&lt;a href="http://feedads.g.doubleclick.net/~a/4qXNSFDq9PGH-rQi3MQN2HHXiyY/1/da"&gt;&lt;img src="http://feedads.g.doubleclick.net/~a/4qXNSFDq9PGH-rQi3MQN2HHXiyY/1/di" border="0" ismap="true"&gt;&lt;/img&gt;&lt;/a&gt;&lt;/p&gt;verticle horizon&lt;br /&gt;&lt;br /&gt; &lt;center&gt;       &lt;h2&gt; Grandmother Spider Steals the Fire&lt;/h2&gt;     &lt;span style="font-size:100%;"&gt;(Creation story of the&lt;br /&gt;    Choctaw People of Tennessee and Mississippi)&lt;/span&gt;    &lt;hr /&gt;   &lt;p align="left"&gt;The Choctaw People say that when the People first came-up out      of the ground, People were encased in cocoons, their eyes closed, their limbs      folded tightly to their bodies. And this was true of all People, the Bird      People, the Animal People, the Insect People, and the Human People. The Great      Spirit took pity on them and sent down someone to unfold their limbs, dry      them off, and open their eyes. But the opened eyes saw nothing, because the      world was dark, no sun, no moon, not even any stars. All the People moved      around by touch, and if they found something that didn't eat them first, they      ate it raw, for they had no fire to cook it.&lt;/p&gt;   &lt;p align="left"&gt;All the People met in a great Pow-wow, with the Animal and Bird      People taking the lead, and the Human People hanging back. The Animal and      Bird People decided that dark was not good, but cold and miserable. A solution      must be found!!! Someone spoke from the dark, "I have heard that the people      in the East have fire". This caused a stir of wonder, "What could fire be"!!!      There was a general discussion, and it was decided that if, as-rumor-had-it,      fire was warm and gave light, they should have it too. Another voice said,      "But the people of the East are too greedy to share with us". So it was decided      that the Bird and Animal People should steal what they needed, the fire!!!&lt;/p&gt;   &lt;p align="left"&gt;But, who should have the honor!!! Grandmother Spider volunteered,      "I can do it!!! Let me try"!!! But at the same time, Opossum began to speak.      "I, Opossum, am a great Chief of the animals. I will go to the East and since      I am a great hunter, I will take the fire and hide it in the bushy hair on      my tail". It was well know that Opossum had the furriest tail of all the animals,      so he was selected.&lt;/p&gt;   &lt;p align="left"&gt;When Opossum came to the East... he soon found the beautiful-red-fire      jealously guarded by the people of the East. But Opossum got closer and closer      until he picked up a small piece of burning wood, and stuck it in the hair      of his tail, which promptly began to smoke, then flame. The people of the      East said, "Look, that Opossum has stolen our fire"!!! They took it and put      it back where it came from and drove Opossum away. Poor Opossum!!! Every bit      of hair had burned from his tail, and to this day, Opossums have no hair at      all on their tails. &lt;/p&gt;   &lt;p align="left"&gt;Once again, the Pow-wow had to find a volunteer Chief. Grandmother      Spider again said, "Let me go!!! I can do it"!!! But this time a bird was      elected, Buzzard. Buzzard was very proud. "I can succeed where Opossum has      failed. I will fly to the East on my great wings, then hide the stolen fire      in the beautiful long feathers on my head". The birds and animals still did      not understand the nature of fire. So Buzzard flew to the East on his powerful      wings, swooped past those defending the fire, picked up a small piece of burning      ember, and hid it in his head feathers. Buzzard's head began to smoke and      flame even faster!!! The people of the East said, "Look!!! Buzzard has stolen      the fire"!!! And they took it and put it back where it came from. Poor Buzzard!!!      His head was now bare of feathers, red and blistered looking. And to this      day, buzzards have naked heads that are bright-red and blistered.&lt;/p&gt;   &lt;p align="left"&gt;The Pow-wow now sent Crow to look the situation over, for Crow      was very clever. Crow at-that-time was pure white, and had the sweetest singing      voice of all the birds. But he took so long standing over the fire, trying      to find the perfect piece to steal that his white feathers were smoked black.      And he breathed so much smoke that when he tried to sing, out came a harsh,      Caw!!! Caw!!!&lt;/p&gt;   &lt;p align="left"&gt;The Council said, "Opossum has failed. Buzzard and Crow have      failed. Who shall we send"!!!&lt;/p&gt;   &lt;p align="left"&gt;Tiny Grandmother Spider shouted with all her might, "LET ME      TRY IT PLEASE"!!! Though the council members thought Grandmother Spider had      little chance of success, it was agreed that she should have her turn. Grandmother      Spider looked-then like she looks-now, she had a small torso suspended by      two sets of legs that turned the other way. She walked on all of her wonderful      legs toward a stream where she had found clay. With those legs, she made a      tiny clay container and a lid that fit perfectly with a tiny notch for air      in the corner of the lid. Then she put the container on her back, spun-a-web      all the way to the East, and walked tip-toe until she came to the fire. She      was so small, the people from the East took no notice. She took a tiny piece      of fire, put it in the container, and covered it with the lid. Then she walked      back on tip-toe along the web until she came to the People. Since they couldn't      see any fire, they said, "Grandmother Spider has failed"!!!&lt;/p&gt;   &lt;p align="left"&gt;"Oh No", she said, "I have the fire"!!! She lifted the pot from      her back, and the lid from the pot, and the fire flamed up into its friend,      the air. All the Birds and Animal People began to decide who would get this      wonderful warmth. Bear said, "I'll take it"!!! but then he burned his paws      on it and decided fire was not for animals... for look what happened to Opossum!!!    &lt;/p&gt;   &lt;p align="left"&gt;The Birds wanted no part of it, as Buzzard and Crow were still      nursing their wounds. The insects thought it was pretty, but they too, stayed      far away from the fire. &lt;/p&gt;   &lt;p align="left"&gt;Then a small voice said, "We will take it, if Grandmother Spider      will help". The timid humans, whom none of the animals or birds thought much      of, were volunteering!!!&lt;/p&gt;   &lt;p align="left"&gt;So Grandmother Spider taught the Human People how to feed the      fire with sticks and wood to keep it from dying, how to keep the fire safe      in a circle-of-stone so it couldn't escape and hurt them or their homes. AFFIRMED.&lt;br /&gt;I.&lt;br /&gt;In his corporate-management positions, Olis was involved in a&lt;br /&gt;complex transaction, enabling Olis and two coworkers to borrow $300&lt;br /&gt;million but make it appear to their corporate auditor, among&lt;br /&gt;others, that these funds were generated from operations. United&lt;br /&gt;States v. Olis, 429 F.3d 540, 541 (5th Cir. 2005) (direct appeal).&lt;br /&gt;To ensure their scheme would not cause the banks involved to lose&lt;br /&gt;money, Olis and his coworkers secretly took other actions; they&lt;br /&gt;Page 2&lt;br /&gt;2&lt;br /&gt;intentionally concealed them from the auditor responsible for&lt;br /&gt;determining the transaction’s accounting treatment. Id. at 542.&lt;br /&gt;At his jury trial, Olis was found guilty on six counts of&lt;br /&gt;securities fraud, mail and wire fraud, and conspiracy. Sentenced&lt;br /&gt;to 292 months imprisonment, Olis appealed his conviction and&lt;br /&gt;sentence.&lt;br /&gt;The former was affirmed, the “wealth” of evidence&lt;br /&gt;against Olis being noted.&lt;br /&gt;Id. at 543.&lt;br /&gt;The latter was vacated,&lt;br /&gt;however, because: he had been sentenced prior to United States v.&lt;br /&gt;Booker, 543 U.S. 220 (2005), and its Sixth Amendment holding was&lt;br /&gt;implicated, Olis’ sentence having been enhanced under the pre-&lt;br /&gt;Booker mandatory Guidelines regime by facts not proved to the jury&lt;br /&gt;beyond a reasonable doubt, Olis, 429 F.3d at 543; and the district&lt;br /&gt;court’s loss-calculation “overstated the loss caused by Olis’s&lt;br /&gt;crimes”, id. at 541 (emphasis in original).&lt;br /&gt;Accordingly, this matter was remanded for resentencing. On&lt;br /&gt;remand, it was determined sentencing probably would not take place&lt;br /&gt;for several months (summer of 2006), due, in part, to the amount of&lt;br /&gt;loss being in dispute; Olis and the Government opted to have&lt;br /&gt;experts address loss calculation and an evidentiary hearing is to&lt;br /&gt;be held. Concomitantly, the district court denied Olis’ motion for&lt;br /&gt;bail pending resentencing, as well as his motion to reconsider.&lt;br /&gt;II.&lt;br /&gt;Solely at issue is the bail-denial, which is reviewed de novo.&lt;br /&gt;Generally, such denial is reviewed for an abuse of discretion,&lt;br /&gt;Page 3&lt;br /&gt;3&lt;br /&gt;United States v. Milhim, 702 F.2d 522, 526 (5th Cir. 1983); but,&lt;br /&gt;when, as here, it involves an error of law that entails statutory&lt;br /&gt;interpretation, review is de novo. See United States v. Orellana,&lt;br /&gt;405 F.3d 360, 365 (5th Cir. 2005).&lt;br /&gt;A convicted defendant has no constitutional right to bail.&lt;br /&gt;See United States v. Williams, 822 F.2d 512, 517 (5th Cir. 1987).&lt;br /&gt;Thus, as the parties acknowledge, any putative right to bail&lt;br /&gt;derives from 18 U.S.C. § 3143, which “establishes a presumption&lt;br /&gt;against” its being granted. Id. The parties disagree, however,&lt;br /&gt;about which subsection of § 3143 applies to Olis’ procedural&lt;br /&gt;posture: he has been convicted and sentenced; his conviction has&lt;br /&gt;been affirmed but his sentence has been vacated; and he awaits&lt;br /&gt;resentencing.&lt;br /&gt;Section 3143 provides, in part:&lt;br /&gt;(a) Release or detention pending sentence. —&lt;br /&gt;(1) ... [T]he judicial officer shall order&lt;br /&gt;that a person who has been found guilty of an&lt;br /&gt;offense and who is awaiting imposition or&lt;br /&gt;execution of sentence ... be detained, unless&lt;br /&gt;the judicial officer finds by clear and&lt;br /&gt;convincing evidence that the person is not&lt;br /&gt;likely to flee or pose a danger to the safety&lt;br /&gt;of any other person or the community if&lt;br /&gt;released ....&lt;br /&gt;(b)&lt;br /&gt;Release or detention pending appeal by&lt;br /&gt;the defendant. — (1) ... [T]he judicial&lt;br /&gt;officer shall order that a person who has been&lt;br /&gt;found guilty of an offense and sentenced to a&lt;br /&gt;term of imprisonment, and who has filed an&lt;br /&gt;appeal or a petition for a writ of certiorari,&lt;br /&gt;be detained, unless the judicial officer finds&lt;br /&gt;—&lt;br /&gt;Page 4&lt;br /&gt;4&lt;br /&gt;(A) by clear and convincing evidence&lt;br /&gt;that the person is not likely to&lt;br /&gt;flee or pose a danger to the safety&lt;br /&gt;of any other person or the community&lt;br /&gt;if released ... and&lt;br /&gt;(B) that the appeal is not for the&lt;br /&gt;purpose of delay and raises a&lt;br /&gt;substantial question of law or fact&lt;br /&gt;likely to result in —&lt;br /&gt;(i) reversal,&lt;br /&gt;(ii) an order for a new&lt;br /&gt;trial,&lt;br /&gt;(iii)&lt;br /&gt;a&lt;br /&gt;sentence&lt;br /&gt;that&lt;br /&gt;does not include a term&lt;br /&gt;of imprisonment, or&lt;br /&gt;(iv) a reduced sentence&lt;br /&gt;to a term of imprisonment&lt;br /&gt;less than the total of&lt;br /&gt;the time already served&lt;br /&gt;plus&lt;br /&gt;the&lt;br /&gt;expected&lt;br /&gt;duration of the appeal&lt;br /&gt;process ....&lt;br /&gt;18 U.S.C. § 3143 (emphasis added).&lt;br /&gt;Accordingly, pursuant to&lt;br /&gt;subsection (a), a convicted defendant may be released pending&lt;br /&gt;sentencing if “the judicial officer finds by clear and convincing&lt;br /&gt;evidence that the person is not likely to flee or pose a danger to&lt;br /&gt;the safety of any other person or the community”.&lt;br /&gt;Id. §&lt;br /&gt;3143(a)(1).&lt;br /&gt;The only circuit court to address subsection (a) in relation&lt;br /&gt;to a pending resentencing has explained it applies only “where a&lt;br /&gt;defendant is awaiting sentencing the first time”. United States v.&lt;br /&gt;Holzer, 848 F.2d 822, 824 (7th Cir. 1988) (emphasis added). The&lt;br /&gt;reasons for releasing a convicted defendant prior to sentencing —&lt;br /&gt;such as his getting his affairs in order — do not apply to an&lt;br /&gt;Page 5&lt;br /&gt;5&lt;br /&gt;incarcerated defendant whose conviction has been affirmed. Id.;&lt;br /&gt;see S. R&lt;br /&gt;EP&lt;br /&gt;. N&lt;br /&gt;O&lt;br /&gt;. 98-225, at 26 (1983), as reprinted in 1984&lt;br /&gt;U.S.C.C.A.N. 3182, 3209 (explaining a short release may be&lt;br /&gt;appropriate “for such matters as getting [the defendant’s] affairs&lt;br /&gt;in order prior to surrendering for service of sentence”).&lt;br /&gt;One&lt;br /&gt;district court applied subsection (a) to a defendant awaiting&lt;br /&gt;resentencing, United States v. Pfeiffer, 886 F. Supp. 303 (E.D.N.Y.&lt;br /&gt;1995), but that case was distinguishable because the defendant had&lt;br /&gt;not yet been incarcerated.&lt;br /&gt;See United States v. Ben-Ari, No.&lt;br /&gt;03CR1471HB, 2005 WL 1949980, at *2 (S.D.N.Y. 15 Aug. 2005).&lt;br /&gt;On the other hand, subsection (b) permits a defendant with a&lt;br /&gt;“pending appeal” to be released only if, inter alia, his appeal is&lt;br /&gt;likely to result, among other things, in a sentence reduced to less&lt;br /&gt;imprisonment than he has already served or will serve during his&lt;br /&gt;appeal (reduced-sentence provision).&lt;br /&gt;18 U.S.C. § 3143(b)(1)(B).&lt;br /&gt;This subsection applies, pursuant to its plain language, to&lt;br /&gt;defendants who have been sentenced and have a pending appeal or&lt;br /&gt;cert petition; in addition, it has been interpreted to apply to&lt;br /&gt;defendants, such as Olis, who are awaiting resentencing but whose&lt;br /&gt;convictions have been affirmed. United States v. Krilich, 178 F.3d&lt;br /&gt;859, 860-61 (7th Cir. 1999). For such a procedural posture, the&lt;br /&gt;Seventh Circuit explained:&lt;br /&gt;We cannot imagine any reason why a person&lt;br /&gt;whose convictions have been affirmed, and who&lt;br /&gt;faces [several] years in prison, should be&lt;br /&gt;Page 6&lt;br /&gt;6&lt;br /&gt;released while the district judge decides&lt;br /&gt;whether (and if so, by how much) to increase&lt;br /&gt;the time remaining to be served.&lt;br /&gt;Breaking a&lt;br /&gt;sentence in the middle does not promote any&lt;br /&gt;end other than reducing the effective penalty&lt;br /&gt;by allowing a holiday or, worse, providing an&lt;br /&gt;opportunity to escape.&lt;br /&gt;Id. at 861-62.&lt;br /&gt;As is obvious from each subsection’s plain language, neither&lt;br /&gt;is a perfect fit for a defendant in Olis’ procedural posture. The&lt;br /&gt;district court found Olis, as neither a flight risk nor a danger,&lt;br /&gt;met the requirements of subsection (a). Nevertheless, it followed&lt;br /&gt;the Seventh Circuit’s view: subsection (a) applies to defendants&lt;br /&gt;who have not been sentenced or incarcerated, while subsection (b)&lt;br /&gt;arguably applies to a defendant, such as Olis, who has been&lt;br /&gt;sentenced, incarcerated, had his conviction affirmed but his&lt;br /&gt;sentence vacated on appeal, and awaits resentencing.&lt;br /&gt;Such a result comports with the goals of the statute and with&lt;br /&gt;common sense. Applying subsection (a) in this instance would lead&lt;br /&gt;to an absurd result: Olis would be temporarily released, only to&lt;br /&gt;return to prison for the remainder of his sentence. See United&lt;br /&gt;States v. Izaguirre-Flores, 405 F.3d 270, 277 (5th Cir. 2005)&lt;br /&gt;(“[W]e will not interpret a statute in a fashion that will produce&lt;br /&gt;absurd results”.) As the district judge stated,&lt;br /&gt;[Olis is] facing substantially more time than&lt;br /&gt;he’s already served. It makes no sense to put&lt;br /&gt;him out on bond, let him reintegrate with his&lt;br /&gt;family, and then tell him, Now you’ve got to&lt;br /&gt;go back to prison ....&lt;br /&gt;Page 7&lt;br /&gt;7&lt;br /&gt;It cannot be disputed that subsection (b)’s “pending appeal”&lt;br /&gt;language envisions a defendant, unlike Olis, who has a pending&lt;br /&gt;appeal on a matter other than, as here, his release on bail pending&lt;br /&gt;resentencing.&lt;br /&gt;Restated, Olis’ instant appeal relates only to&lt;br /&gt;obtaining bail; it does not parallel subsection (b)’s language&lt;br /&gt;concerning a pending appeal or petition for a writ of certiorari.&lt;br /&gt;In contrast, his procedural posture does fit the subsection’s&lt;br /&gt;“found guilty of an offense” language, and he partly satisfies its&lt;br /&gt;“sentenced to a term of imprisonment” requirement. For the latter,&lt;br /&gt;his sentence’s being vacated does not alter the fact that he was&lt;br /&gt;sentenced after his trial.&lt;br /&gt;Now, he is simply awaiting&lt;br /&gt;resentencing. As discussed, the delay in Olis’ being resentenced&lt;br /&gt;is caused largely by his and the Government’s use of experts to&lt;br /&gt;address the calculation of loss resulting from Olis’ scheme.&lt;br /&gt;Olis could have moved for release under subsection (b) when&lt;br /&gt;his direct appeal was pending; the motion probably would have been&lt;br /&gt;denied.&lt;br /&gt;Because Olis has already appealed his conviction and&lt;br /&gt;sentence, subsection (b) remains a far better fit than (a).&lt;br /&gt;Applying subsection (b), the district court concluded Olis&lt;br /&gt;should not be released pending resentencing. As of January 2006,&lt;br /&gt;when the district court intended to resentence him, Olis had served&lt;br /&gt;only 20 of his vacated 292 months’ sentence. In imposing that&lt;br /&gt;sentence, the district judge “overemphasized his discretion”, Olis,&lt;br /&gt;Page 8&lt;br /&gt;8&lt;br /&gt;429 F.3d at 548, and held Olis responsible for over $100 million of&lt;br /&gt;estimated loss. At resentencing, even were he held responsible for&lt;br /&gt;only one percent of that amount ($1 million), Olis would still face&lt;br /&gt;an imprisonment range of 97 to 121 months. Because he has served&lt;br /&gt;far less than this lower, possible sentence, Olis cannot meet §&lt;br /&gt;3143(b)(1)(B)(iv)’s reduced-sentence provision.&lt;br /&gt;Further, he&lt;br /&gt;neither contended in district court, nor here, that he meets the&lt;br /&gt;requirements of subsection (b), instead relying solely on&lt;br /&gt;subsection (a), which does not apply.&lt;br /&gt;In sum, Olis fails to&lt;br /&gt;overcome the presumption against release pending resentencing. The company owes South Texans $231 million that it overcharged consumers on their electric bills since 2001. &lt;br /&gt;&lt;br /&gt;AEP, a $13-billion company based in Columbus, Ohio has proposed returning the $231 million to consumers over the next 8 years. &lt;br /&gt;&lt;br /&gt;Senator Hinojosa is urging the company to return the money in less than one year. "AEP has given no logical reason why they cannot pay back this money to consumers in the next year," Senator Juan "Chuy" Hinojosa said. "This money belongs to the ratepayers, not AEP." &lt;br /&gt;&lt;br /&gt;Senator Hinojosa said the rebate would make the most impact during the hot summer months when electricity bills are at their highest. &lt;br /&gt;&lt;br /&gt;"Paying the money back over 8 years will amount to pennies for consumers instead of dollars, which could make a real difference for working families right now." &lt;br /&gt;&lt;br /&gt;Senator Hinojosa is asking South Texans to let the PUC know how they feel about AEP's 8-year proposal. Mayor Richard Cortez of McAllen and Mayor J. Wesley Jacobs of Falfurrias have already submitted letters to the PUC in favor of Senator Hinojosa's position that the company pay back the $231 million in the next year. The microphone cut out after the valedictorian at Foothill High made reference to God. &lt;br /&gt;&lt;br /&gt;The family says the District's decision isn't fair. Brittney McComb says she's a straight A student, number one in her class, and is headed to Biola University in the fall. &lt;br /&gt;&lt;br /&gt;Brittney attributes all of her success to God. Trouble is, she tried to explain that during her speech which the school district said they told her beforehand was a no-no. &lt;br /&gt;&lt;br /&gt;"God's love is so great." &lt;br /&gt;&lt;br /&gt;This was part of the speech that Brittney McComb says she so wanted to give on graduation night. But because it did have numerous references to God and Jesus Christ, the school district cut off the mic, leaving her practically silent. That's when many people stood up and booed, showing their support. &lt;br /&gt;&lt;br /&gt;Now, the day after, McComb says she got nothing but support from her fellow students. "All of my classmates came up to me and were so happy. They told me they loved me and I said God's awesome because I couldn't have done it without him." &lt;br /&gt;&lt;br /&gt;McComb says the district reviewed her speech beforehand, just like everyone else. But she says they sent it back with the last half chopped off. &lt;br /&gt;&lt;br /&gt;"They said it was offensive, it identifies a particular religion," explains McComb. "I really think it's free speech; we're American, we should be able to handle that." &lt;br /&gt;&lt;br /&gt;We asked her father about that. &lt;br /&gt;&lt;br /&gt;Rob McMillan: We have freedom of speech, but what about separation of church and state? &lt;br /&gt;&lt;br /&gt;Michael McComb: They brought that up, and they say they were going to give us some documentation to prove why she could say that in her speech. &lt;br /&gt;&lt;br /&gt;They said the documentation was ambiguous. That was when Brittney said she took it upon herself to go ahead and give her speech as written, no matter what the consequences might be. &lt;br /&gt;&lt;br /&gt;The district tells News 3 there are guidelines for what valedictorians can and can't say, but they didn't get back to us on our request for an interview. A district spokesperson told us they were not trying to avoid interviews on this subject and that multiple graduation ceremonies prevented top administrators from giving us an interview. &lt;br /&gt;&lt;br /&gt;The school district maintains it was simply following procedure at the Foothill Graduation. &lt;br /&gt;&lt;br /&gt;We're told students are required to submit their speeches in writing ahead of time and they're told if they deviate from the script at all, their microphones will be cut off.
