It's been a while that I blogged, that's because it's been very busy. There are holidays now in Belgium for 2 weeks, and the weather is incredible so it's definately gonna be the best holidays ever! I'm going to centerparcks, it's kinda a holiday village, with a couple of my best friends. gonne be cool to, and planning to prank them all.

Last few days have been ultrasick. My days were basically divided in drinking/sleeping/working/eating. Right now I have the worst hangover I ever had :(

The reason I don't have a lot of time is because I've got a funny sidebet with a friend of mine. We both deposited 50€ on a pokersite about a month ago, but it had to be a site we deposited before so we don't get a poker bonus and I picked pokerstars. Rakeback is allowed. We bet even money, and we're gonna look who's got the most money in august. The winner gets 50% of the other one's money, so I'm grinding like hell. For bankrollmanagement I use the following rules:

HU cashgame: Always buy in 50BB-75BB, and only on limits I have 10 full BI's for. Only 2tabling.
6man cashgame: 50-75BB, 10 full BI bankroll, preferably 2-4tabling
SNG: only normal 9mans for keeping the variance down. need 10 buyins.
Tourneys: a tournament in a while is okay, not really bankrollmanagement needed, but of course I shouldn't take unnecessary risks.

The first few days I 10tabled the normal 2$ 9 mans. Ran really well and ran my bankroll up to 340$. Took a hit in a 15$ tourney, managed to have a decent cash of 450$ for total BR of around 720. Decided to play some 5$ sngs. few coolers, so went back to 630$. 4 tablet 50NL HU against a fish and won 340. More grinding, and at 1850$ now. Had a lot of coolers recently too.

I ran into a friend of mine at the track once. We decided to have a friendly race ... one mile.

Starting off, he pulled just ahead of me. I thought I would close the distance and pass him after a short bit, but could never quite do it.
The whole lap my body was on fire, and I was pushing it as hard I could. He crossed the line 10 meters ahead of me. He didn't even look winded, just a dead-set look in his eyes.

Afterwards I asked him how he ran that fast, and he told me that it is all in the motivation you light in your mind..imagining your own world and blotting out all everything else.

So I asked, "What do you imagine?"

He replied, "What do you do?"

I told him that to run faster, I like to imagine that I am being chased by a wolf.

The reason I put the threadsaver first is the following: I know for a lot of you articles abotu the law or lawyers or attorneys or mesothelioma will not be that nice to read. And that's okay, I'll try to mix in some other subjects. The reason I blog about these subjects a lot, is that I went a year to law school, and got to know a lot of fellow law-students. So whenever there's something new, they let me know.

So what happend today? Well, a friend of mine had to write a thesis about the history of law, and what seemed? There was no wikipedia article about it in dutch. And in English, there was but only as a submenu of lawyer and it was very limited. She took her responsibility and wrote some about it on the English Wikipedia, and is planning to translate it in Dutch. For you all, here's her article in English:

Ancient Greece

The earliest people who could be described as "lawyers" were probably the orators of ancient Athens (see History of Athens). However, Athenian orators faced serious structural obstacles. First, there was a rule that individuals were supposed to plead their own cases, which was soon bypassed by the increasing tendency of individuals to ask a "friend" for assistance.^[175] However, around the middle of the fourth century, the Athenians disposed of the perfunctory request for a friend.^[176] Second, a more serious obstacle, which the Athenian orators never completely overcame, was the rule that no one could take a fee to plead the cause of another. This law was widely disregarded in practice, but was never abolished, which meant that orators could never present themselves as legal professionals or experts.^[177] They had to uphold the legal fiction that they were merely an ordinary citizen generously helping out a friend for free, and thus they could never organize into a real profession—with professional associations and titles and all the other pomp and circumstance—like their modern counterparts.^[178] Therefore, if one narrows the definition to those men who could practice the legal profession openly and legally, then the first lawyers would have to be the orators of ancient Rome.^[179]

A law enacted in 204 BC barred Roman advocates from taking fees, but the law was widely ignored.^[180] The ban on fees was abolished by Emperor Claudius, who legalized advocacy as a profession and allowed the Roman advocates to become the first lawyers who could practice openly—but he also imposed a fee ceiling of 10,000 sesterces.^[181] This was apparently not much money; the Satires of Juvenal complain that there was no money in working as an advocate.^[182]

Like their Greek contemporaries, early Roman advocates were trained in rhetoric, not law, and the judges before whom they argued were also not law-trained.^[183] But very early on, unlike Athens, Rome developed a class of specialists who were learned in the law, known as jurisconsults (iuris consulti).^[184] Jurisconsults were wealthy amateurs who dabbled in law as an intellectual hobby; they did not make their primary living from it.^[184] They gave legal opinions (responsa) on legal issues to all comers (a practice known as publice respondere).^[185] Roman judges and governors would routinely consult with an advisory panel of jurisconsults before rendering a decision, and advocates and ordinary people also went to jurisconsults for legal opinions.^[184] Thus, the Romans were the first to have a class of people who spent their days thinking about legal problems, and this is why their law became so "precise, detailed, and technical."^[184]

During the Roman Republic and the early Roman Empire, jurisconsults and advocates were unregulated, since the former were amateurs and the latter were technically illegal.^[186] Any citizen could call himself an advocate or a legal expert, though whether people believed him would depend upon his personal reputation. This changed once Claudius legalized the legal profession. By the start of the Byzantine Empire, the legal profession had become well-established, heavily regulated, and highly stratified.^[187] The centralization and bureaucratization of the profession was apparently gradual at first, but accelerated during the reign of Emperor Hadrian.^[188] At the same time, the jurisconsults went into decline during the imperial period.^[189]

In the words of Fritz Schulz, "by the fourth century things had changed in the eastern Empire: advocates now were really lawyers."^[190] For example, by the fourth century, advocates had to be enrolled on the bar of a court to argue before it, they could only be attached to one court at a time, and there were restrictions (which came and went depending upon who was emperor) on how many advocates could be enrolled at a particular court.^[191] By the 380s, advocates were studying law in addition to rhetoric (thus reducing the need for a separate class of jurisconsults); in 460, Emperor Leo imposed a requirement that new advocates seeking admission had to produce testimonials from their teachers; and by the sixth century, a regular course of legal study lasting about four years was required for admission.^[192] Claudius's fee ceiling lasted all the way into the Byzantine period, though by then it was measured at 100 solidi.^[193] Of course, it was widely evaded, either through demands for maintenance and expenses or a sub rosa barter transaction.^[193] The latter was cause for disbarment.^[193]

The notaries (tabelliones) appeared in the late Roman Empire. Like their modern-day descendants, the civil law notaries, they were responsible for drafting wills, conveyances, and contracts.^[194] They were ubiquitous and most villages had one.^[194] In Roman times, notaries were widely considered to be inferior to advocates and jurisconsults.^[194] Roman notaries were not law-trained; they were barely literate hacks who wrapped the simplest transactions in mountains of legal jargon, since they were paid by the line.^[195]

After the fall of the Western Roman Empire and the onset of the Early Middle Ages, the legal profession of Western Europe collapsed. As James Brundage has explained: "[by 1140], no one in Western Europe could properly be described as a professional lawyer or a professional canonist in anything like the modern sense of the term 'professional.' "^[196] However, from 1150 onward, a small but increasing number of men became experts in canon law but only in furtherance of other occupational goals, such as serving the Roman Catholic Church as priests.^[197] From 1190 to 1230, however, there was a crucial shift in which some men began to practice canon law as a lifelong profession in itself.^[198]

The legal profession's return was marked by the renewed efforts of church and state to regulate it. In 1231 two French councils mandated that lawyers had to swear an oath of admission before practicing before the bishop's courts in their regions, and a similar oath was promulgated by the papal legate in London in 1237.^[199] During the same decade, Frederick II, the emperor of the Kingdom of Sicily, imposed a similar oath in his civil courts.^[200] By 1250 the nucleus of a new legal profession had clearly formed.^[201] The new trend towards professionalization culminated in a controversial proposal at the Second Council of Lyon in 1275 that all ecclesiastical courts should require an oath of admission.^[202] Although not adopted by the council, it was highly influential in many such courts throughout Europe.^[202] The civil courts in England also joined the trend towards professionalization; in 1275 a statute was enacted that prescribed punishment for professional lawyers guilty of deceit, and in 1280 the mayor's court of the city of London promulgated regulations concerning admission procedures, including the administering of an oath

Doing some research about college loan consolidation for a possible study abroad!

I'm in school! For my paper I started reading up on law support and school tuitions in the USA. I never knew you guys needed that much money to study! I always wished to study in America for a year or so.. Now I have to start considering where I can get a student loan. I don't even know wether there are firms over here who are specialized in college loan consolidation. I should do some research :)

A student loan is designed to help students pay for university tuition, books, and living expenses. It differs from other types of loans in that the interest rate is substantially lower and the repayment schedule is deferred while the student is still in education. Before accepting any kind of student loan, one should be familiar with its basic attributes.

The United States uses a federally guaranteed student loan program to help college students pay for their education. The program allows students to borrow money at a reduced interest rate and defer payment until they are no longer in school. Student loans are generally offered as part of a total financial aid package that may include grants, scholarships, or work study opportunities.
In the United States, there are three types of student loans: two of them are sponsored by the federal government and the other type is private student loans.^[1]

Qualification

Most college students in the United States qualify for some type of student loan, although the amount they can borrow may vary based on several factors. Income level, parents' income level, and other financial considerations are all weighed to determine the amount you are eligible to borrow under the federal student loan program.

Repayment

Repaying a student loan is different, too. In most cases, payment can be deferred on the principal and the interest until the student is out of school. The student loan system has also been criticized including by supporters of other systems such as a grant system.
In coverage through established media outlets, many borrowers have expressed feelings of victimization.^[2]^[3]^[4] Common complaints include: feeling like the terms were not clearly described prior to consummation, having monthly payments equal to half of take-home income, wage garnishment by lenders, inability to charge off student debt in the bankruptcy process (as is possible with mortgages and credit card balances) and being crushed by unyielding lenders when befallen by unfortunate life events (such as disability which prevents work).^[5] There is a valid comparison between these accounts and the college credit card trend in America during the 2000s,^[6] and it could be argued that a similar form of corrective legislation is in order.^[7]
It is often more difficult to discharge a student loan in the USA in the case of bankruptcy. The legislation which covers this is 11 USC 523. This often means that student loans survive a bankruptcy unless the bankrupt can demonstrate "undue hardship".

This is a blog dedicated to my friend, who just graduated from Brussels Law School! She just finished her training period, working for a group of lawyers, where each lawyer had his/her speciality. And she had to work 1 week with each, to see what speciality she would like. Driving Under the Influence of…Binaca?

Don’t spray and drive.

So you’re driving along and suddenly there are flashing red lights in your rear view mirror. You recall that glass of wine with dinner: not nearly enough to be over .08%, of course, but enough to cause an odor of alcohol on the breath. As you pull over, you grab the breath freshener and quickly spray it into your mouth. The officer asks you to step out of the car, holds out a portable breath testing device and asks you to blow into it. A moment later you are being handcuffed.

What happened? One of the many problems with breath machines is that they cannot tell the difference between alcohol coming from the lungs and alcohol which is already in the mouth or throat. This problem is referred to as mouth alcohol, and is particularly troublesome because, believing it to be alcohol from the lungs, the breath machines will incorrectly multiply the detected alcohol by 2100 times (see my earlier post, Breathalyzers — and Why They Don’t Work).

One common source of breath alcohol is breath spray, as well as mouthwash — both of which contain significant amounts of alcohol. Listerine, for example, contains 27% alcohol, Scope 19% and Astring-O-Sol 76%. Even a tiny amount of this on the breath or in the throat, if multiplied by the machine 2100 times, can result in high breathalyzer readings.

This was clearly illustrated in a study conducted with Listerine mouthwash on a breath machine and reported in an article entitled "Field Sobriety Testing: Intoxilyzers and Listerine Antiseptic", published in the July 1985 issue of The Police Chief . Seven alcohol-free individuals were tested at a police station, with readings of .00%. Each then rinsed his mouth with 20 milliliters of Listerine mouthwash for 30 seconds in accordance with directions on the label. All seven were then tested on the machine at intervals of one, three, five and ten minutes.

The results indicated an average reading of .43% blood-alcohol concentration — indicating a level that, if accurate, approached lethal proportions. After three minutes, the average level was still .20%, despite the absence of any alcohol in the system. Even after five minutes, the average level was .11% — well over the legal limit.

In another study, reported in 8(22) Drinking/Driving Law Letter 1, a scientist tested the effects of Binaca breath spray on an Intoxilyzer 5000. He performed 23 tests with subjects who sprayed their throats, and obtained readings as high as .81% — far beyond lethal levels. The scientist also noted that the effects of the spray did not fall below detectable levels until after 18 minutes.

It goes without saying (but I'm saying it) that if you drink, you shouldn't drive. In Arizona, if you are over 21, it is NOT illegal to drive after drinking. However, driving after drinking an unknown amount of alcohol is illegal. Since it is next to impossible to figure out what that unknown amount is, it's best not to take the chance.

If you do make the mistake of drinking and driving in Arizona, and if you are pulled over by an Arizona law enforcement officer, then this article will give an extremely brief overview as to what you should generally expect and what you should generally do. Use this merely as a guide. For help on an individual case, you need to consult with an attorney.

The DUI Stop

You can be stopped for DUI in a variety of ways. The most common are:

an officer stops you for some type of traffic infraction (or perceived traffic infraction) such as speeding, weaving, or failure to yield.
an officer responds to an accident scene where he does not necessarily witness you driving.

Either way, just about every DUI police report will begin with the Officer's observations of signs of alcohol ingestion, such as odor of alcohol and bloodshot, watery eyes. Notwithstanding the fact that these are signs only indicative of ingestion, not necessarily impairment, the Officer will use this as a basis for "further investigation."

"Further Investigation" in this context means asking you to step out of your car and perform field sobriety tests. The Officer will pay close attention to how you exit the car, the manner in which you provide him with your driver's license, registration and insurance and the manner of your speech. Then the Officer will ask you to do Field Sobriety Tests. Depending on what the Officer observes and his suspicions, he will place you under arrest for DUI.

So, if you've been stopped for DUI, how do you respond? First -- and most importantly -- you must be courteous. Don't try to bargain your way out of this. Be respectful. Second, ask for a private place to speak to an attorney. The Officer probably will not allow you to speak to one immediately, however, if he ultimately does not honor your request, your entire case can be thrown out.

I am very skeptical about Field Sobriety Tests (FSTs). For example, I defended a client at a DUI jury trial where the Officer admitted to the jury that my client passed the Field Sobriety Tests, yet he arrested him anyway. The reason for this is simple. Once the Officer stops your vehicle for some reason, for example, weaving, and then observes the odor of alcohol and bloodshot, watery eyes, he's already made up his mind what type of case this is. Everything after that is merely a procedure for gathering additional evidence of guilt. It is not a process to prove your innocence, regardless of what the Officer may tell you. Moreover, the Field Sobriety Tests themselves are merely coordination tests that are difficult to pass even under the most optimal of conditions. Because of these concerns, I don't see any value in agreeing to perform the FSTs. Politely decline. The Officer will probably arrest you anyway.

In case you are wondering, in the example I gave above the client was not convicted!

DUI and Arizona Courts

Misdemeanor DUIs are generally prosecuted in Municipal Courts or Justice Courts in Arizona. Generally, Superior Court handles felony DUIs. Regardless of whether your case is a felony or a misdemeanor, NOBODY should make any decision as to how to proceed on a DUI case without the advice/guidance of an experienced attorney. If you are indigent, you will qualify for a public defender.

Your defense lawyer will review the evidence against you and advise you accordingly. Sometimes it is better to plead out prior to trial. Sometimes it is better to go to trial. It depends on your case. If you go to trial, you have the right to a jury trial. You can also waive a jury and just try your case to the judge. Again, which option is best depends on your case and the judge.

DUI Sentencing and Mandatory Jail Time in Arizona

If you are convicted of DUI in Arizona you will go to jail. It is mandatory. The amount of jail depends on your alcohol concentration, your prior criminal history (particularly DUI history), as well as the circumstances of your case. For a first offense, if your reading is below .15, then the minimum amount of jail is 24 hours. If your reading is between .15 and .20, then the minimum is 30 days in jail. If your reading is above .20, then the minimum jail time is 45 days. Keep in mind that the State has to prove that your actual alcohol concentration was above those minimum amounts in order for you to be subject to the enhanced jail sentence.

As you can well imagine, if it's not your first offense, then the penalties grow exponentially. The jail time is mandatorily enhanced if you have, and the State proves that you have, a DUI prior within 84 months of the current charge. For example, a second offense DUI, with a reading of less than .15, has a 30 day minimum jail sentence in Arizona. A second offense with a reading of between .15 and .20 is 120 days in jail. A second offense with a reading of over .20 is 180 days in jail.

In addition to the jail time, there are mandatory fines in Arizona which also depend on alcohol concentration and prior DUI history. Alcohol classes will be ordered. You will be required to install an ignition interlock device in your vehicle.

DUI in Arizona - The Bottom Line

If you drink, don't drive. But if you do, know your rights. Be respectful to the Officer. Ask to speak to a lawyer in private. Decline the Field Sobriety Tests. Once placed under arrest, agree to the blood test. Request an MVD hearing if your reading is too high. Finally, DO NOT go through this alone. Either hire an attorney experienced in these matters or apply for a public defender. Every DUI case is different. Even seemingly hopeless cases can be effectively fought.

Allow the Blood Test?

Once placed under arrest, you will be given some type of test to determine alcohol concentration. Typically this test is a blood test. The results usually take a few weeks. If you refuse the test, the general procedure is for the Officer to obtain a search warrant from a judge to allow him to forcibly take your blood. So, you see, they'll get the test anyway. Plus, if you refuse the blood test, regardless of the outcome of the criminal case, your license will be suspended for 12 months. If you're thinking that doesn't sound like a good strategy, you are correct. Just take the blood test.

Results of the DUI Blood Test

If the results of the blood test are greater than a .08, then Arizona MVD will send a written notice (via regular mail to your last address on file at MVD) that your license will be suspended for 90 days, the last 60 days of which you may be allowed to drive to and from work, school, or counseling.

Hearings and Suspensions

You may request a civil hearing which, at worst, can delay the start of the 90 day suspension, and, at best, may void the suspension and/or possibly obtain helpful, under oath, statements from the arresting officers. The only downside to requesting a hearing relates to timing of the suspension. Would it be easier for you to serve your suspension earlier rather than later? If that's the case, then perhaps declining a hearing is your better choice, since it often takes at least 45 days to get a MVD hearing.

If you request a hearing because you believe you have a chance there of having the case dismissed, please be aware that it is rare; when these hearings are held, the suspensions are generally upheld. So what's the advantage? You can have more time to prepare for the suspension and you get a sneak peek at the Officer's case against you.

If your blood test reading is less than a .08, then there is no 90 day suspension, unless you're ultimately convicted of the DUI in criminal court (yes, it is possible to be convicted of DUI with readings less than a .08). Note, that if you already served your 90 day suspension, you will not have to serve another 90 day suspension if you are convicted of the DUI. It's a onetime suspension.

How states like Arizona handle with DUI.

Arizona and every other state has DUI laws that are meant to stop drivers from getting behind the wheel of a car after a few glasses of wine, or beer, or alcohol. The limit in our state, sometimes ironically called the "legal limit," is .08%. The best advice any attorney can give you is don't drink and drive. Period. Imagine how many cab rides you can pay for with the money you'd spend on fines and attorneys' fees in a DUI case.

So, let's say you've left the party thinking you're okay to drive only to have the flashing red and blues greet you. How to handle the DUI stop? First, stay in your car unless the officer asks you to step out and if you have your seat belt on, leave it on! Second, know these ten things:

1 - Provide identification. The officer will ask for your driver's license and registration. How easily you find these items will be noted on the officer's report. If you fumble around for them, it will look like you've had too much to drink.

2 - Politely refuse to take field tests. Field tests for DUI are: walking the line, touching your finger to your nose, counting on your fingers, saying your ABCs, holding your leg up while counting, and HGN, the one where the officer asks you to follow a light with your eyes. When you do field tests, you are giving evidence that will be used against you. There is no law requiring you to do the tests. Some officers will tell you they will take you to jail if you don't do the tests. Don't fall for it. They were going to take you to jail anyway.

3 - If asked, politely explain that you will not agree to a search of your car. If the officer has to ask you to agree, it's a red flag. Just say no. If an officer has enough reason to get a search warrant, he or she will. If not, then why search? Usually the question will come at you like: You don't mind if I look in your car, do you? You don't have a problem with my looking in your car? I'm just going to take a quick look inside, okay? Say no--politely, but firmly--and don't explain. And hope your no makes it into the report.

4 - Politely refuse to answer questions. Usually the officer will ask you a few questions about what you've had to drink and then move on to more questions later at the station. Your best response is: "I can only answer your questions on the advice of my attorney." You don't have to call an attorney right then. The statement effectively stops any questioning of you by invoking your constitutional rights. Even when the officer reads Miranda rights to you, the answer should be the same.

5 - Cooperate, cooperate, cooperate. Cooperation means having a good attitude and being polite. It doesn't mean answering questions or doing field tests or talking. Your attitude, appearance and words all become part of the officer's report. Your disposition indicates your level of intoxication. This is not the time to crack jokes, cry, apologize or confess.

6 - Take a breath, blood or urine test if one is offered. When your driver's license was issued, you agreed to take such a test if you were ever pulled over. It's called the Implied Consent Law and even if you don't remember agreeing, you did. If you don't take the test, your license will be suspended for a minimum of one year, even if you are not convicted of DUI. If you take the test and the reading is greater than .08%, your license will be suspended from 30 to 90 days.

After the investigation on the street, the officer will usually take you to the station or to a testing site. Some cities will offer you a blood test, others will offer a breath test. If your test shows your blood alcohol concentration (BAC) to be less than .08%, you may not be charged. If you are, you might be able to later have the case dismissed. If your BAC is .08% to .14%, you will be charged with DUI, and DUI with a BAC over .08%. If your BAC is .15% or more, you will be charged with DUI, DUI with BAC over .08%, and Extreme DUI.

7 - After completing the test, the officer may give you a form that asks whether you want to preserve a sample of your test or waive a sample. NEVER waive! Always ask that a sample be preserved if you are given that choice.

8 - As soon as you are released, go to a hospital, a lab, or call your doctor to arrange to have your own test done immediately. If that test shows a lower BAC, you can use it in your case. If the level is the same or higher, you need not provide that information to the prosecutor.

9 - If you don't want to lose your license, ask for a hearing at the Motor Vehicle Division within fifteen days. The officer will give you a form when he or she takes your license. This Admin Per Se/Implied Consent Affidavit has a paragraph telling you how to request a hearing.

If you are charged with DUI, you are not required to have an attorney. In some cases, a court will appoint one for you. At any stage in the process, you might choose to hire an attorney to help you with your case. If you understand intoxilyzers and how they operate, you can handle the case yourself. If you can interview police officers and question witnesses at trial, you can handle the case yourself. Or if you just feel better walking in and pleading guilty, you can handle the case yourself.

10 - If you decide to hire an attorney, find one who has experience with DUI cases. Hire a qualified attorney you trust, an attorney you meet in person at your first consultation. A good attorney will personally appear in court on your behalf, interview the officer, gather records, prepare motions, and negotiate with the prosecutor. A good attorney will keep you informed about the progress of your case, but don't expect a daily call! Beware of attorneys you don't meet until your first day in court or who aggressively go head to head with the prosecutor during pretrial negotiations. You need an advocate who won't alienate the other side and paint you into a corner.

Conclusion:

Do you really need to take a cab after only one drink? No, not after one ounce of alcohol. Generally speaking, your blood alcohol level rises about .025% for each drink you have. The actual percent is based on your weight, sex, and other factors. Your body eliminates alcohol over time. And now there are relatively inexpensive devices to test your alcohol level. Local stores and catalogs carry personal breath testing devices. Since all devices have an error factor, don't drive if yours reads .05% or over. But remember, the state doesn't have to prove you had a .08%, you are guilty if your ability to drive is impaired to the slightest degree.

The safest bet is to drive sober always. You're more likely to get where you're headed without that stop at the police station! You're less likely to need an attorney, pay fines, go to jail, pay higher insurance rates, and lose your driving privilege. . . or you could always call a cab.

First thing first, the new design. You can't deny it, it looks completely different. It's a lot brighter than the previous one, and more Mario! Woohoow Marioo.

I switched all the widgets to the left, starting by followers, then amt of views, and look! I have 888 pageviews, that's soo cool. I'd like to thank all my fans and readers for letting me get so much pageviews, the last days the pageviews quite have been a rollercoaster, but I'm really happy. Also did you know in Chinese 888 means good fortune? (发发发) I definately hope so!

Under the pageviews is the visitor globe, which is really a cool widget (if it works). I have my doubts about it, but even if it doesn't it's still cool.

Lemon Laws In Belgium, do they exist?

For people who are new on my blog, I'll explain what a lemon law is. A lemon law is a law about consumer protection in USA which deals solely with vehicles. That means when you buy a car and it doesn't work properly, you can rely on the lemon law to let the manufacturer repair it for free. Each state in the USA has it own lemon law; there is eg the Lemon Law of Wisconsin, Lemon Law of California, Lemon Law of Ohio, Lemon Law of Illinois, you get the picture.

In some states it is very powerful. In some, where the manufacturers have better lobbyists, it is not. From what I have gathered there is not much consumer protection in most of Europe relating to automobiles.

I'm pretty sure there is some kind of law in any country stating that if purchased goods are not in good working condition the seller must either repair, take them back or offer a partial refund. The key problem is that with your purchase contract you've also accepted the warranty terms and conditions which usually overrule those laws (sometimes for the better, i.e. 3 years instead of 1 year warranty period) but also might sort of conflict with them (like all free repairs are at <your car manufacturer>'s discretion).

My weekend almost completely dominated by Aston Martin.

So it happened saturday morning, as I was talking to my friend. I said him I bought a car, but I don't have a driver's licens yet. This reminded him of the following story:

Around october 2010, Marek Sosnowski, a 19 year old Polish Guy without a driver's license wins an Aston Martin DB9. How? On Party Poker! Seriously, no kidding, he won it thanks to party poker.
Almost a year before he deposited some money on Party Poker, got a Party Poker bonus I hope for him because they're cool, and grinded it up. Then when he had that 1 year of experience, he entered a tournament with at least 20,000 participants and got to the final table. Because of that cash, he was allowed to enter the live Party Poker event in London, "Drive The Dream", where the winner would receive its own Party Poker Aston Martin DB9. He won and boom, now he's a 19 year old with one of the coolest cars there is.

Sick story, but anyways, let's just try to imagine the car insurance quote he has to pay. The auto insurance quote would be so high I guess, he can better get all his money from party poker OR sell his AMDB9 to someone who can afford the high car insurance quote and grind his money up on partypoker.

Oh my god guys, I'm so happy right now. The thing is, I don't even have my driver's license yet. But some colleague who works with my dad in the insurance office is divorcing, and he doesn't need his car anymore.

Because I could get is for basically nothing, I loaned a bit of money from my parents, and bought it.

As you all know I basically know anything about car insurance now. Thanks to my dad I can get a low car insurance quote.

It's a good thing that I could buy it from someone I know because my cousin also recently got a buy and got a auto insurance with a low car insurance quote. The thing is tho, that after a few days he noticed the car is damaged a lot! After a bit of research and calling with the people from the car insurance, he heard there's nothing he could do about. The car insurance is not gonna pay him to repair the damages, because car insurance is only for accidents and stuff they say. What's weird because he pays a high auto insurance quote.

So I found it weird, I went googling and I found this cool information. Appearantly in the United States they call it a lemon.

A lemon is a defective car that is found to have numerous or severe defects not readily apparent before its purchase. Any vehicle with these issues can be termed a 'lemon,' and, by extension, any product which has major flaws that render it unfit for its purpose can be described as a 'lemon'.

At the core of most lemon laws is the manufacturer's breach of warranty. A manufacturer's warranty is what makes the manufacturer legally responsible for repairs to the consumer's vehicle or good. It is a form of guarantee. An express warranty is typically a written warranty. An implied warranty unlike an express warranty, is not written. The law imposes these obligations on the manufacturer, the seller or both as a matter of public policy. These vary from state to state.

Lemon laws may cover situations even when the vehicle is not under warranty, especially if the seller failed to disclose critical information such as previous damage to the buyer. Knowingly purchasing a car in "as is" condition does not void the buyer's rights under applicable lemon laws. Lemon laws are not limited to cars. There are RV, boat, motorcycle, and wheelchair lemon laws.

Hi guys,

I'm extremely happy today, I'm gonna try to share with you guys why that is. Again a long post, but I really like writing, it's kinda in my blood I guess. I also go to the library a lot, yeah free books are better :D, to get my hands on some classic books. Ok, here we go!

As you can read in the title, it was a very good day. Why was that? I don't know lol. You know sometimes you wake up in the morning and you just have the feeling the day is gonna be wonderfull? So how can you tell it when you're like 1 second awake?

Anyways I had that feeling and then some other fun stuff happened

My mom is sick, so first of all I could sleep longer, because normally I go to school by bus, but now I could take the car. For free. Well that may seems odd, but most of the times when I take the car I have to pay some money for the fuel. But this time for free lol. Not that it's that much money anyways, but you know when something is for free that always feels better.

* I arrive at school. Bam, the first thing that happens is my teacher who's gonna evaluate my project (check my last blog) about the car insurance stuff asks me to come with her to talk. At first I was like oh boy, she's not gonna like what I did with the auto insurance ad, man I better took the student loan consolidation subject, or I should become a poker pro, get another party poker bonus and grind my way up.

But everything went better than expected. Yes, she wanted to talk about my project, but not in a bad way. She said it was a very original ad, and I picked the hardest subject there could be. Other people kinda copied things from the internet, but she liked that I dare to take auto insurance. Then I even impressed her more when I said I thought about taking college loan consolidation as the subject. But anyway, she said her husband bought a car, but the contract and the car insurance quote in her current insurance office where she had life assurance, fire insurance and stuff would be too expensive. So I gave her my dad's phone number. So she called him around noon, and when I came home my dad was really happy, because my teacher's husband bought a porsche carrera and because my dad could give him a really 'cheap' but very good automobile insurance quote, he wanted to get al his assurances to my dad's office.

* My friend of my friend ... (you already got it ,right?) called, and said she went looking for some more college loan consolidation. She found some good offers, called some people, and she has a few appointments next week to go look with her parents if she can get a good school loan consolidation. Anyway, so she was really happy too, we probably gonna see eachother a lot soon, and for sure next schoolyear. Anyway, did I mention she's really hot. Man, if I made millions on party poker, she wouldn't need a college loan, I'd give it to her lol.

*Now we're talking about party poker. Played a bit, built my bankroll of 50$ to about 120$. No worries if it doesn't go that fast if you play poker, I don't really use bankroll management =$ . Cleared my party poker bonus, so kaching, an extra 50$ free!!

So with my 120$ I decided to take a shot in the 4K$ guarantee, 10$ buyin. Did manage to mincash, for 15$, but had a really bad beat to end my tourney. But I still love party poker (instead of full tilt poker and pokerstars or Ultimate bet) and gonna keep on playing there. And hope I'll get another party poker bonus of course! :D

Just kidding, it's gonna be a long one. Tl;dr? Cliffs and questions are at the bottom! :D

So as you could read in my previous post, I had a lot of homework to do, but failed to start due to the wondurfulll interwebs.

It was a project for school, which could decide if I failed or passed my year, so maybe I should have worked harder, but whatever. For those of you who don't know, I study Interactive Media & Design in Mechelen,Belgium.It's about photoshop, illustrator, flash,.. very cool and all about computers.

So this project..We had to take a "business"we would have a lot of info on nearby (friends, family, neighbours, self-experience, ..) e.g. insurance company, bank, school,.. and make some logo's en ads -both print and online - and stuff in the housestyle of the company, to help them in these hard times of economic crisis. From the start this was going to be the subject I thought

car insurance in belgium: a pain in the ass

At first I prefered this. My dad works in an insurance office so any information about car insurance quotes could easily be obtained. I'm also learning how to drive, so it would be interesting to see the difference options when I'm going to buy a car and most importantly: where to get the auto insurance. The problem is car insurance in Belgium can be very expensive, because of the VAT. The solution is to get the auto insurance on the name of one of your parents, because they drive longer and have to pay less. The problem is when you have an accident then, the auto insurance quote is going up, so they'll have to pay more. So I looked around on the internet (probably took me about 4 hours on facebook, skype and party poker first to search for a whole 10 minutes). I decided that if I was going to take this subject, I was going to go with this insurance office called Delta Lloyd. Maybe because it was too easy (blue/white colorpalette & dad works here) or because their car insurance quotes were cheaper than the rest.

*College Loan Consolidations

But then the next happened: a friend of a friend of a friend of a friend (well that's about it) called me, and wanted to ask a few questions about course (IMD). She said she wanted to follow it next schoolyear, but read it costs quite a lot. I said she should get a school/college loan consolidation because a lot of my classmates have some kind of college loans. She said she didn't know anything about it, and as polite as I am, said I was going to do some research for her. As I was researching it, I had this idea. What about this as my subject for my project. I have to admit, college loan consolidation is quite a weird subject, but I have info nearby (the school, my classmates,..), if the project is really good the school might buy it which will end in the teachers loving me and I do my friend of a friend of a friend of a friend a really big favor. So I researched, again, and found some info, again..

The thing in Belgium is, we have this credit system for university and higher education which the government pays. It pays your for your education, as long as you don't fail X times and stuff. The problem is with IMD is the costs the government doesn't pay with the credit system can add up to a high sum. A laptop (preferably mac), software (not all of it can be student versions, like photoshop had to be paid fully), maybe a room in a dorm (money for food, drinks,..), and so on. As you can see, a school loan consolidation can become quite handy for some people. But after a while I decided this was going to be to difficult as a subject. I did give my friend... (you get the picture) the information, and she said she probably is going to have some kind of college loan consolidation.

Soooooo yesterday. Yes, one day before the deadline and I still had to make an electronic ad. Now it seems so easy to make it for a car insurance. First you have a nice car, you let it crash, you put the car insurance quote in the middle of the screen, accentuate it, and it's ready. Normally I would do that, but that seemed just tooooo cheesy. (Now I wished I worked out that idea, then I probably could have slept this night.

So time for some inspiration, and where to get it else than on youtube! Just randomly browsing from video to video, thinking about the relation between the video and the car insurance. And then it happened. *click* I opened some video about the party poker league. NOOOOOO, now I would never start working on my auto insurance project. <-- wish I thought that at the time.

So I think I watched some party poker league video's, then went on on the full tilt poker million dollar challenge, to end with the big game by pokerstars. After watching all those video's I really wanted to play, I saw people playing poker in video's for 2 hours. So I googled a bit, found a party poker bonus and deposited 50 bucks. Some people ask my why I play on party poker. Full tilt poker and pokerstars are bigger, better and their bonuses are better. And honestly, I don't know. Probably something psychologically: Everytime I deposited some money online, I had the best results on party poker. The bad beats on the other 2 rooms just kept coming.

And I don't know if I'm bad at searching but how easy is it to find a party poker bonus? Just go to google and search for 'party poker bonus' and you'll get a zillion results, go to thepiratebay or some other torrent sites I think and a big ad will open where you can read in big, bold letters 'party poker bonus'. And of all the bonuses I had on all 3 sites - party poker, full tilt poker and pokerstars - which one was the easiest to clear? That's right! The party poker bonus.

So I played a bit, and around 2am I call it a session. I'm in half of clearing the party poker bonus, got some money. And had 4 hours to work on my car insurance quotes project.

Allez Standard!! vs Charleroi [Belgian Soccer]

For those who don't know it: I'm a hardcore Standard Liege Fan!

The atmosphere in the stadium is always great, almost every match there is someone with bengal fire,

in top matches there are tifosi (check the picture), supporters are singing, it's just awesome

The thing is they weren't doing that great lately, only 7th place and this after they were the champion for 2 years after a row in '08 and '09. In '10 Anderlecht (the biggest rival of Standard) became champion, and that season Standard really played bad, not winning anything, not even qualifying for european football.

The team in red is Standard, the black-white team is Charleroi. What happens is first some fan of Standard throws bengal fire on the field, and the players of Standard go tell the fans to chill and stop making such commotion. They kinda do that but in the second half, the charleroi fans throw tennis balls to Standardplayers and manage to open the fence and try to get on the field.

Sick atmosphere, right?
