For the first time Megaupload has filed a motion in response to the U.S. indictment. Kim Dotcom’s legal team has asked a Virginia federal court to dismiss the criminal case the U.S. Government started in January. The defense argues that the U.S. violated Megaupload’s due process rights by destroying its business, without having properly served the company. If granted, this means the Megaupload case will be over.

RIAA says Google piracy policies are lacking

The Recording Industry Association of America (RIAA) Wednesday accused Google of not doing enough to stop Internet users from accessing Websites that carry pirated music and other copyrighted content.

The accusations follow Google’s recent release of a so-called Transparency Report that lists and describes requests that the search firm receives from copyright holders to remove links to sites containing infringing content.

In a blog post, Brad Buckles, executive vice president for anti-piracy at the RIAA, blasted Google for releasing what he called a “misleading” report that lacked adequate transparency.

“Google is routinely directing people to unlawful sources of content” contrary …

Still more to read....</p

RIAA wants to issue unlimited takedowns to Google

If Google really hated piracy, it would let copyright holders supply takedown lists of unlimited length. That’s the view of the recording industry, which yesterday issued a blog post from a top anti-piracy executive that blasted Google in the wake of the company’s updated Transparency Report tool. That tool made clear that the major music and video copyright holders were not actually using Google’s takedown tools to their full extent; indeed, Microsoft dwarfed any other single rightsholder in using Google’s takedown system.

In the last month, for instance, the infringement detection company Marketly LLC topped the takedown list with …

Still more to read....</p

PALOS VERDES, Calif.–Federal Trade Commission Chairman Jon Leibowitz, speaking at the D10 conference today, called on technology companies to implement three things to protect consumer privacy.

Acknowledging that tech vendors are doing better today at building privacy into apps, what he called, “privacy by design,” he said that most companies actually want to design with consumer protection in mind.

But, he said, consumers need more transparency. He called for simpler policies for consumers. “They have to be like a nutrition guide on the side of a cereal box,” he said.
Hollywood Super Agent Ari Emanuel Mystified That Google Doesn’t Just Invent A …

Famed Hollywood super agent Ari Emanuel (the model for Jeremy Piven’s character in Entourage, and the brother of Chicago mayor/former Obama chief of staff Rahm Emanuel) doesn’t have a particularly good history when it comes to his understanding of how technology and policy will develop.
Megaupload is challenging the U.S. Government’s possession of millions of dollars in assets it seized from the company and its operators in January. The newly-filed and eye-opening motion slams the U.S. for holding the defendants liable for alleged offenses that aren’t even a crime, ignoring laws designed to offer them protection, failing to provide any detail whatsoever on alleged infringements, and pushing U.S. law far beyond its borders.
