Gen. Parveez Musharaf NOT GUILTY

So the Musharraf news is hot and the Pakistani TV shows are racking in millions in commercial revenues selling Article 6 to the public. Politicians and Judiciary are at the same power play as in 1998 to 1999. However now in 2014 with media and social media, its a well known fact that PLMN and Ex CJ with his goons waged revenge against the Pakistan Army and its ex chief Gen Parveez Musharraf while Army Chief has sold his soul to the devil.

What shocks me is the legal team of Musharraf headed by Kasuri, Parzada and Ranja. All of whom have served as Minister of Law, Constitutional experts and claim to be constitution writers of Pakistan. Each of these lawyer have 30 to 40 years of experience in the field of Law but worthless. I have yet to hear the defense other than " Musharaf was not alone". This is no argument or defense when the prosecution is waving a PCO with Musharraf's signatures on the bottom as " Chief of Army Staff".

Every dummy knows that article 6 case is a fluke and it's constitutionality is still undecided. As this a separate topic but today let's deal with Musharraf issue and match them with facts of Pakistan. I was think what will I do if I was the lawyer for defendant Parveez Musharaf.

My mind said I will plea factual issues of the case not non sense political rhetoric of " get others" like Mr. Kusuri on national TV. I will first challenge the constitutionality of the bench in Pakistan Supreme Court on matter of urgent National importance and secondly I will subpoena all GHQ and PM office records from 2006 to 2008.

Then I thought Dementia is our national disease. Our memories are very short and as a nation we never look back. I am no legal expert but as a political blogger i know, defense of Musharaf is very simple if the facts are stated correctly by a good competent lawyers.

Secondly i thought, like in 1999 and 2007, it was a Pakistani Military's institutional decision to protect Pakistan while complying with the orders of Supreme Court to have elected government of Prime Minister Jamali and Shoukat Aziz running the state affairs. Army and its brass is NOT GUILTY.

In my opinion, Pakistani Military should provide best lawyer to Gen Parveez Musharaf and through ISPR should vocalize on the issue to defend its institutional honor and honor of all those army personal who served the nation with pride from 1999 to 2008 for putting forth the foundation of the democracy that we all enjoying today.

LEGAL FACTUM

Pakistani Army seized the power from Prime Minister Nawaz Sherif on 12th Oct, 1999 when the defendant was in the plane.
As Chief of Army staff, the defendant was made de facto head of the Government of Pakistan.
The judiciary in 2000 indemnify the takeover in Zafar Ali shah(2000 SCMR 1137) case and later gave the defendant as Army Chief, 3 years to amend the constitution and assure a fair election for people of Pakistan as Chief Executive.
Within the 3 year legal time frame ordered by the honorable Supreme Court of Pakistan, as an Pakistan Army Chief, I made sure the court order was complied with and the election were planned.
A fair election was held in Pakistan in Oct 2002 and 15 million people were given a chance to elect the Federal and Provincial governments in Pakistan.
Newly elected Prime Minister Zafar Ullah Jamali and his cabinet took oath of office in 2002 running the affairs of the Federal government and 4 Chief Ministers were sworn in to run the provinces respectively.
After first session at the Parliament in 2002, as Army Chief, I voluntarily transferred the powers of chief executive to the Prime Minister of Pakistan Mr Zafar Ullah Jamali.
Within two years, Jamali proved to be an ineffective prime minister to forcefully implement governmental policies in the country and mounted problems with elite business class of Pakistan.
People of Pakistan through their elected house re elected new Prime Minister Shoukat Aziz in 2004 to run the government of Pakistan.
All legal powers to act as Chief Executive of Pakistan were transferred to the newly elected PM.
During all this time the defendant was acting as President of Pakistan and Chief of Army Staff under Pakistan Constitution.
In or about 2006 or 2007, The Judicial and Administrative powers on Pakistan were having conflicts over administrative issues and security became a concern.
In 2007 I received a letter from then Prime Minister Shokut Aziz asking my assistance in controlling security situation in Pakistan as Army Chief. I was told that the security concerns have gone beyond the control of the civilian government.
As Army Chief, I met with Prime Minister and his advisers and heard there concerns for their fragile government. I assured him that Pakistan Army will keep its commitment with the Supreme Court Order for democracy and stabilization of government in Pakistan.
I than as Army Chief consulted the top military brass including, vice army chief, joint chief's, head of arm forces and discussed the security issue.
On the orders and advice of the elected Prime Minister, his cabinet, 4 chief ministers, 4 governors, and consultation with heads of armed forces of Pakistan, I proclaimed PCO on November 3rd 2007 as Chief of Army Staff to fulfill the orders of the Pakistan Supreme Court to have elected government run the country.

IT IS THEREFORE, I demand all charged against the defendant be dismissed as Army Chief simply complied with the orders of The Pakistan Supreme Court in 2000 and Chief Executive Prime Minister Shoukat Aziz orders on 2007.

The movies on Prophet Muhammad SAWW and clueless ummah

TRING TRING... HELLO !!! I picked up the phone. It was my friend in Canada calling me. ASA and WAAS...Whatz up my friend? I asked. Did you watch the news? people in Islamic world are protesting against the Movie about Prophet Muhammad(PBUH). Pakistan is burning... 9 people are dead and millions of dollars worth of properties are burnt.... he kept going. My friend was very upset while telling me the details. I told him to calm down and tell me what can I do? He took deep breath...We need to arrange a protest. We need to bring out people on Friday to show our love for our Holy Prophet(PBUH). He said.

Stop... Stop... Please!!! Stop. I said. So you want us to be a copycat? Is this the only way to show your love towards the Prophet? Where are the leaders of the Ummah? Did Saudi Arabia suspended its ties with United States to express its distastefulness with this incident? Did President Zardari or Ameer Of Qatar lobbied other nation during UN Session of Leaders? He simply replied...NO.

Brother, we are the only nation who will burn its own homes, cars, public properties, Cinema's, buses and tires to show our distastefulness or love for our Prophet. Wake up...hello...this is 2012. I know...i know he said but still insisted on peaceful demonstration in downtown.

OK...Hear me out...my doctor friend. In 1800 a man named Sir Syed Ahmed Khan said to his people in India that If they want to defeat British, they need to learn their language, manners and ways so that we can beat them in their own game". People declared him " Kafir ". (Maybe after this article many of my reading might have the same thinking about me as well...) but history tell us that Sir Syed was right. Dr. Iqbal, M.A Jinnah, Sir Agha Khan and Muhammad Ali Johar were all foreign Graduates... have live abroad, knew English very well as they spend vast part of their lives living and learning from British and Germans.

What Sir Syed has to do with all this and our protest or Prophet Muhammad(PBUH)? he asked. What I am going to tell you will be a true replica of what Sir Syed said. Times have changed. People who plan this kind of hateful act are not stupid. They have already calculated that Muslims will scream for few days and then go home. Benefit to them is that by the time, these protests will be over, Muslims will kill their own brother and burn their own countries. The mission is accomplished.

So Mr. Smart Pants... you think Muslim should not use their democratic right to freedom of speech. This is only thing we can do... as our leaders are corrupt. He kept insisting.

OK... if you are not going to stop insisting than You have to listen to me and work a plan. Sure, I am listening...he said

If you really want to do something and stop this from happening again. You have to think American way and work the system.

Here are the options:

1) You talk to 100 good Muslims who are willing to put their money where their mouth is and we collect $100,000. We than hire a Top Law Firm and File a lawsuit claiming movies to be classified as hate speech. The lawyers will file Injunction order and force the movies to be removed from all main search engines, YouTube and other media till the case is pending.

2) Email of all US senators, member of House of representatives(US) member of Parliament and Minister (Canada) is available through Google. Let's send emails to their office, make webpages on this issue, use social media to send a message to them to make a law baring " anyone to insult any faith, Holy Prophets or Holy Books. If found guilty will serve a term no less than 10 year in prison". We can get support from all faith groups in North America on this issue.

3) Or lets Copy Jewish Model of Success. Form a " Muslim Political Caucus of North America" let Muslim in North America support it and contribute for this cause and lobby Senators to make a Religion Protection Act.

MY friend was dead silent... are you there doc? I asked, " yes" he replied. Can we do that to beat them in their own Game? He kept silent for 10 seconds...You are so right and now i think, let's drop the protest. We will do something Inshallah. That was the last i heard from him. I thought to myself... maybe one day I will find those 100 people to serve Islam and protect the rights of Muslims in the World. Like Arabs Muslims...we have money but don't know how to use it for lobbying in congress.

New Political Card: Breaking of Greater Punjab

Right when many political think tanks were assuming that Zardari is almost out of his political cards, he is ready to pull one again. If you remember Mr. Zardari speaking in Naudero, he asked Sherif brothers to come and learn politics from him. Trust me he was not joking. All of his crooked politics has brought some fruit for him and he is still the President of Pakistan, head of the ruling party and the country is still under his control.

Zardari is not worried about, Sindh, Bloucistan or KPK but Punjab with 62 percent of the population is the biggest road block for the next election. Although, Imran Khan is doing political work for PTI but all political guru's know that Zardari is the Beneficiary of his efforts. All hard work will be done by IK to break the vote bank of Sheriff Brothers and Zardari will eat the fruit.

IK being a good person, passionate and sentimental leader went through this trauma during long march for Judiciary Movement. He did so much of hard work on the ground but in the end, Mian Brother hijacked the drama. He was sitting and waiting in Shadara Chock Lahore and the Jaloos was in Jhelum headed by Mian Nawaz Sherif as a national hero.

This time again IK is doing the ground work again to win seats in Punjab and the end result will be that Zardari and PLMQ will win in Punjab. Now even PLMN leadership is worried and openly admits that PTI will decrease its vote bank and may give advantage to PPP in Punjab. PLMN is playing its own card pressuring PPP by using Judiciary to further its mission.

"We want rule of law and Government implementing Judiciary decisions". This is coming from a party which has never respected rule of law by themselves. It’s not their fault that they want to manipulate public sentiments, fault lies with the public who buys these kinds of issues and slogans which has nothing to do with their daily lives whatsoever.

Now that everything is on its place, the way Mr. Zardari wants, he is pulling a final card for Punjab. Divide the greater Punjab to make the win much easier for PPP. Yes the new province of South Punjab is in works and you will see that before Eid, you might have details. “Saraykee" province will be created because PPP, PLMQ, MQM and ANP, FML all agree on the issue. They do have enough votes in the NA and Senate to get it approved and because PLMN is weak in South Punjab, they will not be able to do anything.

The new province will take one third of the power away from Sherif Brothers and the rest of the Punjab will be divided in four major parties to fight. PLMN, PTI PLMQ and PPP. As PTI will take away votes from PLMN, the chances are PPP and PLMQ will form the next Government in Punjab. In the very new future, PLMN will ask a national referendum on the issue of creating new sayrikee province but they will be told that NA and Senate are elected by public and if the public votes for a new Province, opposition have to accept it.

Sherif brother are cornered and if they don't take corrective measures within few weeks, the only way out for them will be to use Supreme Court card. They will try to bring public out and ask for street Justice like in the past.

This time it might back fire because the Government will start listening to the Supreme Court and implementing its decisions after August once the Supreme Court appointed Chief Investigator Zafar Qurashi is retired.

Who said saisaat is clean, in Pakistan, it’s about defeating opponent with all the means possible using force, manipulation, twisting of polices or Government officials to get the desired results.

The Last Cards in the Political Deck for PLMN

Although Zardari has kept his cards close to his chest and use them wisely in the last three and half years but the game is very close to its end. He has successfully cornered Sherif Brothers, played with ANP and JUI, used and abused MQM, blackmailed PLMQ through NLC scandal for a partnership and kept Army on the bay by keeping them involved in internal security and domestic operations against extremists. Even his critic acknowledge his political wisdom. Is he done? I guess not. Mr. Zardari still have 2 cards in has hand for a final show down.

The last 2 cards are, sitting on the fence and let Balawal "Bhutto" Zardari become the innocent new leader of PPP whose mom was killed for democracy. This will give a new face to PPP and knowing our public, they will fall for it again. Secondly, if nothing works, start a war in Karachi and play Sindh card causing a ciaos in Pakistan and/or forcing opposition to create public disturbance forcing Pakistan Army to take over. In any case he will run to UK for asylum and live in his Castle.

From the news, we see Balawal is contest election from Lahri so the first card is in play. Now I hear naive leaders like Imran Khan saying on the TV screens that it’s not possible for army to takeover because people will not accept army rule. To me its shows their inexperience and lack of political wisdom. Army don't require people approval Mr.IK. Trust me the Army card is in play too if you follow the news closely. Here is some fact from the history books.

When we think about army takeover, most of us think about Mushraaf coup in 1999. The facts are Mushraaf never declared Marshall Law but “Interim Emergency". For a common person, it might be a memory lapse but people who lived in Auab Khans era and adults of Zia-ul -Haq era can tell you the difference.

Just for the knowledge of my readers,an interim emergency, life is usual but important installations are under the control of the army. Constitution is temporarily suspended but public life is uninterrupted.

In a Marshall Law, the Army runs the Government and every aspect of people daily life. Judiciary is sent home, summary military courts are established, people are hanged on intersections and butts are whipped in the stadium. All government institutions are run by Military officials and public sectors are monitored by the army. Media is censored and barred from publication of political news. When a military jeeps stops outside your house, either you pass out or hide in the bathroom. Ask those who saw General Auab Khans and Zia ul Haq Marshall Law in their life time or the once who got punished during those times.

With 500,000(Half a Million) soldiers and officers under command, half used for India and Afghanistan border, the army still has a a big force available to take control of the country and declare Marshall Law. The question is when?

Simple answer is when the stakeholder wants the army to act to protect their interest. Stakeholder being USA, UK, Japan, Saudi Arabia and IMF or when the army can convince the stakeholder that its time.

Zardari declared this fact to Sherif brothers within first 6 months of taking government that if any attempt to destablize his government is initiated, he will use Military trump card. Sherif brothers took him threat serious and kept singing the song for past 3 years that they are playing safe and friendly opposition because they don't want to derail the democracy. If you have read PLMN statements in the past, you will know they have said again and again that they are trying to save the democratic system.

Question is from whom? Yes PLMN knows that government can create such a ciaos that will force the Military to take action and PLMN will lose its turn. Little do they know that they turn will never come in any case.

Three and half years have passed since the last election and in this time, sherif brother’s has seen their rule shrinking month by month. They now just govern part of the Punjab not all the Punjab like in the past. South Punjab wants to be a seperate province, they just lost election in Kashmir and PLMN is also not popular in Sindh, Baluchistan or KPK. The worst part is, their anti ISI and military sentiments have forced the ISI to promote other small players in Punjab such as PTI and MQM. Add PLMQ and PPP seat adjustment in the mix, Sherif brother are having sleepless nights.

Now that Sherif brothers are cornered, do PLMN have any cards left to play against Zardari, save their political face and come out of the cornor? Yes they do but it might not bring the result they want.

If they want take positive approach, they can give up their ego of ex prime minister and reunite all PML under one leadership. They can then unite other parties to form a solid opposition. This will be seen as positive politics and they will gain popularity they once enjoyed. This will bring end to the Zardari game and he will fold his cards. But knowing their dictatorship loving PLMN leadership, this is not possible.

As Sherif brothers have people like Chaudhri Nisar and Hanif Abbasi, they will suggest the negative approach. Today’s news has disclosed the game plan, if you can read between the lines. It’s time to utilize the last card in the deck which was bought by spending million of Rupees during Judiciary Movement.

Yes you guessed it. The Supreme Court and Chief Justice. As the Judiciary and Administration has drawn guns against each other for who rules the country, the plan by Sherif brother is to make a call to chief justice to get one strong decision against government. This will start the process that will lead the lawyers, civil society and PLMN workers to hit the road for one last long march and this time it will not stop short of Islamabad.

This time the slogan will not be to reinstate the Judges but reinstatement of the Judgments. This is something that public will buy and PLMN can sell easily. This card will bring Government on its knees and the protest will not stop till the Government agrees to call a new elections.

Did you hear Shahbaz Sherif saying that PLMN will sacrifise Punjab government for the judicary just today? The card is now in play.

The risk in this game is Zardari and Military Marriage. A match made by the stakeholders. Zardari will never concede to PLMN but ask the Military to takeover by declaring Marshall Law. If that happens, Sherif brother will move to Saudi Arabia for 10 years and Zardari will vacation in UK for awhile. Once again we will prove that we didn't learn anything from the past and maybe we don't deserve democracy.

The Political Chess in Pakistan

The United States of America want a liberal government who can enforce US policies in Pakistan. On the slip of the coin, the Pakistan army also want liberal government with no connections to extremism. With US and Army thinking on the same lines, I don't see Nawaz Sharif as the next prime minister of Pakistan. He is corrupt, has ties with extremist elements like Lashkar e Ghangvi, Sipha Sahaba and Taliban, has hatred towards PAK army and has soft corner towards redicals elements. Sherif don't fit the profile of a leader who will be hard of Islamic extremists.

At this point in time, If the US and army has to chose between two devils, they will pick Zardari who has become their unconditional slave and serves both master happily. The fact is Imran Khan is an honest man and a great leader but only a student leader. IK admits that he is the leader of the youth. In reality the truth of the matter is that he can create damage but he can't win the elections. At least for next 10 to 15 years PPP and PMLN will still be the 2 major players as 70 percent of the population is uneducated and Army will be the Guardian.

Up until few months back, Nawaz Sherif was very convinced that he will win two third majority in the next elections. His stupid advisors like Chaudhri Nisar and others convinced him that next election will bring sweeping victory. What the fail to tell him was that Punjab is the only playground where they can win. Sindh, Bluchistan and Khaber Pakhtunkwah will not bring anything for the sherif brothers.Zardari also knows this fact, so he informed his masters US and the US showed a grave concern of this fact to the ISI. As army itself don't respect sherif because of past experience( sacking of 3 generals and attempt for the 4th) the plan has been made to break 2 power players of the future government.

In Karachi, MQM has been a major player but in the next election, MQM will compete with PPP, ANP, PTI, Sunni Tahreek and Jamat Islami, the vote bank will be divided and MQM will only be able to gain 10 to 15 seats from present 25 seats.

In Punjab, although PPP will have seat adjustment with PMLQ but PLMN will still be a major contender. To solve that, Imran Khan's PTI is chosen, a bomb who's fuse has been lit by the army. A leader who is sentimental, emotional and redical in his ideas. He is told to follow the blue print that was given to MQM by ISI in 90's. Be a party to represent middle class in Punjab and use student power to achieve the result exactly the foot steps of Altaf Hussian in late 80's and early 90's, if you can remember.

Although the American's don't like Imran Khan and his PTI but they know his profile. Their behavioural experts have told them that he fits the profile of sentimental, emotional and nationalist personality. With known ground reality in Punjab, He might not win all seats but he can deseat enough to cause damage. He can be easily used to take advantage for what the US wants to achieve politically in Pakistan.

IK may not win the election but will cause the damage required for PLMN not to form a government in 2013.This way Zardari gang might have another chance to form a government where Blawal Zardari will be elected from Layari( Karachi) as a new Prime Minister with support from PLMQ, MQM, ANP and PTI for another 5 years.

PPP just has to provide a gaurantee to the US and the Army that corruption will be stopped and if not Army will takeover and the game for all the political parties will be over til 2023.

Now fit the statement of Imran Khan and see why he is saying that he can join Zardari but not Nawaz Sherif. Mark my words and save this game and see this conventional wisdom comes true.
