if a person was appointed as LDC in 1988 and transferred(appointed) to another Cadre in 1998 after qualifying competitive exam. and subsequently promoted to the next higher post in 2002 as per existing RRs on ad-hoc basis and further promoted to the next higher post in 2007/2011 on ad-hoc basis and continued his service for more than 16 years on ad-hoc basis. whether he is entitled for his 3rd MACP after completion of 10 years of the last post he held or not? however, it is also to point that he got his ad-hoc promotions not because of his fault, but the administration has failed to conduct proper DPC well in time. his last promotion was to a “A” category post which cannot be regularized with out the consent of the UPSC.

2. Earlier DPC conducted by an Adminstrative department an be over rule by the same administrative department without giving proper justification. is this right?

3.If a DPC conducted by any Department on the basis of decisions taken by the Hon’ble High Court can be cancelled by any other department(administrative department) and conducting review DPC without considering the decisions of the ruling of the Hon’ble High Court and subsequent decisions of the CAT. Is it in order?
in the High Court decision, a paragraph has already given to upheld the decisions of an Autonomous body. Is this is not enough for giving benefits of the subsequent employees came through the same competitive exam?

Would be of great help if you can clarify on adoption of new wage code by private companies whose business operations are spread across multi-state. Such companies fall under the purview of “Code on Wages (Central) Rules, 2025” or should they wait for the respective states to adopt the new labour codes and notify them in their state Official Gazette? The concern here is that – Employees those who got separated / left the company after the enforcement date of 21 November 2025 were denied the settlement benefits which other wise are entitled as per new labour codes. Through this medium it would be helpful for many employees if this is answered appropriately.
