mso-ascii-theme-font: minor-latin; mso-hansi-font-family: Calibri; mso-hansi-theme-font: minor-latin;">وأكد وزير العمل الأردنى الدكتور ماهر الواكد فى تصريح صحفى اليوم "الأحد" ضرورة احترام التعليمات والإجراءات المتبعة من قبل فرق التفتيش وإظهار الوجه الحضارى للأردن. وقال إن فرق التفتيش ستقوم باتخاذ الإجراءات القانونية اللازمة بحق المخالفين فوراً وهى الغرامة المالية على صاحب العمل الذى يثبت مخالفته لأحكام المادة الثامنة من قانون العمل وتعديلاته والتى تتراوح ما بين 200 الى 500 دينار وتسفير العامل إلى بلده وعدم تمكينه من العودة للعمل فى الأردن إلا بعد مضى ثلاث سنوات. font-size: large; line-height: 115%; mso-ascii-font-family: Calibri; mso-ascii-theme-font: minor-latin; mso-hansi-font-family: Calibri; mso-hansi-theme-font: minor-latin;">ويذكر أن الوزارة نظمت فترة تصويب أوضاع للعمالة الوافدة استمرت أكثر من شهر بهدف تنظيم سوق العمل وإيجاد قاعدة بيانات دقيقة وواضحة لحجم العمالة الوافدة داخل البلاد ولحماية حقوق العمال وأصحاب الأعمال. وصوب حوالى 30 ألف عامل وعاملة من مختلف الجنسيات غير المقيدة بالإقامة معظمهم من المصريين أوضاعهم القانونية بموجب التعليمات التى صدرت لإفساح المجال أمام الراغبين من العمال وأصحاب الأعمال المخالفين لأحكام القانون لتصويب أوضاعهم القانونية، كما عملت الوزارة على إلغاء قرارات الإبعاد الصادرة بحق حوالى 100 عامل وافد بعد استكمال الإجراءات الخاصة بذلك واستيفاء الرسوم المقررة من قبل الوزارة. وسوف تبدأ وزارة العمل الأردنية اعتبارا من الأول من شهر إبريل المقبل بتطبيق نظام الخروج والعودة للعمالة الوافدة. <o:p></o:p></span></div> <div class="MsoNormal" dir="RTL"> <span lang="AR-SA" style="font-family: Arial, Helvetica, sans-serif; font-size: large; line-height: 115%; mso-ascii-font-family: Calibri; mso-ascii-theme-font: minor-latin; mso-hansi-font-family: Calibri; mso-hansi-theme-font: minor-latin;">واعتمدت الوزارة عددا من الأسس بهدف تطبيق نظام الخروج والعودة الذى سيباشر بتطبيقة الشهر القادم وتتضمن العمال الوافدين الذين لا يحملون تصاريح عمل سارية المفعول أو انتهت تصاريح عملهم قبل 19 فبراير 2012 أو لا يوجد لديهم أى قيود فى نظام الاستخدام فى الوزارة يتوجب عليهم مراجعة اقرب مديرية عمل لمكان إقامتهم للحصول على نماذج المغادرة دون الحاجة لوجود كفيل أو صاحب عمل. أما العمال الوافدون الحاصلون على تصاريح عمل تنتهى بعد تاريخ 18 مارس 2012 فعليهم مراجعة المديرية التى أصدرت تصاريح العمل التى بحوزتهم وبرفقة صاحب العمل أو من ينوب عنه بموجب تفويض رسمى وذلك لتوقيع نموذج المخالصة النهائية فى حال رغب العامل بمغادرة البلاد نهائياً أو نموذج الإجازة إذا رغب بالعودة إلى عملة بعد انقضاء إجازته التى تم الاتفاق عليها مع صاحب العمل وبموافقة مدير مديرية العمل، </span></div> <div class="MsoNormal" dir="RTL"> <span style="font-family: Arial, Helvetica, sans-serif; font-size: large; line-height: 115%;">بحيث تكون مدتها بما لا يزيد عن 60 يوماً للعمال الوافدين العاملين فى كافة القطاعات باستثناء قطاع الزراعة وبما لا يزيد عن 120 يوماً للعمال الوافدين العاملين فى قطاع الزراعة. ولا يسمح للعامل الوافد دخول البلاد بعد انقضاء المدة المحددة بالإجازة الممنوحة له.أما بخصوص الحالات الخاصة التى لا تنطبق عليها الشروط المبينة، </span></div> <div class="MsoNormal" dir="RTL"> <span style="font-family: Arial, Helvetica, sans-serif; line-height: 32px; text-align: justify;">واستثنت الإجراءات من ذلك العامل الوافد الذي مضى على التبليغ عن تغيبه أكثر من 15 يوما، والعامل الوافد الذي طلب نقل خدمته تحت الدراسة والعامل الوافد الذي صدر له تأشيرة خروج نهائي.</span><span style="font-family: 'Droid Arabic kufi', arial; line-height: 32px; text-align: justify;">يشار إلى أن نقل خدمات القوى العاملة الوافدة بين الكيانات التابعة لمنشآت مختلفة تتضمن عدة إجراءات، منها ألا يتسبب نقل الخدمة في نزول الكيان المنقول إليه دون النطاق الأخضر المنخفض، وأن يؤخذ في الاعتبار التأشيرات السارية الممنوحة سابقا التي لم تستخدم أو استخدمت ولم تصل العمالة الوافدة التي تم استخدام التأشيرة لاستقدامها والعمالة المتعاقد على استئجارها، من شركات تأجير العمالة المرخصة، التي لم تبدأ عملها لدى المستأجر عند حساب حق الكيان في طلب نقل خدمات عمالة وافدة.</span></span></h4> </div> <div> <span style="font-size: medium;"><span style="font-family: 'Droid Arabic kufi', arial;
