Brussels, 31 May 2012 – The European Commission has today formally requested Cyprus to change the way in which it levies registration tax on second-hand motor vehicles transferred from other Member States.

Under Cypriot law, the full amount of registration tax on the transfer and registration of a second-hand motor vehicle from another Member State is applied, regardless of the age or the mileage of the vehicle. It is levied on the basis of the category of the vehicle, engine capacity and carbon dioxide emissions. Cypriot rules do not, however, take into account the depreciation of the value of second-hand vehicles when they are registered in Cyprus. The Court of Justice ruled that the tax on a second-hand car from another Member State cannot be higher than the “residual tax” incorporated in the value of a similar vehicle registered nationally (Article 110 of the Treaty on the Functioning of the European Union).

In addition, Cypriot rules do not allow taxpayers to challenge the specific assessment of the registration tax made by the tax authorities. The Court of Justice has ruled in previous cases that Member States’ judicial systems should offer the possibility to challenge the statutory scales in their individual case.

Both features of Cypriot legislation are contrary to EU rules and infringe the principle of non-discrimination as interpreted by the Court.

The Commission’s request takes the form of a reasoned opinion (second step of EU infringement proceedings). In the absence of a satisfactory response within two months, the Commission may refer Cyprus to the Court of Justice of the European Union.

Background

A Member State may levy a registration tax on vehicles transferred from another Member State provided EU rules are respected and in particular the non-discrimination principle in Article 110 TFEU. The EU’s Court of Justice has stated in this respect that the depreciated value of a motor vehicle must be taken into account when it is registered in a Member State. This may be done for example by means of depreciation scales. These should, however, guarantee that the tax due does not exceed the tax value of similar vehicles already registered in the national territory. The EU’s Court of Justice has also stated that Member States are obliged to provide means of redress if the taxpayer wishes to challenge the specific assessment of the registration tax.

Mosfiloti – Alhambra old road, Larnaca: Around 8:30 a.m. a moped driven by Safeiris Anthony, 76 years, collided with a car driven by a 28 year old resident of the village in the Larnaca district.

The 76 year old was transferred to Nicosia General Hospital where his death was certified.

The driver of the car had no indication of alcohol, while seems that the motorcyclist wore no protective helmet.

Θανατηφόρο τροχαίο δυστύχημα
*** Σε νέο θανατηφόρο τροχαίο δυστύχημα που συνέβη το πρωί σήμερα, έχασε τη ζωή του ο Αντώνης Σαφείρης, 76 ετών, από τον Κόρνο.
Το δυστύχημα συνέβη γύρω στις 8.30π.μ., στον παλαιό δρόμο Μοσφιλωτής – Αλάμπρας, όταν κάτω από συνθήκες που διερευνώνται, το μοτοποδήλατο που οδηγούσε ο 76χρονος, συγκρούστηκε με αυτοκίνητο που οδηγούσε 28χρονος κάτοικος χωριού της επαρχίας Λάρνακας.
Ο 76χρονος μεταφέρθηκε στο Γενικό Νοσοκομείο Λευκωσίας όπου διαπιστώθηκε ο θάνατός του.
Στον οδηγό του αυτοκινήτου διενεργήθηκε έλεγχος αλκοόλης με μηδενική ένδειξη, ενώ από εξετάσεις που διενεργήθηκαν φαίνεται ότι ο 76χρονος δεν έφερε προστατευτικό κράνος.
Η Τροχαία Λευκωσίας διερευνά τα αίτια του δυστυχήματος.

Nicosia District: Around 6 pm yesterday, an 11 year old was struck by a car driven by a 59 year old.

The child was transported by ambulance to Nicosia General Hospital and then to Makarios Hospital where he was kept in ICU.

The state of health is seen as critical.

Σοβαρό τροχαίο δυστύχημα – Κρίσιμα 11χρονος
*** Γύρω στις 6 μ.μ. χθες, 11χρονος ενώ ποδηλατούσε σε χωριό της επαρχίας Λευκωσίας, κάτω από συνθήκες που διερευνώνται, παρασύρθηκε από αυτοκίνητο που οδηγούσε 59χρονη.
Ο 11χρονος μεταφέρθηκε με ασθενοφόρο στο Γενικό Νοσοκομείο Λευκωσίας και ακολούθως στο Μακάρειο Νοσοκομείο όπου κρατήθηκε διασωληνωμένος στον παιδοχειρουργικό θάλαμο.
Η κατάσταση της υγείας του κρίνεται ως κρίσιμη.
Ο Αστυνομικός Σταθμός Κλήρου συνεχίζει τις εξετάσεις.

Amathus Avenue, Limassol: About 11.15am today a fatal crash occurred where Apostle Makris, a 51 year old Cyprus resident from Greece, died.

A light truck driven by a 28 year old from Limassol, entered the oncoming traffic and collided head-on with the motorcycle driven by the deceased.

He was wearing a protective helmet.

Immediately after the accident, the driver of the truck fled the scene but was stopped at a distance of about two kilometers by members of the Criminal Investigation Department of Limassol.

A search was conducted of the truck and traces of cannabis and white powder, and a cylindrical container with a straw containing traces of white powder, believed to be drug.

Also in that vehicle were various objects, such as satellite dish, electrical and other cables, which the driver was not able to give a satisfactory explanation of their origin.

The 28 year old was arrested by a court order to facilitate investigations

ΘΑΝΑΤΗΦΟΡΟ ΤΡΟΧΑΙΟ ΔΥΣΤΥΧΗΜΑ – ΣΥΛΛΗΨΗ

***     Σε θανατηφόρο τροχαίο δυστύχημα που σημειώθηκε σήμερα το πρωί στη Λεμεσό, έχασε τη ζωή του ο 51χρονος Απόστολος Μακρής, από την Ελλάδα, μόνιμος κάτοικος Κύπρου.

Το θανατηφόρο τροχαίο, συνέβη γύρω στις 11.15 το πρωί, όταν ελαφρύ φορτηγό που οδηγούσε 28χρονος από τη Λεμεσό, στη λεωφόρο Αμαθούντος, κάτω από συνθήκες που διερευνώνται, σε κάποιο σημείο του δρόμου, εισήλθε στο αντίθετο ρεύμα κυκλοφορίας και συγκρούστηκε μετωπικά με τη μοτοσικλέτα που οδηγούσε ο 51χρονος.

Από το δυστύχημα, ο 51χρονος, ο οποίος φορούσε προστατευτικό κράνος τραυματίστηκε θανάσιμα και μεταφέρθηκε με ασθενοφόρο στο Γενικό Νοσοκομείο Λεμεσού, όπου διαπιστώθηκε ο θάνατός του.

Αμέσως μετά το δυστύχημα, ο οδηγός του φορτηγού εγκατέλειψε τη σκηνή, αλλά ανακόπηκε σε απόσταση δύο χιλιομέτρων περίπου, από μέλη του Τμήματος Ανιχνεύσεως Εγκλημάτων Λεμεσού.

Σε έρευνα που έγινε, εντός του οχήματος του 28χρονου, ανεβρέθηκαν δύο σπαστήρες, οι οποίοι περιείχαν  ίχνη κάνναβης και άσπρης σκόνης, καθώς επίσης και ένα κυλινδρικό δοχείο με καλαμάκι που περιείχε ίχνη άσπρης σκόνης, που πιστεύεται ότι είναι ναρκωτική ουσία.

Επίσης, στο εν λόγω όχημα, ανεβρέθηκαν διάφορα αντικείμενα, όπως δορυφορικός δίσκος, ηλεκτρολογικά καλώδια και άλλα, τα οποία ο 28χρονος δεν έδωσε ικανοποιητικές εξηγήσεις για την προέλευση τους.

Εναντίον του 28χρονου εκδόθηκε δικαστικό ένταλμα και συνελήφθη για διευκόλυνση των ανακρίσεων.

Η Τροχαία Λεμεσού σε συνεργασία με την ΥΚΑΝ(Κλιμάκιο Λεμεσού) συνεχίζει τις εξετάσεις.

Recent communications with the Cyprus Department of Customs have highlighted the fact that since 1st May 2004 the Cypriot Authorities have been imposing customs duties on the personal property of those seeking to become permanent residents in Cyprus.

Within a Directive originally introduced in March 1983 and permanently implemented into European Law on 1st January 1984, the Directive (codified in 2009) specifically identifies motor driven vehicles as part of personal property and as such the vehicle should be exempted where it meets the criteria set down for the importation and use of the personal property.

In view of the customs levies that continue to be placed on motor driven vehicles being brought into Cyprus by genuine permanent residents, coupled with the fact that the Authorities refuse to comply with the EU Directive, the Association of British Citizens Overseas (ABCO) is preparing a block formal complaint to the EU Commission in Brussels and also seeking to make a claim for the total repayment of customs duties that have been levied by Cypriot Customs in breach of the procedures as laid down by EU Directive 2009/55/EC (formerly EU Directive 83/183/EEC).

In order that all those affected by the levy since 1st May 2004 can be included, any person believing that they have a claim should make direct contact with ABCO through www.abco-cyprus.com.

The terms of the Directive is explained on the website and in this regard ABCO will also accept approaches from Citizens from any of the 27 Member States who also believe they are entitled to recover any duties paid.

It is believed that a substantial number of residents have paid the duty and under the terms of the Directive, this money should be returned to them plus interest. Each resident that makes contact will be contacted directly and individually and all details will held in confidence.

Around 1 pm today, 54 year old Savvas Savva, was driving a light truck on the Limassol – Paphos highway when he deviated from his course and struck an iron barrier then overturned.

He was not wearing a seat belt and was dead on his arrival at hospital.

***     Γύρω στη 1 μ.μ. σήμερα, ο 54χρονος Σάββας Σάββα, ενώ οδηγούσε ελαφρύ φορτηγό στον αυτοκινητόδρομο Λεμεσού – Πάφου, κάτω από συνθήκες που διερευνώνται, παρεξέκλινε της πορείας του και αφού προσέκρουσε αρχικά σε σιδερένιο κιγκλίδωμα, ακολούθως ανατράπηκε.

Ο 54χρονος, ο οποίος δεν έφερε ζώνη ασφαλείας, μεταφέρθηκε στο Γενικό Νοσοκομείο Λεμεσού, όπου διαπιστώθηκε ο θάνατός του.

Η Τροχαία Λεμεσού διερευνά τα αίτια του δυστυχήματος.

*** Γύρω στις 11 χθες βράδυ, υπέκυψε στα τραύματά του 66χρονος, ο οποίος νοσηλευόταν στο Νευροχειρουργικό Τμήμα του Γενικού Νοσοκομείου Λευκωσίας, μετά από τραυματισμό του σε σοβαρό τροχαίο δυστύχημα που συνέβη στις 11 Απριλίου, 2012 στη Λεμεσό.
Η Τροχαία Λεμεσού συνεχίζει τις εξετάσεις.

A speed campaign starts today with checks across Europe, including Cyprus. The campaign is coordinated under the auspices of TISPOL (The  European Traffic Police Network) and runs for a week.

The aim is to reduce road crashes throughout Europe.
