“We Just Found a Legal Way to Make Millions”

Shawn Pendegraft thought he’d found east street on his way to make millions — taking over foreclosed homes in the greater Charlotte, North Carolina area.

Pendegraft and five accomplices would set-up trusts and use them to file deeds on properties in the $800,000 price range. They then filed $1.2 million in fake liens against the homes and moved into at least one of the homes. ABC-11 in Charlotte gives the rest of the account.

That’s North Carolina Can It Happen Here?

Well, squatters moving into the homes isn’t a new thing and “Cousin Eddy” highlighted that squatters weren’t just in run-down communities. For those that forget, Randy Quaid – “Cousin Eddy” of National Lampoon fame – and his wife were arrested for trespassing after being found squatting on their foreclosed mansion.

But could squatters actually claim ownership of the home in Ohio? Toby asked that question to several local auditors and the response was chirping crickets. The short answer is “I don’t think so, but considering that no one responded I’m not sure.”

Umm … Okay, so Why Do You Say That?

Okay, Ohio is a court-ordered foreclosure state which makes it much harder for anyone to claim or prove ownership of a home.

The biggest thing that can be done is to keep your eyes and ears open. If something looks strange take a second to call the local police department’s non-emergency number.

Be on the look out for:

Same car visiting over and over
U-hauls or trucks being parked at the lcoatino for an extensive amount of time
Items being removed or added to the property.

Of course there are numberous other signs of “foul play” when it comes to these situations. But a strong neighborhood can help thwart crooks from the start.Similar Posts:

Dear Mr. and Mrs. Home Seller,

Can you please explain the “shown by appointment” rider on your real estate sign to me please?

I’m assuming it has to be something that translates back to pre-2006 when the market was hot. But even then, were there so many buyers that they were lining up at your door.

However, it’s now 2012 …

Don’t take this the wrong way, but at best you have 2.5 square feet and at worst your have 1 square feet of space on those riders to get bonus information across to those passing your home. Unless you are located at an interesection with a stop-light you’ve got cars going by 25- to 55- miles per hour and you are grabbing attention on a 6×24 or 6×30 placard.

And you’ve chosen to spend those precious seconds telling buyers that you only want to deal with them if they have an appointment. Which, get thems to ask the question “why do they feel the need to put that?”

And when buyers ask questions about your home before they look at it, you are giving them a chance to eliminate the home before they even get an appointment set.Similar Posts:

What did you do for Memorial Day?

The beach at Delaware Lake State Park was a popular location this Memorial Day - that felt more like the Fourth of July.

We spent the day with Mom at Delaware Lake State Park before heading back to the house for a cook out.

Since the temperature was more like the Fourth of July then Memorial Day, we celebrated as such, by swimming at the lake. The water was warmer than I expected for this time of year and really was a great way to get away from the stress of home and enjoy the peace that comes with the beach. And of course, when you smell someone grilling those burgers — it makes you hungry as can be.

We however headed back to the house to enjoy some fish – including a Trout we picked up at Earth Fare during a recent visit – and it has been a wonderful day.

Hopefully you’ve had a wonderful weekend celebrating those that gave all for our freedoms.

Delaware, Ohio, to host a free recycling event on Saturday, June 2, at that Council for Older Adults from 10 a.m. until 3 p.m.

: Delaware, Ohio, to host a community recycle event on June 2 at the Council for Older Adults on in southern Delaware, Ohio.

The event will give Delaware County residents the opportunity to clean out those garages, bedrooms, and basements and properly dispose of residential and commercial waste. Even better is that Goodwill Industrieswill also be on site to accept clothing and household items can be turned around to assist the community.

There will be a $15 charge for televisions but everything else will be free, however no appliances with Freon will be accepted.

The event is sponsored by the Delaware Gazette, Delaware Rotary, Council for Older Adults, Delaware Area Chamber of Commerce, and Accurate It Services.

There are numerous events taking place around Delaware County on this Memorial Day weekend.

Memorial Day weekend is the unofficial start of summer and a chance for Americans to honor those that made it possible for this great nation to be what it is.

It is extremely hard to figure out where the tradition began but General John Logan in May 1865 was among the first to put out a call for nationalization of America’s war dead.

Delaware County continues that tradition this year with many communities continuing the tradition honoring those that have given their life for the American cause.

We cherish too, the Poppy red
That grows on fields where valor led,
It seems to signal to the skies
That blood of heroes never dies.

City Art Center will host a Red Panty Workshop on Saturday, June 9, from 10 a.m. until 5 p.m. at its location in Delaware, Ohio.

Despite its name, the event is less about Victoria Secrets and more about learning how to reuse recycled materials. Participants will create new items of clothing, culminating at the end of the day with a runway show. Students will learn how to evaluate finds at thrift stores to make the most efficient use of materials available with the least amount of waste.

The plan of the day includes:

Red Panty Workshop will bring its recycling talents to Delaware, Ohio's City Art Center on June 9, 2012.

10 a.m., report to the City Art Center. Overview of various of technique for re-using and recycling clothing including fabric choices, patterns, tips for deconstructing and sewing.
11 a.m., visit to local thrift stores to choose raw for individual projects
Noon, Lunch plus deconstruction and preparation of thrifted materials.
1 p.m., participants work on constructing projects.
5 p.m., participants finish projection and run way presentation ends the day.

Participants should have a basic knowledge of sewing and using a sewing a machine but help will be available for those that might be a bit rusty. The supply list includes bringing $5-10 cash to spend at the thrift store, sewing machine (if available), scissors, straight pins, measuring tape, ruler, paper, pen, pencil, and your own sack lunch. If you have a particular project in mind bring the pattern.

Muslin, patterning paper, thread, buttonw, elastic will be available for purchase from the instructor at a reasonable cost.

Cost of the workshop is $100 per person and to register send your check along with a note card including your Name, e-mail, phone number, and whether you will bring a sewing machine or not; to Tammy Wallace at 26 N. Union Street in Delaware, Ohio 43015.

The Ohio Machine opened up its home portion of the 2012 Major League Lacrosse schedule with an major league win – both on the field and off at Delaware, Ohio’s historic Selby Field.

The Machine won the game on the field 16-10 over the Rochester Rattlers but possibly the biggest win for the team was drawing 6,126 fansto opening night and keeping the crowd rocking with some amazing play by the whole team.

: Exhibitors and visitors shop beneath the legendary Bun’s sign in historic Delaware, Ohio during the 39th annual Delaware Arts Festival.

The 39th annual Delaware Arts Festival will continue today throughout downtown Delaware, Ohio.

There are over 170 exhibits and expectations are that 10,000 people will pass through those booths through Saturday and Sunday — and we were among them on Saturday morning.

The fun will continue today with the “legendary” pet parade which has an entry fee (sorry, Toby thinks it is $5 but can’t find it anywhere to confirm) but that money is a fund raiser for Delaware County animal rescues.

Events at Delaware Arts Festival on Sunday

11 am – 12:15 pm: Buckeye Valley Alumni Band
12:30 – 2 pm: Rusty Strings
2 pm: Pet Parade (Meet at the PNC Bank parking lot at 1:30 pm and walk around the Festival)

3:45 – 5 pm: One Ear

Don’t forget the annual Friends of the Delaware County District Library book sale taking place today from Noon until 5 p.m. at the Library’s Main Branch on East Winter Street only one block east of the Delaware Arts Festival’s main vendors.

: More than 10,000 people are expected to visit downtown Delaware, Ohio, for the 39th annual Delaware Arts Festival and its 170 vendors between yesterday and today.

The event is located along Sandusky Street from Central Avenue (State Route 37) south to William Street (State Route 36) and east and west along Winter Street “basically” from Franklin to Union Street. However, the public parking lot behind 1808 American Bistroon East Winter Street is open for public parking (but good luck!).

We found the best parking spot to be South Union Street in a lot that would normally be reserved for St. Mary’s Cathlic Church and reserved for those donating $5 to one of Delaware County’s Relay for Life teams. A cause that both Gretchen and I are very proud to support — and when we can do so and not have to walk so far … double bonus! (With this morning being Sunday, lot may not be available for parking until after St. Mary’s services are complete.)

When you are closing a transaction, there will normally be a $45 (or so) fee for a title search – and that can be very important as this Phoenix woman found out recently.

Clarina Bayliss purchased the building adjacent to the house she lived in until losing it to the bank. However, when she lost her home to foreclosure she moved into the building believing it was a single-family residence until the city of Phoenix notified her that the house was in fact was a garage.

What is a Title Search?

In short, it is basically where the title company – in the process of providing title insurance – will do a diligent search of the title to make sure that there are no claims against the title.

Would they have found this situation exactly?

Well, that depends on the contract and how the deal is written, etc. However, in Central Ohio the Columbus Board of REALTORS utilizes different contracts for different types of properties and a garage – which would either be considered as improved vacant land or commercial land would be on a different contract than residential real estate purchase contract. The property being listed as “x” by the city and listed as “y” on the contract should attract a red-flag by someone in the search.

But It Really Isn’t For That…

No matter what you think it is good to have a title company review the title of any property you are purchasing for possible issues.

Honestly, how often would you look at the “building” she bought and say that looks like a house?

Where the title search comes in very-handy is in making sure all the previous owner’s debts against the property have been satisfied and paid. In today’s economy of short sales and foreclosures this is a very important detail to make sure is handled.

An example…

You are buying a short sale and assume that because the first and second lender’s have been satisfied then all the lien holders have been satisfied. Well not so fast … there could be:

Contractor Liens
Unpaid Home Owner Association Dues
Outstanding Water & Sewer Bills
Tax Liens

And depending on the type of deed you receive at closing you may be on the hook for most – if not all – of these expenses. So next time you balk at a title search, remember the headache it could be saving you.

Delaware, Ohio’s single-family real estate market has shown signs of improvement over the past several months and in April those signs exploded into numerous blooms after March showers.

The real estate market in Delaware, Ohio, is on the up-tick. Inventory is currently down to 6.49 months which is neutral in terms of being classified as buyer’s vs. seller’s market. Another great sign is that nearly 47% of the properties on the market either were in contract or sold during the month of April.

: Delaware, Ohio in contract home sales are above the six-month average showing signs the market price may soon improve. Sold-6 is sales in last six months; sold-apr homes sold in April; finInsp are homes contingent financing and inspections; esc are homes Contingent Escape; lien are homes Contingent Lien Release; UC are homes that are Under Contract. Sure Sales Are Back But What About Price

In April, well … no. But, we have a little nugget of positive news on that front as well. Over the past six months, the average home that’s sold in Delaware was for $88.57 per square foot. In April, 77 homes went in contract contingent upon finance and inspections at $99.70 per foot. That’s a great big jump and as the chart shows it is happening across the board, with the exception to under contract listings, to homes in contract. Delaware, Ohio should be in the $100 per foot neighborhood in May and above that in June and July.

Condominium Market Remains Soft

As the single-family market in Delaware, Ohio, has seen signs of regaining its strength the condominium market remains extremely soft with more than 17 months of inventory currently on the market.

That 17 months of inventory creates an extreme buyer’s market in the Delaware, Ohio, condominium market and it also shows in the number of homes currently in contract where only18.6 percent of the inventory wasn’t active in April.

In April, four condominiums sold at the average price of $110,975 or $81.99 per square foot after being listed for $118,225 or $87.64. That sold price is 13.1 percent lower than the average price for the 57 active listings at $92.71 per square foot ($139,900).Similar Posts:
