<p>My ex husband had an unknown woman eavesdrop on a conversation between him, myself and my daughter, the phone call was on speaker phone and my ex husband was notified at the start of the telephone call  and during the call, florida where we live and ca. where he lives is an all party state, that the conversation was being recorded, in the middle of the conversation there was a call and my ex was put on hold for a few seconds before resuming the conversation, where we (my daughter and I who were known to my ex and participating in the conversation) discovered an unknown woman speaking about the details of the current call to my ex. she did not identify herself and my ex would only later refer to her as his &#8220;lawyer&#8221;. also  how can I bring charges if any against my ex and this mystery woman. where do I start? </p>

<p>All parties must consent to the recording or the disclosure of the contents of any wire, oral or electronic communication in Florida. Recording, disclosing, or endeavoring to disclose without the consent of all parties is a felony, unless the interception is a first offense committed without any illegal purpose, and not for commercial gain. Fla. Stat. ch. 934.03. These first offenses and the interception of cellular frequencies are misdemeanors. State v. News-Press Pub. Co., 338 So. 2d 1313 (1976).</p>

I don&#8217;t need anyone putting me down and calling me a deadbeat PLEASE just some advise!!<br />
 In may of 2008 I had a payday loan through a on line company (bad idea I now know) they were to take the payment out of my checking, when they tried to take the money they notified me and said there was not enough to cover the payment. Turned out a direct deposit that was supposed to be made wasn&#8217;t. I said I would mail a money order which I did. I thought this was cleared up. I have looked high and low for my M.O. receipt and I cant find it, therefore if said company says they didn&#8217;t receive the payment then I do feel obligated to pay it yet again as its my bad that i lost my proof of payment&#8230;</p>
<p>  Now over a year later i get a call from a company Eclipse Resolutions LLC in New York they have a called 4 or 5 times and leave a message I have tried to return their calls to find out what it was they wanted. When I did get a answer the person I was supposed to talk with was never around and there was no voice mail. So I continued to try and reach someone. I called this AM and spoke with someone they are calling in regards to the payday advance I described. I told them I need to see some documentation, something in writing&#8230;. OK fine but the secretary was out maybe if I call back the next day they can email or fax me something.. so I chat with this person for a bit, I expressed that IF I receive something in writing and this seems valid I can work out some type of agreement. But I was not unwilling to just send them money&#8230;. His response was &#8220;well you have screwed up get a lawyer&#8221; and he hung up on me&#8230;<br />
  So I called back spoke with someone else (at that point I still didn&#8217;t know what company I was dealing with) I tried to talk with him and was interrupted a number of times unable to ever finish a sentence, he then told me that If I didn&#8217;t call back tomorrow and set up a payment agreement and get them a payment via, checking account or debit/credit card by the 3rd that they were sending paper work to my County because I wrote a bad check across state lines and committed a felony offense.  I told him again that if they sent me something in writing to validate the debt I would work out a plan to pay the debt starting 8/15 the earliest I would have money available.. He then proceeded to tell me that they were trying to work with me and it was what it was, if i didn&#8217;t have the money to them by the 3rd then i can expect it to be turned over to the county and he could no longer speak with me as he was leaving the office and the soonest I could get something in writing was via fax or email tomorrow IF I called them tomorrow and he wouldn&#8217;t even take my contact info (email/fax/mailing) so that first thing tomorrow they could get it sent to me. I also asked why I had not received anything up to this date and his response was they will not waste money mailing me a bill.</p>
<p>I am wondering if you can please tell me how to handle this situation? like I said if the original company claims they didn&#8217;t receive payment then I feel obligated to pay it. But I also do not have a good feeling about this other company. I am at a loss at this point and unsure what to do.<br />
 I have been trying to research this company and have came up empty handed. When they leave a message they say a name, and a call back number and case number:  xxxxxx<br />

<p>A collection agency cannot threaten to take you to court unless they are actually taking you to court.</p>

<p>Linda Bollea wants a share of two multimillion-dollar local properties she and her husband own as well as alimony, child support and attorney fees. These are the details in a divorce petition she filed last week in Pinellas Circuit Court against famed wrestler Hulk Hogan after 24 years of marriage. The lawsuit says the marriage is &#8220;irretrievably broken.&#8221; The two had one child – Nick Bollea, 17, who was arrested this month in connection with a wreck that left a passenger, John Graziano, with severe brain injuries. Linda Bollea is seeking child support and a life insurance policy to cover child support in the event that Hogan dies, the petition states. She wants wherever she decides to live to be Nick Bollea&#8217;s primary residence, with Hogan allowed liberal visitation, the petition states. She also wants Hogan to pay for Nick Bollea&#8217;s health insurance, the petition states.</p>
<p>Linda Bollea wants the couple&#8217;s assets equitably distributed – including the family&#8217;s $  .7.2 million mansion on Willadel Drive, which has a gazebo, two boat davits, a pool, a fountain and three fireplaces. She also wants a share of a separate $  2 million waterfront home, the petition states. Neither property has a mortgage on it, the petition states. The couple also have a condominium under construction in Las Vegas; Linda Bollea wants a share of that, too. Two middle-school students in Oregon are facing possible time in a juvenile jail and could have to register as sex offenders for smacking girls on the rear end at school.</p>
<p>Cory Mashburn and Ryan Cornelison, both 13, were arrested in February after they were caught in the halls of Patton Middle School, in McMinnville, Ore., slapping girls on the rear end. Mashburn told ABC News in a phone interview that this was a common way of saying hello practiced by lots of kids at the school, akin to a secret handshake.</p>
<p>The boys spent five days in a juvenile detention facility and were charged with several counts of felony sex abuse for what they and their parents said was merely inappropriate but not criminal behavior.</p>
<p>The local district attorney has since backed off &#8212; the felony charges have been dropped and the district attorney said probation would be an appropriate punishment. The Mashburns&#8217; lawyer said prosecutors offered Cory a plea bargain that would not require him to register as a sex offender, which the family plans to reject.</p>
<p>But the boys, if convicted at an Aug. 20 trial, still face the possibility of some jail time or registering for life as sex offenders.</p>
<p>The boys&#8217; families and lawyers said even sentencing them to probation would turn admittedly inappropriate but not uncommon juvenile rowdiness into a crime. If they are convicted of any of the misdemeanor charges against them, they would have to register as sex offenders.</p>
<p>What&#8217;s Your Take?</p>
<p>&#8220;It&#8217;s devastating,&#8221; said Mark Lawrence, Cory Mashburn&#8217;s lawyer. &#8220;To be a registered sex offender is to be designated as the most loathed in our society. These are young boys with bright futures, and the brightness of those futures would be over.&#8221;</p>
<p>Cory Mashburn said he and Ryan Cornelison slapped each others&#8217; and other kids&#8217; bottoms every Friday. &#8220;Lots of kids at school do that,&#8221; he said.</p>
<p>Cory and Ryan were brought to the principal&#8217;s office Feb. 22, where they were questioned by school officials and a police officer. They were arrested that day and taken in handcuffs to a juvenile detention facility.</p>
<p>Court papers said the boys touched the buttocks of several girls, some of whom said this made them uncomfortable. The papers also said Cory touched a girl&#8217;s breasts. But police reports filed with the court said other students, both boys and girls, slapped each other on the bottom.</p>
<p>&#8220;It&#8217;s like a handshake we do,&#8221; one girl said, according to the police report.</p>
<p>The boys were initially charged with five counts of felony sexual abuse. At a court hearing, two of the girls recanted, saying they never felt threatened or inappropriately touched by the boys. The judge released the boys but barred them from returning to school and required that they be under constant adult supervision.</p>
<p>District Attorney Bradley Berry has since dismissed the felony counts. The boys face 10 misdemeanor charges of harassment and sexual abuse. They face a maximum of up to one year in a juvenile jail on each count, though Berry said there was no way the boys would ever serve that much time.</p>
<p>&#8220;An appropriate sentence would be probation,&#8221; he said. &#8220;These are minor misdemeanor charges that reflect repeated contact against multiple victims. We never intended for them to get a long time in detention.&#8221;</p>
<p>&#8220;We&#8217;re not seeking major penalties,&#8221; he said. &#8220;We&#8217;re seeking change in conduct.&#8221;</p>
<p>&#8216;We Just Want This to Be Over&#8217; Tracie Mashburn, Cory&#8217;s mother, said they will not accept plea and plan to fight the charges.</p>
<p>The arrests, critics said, reflect a trend toward criminalizing adolescent sexual behavior. Between 1998 and 2002, juvenile arrests for sex offenses other than rape or prostitution rose 9 percent &#8212; the only kind of juvenile arrests that rose during that time, according to the Bureau of Justice Statistics.</p>
<p>&#8220;More and more, they are criminalizing normal adolescent or preadolescent behavior,&#8221; said Chuck Aron, co-chairman of the National Association of Criminal Defense Lawyers juvenile justice committee.</p>
<p>Even probation, the Mashburns and their attorney said, would be too severe a punishment.</p>
<p>Julie McFarlane, a supervising attorney at the Juvenile Rights Project in Portland, Ore., said, &#8220;Probation for a sex offense is very difficult thing, and there&#8217;s a pretty high failure rate.&#8221; Failing to meet the terms of probation could mean the boys would be sent to jail.</p>
<p>Depending on the terms of probation, it&#8217;s likely that the boys would not be allowed to have sexual contact with anyone or any contact with younger children, McFarlane said. For Cory Mashburn, that would mean he couldn&#8217;t be left alone with his younger siblings.</p>
<p>&#8220;It&#8217;s been awful,&#8221; said Cory&#8217;s mother. &#8220;We just want this to all be over. But it will never go away. We&#8217;ll always remember it.&#8221;</p>
<p>Berry, the district attorney, said the victims &#8212; the girls who were touched &#8212; were being overlooked. &#8220;What&#8217;s been lost in this whole thing are the victims, who have been pressured enormously by these boys&#8217;</p>

My son was arrested in February this year for drug possession with intent to sell. At the time, he had one joint in his pocket, and some ZigZags in the other.He was arrested at his girlfriends house while she was at work, and the police searched his GF&#8217;s bedroom, and found a small jar with &#8220;doobies&#8221; or &#8220;roaches&#8221; in it, and a scale. He less than 3 gms of marijuana on him. The police seized the joint, the ZigZags, the jar, his cell phone, and the scale. They questioned my son, whom has never been arrested or in any trouble before, and they claim that someone called them and told them that drugs were being sold from the apt. My son did not live there &#8211; but yet, they searched the apt. w/o permission. I read the police report, and the arresting officer claimed that my son told them that he did sell drugs for food and gas money&#8230;WHAT???? First of all, my son is NOT a drug dealer, and if he was, he&#8217;s not STUPID!!! I don&#8217;t know ANYONE who would tell the police, &#8220;Oh yes, officer, I sell drugs&#8221;!!! They imposed a $  10,000.00 bail, and have made the past 9 months a living hell for us. Postponed court dates, harassment, you name it. I did retain an attorney, who seems to have abandoned us after I paid him$  1,000 deposit, and I still owe him $  2,500. He is blowing us off big time!!! I&#8217;m SOOOOO frustrated!!!!! He claims that he made a deal with the D.A. to drop the sales charge, but my son still has Felony posses ion charges against him for having &#8220;Concentrated Cannabis&#8221;&#8230;&#8230;WHAT??!!??? That wasn&#8217;t part of the original charge!!!</p>
<p>I/we are so confused!!!! Can we appeal this?? He was sentenced to 3 years/1 year of jail time with 2 years probation, but they dropped the jail time and gave him probation, and he must submit to drug testing and HIV/STD classes. His &#8220;lawyer&#8221; is telling him that that he can petition the court in TWO YEARS to ATTEMPT to have this expunged&#8230;&#8230;.</p>
<p>PLEASE HELP US!!! My son is not perfect, but he is NO DRUG DEALER!!!! I don&#8217;t know what recourse we have!!! He is a first time offender, a full time student- what went wrong here?????</p>

My kids were taken by CPS and we love them very much! I am 29 and my wife is 24, my youngest child which is 5 months old had a blood clot in her head and has had red purple and white spots on her body which doctors have not been able to diagnose. CPS are accusing us of child abuse and told us that they would try and help us get our kids back and place them with granpa and grandma, my father and mother in-law took the fingerprints so cps can see if they have any felonies &#8220;which they don&#8217;t&#8221; and said that they should be with them in 4 days and its been almost 5 weeks and they lie and say they havent got the results back which even our public defender says is awkward and shouldn’t take that long. our rights are being abused. Now theres a detective that wants to interrogate my wife and me tomorrow. Can I ask for a lawyer before talking to them? I don’t have $   tho. What can I do about this situation. He wants a polygraph test too, but I seen that these things are inaccurate.</p>
<p>Update: detective came to my house and I told him if he had any questions to speak to my lawyer &#8220;public defender&#8221; and I gave him his card. He told me that now he&#8217;s gonna make sure I dont get my kids backnd laughed with the officer he was with after I gave him the card can I do anything against the detective like lawsuit or something?</p>

On that thing that suggest which questions you might be able to answer. For some reason I always get something like &#8220;I commited a felony, need good lawyer&#8221; and &#8220;We&#8217;re going to jail for distribution of an illicit substance. How can we get off?&#8221;</p>
<p>Why do I get these questions? I have no idea and don&#8217;t touch on the crime questions too much. Is there any way to make it so that I don&#8217;t get them?</p>

I get parenting questions and not only am I NOT a parent, I will never be a parent, and I don&#8217;t want to be a parent.<br />

<p>You do not need to hire any attorney at law without researching them and making sure that they are expert in the type of crime that you are charged with. Don't assume that just any attorney can defend your case. Be sure you do your research and find the best for your situation.</p>

1. I am going to court for automobile insurance fraud, now this is a felony if i plea. My lawyer told me that he can try to swing for a mistameanour plea.</p>
<p>2. He can not promise anyhting, but what he can promise is that he will work harder than the &#8221; head of court apointed lawyer&#8221; that i have now.. </p>
<p>3. All the motions, and evidence has been given to my attorney. Now, my attorney is known and respected in superiour court. HE has been court apointed for 28 years. </p>
<p>4. This new lawyer i am talking to, he knows the DA they went to school or something togethere. Does this help, or can it equal the same relation ship and respect my lawyer has with the DA that is working on the case.</p>
<p>5. The new lawyer is charging me, 10k,, five up front for my case. and he will try to go to trial and make a plea of mistameanor, instead of a felony.</p>
<p>6. Does this mean that, he will try to plea to a mistameanor befor trial. But he stated that he will go to trial with this. Sorry if i contradicted and confused with the begining of this sentance.</p>
<p>Note: I have  a clean record, this so called fraud is set to had happen in 2003, march and i have been in College ever since, graduate from Computer Enginering in 2010.<br />
1. New lawyer stated, he can fight for a mistamenour.<br />
2. I was told the same to stick with the court apointed, in superior court.<br />
3. Would a mistamenour affect my employment in the engineering field<br />
4. Or should i just take it to trial and see what happens..<br />
5. Someone plead guilty to our case, because he got a sweeet deal.. I dont want to do that</p>

<p><i>Answer by Slappy</i><br/>If your court appointed lawyer is a public defender, stick with him or her.  They are usually the best trial lawyers you can find in any county.  </p>
<p>He is saying that he will try to get a deal where you can plead guilty to a misdemeanor in exchange to dropping the felony.  He is also saying that if this doesnt happen, he is willing to go to trial.</p>
<p>Either way, stick with the public defender.</p>
