										<content:encoded><![CDATA[<p>On November 20, 2014, the President announced a series of executive actions to crack down on illegal immigration at the border, prioritize deporting felons not families, and require certain undocumented immigrants to pass a criminal background check and pay taxes in order to temporarily stay in the U.S. without fear of deportation.</p>
<p>These initiatives include:</p>
<p>Expanding the population eligible for the Deferred Action for Childhood Arrivals (DACA) program to young people who came to this country before turning 16 years old and have been present since January 1, 2010, and extending the period of DACA and work authorization from two years to three years.</p>
<p>Allowing parents of U.S. citizens and lawful permanent residents who have been in the country since January 1, 2010, to request deferred action and employment authorization for three years, in a new Deferred Action for Parental Accountability program, provided they pass required background checks.</p>
<p>Expanding the use of provisional waivers of unlawful presence to include the spouses and sons and daughters of lawful permanent residents and the sons and daughters of U.S. citizens.</p>
<p>Modernizing, improving and clarifying immigrant and nonimmigrant programs to grow our economy and create jobs.</p>
<p>Promoting citizenship education and public awareness for lawful permanent residents and providing an option for naturalization applicants to use credit cards to pay the application fee.</p>
<p><strong>Important notice: These initiatives have not yet been implemented, and USCIS is not accepting any requests or applications at this time. Beware of anyone who offers to help you submit an application or a request for any of these actions before they are available. You could become a victim of an immigration scam.</strong></p>
<p><strong>Next steps</strong></p>
<p>USCIS and other agencies and offices are responsible for implementing these initiatives as soon as possible. Some initiatives will be implemented over the next several months and some will take longer.</p>
<p>Over the coming months, USCIS will produce detailed explanations, instructions, regulations and forms as necessary. The brief summaries provided below offer basic information about each initiative.</p>
<p>While USCIS is not accepting requests or applications at this time, if you believe you may be eligible for one of the initiatives listed above, you can prepare by gathering documents that establish your:<br />
1. Identity;<br />
2. Relationship to a U.S. citizen or lawful permanent resident; and<br />
3. Continuous residence in the United States over the last five years or more.</p>

										<content:encoded><![CDATA[<p>Based on a briefing today at the White House, the following elements are expected to be part of the Administration&#8217;s announcement on immigration executive actions, also known as the President&#8217;s Immigration Accountability Executive Actions. Our understanding is that details (and memos) are still being finalized, and will be released in the coming hours, days, weeks, and months.</p>
<p>Below is a summary of some of the changes expected to be announced tonight at 8pm ET or tomorrow in Las Vegas. AILA will continue to analyze information as it is released and provide updates on AILA InfoNet. Also, visit AILA&#8217;s Administrative Reform 2014 for updates.</p>
<p>Enforcement Priorities</p>
<p>Many of the existing ICE memos on enforcement priorities and prosecutorial discretion will be replaced by a new memo with three priorities: (1) Suspected terrorists, convicted felons (including aggravated felonies), convicted gang members, and persons apprehended on the border; (2) Persons convicted of serious or multiple misdemeanors and very recent border crossers (those who entered after January 1, 2014); and (3) Those who, after January 1, 2014, failed to leave under a removal order or returned after removal. The memo will contain strong language on the use of prosecutorial discretion.</p>
<p>Deferred Action Benefiting Approximately 4.4 Million Undocumented Individuals</p>
<p>Two deferred action initiatives will be rolled out that are estimated to benefit 4.4 million undocumented individuals: (1) Deferred Action for Parents (DAP): Parents of U.S. citizens and lawful permanent residents (of any age) who have been continuously present since January 1, 2010, and who pass background checks and pay back taxes; and (2) DACA Expansion: The age cap on DACA will be removed and the date when continuous presence must have started will be changed from June 15, 2007 to January 1, 2010. Both of these initiatives will provide deferred action for three years. The expanded DACA should be up and running in 90 days and deferred action for parents in 180 days. Note: no initiative specifically for parents of DACA recipients was included.</p>
<p>I-601A Waiver Expansion</p>
<p>The I-601A provisional waiver will be expanded to include spouses and children of lawful permanent residents. An expansion and clarification of the definition of &#8220;extreme hardship&#8221; is also expected.<br />
Timing of Filing for Adjustment of Status</p>
<p>The ability of individuals with an approved employment-based immigrant petition who are caught in the quota backlogs to file for adjustment of status will be advanced to permit them to obtain the benefits of a pending adjustment. This is expected to impact about 410,000 people. This will be done by regulation.<br />
Business Immigration Changes</p>
<p>A number of business immigration improvements are to be announced. For example, certain investors will be eligible for parole into the U.S., or for parole-in-place, and national interest waivers could be available for entrepreneurs, researchers, inventors, and founders. Also, the term &#8220;same or similar&#8221; for AC-21 purposes will be clarified, L-1B guidance will be released, the H-4 EAD regulation will be finalized, and the length of time permitted on OPT for STEM graduates will be expanded. Additionally, the rulemaking process will be undertaken to modernize the PERM labor certification program and may include a harmless error provision.</p>
<p>Visa Modernization</p>
<p>There will be a Presidential Memorandum directing the various immigration-related agencies to look at modernizing the visa system, with a view to making optimal use of the numbers of visas available under law. Issues such as whether derivatives should be counted towards the visa quota and whether past unused visa numbers can be recaptured are expected to be included in this effort.<br />
State and Local</p>
<p>Secure Communities will be discontinued and replaced with a new initiative, the Priority Enforcement Program (PEP). Details are still forthcoming on what PEP will entail, but in certain circumstances, detainers may be replaced by requests for notification to ICE when a law enforcement entity is about to release an individual.<br />
Parole-in-Place</p>
<p>Parole-in-place will be expanded to include families of individuals trying to enlist in the armed forces, as some branches of the military ban applicants who have undocumented family members.</p>

On October 2, 2013, Democrats in the House of Representatives proposed an immigration reform bill addressing border security, legalization of the undocumented, interior enforcement of immigration laws, and fixes for our dysfunctional legal immigration programs. The bill is based on S.744, the bipartisan bill passed by the Senate by a vote of 68-32 on June 27, 2013. However, the bill removes the Corker-Hoeven border security amendment and replaces it with the bipartisan House border security bill, H.R. 1417, which was passed unanimously by the Homeland Security Committee in May 2013.</span></p>

										<content:encoded><![CDATA[<p>On <b>September 3, 2013</b>, the Department of State will transition to an online immigrant visa application. Immigrant visa applicants will apply online using Form DS-260 (Application for Immigrant Visa and Alien Registration). Applicants will choose their agent online using Form DS-261 (Choice of Address and Agent). Applicants will access both forms on the web at <a href="https://ceac.state.gov/ceac/" target="_blank">ceac.state.gov</a>.</p>
<p>These forms replace the paper DS-230 and DS-3032. The National Visa Center (NVC) may instruct some applicants who previously submitted Form DS-230 to submit Form DS-260. Only Diversity Visa and Cuban Family Reunification Parole applicants will continue to use the paper forms.</p>
<p>Generally, if your DS-230 has already been submitted and accepted, the applicant will not need to complete the DS-260 UNLESS instructed to do so by the NVC or a consular officer.</p>
<ul>
<li>If a case is already documentarily qualified and awaiting scheduling, the case will proceed with the DS-230.</li>
<li>If a case is still in the document collection phase and a checklist letter is sent for any reason, even if a DS-230 is on file, you will be instructed to complete Form DS-260.</li>
<li>If the NVC has already scheduled the consular interview and sent the case to post with the DS-230, then it will stay a DS-230 case. Clients will not need to complete the DS-260 unless a consular officer requests it.</li>
<li>If members are ready to send the DS-230 before September 3rd, they can, but if the case is not documentarily qualified, you will receive a checklist letter which includes completing Form DS-260. However, if the DS-230 is complete and is the last thing needed to make the case documentarily qualified, members may send the DS-230 at this time.</li>

										<content:encoded><![CDATA[<p align="LEFT">Foreign visitors arriving in the U.S.—only via air or sea—who need to prove their legal-visitor status—to employers, schools/universities or government agencies—will be able to access their U.S. Customs and Border Protection arrival/departure record information online when the agency starts its records automation on April 30, 2013.</p>
<p align="LEFT">When the electronic rollout begins April 30, CBP will no longer require international nonimmigrant visitors to fill out a paper Form I-94 Arrival/Departure Record upon arrival to the U.S. by air or sea. The agency will gather travelers’ arrival/departure information automatically from their electronic travel records. This automation will streamline the entry process for travelers, facilitate security and reduce federal costs. CBP anticipates that the automated process will save the agency an estimated $15.5 million a year.</p>
<p align="LEFT">Because advance information is only transmitted for air and sea travelers, CBP will still issue a paper form I-94 at land border ports of entry. CBP will phase-in the Form I-94 automation at air and sea ports of entry through April and May. Foreign visitors will continue to receive the paper Form I-94 until the automated process arrives at their port of entry. Following automation, if travelers need the information from their Form I-94 admission record to verify immigration status or employment authorization, the record number and other admission information will be available at CBP.gov/I94</p>
<p align="LEFT">With the new CBP process, a CBP officer will stamp the travel document of each arriving nonimmigrant traveler. The admission stamp will show the date of admission, class of admission, and the date that the traveler is admitted until. Travelers will also receive on arrival a flier alerting them to go to CBP.gov/I94 for their admission record information.</p>
<p align="LEFT">Travelers will not need to do anything differently upon exiting the U.S. Travelers previously issued a paper Form I-94 would surrender it to the commercial carrier or to CBP upon departure. If travelers did not receive a paper Form I-94, CBP will record the departure electronically via manifest information provided by the carrier or by CBP.</p>

<p>The adjustment of status applications should include six photos in total per applicant, if all three forms listed below are filed:</p>
<ul>
<li>Two for the I-485 Application to Adjust Status</li>
<li>Two for the I-131 Application for Travel Document</li>
<li>Two for the I-765 Application for Employment Authorization.</li>
</ul>
<p>This clarification reflects a change from earlier USCIS guidance provided in the 7/12/2012 NSC stakeholder call, and 8/8/2012 SCOPS minutes, in which USCIS had indicated only two photos would be required in total per applicant.</p>

										<content:encoded><![CDATA[<p>WASHINGTON—Secretary of Homeland Security Janet Napolitano today announced the posting of a final rule in the Federal Register that reduces the time U.S. citizens are separated from their immediate relatives (spouse, children and parents), who are in the process of obtaining visas to become lawful permanent residents of the United States under certain circumstances.</p>
<p>The final rule establishes a process that allows certain individuals to apply for a provisional unlawful presence waiver before they depart the United States to attend immigrant visa interviews in their countries of origin. The process will be effective<strong> on March 4, 2013</strong> and more information about the filing process will be made available in the coming weeks at http://www.uscis.gov/.</p>
<p>“This final rule facilitates the legal immigration process and reduces the amount of time that U.S. citizens are separated from their immediate relatives who are in the process of obtaining an immigrant visa,” said Secretary Napolitano. U.S. Citizenship and Immigration Services (USCIS) received more than 4,000 comments in response to the April 2, 2012 proposed rule and considered all of them in preparing the final rule. “The law is designed to avoid extreme hardship to U.S. citizens, which is precisely what this rule achieves,” USCIS Director Mayorkas said. “The change will have a significant impact on American families by greatly reducing the time family members are separated from those they rely upon.”</p>
<p>Under current law, immediate relatives of U.S. citizens who are not eligible to adjust status in the United States to become lawful permanent residents must leave the U.S. and obtain an immigrant visa abroad. Individuals who have accrued more than six months of unlawful presence while in the United States must obtain a waiver to overcome the unlawful presence inadmissibility bar before they can return to the United States after departing to obtain an immigrant visa. Under the existing waiver process, which remains available to those who do not qualify for the new process, immediate relatives cannot file a waiver application until after they have appeared for an immigrant visa interview abroad and the Department of State has determined that they are inadmissible. In order to obtain a provisional unlawful presence waiver, the applicant must be an immediate relative of a U.S. citizen, inadmissible only on account of unlawful presence, and demonstrate the denial of the waiver would result in extreme hardship to his or her U.S. citizen spouse or parent.</p>
<p>USCIS will publish a new form, Form I-601A, Application for a Provisional Unlawful Presence Waiver, for individuals to use when applying for a provisional unlawful presence waiver under the new process. Under the new provisional waiver process, immediate relatives must still depart the United States for the consular immigrant visa process; however, they can apply for a provisional waiver before they depart for their immigrant visa interview abroad. Individuals who file the Form I-601A must notify the Department of State’s National Visa Center that they are or will be seeking a provisional waiver from USCIS. The new process will reduce the amount of time U.S. citizen are separated from their qualifying immediate relatives.</p>
