The Marshfield Area Community Foundation has launched a project to promote civility and open communication in every realm of public discourse -- from politics to church groups, school boards to youth athletics.

"The Marshfield Area Community Foundation has launched a project to promote civility and open communication in every realm of public discourse -- from politics to church groups, school boards to youth athletics.

The Speak Your Peace civility project is modeled after programs implemented in the past decade by the Community Foundation of Greater South Wood County and the Duluth-Superior Area Community Foundation.

'There's a real need we see in the community,' said Amber Kiggens-Leifheit, MACF executive director.

MACF officials held a training and information session Tuesday at Mid-State Technical College that sought to recruit 'facilitators' who will hold presentations for community leaders, groups and businesses, spreading the project's message.

Tuesday's group of more than 15 people included local teachers and school administrators, leaders of nonprofit groups and health care officials, among others.

MACF leaders hope to get 40 facilitators involved who will reach more than 500 local residents through presentations in the project's first year, Kiggens-Leifheit said.

'We're trying to hit everyone in the community,' Kiggens-Leifheit said. 'It can really be applied everywhere.'

Speak Your Peace focuses on author P.M. Forni's nine 'tools of civility,' which include showing respect, seeking common ground and using constructive language.

The project's tagline: 'It's not what you say. It's how you say it.'

The initiative also involves a resolution accepting the nine tools that organizations can adopt. Several government bodies and school boards in southern Wood County have passed resolutions supporting the concept.

Kiggens-Leifheit said she would like Marshfield City Council, local school boards and 'all groups in town to pass the resolution.'

The effort is particularly relevant now, given the hyperpartisanship dominating state and federal politics.

'Our state, our nation, is very polarized,' said Darlene Berry, an eighth-grade teacher at Marshfield Middle School. 'I think it's seeping into our (personal) relationships when it shouldn't.'

Berry said she plans to apply the group activities and concepts from Tuesday's session in her classroom, and she's interested in volunteering for the civility project.

Kiggens-Leifheit said the foundation will hold another training session for volunteers in the next month. She said community members will be able to request presentations through the MACF website, www.marshfieldareacommunityfoundation.org, or by calling the office at 715-384-9029."

"People are free to choose, but we are not free from the consequence of our choice. This universal paradox plagues the state of Wisconsin as we face the consequences of last fall's election. While hammers and saws are good tools for building, they can just as easily be used to rip apart and destroy. Scott Walker used the tools of tax breaks for corporations and the wealthy while continuing attacks on public education. We now see those 'tools' are having detrimental effects on the very structures he claims they were designed to strengthen. For example, Walker increased taxpayer funding for students to attend private voucher schools by more than $40 million and delivered millions more in tax breaks to out-of-state corporations. On Dec. 23, 2011, the Milwaukee Journal-Sentinel announced, 'Walker's administration laid out ... where it would find more money to balance the state budget, including an additional $46.1 million cut in funds for the University of Wisconsin System.' Despite a cry for 'jobs, jobs, jobs,' his tools have failed to deliver. In fact, Wisconsin is losing jobs; the Wausau Daily Herald reported Dec. 7, 2011, that the Brokaw Mill closure will cause the loss of 450 jobs, the first of several announcements of a similar sort. Elizabeth Warren, a Harvard professor of economics, makes the following case: 'There is nobody in this country who got rich on his own. Nobody. You built a factory out there -- good for you. But I want to be clear. You moved your goods to market on the roads the rest of us paid for. You hired workers the rest of us paid to educate. You were safe in your factory because of police forces and fire forces that the rest of us paid for ...You built a factory and it turned into something terrific or a great idea -- God Bless! Keep a Big Hunk of it. But part of the underlying social contract is you take a hunk of that and pay forward for the next kid who comes along.' Warren's case is strengthened when we consider Thomas Jefferson's profound wisdom, 'Public schools have been our nation's great social equalizer.' Public schools give a fighting chance to those who are not wealthy. While taxpayers pay for the education of our workforce, we all bear the responsibility to provide all the children of the next generations their chance at a quality education. Additionally, Warren states, 'I grew up on the ragged edge of the middle class ... in an America that invested in kids like me,' a claim many voters in Wisconsin share.

Finally then, what other tools do we have at our disposal, and how should we use them?

Section 12 of ARTICLE XIII of the Wisconsin Constitution provides voters with this useful tool: '[Recall of elective officers.]'

Additionally, number (7) of Section 12 includes an important caveat: 'This section shall be ... mandatory ... [and] no law shall be enacted to hamper, restrict or impair the right of recall.'

Walker's tools never will work for Wisconsin's middle-class families.

We must maintain the integrity of our constitution and our state and use the tools at our disposal in order to rebuild what the current administration is so callously tearing down. Recall Mr. Walker."

Breaking: Former Marshfield School Board Member Discusses Budget Reforms

"As Wisconsin debates the possible recall of Gov. Walker, I hope that people consider the magnitude and complexity of the financial mess he is addressing, a mess many years in the making. We must not focus exclusively on the things we don't like without looking at the big picture.

In the Marshfield School District we have twice gone through painful and emotional revenue cap override referendums. The school funding formula correctly was called 'broken' and 'unsustainable,' and needed to be 'fixed at the state level.' Now, after many years of politicians dodging the issue, it has been.

With so much of the state budget going to K-12 education, and about 80 percent of that being people costs, the brunt falls on employees. They are understandably upset, but a solution still needs to be found.

School boards once had unlimited taxing authority. When binding arbitration resulted in expensive union contracts, they could simply raise taxes to cover them. This led to runaway property tax increases, and in 1996, the state adopted a new school funding formula.

Total school district revenues (state and local) were capped with only small annual increases allowed. Teachers' bargaining power was curtailed -- boards could avoid binding arbitration if they offered the teachers at least a 3.8 percent annual increase in total compensation with no reduction in benefits. This latter was called a qualified economic offer, or QEO.

This formula kept property taxes down, but it had a major flaw: teacher compensation was increased much more rapidly than the revenue to pay for it. This was compounded by severe increases in health insurance costs, a benefit not subject to negotiation under the QEO. With compensation outpacing revenues there was only one way to balance the budget: reduce staff. And that's just what happened, either through layoffs or retirements. Every year, we had to run our schools with fewer people than the year before. This is unsustainable.

How about increasing taxes? OK, but that would only get us through one more year, and then we'd need to increase them again. Even if taxes increase at 'only' 3.8 percent annually, they double in 18 years. And keep going. This, too, is unsustainable.

(In 2009 the legislature and Gov. Doyle removed the QEO entirely, greatly compounding the problem. Then there were no limits on collective bargaining, but the limits on revenues remained.)

The essential point is simply this: when operating costs rise faster than the taxes to pay for them, something must give. And tax increases above inflation cannot go on. When the formula forces this situation it is known as a 'structural deficit.'

Gov. Walker's school funding formula is one way to address the structural deficit. Many teachers are willing to go along and pay more for health and retirement benefits, but object to its reduction in collective bargaining power. However, collective bargaining does have a cost when it drives employee costs beyond available revenues.

Marshfield has the best school system in the state of Wisconsin, primarily because of our excellent teachers. I hate to see them so demoralized. But no enterprise, public or private, can survive if its costs exceed its revenues. We must not return to the failed system of the past with its perennial budgetary crises and dwindling staff.

To those in the Recall Walker movement, I respectfully suggest the following. Specify exactly how you would replace the school funding formula. It won't be easy. But Wisconsin needs actual solutions, not just more talk. Craft a comprehensive, sustainable formula that does not return us to a structural deficit. That's the way to save Wisconsin."

This is a response I wrote to a taxpayer with a question for me. I am sharing it in case it answers questions others may have as well. (Feel free to contact me with any questions you have):

Basically, his question was: How do we fix our broken school budget in Marshfield?

I have a copy of the 2011-2012 school year budget (which includes 2009-2010 and 2010-2011 expenditures) and I would be glad to go through it with you if you would like. I would like to show you some of the concerns that I have and give you the opportunity to show me what concerns you have.

The first thing I am suggesting as a proposal for fixing our budget is an independent audit committee should be formed that serves as a tool to the decision making process of the governing body. This will lead the board to wiser choices, places to cut and cap spending and balance our budget like the majority of other school districts in the state have been doing. I would be glad to give you a list of the districts in WI that have lowered, or in some cases stabilized their taxes.

Have you been to a school board meeting, lately? There is next to nothing mentioned about what is going on. I want accountability and accessibility to information regarding short-term borrowing to make payroll and how many bids go out for each building maintenance project, for example. The last meeting I went to was inexcusable. We all sat and waited for ten minutes after the meeting was scheduled to begin, while the board had a closed meeting right next door to all of us. This is not how it is supposed to go and I will not stand for that.

I would like to know what you think about the school board giving serious discussion to selling the structurally sound, historic Middle School for one dollar. Really?

I would like to see many competitive bids on actually maintaining the middle school. I know there are a lot of things that need to be done...I just want to know WHY they haven't been done in so many years.

School Board Rolls Out Referendum Plan to Deal With Mammoth Deficits

"The school district expects to have a $3.7 million deficit in 2013-14, because of the expiration of the $3 million override referendum, Saucerman said. The projected 2013-14 budget is $42 million.

The current district budget is $45.8 million.

If the district closed the current middle school, the annual savings would be about $1 million, Saucerman said. Half of the savings is from utilities and building maintenance, and the remainder is based on eliminated staff positions that will become redundant if the school is closed, he said.

'Which positions, the exact staff isn't known yet,' Saucerman said.

Middle school?

The district's buildings and grounds committee developed four options for the location of the middle school program. The options do not involve building a new facility or remodeling the current building.

At least $5 million is needed to repair, upgrade and maintain the current middle school, according to a committee report. The figures are based on contractor estimates gathered by the committee."

"Colby-based Community Bank of Central Wisconsin is making good progress toward complying with the Federal Deposit Insurance Corp. directive that the bank recapitalize itself, said Keith Strey, city finance director.

The FDIC regulates U.S. financial institutions to ensure they are financially sound and insures deposits in those banks. A bank's capital serves as a 'cushion' for potential losses.

The city and Marshfield Utilities maintain accounts at the CBCW, which has branches in Marshfield, Owen and Thorp.

The bank was categorized by the FDIC as 'significantly undercapitalized' in a supervisory prompt corrective action directive issued April 14, 2011. It was directed to either 'sell enough voting shares or obligations of the Bank' so it can regain adequate capital or become acquired by another depository institution.

'The bank's on track with what they have pledged to do,' Strey said Tuesday while providing a status update about the bank to the city's Finance, Budget and Personnel Committee.

Although the bank was a site to make January property tax payments, the risk to money in the city's accounts was minimal, Strey said. He explained that his department monitors the city's accounts at the bank daily in order to move large deposits to other accounts in another bank.

'During tax time, there was a heightened sense of awareness about this. We were aggressively moving that money out as quickly as we can,' Strey said.

The city maintains about $1 million in two accounts at the bank, which is covered through FDIC insurance and collateral in pledged securities from the bank equaling about $4 million, Strey said.

Since a year ago, CBCW has significantly improved its deposit quality, said interim president Marti Machtan.

'When you look at the overall health day by day, month to month and quarter to quarter, we are making tremendous progress. I understand that certain members of the community are concerned about the (bank) deposits. But bank consultants, bank management, city advisers and everyone involved have concluded that deposits are safe at Community Bank of Central Wisconsin,' Machtan said.

'We have dramatically improved asset quality over the past year. We are out lending in the community,' Machtan said.

In order to achieve an 'adequately capitalized' position as defined by the FDIC, the bank must achieve 4 percent tier one leverage capital. But under the most recent directive, the FDIC requires CBCW to reach 8 percent leverage capital, but didn't specify a time frame.

The bank finished 2010 with tier one leverage capital at 3.67 percent. It finished 2011 with tier one leverage capital at 4.78 percent, Machtan said.

'Achieving the capital levels required by the regulators depends on a number of factors, including earnings, the performance of the national economy, and the health of our local economy,' Machtan said.

'Because of all of those factors, it is difficult to predict with certainty when we will hit the numbers we're aiming for,' he said. 'The good news is that we are continuing to improve.'

Public Service Commision to Investigate PILOTs to School Districts

"The state's Public Service Commission will investigate the Payment in Lieu of Taxes, or PILOT, calculation used by municipal utilities.

The PSC will study the statutory authority for municipalities to collect a PILOT from a utility and the procedures and administrative rules for calculating a PILOT payment. The PSC also will investigate whether municipalities should distribute PILOT revenues to other local taxing jurisdictions, such as a school district.

WHEREAS, the President of the United States of America signed the 2012 NDAA into law on December 31, 2011;

WHEREAS, Section 1021 of the 2012 NDAA purports to authorize, but does not require, the President of the United States to utilize the armed forces of the United States to detain persons the President suspects were part of, or substantially supported, al-Qaeda, the Taliban or associated forces;

WHEREAS, Section 1021 of the 2012 NDAA purports enlarge the scope of the those persons the Office of the President may indefinitely detain beyond those responsible for the September 11, 2001 terrorist attacks, and those who harbored them, as purportedly authorized by the 2001 Authorization for Use of Military Force Against Terrorists, to now include “[a] person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces;”

WHEREAS, Section 1022 of the 2012 NDAA requires the Armed Forces of the United States to detain, pending disposition according to the Law of War, any person involved in, or whom provided substantial support to, terrorism or belligerent acts against the United States, and whom is a member of Al-Qaeda or an associated force;

WHEREAS, The exemption for citizens of the United States in Section 1022 of the 2012 NDAA only exempts them from a requirement to detain and reads as follows, “The requirement to detain a person in military custody under this section does not extend to citizens of the United States”;

WHEREAS, Unlike Section 1022 of the 2012 NDAA, Section 1021 makes no specific exclusion for United States citizens and lawful resident aliens for conduct occurring within the United States;

WHEREAS, the specific exclusion of application to United States citizens and lawful resident aliens contained in Section 1022 of the 2012 NDAA, and the absence of such exclusion in Section 1021 of the NDAA, strongly implies that the provisions of Section 1021 are intended to apply to all people, including United States citizens and lawful resident aliens, whether or not they are captured in the United States;

WHEREAS, the Office of the President of the United States, under both the administrations of George W. Bush and Barak H. Obama, has asserted the 2001 Authorization for the Use of Military Force Against Terrorists allows the Office of the President to indefinitely detain without charge persons, including United States Citizens and lawful resident aliens, captured in the United States;

WHEREAS, United States Senator Carl Levin declared in colloquy on the floor of the United States Senate that the original 2012 NDAA provided that section 1021 (then section 1031 prior to final drafting) specifically would not apply to United States citizens, but that the Office of the President of the United States had requested that such restriction be removed from the 2012 NDAA;

WHEREAS, during debate within the Senate and before the passage of the 2012 NDAA, United States Senator Mark Udall introduced an amendment intended to forbid the indefinite detention of U.S. citizens, which was rejected by a vote of 38–60;

WHEREAS, United States Senator John McCain and United States Senator Lindsey Graham declared in colloquies on the floor of the United States Senate that Section 1021 of the 2012 NDAA authorized the indefinite detention of United States Citizens captured within the United States by the Armed Forces of the United States;

WHEREAS, United States Senator Lindsey Graham declared in colloquy on the floor of the United States Senate that the United States homeland is now part of “the battlefield;”

WHEREAS, Policing the United States of America by the Armed Forces of the United States, as purportedly authorized by the 2012 NDAA, overturns the Posse Comitatus doctrine and is repugnant to a free society;

WHEREAS, Sections 1021 and 1022 of the 2012 NDAA as they purport to authorize, 1) detainment of persons captured within the United States of America without charge or trial, 2) military tribunals for persons captured within the United States of America, and 3) the transfer of persons captured within the United States of America to foreign jurisdictions, are violative of the following rights enshrined in the Constitution of the United States of America;

Article I Section 9, Clause 2’s right to seek Writ of Habeas Corpus;

The First Amendment’s right to petition the Government for a redress of grievances;

The Fourth Amendment’s right to be free from unreasonable searches and seizures;

The Fifth Amendment’s right to be free from charge for an infamous or capitol crime until presentment or indictment by a Grand Jury;

The Fifth Amendment’s right to be free from deprivation of life, liberty, or property, without Due Process of law;

The Sixth Amendment’s right in criminal prosecutions to enjoy a speedy trial by an impartial jury in the State and District where the crime shall have been committed;

The Sixth Amendment’s right to be informed of the nature and cause of the accusation;

The Sixth Amendment’s right confront witnesses;

The Sixth Amendment’s right to Counsel;

The Eighth Amendment’s right to be free from excessive bail and fines, and cruel and unusual punishment;

The Fourteenth Amendment’s right to be free from deprivation of life, liberty, or property, without Due Process of law;

WHEREAS, Sections 1021 and 1022 of the 2012 NDAA as they purport to authorize, 1) detainment of persons captured within the United States of America without charge or trial, 2) military tribunals for persons captured within the United States of America, and 3) the transfer of persons captured within the United States of America to foreign jurisdictions, is repugnant to the following rights enshrined in the (STATE) Constitution: (NOTE – AS WRITTEN FOR THE STATE OF RHODE ISLAND. Article I Section 10’s right to a speedy pubic trial by an impartial jury, right to have the assistance of counsel, and the right to be free from deprivation of life, liberty, or property, unless by the judgment of peers;

Article I Section 18’s requirement that the military authority is subordinate to the civil authority;

WHEREAS, the members of this (Legislature, Town Council, County Government, etc..) have taken an oath to uphold the Constitution of the United States of America and the Constitution of the State of (Rhode Island);

WHEREAS, this (Legislature, Town Council, County Government, etc..) opposes any and all rules, laws, regulations, bill language or executive orders, which amount to an overreach of the federal government and which effectively take away civil liberties;

WHEREAS, it is indisputable that the threat of terrorism is real, and that the full force of appropriate and constitutional law must be used to defeat this threat; however, winning the war against terror cannot come at the great expense of mitigating basic, fundamental, constitutional rights;

WHEREAS, undermining our own inalienable rights serves only to concede to the terrorists’ demands of changing the fabric of what made the United States of America a country of freedom, liberty and opportunity.

NOW BE IT RESOLVED THAT, the (Legislature, City Council, etc…) of the (Your State, Municipality or County), condemns in no uncertain terms Sections 1021 and 1022 of the 2012 NDAA as they purport to 1) repeal Posse Comitatusand authorize the President of the United States to utilize the Armed Forces of the United States to police the United States of America, 2) indefinitely detain persons captured within the United States of America without charge until the end of hostilities as purportedly authorized by the 2001 Authorization for Use of Military Force, 3) subject persons captured within the United States of America to military tribunals, and 4) transfer persons captured within the United States of America to a foreign country or foreign entity; and

BE IT RESOLVED, that the (Legislature, City Council, etc…) finds that the enactment into law by the United States Congress of Sections 1021 and 1022 of the National Defense Authorization Act of 2012, Public Law Number 112-81, is inimical to the liberty, security and well-being of the people of (Your State, Municipality or County), and was adopted by the United States Congress in violation of the limits of federal power in United States Constitution; and

Liberty Preservation Act: Noncompliance

GENERAL DESCRIPTIONThis bill prohibits all public officers, agents, and employees of the State of (STATE) from providing material support or participating in the implementation of Sections 1021 and 1022 of the National Defense Authorization Act of 2012.

HIGHLIGHTED PROVISIONS
This bill:

prohibits all public officers, agents, and employees of the State of (STATE) from providing material support or participating in the implementation of Sections 1021 and 1022 of the National Defense Authorization Act of 2012; and

makes it a class A misdemeanor for a person to provide material support or participate in the implementation of Sections 1021 and 1022 of the National Defense Authorization Act of 2012.

Be it enacted by the People of the State of (STATE):

SECTION 1. NEW LAW

This Act shall be known and may be cited as the “Liberty Preservation Act.”

A.. 1. The Legislature finds that the enactment into law by the United States Congress of Sections 1021 and 1022 of the National Defense Authorization Act of 2012, Public Law Number 112-81, is inimical to the liberty, security and well-being of the people of (STATE), and was adopted by the United States Congress in violation of the limits of federal power in United States Constitution.

2. The Legislature finds that, together, Sections 1021 and 1022 of the National Defense Authorization Act of 2012, as they purport to authorize 1) detainment of persons captured within the United States of America without charge, 2) military tribunals for persons captured within the United States of America, and 3) the transfer of persons captured within the United States of America to foreign jurisdictions, are violative of the following rights enshrined in the Constitution of the United States of America;

Article I Section 9, Clause 2’s right to seek Writ of Habeas Corpus;

The First Amendment’s right to petition the Government for a redress of grievances;

The Fourth Amendment’s right to be free from unreasonable searches and seizures;

The Fifth Amendment’s right to be free from charge for an infamous or capitol crime until presentment or indictment by a Grand Jury;

B The State of (STATE) shall not provide material support or participate in any way with the implementation of Sections 1021 and 1022 of the National Defense Authorization Act of 2012 within the boundaries of this state. The Department of Public Safety is hereby directed to report to the Governor and the Legislature any attempt by agencies or agents of the United States Federal Government to secure the implementation of Sections 1021 and 1022 of the National Defense Authorization Act of 2012 through the operations of that or any other state department.

C. Any public officer, employee, or agent of the State of (STATE), or any employee of a corporation providing services to the State of (STATE) that enforces or attempts to enforce an act, order, law, statute, rule or regulation of the government of the United States in violation of Subsection 1 B of this act shall be guilty of a class A misdemeanor punishable by imprisonment in the county jail not exceeding six (6) months or by a fine not exceeding Five Hundred Dollars ($500.00) or both such fine and imprisonment;

SECTION 2.

This act takes effect immediately upon approval by the Governor.

Liberty Preservation Act: Nullification

AN ACT relating to detainment without charge, military tribunals, and transfer to foreign jurisdictions of persons residing in the State of (STATE); creating the Liberty Preservation Act; providing legislative findings and declarations of authority; prohibiting state from providing material support for certain acts; prohibiting state participation in the implementation of certain acts; making certain acts unlawful; providing penalties; and providing an effective date.Be it Enacted by the People of the State of (STATE):

SECTION 1. NEW LAW A new section of law not to be codified in (STATE) Statutes reads as follows:

This act shall be known and may be cited as the “(STATE) Liberty Preservation Act”

SECTION 2. NEW LAW A new section of law to be codified in the (STATE) Statutes as Section (NUMBER) of Title (NUMBER), unless there is created a duplication in numbering, reads as follows:

The Legislature declares that the authority for this act is the following:

1. The Tenth Amendment to the United States Constitution provides that the United States Federal government is authorized to exercise only those powers delegated to it in the Constitution and nothing more. The guaranty of those limitations on federal power is a matter of contract between the state and people of (STATE) and the United States at of the time that the Constitution was agreed upon and adopted by (STATE) and the United States;

2. Article VI, Clause 2 of the Constitution of the United States provides that laws of the United States are the supreme law of the land provided that they are made in pursuance of the powers delegated to the federal government in the Constitution;

3. Article I Section 9, Clause 2 of the Constitution provides that the Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it;

4. The First Amendment provides that the Congress of the United States shall make no law prohibiting the right of the people to petition the Government for a redress of grievances;

4. The Fourth Amendment provides that the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated;

5. The Fifth Amendment provides that the People have a right to be free from deprivation of life, liberty, or property, without Due Process of law;

6. The Sixth Amendment provides that the people have a right in criminal prosecutions to enjoy a speedy trial by an impartial jury in the State and District where the crime shall have been committed; to be informed of the nature and cause of the accusation; to confront witnesses; to Counsel;

7. The Fourteenth Amendment provides that the people are to be free from deprivation of life, liberty, or property, without Due Process of law.

SECTION 3. NEW LAW A new section of law to be codified in the (STATE) Statutes as Section (NUMBER) of Title (NUMBER), unless there is created a duplication in numbering, reads as follows:

1. Section 1021 of the National Defense Authorization Act of 2012 purports to assert the President’s authority to not only arrest suspected terrorists, but also to determine whether or not a trial, including what type of trial, will be held for those arrested;

2. Section 1022 of the National Defense Authorization Act of 2012 requires detention without trial by the military for a certain class of terrorist and authorizes but does not require the same for citizens of the United States;

3. The exemption for citizens of the United States in Section 1022 of the National Defense Authorization Act of 2012 only exempts citizens from a requirement and reads as follows, “The requirement to detain a person in military custody under this section does not extend to citizens of the United States”;

4. The enactment into law by the United States Congress of Sections 1021 and 1022 of the National Defense Authorization Act of 2012, Public Law Number 112-81, is inimical to the liberty, security and well-being of the people of (STATE), and was adopted by the United States Congress in violation of the limits of federal power in United States Constitution, including but not limited to, those listed in Section 2 of this act.

SECTION 4. NEW LAW A new section of law to be codified in the (STATE) Statutes as Section (NUMBER) of Title (NUMBER), unless there is created a duplication in numbering, reads as follows:

1 The State of (STATE) shall not provide material support or participate in any way with the implementation of Sections 1021 and 1022 of the National Defense Authorization Act of 2012 within the boundaries of this state;

2. The Department of Public Safety is hereby directed to report to the Governor and the Legislature any attempt by agencies or agents of the United States Federal Government to secure the implementation of Sections 1021 and 1022 of the National Defense Authorization Act of 2012 through the operations of that or any other state department;

3. The indefinite detention, prosecution according to the law of war, and transfer to a foreign jurisdiction of persons as provided for by Sections 1021 and 1022 of the National Defense Authorization Act of 2012 are in direct contravention to the limits on federal power as specified in Section 2 of this act and are illegal within the boundaries of the state of (STATE);

SECTION 5. NEW LAW A new section of law to be codified in the (STATE) Statutes as Section (NUMBER) of Title (NUMBER), unless there is created a duplication in numbering, reads as follows:

1. Any public officer, employee, or agent of the State of (STATE), or any employee of a corporation providing services to the State of (STATE) that enforces or attempts to enforce an act, order, law, statute, rule or regulation of the government of the United States in violation of Section 4 of this act shall be guilty of a class A misdemeanor punishable by imprisonment for not more than six (6) months or by a fine not exceeding Five Hundred Dollars ($500.00) or both such fine and imprisonment;

2. Any official, agent, or employee of the government of the United States, or employee of a corporation providing services to the government of the United States that enforces or attempts to enforce an act, order, law, statute, rule, or regulation of the government of the United States in violation of Section 4 of this act shall be guilty of a class B felony punishable by imprisonment for not more than one (1) year, or a fine of not more than Two Thousand Dollars ($2,000.00), or by both such fine and imprisonment.

SECTION 6. This act shall take effect immediately upon approval by the Governor.

Liberty Preservation Act: Local Resolution

WHEREAS, the Constitution of the United States is the foundation of our nation’s rights and freedom, and the basis of our representative democracy; AND

WHEREAS, the indefinite military detention without trial of any person, including US citizens, could be allowed by Sections 1021 and 1022 of the National Defense Authorization Act (NDAA); AND

WHEREAS, the indefinite military detention of any person without trial violates the 5th and 6th amendments of the Constitution of the United States, Article III of the Constitution of the United States, and the Posse Comitatus Act; AND

WHEREAS, the NDAA corrodes the ideals of presumed innocence and right to a fair trial on which our nation was founded, and which generations of activists and military servicemen and women have fought to preserve; AND

WHEREAS the (TOWN, CITY OR COUNTY) of (NAME OF TOWN, CITY OR COUNTY) re-affirms its gratitude for the supreme sacrifice of those in the Armed Forces who have died in battle in the name of those same cherished rights and liberties; AND

WHEREAS, the NDAA’s detention provisions could, under Humanitarian Law Project v. Holder, allow the targeted detention of activists, journalists and other Americans exercising their First Amendment rights despite the crucial role of Free Speech in preserving liberty; AND

WHEREAS, the NDAA’s detention provisions could allow the recurrence of torture in military detention in violation of the Eighth Amendment; AND

WHEREAS, the detention provisions could force US military servicemembers to serve as domestic jailers, a role for which they are neither trained nor equipped, nor is ever appropriate; AND

WHEREAS, the FBI Director, the Defense Secretary, the Director of National Intelligence, the Department of Defense, and many of our nation’s generals, admirals, and servicemen and women have opposed the NDAA’s detention provisions; AND

WHEREAS, the (TOWN, CITY OR COUNTY) of (NAME OF TOWN, CITY OR COUNTY) has an extensive history of protecting its residents’ civil rights and liberties as embodied in its rejection of the USA PATRIOT Act, which led hundreds of other municipalities across the nation to emulate our example;

THEREFORE BE IT RESOLVED that the City Council of (NAME OF TOWN, CITY OR COUNTY), (YOUR STATE), acting in the spirit and history of our community, does hereby declare that we

Strongly affirm our loyalty to the rights and liberties enshrined within the Constitution of the United States, including the Fifth Amendment right to due process and the Sixth Amendment right to trial;

Instruct all our public agencies to decline requests by federal agencies acting under detention powers granted by the NDAA that could infringe upon residents’ freedom of speech, religion, assembly, privacy, or rights to counsel.

Expect all federal and state law enforcement officials acting within the City to work in accordance with local law, and in cooperation with the (NAME OF TOWN, CITY OR COUNTY) Police Department, by allowing any detainees among (NAME OF TOWN, CITY OR COUNTY)’s residents or visitors access to a trial, counsel and due process, as provided by Article III of the Constitution of the United States;

Request that our United States Congressman and Senators monitor the implementation of the NDAA and actively work for the repeal of the NDAA’s detention provisions to restore fundamental rights and liberties embodied in the Constitutions of the (YOUR STATE) and the United States. To that end, the (MAYOR, CITY MANAGER, ETC) shall send copies of this resolution to our US Congressman and Senators, the US Senate Committee on the Judiciary, the US Senate Select Committee on Intelligence, the US House of Representatives Committee on the Judiciary, the US House of Representatives Permanent Select Committee on Intelligence, the US Attorney General, and the President of the United States.

Citizens Push Back Against Library/Community Center/City Hall Project

"The projected cost to build a new library/senior center is about $7 million, with ground breaking planned for 2014.

'This is in the very preliminary planning stages,' said Mayor Chris Meyer, a steering committee member. 'We want community input and so far we've heard from some, but not enough people in the community.'

When the new city fire station was being planned, a frequent complaint from residents was the lack of input sought from them, Meyer said.

It's difficult for residents to comment on the plans when there is nothing available for people to read in one document that explains why a new library or expansion is needed, said Carl Mueller, who spoke during a citizen question and answer period of the meeting.

'You need to have clarity in this process to have the trust of the public,' said Mueller, who is retired. He added the library should have a timeline available that describes why and how the project has progressed and clearly explains the different design options.

'When there's something like this, people will be able to understand and make suggestions,' he said.

Library Director Lori Belongia said she supported Mueller's suggestion and a document would be made available to the public.

By the end of March, the Library Steering Committee will provide to the City Council a detailed needs analysis, estimates for the costs of each option and the projected costs to be covered by donations."

D.P.I. Superintendent Pushes Federal Reserve Agenda as "Financial Literacy"

Why aren't we talking about quantitative easing, currency expansion or fractional reserve banking principles?

"Wisconsin is fortunate to have many fine kindergarten through 12 schools educating our young people. The quality of this state's educational system is among the best in the United States, and the same can be said for Wisconsin teachers.

Those accolades notwithstanding, there is one area in which Wisconsin schools should consider focusing some of their educational muscle: personal financial literacy. More than ever before, our children -- by the time they graduate from high school -- need to be able to cope in the increasingly fast-paced world of financial services.

Today, many young people rarely handle cash, opting instead for the use of debit cards, credit cards and smart phones to make purchases. Those who have jobs probably never see a paycheck because most employers use direct deposit for their payrolls. And, most teens probably never have read the fine print of the contract for their mobile telecommunications devices. Without an understanding of personal finance, teens can incur unexpected charges that damage their financial future.

By the nature of its mission, the Wisconsin Department of Public Instruction has a deep interest in fostering personal financial literacy education in our schools. The agency's 2009 publication, Planning Curriculum in Personal Financial Literacy, was the first of its kind in the nation to offer comprehensive instruction in personal financial literacy for students. The curriculum planning guide was based on Wisconsin Model Academic Standards for Personal Financial Literacy, which help schools infuse financial literacy across the curriculum.

The Wisconsin Department of Financial Institutions through its Office of Financial Literacy also is chartered with promoting personal financial literacy initiatives.

Both agencies have representatives in leadership positions on the Governor's Council on Financial Literacy, which strives to measurably improve the level of financial literacy among Wisconsin citizens.

Today, members of the council will join Gov. Scott Walker in honoring the recipients of the 2011 Wisconsin Financial Literacy Award in a ceremony at the Capitol. The winners -- 14 individuals and eight organizations -- were recognized for efforts that are making a difference in their schools, communities and places of work. Their accomplishments are models for similar activities by any organization or community considering a financial literacy initiative.

For example, the Appleton Area School District has implemented a comprehensive K-12 financial education mapping to ensure that all graduates will be able to meet the ongoing challenges in an ever-changing society. Laurel Scherer, a teacher at Antigo Middle School, has leveraged her partnership with a local credit union to give students real-life lessons in money skills. Sarah Campbell, a teacher at Wisconsin Dells High School, took a holistic approach in re-creating a nine-week personal finance course that all students must take to graduate.

Teachers such as Campbell and Scherer are among the vast majority of teachers who understand the importance of financial literacy education. In a 2010 study conducted by the National Endowment for Financial Education, 89 percent of the K-12 teachers surveyed agreed that students should take either a financial education course or pass a competency test to graduate from high school.

Currently, about one-fourth of Wisconsin school districts require a course in financial literacy. Many other districts include strands of financial literacy education in classes such as economics, mathematics or social studies. Students who are financially literate when they graduate from high school will be better equipped to handle the economic decisions they will face as adults. Let's get all Wisconsin students on the path to being financially literate."
