“Public comments were previously requested via the Federal Register on December 19, 2025, during a 60-day comment period. This notice allows for an additional 30 days for public comments.”

In 2027, the FRN notes, the Bureau “plans to introduce an internet self-response option to the Puerto Rico Community Survey (PRCS) data collection operation. The Census Bureau believes there is value in offering an internet self-response option to households and people living in certain types of group quarters—college/university student housing, group homes, military barracks, workers’ group living quarters, and emergency and transitional shelters in Puerto Rico.”

The FRN further explains the contact strategies for the ACS and PRCS for housing units and group quarters.

However, something else is missing from the FRN. In the original FRN in December 2025, the Census Bureau proposed revising the ACS race and ethnicity questions starting in 2027, to comply with OMB Statistical Policy Directive 15 (SPD 15) that requires a combined race and ethnicity question with a new Middle Eastern and North African (MENA) category and collection of detailed subgroup data whenever possible. Stakeholders have flagged the lack of any mention of the issue one way or another, and anyone interested in SPD 15 should consider filing comments.

“An essential component of planning for the constitutionally-required 2030 Census is planning for operations that ensure a complete and accurate address frame, including housing units that may be hard to identify or locate. Secondary units, commonly known as Accessory Dwelling Units (ADUs), are smaller self-contained, attached or detached, residential units that are located on a property with the main house. To enumerate people living in secondary units, which are not always represented on publicly available or U.S. Postal Service address lists, the 2030 Census will rely on a multifaceted approach involving address frame maintenance, enumeration methods through self-response and in-field data collection, and public promotion and outreach with local organizations. The 2026 Locate Address Test for Accessory Dwelling Units (LAT ADU) was designed to assess the feasibility of obtaining ADU addresses through local government partnerships and to identify potential challenges with locating ADUs during in-field census enumeration activities. The results will help refine strategies for the 2030 Census Local Update of Census Addresses (LUCA) operation, an address partnership program established by Congress through the enactment of Public Law 103-430 (The Census Address List Improvement Act of 1994), and the In-Field Enumeration (IFE) operation, a field activity that collects census responses in person.”

The LAT ADU local government outreach was run last year and the “field activity to locate and classify the ADUs will occur in September 2026… within a 25-mile radius of Census Bureau facilities in Suitland, Maryland and Jeffersonville, Indiana.”

The update, which tracks population changes from 2001 through 2025, also shows a narrowing gap between men and women in older age groups. In 2001, there were about 70.6 men for every 100 women age 65 and older. By 2025, that number increased to 81.6.

The high court found that the amendment itself was flawed because lawmakers approved the proposal after voting had already started in the 2025 House of Delegates elections, depriving more than 1.3 million Virginians of an opportunity to weigh the issue when choosing their representatives.

White House Budget Request

The White House released its Fiscal Year 2027 budget request for the Census Bureau at the beginning of April. The Trump Administration requested $2.01 billion for the U.S. Census Bureau in Fiscal Year (FY) 2027, which is $536.15 million more than the agency’s FY 2026 enacted funding level. Breaking the overall request down into the two accounts that fund the Bureau, the Current Surveys and Programs account would receive $288.5 million (approximately $31 million below its FY 2026 level), while the Periodic Census and Programs account would receive $1.723 billion (approximately $46 million above its FY 2026 level).

On April 22 and April 23, Commerce Secretary Howard Lutnick testified before the Senate and House Commerce, Justice, Science Appropriations Subcommittees, answering questions about the Department’s proposed FY 2027 budget. During the Senate hearing, Senator Brian Schatz (D-HI) asked Secretary Lutnick about the use of postal carriers as enumerators in the 2026 Census Test.

Late in April, the Administration shared a Congressional Justification with full details of the Census Bureau budget request. The Census Project’s summary shared key details, including one piece surprisingly missing: a communications and outreach contract for the 2030 Census.

U.S. House funding bill advances

The House Commerce, Justice, Science Appropriations Subcommittee approved its version of the FY 2027 Commerce, Justice Science Appropriations bill on April 30, 2026, by an 8-6 party-line vote. The bill will be considered by the full House Appropriations Committee on May 13.

As noted in a statement from The Census Project, “The bill recommends that the Census Bureau receive $1.49 billion in FY 2027, an amount equal to what the agency received in FY 2026. This funding level is approximately $521 million below the Administration’s request, $2.01 billion, and even farther below the funding level, $2.11 billion, that was endorsed by 85 members of The Census Project and 44 bipartisan members of the U.S. House of Representatives.”

Further, The Census Project’s statement noted concerns that, “once again, the Subcommittee has included language in its bill, Section 579, that would preclude the Census Bureau from enforcing the mandatory response requirement of the decennial census and ACS, while also limiting the Bureau to no more than two follow up inquiries across all of its surveys. This provision, which Congress has rejected twice before, would have a devastating impact on the decennial census, which historically has had to send more than two invitations to self-respond in order to count more than half of U.S. households. Likewise, the provision would undermine coverage in the ACS and the Current Population Survey, which require more than 3 and approximately 2.5 follow-up contacts, respectively. Major business, economic, and demographic surveys that have multiple follow-up contact strategies would likewise be adversely impacted, which is why the business community has expressed opposition to this language in the past. Given the adverse impact this provision would have on data quality overall, The Census Project hopes Section 579 will be removed as the CJS bill proceeds.”

U.S. Senate

While the Senate has not yet shared when it will consider FY 2027 appropriations legislation, 21 Senators sent a Dear Colleague letter on April 14, 2026 reflecting the funding recommendation from The Census Project, highlighting concerns about preparations for the 2030 Census and sustaining and enhancing the American Community Survey (ACS) in their call for making “the Census Bureau a high priority.”

Policy Update

April Standard Deviations Blog Features Report on Federal SOGI Data Landscape

The Census Project shared a Standard Deviations blog, “Demystifying Data Privacy: Understanding the Privacy Act of 1974”, from the Association of Public Data Users (APDU). The APDU authors wrote about privacy in federal data and resources APDU is working to provide to “help policymakers, researchers, advocates, and the public better understand the mechanics of the Privacy Act, the rights it conveys, and the obligations it  imposes on federal agencies to collect, manage, and disclose personal information responsibly.”

The Census Project sponsors the Standard Deviations series to provide census stakeholders with an opportunity to share their news and views (not necessarily endorsed by The Census Project).

Make It Count Act (H.R. 7167)

Rep. Tom Barrett (R-MI-07) introduced the Make It Count Act (H.R. 7167), legislation that would add a citizenship and immigration status question to the decennial census, require congressional apportionment to be based only on a count of U.S. citizens, and only allow states to carry out a single congressional redistricting in the decade following a decennial census and apportionment. A New Roadmap to 2030 Census Organizing

The Census Counts campaign recently released a new Roadmap to 2030 Resource Guide, “a practical, action-oriented tool designed to help organizations, advocates, and local leaders prepare for the next decade of census engagement.”

Requests for Public Comments

In April, The Census Project highlighted several requests for public comments that may be of interest to census stakeholders:

• The Bureau requested comments on the Survey of State Government Research and Development (SGRD) by May 1, 2026, following an earlier Federal Register Notice in November. The agency proposes to extend the survey without any changes.
• The U.S. Census Bureau requested public comment on revisions to the National Survey of Children’s Health (NSCH) by April 25, 2026. This is a follow-up from a prior Federal Register Notice in December.

Census Bureau Releases

The Bureau released new Business Formation Statistics (BFS) for March 2026.

The U.S. Census Bureau released a downloadable file containing estimates of the nation’s resident population by single year of age and sex as of July 1, 2025.

The U.S. Census Bureau released a series of data tables of the most common first and last names reported in the 2020 Census.

The Bureau released new tables and files containing detailed data from its 2025 Annual Survey of State Government Tax Collections (STC), including taxes imposed and collected by state governments and the District of Columbia. These data cover five broad tax categories and up to 25 tax subcategories.

The U.S. Census Bureau released a new summary report and data tables for the 2025 Annual Survey of Public Employment & Payroll (ASPEP). These statistics provide a comprehensive look at the employment of the nation’s state and local governments.

The U.S. Census Bureau released new data products from the Business Trends and Outlook Survey (BTOS), a survey that measures business conditions and projections on an ongoing basis, on April 9 and April 23, 2026.

The U.S. Census Bureau released new data on employment, food sufficiency, housing status, difficulty of paying usual household expenses, use of Artificial Intelligence (AI), and other topics from the Household Trends and Outlook Pulse Survey (HTOPS) on April 23.

The U.S. Census Bureau announced it will offer a two-day embargo period for qualified media to view the Vintage 2025 population estimates for local governmental units, including incorporated places, minor civil divisions and consolidated cities, and national, state and county housing unit estimates.

The key piece missing from the justification appears to be a communications and outreach contract for the 2030 Census (discussed farther down in the analysis).

Among the highlights from the justification:

• “The President’s Budget also proposes to reorganize the Bureau of Labor Statistics (BLS), Bureau of Economic Analysis, and the Census Bureau at the Department of Congress.”
• “The FY 2027 request for the Census Bureau is $2.012 billion. Major activities that would be funded by the budget request include: 2030 Census  (Total Funding $1.072 billion BA/Obl. and 1,874 FTE/2,264 Positions; Program Change +$497.5 million and +495 FTE/+529 Positions). The 2030 Census is not just a constitutional mandate—it’s a foundational pillar of American governance that underpins critical functions of government, economic planning, and equitable resource distribution.”

• “The 2030 Census Program has a 15-year lifecycle. As a result, the 2030 Census activities are planned and conducted in four phases, beginning with Early Planning (FY 2019 – FY 2021), followed by Design Selection (FY 2022 – FY 2024), Development and Integration (FY2025 – FY 2029), and Peak Production and Closeout (FY 2029 – FY 2033). The maturation of the 2030 Census IT and non-IT solutions is an iterative process which will evolve through additional design work and testing.”
• “At the base FY 2027 funding level, the Census Bureau could only focus on 2030 Census preparations necessary to ensure timely delivery of statutorily required apportionment totals to the President and redistricting data to the states at an acceptable quality level.”
• “The American Community Survey (ACS) furthers the Census Bureau’s mission to serve as the leading source of quality data about the Nation’s people and economy by providing current demographic, social, economic, and housing information about all America’s communities, from the largest cities to the small rural communities.”
• “Base Program: The ACS is the premier source of social, demographic, economic, and housing information for the nation, states, counties, cities, and towns. Information from the survey generates data that help determine how trillions in Federal and state funds are distributed each year. The data help policymakers to make informed decisions on where to locate schools, hospitals, and services and for business leaders to accurately target their customer base, find new markets, or identify population centers that could meet their hiring needs. When people fill out the ACS form, they are helping to ensure that decisions about the future of their community can be made using accurate and current data. Decision-makers require a clear picture of their population so that scarce resources can be allocated efficiently and effectively.”

2030 Census Communications Contract: As mentioned above, the FY2027 justification is silent on the issue or an outreach plan, partnership program, or communications contract for the 2030. By contrast, the FY 2017 Congressional Justification had much to say about a contract that had already been awarded, with a section titled “Optimizing Self Response.” Per the FY 2017 document:

• “The goal of Optimizing Self-Response is to communicate the importance of the 2020 Census to the United States population and generate the largest possible self-response, minimizing the need to conduct expensive in-person follow up with those households. The Census Bureau plans to incorporate the use of technology as well as a communications campaign to engage and encourage the use of the Internet as the primary response mode. The campaign will provide information to government agencies, host events at community, recreation, and faith-based organizations, and publicize the tests through radio advertising and social media. Additionally, we will allow respondents to submit a questionnaire without a unique identification code to encourage and motivate the population to self-respond. These design changes have the potential to save the Census Bureau an estimated $400 million.”
• “During FY 2016, the Census Bureau begins preparatory work for the 2020 Communications and Partnership Program. This program designs the communications and partnership plan for the 2020 Census. This includes preparation for the maintenance of an external 2020 Census website. A large focus of developing the partnership program includes consultations with external stakeholders to elicit a wide range of options and strategies for gaining their support in communicating the importance of the 2020 Census to the public. We continue tribal consultations in FY 2016 with the 566 federally recognized tribes. Finally, the program provides plans to test the impact of different communications methods to support self-response. In FY 2017, we will begin planning the 2020 Census Communications and Partnership Programs. We will build a partnership database in 2017 and begin planning all components of the 2020 Census  Integrated Communications Campaign, including the strategy during the end-to-end test in 2018. One major component includes development of the audience segmentation model and the advertising campaign The Census Bureau is on track to award the Integrated Communications Contract this year (a year earlier than for the 2010 Census). However, developing the overall campaign plan and research to develop a robust audience segmentation model requires significant time and resources. Time and resources that may mean less contractor support for the 2018 End-to-End Test in order to ensure readiness for the 2020 Census.”

The April 21, 2026 stakeholder sign-on letter to the House and Senate Commerce Justice Science Appropriations Subcommittee chairs and ranking members highlighted concerns about 2030 Census preparation and maintaining and improving the American Community Survey (ACS). The letter noted that the funding request “would enable the Census Bureau” to “also pursue other necessary and worthy data collection and dissemination innovations across its other surveys and programs,” such as the Population Estimates Program, the Current Population Survey, and the Survey of Income and Program Participation (SIPP).

The letter concluded that, “While we appreciate the challenges that the current fiscal environment presents, this is exactly the wrong time in the long-expected ramp-up to the 2030 Census for Congress to constrain funding for the U.S. Census Bureau.…Our country and the economy are going through a period of unprecedented stresses. The comprehensive, nonpartisan and trusted official statistics the Census Bureau provides the nation are essential to understanding where we have been, and how we can plan for where we want to go.”

At the Association of Public Data Users (APDU), we noticed a recurring theme during our events in 2025: members were expressing increasing concern about data privacy, confidentiality, and security.

These concerns have important implications for data collection efforts, including the decennial census and American Community Survey (ACS).. If people don’t trust that their information will be safe, they may opt out of participating. Research conducted by the Census Bureau in 2019 showed that privacy concerns are a barrier to participation in the census. One quarter of respondents expressed concern about the privacy and confidentiality of their responses. And that was before the recent flood of evidence that there are new privacy, confidentiality, and security concerns with the handling of government data.

More recent polling from the Center for Democracy and Technology (CDT) suggests that concerns about data privacy are now widespread. More than 80 percent of people across the United States say that having legal protections for the sensitive information government agencies collect and store is important.

CDT’s analysis also shows clearly that these concerns span the political spectrum. There’s broad, bipartisan interest in protecting people’s information from threats including security breaches and government misuse. But the study also finds that less than half of Americans know their legal rights.

And it’s not just the public that has knowledge gaps.

At APDU, as we’ve embarked on providing technical assistance to litigators, legislators, journalists, advocates, and privacy technologists, our team noticed information gaps among different groups working on data privacy. Tech folks talk to tech folks. Policymakers talk to policymakers. The situation is like having a room of people who are blindfolded, touching an elephant—privacy technology experts understand one piece of the puzzle, policymakers understand another, advocates a third, data users a fourth, litigators a fifth. And there is limited communication and knowledge-sharing across groups.

In addition to information silos, we also found some… not quite accurate information out there. The widespread confusion is, perhaps, not surprising. There is no single, comprehensive law in the U.S. Instead, privacy law is a patchwork of dozens of separate federal laws, along with an even greater number of state laws and complicated issues around Tribal data sovereignty.

So, with support from the Annie E. Casey Foundation, we brought together a team of experts to help fill knowledge gaps and raise awareness so we can all work together more effectively to strengthen data privacy protections.

Although there is no unifying privacy law in the U.S., the Privacy Act of 1974 is foundational.

The Privacy Act of 1974 provides guardrails for when and how personal data is handled and shared by federal agencies. However, the rules—and the gaps or shortcomings in those rules—are widely misunderstood and are being exploited or twisted to treat individuals unfairly. We created a set of resources to help policymakers, researchers, advocates, and the public better understand the mechanics of the Privacy Act, the rights it conveys, and the obligations it  imposes on federal agencies to collect, manage, and disclose personal information responsibly. The reports and briefs are accompanied by recorded trainings on data privacy.

You can use the reports and recordings to learn how to effectively assert your rights, address vulnerabilities, and hold the government accountable for treating everyone fairly.
