<p>You consult your Uber and Lyft apps, but the wait is going to be extensive. Your mind logically travels to your 16-year-old, who has a valid learnerâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s permit.</p>
<p>You reflect on all the interrupted sleep they caused you, the nights spent worrying when they were sick, and all the homework you helped with after dinner. You start to think about your kid as a responsible young person, someone who is capable and aware, and you ask yourself the question: <em>Surely, they can drive us home safely? What could be the harm?</em></p>
<p>&nbsp;</p>
<p><strong>Â A Legal Gray Area for Supervisor Drivers in California </strong></p>
<p>Teenage drivers can have absolutely no alcohol or drug in their systems while they are driving because they are under the legal age of majority. Additionally, if driving a vehicle with passengers, they must be supervised by a licensed parent, guardian, or other adult over the age of 25. But can you, the adult, be drunk while in the passengerâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s seat?</p>

<p>â€œAlthough there is no specific law against mom or dad being dead drunk with a teenage driver at the wheel, police take a pretty dim view of the practice, and say that in the case of an accident they would try to find a way to file charges against the supervising adult,â€ <a href="https://www.latimes.com/archives/la-xpm-2004-jan-21-hy-wheels21-story.html">according to a 2004 Los Angeles Times article</a>.</p>

<p>But why the legal murkiness, particularly in population-concentrated states like California and New York?</p>

<p><strong>Buzard Family Tragedy in New York Leads to â€œAbbagailâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s Lawâ€ </strong></p>
<p><strong>Â </strong></p>
<p>A proposed New York bill titled <em>Abbagailâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s Law</em> prohibits â€œsupervising drivers from acting under the influence of alcohol and/or drugs and subjects them to criminal charges,â€ <a href="https://www.nysenate.gov/legislation/bills/2017/S373">according to The new York State Senate</a>. Despite repeated attempts, the bill has never passed the Assembly.</p>
<p>â€œThe history of the bill goes back to 2009, after an intoxicated man â€¦ convinced his 17-year-old cousin to drive with a learnerâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s permit to the store to get more alcohol. Two children were put into car seats in the backseat, and his 8-year-old [Abbbagail] was seated on the lap of a 14-year-old,â€ according to Rochester First.</p>
<p>The teenage driver was speeding and lost control of the vehicle, causing Abbagail to be thrown from the vehicle. She then became trapped underneath it, as it rolled down an embankment.</p>
<p>&nbsp;</p>
<p>The bill argued that Abbagailâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s dad should have faced harsher legal penalties from the case.</p>
<p>The case forced the issue into the national spotlight and spurred discussion and legislation, although that legislation has stalemated in many states, including California and New York.</p>

<p>For many Americans, Independence Day is synonymous with indulgence, <a href="https://wallethub.com/blog/4th-of-july-facts/22075">including eating 150 million hotdogs and spending a whopping $3 billion on beer and wine</a>. Combine over $3 billion in alcoholic drinks with the number of people who decided to travel over 50 miles from home for a celebration: 50.7 million, and itâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s a recipe for trouble.</p>
<p>Unfortunately, not everyone was able to find a designated driver, cab, Uber, or Lyft in Southern California when they needed one this past holiday weekend.</p>
<p>And the California Highway Patrol (â€œCHPâ€) and police departments were out in force, focusing on distracted, reckless, or drunk driving in a <a href="https://www.bing.com/ck/a?!&amp;&amp;p=2fe1e1f6668ffdd2JmltdHM9MTY4OTEyMDAwMCZpZ3VpZD0xYzdjYmIyMy1lNTNjLTZkMTUtMjc2Ny1hOWFkZTEzYzYzMzQmaW5zaWQ9NTU5Mg&amp;ptn=3&amp;hsh=3&amp;fclid=1c7cbb23-e53c-6d15-2767-a9ade13c6334&amp;psq=fourth+of+july+dui+data+for+2023+california&amp;u=a1aHR0cHM6Ly93d3cubXNuLmNvbS9lbi11cy9uZXdzL3VzL2NocC1zLWZvdXJ0aC1vZi1qdWx5LW1heGltdW0tZW5mb3JjZW1lbnQtY2FtcGFpZ24tYmVnaW5zLWZyaWRheS9hci1BQTFkZFV1cA&amp;ntb=1">weekend long â€œmaximum enforcementâ€ campaign</a>.</p>
<p>As a result, drunk driving accidents and charges were in abundance this holiday season â€“ more so than has been the trend from recent years.</p>
<p>&nbsp;</p>
<h2><strong>July is the Most Dangerous Month for Car Travel </strong></h2>
<p>Over the four-day weekend, the CHP arrested 1,224 people for driving under the influence on California roads and highways, <a href="https://www.abc10.com/article/news/crime/fourth-of-july-weekend-california-dui-and-deaths/103-3a31ac1b-99cb-47d6-b83e-d816c04f8ab5">according to ABC 10</a>. What does that number of statewide California 4<sup>th</sup> of July DUIs mean? It means that more people were arrested for DUI and drug DUI this year than the agency arrested in the past two years.</p>
<p>When the increase of travelers crowd the highways for social engagements, and possibly some who have had a few too many drinks, the Fourth of July weekend earns the distinction of one of the most dangerous times to be on the road.</p>
<p>This has resulted in many newspapers and websites trying to help drivers discover the safest and best time to travel for the Fourth of July holiday.</p>
<p>&#8220;July Fourth is a holiday where people are off work, out of school, and they may be celebrating with alcohol,&#8221; Russ Rader, the senior vice president of communications at the Insurance Institute for Highway Safety (â€œIIHSâ€) told Today. &#8220;And alcohol use sharply increases the risk of crashes.&#8221;</p>
<p>This makes July one of the most dangerous months to be on the road, with more people dying in drunk driving crashes than any other month of the year, according to Today.</p>
<p>Nearly 70 people died in car crashes over the 4<sup>th</sup> of July holiday weekend across California, according to ABC 10.</p>
<p>The â€œNational Highway Traffic Safety Association found that between 2007 and 2011, 40 percent of all the highway deaths that occurred were the result of drunk drivers over the Fourth of July weekend. July 3rd was also in the list of the top 10 deadliest days to be on the roads because of drivers being under the influence,â€ <a href="https://alcohol.org/statistics-information/holiday-binge-drinking/">according to alcohol.org</a>.</p>
<p>The IIHS notes that car crashes taking place on or during the Independence Day holiday claim an average of 118.4 lives every year, particularly since binge drinking around the Fourth of July makes the occasion â€œone of the most consistently deadly days of the year.â€ The organization emphasizes that this increased risk not only applies to those who drive drunk, but also other drivers and pedestrians.</p>
<p>&nbsp;</p>
<p>This rise in DUI arrests this year is concerning to the CHP, Officer Mike Salas told MSN. Therefore, the CHP is currently focusing on educating people that even one drink can put others, yourself, and your freedom to drive at risk.</p>
<p>&nbsp;</p>
<h3><strong>Tragedy in Oceanside</strong></h3>
<p>Itâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s sometimes hard to believe that tragedies can occur in our own backyards, but unfortunately one did occur here in Southern California this 4<sup>th</sup>.</p>
<p>A 20-year-old Camp Pendleton Marine, Edward Minot Jr. with the 1<sup>st</sup> Maintenance Battalion, <a href="https://www.nbcsandiego.com/news/local/camp-pendleton-marine-involved-in-oceanside-crash-that-killed-12-year-old/3259255/#:~:text=A%20Camp%20Pendleton%20Marine%20was%20arrested%20on%20suspicion,of%20July%2C%20the%20U.S.%20Marine%20Corps%20confirmed%20Thursday.">was arrested on suspicion of driving under the influence and vehicular manslaughter</a> that killed 12-year-old Santiago Gaspar in Oceanside on the 4<sup>th</sup> of July.</p>
<p>The two-car crash that took place around 11 p.m. on Surfrider Way and North Myers Street occurred shortly after Oceanside Police attempted to pull over Minot, who was driving without headlights on. He failed to stop, instead speeding up to a high rate of speed before striking the vehicle within which Gaspar, his six-year-old brother, and an adult driver were in. The driver and Gasparâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s brother were taken to the hospital with non-life-threatening injuries.</p>
<p>One woman who lives near the crash site said the accident sounded like a bomb. Minot, who suffered non-life-threatening injuries was placed under arrest at the hospital.</p>
<p>While the investigation is ongoing, police suspect alcohol and speed factored into the crash.</p>

<p>â€œFrom an evolutionary perspective, early humans had to form social groups to hunt, gather food, protect each other and survive. As a result, we have evolved tendencies to support group cohesion by conforming to group norms and shunning non-conformity,â€ he writes. So, if we tend to associate with people who are like us and engage in similar behaviours, and we start doing things in a way that goes against the group norms, such as not drinking in a social situation, this can be a challenge to the acceptability of that behaviour in the group.â€</p>
<p>A seismic shift in habits/behavior will challenge relationships, even ones initially perceived as strong.</p>
<p>People who experience a DUI arrest often suffer from depression and self-esteem/self-loathing issues in the following weeks and months. They may begin to pull away from social situations, partly due to transportation difficulties, likely not wanting to be tempted by social drinking or drugs, and also because of social isolation from dealing with the depression and guilt.</p>
<p>Chances are high that your friend who has experienced a DUI arrest will lose friends, and as a result will feel lonely. Show them that you value them and be willing to transcend old social patterns to help your relationship evolve, and to support them during a difficult time. In other words, be a true friend to them. 										<content:encoded><![CDATA[<h1><strong>Windsor Hills Crash Suspect Nicole Linton Charged with Murder, Lawyers Argue She Had a Seizure</strong></h1>
<p>Anyone who saw the gas station surveillance video from the fiery car crash in Los Angeles, California on August 4, 2022, likely hasnâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />t forgotten it. But was there more than meets the eye with this crash?</p>
<p>&nbsp;</p>
<p>On August 4, 2022, thirty-seven-year-old Nicole Linton, a traveling nurse from Texas blew through the intersection of La Brea and Slauson Avenues. Her Mercedes-Benz subsequently burst into flames, leaving active fire burning down the pavement and billowing smoke.</p>
<p>Six people died from the high-speed collision, including an eleven-month-old and an unborn baby. Eleven additional people were injured.</p>
<p>Linton survived the crash and was charged by the Los Angeles County District Attorney with six counts of murder and five counts of gross vehicular manslaughter, <a href="https://www.latimes.com/california/story/2022-08-08/mercedes-driver-charged-with-murder-in-windsor-hills-crash">according to the Los Angeles Times</a>.</p>
<p>She faces life in prison if convicted of all charges, according to Times reporting.</p>
<p>Such severe charges are typically reserved for DUI offenders who have been convicted of a DUI offense and have taken DUI education classes.</p>
<p>Some news outlets reported that Linton was under the influence of alcohol, hinting at a California DUI; however, Los Angeles County Dist. Atty. George GascÃ³n said shortly after charges were made that there was no evidence of alcohol in her system.</p>
<p>The District Attorneyâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s office is building its case against Linton around her previous dangerous driving behaviors, particularly after the California Highway Patrol investigators discovered she was involved in thirteen prior crashes.</p>
<p>Prosecutors are citing that with her history of dangerous crashes, she should have been aware of the hazards and repercussions of reckless driving.</p>
<p>&nbsp;</p>
<h2><strong>Linton Denied Bail </strong></h2>
<p>A Los Angeles judge denied a motion to let her out of the cityâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s Twin Towers Correctional Facility and allow her to be treated in a psychiatric hospital. She remains in custody and under a â€œno bailâ€ hold.</p>
<p>â€œWe are disappointed with the judgeâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s ruling,â€Â her attorney Jacqueline Sparagna said at the time, <a href="https://nypost.com/2022/09/12/nurse-nicole-linton-denied-bail-in-fatal-los-angeles-car-crash-case/">according to the New York Post</a>. â€œWe believe that a psychiatric lock-down hospitalâ€” where Nicole would not have been able to simply walk outâ€” is the most appropriate place for her to remain pending this case.Â Thereâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s no question here that this is a mental illness-related car accident, and she should be housed at a psychiatric facility where she can receive treatment and undergo the testing necessary to determine what actually happened.â€</p>
<p>&nbsp;</p>
<p>Prosecutors said data shows Linton floored her car for at least five seconds before reaching the intersection, reaching speeds of 122-130 mph.</p>
<p>&nbsp;</p>
<p>The Times obtained motions and attachments filed by Lintonâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s defense attorneys that cite a â€œfrighteningâ€ mental health crisis in the time before the crash. The attorneys also detailed her four-year struggle with bipolar disorder and unwillingness to continue bipolar medication after an online therapist told her she simply had anxiety.</p>
<p>After quitting her medications cold turkey and not sleeping for days, they say, she had a deteriorating mental health crisis that resulted in the crash.</p>
<p>â€œShe has no recollection of the events that led to her collision,â€ wrote Doctor William Winter on Aug. 6. Winter treated Linton at the Ronald Reagan UCLA Medical Center, according to The Times.</p>
<p>&nbsp;</p>
<h2><strong>At the Crux of the Legal Argument </strong></h2>
<p>â€œLintonâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s attorneys argued in their Aug. 29 bail motion the nurse lost consciousness as she drove her Mercedes into several cars, triggered by her bipolar disorder or a seizure,â€ according to the New York Post. â€œThey asked that Linton be released with conditions so that she could be evaluated at the UCLA Resnick Neuropsychiatric Hospital.â€Â </p>
<p>Meanwhile, prosecutors argued a psychiatric evaluation showed no indication of a seizure and reported that the vehicleâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s data and surveillance video showed that she had â€œcomplete control over steering.â€</p>
<p>â€œThis NASCAR-worthy performance flies in the face of the notion that she was unconscious or incapacitated,â€ they added in a motion.</p>
<h2><strong>Pushing the Defense at the Preliminary Hearing </strong></h2>
<p>In an atypical move, Lintonâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s defense attorneys are planning to call a neurologist who specializes in epilepsy and seizures at the preliminary hearing.</p>
<p>Sparagna, Lintonâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s defense attorney, noted her clientâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s history of mental health issues and said she has had seizures in the past. The witness, she said, is a leading expert in seizures and epilepsy.</p>
<p>â€œEverything the doctor has reviewed is consistent with her having a seizure. People who fall asleep at the wheel go limp, but if they have a seizure, everything tenses up. This is consistent with why her foot was on the pedal,â€ she said, <a href="https://www.newsbreak.com/los-angeles-ca/2967837526064-nurse-nicole-linton-charged-with-killing-six-in-130mph-crash-froze-at-wheel-lawyer">according to a recent article in the New York Post.</a></p>
<p>Linton pleaded not guilty to six counts of murder and five counts of vehicular manslaughter. Her preliminary hearing is scheduled for April 17.</p>

<p>Offering obvious and direct help/advice can contribute to your friend feeling helpless in the situation. In other words, if the advice you offer is too take-charge it may make them feel like they are incapable of handling things on their own.</p>
<p>â€œInÂ <a href="https://psycnet.apa.org/record/2007-02840-006">research</a>, people who received obvious and visible social support â€“ rather than subtle, invisible social support â€“ felt more stressed about an upcoming negative event,â€ Kalokerinos writes. A better approach is to ask your friend what they want, how they might be able to reshape the situation, and listen attentively as they discuss their options. This places you in the position of a sounding board, something everyone needs when they are going through a stressful event.</p>
<p>Your goal should be to facilitate your friendâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s decisions, not dominate them.</p>

<p>Validating-and-reframing is an evidence-backed approach that helps stop the spiral of rumination.</p>
<p>It is equally important to consider a strategy of support that is appropriate to the situation. Some researchers are exploring how the most effective way of giving support may be dependent upon who, where, and when regarding the situation.</p>
<p><strong>Consider the personality (and self-esteem) of the person youâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />re helping:</strong> People with lower levels of self-esteem are often more responsive to emotional support that validates their experiences, according to a series of studies conducted at the University of Waterloo. These studies revealed that people with lower self-esteem â€œbenefited less from reframing and other forms of cognitive social support.â€</p>
<p>â€œPeople with lower self-esteem found this reframing cognitive support less helpful, and the people who provided the support felt worse about the interaction, themselves and their friendships more broadly,â€ she writes.</p>
<p>These findings suggest that it is vital to carefully consider your friendâ€<img src="https://s.w.org/images/core/emoji/14.0.0/72x72/2122.png" alt="™" class="wp-smiley" style="height: 1em; max-height: 1em;" />s personality and their preferences when you provide support.</p>
<p><strong>Consider culture, too, when providing support</strong>:</p>
<p>Some families and cultures are more comfortable with more direct support, whereas others appreciate more subtle actions. According to Kalokerinos, cross-cultural studies between European, Asian and Asian American, and the Latino cultures in the US show varying levels of willingness to both ask for and to be receptive of support: bottom line, different cultures often have different dynamics.</p>
<p><strong>Consider when: Online or in-person </strong></p>
<p>People have grown skeptical of interactions based in the digital world, but this can still be incredibly effective, particularly with the younger generations and especially with young people who have limited support in-person.</p>
<p>â€œIndeed,Â <a href="https://psycnet.apa.org/fulltext/2020-71594-001.html">studies</a>Â with young adults have found that support received digitally (e.g., through messages and video calls) was just as helpful as face-to-face support,â€ Kalokerinos writes. If digital support is readily available, as is often the case, then it is worth using, she notes, explaining that the strategies she has shared are equally applicable in the digital world and can be helpful in supporting friends from afar.</p>
<p>The great news from all these recent studies that she discusses is that there is an opportunity for everyone to be a better friend and family member. Challenging times are growth opportunities for the person struggling, and for those striving to support them. So much of life is the continual process of learning; the willingness to humble yourself and discover a new and better path. However, determining which plea is in your best interest depends on many factors.
