We resent the Suffering, Injustice and Violence in our society, and observe that the unrighteous often seem to prosper while the finest people we know seem to suffer unfairly.

He made it clear in the letter to the Romans that even if we have never read a Bible, listened to a sermon, or heard the name of Jesus, Moses, or Isaiah, we should still know GOD through the awareness of what has been created and the apparent miracles that surround us. - Jimmy Carter

1932: 9 Banks Absolved Of $2,842,616 Claim In Harriman Case

Government Suit to Collect on 1932 Guarantee of Deposits Dismissed by Shientag.

‘CONTRACT’ HELD INVALID

Power of Executives to Bind Institutions Without Assent of Directors is Denied.

SETTLEMENT BY 11 STANDS

$3,592,943 Paid by Others in Clearing House is Viewed as Legally Required.

A government suit in equity to recover $2,842,616 from nine member banks of the New York Clearing House to complete the payment of depositors in the closed Harriman National Bank was dismissed here yesterday in the State Supreme Court by Justice Bernard L. Shientag.

In a 12,000-word decision, he found the government had proved its case at every point except one.

“All the essentials of a valid contract were present,” he found reviewing the informal guaranty of $16,000,000 Harriman deposits given to the government in 1932 by the Clearing House Committee to keep

The then insolvent bank open lest a failure at that critical time affect the whole banking structure.

The one element that defeated recovery for the Harriman depositors, Justice Shientag decided, was the failure of the bank presidents who negotiated the guaranty to submit it to their boards of directors.

Bank Presidents Criticized

In a long and emphatic section of his opinion he then criticized bank presidents for forgetting that the directors are really the bank, while the president legally is only a person of small authority who often forgets that “assumed power is a dangerous base for important dealings.”

“There is a tendency on the part of the executive officers of large banking institutions to exercise an attitude of proprietorship with respect to the banks they represent,” Justice Shientag wrote. “That is not a practice to which the court should lend its sanction, particularly in an unusual situation such as is here presented.

The conception of ‘nominal director’ has been rejected by the courts. It would be inconsistent to hold directors to this measure of responsibility and at the same time permit executive officers of the institution, acting without express or implied authority, to enter into engagements of the character we are here considering.

“Probably no one who participated in these transactions can now indulge in comfortable reflections on what took place. Many things were done in a loose, casual, un-orderly fashion. This court is called upon to determine the issues in accordance with established legal principles.

“Perhaps the correct interpretation of what occurred is that indicated by Buckner (Mortimer N. Buckner, chairman of the New York Trust Company and then president of the Clearing House), whose sincerity is evident, who said: “There are a number of us who recognize a moral commitment and the question is now whether we will stay by our pro rata share of the loss and let those who don’t want to recognize it stay out.”

Government Appeal Expected: Justice Shientag’s decision relieving the nine banks of the $2,842,616.

Mr. Tom Kelly, was ready with shovel in hand first thing this morning helping to clear away a pathway that leads to his favorite Tavern. He told me he would like to have a pair of sunglasses like mine and I told him that I would be happy to provide them and would drop them off at the Buzzards Bay Tavern which is located on Main Street in the Village of Buzzards Bay. I was finally able to check his sneaker size. A 10 and half wide if someone would like to donate and drop off a pair of sneakers. He seems to trust the owners of the Tavern in their duty of making sure that if an item was brought in, it would be delivered to him personally.

Mr. Tom Kelly is a 62 year old elderly man who just celebrated his birthday on November 9th. He did attend the Homeless for the Holidays event that just recently passed where he was offered warmth, food, and drink during the four day ongoing Food/Toy and Cash fund raising session.

Massachusetts: It is not very much harder to be nice to people than it is to be mean to people. This is only a short version of the interesting conversation that Mr. Tom Kelly and I shared this morning when I found him sitting on a chair at the front entrance of the Buzzards Bay Tavern where he is working on litter control. He could use a new winter coat. He is down to one glove and most likely could use a new pair of sneakers. He did mention that his right foot has been giving him a problem as of late and some of those heated hand and foot warmers would be nice. He currently sleeps in a camper with no heat, running water or electrical service. He told me where it is located but doesn't want anyone else to know. We discussed the sun being his main source of "Solar Energy" for the time being.

Tom Kelly By Ana Paulina

12, 2009

When I dropped in to check on the outcome status of the Homeless for the Holidays event, I noticed this elderly gentleman huddled over a metal drum of open flames, who just happen to trigger an earlier reflex memory in previous months, where I found him sprawled out on a flower bed over by a traffic Rotary.

Mr. Tom Kelly, holding a cup of water.

Q: What’s your name?

A: "Tom Kelly"

Q: Where are you from Mr. Kelly?

A: "The mid-Atlantic."

Q:The Mid-Atlantic?

A: “Yes, and New York, hitched my way here ( Cape Cod ) and this is where they knocked me off ( Bourne ) I love being near the water, have been watching the ships roll by for the last twenty years.”

Q: Do you have any family?
A: “I don’t know.”

Tom, it’s cold out.
A: “I know, I don’t have my winter gear on yet.”

Q: Have you sought out help?

A: “I like the nip bottles, I can’t give it up.” I try but it’s hard.”

Mr. Tom Kelly, has been living on the streets of Bourne for the last twenty years.

Our conversation was soon interrupted by the arrival of some noodles and chicken followed by the offering of a safe and warm place to spend the night by property owner Mr. Fred Carbone of the Bay Motor Inn, located in the Business District of Bourne. . Feeling comfortable with the idea, I soon left Mr. Tom Kelly to enjoy his meal in peace for the night.
