					<description>I completely agree.  My experience is that organisations frequently only pay lipservice to their DPA obligations.  Often they take comfort in the (erroneous) assumption that, if any complaint is made to the ICO, they'll be ok as long as they can show they made a decent stab at compliance.</description>

I am "interested" in a friend's case where he is suing an insurance broker for negligence - the issue of the sophistication of the buyer of the insurance cover has arisen ie the broker is saying he did not have to bring to the clients attention "conditions precedent to liability" as the client was a commercial person and "should have known" the effect - quite - but the clauses were not even pointed out!! Thanks agin for your blog which kinda helped....</description>

The use of force majeure is to deal with events that are out of the parties' control, the courts allow you to define the context of the events. Thus it should be no problem to define which events are force majeure and which events trigger the disaster recovery?</description>
