For any state to achieve a sense of order and identity, it requires a shared set of values to be recognized and accepted by its subjects. Such values tend to be instilled by a system of fundamental laws and principles, and upheld by parliaments, courts, and other institutions established to maintain and reinforce them. This notion of shared membership, of collective rights and responsibilities as common to commercial companies and supranational organizations such as the European Union (EU) as to organs of any individual government is known as a ‘constitution’.

Constitutions come in all shapes, sizes, and formats. They can be formal or informal, long or short, absolute or merely advisory. Most signifi cant, though, is the difference between the two broad types of constitution adopted by individual states: written and unwritten. Of course, for any set of ideas related to one’s citizenship of a state to be communicated and sustained effectively, some kind of written record will need to exist. Yet there is an important distinction between constitutions described as ‘written’ and ones that are not. All constitutions of any worth comprise elements that have been written in a literal sense—for example, laws or decrees laid down in documentary form. But this does not make them ‘written constitutions’ per se. Written constitutions are, rather, codifi ed frameworks: single manuscripts summarizing the rights, values, and responsibilities attached to membership of the states to which they relate.
For historical reasons, some states have adopted written constitutions while others have not. Although this is not universally the case, written constitutions have tended to emerge in countries where there has been a sudden change in the entire system of government caused by a political upheaval such as a war, invasion, or revolution. This was certainly the case for two of the nations with whom the term is perhaps most closely associated: France and the USA. France’s constitution derives from the Declaration of the Rights of Man and of the Citizen, adopted on 26 August 1789 by the National Constituent Assembly convened in the aftermath of the French Revolution, and later amended to enshrine the three abiding principles of ‘liberty, equality, and fraternity’. The USA adopted its equivalent a decade after declaring independence from Britain, on 17 September 1787, at a landmark constitutional convention in Philadelphia, Pennsylvania, addressed by the Enlightenment philosopher Benjamin Franklin.

Anger Management (Be Calm)

My husband, our two kids, and I were enjoying an idyllic trip to Hawaii, driving up the winding (and dangerous) Road to Hana and taking in the beauty of the cliffs and coastline. And then it happened. For no apparent reason, my son, then age 5, threw a water bottle from the backseat toward my husband, and it hit the windshield with a ferocious bang. By some miracle, we didn't crash, but we did lose control...big-time. Both my husband and I were ranting, raving, screaming, threatening: "Why would you do that? Don't you know we could have been killed? Here we are taking you on the vacation of a lifetime, and you throw a water bottle for no reason?" And on and on we went, spewing way more venom than our preschooler could ever deserve or even comprehend, for that matter.

Tears began rolling down our son's cheeks, and his lip quivered as he fought back sobs. After what I'm sure seemed like an eternity to him, we calmed down and continued on our way, and I tried to bury the incident in the back of my mind.

I had almost forgotten all about it when, a few weeks later, I replayed our Hawaii-trip video. There I was, recording a waterfall out the window of the car. I tucked the camera into its bag — accidentally leaving it still recording — and then the "water bottle incident" occurred. Though the screen was black, I heard my husband and myself screaming at our son, badgering him, shaming him.

Then it was my turn to fight back tears. How could I have freaked out like that in front of my kids, at my kid? The rant sounded so much more vicious and vile than I remembered its having been, but there it was on tape — proof that I was the worst mother in the world. I may have erased that incident from the vacation video, but I don't think I'll ever be able to erase it from my memory.

Like it or not, most of us parents flip out in front of our dear children from time to time. Sometimes the anger is aimed at them, other times not, but it's almost always a deeply unsettling experience. Fortunately, there are simple — sometimes surprising — steps you can take to repair the damage, not to mention avoid meltdowns in the future.

The High Price of Losing It

First, recognize that regularly lashing out at or in front of your kids isn't par for the parenting course. It can do some very real damage to their psyches, says psychologist Matthew McKay, Ph.D., a professor at the Wright Institute in Berkeley, CA, and coauthor of When Anger Hurts Your Kids. "Studies have shown that parents who express a lot of anger in front of their kids end up with less empathetic children. These kids are more aggressive and more depressed than peers from calmer families, and they perform worse in school. Anger has a way of undermining a kid's ability to adapt to the world," McKay says.

Gulp. And the younger the kid, the bigger the impact, experts say. "When children are little, you're their universe," says psychologist Robert Puff, Ph.D., author of Anger Work: How to Express Your Anger and Still Be Kind. "When you get angry, their world is shaken. By the time they get older, they have friends and other people in their lives to turn to, and that minimizes the impact." Also worth noting: The occasional, nonabusive freak-out is generally much less damaging than regular fireworks, which send a child the message that he or she is not safe and that there's something wrong with him, says McKay.

That said, kids can actually learn an important lesson from seeing you lose your temper and then regain your cool. "This provides an opportunity to show kids that we all get angry, but what really counts is how we repair things afterward," says McKay. Here, the step-by-steps for doing just that.

When You Shriek at Your Kids

Real-mom meltdown: When Jennifer*, of Huntington Beach, CA, went to visit Disneyland with her three kids, she didn't realize the "happiest place on Earth" would be the setting for one of her ugliest parenting moments. "It was a big outing for us, and the park was very hot and crowded that day," she recalls. "Two of my kids have cystic fibrosis and could use a special pass to bypass the lines. But my 13-year-old went and lost his. Out of nowhere, I yelled, 'You've got to be bleeping kidding me. What the hell is wrong with you?' Immediately, my son started to cry. He had never heard me swear or be so mean to him, and he was devastated. Everyone standing around us was looking at me in disgust. I had to keep apologizing. Tears were streaming down my face because I had obviously hurt him so much."

A University of New Hampshire study found that 90 percent of parents admitted to having hollered at their children, ages 2 to 12, within the course of a year (the other 10 percent must have either been angels or had selective memories).

To avoid a scream-fest, try this trick: In that white-hot moment of anger, visualize your child as a baby, says Sandra P. Thomas, Ph.D., a professor at the University of Tennessee, Knoxville, and coauthor of Use Your Anger: A Woman's Guide to Empowerment. "Older kids and teens are not adorable like babies, and sometimes they can be very obnoxious," she explains. "When you remember them as the babies they once were, that can do some good."

So can taking a break. "If you're able, take a time-out and walk into another room, even if it's just for a minute or two," says psychologist Laura J. Petracek, Ph.D., author of The Anger Workbook for Women. The key here is getting some literal distance from the situation and recovering your sense of calm.

If your anger has already boiled over, the most important thing now is to own up to what you've done wrong. Don't give in to the temptation to blame your child for triggering your outburst. "Say, 'I am very disappointed at your carelessness, but I shouldn't have yelled like that. It was wrong for me to lose it in that way, and I'm very sorry,' " advises Thomas. (Tip: Don't overdo the apology — if you dwell on it, it can make a kid feel as if he's truly been victimized.) Then promise that you will try your best not to do it again, comfort your child as needed, and move on.

When You Spar With Your Spouse

Real-mom meltdown: Angie*, of Seattle, says life has been particularly stressful since her husband lost his job — and their arguments sometimes play out in front of daughter Lexi, age 3. "Just last night, I was yelling at him for not cleaning the house," she confesses. "Lexi came over, tugged on my shirt, and said, 'Be nice to Daddy.' The look in her eyes was one of terror; it stopped me in my tracks. We eventually made up and tried to assure her that Mommy and Daddy still loved each other, but I don't know if she bought it."

It can be devastating for a child to see her parents get furious with each other, warns Charles Spielberger, Ph.D., a psychologist who specializes in the study of anger at the University of South Florida. It's important to circle back quickly and do damage control. Don't try to explain the situation away by reciting a laundry list of ways in which your spouse provoked you — this will only further embroil your children in the drama and stress. "Instead, you might say, 'I was really mad at your dad earlier. We've talked about it, and we're working it out. People who live together get angry sometimes. We're sorry for yelling. We still love each other,' " Thomas recommends. Even if you still want to throttle your spouse, telling your kids you are smoothing things over will help ease their fears and make them feel more secure.

If you can, emphasize what you'll do differently next time, says Jerry Deffenbacher, Ph.D., professor of psychology at Colorado State University, who studies anger issues; this will help a child learn from the experience. For instance: "I was mad that your dad burned the garlic bread, but I apologize; I shouldn't have shouted at him like that. I was frazzled from a really hard day. Next time, we'll remember to set the kitchen timer when we use the oven."

Keep further comments to a minimum. Overexplain yourself, and you could wind up turning your kid into a mediator or therapist, cautions Puff. There's no need to drag her even deeper into your drama.

Real-mom meltdown: While Fiona*, of Detroit, was buckling her youngest son into his car seat after a trip to a bakery, an older driver pulled up near her and began honking. "He was screaming, 'Close your f— door!' without having given me any warning that I was blocking his spot. I raged right back, 'Can't you see I'm putting my baby in his car seat, you $%*#@?!' My tween in the backseat was pretty rattled by my outburst, and I felt horrible about it."

Your first instinct might be to apologize to your kids for having gotten mad — but don't. Everyone gets angry, so you shouldn't be sorry for having experienced this emotion. (This is especially important if you have daughters — girls from a young age are told they shouldn't show anger, says Puff, encouraging them to bottle up their feelings.)

Instead, tell the kids what set you off. Explains McKay: "You might say, 'That man said something that really hurt my feelings, and I got very upset.' " Next, apologize for how you expressed your anger. "Make sure they know that swearing — or whatever you did — was not the appropriate reaction," says Thomas. "Emphasize that you would never want them to act that way." Also say you are sorry if your outburst scared or embarrassed them. (Let's face it — it probably did.) Explain that you let your emotions get the best of you, and that you'll handle it better next time. And then comes the real challenge: making sure that you do.

Short-Circuiting Your Anger

To keep your cool going forward, follow these ground rules:

Ask the right question When a child is being difficult and your temper is about to flare, follow this advice from McKay: Instead of thinking, Why is he doing this to me?, focus on the child; he's probably acting out for a reason. Is he hungry, bored, tired, or in need of attention? Try to meet his need instead of letting your anger get the best of you.

Keep an anger journal that documents when you lose your cool. "Look for patterns — what time of day do you get angriest? Under what circumstances?" advises Deffenbacher. "Once you identify those anger 'flash points' in your life, brainstorm ways to minimize them." You can even get your kids in on the act: Say, "It irritates me when you ignore your chores — how can we make this a better situation?" By giving your kids a voice, you're empowering them to be part of the solution.

Minimize marriage spats "In a calm moment, you and your spouse should agree to handle your next argument differently," Deffenbacher says. "Give yourselves permission to walk away if you're getting too angry in front of the kids. Develop a code word for when you are getting really mad, and let that signal that you'll discuss the issue later, in private, when you're calmer."

Talk through your emotions out loud when you're with your kids and a stranger annoys you. "Say, 'Wow, that person just cut me off — how rude! But maybe there's an emergency she had to deal with, or she just didn't see me. Whatever the case, I'm not going to let it ruin my day,' " recommends Deffenbacher. By doing this, you're modeling how to handle life's everyday frustrations — and how to control your anger before it controls you.

For anyone interested in getting Paretologic’s PC Health Advisor license key, I suggest you to read what I’ve found after I purchased it. It is important for me to tell others what it is all about and if it can really help in fixing PC problems and other Windows glitches. I found something really interesting about it…I’ll tell you about that later.

I guess that you probably experience some kind of error(s) with your PC/Windows, whether it is an error message or maybe other general Windows problem, and you’ve probably heard that this tool can help you to fix that.
When I happened to come across that irritating dll error, I searched the web for a solution; there was a flood of information and tons of suggestions: “do this…”, “edit that registry record…”, “replace that file…”, come on people, I’m not a computer savvy and I’m not going to do all that, it sounds too risky…
Too risky from one hand and too expensive for a PC technician to repair from the other hand, I called one of my buddies who told me that he can try fixing that dll error, but he gently implied that he prefers to avoid that so if something goes wrong, I won’t be blaming him for that...
He suggested me to try and get a reliable errors repair tool and mentioned a few including Paretologic’s PCHA. I’ve installed it, ran a scan, it detected a bunch of dll errors. At that point it asked me for a license in order to repair those errors.
Anyway, I found someone on Facebook who gave me the following serial key:
36003-4CA20-A84DA-6E62A
It worked for me in the beginning, but after a while it got expired (you can try it on your machine, maybe it’ll work for you without expiring…)
Next I got a valid PC Health Advisor license key and it really fixed that problem, but that wasn’t the point that I wanted to tell you about…
The point was that it detected something else, a much worse problem that I didn’t even know about – a Malware (Malicious Software) that resides on my PC…(Where was my anti-virus program when I needed it?) it removed it immediately.
Warning! - don’t waste your time trying to find a free PCHA license, there isn’t such thing…and if so, it is probably illegal and might get you into trouble. (Getting a valid PC Health Advisor license key costs ‘peanuts’ and they provide free support for any problem that their tool hasn’t been able to repair).
Kenneth D. Chestek, Indiana University School of Law (Indianapolis) has publishedCompeting Stories: A Case Study of the Role of Narrative Reasoning in Judicial Decisions. Here is the abstract.

Within minutes after President Obama signed into law the Patient Protection and Affordable Care Act (derisively referred to by some as the “Obamacare” law), the lawsuits started flying. Literally dozens of suits were filed all across the country. Some were frivolous, but many others raised serious issues of federalism and the reach of Congress’ power under the Commerce Clause.

Of the initial spate of lawsuits, ultimately five were decided by various trial courts on the merits of the Commerce Clause issue. Three judges found the law constitutional, and two others found it unconstitutional. But since the issue is almost purely a question of law (it is the same Commerce Clause and the same body of Supreme Court precedent interpreting it in all five cases), the question arises: why did these cases come out differently?

The mainstream media has seized upon a political explanation: the three judges who found the law constitutional were appointed by Democratic Presidents, while the two judges who found the law unconstitutional were appointed by Republican Presidents. This article challenges that assumption, and suggests a more nuanced explanation: each of the plaintiffs in these cases had different stories to tell. The article explores narrative reasoning (defined as norm-based thinking instead of pure rule-based reasoning) as a possible explanation for the divergent results in these cases.

10 Things Every Taxpayer Needs to Know About the Pension Law

By: Maggie Beetz

The Pension Protection Act, signed into law on August 17, 2006, is designed to address the nation-wide problem of under-funded pension plans. The law penalizes noncompliant companies and encourages employee contributions, but many of the changes directly impact taxpayers of all ages, regardless of retirement status.

"Taxpayers will benefit from many of the act's provisions, some of which come in the form of tax breaks, but individuals cannot take full advantage of the tax breaks until the new laws are fully understood," said Michael Smith, Managing Authorized Taxpayer Representative at tax services firm FSI Tax Corp.

The following is a rundown of the most important tax code changes and how they will likely affect taxpayers, as well as retirees.

1. Direct IRA Tax Return Deposits

Taxpayers can now have their tax returns deposited directly into their IRA accounts. The IRS already offers taxpayers the option to automatically deposit returns into checking and saving accounts. By adding IRA accounts, legislators hope taxpayers will contribute more funds toward their retirement accounts.

2. 529 College Savings Plans

Many temporary tax laws enacted by the 2001 tax cuts were made permanent by the Pension Protection Act. This includes the ability to make withdrawals from 529 college savings plans without suffering tax penalties.

"Tax-free college savings withdrawals may seem inappropriate in a pension law, but this provision is welcomed by parents who would otherwise resort to tapping their IRAs to fund their children's education," said Smith.

3. Saver's Credit

Another 2001 tax break that was set to expire this year is the Saver's Credit, a tax credit matching up to $2,000 for lower-income workers who put money into their retirement accounts. This tax break benefits workers who earn less than $25,000 because pre-tax contributions lower the taxpayer's reportable income and the Saver's Credit provides additional tax relief with its matching funds.

4. Increased Contribution Levels

In 2001, the IRS temporarily raised employee-sponsored retirement plan contribution levels from $2,000 to $4,000 this year, $5,000 in 2008 and then adjusted by inflation. The higher limits were set to expire in 2010, but the act made them a permanent increase.

This change, also intended to encourage increased contribution amounts, applies to 401(k)s, IRAs, 403(b)s, 457s and catch-up contributions for workers aged 50 and older.

5. Direct Rollovers from a 401(k) to a Roth IRA

Employees who move from one workplace to another were previously permitted to transfer their 401(k)s to traditional IRAs, both of which require taxes to be paid once money is withdrawn. Only then was the individual allowed to transfer the account into a Roth IRA.

The law now permits former employees to transfer their employer-funded retirement accounts directly into a Roth IRA, a popular option due to the fact that contributions are made after taxes are taken from earnings, which means that there are no taxes due upon withdrawing funds.

"The tax code changes enacted by the Pension law benefit taxpayers and steer them toward contributing to their own retirements," explained Smith. "While companies should be held accountable for funding employee pensions, each taxpayer should take advantage of changes that make it easier to ensure a secure retirement."

Tax Deductions for Charitable Giving

Non-pension-related tax code changes include several provisions that significantly increase charitable giving regulations, some of which are unlikely to please donors.

5. Documenting Items

To discourage taxpayers from inflating the value of non-monetary charitable donations for inflated tax deductions, the IRS now requires taxpayers to fill out a form detailing the gifts. Additionally, any significant household item, valued at more than $500, must be appraised before the taxpayer can take a deduction.

Many charitable organizations, including Goodwill Industries International, say the new provisions will guard against worthless donations more suitable for the trash bins, but critics argue that increased regulation will discourage would-be donors and cause a decrease in charitable giving.

6. Documenting Monetary Gifts

Monetary donations will also require documentation. Regardless of the amount, a taxpayer should retain proof of any donation. Appropriate documentation can be a bank record, canceled check, credit card statement or receipt from the charity.

"These records are not required to be included in the tax return but they should be kept on hand should the IRS request proof," advised Smith.

7. Direct Donations from IRAs for Seniors

Another tax law that many charities support affects only seniors. For the next two years, donors 70 ½ or older will be able to donate to charities directly from their IRAs, an accommodation that keeps the donated amount tax-free and avoids tax penalties for early withdrawals.

This provision benefits eligible taxpayers who take the standard deduction, which many older filers do because they receive larger standard deductions. This can also benefit individuals facing donation limits. Generally, people cannot donate more that 50 percent of their incomes, but the money does not count as income when it comes directly from the IRA.

Officials at charities such as United Way claim that despite being temporary, this provision will likely bring in tens of millions of dollars.

Other Pension Provisions

8. Automatic 401(k) Sign Up

Employers are allowed to automatically sign up employees for a 401(k). This change encourages participation from people who may not otherwise bother to sign up for the plan in the first place, though they will have the option to opt out.

9. Investment Advice

Because employees often choose safer investments for their 401(k)s, which generally result in modest returns, the act allows them to receive investment planning advice to encourage riskier investments with the potential for higher returns. The act also provides protection against dishonest advisers who steer employees toward decisions that could increase their own profit.

10. Non-Spousal Benefits

Two provisions that expand allowable withdrawals are pleasing gay rights activists. The non-spousal rollover lets retirement account assets be transferred to a designated beneficiary upon the retiree's death and the hardship distribution allows retirement account assets be used for a medical or financial emergency of a beneficiary other than a spouse or a dependent.

The majority of the Pension Protection Act aims to ensure that companies fully fund traditional pension plans over a seven-year period, starting in 2008. But many provisions promote increased individual employee participation in retirement planning.

Smith said that while the new law expands allowances and makes it easier for individuals to increase retirement savings, it may be a step toward employee-funded retirement plans - a move that has many critics concerned.

How to Obtain Optimal Health

By: Monique Hawkins

You should already know that nutrition is very important to your quality of life. If you want to have a healthy life and lifestyle, you will need to have a healthy diet with proper nutrition. You might hear all the time that your nutrition greatly affects the way you live and your quality of life but have you ever really thought about why? Do you really understand why it is so important?

If you really want to take the steps to live the long life that you deserve and to be as healthy as possible and enjoy those years, than you need to learn all you can about the importance of optimal nutrition. What you eat really affects your body and health.
1. What is optimal nutrition?
2. What nutrients do you need to be healthy?
3. What foods give you these nutrients?
Importance of Optimal Nutrition
Optimal nutrition is very important to your overall health and fitness. Studies have shown that people can actually live longer if they have healthy nutrition. It is proven that there is a link between optimal nutrition and long life and long term health.
If you take a look at society, you will notice an increasingly large number of people that are overweight and obese. You will also see problems such as poor teeth and acne, dry, brittle skin, dry hair and other problems. You will find many people on medications for headache, stomach problems, acid reflux, constipation, heart disease, high blood pressure and more. What may be more alarming than the high amount of medications is the fact that most people receive very little information about what is actually causing their disease or condition. Instead, they get a pill.
What many people never know is that what they are eating (or not eating) can be causing these health problems. You also need to understand that you will have to make changes and adjustments to your intake over the years and stages of your life. Just like toddlers need a different diet from teenagers, you also need to alter your diet as you continue through all of life's stages. Understanding what is best for you through each stage of your life is the best way to remain in optimal health.
Micro and Macronutrients
Many people hear that they need proper nutrition but just what does that mean exactly? What nutrients do you need to be healthy? Optimal nutrition will include a variety of different micronutrients and macronutrients. Micronutrients include certain vitamins, minerals and antioxidants. Macronutrients include carbohydrates, proteins and fats that make up the foods you eat.
There is too often a lot of myth surrounding the nutrients, our bodies and how we use these nutrients. This is why it is very important that you get all the facts when planning to change your lifestyle and diet. Many people are suffering from malnutrition and may not even know it. Many overweight individuals may be suffering from malnutrition. Just because you are eating does not mean you are eating the right things.
Micronutrients are the vitamins, minerals and antioxidants that your body needs to be healthy. The specific ones and amounts of each will depend on your body, sex, age and other factors. Every person is different so there is not one set plan that works for everyone. You need to learn what works for you. As you change, grow older, etc. this will change again and you will continue to have to adjust this.
Macronutrients are the carbs, proteins and fats that you get from foods. The amounts of these that you need will vary as well. This is where many myths come in about what you should or should not eat. The facts are that too much of anyone can be bad and not enough can be bad. It's all about finding a balance. This means those "All-Carb" or "No Carb" diets that are so popular on the market are really not the best thing for you.
What you choose to ingest in your body has a big impact on your overall health and your general well-being. People now eat more fast foods and frozen dinners and other quick meals that are not very nutritious at all. Some of these foods even have additives in them that can make them addictive so that you want more and more. People typically eat out of hunger and many of these foods do not work to satisfy your hunger leaving you wanting more or something else. Yet, they still have many calories and fat and other things that your body does not need.
Make the Committment
If you are serious in obtaining optimal health to the best of your ability, then take a look at your lifestyle in general. Are you eating the right foods? Are you exercising? Are you getting plenty of fresh air on a daily basis? Do you have positive relationships? If you find yourself answering "no" to these questions, then make the commitment to change. Talk with your family, friends, or a nutritionist. Check to see if there are support groups in your area related to health and lifestyle changes. Look into joining your local gym. Do your research and then purchase the right nutritional supplements that will help you achieve your goals.

If you at least try to make a change in one area, more are sure to follow! You are now on your way to optimal health.

Taking a Chance on Healthy Living!

By: Dan Farrell

One of the most important aspects of living a healthy and prosperous life is understanding "risk." By this I mean knowing how to understand and analyze situations in life that affect health. Being able to accurately weigh benefits and risks when making health decisions is very important! Too often decisions are based on incomplete or inaccurate information and this is a huge mistake with significant consequences!

Failure to accurately assess risk keeps people locked in all kinds of unhealthy situations including poor eating and exercise habits (lifestyle), relationships and jobs. Sometimes people are just afraid to step out and make a change. They see "risk" in making a change when the REAL risk comes from NOT making a change. From my perspective, living with the stress, unhappiness and frustration of indecision and poor health is the greatest risk of all, and one that is definitely not worth taking!
Accessing "risk" is nothing more than collecting information, weighing the alternatives and then making appropriate decisions based on the information.
Some risks to our health are more "real" than others. For example, it is common knowledge that obesity is associated with a wide variety of health problems. On the other hand, there are some health risks that are so remote we rarely think about them. On a practical level, eating highly processed foods and avoiding a daily dose of fresh fruits and vegetables is rarely considered serious. But, as too many have already discovered, the long range consequences of this practice are real and devastating.
Failure to accurately assess risk limits us in many ways. We imagine the "risk" of talking with our children about drugs, dating or sex and we put off having the "talk," even though the risks of NOT talking are infinitely greater. Fear of flying and public speaking are two more "risks" affecting millions of people. But practically speaking, these fears are unfounded. People ride in cars every day, even though cars are far more dangerous than commercial aircraft! It's a failure to accurately assess risk, and it limits our health, prosperity and pleasure in life.
The goods news is that failure to accurately access risk is reversible! The effects of those decisions to eat inappropriately or NOT to exercise are, as the common expression goes, "do-overs." We can effect positive change in our lives by following a few simple steps to accurately access risk:
1. Accurately define your present situation and access your health "risks". Are you eating a healthy diet? Are you getting enough exercise and good quality sleep? What are the consequences if you DON'T change? Weigh the benefits of healthier living vs the potential risks such as increased cost, inconvenience or discomfort.
2. What do you stand to gain if you change your present circumstances? Assess the "up-side" potential. Too often we look only at the "downside" risk and forget the benefits. What good things might happen if you take the risk and win?
3. Limit the "down-side" if you happen to make a wrong decision. Don't continue down a path if it does not produce results. This is especially important when following weight loss programs. If the pounds are not coming off or if the weight loss is only temporary, find a new program! You not only want to lose weight, but want to sustain the weight loss for as long as possible. Take steps to ensure this will happen. Clear, concise, realistic objectives will definitely help.
4. Reduce your risk by being smart! Understand the situation and seek the advice of experts in the field of health and nutrition. This includes finding and forming partnerships to receive support and get good advice.
5. Have a fall-back position. If the decision you make fails to produce the desired results, be prepared to take a long, hard look at the circumstances and be prepared to change what you are doing.
Everything in life involves some element of risk. Driving your car, meeting someone new, crossing the street...but we do them every day. Winners in life are willing to accept the risk and continue on their way! Get involved, be smart about how you play the game, come prepared for a few failures along the way, but don't quite. You will reap the benefits for your effort and live a happier and healthier life. I like to remember the words of the great Winston Churchill when he said, "Never, never, never give up!"

For a variety of reasons, clinicians often struggle to arriveat a confident diagnosis of IBS. The differential diagnosis in patients who have symptoms that are suggestive of IBS is broad and there is no reliable biologic marker for this condition. IBS is viewed more often as a "diagnosis by exclusion" than as a primary diagnose. The manning criteria, Rome I and Rome II criteria, developed by multinational working groups, provide a uniform framework for the selection of patients in diagnostic and therapeutic trials of IBS.

Gastrointestinal infection with its consequent mucosal inflammation seems to play a role in the etiology of IBS in a subset of patients, although there is some doubt that this condition is of real importance. Recent observations suggest that substantially less than 25% of patients develop "Post-infectious" IBS.

Nonetheless, recent research has identified abnormalities in immune function in a subset of patients with IBS. Most patients who develop IBS after an Enteric infection will suffer with diarrhea-predominant symptomatology. In such patients, abnormalities in intestinal permeability, gut transit and the numbers and function of immune cells have been proposed. It is likely that post-infectious IBS is one of many disorders that lead to chronic inflammation of the GI tract causing symptoms suggestive of IBS.

The role of emotional stress as an etiologic factor in IBS may also be inferred from the effects of psychological therapies on IBS symptoms. Indeed psychosocial stress alters GI motor fuction and sensation.

Emotional Stress can exacerbate GI symptoms in patients who have functional GI disorders. Anxiety disorders, somatoform disorders can be identified in approximately 40% of patients who have IBS in referral practices.

IBS is actually a heterogeneous combination of different factors as well as other mechanisms that remain to be elucidated.

IBS probably represents the common clinical expression of multiple potential pathophysiologic factors. Potential factors that contribute to IBS include a genetic predisposition to the condition, disturbed central nervous system pain processing and visceral hypersensitivity, mucosal inflammation, abnormal colonic motility and emotional stress.

Genetic Predisposition

It is not uncommon for patients who have suspected IBS to describe similar symptoms, if not the diagnosis, of IBS is family members. This observation gave rise to several studies that evaluated the possible role of a genetic predisposition for IBS, Although these studies do seem to support a genetic contribution for IBS, Although these studies do seem to support a genetic contribution to IBS, the basis of this contribution remains unknown, some investigator hypothesized that differences in inherited patterns of serotonin processing at the neuronal level may play a role, IBS is more common in patients who have first degree relative who has IBS symptoms. Such observational studies, although interesting, do not help us to understand the contribution to "nature versus nurture". The presence of a parent with IBS has been shown to be predictive of the subsequent development of IBS. This finding lends credence to the theory that IS may have a significant learning or behavioral component..

Altered Motility

Numerous motility abnormalities that affect the GI tract have been identified in patients who have IBS. For many years, investigators focused on the role of abnormal motility in the pathogenesis of IBS.

For example, patients whose predominant symptom is diarrhea seem to have accelerated whole gut and colonic transit times. Conversely, Patients who have constipation-predominant IBS demonstrate decreased migrating motor complexes compared with controls who did not have IBS. Whether these motility changes are primary or secondary to another potential etiology of IBS remain to be proven. The degree of variability in observed results and the methodologic limitation of previous trials of colonic motility highlight the need for additional evidence in this area.

Visceral Hypersensitivity and brain-gut interactions

The potential roles of heightened visceral sensation, also referred to as "visceral hypersensitivity" and abnormalities in brain=gut interactions have also been implicated in the pathogenesis of IBS. Several Investigators have reported a heightened visceral Sensation in response to rectal balloon distension in patients with IBS and other functional GI Disorder abnormalities have been identified consistently in the activation of the anterior cingulate cortex which probably plays an important role in the development of attention to aa painful stimulus, the unpleasantness associated with a painfull stimulus, and attribution of an emotional response to a painful stimulus. The anterior cingulate cortex also plays an imprtant role in the activation of descending inhibitory pathways that help to gate or control the passage of afferent information from the periphery to the brain.
This is an excellent (and very important) question. After all, it doesn’t do you much good to know what the law of attraction is if you do not know how to use it to achieve success in your own life. Once you have mastered the basics of the law of attraction you will be able to apply it to any area in your life.

1) The first step in finding success through the law of attraction is to accept responsibility for the things that have occurred in your life, both good and bad. This is often the most difficult part of achieving success through manifestation because we are taught from childhood to believe that our environment contributes in a large part to the circumstances in which we find ourselves. It’s very hard to take the responsibility and acknowledge the fact that your environment was not the major contributing factor in each of these events; in many cases you will have no one to blame but yourself.

In order to help yourself move past these events take a moment and write down on a piece of paper all of the major events in your life (again, both good and bad). Leave plenty of room underneath each one. Now, take a moment to go back and review these events. Write down what you were feeling at the time they happened, how you felt before they happened and what events had occurred prior to this. Chances are you are going to find that events occurring in your favor occurred at times when you were possessed of a positive attitude and other things in your life were going right. On the flip side, events which occurred probably happened concurrently with other events in your life which caused you to have a negative outlook on life. Coincidence?

2) Once you have accepted the fact that you are responsible for your own fate it is time to go one step further and determine what it is about your life that you would like to change. Do you want to find another job? Move to a new house? Enter into a meaningful relationship? Receive a promotion?

Identify the things you wish to achieve and write them down. Display them in a prominent place; constantly being able to view the anticipated results of your endeavors will help to keep you on the right track. In essence, with the creation of this list you are asking the universe for what you want. Take the time to think on this for a while so that it is embedded firmly in your mind, and keep your goals specific; making a goal too big or too general is an almost certain guarantee that you will not be able to achieve it because you will be too busy worrying about how you are going to achieve it.

3) Raise your vibrations so that they are all positive. Act and feel as though you are confident that the end result you are hoping for is going to occur. This is an essential part of the law of attraction because it is very easy to allow your mind to begin to wander to all of the difficulties which you may encounter when trying to achieve your goals. This will cause your vibrations to become negative and will work against you rather than for you.

4) Accept that it can happen. Many times your subconscious is your own stumbling block; you will be attempting to convince your conscious mind that something can happen while at the same time your subconscious is picking out the reasons that it will never work. In order to help yourself overcome this stumbling block and have absolute faith in the fact that you will be able to effect this change in your life you should look again at the sheet of paper upon which you have written your goals and attempt to write them in terms that will help your mind and body accept them as fact.

It is recommended that you write these statements in the third person rather than the first; it is often difficult for the mind to accept something as fact when it is couched in such relative terms as I, me or my. For example, if you are attempting to find a new job you could say, “Millions of people every year work in jobs which make them happy.” If you are seeking to enter a meaningful relationship you could say, “Millions of people around the globe have found their soul mate and are now happily settled in comfortable, established relationships”.

The purpose of writing these statements down is to purge the negative vibes and doubts from your mind. If you are unable to accept the outcome as fact your subconscious mind is going to conjure a different outcome, and it is going to be this outcome that your mind and body focus on; therefore, this outcome is going to be the one that will become your reality and you will walk away absolutely certain that the law of attraction is one hundred percent false.

What Can the Law of Attraction Do for You?

"Why is true success so relatively effortless? It might be likened to the magnetic field created by an electrical current through a wire. The higher the power of the current, the greater the magnetic field that it generates. And the magnetic field itself then influences everything in its presence." David R. Hawkins, M.D., Ph.D.

The law of attraction can help to determine the course of your future, and the successes or failure which you may encounter along the way.

Work
Let us for a moment consider the possibilities of the law of attraction when applied to your working environment. For those who are searching for a job it may be impossible to find one which suits them. Is this because such a job does not exist, or is it because in their subconscious mind they believe that they will not be able to find a job and consequently are releasing so much negative energy out into the universe that they are actually driving these jobs away?
Anyone who has ever tried to search for a job (or known somebody who was) knows that you have a drastically improved chance of finding gainful employment when you are already employed elsewhere than when you are unemployed. For someone who has lost their job and is currently without employment it may seem easier to climb Mount Everest than to get that first all-important interview. It seems as though job after job simply isn’t interested in what they have to offer.

Why is this? It certainly cannot be because there are no employment opportunities out there; after all, chances are they would not have applied for the job if the job had not already made its interest in recruiting new employees clear. Why, then, do people suffer from unemployment for months or even years at a time?

The answer to that is they often believe they will not be able to find a job, and consequently they have stopped trying. In their subconscious minds they do not truly believe that any of their efforts will bear fruit, and so they are projecting that negative energy all around them.

On the other hand, an individual who already has a job is secure and confident in their ability to find a job and do it well; after all, someone has obviously thought them worthy enough to hire them (and keep them) in the first place, and chances are if they are searching for a new job it is because they are confident enough in their abilities that they believe they deserve a job that will treat them better/pay them more/provide more stimulating work/etc.

It is this quiet confidence that will lead to the effects of the law of attraction becoming obvious. Since they are projecting this positive energy around them they will be drawing in positive energy as well, attracting the job that they truly want. Remember when you were listing your goals above and you had to accept the fact that they could happen?

Chances are that you too are looking for more from your career than you have right now; if you are not, then you probably don’t need to be reading this because you have obviously already mastered the ability to chart your own destiny. If you are still seeking for that golden opportunity, ask the universe for it, then sit back and wait, secure in the knowledge that the universal law of attraction will bring it to your doorstep. It might not be today, it might not be tomorrow, but it will occur.

Let us say that you are satisfied with the job you have but you are seeking a promotion; after all, no one wants to be at the bottom of the totem pole forever.

In order to get the promotion you are dreaming about the first thing you must do is remove any doubt from your mind. Walk into the interview one hundred percent sure that the position will be yours; remember, if you are still living with the belief that the position may be above you and you are not certain that you have the necessary skills to fill the position you are absolutely right.

“We are unlimited beings…we have no ceilings”

Michael Beckwith

The same principle can be applied to the opening of a new business as well. If you have ever gone to high school you have probably received the lecture on what to do and what not to do in an interview. One of the biggest don’ts in interviewing protocol is to let the interviewer see that you are nervous. By showing the interviewer that you have confidence in your ability to handle any job which they throw at you, you are increasing your value as an employee in their eyes.

The same can be said of any attempts to open a business. It is essential when approaching prospective investors that you have one hundred percent confidence in yourself and your business in order to guarantee that they will be willing to take a chance on you.

Is this need for absolute confidence a coincidence only, or is it the law of attraction at work? By having confidence in your abilities you are sending positive energy out into the universe, and consequently drawing the positive energies currently existing in the universe back unto yourself.

It is impossible to over-emphasize the importance of vibrating positive energy when you are talking about the law of attraction, and you will see this theme repeated in any and all conversations pertaining to it. The release of positive energy into the universe is what allows you to chart the course of your destiny on a strong route to success rather than a wavy road of uncertainty that will eventually lead you unhappiness, either through the failure to achieve the goals for which you have worked so hard or through the constant up and down flow of your life, never being certain which is going to dominate.

Love and Family

There are two parts of their life which people generally try to change; their work environment and the relationships which they have with their families and their significant others. You may be asking yourself, “Can the law of attraction really help me to build relationships with the people that I love, and to mend broken fences?”

The answer is, absolutely! The people you love are governed by the same ebb and flow of energy as you yourself are, and as such their energies will naturally be attracted to like energies which are being emitted from another person. If you are vibrating positive energies and emotions they will respond in kind. They will not be able to help themselves; it is simply the way of the world.

Let us consider your family first, as with family there is already a subliminal bond which will help you to improve your relationship right from the very beginning. There are many reasons why family members may find themselves at odds with each other; it is not necessarily a pre-requisite that you like the people you love, and for families who often find themselves in each other’s back pockets and competing for common resources the fights can become vicious.

Regardless of the reasons you and your family may have had for your falling out it is never good to leave relationships festering like that. You need to fix them in order to achieve true serenity and harmony in your life (have you begun yet to notice how closely the law of attraction interacts with other laws which govern the universe?). In order to fix a relationship that has been broken you must first be confident in the fact that you not only are going to be able to mend the broken ties, but that you truly want to.

It is very easy to utter lip service to the people around you, telling them that you want to mend your broken fences (and often blaming the fact that they are broken on the other party involved, of course) when in reality you continue to carry the stain of dislike that you hold towards the other person in question. You don’t really want to mend your fences, or if you do you have not yet let go of what has caused the separation in the first place.

Letting go of your resentment is an essential ingredient in finding harmony, for in order for the law of attraction to be able to work to smooth your way you must first rid yourself of all of the negative energy you have been sending towards them so far. It is important that you accept the fact that you can forgive and forget, allowing the two of you to move on with your life with a much happier relationship than you have experienced to date.

The process of attracting a significant other is much the same; however, in order for the law of attraction to be able to attract them to you, you must be very specific when making your request to the universe regarding exactly what it is that you are looking for in a relationship.

This does not mean that you should outline the color of their hair, their eyes, their political background (although if this is of primary importance you it may be worth submitting it for consideration) or their political position in society. Remember, the law of attraction means that your subconscious mind is going to be drawn to their subconscious mind, and politics are not going to be of primary importance there. Instead, focus on the kind of values you wish for them to possess, the type of relationship that you are looking to share with them (do you want to get married, date casually, etc) as well as personality traits which you feel are especially important. Then allow yourself to believe that you are going to find this paragon of virtue.

The last step here is the most important. As was the case in the example we used pertaining to the ability of an individual to obtain employment, the belief that a relationship with the person of your dreams is beyond your reach is going to result in you being absolutely correct. Remind yourself that every day hundreds of men and women are building a life with the person of their dreams; there is no reason for you to be excluded from this number.

It is essential that once you have placed a request for a significant other with the universe that you be willing to have patience for the desired results to occur. The whys and wherefores of this will be discussed in more depth a bit later, but for now let us look at the obvious. The universe is not always going to give you exactly what you want, exactly when you want it. It does things in its own time.

Now, imagine that you have asked the universe to give you the man or woman of your dreams, but you become impatient because they have not yet become a part of your life within a few months of making the request. You begin to date someone else, and that someone else begins to occupy your mind and your attentions until they are all that you see. They are not the person which you asked the universe for, however; they are simply someone intended to fill the time until that person arrives.

Over the course of time that you are dating this other individual, however, you have become acquainted with quite a lot of new people. These new people are shadows passing in and out of your life because they are not this new person whom you have begun to date. What would you do if the person you had been waiting for was among that number? What if they had come looking for you, but you did not recognize them because you were so busy trying to keep yourself busy until they got there?

It is essential that you not close either your mind or your heart to the universe because of external distractions; this is the most fatal mistake you could make, for it means that you have lost faith in the ability of the energies of your mind to interact with the energies of nature to bring you your desired results, and the negative energies generated from these thoughts will result in the person of your dreams walking away from you before you even knew they were there.

Before we go too deep into the modern applications of the law of attraction it is important that you understand that this is not simply New Age nonsense (most descriptions of the law of attraction refer to it as a product of a New Age Mentality). The principles of the law of attraction date back far beyond the new found popularity of the New Age.

The immortal Buddha was actually one of the first to introduce man to the law of attraction. He said, “What you have become is what you have thought.” This was a principle that the people of the east were acquainted with for centuries before it began to sweep into the western hemisphere.

The concept of karma also may have drawn its roots from the law of attraction. Karma states that you will eventually be revisited by that which you have sent out into the universe. If you have practiced kindness and compassion you will receive in kind. If you have been deliberately cruel to another you will receive back into your life that cruelty which you have sent out. Your actions and thoughts morph into physical entities, causing the universe to react in kind.
The law of attraction began to gain popularity in the western hemisphere in the 19th century, as people began to appreciate the power of positive thinking and apply it to their life. This new concept was first introduced to the general public by William Walker Atkinson, the editor of New Thought magazine, who published a book called Thought Vibration or the Law of Attraction in the Thought World in 1906.
As you can see, the law of attraction is not new. The concept that thought can have a predominate affect on the course of a man’s destiny has been taught by wise men throughout the ages, and has given rise to a whole new era of beliefs.
What is the Premise of the Law of Attraction?

The theory behind the law of attraction is the belief that energy attracts like energy in the vast expanse of space and time that comprises our universe. Each person’s being is constantly radiating energy out into space; the type of energy being radiated is determined by the emotional state of the individual in question and may differ from day to day-sometimes even hour to hour!

This emotional energy is what is commonly known as a “vibe” and is referred to as a vibration by scientists studying the law of attraction. Chances are that you are familiar with the term. Have you ever been with someone who is so happy they seem to be radiating a “glow which inspires happiness in all those around them? By the same token, have you ever spent time with someone who was so critical and unhappy that they consistently gave off a “negative vibe” which seemed to suck the life and happiness out of all those around them?
You do not have to possess psychic powers to be able to feel the vibes that people emit; this energy is very real on a psychological plane and will affect anyone, anywhere at any time. Our vibrations are usually an unconscious response to some form of environmental stimulus; something has happened which has caused us to feel happy, or sad, or scared, or confused, or stressed, etc., and our subconscious response to this (because vibes are generated and projected from the subconscious rather than the conscious) is something that is beyond our control.

Chances are the person who is emitting a negative vibe does not choose to be unhappy, nor do they wish to inflict their unhappiness on all those around them by the simple fact of their presence. (Before you say what you are thinking, yes, there are some exceptions to this rule. Misery does love company and there are many who take a great deal of delight in inflicting their pain on other people. It is important to understand that this is not usually done in a desire to cause others pain but out a desire to not feel so alone in their unhappiness. But we digress…)

There are a number of feelings which lead to positive and negative vibes being emitted, and it is important before we continue on any form of discussion about the law of attraction that you understand what each of these are (you’ll understand the reasons for this a little later).

Positive vibes

Positive vibes are generated from good feelings, such as:

Hurt

What do Vibes Have to With the Law of Attraction?
As we mentioned earlier the fundamental principle of the law of attraction is the belief that life energy attracts like energy. This means that if a person is emitting positive vibes they will draw good things to them and if they are emitting negative vibes they will draw bad things to them.

”You are a living magnet, attracting what you want.”

”You are a living magnet, attracting what you want.”
You have seen this principle in practice before. Have you ever known someone who was always upbeat and positive and seemed to be too lucky to be true? On the flip side, you have certainly known someone who loved to complain and look on the darker sides of life that always seemed to have something new to complain about because things were always going wrong in their life. These examples show people attracting the results of the energy they are giving off.
“Remember, you attract to your life whatever you give your attention, energy and focus to, whether wanted or unwanted.” Michael J. Losier
Does this mean that all of the bad things that happen to you in this life are because you subconsciously wanted them to? This is one of the most common arguments against the concept of the law of attraction and it often the hardest to refute because people have not yet recognized that the law of attraction is not a pipe dream or something that someone dreamed up while sitting on their porch one hot summer night. It is a fact of life, and its effects are far reaching.
In answer to your question, no, not everything bad that happens in your life is a result of you subconsciously wishing for it to happen. Sometimes it is a result of someone else wishing for it to happen. To quote an example from a website pertaining to the law of attraction a child or a spouse who is abused is not abused because they wished for this abuse to happen. This abuse happened because the abuser allowed their negative thoughts concerning their child or spouse to creep across their subconscious until they eventually began to dictate their actions.
The mind is a powerful thing, and where the mind goes the feet will soon follow. The foundation of any success you are going to encounter in lie is not the ability of your physical body to overcome the obstacles but of your mind to believe that a way lies around them. “Where there’s a will, there’s a way.” Where your mind can believe that there is a way for the body to achieve its heart’s desire a way does exist.

What is the Law of Attraction?

The belief held by many theorists is that the universe is governed by a set of universal laws; these laws cannot be changed, cannot be broken and apply to every individual, regardless of age or nationality. These laws are the riverbanks which guide the flow of their lives on its journey to its ultimate end.
The law of attraction is one such law. The law of attraction is the belief that anyone can determine their destiny through the power of their minds.

The Law of Attraction: Getting Everything You Want Out of Life Through the Power of Your Own Mind. And Let Your Thoughts Determine Your Destiny

Imagine for a moment that you have in your possession a source of complete and total power. You alone can command the warmth of the sun, the fall of the rain, the turn of the tides and the direction of the winds. What would you do with this kind of power? Would you abuse it causing the world to fall into utter chaos? Would you be benevolent and merciful, using your power to help the people of your planet achieve their ultimate potential?

Unfortunately (or fortunately, as the case may be) there is no way for a person to have that much power. Mother Nature controls the planetary systems according to her own rules and her own designs. You will never be able to have utter control over the environment you are inhabiting.
What if you could, however, have the power to determine the course of your own life? What if you could accomplish great things and acquire great riches just by using the power of your own mind? What if I told you that this does not have to be a “what if?” What if I told you that you possess in your psyche the power to chart the course of the rest of your life on whatever path you see fit?
Chances are you would tell me that I had obviously been watching too much Sci-Fi and needed to get out of the house more often, not to mention my obvious need to expand my vocabulary, considering the number of times I have used “what if” in this conversation. You would be wrong (about the Sci-Fi, anyway). Every person holds in their mind the power to shape the events of their life to achieve whatever end they see fit. This power is what is known as the law of attraction.
