Congressman Solomon Ortiz has selected Denise Blanchard as his chief of staff.

Blanchard was formerly deputy chief of staff and district director. She was promoted to replace Fernando Gomez who resigned.

Blanchard, a Brownsville native and Ortiz' long-time Director of District Operations, has worked for Ortiz for more than 16 years. Her experience includes constituent services, district office operations, and a political understanding of South Texas. She began service with Ortiz in 1991, becoming District Director in 1995. Previously, she worked with the Brownsville Chamber of Commerce, the Brownsville Economic Development Council and the Brownsville-South Padre Island International Airport.

This is Ortiz's second staff resignation in two months.

Ortiz’s long-time communications director, Cathy Travis, resigned Dec. 31 to continue her writing career. Ortiz hired Dallas-native Danny Guerra, 25, to replace Travis. Guerra wrote previously for political news magazine Congressional Quarterly. According to The Brownsville Herald, he also worked previously with several Texas legislators.

Representative Ortiz to replace his long-time chief of staff, 'Lencho' Rendon with 'Nando' Gomez.

Ortiz, D-Corpus Christi, also announced the promotion of Denise Blanchard, director of district operations to deputy chief of staff, the post Gomez held.

Ortiz said that Gomez, “is very level-headed. He is not the type that gets angry. He always looks at the issue before he makes a decision and he always counsels with the staff.”

Ortiz said Gomez of Gregory worked in Washington, D.C., for eight years as legislative director for former U.S. Rep. Martin Frost, as Ortiz’s legislative director in 2005, followed by promotion to deputy chief of staff. Ortiz said Gomez handles military matters. Gomez also worked in Austin for the state Legislature.

THE CAT IS OUT OF THE BAG: (Part 1 of 3) Top Republicans Admit That Mauricio Celis is Not The Main Target But The Democratic Party {E} Defenzor Exposes Glimpses Of An Intricate Attack Plan] Corpus Christi, Texas –

Rove Expedience & A Simple Activation Mechanism:

Both top insiders and players within the Republican Party have admitted to this publication that a clique exists within its party that is doing everything possible to use Mauricio Celis' case to influence the upcoming elections. A few sources shared that Celis is not the main target but the Democratic party and its candidates are. Celis is just a target of convenience – "an expedient victim to point the finger at." "It is nothing personal," one ultra right Republican source told El Defenzor.

"He fits the bill of a good target. It will be the method by which some top people in our party will disenchant many in the general pubic with the Democrat Organization including undecided voters such as Independents." ASSERTIONS WITHOUT PROOF:

An element within the Republican Party (who hold radical opinions about the people of South Texas and its culture in general) are making the case that all candidates within Democratic Party that accepted campaign contributions from Celis are corrupt and/or dishonest and/or lacking in ethics. This propaganda is simply not true and is a veiled attempt at suppressing Hispanic votes and the Democratic parties domination. These are "assertions without proof" that some Republicans radicals, who hold such extreme views , are pushing: In a nutshell, allegedly corruption has surfaced in the Democratic Party due to the fact that is has governed for too long in South Texas. Republicans hope that this gutter politics can prevail.

WHO IS MAURICIO CELIS? Celis (born in Mexico, raised in Rockport in a low income neighborhood, who raised himself by his own "bootstraps" found a niche in legitimate businesses and the legal market and made a fortune. He also served in the U.S. Navy and was honorably discharged and is a family man with a son and a daughter who has tried to shelter from these attacks. Because of his youth (36 years of age) and his rapid rise in the business community and accumulation of wealth which he shared generously with the Democratic party he simply made a good target for the Radical Right who wish to bring back white domination and control Hispanics through fear and intimidation even from the highest powers in Texas and Washington.

Celis has been portrayed as a byproduct of a crooked and oppressive system. He has never ran for office only made contributions to candidates whom he agreed with politically and/or had a close affinity. Celis is not a felon and reportedly had a world renowned law firm give all of his business enterprises a thumbs up. Now, the stereotypical accusations that any Hispanic who has wealth is part of the underworld has been thrown at him regardless of the flimsy and untenable ground it stands on. THE FABRICATED VICTIMS: This above-mentioned hostile fringe within the Republican Party has laid out a sophisticated plan of attack to isolate Celis and many Democratic leaders by a guilt by association ploy. The Victim, according to them, are the: constituents of South Texas (especially Hispanics, in that Celis in a sense is a role model and has launched the wrong message to new generations. In the Radical Republican’s eyes he has promoted added a malignancy to the way of life of Hispanics. These radicals do not want a power base of wealthy Hispanics and have proven that they want to isolate, humiliate, and slander these figures in order to terrorize and suppress Democratic voting. The mainstream media including all the TV stations locally and the San Antonio Express-News have been accomplices in the witch hunt and execution of this plan, according to one source who is employed with the state due to his Republican political connections within the party. "Celis, in some video footage, is pictured up close to the point where the pores on his face are noticeable. He is pictured as a" Soprano-like" heavy-set and imposing thug, in a dark suit much like a gangster that usually gets out of a black sedan and with dark sunglasses." These negative stereotypes imprinted in the public’s minds are what the Radical Republicans are trying to achieve. Truth be told, shortly after Celis began to be attacked the trial lawyer who had "an exploratory committee" to run for Senate, Mikal Watts withdrew. Also, young and up and coming State Representatives and judges ran for cover because many of them accepted money from Celis. THE INTENDED TARGET – WHO ARE THEY TRYING TO PORTRAY AS VILLAINS? The intended target is not Celis per se, but the Democratic party, according to many of the sources interviewed. As one inside source put it, "He is just being portrayed as a byproduct of a corrupt and oppressive system – the Democratic Party... A byproduct of La Palanca, of the culture of George Parr and amigitos (friends)." The same insider bragged: "It has been brilliantly executed, that is, how Celis is portrayed with a shady Third World-ish attitude and value system). He is pictured as someone who has robbed us of the American dream... It is implicated that he cut line and did not play by the rules. Brilliant scheme don't you think?" Even Attorney Thomas J. Henry, who initiated the attack against Celis by exposing that he was not an attorney here "nor anywhere in the world" through Television advertisements, pointed out to ElDefenzor some very interesting observations that confirm the cited suspicions. "Mauricio Celis was doing okay. His mistake was to get involve in politics and then start to make political contributions to candidates running within the Democratic Party. I think he was trying to legitimize himself. He should have stayed sequestered in his nice office and everything would have been alright." It seems like a simplistic explanation is being executed to demonize Celis. It seems plausible when applied to him even though there is no evidence that he has connections with the underworld in Mexico or Latin America. But one Republican insider (who is consciously aware of this element of attack) who is involved in structuring campaigns explained: "The reason it seems plausible to many is because they want to believe it. Key reporters within the media have harped that just because an investigation is going on – it means something has to be horrifically wrong. The goal has-been to polarize the masses and the poor and even the middle class against Celis. A climate has been encouraged for the media audience to have little sympathy and connection with him. Who Will The Manufactured Vindicators/Heroes and The Vehicle Of This Scheme Be? The Defenzor asked one of the sources. Who will the "Vindicators" in this well-orchestrated modern day persecution of a man who achieved the American dream be? The Defenzor asked one of the sources involved with Republican Women. The answer: "I believe it is the Republican office holders: Texas Attorney General Greg Abbot, NuecesCounty Jim Kaelin and the Republican Judge (whom I believed was pressured via partisan political muscle) who signed the order to raid his offices." What will be the ideal vehicle to keep the attack lingering on until the election? The response: "Conservative radio and a special network of media people within the mainstream media who espouse our views. In Conservative radio it is especially effective in that the allegations become a one-way street. The audience is very much receptive to attacks against their political foes – the Democrats.... And many hold prominent offices within the Republican Party even at the state level... whose job is to 'plot against Democrats.'" The simplicity of the plan is this: It doesn't’t matter if the information is not accurate or confirmed when you feed it to an audience who despise the Democratic Party anyway, or you have a lawyer who gives hundreds of thousands of dollars like Thomas J. Henry to control the television airwaves and try to try and convict Celis even before he is accused of anything in October of 2007. Some whisper that Henry is only a finger puppet for those rich white lawyers like the Club who want to control the legal profession, cut deals with the Republicans so no further limiting of lawsuits will occur and use Celis as the sacrificial lamb. As Celis mounts his defense it will be interesting to see all of these facts if proven come to light. THE VOID AND HISPANIC REPUBLICANS: OUT IN THE COLD? ARE THEY BEING USED FOR NUMBERS AND THEIR BELIEFS DISCOUNTED?

While the Republican Party has attempted to portrayed Hispanics who enrolled in the Republican Party as enlightened such Attorney/Political Strategist Filemon B. Vela. Jr. (see December 2007 article, "The Prodigal Son") and his wife 13th Appeals Court Justice RoseVela – there are some that are embittered. "We do our thing in theHispanic Republican Assembly and they whites) do their thing. As long as we don't interfere in what they are doing everything is fine." The question that surfaces -- Is it segregation within the Republican Party? Do some of the top leaders who are part of the element informally referred to as the "lunatic fringe" only care about theHispanic vote and their numbers and not Hispanic input? When has it ever been any different. Go to a Republican gathering and Hispanics are only tolerated for the swing votes they bring.

Joey Martinez, whose father owns the Fruit Kings in the region, has-been an active participant in the party and in face he has gone above and beyond the call of duty to educate many in South Texas about the beneficial aspects of conservative thinking. However Martinez has admitted to El Defenzor that there is an element within the Republican Party that refuses to tolerate anything dealing with Texan culture. Martinez explained: "I was asked one day to help decorate some of the rooms while we were waiting for elections returns – the campaign workers of Jim Kaelin and a few others were present. We had a cowboy room and so forth. So I decided to decorate a Tejano Culture room. Was asked by prominent organizers of these campaigns to take everything down in that many (Anglos) who would be attending would be alienated and upset. I tried to explain that we as Hispanics are also sensitive and deserved a room to feel comfortable, to make many feel at ease. Soon after, the requests became demands... " Thus one story of many embittered Hispanic Republicans who are made to feel belittled or that their beliefs are not part of the redneck Republican image that politicians like Kaelin do not want to lose as a base. Martinez, who plays the accordion and is a Tejano music fan, concluded: "How can this element within the Republican Party expect to win elections if they are out to change us to see the world only through their eyes and not to see it through ours. They (and I am not saying everyone) don't accept our way of life and culture." An Hispanic woman that is actively involved with an Republican Women group told El Defenzor during an interview: "Some top figures within the Republican Party are encouraging us to take the message that Celis is hurting the Hispanic community. I understand that Celis has never ran for office nor cared to do such a thing. It seems some within this party want to cut off the funding sources to Democrats; but they don't have to go out for blood. No one seems to be challenging them. This is why they attack because they know they can... Even our local District Attorney Carlos Valdez seems to have jumped into their bandwagon." The Defenzor approached Corpus Christi City Councilman Larry Elizondo (who is considered an independent minded politician) and asked him if he felt Mauricio Celis had done anything wrong. Councilman Elizondo responded: "I don't think so. I feel it is media hype. I believe it is a gray area. Mauricio Celis found a niche in the market and many who are jealous of him are demonizing him." Many Hispanics are beginning to realize that the nonstop attack on Celis is very suspicious. Never has an attorney slandered another individual on TV in such a manner nonstop and no one has stopped to question why? No one has also questioned why Sheriff Kaelin got involved weeks later and was all over the news going after Celis. Politically motivated? You bet!! THE CAT IS OUT OF THE BAG: Isn’t the attacks against Celis and more to the point the Democratic Party controlled by Hispanics just gutter level politics? Sheriff Kaelin and Texas Attorney General Abbot both have politicized their offices. They are using their offices and resources to target partisan competitors. They both have a questionable past in dealing with minority issues. Sheriff Kaelin has deep dark secrets that will be share with our audience if necessary that were not brought up during his last campaign (and remarks that go beyond "the Rudy Bibotes" remark made on Domingo Live this weekend byte Head of the Nueces County Live Stock Show) – and Abbot has on several occasions targeted solely minorities with his infamous campaigns to supposedly stamp out voter fraud. In his last foray when he targeted mostly Hispanic women from Robstown (mostly ladies who were not familiar with the new elections laws) and other minorities in the state. Some believe that the voting machines and arrest of politiceras was a method to suppress the vote on the West side of Corpus Christi and Robstown which are Democratic strongholds. All the individuals targeted in the 2006 political cycle and before then were minority and Democrats (only Hispanics and Blacks). "Can you believe, not a single Anglo was indicted throughout the state during that foray only minorities who happen to be Democrats. How convenient," one political observer rold el Defenzor. The representative of the office of the Texas Attorney General was challenged by El Defenzor. El Defenzor pointed out why a booklet on how to identify voter fraud (which was put together and put out by the Attorney General's office) had a photo in the introduction of Black Americans at the polls; and then in the subsequent pages a section entitled "What to look for" in identifying mail voter fraud – an envelope was pictured with a "sickle cell" stamp (of a black woman holding her baby). This element wants to expediently belief the "assertions without proof" because either they are disenchanted with the Democratic Party being too Hispanicized; or because something is being offered the within the Republican party. And conservative radio has been the place to take such grips – Conservative Radio Commentator Eric Von Wade on one occasion (before taking the Channel 10 TV job) said that persons coming in from Mexico should be stamped a number like rubber ducks are in a carnival ... Just in case they need to be hunted down. He was the president of the rifle association at the time when he made the remark. A few that are part of this extreme fringe of the Republican Party have been stating: "Celis asked for it." This argument, however, is as slippery slope with terrible consequences. As Bush Escobedo, who sits on the 4A board and has been a community activist said: "All Mauricio (Celis) really did was parade his happiness and newly acquired fortune. But by what standard did he become a villain who invited both a legal and political attack on him? I believe all successful Hispanics now will have to be very careful – they just might be targeted in a similar manner." Escobedo concluded: "If The Texas Attorney General and Sheriff Jim Kaelin were motivated exclusively by public welfare they should have waited for evidence before making accusations. I don't believe the dislike of Celis is personal. He is a symbol of a larger hurt and of afar deeper anger. He has become a projection screen for this pain. awesome article! I agree. The Republicans went way overboard with Celis. It's all for what? A naked girl at a sripes store who was drunk and Celis' partner's girlfriend from the Utopia nightclub? Give me a break. The badge was from him really being a peace officer. The only other crime he did was give a boatload of money to keep the Republicans at bay and not steal all the elections like they did nationally and last but not least he had a legitimate loophole to set up his firm. Oh! one more thing: He has a clean record, is a family man and has two kids. THIS IS A MAJOR SET UP!!!!

BROWNSVILLE, Texas – The man who arranged the delivery of bribe payments to two Willacy County commissioners in exchange for contract advantages in the construction of the Willacy County Adult Correctional Center (Center) in Raymondville, Texas, was sentenced today, U.S. Attorney Don DeGabrielle announced.

David Cortez, 72, of Laredo, Texas, will be serving a three-month term of imprisonment at a facility to be designated by the U.S. Bureau of Bureau of Prisons to be followed by a two-year term of supervised release during which Cortez will be confined to his home for six months. U.S. District Judge Andrew Hanen imposed the sentence this morning and further ordered Cortez to pay a $25,000 fine.

Two Willacy County commissioners -- Jose Jimenez, of Sebastian, Texas, and Commissioner Israel Tamez, 60, of Raymondville, Texas, were convicted in January 2005 for accepting bribe payments in exchange for contract advantages in the construction of the Center, which houses federal inmates. On March 24, 2005, former Webb County Commissioner David Cortez, who arranged the delivery of the bribe payments to these men, admitted to forwarding a series of payments totaling approximately $39,000 from a corporation involved in soliciting a consulting contract regarding the Center in Willacy County. The payments were in exchange for providing the particular corporation with advantages not available to others interested in, and competing for the consulting contract concerning the Center.

Former Willacy County Commission Israel Tamez was sentenced to six months in prison, to be followed by three years of supervised release and fined $25,000.

The charges against former Willacy County Commissioner Jose Jimenez were dismissed following his death earlier this year.

Cortez, who had been serving as a county commission for Webb County at the time of his conviction, resigned following the entry of his guilty plea in March 2005.

The charges filed against David Cortez and the two commissioners were the result of an investigation conducted by special agents of the FBI, the Texas Rangers, and the Willacy County Sheriff's Department.

McALLEN, Texas – Paulita Nilo, 24, of Mercedes, Texas, was sentenced to prison for bribery of a public official, U.S. Attorney Don DeGabrielle announced today.

Judge Ricardo H. Hinojosa sentenced Nilo on Thursday, Nov. 16, 2006, to a year and a day in federal prison, without parole. Nilo was ordered to surrender to the U.S. Marshals on Dec. 29, 2006. The prison term will be followed by a two-year term of supervised release.

Nilo pleaded guilty in July, admitting that in May 2006, she approached a Customs and Border Protection (CBP) officer while he was off-duty and offered him an unspecified amount of money to facilitate the smuggling of an undocumented alien through the Progreso, Texas Port of Entry. The CBP officer reported the incident to his superiors. During the subsequent investigation, Nilo exchanged numerous telephone calls with the CBP officer concerning arrangements for the passage of an undocumented alien into the United States. Ultimately, Nilo paid the officer $300, and on that same day was immediately arrested after driving a vehicle through the Progreso, Texas Port of Entry, accompanied by an undocumented alien.

The charge against Nilo is the result of an investigation conducted by the Department of Homeland Security - Office of Inspector General and Customs and Border Protection. The case was prosecuted by Assistant U.S. Attorney Linda Requenez Rossborough.; 12:03 AM

FORMER COUNTY COMMISSIONER SENTENCED IN BRIBERY CASE

BROWNSVILLE, Texas – A former commissioner of Willacy County was sentenced to prison for accepting bribe payments related to contracts for the Willacy County Adult Correction Center in Raymondville, Texas, U.S. Attorney Don DeGabrielle announced today.

Israel Tamez, 60, of Raymondville, was sentenced to serve six months in federal prison and fined $25,000 at a hearing held this morning before U.S. District Judge Andrew Hanen. Tamez has been permitted to remain free on bond pending an order from the court directing him to surrender himself to a prison facility to be designated by the U.S. Bureau of Prisons. Following his release from prison, the court has ordered Tamez to serve a three year term of supervised release.

The bribery charge filed against Tamez was the result of an ongoing investigation conducted by special agents of the FBI, the Texas Rangers, and the Willacy County Sheriff's Department.

Tamez and former Willacy County Commissioner Jose Jimenez of Sebastian, Texas, were originally charged with conspiracy to commit bribery in a one-count information. Both men pleaded guilty to the charge in January 2005 when they admitted to agreeing to accept cash in exchange for voting to select particular corporate representatives and their companies in competition for the design, construction, financing, maintenance and management of the Correction Center. Tamez admitted receiving a series of cash payment totaling $10,000 or more from the corporate representatives selected to receive the contracts.

The charges against former Commissioner Jose Jimenez were dismissed earlier this year due to his death.

What is the Nueces County Infrastructure Rehabilitation Program?

The Nueces County Infrastructure Rehabilitation Project is an endeavor to address the critical infrastructure needs of Nueces County. How Can the Public Voice Support, Opposition or Concerns about a Road or Bridge Improvement Project?

For projects initiated through the CIP process, the county will hold quarterly public meetings with residents to discuss a particular road and bridge improvement project. Letters will be sent to property owners in the affected area inviting them to attend the public meeting(s) with county officials and others involved in the project. Nueces County will also issue news releases to the media and place legal advertisements in the newspaper to notify residents about a public meeting.

The purpose of the meeting is to provide an overview of the project, answer citizens' questions and gather comments from community members about the design of the project. In addition to the public meeting(s), residents can voice their concerns or questions at the Nueces County Commissioners Court Meeting during Public Comments. Project Team members also attend each meeting to provide a project update to the Commissioners Court and to answer any questions that may arise.

February 15, 2007 — The Brownsville Navigation District board on Wednesday approved a settlement proposal with Dannenbaum Engineering Corp. of Houston, regarding a failed bridge project.

The district spent more than $20 million for a new international bridge that was never built. An internal BND investigation later revealed that most of the money paid to Dannenbaum was not justified.

Just how much of the $21.4 million spent on the nonexistent bridge will be recouped is unknown.

The terms of the settlement are being kept confidential until both parties sign the proposal. It will come back to the board for final action on Feb. 21.

Chairman Martin Arambula, vice chairman Luigi Cristiano and fellow commissioners Roy de los Santos and Carlos Masso voted for the settlement with Dannenbaum, the project engineers and managers.

Commissioner Peter Zavaletta voted against the move, saying, "I think it's a bad agreement."

The board majority immediately rejected a proposal from Zavaletta that the board should contact the Cameron County District Attorney, the Texas Rangers, the FBI, and U.S. Attorney's Office, urging criminal investigations into the project to continue and reaffirming its full cooperation.

Zavaletta also proposed that interim administrator Donna Eymard and commissioners tell the law enforcement agencies that they would willingly serve as complainants in the event criminal charges are brought.

He said he feared that law enforcement agencies would think that BND was satisfied with all aspects of the project in reaching a settlement.

"This is too important to taxpayers," Zavaletta said.

Fellow commissioners, however, indicated that Zavaletta's proposal took them by surprise and said that Zavaletta should have brought this up in executive session before springing it on the board in public.

"In theory, it's a great idea," Cristiano told Zavaletta. Cristiano then admonished him, asking, "What message are you sending by blindsiding us?"

Commissioners agreed to discuss Zavaletta's proposal at BND's upcoming meeting Feb. 21.

The settlement brings an end to nearly two years of litigation.

BND paid Dannenbaum $15.4 million from 1997 to 2004.

Following an investigation by The Brownsville Herald, a spending study by BND special counsel showed that of the monies paid to the firm, $9.2 million were not justified, $1.7 million in possible "success" fees were in question, and the firm might have done about $4.5 million in engineering work.

In the midst of mediation efforts, Dannenbaum sued BND in the spring of 2005, claiming the district owed it $822,365.

BND countersued to recoup the millions paid to the firm, claiming breach of contract, self-dealing and fraud.

I completely agree with Peter Zavaletta. This is in light of the fact that the terms to this agreement are not available. WHY???? The money paid came from taxpayers so I think we should at least know what these terms are going to be before these other commissioners make a big decision like this. I want to congratulate Mr. Zavaletta for being a good commissioner and looking for our best interest.

There has been talk that several people might run. On Monday, attorney Robert Zamora officially announced that he has filed for the position, which is now held by Alex Garcia Jr.

"I have not only experience as a lawyer operating my own business for close to 30 years," Zamora said. "What I would like to do is lend the energy and the experience that I have to the operation of the Democratic Party here in Nueces County.

The race will be decided in the state presidential primary in March.

You know I have been in and out of Mauricio's trial. A few observations from the first time I was there. IMO a pro establishment Judge with a subtle leaning towards housekeeping but enough to cancel technical victories for the defense. To my surprise (which really shouldn't have been a surprise) was the Texas Deputy Attorney General and he was on a mission. I think about it for a bit and start to smell the stench. This prosecution is a winnable prosecution but it is not one seeking Justice. Josie (the Politiquera from the commentarios) and the political targeting / retaliation exacted in her from the same Level and branch of government. We all know the prosecution of her as a criminal was ridiculous. The ones who disagree do so because they dont like her politics but not because technically she was prosecutable. This is suppression of the NUECES DEMOCRATIC PARTY. Mauricio is being prosecuted out of Political Expediency. Angelica takes credit as this thing being her baby, she has put together a winnable case against a man she despises right along side of Mikal Watts. I know the disdain Angelica harbors for these men who with their money influence South Texas Politics. She knows they are cheating and she ran her election campaign fair and square to lose by a very narrow margin. Now all of that said, i do not believe her diligence stems from Professionalism. Also, I cannot see her casting stones as she is not without prosecutable transgressions. I believed in Angelica and thought if anyone would retain a humble objectivity that it would be Angelica. My opinion diminished now by our last two communications. I contacted her by phone and asked her if she would apprise a situation dealing with the status of my wife (unlawfully confined) and how I might remedy the situation. She was very polite (but in hindsight) out of expedience only she said, Yes Mr Haley I will look into the situation and I will call you back. It will probably be late today but I assure you I will call you back today Mr Haley." I still remain. This is all I need to know Angelica has turned to the Dark Side.

On another note "The Whole World Knew" Mauricio was not a licensed attorney. Let's suppose they did not have a clue he did not possess a license, who dropped the ball and allowed him to operate in the State Judiciary without credentials? Now get rid of everyone who should have known and claims they did not know as their defense. WATT they are really telling everyone is that they are incompetent. GET RID OF TEH INCOMPETENCE!

As for Angelica, I am truly disappointed for her and in her. She knows it and avoided talking to me while Carlos just patted me on the back. She did have to speak to my wife as it was unavoidable. Angelica's cower to us says it all. She knows it doesnt feel right cuz if it did she would face us with passion and confidence. Where did the Old Angelica go?

As for Mauricio, he is in the grinder. Mikal Watts, Two Fer, Firestone and Velacrat Politics. The only option he has is to bring in the Politicos and get them on record. If he has half a brain he will set up the three rings right there in the courtroom and let the Political Circus begin. Hell, he should even subpoena Hillary. The witness list is where we turned the tables and it can be so for Mauricio as well. I have tried to show him the water but I cant make him drink.

Town built between arroyo, Hall's Bayou

When Henry Kinney, Corpus Christi's founder, arrived in 1839, some believe he landed at the mouth of an arroyo, later called Blucher's Creek. It emptied into the bay near where Cooper's Alley intersects with Water Street.

In the early years, this arroyo was called Chatham's ravine. It was dammed to form a reservoir. Hogs wallowing in the town's water supply was a persistent problem in the 1840s and '50s (maybe they had boil-water alerts back then).

As the town grew, the dividing line between North and South Chaparral, and North and South Water, was the arroyo, or Blucher's Creek. The distinction between north and south street addresses downtown doesn't make sense unless you know that the arroyo was between Laguna and Cooper's Alley. It was covered and built over, and now is concealed under the growth of the city.

There were about three blocks south of the arroyo, and much of it dominated by E.D. Sidbury's lumber yard. That part of town where Shook's Garage is located once was called South Beach.

Where the arroyo emptied into the bay had the deepest water off the shoreline. That deep water explains why major piers were built there. One of the first was built by William Mann, in 1848. The Central Wharf, built in 1853, was enlarged in the 1870s to become the city's main wharf. In 1914, the Municipal Wharf was built just south of where the arroyo emptied into the bay.

On the north end of the downtown was another inlet, this one a slough called Hall's Bayou. It separated Corpus Christi from North Beach.

Once in the 1840s, horse wranglers on North Beach, working for Henry Kinney, were killing and skinning mustangs when they saw a party of Comanches ride up to the slough. They hid and watched as the braves threw buffalo robes into the shallow slough so their ponies wouldn't bog down in the mud.

In the 1870s, John Hall, an Englishman, built a beef packing house there. Discarded meat was dumped on the salt flats. Around the turn of the 20th Century, Hall's Bayou was a favorite place for boys to go crabbing; restaurants like that at the Seaside Hotel would buy the crabs for a nickel each. In the 1920s, it was dredged to become the entrance to the port. When you cross Harbor Bridge, you're crossing over Hall's Bayou.

Just as the arroyo separated north from south on the city's downtown street addresses, Hall's Bayou separated "The Beach" section of the city from North Beach. No one today calls the area around American Bank Plaza and Whataburger Field "The Beach," but that is what it was known as. Anything north and east of the 1914 courthouse was called "The Beach." Corpus Christi had South Beach, The Beach, and North Beach. All three suffered the most destruction in the 1919 storm, no doubt because these areas are on low ground, sure, but perhaps also because the storm surge followed the course of those natural inlets to the bay.

A mile west of town was the Salt Lake, between Winnebago Street and where the port turning basin is today. During the Civil War, Confederate soldiers butchered cattle on the Salt Lake. At that time, Rosalie Priour's husband had a big vegetable farm there. The Salt Lake dried up in the terrible drought that began in 1863.

The Salt Lake, Hall's Bayou and the arroyo exist now only on old maps and history books.

Ferries on the Nueces

The first act of Nueces County in 1847 was to set ferry tolls on the Nueces River and Rio Grande, since Nueces County took in all the territory in between. Tolls were 25 cents for a pair of oxen; 25 cents for a horse; 25 cents for every wheel on a wagon.

The main ferry on the lower Nueces was at the Santa Margarita crossing below the village of San Patricio. This was an ancient crossing, going back to the 1700s. The Paso de Santa Margarita was a good place to ford; the river was wide there and shallow, with a rocky bottom that provided good footing for teams.

In the 1850s, Samuel Reed Miller opened a store and established a ferry at Santa Margarita. In 1857, Robert Love, a rancher on the Nueces, planned to build a toll bridge across the river to compete with Miller's Ferry, but the plans fell through.

During the Civil War, Miller's Ferry was a major stopping place on the Cotton Road. The big wagons loaded with cotton were too heavy for the little ferry barge. When the river was high, the drivers would camp and wait until it was fordable.

The main stage road from Corpus Christi to San Antonio crossed the river at Miller's Ferry.

After the Civil War, rancher Sylvanus Gerard Miller began his own ferry at Lagarto. For a few years, there were two Miller's Ferries on the Nueces. By the 1870s, Samuel Reed Miller's grandson, Alonzo Quinn, took over the ferry and it became known as Quinn's Ferry.

Borden's Ferry was above Nuecestown (near where Calallen is today), a half-mile from Sharpsburg. Judge Sidney Borden, a cousin to canned-milk inventor Gail Borden, owned the ferry and a store.

O.H. Hearn established a ferry in 1867 at Nuecestown. If Borden's Ferry was the best route to Sharpsburg, Hearn's was the best way to Meansville. The road leading to the ferry was called Hearn's Ferry Road. Below that was A.L. Bitterman's Ferry, at the mouth of the Nueces. It was operated, while it lasted, to make it easier for the Rachal family of White Point to travel to Nuecestown.

Borden's Ferry was the last still in use, until 1913. By that time, bridges had been built across the river.

CORPUS CHRISTI — A 34-year-old Texas Department of Transportation worker is in critical condition Thursday afternoon with what police described as head-to-toe injuries after a local judge's car hit his parked work truck.

The accident occurred about 3:20 p.m. Thursday on an exit ramp from Padre Island Drive to Interstate 37, police at the scene said. 105th District Court Judge J. Manuel Bañales was driving a Cadillac Deville and spun out on the ramp, slid off the road and hit the pickup. The truck was parked as the employee was doing sign work nearby.

The worker was kneeling outside the truck and was hit directly by the Cadillac, police said. The truck was pushed about 50 yards from the point of impact.

Bañales' was taken to Christus Spohn Hospital Memorial with injuries that are not believed to be life threatening, police said.

The 34-year-old was also taken to Christus Spohn Hospital Memorial and is undergoing emergency surgery, police said. Police remain at the scene.

Rescuers had to cut the roof and doors off the Cadillac DeVille to free Bañales, who, along with the transportation worker struck, was taken to the Christus Spohn Hospital Memorial.

A local judge's car hit a transportation department worker crouching near his truck about to fix a sign Thursday afternoon, sending the worker to the hospital in critical condition, police said.

A Texas Department of Transportation heavy-duty pickup with a cherry-picker lift was parked near a ramp connecting Padre Island Drive to southbound Interstate 37 when J. Manuel Bañales, 105th District Court judge and presiding judge of the Fifth Judicial Administrative District, entered the ramp. His gold Cadillac Deville slid off the pavement and struck the truck parked a few feet away on the grass.

Two workers had just pulled over to fix a small, directional black and yellow sign about 2:45 p.m., said police Capt. John Houston, when one worker spotted the Cadillac heading straight for the truck and jumped out of the way. Another worker, 34 years old, wasn't able to move.

"He was hit with the full force of the vehicle," Houston said. "He's injured head to toe."

That worker was rushed to Christus Spohn Hospital Memorial with life-threatening injuries. Late Thursday he was in emergency surgery and on a ventilator. Bañales' injuries are not believed to be life-threatening, police said. He was taken to the same hospital.

The ramp was closed until about 6 p.m. as Corpus Christi police and Texas Department of Public Safety troopers cataloged the accident.

Houston said officers responded to the accident just like any other of the same severity, and state troopers were called in to help re-create the accident.

It wasn't clear Thursday afternoon how fast the Cadillac was going or what caused the accident, Houston said.

The Cadillac came to rest in the wrong direction, with its roof and doors removed with the Jaws of Life. The truck was some 50 yards away, pushed halfway up an embankment to another ramp by the force of impact.

As officers combed the road and car, a yellow grate from the pickup with three orange cones and a water cooler sat a few feet away from the car's front bumper. The worker who jumped out of the way was just about to set up the cones when the car struck, a transportation department spokesman said.

Bañales has been a district judge for 21 years. As presiding judge of the Fifth Judicial Administrative District, he assigns judges to cases when the regular judge is unavailable.

Second, I am glad Banales was not seriously injured but I wonder if Banales was speeding or perhaps on his cell phone and not paying attention. I hope DPS does a full investigation and does not form a biased opinion based on the fact that he is a judge.

Being a judge should be secondary in this situation. He is not in control of the investigation. I hope he was not on his cell phone, maybe this is a good example of what happens when you try to multitask while driving. May God be with the injuried man and his family. A full investigation should be performed and being a judge is no excuse for failure to CONTROL you vehicle.

I can't guess on whether or not he was drinking, but in my estimation: Judge Banales was probably speeding. In order for a mid-size car to send a much larger parked truck "approximately 50 yards" and "up an embankment" after impact, I would assume a high rate of speed. I would guess since he's on a ramp with advisory speeds (probably at 40MPH), that he was going much faster than that and that's how he also probably lost control.

I wish the report would state which ramp exactly Judge Banales was entering. There's one flyover ramp that heads towards Calallen and another ramp that heads towards Downtown. I'd like to know where the TxDOT truck was parked, and where Banales veered off the pavement.

I saw the accident yesterday when I was leaving work, and it looked horrible. The entire roof of the mid-size car was destroyed, and I was thinking that driver was seriously injured or killed.

My prayers go out to the TxDOT worker,. I hope he recovers fully. I also hope Judge Banales is doing well.

Maybe now the Judge will know that accidents CAN happen. Hope the TxDot workers pulls out of this with no long-term effects. Because of the media attention I'm sure the Judge will be citing for "failure to control" his vehicle and/or "driver inattention".

Yes, accidents do happen. However when a person makes the choice to get in the drivers seat of a vehicle, while under the influence of alcohol or drugs then thats no accident.

May God be with all involved. I am sure that Judge Banales and his family feel horrible. Come on folks, accidents happen and we have no idea why this one happened.

Maybe he was headed back to work, maybe this or maybe that, but lets wait until the investigation is done.

My son went to school with his daugter and I personally think Judge Banales is a awesome individual. And no I am not hispanic so don't go there. He was very involved with his kids and I think as a judge he is fair.

Some of you all are so stupid. Judge Banales is a fair judge and you all need to give him the benefit of the doubt. He could have been having trouble breathing, having a heart attack or even having a stroke. You all don't know that but you all are just assuming that he was drunk. Instead of being so narrowed minded you all should pray for the TXDOT worker and for Judge Banales as we don't know what actually happened. I like Judge Banales.
I wish this young TX Dot worker well and hopefully a full and speedy recovery.
Maybe the Judge just lost control of his car when he noticed the parked vehicle. Did anyone ever think about that? Remember, Banales is the Judge who is trying to keep your kids safe from sex offenders, so before you go bashing him without knowing the facts, remember, he is a good judge.

Surely authorities administered a breathilizer test to theJudge to allay any future questions by the public about his sobriety. There is no question that a high rate of speed was involved, and there are strict laws regarding caution in work or construction zones. The Judge clearly was the at-fault party to the accident. Judges and Law Enforcement are held to a higher standard than those they serve, so the public will expect a thorough and fair review of his case. In the meantime our wish is for a full and complete recovery by both parties. God be with them.

i hope judge banales ok. what bothers me is how the news reported the story. to me, it seems the main part of the story was all about judge banales being in a car accident. the story should focus on the fact that a person (txdot worker) was almost killed. my heart goes out to the worker's family. it seems that the judge was driving at an unsafe speed. judge banales will have to live the rest of his life knowing he almost killed someone....and that is heavy.

this is pompous judge..it is mandatory to DPS to take a blood draw if there is a death or possiblity of a death in an auto accident..

BANALES IS GETTING AWAY WITH A THIRD CRIME?

Today Maximum Manuel is again trying to slither his way out of yet anothe crime. As we have reported before it is not the first time Banales has been protected. He reportedly failed to control speed while exiting off 37 and hit a young man (34) and knocked he and the vehicle 50 feet. Banales had previously hit a homeless person according to police sources and he refused to exit the vehicle a few years ago, was rumored to have been under the influence of alcohol, called Carlos Valdez to come and rescue him and no charges were filed against him and the homeless man received a civil settlement. In another arrest Banales was reported to have solicited a prostitute and was handcuffed but later released.

Now in the most outrageous coverup the mainstream media was showing him in neckbrace, minimizing the poor young man's serious injury, in fact which may lead to death.

IS BANALES ABOVE THE LAW?
Banales has had a questionable past including representing Biker's on drug charges. Reportedly after getting them off he was given women as presents. Unbelievable. He lost judge elections 3 times and was about to be run out of town until his controller DARREL BARGER a defense attorney who employs all of his children and who has told many an attorney that he controls judge Banales and reportedly Banales pushes all cases aside when this man enters the courtroom. Now he has hit a young man, exiting at a high rate of speed and hit the car and knocked it 50 feet. Can you imagine the high rate of speed that Maximum Manuel Banales was doing? Reportedly, one of the workers had time to move out of the way and the other one didn't have a chance. The media is already circling the wagons and even SHERIFF KAELIN is on message to want people to feel sorry for this man.

How many hispanics have been victim to his maximum treatment and sentencing after he has broken the law now at least 3 times and gotten away with it? The Defenzor consulted with an accident reconstructionist and that expert believes that the look of the vehicles and the high rate of speed well over 50mph that pushed the truck over 50 feet is very suspicious. If they do not charge him with excessive speed, failure to control vehicle and negligent homicide if the boy dies is an injustice and a coverup.

WHY ARE THE WAGONS BEING CIRCLED ALREADY?

Banales is the administrative judge in control of many courts and appointed by Perry (one of the few Democrats, but he also has licked the boots of the King Ranch and Armstrongs for so long (see the Fernandez battle for legitimizing the doctor as the heir of Miflin Kenedy) that he shut down with his good friends Jorge Rangel and Tony Canales. Now Judge Maximum Banales has hit and seriously hurt and possibly murdered a young man and TxDot employee. Justice must finally be served. But, unfortunately, and predictably the Defenzor predicts that the powers that be here will cover and coddle Banales once again. 1) Homeless man seriously hurt 2) hooker solicited 3) and now a reckless driver.

GET THE EVIDENCE FROM BANALES' CADILLAC?
With his fancy Cadillac where is the blackbox on the Cadillac? It can calculate how fast he was going! He was traveling at a high rate of speed, there is no doubt by the look of both vehicles. He was driving reckless and if the boy dies it is a homicide according to one local criminal attorney who wishes to remain nameless and also who corroborated that Darrel Barger bragged about controlling and having influence over Banales.

INDICT BANALES! He is not the victim! The poor man who was working needs to be heard! Where is DPS investigating? This is not his first accident? Where is the D.A. investigation? DO NOT LET A COVERUP OCCUR. THE DEFENZOR feels for the family of the poor man. How dare the mainstream media make Banales the victim here when he caused an accident and was careless and has hurt an innocent man!

Fight for South Texas fortune renewed with ruling

CORPUS CHRISTI, Texas -- The case of an elderly Corpus Christi woman seeking to prove she is the unrecognized daughter John G. Kenedy and heir to a South Texas fortune got a boost with a ruling by the 13th Court of Appeals.

The appellate court overturned a state district judge's ruling that had blocked Ann Fernandez's suit against the two nonprofit organizations that control the 400,000-acre Kenedy Ranch and its considerable mineral assets, the San Antonio Express-News reported Sunday.

"My understanding is we can now pursue the case on behalf of my mom, for her honor and her memory," said Dr. Ray Fernandez, son of Ann Fernandez, 82, who is in a nursing home.

The estate's estimated value is between $500 million and $1 billion.

"They ruled that Ann Fernandez has not had her day in court. Now we will get to demonstrate she was the heir to John G. Kenedy," said Marcos Ronquillo, who represents the Fernandez family.

Lawyers for the John G. and Marie Stella Kenedy Memorial Foundation and the John G. Kenedy Jr. Charitable Trust, which are fighting Fernandez's efforts to prove she is Kenedy's sole heir, did not return calls to the Express-News.

They have said Kenedy's estate was legally closed many decades ago, leaving the parentage issue moot.

When Kenedy died in 1948, he was believed to be sterile and had no known heirs. Fernandez claims he had at least one child with Mary Rowland, a household maid.

Ronquillo expects this ruling to revive a bid to exhume Kenedy's body at the family's La Parra Ranch. The request has been pending at the Texas Supreme Court since it was blocked three years ago.

City signs for border land surveys, adds fuel to fence fire

U.S. Army Corps of Engineers survey markers were placed in Hope Park several months ago. Without the mayor'c consent, the city has granted permission for the government to survey it's land for the border fence.

The government’s demand for permission to conduct their initial surveys had been held at bay for months by organized resistance movements led by border mayors, residents and other elected officials.

That is until last week when city officials signed on the dotted line and stepped aside, allowing the U.S. Army Corps of Engineers to access public land, including city parks near the Rio Grande.

“We didn’t want to risk our relationship with the Corps,” Commissioner Ricardo Longoria said Wednesday. “We’re depending on them for our resaca restoration project. ”

On Jan. 8, the city signed an agreement issued by the Department of Homeland Security allowing the Corps of Engineers onto city properties.

In an Oct. 16 meeting, the City Commission denied Mayor Pat Ahumada’s proposal to refuse access to government surveyors. According to Longoria, this denial constituted a vote to grant consent to the surveyors.

But between the October meeting and the signing of the DHS document, no public vote took place on the issue. City Manager Charlie Cabler said he signed the form in executive session, behind closed doors.

“It is the first I hear of it," City Attorney Jim Goza said Wednesday. "I wasn’t aware that a form had been signed or sent out.”

Goza could not recall a vote to allow access for land surveys and added that officials cannot vote in executive session.

“As far as Charlie (Cabler) signing the form,” Commissioner Leo Garza said, “I don’t remember us voting or authorizing him (to do that).”

The Department of Homeland Security sent a letter on Dec. 7 asking the city for its consent to survey land, but according to city officials, the letter was sent to the wrong address. As a result, officials say, the city didn’t respond until after DHS’ Jan. 6 deadline.

Although the form of consent was only recently signed, commissioners discussed the issue at several commission meetings in late 2007. They claim to have considered the expertise of federal representatives, including U.S. Rep. Solomon Ortiz, D-Corpus Christi.

“We were told that there wasn’t much we could do,” Longoria said. “It was out of our control.”

However, Ortiz claims he offered no such insight. "If I was a landowner I wouldn’t give consent,” he said.

“The city commissioners will have to make the decision on their own.”

Mayor Ahumada was not present at the Jan. 8 closed-door meeting. On Wednesday, he was incensed by the City Commission’s decision. Surveyors will now have access to property at Hope Park, Impala Park, and several other stretches of land that lie in the path of a proposed fence stretching 17 miles in Brownsville.

“We’re only making it easier for them to start this project,” Ahumada said. “Citizens will now be able to blame the commission if they don’t support the fence … We live in a divided city.”

Ahumada is an active member of the Texas Border Coalition, an organization composed largely of elected officials from border communities. The coalition offered to donate $25,000 toward the city’s legal defense, but now that commissioners have given their consent to DHS, Ahumada doubts that the funds will be available.

The Brownsville Public Utilities Board received the same letter from DHS asking for consent, but the board refused. PUB owns 300 acres of land on West 13th Street and another 130 acres in the Southmost area. The 13th Street property is the site of a river pumping station, a power plant, and a water reservoir.

PUB could become a defendant in one of the 102 lawsuits expected to be filed in the fight over a border fence.

On Monday, the Justice Department filed the first of such suits against the city of Eagle Pass. A day later, the judge ordered the city to temporarily turn over land to the federal government.

After land is surveyed, the federal government will begin the process of purchasing property that lies along the path of the fence. If landowners refuse to sell, they will be sued again.

“They have a right to fight the fence,” Congressman Ortiz said, “and that’s what they’re doing.”

As historic figures go, Petra's must have been terrific. Her looks stunned frontiersmen.

And after researching her for years, biographers Jane Clements Monday and Frances Brannen Vick concluded that Petra (1825-1885) was beautiful not merely physically, but spiritually as well. Forever helping friends, kin and her Catholic church, she gave away a wagonload of money to charities way before such acts earned tax credits.

Historian John Henry Brown called her "a woman of superior accomplishments and great natural intelligence." He noted, "She was considered one of the handsomest women of her day."

Indian warriors killed her father, ex-governor of Spanish Texas, and carried off three of her sisters, one of whom was never rescued. After marrying a Mexican army colonel, Petra Vela de Vidal had six children. Widowed, she then married steamboat tycoon Mifflin Kenedy and had six more children. She helped the captain build a ranching empire whose tall bunchgrasses and mesquites adorned oil deposits unknown to them that today are worth untold millions.

A Pennsylvania Quaker who, as a boy, shipped before the mast, Captain Kenedy and another Yankee steamboat captain, Richard King, partnered as tight as bark on a Gulf Coast scrub oak. And, after profitably plying the Rio Grande with their fleet of steamboats, they amicably divvied up the proceeds in 1868.

Mifflin Kenedy had 400,000 acres (in present Kenedy County), next to the 900,000-acre King Ranch. Both captains were business majors of the buccaneer school. Unapologetic wartime profiteers, they got rich moving troops and munitions during the U.S. war with Mexico and running Confederate cotton during the Civil War.

If it weren't footnoted, Petra's Legacy: The South Texas Ranching Empire of Petra Vela and Mifflin Kenedy (Texas A&M Press) might be mistaken for soaring fiction. It is chockablock with crooked politics, cattle rustlers, land fraud, warfare, and enough illicit sex to populate South Texas courtrooms for generations. There were once about 300 claimants to the Kenedy estate.

Mifflin and Petra's aggressive son, James "Spike" Kenedy, drove herds to railheads in Kansas, where he proved a poor loser at the gambling tables.

On July 20, 1872, in Ellsworth, Kan., a gambling dispute erupted into a gunfight between Spike and Print Olive, a Texas rancher and gunman. Both shot-up combatants recovered.

In August 1878, the quarrelsome cards set Spike at odds with Mayor Jim Kelley of Dodge City, Kan. Spike tried to murder him, shooting into his house. His Honor was out, but his sleeping roommate, Dora Hand, a popular singer at the Lady Gay Theater, caught a fatal slug. Maybe being the son of the second-richest cowman in Texas had something to do with Spike's beating the rap.

In April 1884, Spike shot to death a disagreeable, vagrant vaquero at the La Parra Ranch. It was ruled accidental.

Much earlier, Petra's son (Spike's half-brother), Adrian Vidal, who had deserted both the U.S. and Confederate armies, was executed by Imperialists in Mexico, where he had been captured while fighting Emperor Maximilian's troops. The Kenedys' firstborn son, Tom, 35, was killed from ambush in 1888 while campaigning for sheriff in Cameron County.

When the Texas State Historical Association gathers March 5 in Corpus Christi, Petra's biographers will talk about her and the problems facing researchers of women in her time and place. Fran Vick is the association's new president, and former Huntsville Mayor Jane Monday is on the executive board. Historians will find the Kenedys' old La Parra Ranch a short drive down U.S. 77 from Corpus Christi.

An Actuary is a person whose work is to calculate statistically risks, premiums, life expectancies, etc. for the insurance industry and the emerging "bean-counting" approach to risk management in the Corporate Scheme. This "bean-counting" rings clear and is exemplified in the movie "A Class Action" . The central premise of the film is roughly analogous to the controversy surrounding the Ford Pinto and Mustang II.

Durrill v. Ford Motor Company

A rear end collision fire case in which a 1974 Ford Mustang II vehicle exploded into flames. The two occupants of the vehicle, Devary Durrill and Bonnie Watkins, died of burns. The accident happened in Corpus Christi Texas and was tried by Perry & Haas. Watts worked at the Corpus Christi plaintiffs’ firm Perry & Haas, where he trained in vehicle litigation and was involved in numerous suits against Ford.

In the movie "A Class Action" the auto manufacturer utilizes a "bean-counting" approach to risk management, whereby the projections of actuaries for probable deaths and injured car-owners is weighed against the cost of re-tooling and re-manufacturing the car without the defect (exploding gas tanks) with the resulting decision to keep the car as-is to positively benefit short term profitability.

Basically the actuary crunches the numbers and calculates a probability. How many people will die and how many will be injured (if the defect is not corrected) The number of dead and injured are translated into a dollar amount which is weighed against the cost of re-tooling and re-manufacturing the car without the defect. The decision is made and carried out knowing that their product will kill people. They know their decision will take the life of an X number of unknown and unborn heirs to the HELLHOLE of a death trap to be sold as the dealerships assure the consumer that the product is safe.

The Ford Pinto, one of the best-selling cars of the 1970s, had a defective gas tank with an unfortunate tendency to burst into flames in rear-end collisions. Instead of fixing the Pinto, Ford lobbied against federal regulation affecting fuel tank safety. As part of the lobbying effort, the company prepared a cost-benefit analysis. According to Ford's engineers, it would cost $11* per car, or $137 million per year for the industry as a whole, to meet the rollover standard, while avoiding an estimated 180 deaths per year, along with an equal number of serious burn injuries and a few thousand wrecked cars.

Ford's cost-benefit analysis valued those lives at a mere $200,000 apiece. That number was calculated by the National Highway and Traffic Safety Administration at the request of the auto industry, mainly on the basis of lost wages, plus medical and legal costs and a small amount for pain and suffering. At $200,000 per head, 180 deaths are "worth" $36 million, not nearly enough to "justify" a $137 million expenditure. As Ford saw it, spending an extra $11 per car to fix the gas tank just wasn't worth it.
Despite Ford's lobbying, the gas-tank safety regulation was adopted. Ford responded by immediately, and inexpensively, making the 1977 Pinto safer. But the damage to the company's image had been done. The public realized that Ford had knowingly produced a dangerous car, leading to hundreds, perhaps thousands, of preventable deaths. The only way to convince a Corporate Giant is for the cost analysis to favor correcting the defect and the only way to do this is for the cost of a wrongful death to exceed the cost of re-tooling and re-manufacturing the car without the defect.

Yes, in the eyes of those who have not experienced the ordeal of losing a loved one from a defective products such as Ford Pintos exploding upon impact, Firestone tires falling apart in the Texas heat, Chrysler minivans ejecting belted children due to poor door latches, or due to gross neglect by corporate chieftans, countless bad drugs pulled from the market because of no effective regulatory controls at the FDA and pharmaceutical companies decisions to place profits over patient's lives (Rezulin, Baycol, Fen-Phen, Vioxx), old ladies subjected to unnecessary second surgeries to replace tainted hip implants, 40% is a hefty amount to share with a lawyer. On the other hand WATT choice will stop the recurrence of such preventable accidents? No amount of money can ever compensate for the loss of a loved one or for permanent injury?

Is it worth it for someone to pay you 60% of $500 million so they will hold accountable the ones responsible for deciding to burn your daughter alive?

What a superficial column! This is never about anything substantive- never discusses any real political issues. This lady is just a groupie at council and commissioner's meetings, reporting the stupid things they do or say.

The last week of the year is when people are making their final decisions to run for office. Something could have been written about attorneys thinking of challenging the rude Judge Longoria or what happened about possible opponents to Juan Garcia but no she'd rather talk about nonsense. If she wants to learn more about what commissioners are thinking when they dress the same perhaps she can do a series hiding out in each politician's closet and watching and listening to them dress- and the Caller - Times can get someone to deal with the more serious issues.

For someone who proclaims his independence from the White House, U.S. Sen. John Cornyn of Texas can still sound like a cheerleader for President Bush.

Speaking to fellow Republicans in Fort Worth at a presidential straw poll recently, Cornyn staked a claim to re-election next year as a pro-war, anti-tax candidate who expects to match up with voter sentiments in his home state.

He stressed his support for the course Bush has set in Iraq and suggested that voters can rely only on Republicans to extend the tax cuts Bush made in his first term.

Two Democratic Senate hopefuls, San Antonio lawyer Mikal Watts and state Rep. Rick Noriega of Houston, are counting on voters to hold Cornyn accountable for Republican stewardship of Congress in the first four years of his six-year term.

"People will not rehire someone who has had bad plans replaced by more bad plans," Noriega said.

Watts called Cornyn a senator "who parrots exactly what he's told to say by this administration and Karl Rove," the former White House counselor.

Cornyn, who ran in 2002 as part of "Team Bush," said in an August interview that he has been a Bush ally on judicial appointments and the war on terrorism but that he has also parted with his friend on a few issues.

A Cornyn proposal to allow greater access to federal records has cleared the Senate without White House backing. Cornyn also is among senators at odds with the president by proposing to give states alternative ways of complying with the federal education accountability system that Bush started.

Also, he and Sen. Edward Kennedy, D-Mass., are seeking to grant the Food and Drug Administration regulatory authority over tobacco and ingredients including nicotine, a step yet to be endorsed by Bush.

This summer, Cornyn opposed the Bush-favored compromise on changes to immigration policy. The senator unsuccessfully offered an amendment barring felons and other offenders from legal residency.

He later called Bush tone-deaf on the issue. "I don't think he had any real concept of the public engagement on that issue," he said.

In Fort Worth, though, Cornyn said Bush was absolutely right to raise the specter of Vietnam when discussing Democrats' calls for a timed withdrawal of troops from Iraq.

If American forces leave prematurely, Cornyn said, the region will plunge into a humanitarian crisis, and unwatched terrorists will plot attacks. "Unless we get the job done, they will follow us here," he said. "And we've got to make sure that never ever happens again. Not another 9/11, not ever."

His Democratic opponents each noted that as young men, Cornyn and Bush didn't serve in Vietnam.

Noriega, a lieutenant colonel in the Texas National Guard, said, "Comparing Vietnam to the Middle East is like comparing apples to wheat; they are not in the same food group. Differences include geography, terrain, cultures, religion, technology, history of region, just to name a few. This is just another example of the unfortunate circumstance we face when we have leaders who have not walked the walk."

Watts said, "I don't think there is a plan for victory in Iraq. ... We have to stay in the region, but I don't think we should be standing around on street corners getting shot at while we observe someone else's civil war."

On the domestic front, Cornyn charged Democrats with planning not to extend tax cuts enacted at Bush's request starting in 2001. Barring congressional action, cuts of income, capital gains, dividends and other taxes will expire in 2011.

On Capitol Hill, the cuts are rated either Bush's keystone domestic achievement or a gift to the nation's wealthiest residents.

The nonpartisan Congressional Budget Office estimates that extending the tax cuts would cost the government more than $1.8 trillion through 2017.

Tax-cut advocates say such money rightly belongs to taxpayers.

Cornyn's take: Democrats will let into law the biggest tax increase in history.

"They're going to do it without a single vote unless we get the majority back," he said. "They're going to do it because the tax relief that we passed under President Bush back in 2003 will expire unless we make it permanent. And we have to get the majority back and keep taxes low and keep America growing."

Watts said he would review each tax cut one by one but opposes extending cuts for the wealthy as long as government runs a deficit.

Noriega called it "blatantly false" to forecast all the cuts vanishing.

Nationally, 52 percent of voters favored making the tax cuts permanent in a poll conducted this year by Moore Information, an Oregon-based research firm. Thirty-eight percent preferred to let the cuts expire, and 10 percent had no opinion.

Republicans and a plurality of independents supported making the cuts permanent. A majority of Democrats wished to see them expire.

About half of respondents agreed that the cuts should be extended only for households with annual incomes of less than $150,000. About a third of voters favored making the cuts permanent for everyone.

Jason Furman, an economist and senior fellow with the Brookings Institution, an independent research outfit, testified before the House Ways and Means Committee last week that extending the cuts would widen after-tax income gaps between Americans.

Furman said a best-case U.S. Treasury projection suggests an extremely slight impact on the economy, with extended cuts more likely increasing the national debt and reducing government savings.

An eventual need to repay the cuts, he said, would drive down disposable income as taxpayers see cuts in government programs or bumps in taxes to bankroll the cuts, leaving at least three in four households with lower after-tax incomes.

"There is no free lunch because, ultimately, the government faces a budget constraint," Furman said.

Isn't it intriguing that the voting boxes that determined LBJ's election were controlled by a man who worked for the interests that controlled our drug-running railroad in Laredo-- the Tex Mex? Is it the same drug network in Florida that controls those Broward County boxes?

The same man was implicated in the death of the son of a South Texas attorney, alleged to have been killed by Mexican assassins mentioned in the Torbitt Document as having been involved in the Kennedy assassination.

DUVAL COUNTY. Duval County (Q-15) is in south central Texas about fifty miles inland from the Gulf of Mexicoqv and seventy-three miles north of the Rio Grande. It is bordered by Webb, La Salle, McMullen, Live Oak, Jim Wells, Brooks, and Jim Hogg counties. San Diego, the county seat and most populous town, is on the Texas Mexican Railroad at the intersection of State highways 44 and 359 and Farm road 1329, about fifty-two miles west of Corpus Christi and eighty miles east of Laredo.

Duval County's reputation for political corruption peaked with Lyndon B. Johnson's election to the United States Senate in 1948. The famous Box 13, which gave Johnson his eighty-seven-vote victory, was actually in Jim Wells County, but the manipulation of the returns was almost certainly directed by Parr. In the 1900 presidential election Duval County went Republican, but since that time, thanks largely to the efficiency of the Parr machine and the customary tendency of Hispanics to vote for Democrats, the county has delivered majorities to the Democratic party on the order of 94 percent in 1916, 98 percent in 1932, 95 percent in 1936, 96 percent in 1940, 95 percent in 1944, 97 percent in 1948, and 93 percent in 1964. In fact, only once between 1916 and 1972 did the Democratic candidate receive less than 74 percent of the vote in Duval County; that year, 1956, a mere 68 percent voted Democratic. Even after the demise of the Parr machine in 1975 Democrats continued to dominate. The remainder of Parr's political career was highlighted by a seemingly
endless series of spectacular scandals, involving election fraud, graft on
the grand scale, and violence. His most celebrated scheme decided the
outcome of the United States Senate race between Coke R. Stevenson and Lyndon B. Johnson in 1948. With Stevenson the apparent winner, election
officials in Jim Wells County, probably acting on Parr's orders, reported an additional 202 votes for Johnson a week after the primary runoff and provided the future president with his eighty-seven-vote margin of victory for the whole state.

Amid charges of fraud, the voting lists disappeared. Even more sordid controversies followed. As strong challenges from the Freedom party, consisting mainly of World War II veterans, developed in several South Texas counties, including Duval, two critics of Parr's rule and the son of another met violent deaths. While denying Parr's involvement in two of the killings, his biographer, Dudley Lynch, concedes that the evidence against Parr in the shooting of the son of Jacob Floyd, an attorney for the Freedom party, was
both "highly circumstantial" and "highly incriminating."

After this third murder, Governor Allan Shivers, Texas attorney general John Ben Shepperd, and federal authorities launched all-out campaigns to destroy the Parr machine. Investigations of the 1950s produced over 650 indictments against ring members, but Parr survived the indictments and his own conviction for federal mail fraud through a complicated series of dismissals and reversals on appeal. In the face of another legal offensive in the 1970s and a rebellion within his own organization, he finally relented. While appealing a conviction and five-year sentence for federal income tax evasion, the Duke of Duval committed suicide at his ranch, Los Harcones, on

While you can't play "what-if" with any certainty, you have to wonder
whether the area from San Antonio and Corpus Christi south would have known the same emptiness that prevailed in the in-between sections of Tamaulipas, Nuevo León, Coahuila, and Chihuahua if the Anglos hadn't turned their particular talents and drives Valleyward. It started as a land of great
ranches, which in themselves invite sparse settlement, and it might have remained as untaken as the country between Del Rio and Fort Stockton if Colonel Uriah Lott had not perceived that with a railroad, the Valley could become a year-round fruit and vegetable garden for much of the United States.

Lott buttonholed B. F. Yoakum, who at the beginning of the twentieth century sent Captain J. E. Hinckley reconnoitering through the Valley into Mexico to find a way of tapping the riches-almost entirely potential-on either side of the border. He enlisted the irresistible enthusiasm of Theodore Roosevelt, who envisioned a road that would eventually extend all the way through Central America, where he had designs on the Panama Isthmus. Anglo American survey crews came in, built a steel bridge between Brownsville and Matamoros suitable for locomotives or buggies, and began planning other routes that would connect such diverse places geographically as New Orleans, San Antonio, Memphis, and Chicago. Down in Mexico, President Porfirio Diaz, who
welcomed yanqui development (translated sometimes as exploitation), encouraged Yoakum and his cohorts, and even offered to help underwrite the cost. Some of the Anglos backing Yoakum remain memorable names three-quarters of a century after the event-Robert J. Kleberg, Robert Driscoll Sr., John G. Kenedy, Caesar Kleberg, and John J. Welder--to name only a few. On January 12, 1903, they received their charter to do business as the St. Louis, Brownsville, and Mexico Railway, to extend from Sinton to Brownsville, with reticulation of future roads to branch northward and eastward from there.

The foundation of the paper work for connecting the Valley with the United States and Texas had been laid.

Actually, the Anglos had been in the Valley since the period of the War against Mexico. They had been slow to arrive because the area from the Nueces River to the Rio Grande was disputed. Mexico had refused to accept Santa Ana's cession of the region to Texas, which meant that an enormous region in truth belonged to no one. Or worse, to whoever could take and hold it. It would have been comparable to a modern Lebanon except that fortunately it was empty of people.

Then developers brought in the St. Louis, Brownsville, and Mexico Railway. The year was 1903, two decades after Texas had shut down land grants to railroads. No help would come from that source. Rumors of incoming railroads had been spread before, but no rails or locomotives had been seen. But like the neglected maiden who suddenly has three suitors, Brownsville began to be courted by the Southern Pacific and the Frisco-Rock Island, as well as the St. Louis, Brownsville, and Mexico railroads. The town fathers voted to raise a bonus of 12,000 acres on either side of the projected road to the distance of four miles, plus $40,000 in cash, and forty to fifty acres within Brownsville itself for depot grounds plus twenty more acres for shops. The list of endorsers reads like a Who's Who of Texas for the first half of the twentieth century.

Up in St. Louis, another syndicate of almost a hundred business leaders were banding together to see that the railroad got underway. The bulk of the capital would have to come out of Missouri.

Ironically, the railroad that brought in the Yankees and the high-gear economy to the Valley went into receivership in 1913, a condition brought on largely by insufficient freight. Dutch-born Uriah Lott, who had secured the financial assistance of Mifflin
Kenedy and Richard King in the building of the Texas-Mexican Railroad to Laredo, was also hoping to give the Lower Valley the same access to the "outside world." A railroad to the Lower Valley would also give Corpus Christi another rail outlet. In 1889, consequently, Lott received a charter to build the St. Louis, Brownsville and Mexico Railway. A.M. French, chief engineer on the project, ran several different lines to the river, but eventually agreed on a road that would join the Texas-Mexican Railroad some fifteen miles west of Corpus Christi at what is today Robstown. After sod was broken on the line on July 26, 1903, sweaty laborers set out hacking a right-of-way through the brush south toward the Lower Valley. A native of New York and a steamboat pilot and captain by trade, King came from Florida to Texas and the Rio Grande in 1847 for Mexican War service. Commanding the steamboat, Colonel Cross , he served for the War's duration, transporting troops and supplies for the United States Army. He remained on the border after the Mexican War and became a partner in the Brownsville steamboat firms of M. Kenedy & Company (1850-1866) and its successor, King, Kenedy & Company (1866-1874). Between 1862 and 1865 Stillman, King, and Kenedy transported Confederate cotton to Matamoros under contract for payment in gold. Stillman bought much of the cotton and sent it to his textile complex at Monterrey, but he sold even more of it in New York through his mercantile firm, Smith and Dunning. The United States government was a major purchaser. On one sale at Manhattan Stillman netted $18,851 on a gross of $21,504. His cotton buyers in Texas included George W. Brackenridge, and one of his major suppliers was Thomas William House [father of Col. E.M. House]. By the end of the war Stillman was one of the richest men in America. He concentrated his investments in
the National City Bank of New York, which his son James later controlled, and supplied Brackenridge with $200,000 in the 1870s in order to establish the San Antonio National Bank. Stillman married Elizabeth Pamela Goodrich of Wethersfield, Connecticut, on August 17, 1849. He built a notable home in Brownsville in 1850 and lived in Brownsville and New York City until 1866, when he moved permanently to New York. He died there in December 1875. Henrietta King
In 1854, King had married Henrietta Maria Morse Chamberlain, a Presbyterian missionary's daughter. King Ranch Archives describe Henrietta King as mild-mannered with an iron will which carried her through the prolonged absences of her husband. She had been well-schooled, and was known to give polish and luster to her well-known, generous husband. She also proved she had fortitude, when, pregnant with her fifth child, she was present at the Ranch when the Union cavalry raided Rancho de Santa Gertrudis in 1863. Although the family moved to San Antonio following the raid, she moved them back in 1866 to continue the King family's ties to the land.

Upon her husband's death when she was 53, Mrs. King controlled a vast area of South Texas and a business that was immensely successful, but not without problems. She immediately turned to Robert J. Kleberg Sr., a young lawyer who had been involved in the Ranch's legal business for several years. She appointedhim business manager on Jan. 1, 1886; six months later, he became her son-in-law when he married the youngest King daughter, Alice Gertrudis.

Under Mrs. King's and Kleberg's guidance, cross fences were built to divide the sprawling acres into manageable pastures. They embarked on a brush control program. They suffered through South Texas' most crippling natural occurrence, drought. They helped to build the town of Kingsville in 1903-04. And continuing Captain King's prowess in diversifying, the Ranch became involved in banking, lumber, leather goods, newspapers and publishing, retail businesses and dairy farming.

Under her leadership and that of Robert Kleberg, the Ranch's South Texas holdings had grown to 1.2 million acres, 94,000 head of cattle, 4,500 horses and mules, and 1,000 sheep and goats. Estate taxes, operational debt and lawsuits challenging the estate's division caused uncertainty. In her will, she stipulated a 10-year trust to give her heirs time to settle differences and arrange her affairs and assets. Her ultimate goal was to preserve the King Ranch as a single entity according "to my wishes and the wishes and views of my late husband, Captain Richard King."

In response, Alice King Kleberg, Henrietta's youngest daughter and Robert's wife, consolidated much of King Ranch by buying out other heirs. Thus, in 1934, Mrs. Kleberg created King Ranch, Inc., and it was this entity that inherited Alice's part of the Ranch as well as the other property which she had purchased. She sold stock in the new corporation to her five children, and descendants of Robert and Alice Kleberg are the 60-some shareholders of today's King Ranch.

From a Family Business to a Corporate Environment.
The last quarter of the 20th Century has brought further changes to King Ranch. Since 1977, all overseas ranching operations except for that in Brazil was sold. The King Ranch's Corporate History statement credits James H. Clement and his successor John B. Armstrong with guiding the Company to eliminate debt and "...through the difficult Texas business environment of the 1980s and (they) oversaw the painful, and sometimes stormy, transition from a family business enterprise to the present corporate structure with outside directorship and professional management." Since 1988, the King Ranch Chief Executive Officer has not been a King family member, although the corporate board of directors still includes some descendants.

By the early 1970's, King Ranch holdings totaled, worldwide, approximately 11.5 million acres. In 1974, with the death of Bob Kleberg and Dick, Jr., in poor health, the Family selected James H. Clement, Sr., the husband of King's great granddaughter Ida Larkin, as President and CEO. Together with successor John B. Armstrong (husband to King's great granddaughter, Henrietta Larkin), Clement steered the Ranch though the difficult Texas business environment of the 1980's. They also oversaw the transition from a Family business to a modern corporate structure -- based primarily on the

ARMSTRONG - In the brush country south of Sarita, a few miles east of U.S. Highway 77, sophistication and political power have mixed with the independence of Texas pioneers.

Here, 6-foot-4-inch Tobin Armstrong, the descendant of a Texas Ranger and a Yale scholar, and the petite brunette, Anne Armstrong, former U.S. ambassador to Great Britain, hold court.

Guests at the 50,000-acre ranch have included former president George Bush; his son and presidential candidate Gov. George W. Bush, the Rockefellers and Prince Charles.

Armstrong Ranch still is an old-fashioned Texas ranch, run by Tobin Armstrong, who oversees it by Suburban and mobile telephone. A colony of cowboys who live in houses surrounding the big house work the 2,500 Santa Gertrudis cattle while riding thoroughbred horses, the Armstrong version of cow ponies.

"One of the best things about this ranch is that it is a grandchild magnet," said Tobin Armstrong, who has five children and 12 grandchildren, who visit the ranch frequently.

The Armstrong Ranch was purchased in 1852 and settled in 1882 by John Armstrong III, a Texas Ranger from Tennessee. He had come to South Texas to clean up the border and became famous for capturing the notorious outlaw John Wesley Hardin.

His sons combined the sophistication of an East Coast education with the ruggedness of a ranch upbringing. Charlie Armstrong, Tobin Armstrong's father, graduated from Yale in 1908 and returned to South Texas to manage the ranch. Charlie's brother, Tom Armstrong, graduated from Princeton and Harvard Law School before going to work as an executive for Standard Oil Co.

The Armstrongs were instrumental in bringing polo to South Texas, and when Prince Charles came to visit, Tobin arranged a match for him on the ranch's polo field.

"I never rode a bought horse," Armstrong said. "I raised and trained my own thoroughbreds."

Tobin Armstrong was tutored at home until he was 9, when he was sent to private school in San Antonio. He attended the University of Texas and Texas A&M University.

Ties between the Armstrong Ranch and the King Ranch always have been close.

Tobin's older brother, John Armstrong, married the King Ranch's Henrietta Kleberg, and his uncle, Tom, married her mother, Henrietta Kleberg Larkin. John Armstrong was the last family member to serve as president of the King Ranch.

Despite the international circles in which they move, the Armstrongs are still ranchers to the core, talking of weather and rainfall as readily as business and politics.

"Look how green the grass is,'' Anne Armstrong said on a recent hot day. "We haven't had it like this for several years. It will be good for the cattle."

Armstrong, Anne Legendre (1927-...), was the first woman to serve as United States ambassador to Britain. President Gerald R. Ford appointed her to the office, which she held in 1976 and 1977. She had previously been the first woman to hold the Cabinet-level post of counselor to the president. She was named to that position by President Richard M. Nixon in 1972 and served under both Nixon and Ford.

Anne Legendre was born in New Orleans and graduated from Vassar College. She married Tobin Armstrong, a Texas cattle rancher, in 1950. She served as vice chairman of the Texas Republican Party from 1966 to 1968. In 1971 and 1972, she was cochairman of the Republican National Committee. After reading this article i got to believe the author is not familiar with the adversarial process or the article is pure prevarication. Who wants to buy a vehicle without laminated windows. I don't, but in Mikal's argument it was just mental re-enforcement for the jury and he is representing his client with zeal. .In layman terms Laminated glass, which is two layers of plate glass with plastic laminate in between, is used on automotive windshields. It has been used for decades to keep objects from easily getting through the windshield and entering the vehicle. The negative is it prevent easy exit should one need to break the glass in order to escape in a submerged situation or something of that nature.

When an automaker knows there is a faulty product that will "cause a death or two" and they acquiesce, or continue to produce the vehicle with the defective product and they dont recall the defective product for WATT ever reason they need to pay.

Watt if you or your family member purchased a brand new Explorer or Expedition or Excursion. You plan a vacation and plot out your trip planning to stop for the young ones at the rest areas and to stretch the legs and maybe even swap drivers. Everybody has their pillow and their reading material or headphones and music, for the kids you had the video screen and dvd systenm installed and you even went the extra mile and installed a Playstation III for the kids and the kids at heart.

So we are cruising and everyone is commenting on the comfort, the neat features, the enhanced entertainment, and the overall "On The Road" experience the new vehicle provides.

The last thing on their mind is breaking down, needing to check the fluids every few miles, or rolling down the window because the air conditioning dont work. The passengers and the driver feel secure and safe; maybe they dont even buckle up.

The next thing we know the vehicle has become impaired and unstable. The resulting tumbling, sliding, shattering of glass, screaming, and bending of metal that happens in less than a minute (but feels like a lifetime) comes to a rest and there is a eerie silence for a moment. Then the lucky ones can moan in their pain and the silent ones Vaya Con DIOS. How long before the Halo FLight? How long before rescue?

And you come to find out you have lost 1 or 2 or 5 of your loved ones because of something that makes no sense at all.

I am not talking about the Blowout people, I am talking about the decision made by the automaker that your loved ones were just another number, a casualty in the name of profits.

Would you want an advocate fighting for your interests like Mikal Watts fights the giant automakers?

Three college girls are driving cross-country pulling a U-Haul trailer while simultaneously sharing a bag of marijuana. About 20 hours into the voyage, the driver brakes hard on a hill and loses control, sending the car off the side of the road.

They weren't wearing seat belts.

Was she high? Fatigued? Did she forget that breaking hard on a downslope while pulling a fully-stuffed U-Haul is a big no-no?

Whatever. Represented by Corpus Christi plaintiff's lawyer Mikal Watts in a suburban Houston courtroom, she demanded millions in damages over the accident-- from a tire maker.

No matter that Texas state investigators blamed the wreck on driver error and speeding, concluding the tires remained intact after the crash and worked just fine. Still, Watts argued they were wrong, that it wasn't her fault. He even demanded the judge declare a mistrial when the defense had the nerve to raise the girl's driving-while-pot smoking in court.

Is this the kind of guy-- one who would make such a specious, if self-serving, argument with a straight face-- that we want representing Texas in the U.S. Senate?

Mr. Watts, a 39-year-old mega-millionaire and judge's son who flies private, is traveling the state this summer, raising money and straining to re-define himself as a populist "everyman" in preparation for the Spring 2008 Democrat primary election.

He made his bones making arguments like the aforementioned, suing automakers and other businesses. But suffice to say, he won't be bragging on the campaign trail about the "marijuana mistrial" or his lawsuit blaming Ford for an accident in which the driver was speeding, had been drinking and wasn't wearing a seat belt.

The automaker was at fault because, according to Watts, it didn't laminate its side windows.

Watts will also remain mum about the embarrassing hiccup in that Ford case-- when it was revealed mid-trial that one of his associate lawyers was dating one of the jurors. She had even helped him "recruit" two of the plaintiffs for Watts, evidence showed.

Apparently under no ethical obligation to tell the court about this, Watts remained quiet and steadfast. It paid off-- he won a $31 million verdict.

"Mikal Watts has spent his entire career fighting on behalf of average, working Texans," promised his spokesman in a recent interview.

Don't believe it just because he says so.

"Mr. Benitez is one of those instructors who are there for students," Camacho said. "I have never seen him turn a student away."

Rangers join search for suspect

Law officers seek man suspected in shooting of Del Mar instructor

As Texas Rangers join the investigation of the shooting of a Del Mar College criminal justice instructor Saturday, the college community is struggling to understand how the former U.S. Border Patrol agent became a victim of a violent crime in his remote Kleberg County home.

Albert Benitez, the Del Mar College criminal justice instructor who was shot several times in the stomach at his home Saturday morning, was in critical, but stable condition Monday at Christus Spohn Hospital Memorial, Kleberg County investigators reported Monday.

Kleberg County Capt. Rick Torres said sheriff's department investigators are working with the Texas Rangers to find the suspect. Investigators have not found the gun used to shoot Benitez.

Benitez was shot several times after a man broke into his home on County Road 2130 outside of Ricardo in Kleberg County around 7 a.m. Saturday, the Kleberg County Sheriff's Office reported. The intruder then kidnapped Benitez's girlfriend and took a green Ford Crown Victoria that was parked at the home, investigators said in a statement issued Saturday. Investigators are not releasing the woman's name.

No arrests have been made in connection with the shooting and kidnapping, Torres said.

Benitez, a faculty member since January 2001, is a former U.S. Border Patrol agent. He graduated from Texas A&M University-Corpus Christi with a master's degree in public administration in 2000.

Del Mar College students, faculty and officials were shocked to learn that Benitez was a victim of a violent crime.

"It's a tragedy when it happens to anyone, especially when it happens to faculty," said Gabe Rivas, Del Mar College regent. "It's ironic that it happened to someone in law enforcement."

John Graham, a Del Mar College criminal justice instructor who worked with Benitez while Benitez was a graduate student and later as a colleague, said the Del Mar College community is stunned and eager for his recovery.

"I don't get it. I don't understand it," Graham said, who added that he has not been able to sleep the past two days.

"I want the perpetrator or perpetrators captured, and I want him back in the classroom 100 percent well," he said.

Donna Strong, an instructor who teaches classes with both the English and criminal justice departments, said Benitez goes the extra mile for students and applies his experience as a former Border Patrol agent to his lessons.

"The students just adore him," Strong said.

Suzi Camacho, a Del Mar College criminal justice student, said she and other students were saddened to learn of Benitez's condition.

"We're very shocked and sad, but he's a fighter." Camacho said. "I know he is going to survive this."

Camacho also said Benitez was dedicated to his students.

"Mr. Benitez is one of those instructors who are there for students," Camacho said. "I have never seen him turn a student away."

The woman who was kidnapped told police the shooting suspect jumped from her car at the intersection of U.S. Highway 77 and Caesar Avenue in Kingsville. Saturday morning, local law enforcement agencies began a manhunt for the suspect, who they described as a Hispanic man dressed all in black.

Students, criminal justice instructors and friends described Benitez as a man dedicated to his family's tradition in law enforcement. Benitez's father, Tony Benitez, is a retired Kingsville police officer.

"He was born and bred in law enforcement," said Kingsville Mayor Phil Esquivel, who grew up with Benitez and his family.

COMMENTARY:
On the July 25, 2007, Glenn Beck Show on CNN Headline News, Rep. Dana Rohrabacher revealed documents he received that the Department of Homeland Security and U.S. attorney's office tried hard to keep him from having. The documents show the number of border passes given to Osbaldo Aldrete-Davila, the drug smuggler in the Ramos and Compean Border Patrol agents case and when the passes were issued.
The documents point out that two drug deals had taken place when Mr. Davila used his border passes. The second time he was issued his pass, the Department of Justice had already been notified by the DEA that he had been involved in a drug shipment, but the pass was still issued to him. Rep. Rohrabacher contends that this evidence and more about the star prosecution witness had been kept from the jury, which resulted in Agents Ramos and Compean being found guilty and sentenced to jail.
The Congressman also claims he contacted the White House and tried to defuse the situation by asking the President to ask the judge to let the wrongly convicted agents out on bail or bond, pending their appeal. The White House initially told him that it was a "great idea," but the next day the White House issued a press release stating they were opposed to letting them out on bail and never followed up with the congressman.
Sam Antonio, National Immigration Spokesman for the John Birch Society, was also a guest on the July 25th show. Mr. Antonio pointed to the case to a general demoralizing of the very thinly spread U.S. Border Patrol and linked the Security and Prosperity Partnership (SPP) President Bush had agreed to with Canada and Mexico in 2005 as the reason why the southern border is not being enforced. According to Mr. Antonio, Mexico's participation in the SPP is permitting it to influence U.S. border enforcement.
Of course, President Bush commuted Scooter Libby's sentence because he thought the 30-month jail sentence was "excessive." Weigh that against two Border Patrol agents doing their job and getting into a paperwork SNAFU that costs them 11 to 12 years of their lives.
Even Democratic Senator Dianne Feinstein and Republican Senator John Cornyn of the Senate Judiciary Committee consider this excessive ... shouldn't the President?

Cornyn wasn’t counting on a spending contest. With a united effort we will attract the Democratic Right & the Republican Left. The aggressive Progressives will need to moderate a bit in order for it to happen. Even when we go after Cornyn, we need to be reasonable. Quit calling them Republicans, they are carpet baggers. We don’t need to over exaggerate their faults and go on and on. Just point out the facts. To say it with a severely postured rhetoric accomplishes not a thing except it compromises credibility and objectivity and those attributes we need to solidly establish to overrun this Carpet Bagger Machine. The Carpet Baggers are over compensating as well. We accomplish nothing by being disingenuous, it is time to trim down where we take issue to our strongest points and make it where we dont sound the alarm everytime a Carpet Bagger druels on himself. Right now both sides are making a lot of chatter accomplishing nothing. Chose your battles to be the most important and influential battles that we can win in the eyes of the average citizen seated at the middle right. Quit harping about the religious and far right and let’s sell them WATT we believe in within reason. When we speak make it short and if they dont agree move on. Let get our Candidates to make a contract with the people of Texas. A Carpet Bagger is incapable of this kind of commitment.

Our strengths and we exploit their weaknesses.

And the stonewalling conservatives will need to step up the pace a little. Time for some of the compromises to come from the right side of the party.

boadicea, The Democratic Part I agree needs to be redefined But not farther to the Left. We need to engulf and engage the average citizen. Litmus test on abortion is not a defining element of a Democrat. Maybe for a progressive. The Voting Record can only tell us how they voted it give us no insight on why. Many times you need to barter and trade out according to priorities. In the Case of Cornyn look at his interaction with Solomon Ortiz Sr and the non voting record of Ortiz. Ortiz influences from underneath and he works with infamous Carpet Baggers like Randy & Tom Delay, Cornyn, not Kay Bailey. The reason we call em Carpet Baggers is by calling them by their legitimate name is promoting in nature.

Right now we need to work together to include the Progressive within the Party but when it comes to Democratic Policy we need to present reasonable parameters. Who cares if I kicked the incumbent or a candidate who is going to win, if I kick him a grand or two. I am donating to him for his consideration and his ear. That does not mean I dictate policy to him but that he will give me the chance to convince him to adopt some or none of what I believe in.

Watt are your top three issues when choosing a candidate in the Democratic primary.
