflect productive working years rather than youth
Additional 10 point differential introduced for “Superior English” language ability (IELTS 8)
Additional points for extended periods of employment in Australia
Additional points for longer periods of professional experience generally
Considerable additional points for university graduates, particularly for applicants with PhDs
Relative advantages of trade and degree qualified occupations have been reversed
Regional nomination and family sponsorship points reduced
No indication of difference between independent and sponsored pass marks at this stage
Pass mark of 65

วีซ่านักเรียนอายุต่ำกว่า 18 อยู่กับยาย ยายจะไปเที่ยว

มีลูกค้าคนหนึ่ง เป็นเด็กนักเรียน อายุต่ำกว่า 18 อาศัยอยู่กับคุณยาย คุณยายเปลี่ยนสัญชาติเป็นคนออสเตรเลี่ยนแล้ว คุณยายเป็น guardian ของน้องคนนี้

คือปกติแล้วน้องนักเรียนที่อายุต่ำกว่า 18 ขอวีซ่านักเรียน ก็ต้องมีผู้ปกครอง หรือ guardian นะครับ และเด็กต้องอยู่ในความดูแลของ guardian ตลอด เวลา guardian จะเดินทางออกนอกประเทศ น้องนักเรียนก็ต้องไปด้วย จะทิ้งเด็กต่ำกว่า 18 โดยไม่มีผู้ปกครองไม่ได้

หรือถ้าจะเดินทาง แล้วเด็กยังต้องไปโรงเรียน เราก็ต้องหาคนมาดูแลแทน แค่นั้นไม่พอนะครับ เพราะคนไทยเราชอบคิดทำอะไรกันง่ายๆ กฏหมายที่นี่ให้ความคุ้มครองเด็กและผู้เยาว์ และกฏหมายของแต่ละรัฐก็ไม่เหมือนกัน

ของที่ NSW ผู้ปกครองหรือ guardian ต้องแจ้งทางโรงเรียน แล้วทางโรงเรียนจะออกหนังสือรับรองว่า ช่วงที่ guardian ไม่อยู่ในประเทศเนี๊ยะ ใครจะเป็นคนดูแลเด็กแทน หนังสือรับรองเรียกว่า Confirmation of Appropriate Accommodation Welfare Arrangement (CAAW). เสร็จแล้ว guardian ก็ต้องยื่นหนังสือ CAAW ตัวนี้ไปที่ Immigration หรือ เอเยนต์ของท่านนะครับ

ไม่ใช่นึกอยากจะเดินทางก็ซื้อตั๋ว ปุ๊บปั๊บเลย ไม่ใช่นะครับ

ซื้อรถจากคนที่ Visa ใกล้จะหมดอายุ

วันนี้มีคนโทรมาถามว่า จะซื้อรถต่อจากคนที่ Visa เค๊าใกล้จะหมดแล้ว จะทำยังไง จะมีปัญหาอะไรมั๊ย

ง่ายๆ สั้นๆ ครับ ไม่มีปัญหาอะไรครับ เพราะการซื้อขายรถ ไม่มีอะไรที่เกี่ยวกับวีซ่าเลย
กรอกใบโอน แล้วไปยื่นที่ RTA จ่ายเงิน ทุกอย่างก็เรียบร้อยแล้วครับ

เข้าใจว่าคนไทย โดยเฉพาะคนที่มาอยู่ที่นี่ใหม่ ไม่ค่อยรู้เรื่องกฏหมาย เพื่อความสบายใจของท่าน โทรหาถาม หรือปรึกษาได้นะครับ ยินดีตอบคำถาม แทบทุกคำถาม เพราะบางที ก็เป็นเรื่องง่ายๆ สั้นๆ ถามมา ตอบไป ไม่ถึง 2 นาที

Minister for Immigration and Citizenship, Chris Bowen MP, today warned prospective migrants and visa applicants to Australia to be wary of migration scammers.

'It is vital that people are aware of fraudsters' tricks before handing over money for immigration assistance which is never provided,' Mr Bowen said.

'This is why the Department of Immigration and Citizenship (DIAC) has launched a new online consumer protection resource to help people to learn about migration scams online and safeguard against scams.

'The Protect Yourself from Migration Fraud information kit includes victims' stories, tips to stay safe online, information on how to identify non-genuine websites and fraudulent emails, links to consumer resources and a video testimonial.'

The information kit has been developed following an increase in complaints about internet migration scams, which often appear to be official Australian Government websites.

'A common tactic of these sites is the use of language such as 'registered provider' or 'Australian visa application service',' Mr Bowen said.

'They claim that they can 'guarantee' a visa, this is a 'once in a lifetime opportunity' or it is your 'only chance' to travel or migrate to Australia.'

In the most prevalent scam, clients are invited to register online before a salesperson contacts them and asks them to provide credit card details. Charges are then debited to their card despite no migration service being provided.

Migration fraud involves illegal operators posing as migration professionals. In Australia, migration agents must be registered with the Office of the Migration Agents Registration Authority.

เข้าใจว่าน้องๆหลายคน โดนเฉพาะน้องๆที่ถือวีซ่านักเรียน โดยเฉพาะน้องๆคนไทยยอดฮิต ลงเรียน college ถูกๆ เพื่อที่จะได้วีซ่าไว้ทำงาน พอวีซ่าใกล้หมด ก็ไม่อยากเรียนต่อ ไม่อยากจ่ายค่าเทอม หลายๆคนสอบถามกันมาเยอะเหลือเกิน เรื่อง Work & Holiday Visa

ขอตอบง่ายๆ สั้นๆนะครับ ว่าขอ onshore ไม่ได้ ต้องขอ offshore นะครับ ต้องกลับไปทำเรื่องจากกระทรวงแรงงาน อะไรอีกเยอะแยะ มากมาย แต่ละปีก็มีโควต้าจำกัด ตอนนี้ ก็ได้แค่ 500 คนเอง ไม่ได้เยอะแยะมากมายอะไรเลย

เป็นคำถามยอดฮิต จากพี่ๆคนไทยที่ทำงานร้านอาหารไทย ก็เลยขอนำมาเขียนให้ได้อ่านกัน

คนที่ได้วีซ่าทำงาน 457 มา ที่ต้องทำงานให้นายจ้างเป็นเวลา 4 ปีนั้น

1. ต้องทำงานให้กับนายจ้างที่เค๊า sponsor เรามาเท่านั้นนะครับ แต่ถ้าอยากจะเปลี่ยนนายจ้างก็สามารถทำได้นะครับ โดยที่เราไม่ต้องขอวีซ่าตัวใหม่ ก็ใช้ตัวเก่านี่แหละ เพียงแต่ว่า เจ้านายเก่าต้องแจ้งยกเลิกไปที่ ทางอิมมิเกรชั่น และเจ้านายใหม่ ก็ทำเรื่อง sponsor ได้ทันที ลูกจ้างก็ไม่ต้องทำอะไรครับ แต่ขอบอกไว้ก่อนนะครับว่า การที่นายจ้างจะทำเรื่อง sponsor ใครมาทำงานนั้น ขั้นตอนจะยุ่งยากและซับซ้อนกว่าเมื่อ 2-3 ปีที่ผ่านมาเยอะ แนะนำให้ใช้ immigration agent ที่รู้เรื่องกฏหมายนะครับ อย่าพยายามทำกันเอง (เสียน้อยเสียยาก เสียมากเสียง่าย ไม่ดีครับ)

2. ถ้าเผื่อเรา (ลูกจ้าง ที่ถือวีซ่า 457) ได้มีโอกาสยื่นขอวีซ่าแต่งงาน หรือยื่นขอ Parent Visa โดยที่ลูกๆเป็นคน sponsor หรือวีซ่าอย่างอื่น อะไรก็ตามแต่ พี่ๆที่ถือ วีซ่า 457 จะไม่ได้ bridging visa ทันทีนะครับ bridging visa ที่มีผลบังคับก็ต่อเมื่อ วีซ่าอันเก่า 457 ของเราหมดอายุ เพราะบางคนอยากออกจากงานเก่า แล้วกะใช้ bridging visa ในการหางาน ไม่ได้นะครับ ยังไงก็คงต้องติดวีซ่า 457 ไปจนกว่าจะหมดอายุ หรือ ผลของวีซ่าตัวใหม่จะออก

3. ออกมาเป็น self-employed หรือเป็นนายจ้างของตัวเอง ก็ไม่ได้นะครับ คือวีซ่าตัวนี้ ออกมาให้เป็นลูกจ้างจริงๆว่างั้นเถอะ
